		<section id="id43541F275B6F413799499878C5363D14" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>National Infrastructure Improvement

			 Act of 2006</short-title></quote>.</text>

		</section><section id="IDF0978D183F6149A280DA6263F79ABA90"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="IDBE73ED1E9E4D4946B9D81DA4B2AD6F77"><enum>(1)</enum><header>Acquisition</header><text>The

			 term <term>acquisition</term> includes the addition of land, sites, equipment,

			 structures, facilities, or rolling stock by purchase, lease-purchase, trade, or

			 donation.</text>

			</paragraph><paragraph id="ID46E7869B488745179B2DD2B3CA79EBFB"><enum>(2)</enum><header>Commission</header><text>The

			 term <term>Commission</term> means the National Commission on the

			 Infrastructure of the United States established by section 3(a).</text>

			</paragraph><paragraph id="IDEF5CF8A5790C41DFAE9B4EF962521DF9"><enum>(3)</enum><header>Construction</header><text>The

			 term <term>construction</term> means—</text>

				<subparagraph id="ID0FD57B202CDC454F9A94D2E2E2F32BD5"><enum>(A)</enum><text>the design,

			 planning, and erection of new infrastructure;</text>

				</subparagraph><subparagraph id="ID75DB5E03388E4AD1B0E54DE7EE927850"><enum>(B)</enum><text>the expansion of

			 existing infrastructure;</text>

				</subparagraph><subparagraph id="ID95A78A57B27F44A3A0E1CBD859677087"><enum>(C)</enum><text>the

			 reconstruction of an infrastructure project at an existing site; and</text>

				</subparagraph><subparagraph id="IDDC670C9F034247528B4B872EDDE03C03"><enum>(D)</enum><text>the installation

			 of initial or replacement infrastructure equipment.</text>

				</subparagraph></paragraph><paragraph id="ID421F9E80C5624BB79ABA76843D7F6F7B"><enum>(4)</enum><header>Infrastructure</header>

				<subparagraph id="IDDD1DE6383FA64C03B6E86B7818F28601"><enum>(A)</enum><header>In

			 general</header><text>The term <term>infrastructure</term> means a nonmilitary

			 structure or facility and equipment associated with that structure or

			 facility.</text>

				</subparagraph><subparagraph id="IDA4958334F0AC4F0AB8A31E9CAD8E4388"><enum>(B)</enum><header>Inclusions</header><text>The

			 term <term>infrastructure</term> includes—</text>

					<clause id="ID88DDC4C7F5344E0C8F86628B9DE166CB"><enum>(i)</enum><text>a

			 surface transportation facility (such as a road, bridge, highway, public

			 transportation facility, and freight and passenger rail), as the Commission, in

			 consultation with the National Surface Transportation Policy and Revenue Study

			 Commission established by section 1909(b)(1) of the Safe, Accountable,

			 Flexible, Efficient Transportation Equity Act: A Legacy for Users (Public Law

			 109–59; 119 Stat. 1471), determines to be appropriate;</text>

					</clause><clause id="ID76AFAB3424294D16A77418C8664F429A"><enum>(ii)</enum><text>a

			 mass transit facility;</text>

					</clause><clause id="ID7A5B8214342D468CA913DA640E32A198"><enum>(iii)</enum><text>an airport or

			 airway facility;</text>

					</clause><clause id="IDBCC32FD31EFC47EFB137E684B1657215"><enum>(iv)</enum><text>a

			 resource recovery facility;</text>

					</clause><clause id="ID41A8B393CD784035A45A5F1783082124"><enum>(v)</enum><text>a

			 water supply and distribution system;</text>

					</clause><clause id="ID2B0067004CDE44A18EB1A5F334262157"><enum>(vi)</enum><text>a

			 wastewater collection, treatment, and related facility;</text>

					</clause><clause id="IDC4AF143DAE1E4648814BC565B6C28C38"><enum>(vii)</enum><text>waterways,

			 locks, and dams;</text>

					</clause><clause id="idE4166B3170B24D52A2A9776594C1C743"><enum>(viii)</enum><text>a levee and

			 any related flood-control facility;</text>

					</clause><clause id="ID6165C0603CB44C46919B423B22C6C5D0"><enum>(ix)</enum><text>a

			 dock or port; and</text>

					</clause><clause id="ID5F364B165D724737952517C69017A2E4"><enum>(x)</enum><text>a

			 solid waste disposal facility.</text>

					</clause></subparagraph></paragraph><paragraph id="ID5ED0B5D65E464BA59C9035681386536A"><enum>(5)</enum><header>Maintenance</header><text>The

			 term <term>maintenance</term> means any regularly scheduled activity, such as a

			 routine repair, intended to ensure that infrastructure continues to operate

			 efficiently.</text>

			</paragraph><paragraph id="IDB3017FE2ACA44CECB04CBA6F274A1514"><enum>(6)</enum><header>Rehabilitation</header><text>The

			 term <term>rehabilitation</term> means—</text>

				<subparagraph id="IDBBC6CD78568D4B0BB87D01473BE4634A"><enum>(A)</enum><text>the correction of

			 a deficiency in existing infrastructure so as to extend the useful life or

			 improve the effectiveness of the infrastructure;</text>

				</subparagraph><subparagraph id="IDE0038925FCBE481D92EC384CB1D0BC14"><enum>(B)</enum><text>the modernization

			 or replacement of equipment of existing infrastructure; and</text>

				</subparagraph><subparagraph id="ID67164BA5E72A46939715510030A962FC"><enum>(C)</enum><text>the modernization

			 of, or replacement of parts for, rolling stock relating to

			 infrastructure.</text>

				</subparagraph></paragraph></section><section id="ID2AA45C43694A459F93E5F6DAC57B7CFF"><enum>3.</enum><header>Establishment of

			 Commission</header>

			<subsection id="ID6539DDA934D44867AF48FCDB5C21B6A4"><enum>(a)</enum><header>Establishment</header><text>There

			 is established a commission to be known as the <quote>National Commission on

			 the Infrastructure of the United States</quote> to ensure that the

			 infrastructure of the United States—</text>

				<paragraph id="ID69847C2F037A4D88A3B0FBE5967105C0"><enum>(1)</enum><text>meets current and

			 future demand; and</text>

				</paragraph><paragraph id="IDE4CCB664179C40139CBC3F222EA3E183"><enum>(2)</enum><text>facilitates

			 economic growth.</text>

				</paragraph></subsection><subsection id="IDC5E334A6D49A41E4865B804F1CE074E2"><enum>(b)</enum><header>Membership</header>

				<paragraph id="IDF3E9045724E7435CBD10DD239574DA2E"><enum>(1)</enum><header>Composition</header><text>The

			 Commission shall be composed of 7 members, of whom—</text>

					<subparagraph id="ID9E994A4668D4442883530678393DF35D"><enum>(A)</enum><text>3 members shall

			 be appointed by the President;</text>

					</subparagraph><subparagraph id="ID605B6C1CE39A4C5B854B1BAF97D0623D"><enum>(B)</enum><text>1 member shall be

			 appointed by the Speaker of the House of Representatives;</text>

					</subparagraph><subparagraph id="ID99C72DBD13024523B1DA4D2399E4DEA5"><enum>(C)</enum><text>1 member shall be

			 appointed by the minority leader of the House of Representatives;</text>

					</subparagraph><subparagraph id="ID83268AEBF7134166BD7382D096DD7AC5"><enum>(D)</enum><text>1 member shall be

			 appointed by the majority leader of the Senate; and</text>

					</subparagraph><subparagraph id="ID986098FC289845839DA76FB95E688B78"><enum>(E)</enum><text>1 member shall be

			 appointed by the minority leader of the Senate.</text>

					</subparagraph></paragraph><paragraph id="IDA3768E919A05481F92F1C78450532FC7"><enum>(2)</enum><header>Qualifications</header><text>Each

			 member of the Commission shall have experience in 1 or more of the fields of

			 economics, public administration, civil engineering, public works,

			 construction, and related design professions, planning, or public investment

			 financing.</text>

				</paragraph><paragraph id="ID0E6B475667CF498CBBCF4AA527541BDD"><enum>(3)</enum><header>Date of

			 appointments</header><text>The members of the Commission shall be appointed

			 under paragraph (1) not later than 90 days after the enactment of this

			 Act.</text>

				</paragraph></subsection><subsection id="ID63C215A270B44EC9B3B4AFBB48F66126"><enum>(c)</enum><header>Term;

			 Vacancies</header>

				<paragraph id="ID19027C203D6A4AEC93A63C65F9FA81B3"><enum>(1)</enum><header>Term</header><text>A

			 member shall be appointed for the life of the Commission.</text>

				</paragraph><paragraph id="IDECA827D626A24127B7AFE5C65D38C083"><enum>(2)</enum><header>Vacancies</header><text>A

			 vacancy in the Commission—</text>

					<subparagraph id="IDE46E2B3E9FC84F2BA4DD92E2E587BDEF"><enum>(A)</enum><text>shall not affect

			 the powers of the Commission; and</text>

					</subparagraph><subparagraph id="ID216E7205CD1349DB8922C0799FCB1ACF"><enum>(B)</enum><text>shall be filled,

			 not later than 30 days after the date on which the vacancy occurs, in the same

			 manner as the original appointment was made.</text>

					</subparagraph></paragraph></subsection><subsection id="IDBB2E960C9948499DB5F0994295281D4F"><enum>(d)</enum><header>Initial

			 Meeting</header><text>Not later than 30 days after the date on which all

			 members of the Commission have been appointed, the Commission shall hold the

			 initial meeting of the Commission.</text>

			</subsection><subsection id="ID9F85AEA798644025B27AC873D7B953E9"><enum>(e)</enum><header>Meetings</header><text>The

			 Commission shall meet at the call of the Chairperson or the majority of the

			 Commission members.</text>

			</subsection><subsection id="ID30071FAE55A947F183676CE436F46004"><enum>(f)</enum><header>Quorum</header><text>A

			 majority of the members of the Commission shall constitute a quorum, but a

			 lesser number of members may hold hearings.</text>

			</subsection><subsection id="IDAB02C777DCED4E7292B24273601157FE"><enum>(g)</enum><header>Chairperson and

			 Vice Chairperson</header><text>The Commission shall select a Chairperson and

			 Vice Chairperson from among the members of the Commission.</text>

			</subsection></section><section id="ID2B45478CB14E402F961DA977423DB67B"><enum>4.</enum><header>Duties</header>

			<subsection id="ID7700166FA79A44E999DBFCF74C35B13D"><enum>(a)</enum><header>Study</header>

				<paragraph id="IDFE97E5BC9E474D6CB769FAB70DB86199"><enum>(1)</enum><header>In

			 general</header><text>Not later than February 15, 2009, the Commission, in

			 consultation with the advisory group established by paragraph (3)(A), shall

			 complete a study of all matters relating to the state of the infrastructure of

			 the United States.</text>

				</paragraph><paragraph id="ID29975BBAC1C24CDAAB93379B3E54348B"><enum>(2)</enum><header>Matters to be

			 studied</header><text>In carrying out paragraph (1), the Commission shall study

			 such matters as—</text>

					<subparagraph id="ID8B59E382C7FB46189B6AEB4AFB0B6193"><enum>(A)</enum><text>the capacity of

			 infrastructure improvements to sustain current and anticipated economic

			 development and competitiveness, including long-term economic growth, and to

			 support a sustained and expanding economy;</text>

					</subparagraph><subparagraph id="ID6771775D99F94D1FA4478B83919CEDAF"><enum>(B)</enum><text>the age and

			 condition of public infrastructure (including congestion and changes in the

			 condition of that infrastructure as compared with preceding years);</text>

					</subparagraph><subparagraph id="ID611FA485165541288B994574AACC30D1"><enum>(C)</enum><text>the methods used

			 to finance the construction, acquisition, rehabilitation, and maintenance of

			 public works improvements (including general obligation bonds, tax-credit

			 bonds, revenue bonds, user fees, excise taxes, direct governmental assistance,

			 and private investment);</text>

					</subparagraph><subparagraph id="IDCE35B2E0809F44C2A64D4CA970C69400"><enum>(D)</enum><text>any trends or

			 innovations in methods used to finance that construction, acquisition,

			 rehabilitation, and maintenance;</text>

					</subparagraph><subparagraph id="ID70FEF0992F6C4CFDAAF862721A3F76BE"><enum>(E)</enum><text>investment

			 requirements, by type of facility, that are necessary to maintain the current

			 condition and performance of those facilities and the investment needed (as

			 adjusted for inflation and expressed in real dollars) to improve those

			 facilities in the future;</text>

					</subparagraph><subparagraph id="IDB598B68A45FD4AF48FEBD400BD932CF0"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="ID57E9C5A6FF264AAB8092B11CC391FBF9"><enum>(i)</enum><text>the projected share of

			 Federal, State, local, and other government levels of investment requirements

			 as identified in subparagraph (E); and</text>

						</clause><clause id="ID7FDDDB38BF794B89BF9099C0DB2D6357" indent="up1"><enum>(ii)</enum><text>the projected expenditure on

			 infrastructure facility improvements described in subparagraph (E) by each

			 level of government;</text>

						</clause></subparagraph><subparagraph id="ID62CB689A8FE740FD8A770953C77BB01D"><enum>(G)</enum><text>estimates of the

			 return to the economy from public works investment;</text>

					</subparagraph><subparagraph id="IDF159EEEF635D41A99A81BB583BCCE6AF"><enum>(H)</enum><text>any trends or

			 innovations in infrastructure procurement methods; and</text>

					</subparagraph><subparagraph id="ID4880DCBF7FA34175BB538D3BBCCBBA4C"><enum>(I)</enum><text>any trends or

			 innovations in construction methods or materials.</text>

					</subparagraph></paragraph><paragraph id="ID4930B283EC09481A8DA20DDA656C0F93"><enum>(3)</enum><header>Consultation</header>

					<subparagraph id="id834D173A7E3C42CCB0808F3FF45E2E4D"><enum>(A)</enum><header>Establishment</header><text>There

			 is established an advisory group to provide assistance and advice on request of

			 the Commission.</text>

					</subparagraph><subparagraph id="id94176C98A85344E695626A03BFE6C435"><enum>(B)</enum><header>Membership</header><text>The

			 advisory group shall be composed of—</text>

						<clause id="ID09085B7263A04A7E9D0617C0FD777A14"><enum>(i)</enum><text>the

			 Secretary of the Army;</text>

						</clause><clause id="IDEDC8747DF7154A24B21162586D4D8FDC"><enum>(ii)</enum><text>the Secretary of

			 Agriculture;</text>

						</clause><clause id="IDDDC92E0A7D394C78AD83CDEBD6C6ED10"><enum>(iii)</enum><text>the Secretary

			 of Transportation;</text>

						</clause><clause id="ID291B035133F544EA9A2129AF272B2E30"><enum>(iv)</enum><text>the

			 Administrator of the Environmental Protection Agency;</text>

						</clause><clause id="IDF55229730C9C410F8CACDC54DB5FC222"><enum>(v)</enum><text>the

			 Secretary of Commerce;</text>

						</clause><clause id="ID5883422F48474F4E8BC9336246F05244"><enum>(vi)</enum><text>the Secretary of

			 Education;</text>

						</clause><clause id="IDE1E8E93A369A4E7FA86E0D05F711AA1A"><enum>(vii)</enum><text>the Secretary

			 of Energy;</text>

						</clause><clause id="ID99B0750172D2410E8135DEAAEB9DBFE0"><enum>(viii)</enum><text>the Secretary

			 of the Treasury;</text>

						</clause><clause id="IDDE40D06F1829412FADBEE7C9BB91A0CF"><enum>(ix)</enum><text>the Secretary of

			 the Interior;</text>

						</clause><clause id="IDE938604804974E37A7363296C321C2E1"><enum>(x)</enum><text>the

			 Administrator of General Services;</text>

						</clause><clause id="id1DDDBFA39F6E4A0B9E3774FB3634CC56"><enum>(xi)</enum><text>the Director of

			 the Office of Management and Budget;</text>

						</clause><clause id="id336B80D6439D4860A5DD6474F54E5954"><enum>(xii)</enum><text>a

			 representative of the National Governors Association;</text>

						</clause><clause id="idCBF15937E71346AC8EF54AE668AE4C33"><enum>(xiii)</enum><text>a

			 representative of the National Association of Counties;</text>

						</clause><clause id="id461F616CAA044576B871D405C3BB4C0C"><enum>(xiv)</enum><text>a

			 representative of the United States Conference of Mayors; and</text>

						</clause><clause id="id1ABBF05D260643099D63EA3A12A8752E"><enum>(xv)</enum><text>a

			 representative of the National Conference of State Legislatures.</text>

						</clause></subparagraph><subparagraph id="idDD746A03B8604B75A09CCAFFF1446817"><enum>(C)</enum><header>Compensation</header><text>The

			 members of the advisory group shall serve without compensation.</text>

					</subparagraph><subparagraph id="id1B388FBBEE7144B089D9687AE7B625FB"><enum>(D)</enum><header>Termination</header><text>The

			 advisory group shall terminate on September 30, 2009.</text>

					</subparagraph></paragraph><paragraph id="ID5AFD36D8122C49F69982E317402BEB85"><enum>(4)</enum><header>Resources;

			 data</header><text>In carrying out paragraph (1), to the maximum extent

			 practicable, the Commission shall—</text>

					<subparagraph id="ID7A9A20A3304D40D2BD23F448A3D90ADA"><enum>(A)</enum><text>use existing

			 studies, data, sampling techniques, and reports of other commissions;

			 and</text>

					</subparagraph><subparagraph id="ID8E30AFA318D84D06848C08401F63E7DC"><enum>(B)</enum><text>if collecting new

			 data under this section, make every effort to ensure that the data is collected

			 in consultation with the States so as to ensure that uniform methods,

			 categories, and analyses are used.</text>

					</subparagraph></paragraph></subsection><subsection id="ID5B99EB4E62A74C9589F3E745538EE389"><enum>(b)</enum><header>Recommendations</header><text>The

			 Commission shall develop recommendations—</text>

				<paragraph id="IDCEE1A991524646F092DBA9F6171D6FE0"><enum>(1)</enum><text>on a Federal

			 infrastructure plan that will detail national infrastructure program

			 priorities, including alternative methods of meeting national infrastructure

			 investment needs to effectuate balanced growth and economic development;</text>

				</paragraph><paragraph id="IDD7E1ECCCABD1466FAAF7C0B955105491"><enum>(2)</enum><text>on public works

			 improvements and methods of delivering and providing for public work

			 facilities;</text>

				</paragraph><paragraph id="IDE228108C82FF4227920F84F1C7CDACF9"><enum>(3)</enum><text>for analysis or

			 criteria and procedures that may be used by Federal agencies and State and

			 local governments in—</text>

					<subparagraph id="IDA2C89391F1B946889AE609B6D9CE1D3F"><enum>(A)</enum><text>inventorying

			 existing and needed public works improvements;</text>

					</subparagraph><subparagraph id="ID408A6FC7FAAC467AA9C023A349CEED98"><enum>(B)</enum><text>assessing the

			 condition of public works improvements; and</text>

					</subparagraph><subparagraph id="IDAE49B6AD43A54955841FA23F234EE048"><enum>(C)</enum><text>developing

			 uniform criteria and procedures for use in conducting those inventories and

			 assessments; and</text>

					</subparagraph></paragraph><paragraph id="IDE5FF88DF2DDC4CF287CCE8463B37168F"><enum>(4)</enum><text>for proposed

			 guidelines for the uniform reporting, by Federal agencies, of construction,

			 acquisition, rehabilitation, and maintenance data with respect to

			 infrastructure improvements.</text>

				</paragraph></subsection><subsection id="ID142B630337A248398139F1B471024F24"><enum>(c)</enum><header>Statement and

			 Recommendations</header><text>Not later than February 15, 2009, the Commission

			 shall submit to Congress—</text>

				<paragraph id="ID1B4DD511046C47ADA8F3BFAA86E83324"><enum>(1)</enum><text>a detailed

			 statement of the findings and conclusions of the Commission; and</text>

				</paragraph><paragraph id="ID01F79DA920DF42E2B5316D082597B9BE"><enum>(2)</enum><text>the

			 recommendations of the Commission under subsection (b), including

			 recommendations for such legislation and administrative actions for 5-, 15-,

			 30-, and 50-year time periods as the Commission considers to be

			 appropriate.</text>

				</paragraph></subsection></section><section id="IDF47A5D9575DB476EBA2D2A8569994A34"><enum>5.</enum><header>Powers of the

			 Commission</header>

			<subsection id="ID8C6A31AAC6644FA3919629D4B4D1A511"><enum>(a)</enum><header>Hearings</header><text>The

			 Commission shall hold such hearings, meet and act at such times and places,

			 take such testimony, administer such oaths, and receive such evidence as the

			 Commission considers advisable to carry out this Act.</text>

			</subsection><subsection id="ID407F1C2FA3B04CEFA43951FB786A2E3B"><enum>(b)</enum><header>Information

			 From Federal Agencies</header>

				<paragraph id="ID7EE1189141974CD7B833AB310E9521C5"><enum>(1)</enum><header>In

			 general</header><text>The Commission may secure directly from a Federal agency

			 such information as the Commission considers necessary to carry out this

			 Act.</text>

				</paragraph><paragraph id="ID0FC883B43B074B8A8EBF377DC86C3AB0"><enum>(2)</enum><header>Provision of

			 information</header><text>On request of the Chairperson of the Commission, the

			 head of the Federal agency shall provide the information to the

			 Commission.</text>

				</paragraph></subsection><subsection id="ID074ACEB6F68D4B77AC4C54B1E049D895"><enum>(c)</enum><header>Gifts</header><text>The

			 Commission may accept, use, and dispose of gifts or donations of services or

			 property.</text>

			</subsection><subsection id="IDE5AC7A44E2DB4646B07507DC545B937D"><enum>(d)</enum><header>Contracts</header><text>The

			 Commission may enter into contracts with other entities, including contracts

			 under which 1 or more entities, with the guidance of the Commission, conduct

			 the study required under section 4(a).</text>

			</subsection><subsection id="ID429F5B06657E4BBB9D0E97661BF11DE5"><enum>(e)</enum><header>Postal

			 Services</header><text>The Commission may use the United States mails in the

			 same manner and under the same conditions as other agencies of the Federal

			 Government.</text>

			</subsection></section><section id="IDA084B63FCCBF4ECDB05EE9A604BBCE21"><enum>6.</enum><header>Commission

			 personnel matters</header>

			<subsection id="ID2E257DC476D54F9E959E67D98DFEFE6A"><enum>(a)</enum><header>Compensation of

			 Members</header><text>A member of the Commission shall serve without pay, but

			 shall be allowed a per diem allowance for travel expenses, at rates authorized

			 for an employee of an agency under subchapter I of chapter 57 of title 5,

			 United States Code, while away from the home or regular place of business of

			 the member in the performance of the duties of the Commission.</text>

			</subsection><subsection id="ID2399A065B0184C469AD96FF02B2454BE"><enum>(b)</enum><header>Staff</header>

				<paragraph id="IDCAC03FEF00694FE19676FE6DA36604AD"><enum>(1)</enum><header>In

			 general</header><text>The Chairperson of the Commission may, without regard to

			 the civil service laws, including regulations, appoint and terminate an

			 executive director and such other additional personnel as are necessary to

			 enable the Commission to perform the duties of the Commission.</text>

				</paragraph><paragraph id="ID112EB99ECD274B0CB696C86D73F25544"><enum>(2)</enum><header>Confirmation of

			 executive director</header><text>The employment of an executive director shall

			 be subject to confirmation by a majority of the members of the

			 Commission.</text>

				</paragraph><paragraph id="ID3FE04666D7484EC2A95C7E8CF2FAC588"><enum>(3)</enum><header>Compensation</header>

					<subparagraph id="IDFF7B72DC9F5F46A7901B9451A52D58D6"><enum>(A)</enum><header>In

			 general</header><text>Except as provided in subparagraph (B), the Chairperson

			 of the Commission may fix the compensation of the executive director and other

			 personnel without regard to the provisions of chapter 51 and subchapter III of

			 chapter 53 of title 5, United States Code, relating to classification of

			 positions and General Schedule pay rates.</text>

					</subparagraph><subparagraph id="ID4493CECFE56A4EBE9528DDDA0D49AD41"><enum>(B)</enum><header>Maximum rate of

			 pay</header><text>In no event shall any employee of the Commission (other than

			 the executive director) receive as compensation an amount in excess of the

			 maximum rate of pay for Executive Level IV under section 5315 of title 5,

			 United States Code.</text>

					</subparagraph></paragraph></subsection><subsection id="IDA59ACC749DF646239A315F63C1CDDFAC"><enum>(c)</enum><header>Detail of

			 Federal Government Employees</header>

				<paragraph id="IDB03FE83DE2CB45D6A1F5EE5C9B5B80D7"><enum>(1)</enum><header>In

			 general</header><text>An employee of the Federal Government may be detailed to

			 the Commission without reimbursement.</text>

				</paragraph><paragraph id="ID8149EED05B5345FB9702E0AF0815D24B"><enum>(2)</enum><header>Civil service

			 status</header><text>The detail of a Federal employee shall be without

			 interruption or loss of civil service status or privilege.</text>

				</paragraph></subsection><subsection id="ID99BB9E4B4C49460E91DFBCDECC55B8C6"><enum>(d)</enum><header>Procurement of

			 Temporary and Intermittent Services</header><text>On request of the Commission,

			 the Secretary of the Army, acting through the Chief of Engineers, shall

			 provide, on a reimbursable basis, such office space, supplies, equipment, and

			 other support services to the Commission and staff of the Commission as are

			 necessary for the Commission to carry out the duties of the Commission under

			 this Act.</text>

			</subsection></section><section id="ID196E8D9AC55248398D4A46467DC9B5EF"><enum>7.</enum><header>Congressional

			 Budget Office review</header><text display-inline="no-display-inline">Not later

			 than 90 days after the date on which the report under section 4(c) is submitted

			 to Congress by the Commission, the Congressional Budget Office shall review the

			 report and submit a report on the results of the review to the Committee on

			 Environment and Public Works and the Committee on Commerce, Science, and

			 Transportation of the Senate and the Committee on Transportation and

			 Infrastructure of the House of Representatives.</text>

		</section><section id="IDA79E6288EE194EA9988B7A9EB544404C"><enum>8.</enum><header>Funding</header>

			<subsection id="ID5CEF313B589A4319B7B8F1E4818CF55C"><enum>(a)</enum><header>Fiscal Year

			 2007</header><text>For fiscal year 2007, from amounts otherwise made available

			 to the Secretary of the Treasury and the Secretary of Transportation for

			 administrative and policy measures for that fiscal year, each of the

			 Secretaries shall transfer to the Commission not more than $1,000,000, as the

			 Commission may request to carry out this Act.</text>

			</subsection><subsection id="IDB9A5E5FC198543CCBC3370B16DD40D6C"><enum>(b)</enum><header>Future Fiscal

			 Years</header><text>There is authorized to be appropriated to the Commission to

			 carry out this Act $1,000,000 for each of fiscal years 2008 and 2009.</text>

			</subsection></section><section id="IDB1A01CB36C14414EAC1DCCF3C7058368"><enum>9.</enum><header>Termination of

			 Commission</header><text display-inline="no-display-inline">The Commission

			 shall terminate on September 30, 2009.</text>
