		<legis-type>A BILL</legis-type>

		<official-title>To amend title XVIII of the Social Security Act to reduce

		  the coverage gap in prescription drug coverage under part D of such title based

		  on savings to the Medicare program resulting from the negotiation of

		  prescription drug prices.</official-title>

	<legis-body>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Medicare Prescription Drug Gap

			 Reduction Act of 2006</short-title></quote>.</text>

		</section><section id="id62587221844245B4BB6B7D5CF33E7043"><enum>2.</enum><header>Reducing

			 coverage gap</header><text display-inline="no-display-inline">Section

			 1860D–2(b) of the Social Security Act (42 U.S.C. 1395w–102(b)) is

			 amended—</text>

			<paragraph id="idCEF5EAC7E4074EB687995D22DFB7CACC"><enum>(1)</enum><text>in paragraph

			 (3)(A), by striking <quote>paragraph (4)</quote> and inserting <quote>paragraph

			 (4), subject to the increase described in paragraph (7)</quote>; and</text>

			</paragraph><paragraph id="idF8BBC61991A746B78A2B1F4BC8FCDD57"><enum>(2)</enum><text>by adding at the

			 end the following new paragraph:</text>

				<quoted-block display-inline="no-display-inline" id="id81F95E9CE7BD411EA4F1084BC3733A5D" style="OLC">

					<paragraph id="id20A1C7DFECC346C3B0D7A09CADDE8864"><enum>(7)</enum><header>Increase of

				initial coverage limit based on medicare savings due to negotiation of drug

				prices</header><text>For each year (beginning with 2006), the Secretary shall

				increase the initial coverage limit for the year specified in paragraph (3) so

				that the aggregate amount of increased expenditures from the Medicare

				Prescription Drug Account as a result of such increase under this paragraph in

				the year (as estimated by the Office of the Actuary of the Centers for Medicare

				&amp; Medicaid Services) is equal to the aggregate amount of reduced

				expenditures from such Account that the Office of the Actuary estimates will

				result in the year as a result of the application of the amendment made by

				section 3(a) of the <short-title>Medicare Prescription

				Drug Gap Reduction Act of

				2006</short-title>.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="id6256B8E8F45341F4B9CDD630149EDF79"><enum>3.</enum><header>Negotiating fair

			 prices for medicare prescription drugs</header>

			<subsection id="IDA21040559C304F44AF487336FD745082"><enum>(a)</enum><header>In

			 General</header><text>Section 1860D–11 of the Social Security Act (42 U.S.C.

			 1395w–111) is amended by striking subsection (i) (relating to noninterference)

			 and inserting the following:</text>

				<quoted-block display-inline="no-display-inline" id="id132D7B59847A47368055794C3A164BFA" style="OLC">

					<subsection id="ID8D8B502275224F52B32ED762D26DEF98"><enum>(i)</enum><header>Authority To

				Negotiate Prices With Manufacturers</header>

						<paragraph id="ID5119FFDF41E246F8AA6A8B8750CC6224"><enum>(1)</enum><header>In

				general</header><text>Subject to paragraph (4), in order to ensure that

				beneficiaries enrolled under prescription drug plans and MA–PD plans pay the

				lowest possible price, the Secretary shall have authority similar to that of

				other Federal entities that purchase prescription drugs in bulk to negotiate

				contracts with manufacturers of covered part D drugs, consistent with the

				requirements and in furtherance of the goals of providing quality care and

				containing costs under this part.</text>

						</paragraph><paragraph id="ID95FB5EC2BB5F41FAA4D7664B3CE17AC7"><enum>(2)</enum><header>Mandatory

				responsibilities</header><text>The Secretary shall be required to—</text>

							<subparagraph id="ID3A24D83C1B91490F8C533F7B73E480B2"><enum>(A)</enum><text>negotiate

				contracts with manufacturers of covered part D drugs for each fallback

				prescription drug plan under subsection (g); and</text>

							</subparagraph><subparagraph id="IDBF0E59C3275F427588704AAD833A997D"><enum>(B)</enum><text>participate in

				negotiation of contracts of any covered part D drug upon request of an approved

				prescription drug plan or MA–PD plan.</text>

							</subparagraph></paragraph><paragraph id="ID0F6E5A57AD4646F1BC50DC04B0743872"><enum>(3)</enum><header>Rule of

				construction</header><text>Nothing in paragraph (2) shall be construed to limit

				the authority of the Secretary under paragraph (1) to the mandatory

				responsibilities under paragraph (2).</text>

						</paragraph><paragraph id="id68E2E4785AD14E9DAC6D4F2C7FBDF647"><enum>(4)</enum><header>No particular

				formulary or price structure</header><text>In order to promote competition

				under this part and in carrying out this part, the Secretary may not require a

				particular formulary or institute a price structure for the reimbursement of

				covered part D

				drugs.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID47B327B8DCA04869A153D805321DE725"><enum>(b)</enum><header>Effective

			 Date</header><text>The amendment made by subsection (a) shall take effect as if

			 included in the enactment of section 101 of the Medicare Prescription Drug,

			 Improvement, and Modernization Act of 2003 (Public Law 108–173).</text>
