			<paragraph commented="no" display-inline="no-display-inline" id="id1A5E5397BC944DE78395D4069D3618E0"><enum>(1)</enum><header>Appropriate

			 congressional committees</header><text>The term <term>appropriate congressional

			 committees</term> means the Committee on Homeland Security and Governmental

			 Affairs of the Senate and the Committee on Homeland Security of the House of

			 Representatives.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBF5E43103BED4C44A35E640D958473E9"><enum>(2)</enum><header>Border</header><text>The

			 term <term>border</term> means the international border between the United

			 States and Canada and between the United States and Mexico.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB41A2311E98043D7A274932320F16385"><enum>(3)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of Homeland Security.</text>

			</paragraph></section><title id="idFC68B1812E8247AEB979D6C34120C9FF"><enum>I</enum><header>Border

			 Security</header>

			<section id="id9BDFF2D9149743609D36909AE5FAA618"><enum>101.</enum><header>Personnel</header>

				<subsection id="id9EB3E062DC814D3EBBBB1DE0E137E5BA"><enum>(a)</enum><header>CBP

			 agents</header><text>In addition to the positions authorized under section 5202

			 of the Intelligence Reform and Terrorism Prevention Act of 2004 (Public Law

			 108–458), in each of fiscal years 2007 through 2011, the Secretary shall

			 increase by not less than 1,500 the number of positions for full-time,

			 active-duty agents within the Bureau of Customs and Border Protection.</text>

				</subsection><subsection id="id50A5A9A5EC3E49DA9707BE75EBDCD217"><enum>(b)</enum><header>ICE

			 agents</header><text>In addition to the positions authorized under section 5203

			 of the Intelligence Reform and Terrorism Prevention Act of 2004 (Public Law

			 108–458), in each of fiscal years 2007 through 2011, the Secretary shall

			 increase by not less than 1,500 the number of positions for full-time,

			 active-duty agents within the Bureau of Immigration and Customs

			 Enforcement.</text>

				</subsection><subsection id="idC642F6217E01438CBB075681C6910FAB"><enum>(c)</enum><header>Employment of

			 retired law enforcement officers</header>

					<paragraph id="id7646307466CA43FB802F9BBBB2EC2C2E"><enum>(1)</enum><header>Study</header><text>The

			 Secretary shall conduct a study of the feasibility of hiring, on a part-time

			 basis, retired Federal law enforcement officers to supplement the capabilities

			 of the Bureau of Customs and Border Protection and the Bureau of Immigration

			 and Customs Enforcement.</text>

					</paragraph><paragraph id="idEA2EB2DD36CC42BB82878F93EDF97DD7"><enum>(2)</enum><header>Report</header><text>Not

			 later than 180 days after the date of enactment of this Act, the Secretary

			 shall submit a report, in classified form, if necessary, to the appropriate

			 congressional committees. The report shall include—</text>

						<subparagraph id="idEA09B7356B0B47A097DE6638BD18FAE9"><enum>(A)</enum><text>the results of

			 the study conducted under paragraph (1); and</text>

						</subparagraph><subparagraph id="id3A0276DF57B1417C9A3B6C45BF7076BE"><enum>(B)</enum><text>a plan to

			 implement a program that employs retired Federal law enforcement officers for

			 border security, if the Secretary determines that such plan is feasible.</text>

						</subparagraph></paragraph><paragraph id="idF6F65D1058D74A2BAD62C8E02F7E8EEF"><enum>(3)</enum><header>Implementation</header><text>If

			 the Secretary determines that the plan described in paragraph (2)(B) is

			 feasible, the Secretary shall implement the plan not later than 90 days after

			 the submission of the report to Congress under paragraph (2).</text>

					</paragraph></subsection><subsection id="id1DF3AF1E94EA41EF9A123DD6BB3F07AB"><enum>(d)</enum><header>Recruitment and

			 retention program</header>

					<paragraph id="id08376E5A10D94CC59DC48E95A051680F"><enum>(1)</enum><header>Implementation</header><text>The

			 Secretary shall conduct a 5-year program to facilitate the recruitment and

			 retention of agents within the Bureau of Customs and Border Protection and the

			 Bureau of Immigration and Customs Enforcement.</text>

					</paragraph><paragraph id="id7D020563C6DC454B9BB565E008D937EA"><enum>(2)</enum><header>Report</header><text>Not

			 less frequently than once every 90 days during the 5-year period of the program

			 authorized under paragraph (1), the Secretary shall submit a report on the

			 results and progress of the program, in classified form, if necessary, to the

			 appropriate congressional committees.</text>

					</paragraph></subsection><subsection id="id4B3AA68F56B844988E5F753249E7DC4A"><enum>(e)</enum><header>Other

			 personnel</header><text>In each of fiscal years 2007 through 2011, the

			 Secretary and the Attorney General shall increase, to the extent determined

			 necessary by the Secretary and the Attorney General, the number of—</text>

					<paragraph id="idC74DB32FDEFF46D993AEA87123DD5AE9"><enum>(1)</enum><text>Department of

			 Homeland Security personnel, including attorneys, who have responsibilities

			 involving illegal aliens or immigration issues;</text>

					</paragraph><paragraph id="id0C4D51D4D03F43FAAE65D36C330C0DB5"><enum>(2)</enum><text>attorneys

			 participating in the Federal Defenders Program;</text>

					</paragraph><paragraph id="idF6154D7105D147F587B28B5F20FD2944"><enum>(3)</enum><text>attorneys in

			 United States Attorneys’ Offices;</text>

					</paragraph><paragraph id="id2A34EFFF53CD4D83A0F8EC8536831521"><enum>(4)</enum><text>attorneys in the

			 Office of Immigration Litigation;</text>

					</paragraph><paragraph id="idF0065A84AB67484E8271C936F5E1E6AD"><enum>(5)</enum><text>deputy marshals

			 in the United States Marshals Service; and</text>

					</paragraph><paragraph id="idE0CA7E7FBEF64894A60B6E7E6E8B62BB"><enum>(6)</enum><text>immigration

			 judges.</text>

					</paragraph></subsection><subsection id="idB2EF24AB8D394D0081DF7F39D83FCB04"><enum>(f)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated for

			 each of fiscal years 2007 through 2011 such sums as may be necessary to carry

			 out this section.</text>

				</subsection></section><section id="idD22CFA8EBEE3494B93F9A4E50803BC43"><enum>102.</enum><header>Federal Law

			 Enforcement Training Center</header>

				<subsection id="idE194B8EE282546289EBA9A86A0B47258"><enum>(a)</enum><header>Infrastructure

			 improvements</header><text>The Secretary shall make necessary improvements to

			 the following law enforcement training facilities:</text>

					<paragraph id="id52FA1A1F82384FFC8A8DB5B491433A9C"><enum>(1)</enum><text>The Federal Law

			 Enforcement Training Center in Glynco, Georgia.</text>

					</paragraph><paragraph id="id3BDDD191E1E343549A4BFADA3BADBEE3"><enum>(2)</enum><text>The residential

			 training sites located in Artesia, New Mexico and Charleston, South

			 Carolina.</text>

					</paragraph><paragraph id="id43A4899B60AD4BA3BD135AF5CE187F25"><enum>(3)</enum><text>The inservice

			 requalification training facility located in Cheltenham, Maryland.</text>

					</paragraph></subsection><subsection id="idE4B847983A684E66A6B485287963EBE7"><enum>(b)</enum><header>Training

			 enhancements</header><text>The Secretary shall improve the training of agents

			 within the Bureau of Customs and Border Protection and the Bureau of

			 Immigration and Customs Enforcement and other personnel in the Department of

			 Homeland Security with similar responsibilities. Such improvements shall

			 include—</text>

					<paragraph id="id5C925698DE7048679BEF3A792257D1CF"><enum>(1)</enum><text>the acquisition

			 of appropriate training aids;</text>

					</paragraph><paragraph id="id9CA95972C0814640B5D23E23B14A2D23"><enum>(2)</enum><text>hiring qualified

			 instructors; and</text>

					</paragraph><paragraph id="idDEC4CDFDB98A4A908C09348CB157D2AA"><enum>(3)</enum><text>instruction on

			 fraudulent document detection.</text>

					</paragraph></subsection></section><section id="id3948173E4F4347DAAF6FE01416288F75"><enum>103.</enum><header>Interagency

			 asset sharing</header>

				<subsection id="id10BDA65B77DB4BD082FD3FBD8ECB1B34"><enum>(a)</enum><header>Study</header><text>The

			 Secretary, in consultation with the Secretary of Defense, shall conduct a study

			 of the feasibility of using National Guard personnel and assets of the

			 Department of Defense, including all terrain vehicles and unmanned aerial

			 vehicles, to assist the Bureau of Customs and Border Protection.</text>

				</subsection><subsection id="idEF74F55B71D748E49AD311190782C6F2"><enum>(b)</enum><header>Report</header>

					<paragraph id="idF16051C50AB1434BA96C56375C6C5563"><enum>(1)</enum><header>In

			 general</header><text>Not later than 90 days after the date of the enactment of

			 this Act, the Secretary shall submit a report, in classified form, if

			 necessary, to the appropriate congressional committees.</text>

					</paragraph><paragraph id="idCF10FE0A3C3D41B3A3CF4F72588FAFB0"><enum>(2)</enum><header>Contents</header><text>The

			 report submitted under paragraph (1) shall include—</text>

						<subparagraph id="id046BFA15D7014BDFA65059D6CA1CD2E7"><enum>(A)</enum><text>the results of

			 the study conducted under subsection (a); and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80C9A64271354B6B9E856E4953CF5F00"><enum>(B)</enum><text>a plan to

			 implement a program that employs retired Federal law enforcement officers for

			 border security, if the Secretary determines that such plan is feasible.</text>

						</subparagraph></paragraph></subsection><subsection id="id30A524033FCB4FED9DF081BFDCAE8DD7"><enum>(c)</enum><header>Implementation</header><text>If

			 the Secretary determines that the plan described in subsection (b)(2)(B) is

			 feasible, the Secretary shall implement the plan not later than 90 days after

			 the submission of the report to Congress under subsection (b).</text>

				</subsection></section><section id="id98C8B9F874124A16BA892EDD437F7BD3"><enum>104.</enum><header>Technology and

			 Infrastructure</header>

				<subsection id="id404029645023455A90FD965632ED7895"><enum>(a)</enum><header>Technologies</header><text>Not

			 later than 90 days after the date of enactment of this Act, the Secretary shall

			 submit a report, in classified form if necessary, to the appropriate

			 congressional committees. The report shall contain a plan to utilize new and

			 existing technologies to assist the Bureau of Customs and Border Protection and

			 the Bureau of Immigration and Customs Enforcement in securing the

			 border.</text>

				</subsection><subsection id="id330AEF5C47504FB091F853A9BEBB79EA"><enum>(b)</enum><header>Border

			 wall</header>

					<paragraph id="id8E6921B52B3E4A509A109D9DA4FDD9D8"><enum>(1)</enum><header>In

			 general</header><text>Not later than 90 days after the date of enactment of

			 this Act, the Secretary shall initiate a process for planning, constructing,

			 and maintaining a permanent barrier, fence, or wall in appropriate areas along

			 the border.</text>

					</paragraph><paragraph id="id98349E324CE14B0384C287943D002B79"><enum>(2)</enum><header>Report</header><text>Not

			 less frequently than once every 90 days, the Secretary shall submit a report,

			 in a classified form if necessary, to the appropriate congressional committees

			 on the progress made in carrying out paragraph (1).</text>

					</paragraph></subsection><subsection id="id424ACE91D19041D1865D31A3BA4C26D1"><enum>(c)</enum><header>Detention

			 facilities</header>

					<paragraph id="id8A60B3E0CE754DB0975E9960B2EE559E"><enum>(1)</enum><header>Construction</header><text>The

			 Attorney General shall plan, construct, maintain, and acquire additional

			 detention facilities for the purpose of immigration detention and

			 removal.</text>

					</paragraph><paragraph id="idECF0F58A45D24225808E49F7474A1AB8"><enum>(2)</enum><header>Use of closed

			 or unused military installations</header><text>The Secretary, in consultation

			 with the Secretary of Defense, shall conduct a study of the feasibility of

			 using military installations designated for closure or realignment as possible

			 immigration detention centers.</text>

					</paragraph></subsection><subsection id="idC5B758B7E2A64BC9BF7375810E57EF64"><enum>(d)</enum><header>Ports of

			 entry</header>

					<paragraph id="idA576CA0B2B7049C29A92F4AD5F105C15"><enum>(1)</enum><header>Infrastructure

			 report</header><text>The Administrator of General Services shall submit an

			 annual report to Congress that—</text>

						<subparagraph id="id7467887A439442A380B2B1879BA96F84"><enum>(A)</enum><text>describes the

			 status of the infrastructure at ports of entry into the United States;

			 and</text>

						</subparagraph><subparagraph id="idFE3D651476354D71B25D11BD133014D1"><enum>(B)</enum><text>identifies

			 projects to improve security at such ports of entry.</text>

						</subparagraph></paragraph><paragraph id="id35FF932AEC3848FF8537D4950FAD4849"><enum>(2)</enum><header>Vulnerability

			 report</header><text>Not less frequently than once every 6 months, the

			 Secretary shall submit a report, in classified form if necessary, to the

			 appropriate congressional committees on vulnerabilities at ports of entry into

			 the United States.</text>

					</paragraph><paragraph id="id6D51DF970C1A4C64AE5D187F81DCA508"><enum>(3)</enum><header>Demonstration

			 programs</header><text>The Secretary shall establish demonstration programs to

			 evaluate and assess border security and port of entry technologies.</text>

					</paragraph></subsection><subsection id="idBEA3A4B04C864B72A103AEDF97EC133F"><enum>(e)</enum><header>Access

			 roads</header><text>The Secretary is authorized to plan, construct, and

			 maintain necessary access roads to secure the border.</text>

				</subsection><subsection id="id140CA7E630554688B593BD7F21A0F876"><enum>(f)</enum><header>Unmanned aerial

			 vehicles and associated infrastructure</header><text>The Secretary shall

			 acquire and maintain unmanned aerial vehicles for use on the border, including

			 related equipment such as—</text>

					<paragraph id="id75DE7AD50E06439B86A9EF0CD0253620"><enum>(1)</enum><text>additional

			 sensors;</text>

					</paragraph><paragraph id="id2B87DCD8F6424C45B6774426BC6F1481"><enum>(2)</enum><text>critical

			 spares;</text>

					</paragraph><paragraph id="id92141DBF9D574B74A032AF3246855476"><enum>(3)</enum><text>satellite command

			 and control; and</text>

					</paragraph><paragraph id="id442CBD8D5A534DEDA693D879879A2D62"><enum>(4)</enum><text>other necessary

			 equipment for operational support.</text>

					</paragraph></subsection><subsection id="id1DB3BD1EA790459B8A55AD16409B6265"><enum>(g)</enum><header>Acquisition of

			 additional assets</header><text>The Secretary shall—</text>

					<paragraph id="id839ACD367C604CB2BC8C4FEBE4BD7A91"><enum>(1)</enum><text>plan, construct,

			 and maintain new and existing permanent and temporary checkpoints on the

			 border; and</text>

					</paragraph><paragraph id="id328CCBDA04D94520BC6E62B8032914BD"><enum>(2)</enum><text>acquire and

			 maintain physical assets necessary to secure the border, including—</text>

						<subparagraph id="idC11404EA433048F6AA59EC65F9253458"><enum>(A)</enum><text>all terrain

			 vehicles;</text>

						</subparagraph><subparagraph id="id85D63BC7F5D1407583A1A75FC88B055B"><enum>(B)</enum><text>police

			 vehicles;</text>

						</subparagraph><subparagraph id="id7E134D1A2C1849EC840DE1DE3A3DD904"><enum>(C)</enum><text>aircraft,

			 including helicopters;</text>

						</subparagraph><subparagraph id="idB7F8C00CEEE7458FADA754961D314764"><enum>(D)</enum><text>interoperable

			 communications equipment;</text>

						</subparagraph><subparagraph id="idCDA71CF4E4724385BDEA8A75DF4ABD20"><enum>(E)</enum><text>firearms;</text>

						</subparagraph><subparagraph id="id141E106E61C0470C982384CB27F147F9"><enum>(F)</enum><text>sensors;</text>

						</subparagraph><subparagraph id="id1DF8BF481AF94150BF52E14AF2F7354A"><enum>(G)</enum><text>cameras;</text>

						</subparagraph><subparagraph id="id5236BC756E1A4992A8E2B8FDFA7C0918"><enum>(H)</enum><text>lighting;

			 and</text>

						</subparagraph><subparagraph id="idE6EEF4D53BB14013BBA16832F3F159D6"><enum>(I)</enum><text>such other

			 equipment, technologies, and other assets necessary to secure the

			 border.</text>

						</subparagraph></paragraph></subsection><subsection id="idEA11104AF573470D9D76E3C50BF52F29"><enum>(h)</enum><header>Authorization

			 of appropriations</header>

					<paragraph id="id24F000CCCA0F4AC4BD3874E3D3116FE9"><enum>(1)</enum><header>In

			 general</header><text>There are authorized to be appropriated for each of

			 fiscal years 2007 through 2011—</text>

						<subparagraph id="idB21921DF508545A592A664A2C217E3BA"><enum>(A)</enum><text>such sums as may

			 be necessary to carry out subsection (b);</text>

						</subparagraph><subparagraph id="id3A7783897A414C52815D75B3FD1ED644"><enum>(B)</enum><text>such sums as may

			 be necessary to carry out subsection (c);</text>

						</subparagraph><subparagraph id="id4899CE9E6D824B0EB875EAD3D11D00A9"><enum>(C)</enum><text>$150,000,000 to

			 be used by the Secretary to plan, construct, maintain, and implement

			 improvement projects identified under subsection (d)(1)(B);</text>

						</subparagraph><subparagraph id="id99C54FF2D3B34D3C870A111F110B7D2E"><enum>(D)</enum><text>$25,000,000 to

			 carry out subsection (d)(3); and</text>

						</subparagraph><subparagraph id="id583C6777713E42698468EF34FD56F036"><enum>(E)</enum><text>$1,000,000,000 to

			 carry out subsection (g).</text>

						</subparagraph></paragraph><paragraph id="idA7107BECFA674D83AA15A036944F455C"><enum>(2)</enum><header>Unmanned aerial

			 vehicles</header><text>There are authorized to be appropriated to the

			 Department of Homeland Security to carry out subsection (f)—</text>

						<subparagraph id="id01B149DD218E404099DFAD4620FAC6D1"><enum>(A)</enum><text>$178,400,000 for

			 fiscal year 2007; and</text>

						</subparagraph><subparagraph id="id1D377A24F4B748BC937E1BF0F6C55DC1"><enum>(B)</enum><text>$276,000,000 for

			 each of fiscal years 2008 and 2009.</text>

						</subparagraph></paragraph></subsection></section><section id="idCE73C9E1B5A64515AA3754701C7CD98F"><enum>105.</enum><header>State and

			 local grants</header>

				<subsection id="id6A0176FDD14A4533B498D6B68403B068"><enum>(a)</enum><header>Grants

			 authorized</header><text>The Secretary shall award competitive grants to

			 eligible State, local, and tribal law enforcement agencies to provide financial

			 assistance for costs related to border security activities, including efforts

			 to combat criminal activity within the jurisdiction of such agencies.</text>

				</subsection><subsection id="id829DF361209C4E5E9BCD299FB4DA23B8"><enum>(b)</enum><header>Use of

			 funds</header><text>Grants awarded under this section shall be used to provide

			 additional resources for law enforcement agencies to combat criminal activity

			 occurring near the border, including—</text>

					<paragraph id="idB523316AEE3C42A7B93E341F6FBB7E0F"><enum>(1)</enum><text>law enforcement

			 technologies;</text>

					</paragraph><paragraph id="idCF40C85B48A84703B0C98F7718FD9865"><enum>(2)</enum><text>equipment, such

			 as police-type vehicles, all-terrain vehicles, firearms, sensors, cameras, and

			 lighting, and maintenance for such equipment;</text>

					</paragraph><paragraph id="idDB5D468397C246AFB5552A825C134EED"><enum>(3)</enum><text>computer

			 equipment; and</text>

					</paragraph><paragraph id="id6CD6A241FEF7408A9C95060C2B01BE67"><enum>(4)</enum><text>such other

			 resources that may be available to assist the law enforcement agency with

			 border security.</text>

					</paragraph></subsection><subsection id="id3A71BD96F2A8480B950D3EB43D24789B"><enum>(c)</enum><header>Application</header><text>A

			 law enforcement agency desiring a grant under this section shall submit an

			 application to the Secretary at such time, in such manner, and containing such

			 information as the Secretary may require.</text>

				</subsection><subsection id="idEE3CD3F1D60947168098D75DB94844F3"><enum>(d)</enum><header>Selection

			 criteria</header><text>In selecting grant recipients under this section, the

			 Secretary shall give priority to applicants providing law enforcement for

			 jurisdictions that—</text>

					<paragraph id="id52A575844E504337851B265A97413B3B"><enum>(1)</enum><text>are close to the

			 border;</text>

					</paragraph><paragraph id="idF3E7320859FA4D898FEC9AB2D584C86E"><enum>(2)</enum><text>have small

			 populations;</text>

					</paragraph><paragraph id="idBE280BEF95F947DB9F7F6012927B0BA5"><enum>(3)</enum><text>have more felony

			 criminal cases filed per United States district court judge;</text>

					</paragraph><paragraph id="id598E509958E84E96975262ED9FC35BE2"><enum>(4)</enum><text>are located in

			 States with more undocumented aliens, based on the most recent decennial

			 census; or</text>

					</paragraph><paragraph id="idA397194F8C9C419CB2CD292617643843"><enum>(5)</enum><text>are located in

			 States with more undocumented alien apprehensions in the most recent fiscal

			 year.</text>

					</paragraph></subsection></section></title><title id="id1081CD9F87214CB6B3F0C88CFB4E7CEE"><enum>II</enum><header>Agricultural

			 Workers</header>

			 title</header><text>This section may be cited as the <quote><short-title>Wage Equity Act of 2006</short-title></quote>.</text>

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1188(a)">8 U.S.C.

				agricultural workers in the occupation in the area of intended employment,

									</clause><clause commented="no" display-inline="no-display-inline" id="ID8923E47F6CFB44B7B3FE00160000E77E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the greater of—</text>

										<subclause commented="no" display-inline="no-display-inline" id="id732F06BFE4E44250B1762349D2FF42E1"><enum>(I)</enum><text display-inline="yes-display-inline">the hourly wage described in section

				6(a)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206(a)(1)">29 U.S.C. 206(a)(1)</external-xref>);

				or</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="id35158AB8EE5644949BC80E0D275A975A"><enum>(II)</enum><text display-inline="yes-display-inline">the applicable State minimum wage.</text>

										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0F097ACDFE814FFA8E6C348611D70948" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In complying with subparagraph (A)(i), an

				employer (or the employer’s agent) may request and obtain a prevailing wage

				determination from the State employment security agency. An employer who

				obtains such a determination and pays the wage determined to be prevailing

				shall be considered to have met the requirement of subparagraph (A)(i).</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID316B1A9834BF4D68935EEA00515000D3" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">In lieu of the procedure described in

				subparagraph (B), an employer may rely on other wage information, including a

				survey of the prevailing wages of workers in the occupation in the area of

				intended employment that has been conducted or funded by the employer or a

				group of employers, that meets criteria specified by the Secretary of Labor in

				regulations.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF39AE5424D51493C8B965068F1F51D57" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">If the prevailing wage described in

				subparagraph (A)(i) is an hourly wage, the employer may pay workers in the

				occupation by an incentive method of pay such as a piece rate, task rate, group

				incentive rate, or other incentive method, if the average hourly earnings of

				the employer’s workers paid by such incentive method, taken as a group, are at

				least equal to the prevailing hourly wage required by subparagraph (A)(i) for

				the hours worked at the incentive payment method, after making any additions to

				any worker’s pay required to comply subparagraph

				(A)(ii).</text>

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD8D73FEE841B4D4689C42E23927ECE3B"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="INA/218(i)">Section 218(i)</external-xref> of the

				</subsection></section><section commented="no" display-inline="no-display-inline" id="id4637B895880E453987B83A24AC03D1BD"><enum>202.</enum><header>Extension of

			 preemption to required construction of day laborer shelters</header><text display-inline="no-display-inline">Section 274A(h)(2) of the Immigration and

			 Nationality Act (8 U.S.C. 1324a(h)(2)) is amended to read as follows:</text>

				<quoted-block display-inline="no-display-inline" id="id6C33E8F86D7C46BCB41F2B36C157AABC" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="idEB2ADA510CA7420B852E97DB07D5CF90"><enum>(2)</enum><header>Preemption</header><text display-inline="yes-display-inline">This section preempts any State or local

				law that—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id68DCB83928424DDE98133722DE82E24F"><enum>(A)</enum><text display-inline="yes-display-inline">imposes civil or criminal sanctions (other

				than through licensing and similar laws) upon those who employ, or recruit or

				refer for employment (for a fee), unauthorized aliens; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8F7D897D225349BD8DD452931D87046C"><enum>(B)</enum><text>requires, as a

				condition of conducting, continuing, or expanding a business, that a business

				entity—</text>

							<clause commented="no" display-inline="no-display-inline" id="idBD06BC20DC434D4092E510F027878D0C"><enum>(i)</enum><text>provide, build,

				fund, or maintain a shelter, structure, or designated area for use by day

				laborers at or near its place of business; or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idB5601828D28445AAABB986EC9689EE03"><enum>(ii)</enum><text>take other steps

				to facilitate the employment of day laborers by

				others.</text>

							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 criminal penalties for alien smuggling</header><text display-inline="no-display-inline">Section 274(a) of the Immigration and

				penalties for certain crimes committed by illegal aliens</header>

								<subsection id="IDbd4ca37a2c76462989dc3c82592241a5"><enum>(a)</enum><text>Any alien

				unlawfully present in the United States, who commits, or conspires or attempts

				to commit, a crime of violence or a drug trafficking offense (as defined in

				section 924), shall be fined under this title and sentenced to not less than 5

				years in prison.</text>

								</subsection><subsection id="ID0ef446b8f2d54e8a88214b0358fbbf52"><enum>(b)</enum><text>If an alien who

				violates subsection (a) was previously ordered removed under the Immigration

				and Nationality Act (8 U.S.C. 1101 et seq.) on the grounds of having committed

				a crime, the alien shall be sentenced to not less than 15 years in

				prison.</text>

								</subsection><subsection id="ID2c07f64c7b5f48f78a8ae1cb8f298dc4"><enum>(c)</enum><text>A sentence of

				imprisonment imposed under this section shall run consecutively to any other

				sentence of imprisonment imposed for any other

				crime.</text>

								</subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>

			 237(a)(2) of the Immigration and Nationality Act (8 U.S.C. 1227(a)(2)) is

			 amended by adding at the end the following:</text>

			 penalties</header>

				<subsection id="idB4C3E7891DA6466F9E900BAE7A5B6918"><enum>(a)</enum><header>In

			 general</header><text>Section 218A of the Immigration and Nationality Act, as

			 added by section 402, is amended by adding at the end the following:</text>

						<subsection id="id90F7BE37852B4B82A48DD3E1E6592553"><enum>(f)</enum><header>Penalties</header>

				workers</header><text>A guest worker who violates any of the terms described in

				subsection (d) shall be subject to deportation and shall be ineligible to

				receive a nonimmigrant visa under this section.</text>

							</paragraph><paragraph id="idBEC82EADDFC84224A84C34F138C47570"><enum>(2)</enum><header>Employers</header>

								<subparagraph id="id14C58A266E6749B5AFD658278B3D1143"><enum>(A)</enum><header>Notification of

				violation</header><text>An employer who fails to notify the Secretary of

				Homeland Security after discovering that a guest worker has violated any of the

				terms described in subsection (d) shall be ineligible to employ any alien in

				possession of a nonimmigrant visa issued under section.</text>

								</subparagraph><subparagraph id="id7DD71D4223D8483EB257C4555B9BC99B"><enum>(B)</enum><header>Employment of

				illegal workers</header><text>Any employer who knowingly employs a worker in

				the United States who is not authorized to work in the United States shall be

				subject to—</text>

									<clause id="id7C31FA1BFC014D6991BE98BBB2615835"><enum>(i)</enum><text>for the first

				violation, a civil penalty in an amount not to exceed $25,000; and</text>

									</clause><clause id="id3C6FC554F152414380CEB6BD0D6DD04B"><enum>(ii)</enum><text>for the second

				or subsequent violation—</text>

										<subclause id="idBCE02F884F764392A321EC47F22359DC"><enum>(I)</enum><text>a term of

				imprisonment not to exceed 2 years for the individual who hired the

				unauthorized worker; and</text>

										</subclause><subclause id="id7EFD7EB6DFAC48A1B65AE9DEB9D6D568"><enum>(II)</enum><text>disqualification

				of the employer from further participation in the guest worker program

				authorized under this

				section.</text>

										</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="id55254C81738543A488FEE64193495A2A"><enum>(b)</enum><header>Effective

			 date</header><text>The amendment made by subsection (a) shall take effect on

			 the date which is 2 years after the date of the enactment of this Act.</text>

				</subsection></section></title><title id="idA9B58CD7FA764B9AA1A11E1E43582693"><enum>IV</enum><header>Removal and

			 violation tracking</header>

			<section id="ID5057dd4929ad4efcaead11a393bf8745"><enum>401.</enum><header>Institutional

			 removal program</header>

				<subsection id="ID878df5dc6476487ca9e96443fdb0db6e"><enum>(a)</enum><header>Institutional

			 removal program</header>

					<paragraph id="IDed1007e534354423a6f435f120e8f9c4"><enum>(1)</enum><header>Continuation</header><text>The

			 Secretary shall continue to operate the Institutional Removal Program of the

			 Department of Homeland Security to—</text>

						<subparagraph id="IDcd6426d498984fa7a5738e6cb553e490"><enum>(A)</enum><text>identify

			 removable criminal aliens in Federal and State correctional facilities;</text>

						</subparagraph><subparagraph id="IDb012288077fb481a8dd2fc2e23fc6ebf"><enum>(B)</enum><text>ensure that such

			 aliens are not released into the community; and</text>

						</subparagraph><subparagraph id="ID9490ebb962854b188b4c2d1e1fb3f814"><enum>(C)</enum><text>remove such

			 aliens from the United States after the completion of their sentences.</text>

						</subparagraph></paragraph><paragraph id="ID620844ba85dc444db9659b5963e15b13"><enum>(2)</enum><header>Expansion</header><text>Not

			 later than 5 years after the date of the enactment of this Act, the Secretary

			 shall expand the Institutional Removal Program to every State.</text>

					</paragraph><paragraph id="id8396B58886DA4C39870B3AD0EFC87A1E"><enum>(3)</enum><header>State

			 participation</header><text>The appropriate officials of each State in which

			 the Secretary is operating the Institutional Removal Program should—</text>

						<subparagraph id="ID7d657a498d1844bb8503e09afe44985b"><enum>(A)</enum><text>cooperate with

			 Federal officials carrying out the Institutional Removal Program;</text>

						</subparagraph><subparagraph id="IDed8480194f8640949c9ccf206ffa1698"><enum>(B)</enum><text>expeditiously and

			 systematically identify criminal aliens in the prison and jail populations of

			 the State; and</text>

						</subparagraph><subparagraph id="ID7fc7c4d7164a452dbce4012be3306d4d"><enum>(C)</enum><text>promptly convey

			 the information described in subparagraph (B) to the appropriate officials

			 carrying out the Institutional Removal Program.</text>

						</subparagraph></paragraph></subsection><subsection id="IDfeea28ec85a747f98c2516d98d77f58d"><enum>(b)</enum><header>Report to

			 congress</header><text>Not later than 2 years after of the date of the

			 enactment of this Act, the Secretary shall submit a report to Congress on the

			 participation of the States in the Institutional Removal Program.</text>

				</subsection><subsection id="idB853DE6BB6D24BE08764A50A10492E76"><enum>(c)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated

			 $50,000,000 to carry out the expanded Institutional Removal Program authorized

			 under subsection (a).</text>

				</subsection></section><section id="ID5835546c3c0d47e3b979b96681bb4a91"><enum>402.</enum><header>Authorization

			 for detention after completion of state or local prison sentence</header>

				<subsection id="idE4475CFFA6CF4E74B1ABFC684C73DBFA"><enum>(a)</enum><header>In

			 general</header><text>Law enforcement officers of a State or political

			 subdivision of a State are authorized to—</text>

					<paragraph id="ID1ff3bd9da78e425dacaaa3f4a0818edc"><enum>(1)</enum><text>hold an illegal

			 alien for a period of up to 14 days after the alien has completed the alien's

			 State or local prison sentence in order to effectuate the transfer of the alien

			 to Federal custody when the alien is removable or not lawfully present in the

			 United States; or</text>

					</paragraph><paragraph id="IDba42fb1311514d91a5735d4e0e974f7d"><enum>(2)</enum><text>issue a detainer

			 that would allow aliens who have served a State or local prison sentence to be

			 detained by an appropriate prison until personnel from the Bureau of

			 Immigration and Customs Enforcement can take the alien into Federal

			 custody.</text>

					</paragraph></subsection><subsection id="id451CB20F8F5D4679AFF041C33597B7A3"><enum>(b)</enum><header>Reimbursement</header>

					<paragraph id="ID579e415898c14b58a7c47d423c5075b8"><enum>(1)</enum><header>In

			 general</header><text>The Secretary shall reimburse a State or a political

			 subdivision of a State for all reasonable expenses incurred by the State or the

			 political subdivision for the detention of an alien as described in subsection

			 (a).</text>

					</paragraph><paragraph id="id802618AED3C1480489A8DD57FDC1BF40"><enum>(2)</enum><header>Cost

			 computation</header><text>The amount of reimbursement provided for costs

			 incurred carrying out subsection (a) shall be determined pursuant to a formula

			 determined by the Secretary.</text>

					</paragraph></subsection><subsection id="idCB3E005E724A40C0835928624DDEB568"><enum>(c)</enum><header>Technology

			 usage</header><text>Technology, such as videoconferencing, shall be used to the

			 maximum extent possible to make the Institutional Removal Program available in

			 remote locations. Mobile access to Federal databases of aliens and live scan

			 technology shall be used to the maximum extent practicable to make these

			 resources available to State and local law enforcement agencies in remote

			 locations.</text>

				</subsection><subsection id="ID8547bca23f4142d7bd7bda34135a4e77"><enum>(d)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated such sums as may be necessary to reimburse a

			 State or political subdivision of a State for the detention of an illegal alien

			 pursuant to subsection (b).</text>

				</subsection></section><section id="IDb288734cf3584ccc948dcfbb87e8c6f3"><enum>403.</enum><header>Use of the

			 National Crime Information Center Database to track violations of immigration

			 law</header>

				<subsection id="id62DB149ABFBA4FDDACD6ED60E8FBDF79"><enum>(a)</enum><header>Provision of

			 Information to the National Crime Information Center</header>

					<paragraph id="IDdaafb5117df6488bb65b7bac04aa3204"><enum>(1)</enum><header>In

			 general</header><text>Not later than 1 year after the date of the enactment of

			 this Act, the Secretary shall provide the National Crime Information Center of

			 the Department of Justice with such information as the Director may have

			 related to—</text>

						<subparagraph id="IDcdcc34b4cc174e5b88342d50aed56227"><enum>(A)</enum><text>any alien against

			 whom a final order of removal has been issued;</text>

						</subparagraph><subparagraph id="IDeb7dfb3749bc4093958fef22de5c5dcc"><enum>(B)</enum><text>any alien who is

			 subject to a voluntary departure agreement that has become invalid under

			 section 240B(a)(2) of the Immigration and Nationality Act (8 U.S.C. 1229c);

			 and</text>

						</subparagraph><subparagraph id="IDa75f295119304cc9b48e077aafe87140"><enum>(C)</enum><text>any alien whose

			 visa has been revoked.</text>

						</subparagraph></paragraph><paragraph id="ID737b1c0d0c634e69aec415a1f6db162e"><enum>(2)</enum><header>Requirement to

			 provide and use information</header><text>The information described in

			 paragraph (1) shall be provided to the National Crime Information Center, and

			 the Center shall enter the information into the Immigration Violators File of

			 the National Crime Information Center database if the name and date of birth

			 are available for the individual, regardless of whether the alien received

			 notice of a final order of removal or the alien has already been

			 removed.</text>

					</paragraph><paragraph id="IDba18fa69b9454333b6a1b82c56a13a1e"><enum>(3)</enum><header>Removal of

			 information</header><text>If an individual is granted cancellation of removal

			 under section 240A of the Immigration and Nationality Act (8 U.S.C. 1229b), or

			 granted permission to legally enter the United States pursuant to such Act

			 after a voluntary departure under section 240B of such Act (8 U.S.C. 1229c),

			 information entered into the National Crime Information Center under paragraph

			 (1) shall be promptly removed.</text>

					</paragraph></subsection><subsection id="IDad8c7a6585eb46d385ba6677f1df10f5"><enum>(b)</enum><header>Inclusion of

			 information in the National Crime Information Center

			 Database</header><text>Section 534(a) of title 28, United States Code, is

			 amended—</text>

					<paragraph id="ID92e8233093a64138b9521c15006782b1"><enum>(1)</enum><text>in paragraph (3),

			 by striking <quote>and</quote> at the end;</text>

					</paragraph><paragraph id="IDa3a0694f2761483b9d57c12a4111bc96"><enum>(2)</enum><text>by redesignating

			 paragraph (4) as paragraph (5); and</text>

					</paragraph><paragraph id="ID5afc60b729b84484900bb2f1c0bddad4"><enum>(3)</enum><text>by inserting

			 after paragraph (3) the following:</text>

						<quoted-block display-inline="no-display-inline" id="idA05EA1066B084968BCF2E2A5F71C86FB" style="OLC">

							<paragraph id="ID07ada486f6a545dca5bdb2fbcf22a91c"><enum>(4)</enum><text>acquire, collect,

				classify, and preserve records of violations of the immigration laws of the

				United States, regardless of whether the alien has received notice of the

				violation or the alien has already been removed;

				and</text>

							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
