		<official-title>To promote the development of democratic institutions in

		  areas under the administrative control of the Palestinian Authority, and for

		  other purposes.</official-title>

		<section id="H7A332DF8919E4E0B91BE8760E5CB2EF3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote>Palestinian Anti-Terrorism Act of 2006</quote>.</text>

		</section><section id="HD253CC87BA6F4791AA30EE97E5117F68" section-type="subsequent-section"><enum>2.</enum><header> Limitation on

			 assistance to the Palestinian Authority</header>

			<subsection id="H552F9B59AFB04DA29302FD6169C2B06"><enum>(a)</enum><header>Declaration of

			 policy</header><text display-inline="yes-display-inline">It shall be the policy

			 of the United States—</text>

				<paragraph id="idD9643745098F49E392904FD40486C822"><enum>(1)</enum><text>to support a

			 peaceful, two-state solution to end the conflict between Israel and the

			 Palestinians in accordance with the Performance-Based Roadmap to a Permanent

			 Two-State Solution to the Israeli-Palestinian Conflict (commonly referred to as

			 the <quote>Roadmap</quote>);</text>

				</paragraph><paragraph id="idE2C64DD6609C4F91904276C7E9A74BE0"><enum>(2)</enum><text>to oppose those

			 organizations, individuals, and countries that support terrorism and violently

			 reject a two-state solution to end the Israeli-Palestinian conflict;</text>

				</paragraph><paragraph id="id0301D331D2E840E28AE77522C78E5793"><enum>(3)</enum><text>to promote the

			 rule of law, democracy, the cessation of terrorism and incitement, and good

			 governance in institutions and territories controlled by the Palestinian

			 Authority; and</text>

				</paragraph><paragraph id="id46654A66C22441769261957B9C6D3BB4"><enum>(4)</enum><text>to urge members

			 of the international community to avoid contact with and refrain from

			 financially supporting the terrorist organization Hamas until it agrees to

			 recognize Israel, renounce violence, disarm, and accept prior agreements,

			 including the Roadmap.</text>

				</paragraph></subsection><subsection id="HC837A7464D4945F99D5F2FC68045D041"><enum>(b)</enum><header>Amendments</header><text display-inline="yes-display-inline">Chapter 1 of part III of the Foreign

			 Assistance Act of 1961 (22 U.S.C. 2351 et seq.) is amended—</text>

				<paragraph id="H5A3EC5F7AA1D44969E7B4C71285E537B"><enum>(1)</enum><text>by redesignating

			 the second section 620G (as added by section 149 of Public Law 104-164 (110

			 Stat. 1436)) as section 620J; and</text>

				</paragraph><paragraph id="HCE26FE0533E0475382D096B41C979503"><enum>(2)</enum><text>by adding at the

			 end the following new section:</text>

					<quoted-block display-inline="no-display-inline" id="HD0EBB7D98363487AA06271B6B1002FF8" style="OLC">

						<section id="H88E6528C079A4B61AA51EA8CC2BE9FCE"><enum>620K.</enum><header> Limitation on

				assistance to the Palestinian Authority</header>

							<subsection id="HC294D72118574FE485109FB64794D5F0"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">Assistance may be provided under this Act

				to the Palestinian Authority only during a period for which a certification

				described in subsection (b) is in effect.</text>

							</subsection><subsection id="HF3695560EFE847149EF6BCBFC73B7007"><enum>(b)</enum><header>Certification</header><text>A

				certification described in this subsection is a certification transmitted by

				the President to Congress that contains a determination of the President

				that—</text>

								<paragraph id="H2C8688E3AC6E442C859DA1939465ECFA"><enum>(1)</enum><text display-inline="yes-display-inline">no ministry, agency, or instrumentality of

				the Palestinian Authority is effectively controlled by Hamas, unless Hamas

				has—</text>

									<subparagraph id="H267EA5F8455645D3BFFCD4C6A73193F"><enum>(A)</enum><text>publicly

				acknowledged Israel’s right to exist as a Jewish state; and</text>

									</subparagraph><subparagraph id="H01621D77E6A6496490215E394E63CC4E"><enum>(B)</enum><text>committed itself

				and is adhering to all previous agreements and understandings with the United

				States Government, with the Government of Israel, and with the international

				community, including agreements and understandings pursuant to the

				Performance-Based Roadmap to a Permanent Two-State Solution to the

				Israeli-Palestinian Conflict (commonly referred to as the

				<quote>Roadmap</quote>); and</text>

									</subparagraph></paragraph><paragraph id="HCB7FF76F6D5B42F3943F71ABFE5C06D4"><enum>(2)</enum><text display-inline="yes-display-inline">the Palestinian Authority has made

				demonstrable progress toward—</text>

									<subparagraph id="H8E3466C2E6A44FEA9600C7A7FA57D644"><enum>(A)</enum><text display-inline="yes-display-inline">completing the process of purging from its

				security services individuals with ties to terrorism;</text>

									</subparagraph><subparagraph id="HF17C6C2CDA904404B44C29B2DE892800"><enum>(B)</enum><text display-inline="yes-display-inline">dismantling all terrorist infrastructure

				within its jurisdiction, confiscating unauthorized weapons, arresting and

				bringing terrorists to justice, destroying unauthorized arms factories,

				thwarting and preempting terrorist attacks, and fully cooperating with Israel’s

				security services;</text>

									</subparagraph><subparagraph id="H4427ECC1485E4CCC89C151223774728B"><enum>(C)</enum><text display-inline="yes-display-inline">halting all anti-American and anti-Israel

				incitement in Palestinian Authority-controlled electronic and print media and

				in schools, mosques, and other institutions it controls, and replacing

				educational materials, including textbooks, with materials that promote peace,

				tolerance, and coexistence with Israel;</text>

									</subparagraph><subparagraph id="H36DC6C2204D84C97A309ADA1DF2DAF36"><enum>(D)</enum><text display-inline="yes-display-inline">ensuring democracy, the rule of law, and an

				independent judiciary, and adopting other reforms such as ensuring transparent

				and accountable governance; and</text>

									</subparagraph><subparagraph id="HA39499CA832C4696A4A500A22FD3D9A4"><enum>(E)</enum><text display-inline="yes-display-inline">ensuring the financial transparency and

				accountability of all government ministries and operations.</text>

									</subparagraph></paragraph></subsection><subsection id="H51B10A3AC3CB463E9B17F773D2E6B49"><enum>(c)</enum><header>Recertifications</header><text display-inline="yes-display-inline">Not later than 90 days after the date on

				which the President transmits to Congress an initial certification under

				subsection (b), and every six months thereafter—</text>

								<paragraph id="H847F7C10ED924AABAE9484B8B0ADB8D3"><enum>(1)</enum><text>the President

				shall transmit to Congress a recertification that the conditions described in

				subsection (b) are continuing to be met; or</text>

								</paragraph><paragraph id="H4E2F93261B26425C846F15EFE90450B4"><enum>(2)</enum><text>if the President

				is unable to make such a recertification, the President shall transmit to

				Congress a report that contains the reasons therefor.</text>

								</paragraph></subsection><subsection id="H2050BBB6B4514A87AEDB3624F69FFFF"><enum>(d)</enum><header>Congressional

				notification</header><text display-inline="yes-display-inline">Assistance made

				available under this Act to the Palestinian Authority may not be provided until

				15 days after the date on which the President has provided notice thereof to

				the Committee on International Relations and the Committee on Appropriations of

				the House of Representatives and to the Committee on Foreign Relations and the

				Committee on Appropriations of the Senate in accordance with the procedures

				applicable to reprogramming notifications under section 634A(a) of this

				Act.</text>

							</subsection><subsection id="id61BFE969478F4758BCCD18AF53B84E62"><enum>(e)</enum><header>National

				security waiver</header>

								<paragraph id="idC395E734CFAD42CAA3F4F86881FCE6C0"><enum>(1)</enum><header>Waiver</header><text>The

				President may waive the limitation in subsection (a) with respect to the

				administrative and personal security costs of the Office of President of the

				Palestinian Authority and for activities of the President of the Palestinian

				Authority to promote democracy and the rule of law if the President certifies

				and reports to the appropriate congressional committees that—</text>

									<subparagraph id="id03DF7CC1EEA64F52AB018579F89E7030"><enum>(A)</enum><text>it is in the

				national security interests of the United States to provide such assistance;

				and</text>

									</subparagraph><subparagraph id="id3F487251DB684C09AA3C225BA9A20256"><enum>(B)</enum><text>the President of

				the Palestinian Authority and the President's party are not affiliated with

				Hamas or any other foreign terrorist organization.</text>

									</subparagraph></paragraph><paragraph id="idA48BCE7EFC18497B9C0D49201D8ADEA1"><enum>(2)</enum><header>Consultation

				required</header><text>The President shall consult with the appropriate

				congressional committees prior to making a certification under paragraph

				(1).</text>

								</paragraph></subsection><subsection id="H54A570CDCDC44FFDBEB5460766574E3C"><enum>(f)</enum><header>Definitions</header><text>In

				this section:</text>

								<paragraph id="id80058A28C29141ED91B842A900F36DF0"><enum>(1)</enum><header>Appropriate

				congressional committees defined</header><text>The term <quote>appropriate

				congressional committees</quote> means—</text>

									<subparagraph id="idD4EBBE41EAE846C58AEAC3D67D7CFCB1"><enum>(A)</enum><text>the Committee on

				International Relations and the Committee on Appropriations of the House of

				Representatives; and</text>

									</subparagraph><subparagraph id="id5570AE7EA030470296A3ACD7863D9746"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations and the

				Committee on Appropriations of the Senate.</text>

									</subparagraph></paragraph><paragraph id="H29A0DDA9730441DF83C429EAC7DA9CC7"><enum>(2)</enum><header>Foreign

				terrorist organization</header><text display-inline="yes-display-inline">The

				term <quote>foreign terrorist organization</quote> means an organization

				designated as a foreign terrorist organization by the Secretary of State in

				accordance with section 219(a) of the Immigration and Nationality Act (8 U.S.C.

				1189(a)).</text>

								</paragraph><paragraph id="H3EBFAE837FF244249B490085BC0086A0"><enum>(3)</enum><header>Palestinian

				authority</header><text display-inline="yes-display-inline">The term

				<quote>Palestinian Authority</quote> means the interim Palestinian

				administrative organization that governs part of the West Bank and all of the

				Gaza Strip (or any successor Palestinian governing entity), including the

				Palestinian Legislative

				Council.</text>

								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection id="idF0E05C1107344BC790C378F80E7342E1"><enum>(c)</enum><header>Previously

			 obligated funds</header><text>The provisions of section 620K of the Foreign

			 Assistance Act of 1961, as added by subsection (b), shall be applicable to the

			 unexpended balances of funds obligated prior to the date of the enactment of

			 this Act.</text>

			</subsection></section><section id="H9C10A41AC27B4B478874F1DE00DA58F7"><enum>3.</enum><header>Limitation on

			 assistance for the West Bank and Gaza</header>

			<subsection id="H6F404609A62C4C6C93F16FAAE3C0F01C"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Chapter 1 of part III of the Foreign

			 Assistance Act of 1961 (22 U.S.C. 2351 et seq.), as amended by section 2(b)(2),

			 is further amended by adding at the end the following new section:</text>

				<quoted-block display-inline="no-display-inline" id="H48608230095E4B9C8B51CB5B5B524DC7" style="OLC">

					<section id="H62A50A920BB941A4AF146D6326CFBA26"><enum>620L.</enum><header>Limitation on

				assistance for the West Bank and Gaza</header>

						<subsection id="HC126287AA8D946ED99D0F64131E6DED"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">Assistance may be provided under this Act

				to nongovernmental organizations for the West Bank and Gaza only during a

				period for which a certification described in section 620K(b) is in effect with

				respect to the Palestinian Authority.</text>

						</subsection><subsection id="HEE70F1F724E34D5B942CE8418044A278"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subsection (a) shall not apply with respect

				to the following:</text>

							<paragraph id="HD5634527BCC6463EB8521305A2BD575C"><enum>(1)</enum><header>Assistance to

				meet basic human needs</header><text>Assistance to meet food, water, medicine,

				or sanitation needs, or other assistance to meet basic human needs.</text>

							</paragraph><paragraph id="id3EADFE6518CE43A9B11B592864EF537E"><enum>(2)</enum><header>Assistance to

				promote democracy</header><text>Assistance to promote democracy, human rights,

				freedom of the press, non-violence, reconciliation, and peaceful co-existence,

				provided that such assistance does not directly benefit Hamas or other foreign

				terrorist organizations.</text>

							</paragraph><paragraph id="HC1A81F90ED4442D7814580B2A77E7E6E"><enum>(3)</enum><header>Other types of

				assistance</header><text>Any other type of assistance if the President—</text>

								<subparagraph id="H121F996582AE44DFBBFD627E55DBA9D6"><enum>(A)</enum><text>determines that

				the provision of such assistance will further the national security interests

				of the United States; and</text>

								</subparagraph><subparagraph id="HFA8BC170444F48739D15A5791866C781"><enum>(B)</enum><text>not less than 45

				days prior to the obligation of amounts for the provision of such

				assistance—</text>

									<clause id="HD4A5B9D2B18B465A8F7CA339E6743FD0"><enum>(i)</enum><text>consults with the

				appropriate congressional committees regarding the specific programs, projects,

				and activities to be carried out using such assistance; and</text>

									</clause><clause id="H071A6A31574947C284D9C6B7C9702798"><enum>(ii)</enum><text>submits to the

				appropriate congressional committees a written memorandum that contains the

				determination of the President under subparagraph (A).</text>

									</clause></subparagraph></paragraph><paragraph id="H16DF6D4ED0D64807B43F8436589F351B"><enum>(4)</enum><header>Definition</header><text>In

				this subsection, the term <quote>appropriate congressional committees</quote>

				means—</text>

								<subparagraph id="HD8885863E2554365896E55D615BA1616"><enum>(A)</enum><text>the Committee on

				International Relations and the Committee on Appropriations of the House of

				Representatives; and</text>

								</subparagraph><subparagraph id="H4DD617EF3EF044C0A0B6C4A4CCF0FC90"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations and the

				Committee on Appropriations of the Senate.</text>

								</subparagraph></paragraph></subsection><subsection id="HB53C7F6E0D2F4538956DEEB0B2003E60"><enum>(c)</enum><header>Marking

				requirement</header><text display-inline="yes-display-inline">Assistance

				provided under this Act to nongovernmental organizations for the West Bank and

				Gaza shall be marked as assistance from the American people or the United

				States Government unless the Administrator of the United States Agency for

				International Development determines that such marking will endanger the lives

				or safety of persons delivering such assistance or would have a significant

				adverse effect on the implementation of that assistance.</text>

						</subsection><subsection id="H883CF7957D9A4A7BB12715B194A413D3"><enum>(d)</enum><header>Congressional

				notification</header><text display-inline="yes-display-inline">Assistance made

				available under this Act to nongovernmental organizations for the West Bank and

				Gaza may not be provided until 15 days after the date on which the President

				has provided notice thereof to the Committee on International Relations and the

				Committee on Appropriations of the House of Representatives and to the

				Committee on Foreign Relations and the Committee on Appropriations of the

				Senate in accordance with the procedures applicable to reprogramming

				notifications under section 634A(a) of this

				Act.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="HA92094C8B65A4992894941CC55CC5062"><enum>(b)</enum><header>Oversight and

			 related requirements</header>

				<paragraph id="HAF6714ED8ED941C1AE7183F021271342"><enum>(1)</enum><header>Oversight</header><text display-inline="yes-display-inline">For each of the fiscal years 2007 and 2008,

			 the Secretary of State shall certify to the appropriate congressional

			 committees not later than 30 days prior to the initial obligation of amounts

			 for assistance to nongovernmental organizations for the West Bank or Gaza under

			 the Foreign Assistance Act of 1961 that procedures have been established to

			 ensure that the Comptroller General of the United States will have access to

			 appropriate United States financial information in order to review the use of

			 such assistance.</text>

				</paragraph><paragraph id="H23012E55087C496D93710500F18CD529"><enum>(2)</enum><header>Vetting</header><text display-inline="yes-display-inline">Prior to any obligation of amounts for each

			 of the fiscal years 2007 and 2008 for assistance to nongovernmental

			 organizations for the West Bank or Gaza under the Foreign Assistance Act of

			 1961 or any other provision of law, the Secretary of State shall take all

			 appropriate steps to ensure that such assistance is not provided to or through

			 any individual or entity that the Secretary knows, or has reason to believe,

			 advocates, plans, sponsors, engages in, or has engaged in, terrorist activity.

			 The Secretary shall, as appropriate, establish procedures specifying the steps

			 to be taken in carrying out this paragraph and shall terminate assistance to

			 any individual or entity that the Secretary has determined advocates, plans,

			 sponsors, or engages in terrorist activity.</text>

				</paragraph><paragraph id="H826856DD4CAD4E2EB031D5C1221BF9A8"><enum>(3)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No amounts made available for fiscal year

			 2007 or 2008 for assistance to nongovernmental organizations for the West Bank

			 or Gaza under the Foreign Assistance Act of 1961 may be made available for the

			 purpose of recognizing or otherwise honoring individuals who commit, or have

			 committed, acts of terrorism.</text>

				</paragraph><paragraph id="H34E413A6DC42448FBB55ED9FC030F416"><enum>(4)</enum><header>Audits</header>

					<subparagraph id="H54E177673ABE454997C05946C6C8B6E"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Administrator of

			 the United States Agency for International Development shall ensure that

			 Federal or non-Federal audits of all contractors and grantees, and significant

			 subcontractors and subgrantees, that receive amounts for assistance to

			 nongovernmental organizations for the West Bank or Gaza under the Foreign

			 Assistance Act of 1961 are conducted for each of the fiscal years 2007 and 2008

			 to ensure, among other things, compliance with this subsection.</text>

					</subparagraph><subparagraph id="HEEF453DC831B4569BF103749A7B7A59"><enum>(B)</enum><header>Audits by

			 inspector general of usaid</header><text display-inline="yes-display-inline">Of

			 the amounts available for each of the fiscal years 2007 and 2008 for assistance

			 to nongovernmental organizations for the West Bank or Gaza under the Foreign

			 Assistance Act of 1961, up to $1,000,000 for each such fiscal year may be used

			 by the Office of the Inspector General of the United States Agency for

			 International Development for audits, inspections, and other activities in

			 furtherance of the requirements of subparagraph (A). Such amounts are in

			 addition to amounts otherwise available for such purposes.</text>

					</subparagraph></paragraph></subsection></section><section id="H5034EF8856174503AAE70095D4766E04"><enum>4.</enum><header>Designation of

			 territory controlled by the Palestinian Authority as terrorist

			 sanctuary</header><text display-inline="no-display-inline">It is the sense of

			 Congress that, during any period for which a certification described in section

			 620K(b) of the Foreign Assistance Act of 1961 (as added by section 2(b)(2) of

			 this Act) is not in effect with respect to the Palestinian Authority, the

			 territory controlled by the Palestinian Authority should be deemed to be in use

			 as a sanctuary for terrorists or terrorist organizations for purposes of

			 section 6(j)(5) of the Export Administration Act of 1979 (50 U.S.C. App.

			 2405(j)(5)) and section 140 of the Foreign Relations Authorization Act, Fiscal

			 Years 1988 and 1989 (22 U.S.C. 2656f).</text>

		</section><section id="HBAD50ED781F14D3BAFD76C30F2621F4B"><enum>5.</enum><header>Denial of visas

			 for officials of the Palestinian Authority</header><text display-inline="no-display-inline">A visa should not be issued to any alien who

			 is an official of, affiliated with, or serving as a representative of the

			 Palestinian Authority, other than the President of the Palestinian Authority

			 and his or her personal representatives, provided that the President and his or

			 her personal representatives are not affiliated with Hamas or any other foreign

			 terrorist organization, during any period for which a certification described

			 in section 620K(b) of the Foreign Assistance Act of 1961 (as added by section

			 2(b)(2) of this Act) is not in effect with respect to the Palestinian

			 Authority.</text>

		</section><section id="H2FE962A55BAF4BB99161B30044D217D4"><enum>6.</enum><header>Travel

			 restrictions on officials and representatives of the Palestinian Authority and

			 the Palestine Liberation Organization stationed at the United Nations in New

			 York City</header>

			<subsection id="idE6D48573562F46BFA2B191F7D9E62724"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Notwithstanding any

			 other provision of law, and except as provided in subsection (b), the President

			 should restrict the travel of officials and representatives of the Palestinian

			 Authority and of the Palestine Liberation Organization, who are stationed at

			 the United Nations in New York City to a 25-mile radius of the United Nations

			 headquarters building during any period for which a certification described in

			 section 620K(b) of the Foreign Assistance Act of 1961 (as added by section

			 2(b)(2) of this Act) is not in effect with respect to the Palestinian

			 Authority.</text>

			</subsection><subsection id="id5BAFFA3DC1F5457DBDA8FA14FABB905A"><enum>(b)</enum><header>Exception</header><text>The

			 travel restrictions described in subsection (a) should not apply to the

			 President of the Palestinian Authority and his or her personal representatives,

			 provided that the President and his or her personal representatives are not

			 affiliated with Hamas or any other foreign terrorist organization.</text>

			</subsection></section><section id="H855B89097ECF4E7CBAF5FB8F3475F7F1"><enum>7.</enum><header>Prohibition on

			 Palestinian Authority representation in the United States</header>

			<subsection id="H8881D36CF58D49069F8D06EF04DAE39C"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,

			 it shall be unlawful to establish or maintain an office, headquarters,

			 premises, or other facilities or establishments within the jurisdiction of the

			 United States at the behest or direction of, or with funds provided by, the

			 Palestinian Authority during any period for which a certification described in

			 section 620K(b) of the Foreign Assistance Act of 1961 (as added by section

			 2(b)(2) of this Act) is not in effect with respect to the Palestinian

			 Authority.</text>

			</subsection><subsection id="H92024D602C744B538CBF1D525D50B792"><enum>(b)</enum><header>Enforcement</header>

				<paragraph id="H4E01163252A043F9A1D8A4B9236E3234"><enum>(1)</enum><header>Attorney

			 general</header><text>The Attorney General shall take the necessary steps and

			 institute the necessary legal action to effectuate the policies and provisions

			 of subsection (a).</text>

				</paragraph><paragraph id="H0DAF5220DCFF44DB943769D81EDC16C1"><enum>(2)</enum><header>Relief</header><text>Any

			 district court of the United States for a district in which a violation of

			 subsection (a) occurs shall have authority, upon petition of relief by the

			 Attorney General, to grant injunctive and such other equitable relief as it

			 shall deem necessary to enforce the provisions of subsection (a).</text>

				</paragraph></subsection><subsection id="idC47DDBCDDCC24DA89C5843EFF0D98B97"><enum>(c)</enum><header>Waiver</header><text>Subsection

			 (a) shall not apply if the President determines and certifies to the

			 appropriate congressional committees that the establishment or maintenance of

			 an office, headquarters, premises, or other facilities is vital to the national

			 security interests of the United States.</text>

			</subsection></section><section id="H83CD668836824D03849EEA00E58CA3F"><enum>8.</enum><header>International

			 financial institutions</header>

			<subsection id="H5C4B16715CC646338B154B7CCA935731"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">The President should direct the United

			 States Executive Director at each international financial institution to use

			 the voice, vote, and influence of the United States to prohibit assistance to

			 the Palestinian Authority (other than assistance described under subsection

			 (b)) during any period for which a certification described in section 620K(b)

			 of the Foreign Assistance of 1961 (as added by section 2(b)(2) of this Act) is

			 not in effect with respect to the Palestinian Authority.</text>

			</subsection><subsection id="id681316CF855843F19E82C07ADA33E748"><enum>(b)</enum><header>Exceptions</header><text>The

			 prohibition on assistance described in subsection (a) should not apply with

			 respect to the following types of assistance:</text>

				<paragraph id="idFBF44DD127234313B19FF0341FC1756E"><enum>(1)</enum><text>Assistance to

			 meet food, water, medicine, or sanitation needs, or other assistance to meet

			 basic human needs.</text>

				</paragraph><paragraph id="id1713DD69AEFF4F609ADDC092A91F0D43"><enum>(2)</enum><text>Assistance to

			 promote democracy, human rights, freedom of the press, non-violence,

			 reconciliation, and peaceful co-existence, provided that such assistance does

			 not directly benefit Hamas or other foreign terrorist organizations.</text>

				</paragraph></subsection><subsection id="H7A89F37CA97544E3AAD337DC9300FB28"><enum>(c)</enum><header>Definition</header><text>In

			 this section, the term <quote>international financial institution</quote> has

			 the meaning given the term in section 1701(c)(2) of the International Financial

			 Institutions Act (22 U.S.C. 262r(c)(2)).</text>

			</subsection></section><section display-inline="no-display-inline" id="HE88E2655598046F09383C8539D3EA038" section-type="subsequent-section"><enum>9.</enum><header>Diplomatic contacts

			 with Palestinian terror organizations</header><text display-inline="no-display-inline">No funds authorized or available to the

			 Department of State may be used for or by any officer or employee of the United

			 States Government to negotiate with members or official representatives of

			 Hamas, Palestinian Islamic Jihad, the Popular Front for the Liberation of

			 Palestine, al-Aqsa Martyrs Brigade, or any other Palestinian terrorist

			 organization (except in emergency or humanitarian situations), unless and until

			 such organization—</text>

			<paragraph id="HDE862460AC1B44EE00A966A5239B51A0"><enum>(1)</enum><text display-inline="yes-display-inline">recognizes Israel’s right to exist;</text>

			</paragraph><paragraph id="HE8CF55F4957444DDBF8593D7A9FDB1AE"><enum>(2)</enum><text>renounces the use

			 of terrorism;</text>

			</paragraph><paragraph id="H5FFCB50D258245E98B3046CA51612C35"><enum>(3)</enum><text>dismantles the

			 infrastructure in areas within its jurisdiction necessary to carry out

			 terrorist acts, including the disarming of militias and the elimination of all

			 instruments of terror; and</text>

			</paragraph><paragraph id="HB5BA34E5192E4380BDD015F87108CAE3"><enum>(4)</enum><text>recognizes and

			 accepts all previous agreements and understandings between the State of Israel

			 and the Palestinian Authority.</text>

			</paragraph></section><section id="idD8D57F4451D640F8B11A762136B1A985"><enum>10.</enum><header>Reporting

			 requirement</header><text display-inline="no-display-inline">Not later than 90

			 days after the date of the enactment of this Act, and annually thereafter, the

			 Secretary of State shall submit to the appropriate congressional committees a

			 report that—</text>

			<paragraph id="idB19B0C146E36462B83809ED7CAA86FDE"><enum>(1)</enum><text display-inline="yes-display-inline">describes the steps that have been taken by

			 the United States Government to ensure that other countries and international

			 organizations, including multilateral development banks, do not provide direct

			 assistance to the Palestinian Authority for any period for which a

			 certification described in section 620K(b) of the Foreign Assistance Act of

			 1961 (as added by section 2(b)(2) of this Act) is not in effect with respect to

			 the Palestinian Authority; and</text>

			</paragraph><paragraph id="idA937340DCE3B43F2A9E5BB05176D6085"><enum>(2)</enum><text>identifies any

			 countries and international organizations, including multilateral development

			 banks, that are providing direct assistance to the Palestinian Authority during

			 such a period, and describes the nature and amount of such assistance.</text>

			</paragraph></section><section id="HC495FDB9B16F4A70847FA8B79D2200DE"><enum>11.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="HBC88540FE8DD4B6CB99E54D8100C499"><enum>(1)</enum><header>Appropriate

			 congressional committees</header><text display-inline="yes-display-inline">The

			 term <quote>appropriate congressional committees</quote> means—</text>

				<subparagraph id="HB3913C5F923F40F8901DA49B07A9D169"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on International Relations

			 and the Committee on Appropriations of the House of Representatives; and</text>

				</subparagraph><subparagraph id="H06A316ACD3D443558B04163D8F68EE5F"><enum>(B)</enum><text>the Committee on

			 Foreign Relations and the Committee on Appropriations of the Senate.</text>

				</subparagraph></paragraph><paragraph id="HFDBE2A6A2D2448A0B263FACFFF8C4215"><enum>(2)</enum><header>Palestinian

			 Authority</header><text display-inline="yes-display-inline">The term

			 <quote>Palestinian Authority</quote> has the meaning given the term in section

			 620K(e)(2) of the Foreign Assistance Act of 1961 (as added by section 2(b)(2)

			 of this Act).</text>
