		<official-title>To require a more reasonable period for delayed-notice

		  search warrants, to provide enhanced judicial review of FISA orders and

		  national security letters, to require an enhanced factual basis for a FISA

		  order, and to create national security letter sunset

		  provisions.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Limitation on reasonable

			 period for delay</header><text display-inline="no-display-inline">Section

			 3103a(b)(3) of title 18, United States Code, is amended by striking <quote>30

			 days</quote> and inserting <quote>7 days</quote>.</text>

		</section><section id="id46236717A1F44439A3DB74ADC997270F"><enum>2.</enum><header>Judicial review

			 of FISA orders and national security letters</header>

			<subsection id="id1FC7D84D18B046C1AB637B7ACA2E5483"><enum>(a)</enum><header>FISA</header><text>Subsection

			 (f)(2) of section 501 of the Foreign Intelligence Surveillance Act of 1978 (50

			 U.S.C. 1861) is amended</text>

				<paragraph id="id4CE45E2453454D749961452B2E81A805"><enum>(1)</enum><text>in subparagraph

			 (A)(i)—</text>

					<subparagraph id="id8ABCAEBBE32F4A988B0AFE753CFA4466"><enum>(A)</enum><text>by striking

			 <quote>a production order</quote> and inserting <quote>a production order or

			 nondisclosure order</quote>; and</text>

					</subparagraph><subparagraph id="idCEE51DCB52984AF080244479E7916681"><enum>(B)</enum><text>by striking

			 <quote>Not less than 1 year</quote> and all that follows through the end of the

			 clause;</text>

					</subparagraph></paragraph><paragraph id="id091B442546EA4670B2B170B7AF49658A"><enum>(2)</enum><text>in subparagraph

			 (A)(ii), by striking <quote>production order or nondisclosure</quote>;

			 and</text>

				</paragraph><paragraph id="id81A957298FF4482CB5C842E128B642FB"><enum>(3)</enum><text>in subparagraph

			 (C), by striking clause (ii) and redesignating clause (iii) as clause

			 (ii).</text>

				</paragraph></subsection><subsection id="id0C306347BE0E4E84950867B20F836174"><enum>(b)</enum><header>Judicial review

			 of national security letters</header><text display-inline="yes-display-inline">Section 3511(b) of title 18, United States

			 Code, is amended—</text>

				<paragraph id="idB82AB0F838C241139A6EA508E4C93CED"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>If, at

			 the time of the petition,</quote> and all that follows through the end of the

			 paragraph; and</text>

				</paragraph><paragraph id="id9B812D5439FD4EC68BE2AE77E264A4C1"><enum>(2)</enum><text>in paragraph (3),

			 by striking <quote>If the recertification that disclosure may</quote> and all

			 that follows through <quote>made in bad faith.</quote>.</text>

				</paragraph></subsection></section><section id="id938C3C86658845CC8461FBF92E987DD5"><enum>3.</enum><header>Factual basis

			 for requested order</header><text display-inline="no-display-inline">Section

			 501(b)(2)(A) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.

			 1861(b)(2)(A)) is amended to read as follows:</text>

			<quoted-block act-name="" display-inline="no-display-inline" id="id64A6B2E289D74DA3AFDB6A7BF32C141A" style="OLC">

				<subparagraph id="id2409AFB2E9BC4A7D84862B376E435240"><enum>(A)</enum><text>a statement of

				facts showing that there are reasonable grounds to believe that the records or

				other things sought—</text>

					<clause id="id2C714C202709493FB0FC19F088ACC615"><enum>(i)</enum><text>are relevant to

				an authorized investigation (other than a threat assessment) conducted in

				accordance with subsection (a)(2) to obtain foreign intelligence information

				not concerning a United States person or to protect against international

				terrorism or clandestine intelligence activities; and</text>

					</clause><clause id="idC9D6FD457A7B4DCFBFAB4AB45726A9D8"><enum>(ii)</enum><text>either—</text>

						<subclause id="id2AC1D01D028A4A1188FCCD8084E24FB7"><enum>(I)</enum><text>pertain to a

				foreign power or an agent of a foreign power;</text>

						</subclause><subclause id="id367F460F40A34221BD0B9C4D783291F9"><enum>(II)</enum><text>are relevant to

				the activities of a suspected agent of a foreign power who is the subject of

				such authorized investigation; or</text>

						</subclause><subclause id="idAF47E63AD9274345B1CFFD15D98E5A7F"><enum>(III)</enum><text>pertain to an

				individual in contact with, or known to, a suspected agent of a foreign power;

				and</text>

						</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="id5418D197DC6C4897B6075A89038C2662"><enum>4.</enum><header>National

			 security letter sunset</header><text display-inline="no-display-inline">Section

			 102 of the USA PATRIOT Improvement and Reauthorization Act of 2005 (H.R. 3199,

			 109th Congress, 2d Session) is amended by adding at the end the

			 following:</text>

			<quoted-block display-inline="no-display-inline" id="id10F768C309A54741B8C4760CDD50613A" style="OLC">

				<subsection id="idAF3111CD3078466880ACA7DBB29108F5"><enum>(c)</enum><header>Other

				sunsets</header>

					<paragraph id="idD0C0E8079DAB42C4A279AC52C64E64B7"><enum>(1)</enum><header>In

				general</header><text>Effective December 31, 2009, the following provisions are

				amended so that they read as they read on February 27, 2006:</text>

						<subparagraph id="id4D7A9DC065C3437FB019CB04D5E89F41"><enum>(A)</enum><text>Section 2709 of

				title 18, United States Code.</text>

						</subparagraph><subparagraph id="idFF83EB8385094B8A895F158CFB5DC534"><enum>(B)</enum><text>Sections 626 and

				627 of the Fair Credit Reporting Act (15 U.S.C. 1681u, 1681v).</text>

						</subparagraph><subparagraph id="idB7C8660D535E4FD6934379958CEA872D"><enum>(C)</enum><text>Section 1114 of

				the Right to Financial Privacy Act (12 U.S.C. 3414).</text>

						</subparagraph><subparagraph id="id2BCA08887A7745C7B31292C69CA36372"><enum>(D)</enum><text>Section 802 of

				the National Security Act of 1947 (50 U.S.C. 436).</text>

						</subparagraph></paragraph><paragraph id="id411FD0D47F664540BE0CBA7833F332CA"><enum>(2)</enum><header>Exception</header><text>With

				respect to any particular foreign intelligence investigation that began before

				the date on which the provisions referred to in paragraph (1) cease to have

				effect, or with respect to any particular offense or potential offense that

				began or occurred before the date on which such provisions cease to have

				effect, such provisions shall continue in

				effect.</text>

					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="id3EB595A702D044AD86B3FF876E0C4FDE"><enum>5.</enum><header>Rule of

			 construction</header><text display-inline="no-display-inline">Amendments to

			 provisions of law made by this Act are to such provisions, as amended by the

			 USA PATRIOT Improvement and Reauthorization Act of 2005 (H.R. 3199, 109th

			 Congress, 2d Session) and by the USA PATRIOT Act Additional Reauthorizing

			 Amendments Act of 2006 (S. 2271, 109th Congress, 2d Session).</text>
