		<official-title>To amend the Atomic Energy Act of 1954 to require a
		  licensee to notify the Atomic Energy Commission, and the State and county in
		  which a facility is located, whenever there is an unplanned release of fission
		  products in excess of allowable limits.</official-title>

			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Nuclear Release Notice Act of
			 2006</short-title></quote>.</text>

			 notice requirement</header><text display-inline="no-display-inline">Section 103
			 of the Atomic Energy Act of 1954 (42 U.S.C. 2133) is amended—</text>
			<paragraph changed="deleted" id="id167CA3EEFDA8418FA46A9E9CBCC75B0E" reported-display-style="strikethrough"><enum>(1)</enum><text>by redesignating
			 subsection f. as subsection e.; and</text>
			</paragraph><paragraph changed="deleted" id="idE16E0187E17848C09D833AF65548D06B" reported-display-style="strikethrough"><enum>(2)</enum><text>in subsection e.
			 (as so redesignated)—</text>
				<subparagraph id="id79BCBB06DC424E5087598CC353F20F0C"><enum>(A)</enum><text>by designating the
			 first, second, and third sentences as paragraphs (1), (2), and (3),
			 respectively;</text>
				</subparagraph><subparagraph id="id0ED177FFA98F48A486507FCC17048ECB"><enum>(B)</enum><text>by striking the
			 subsection designation and paragraph (1) (as so designated) and inserting the
			 following:</text>

				required</header>
								<subparagraph changed="deleted" id="id3E20DD5C5D964459A65B49D37646EDAC" reported-display-style="strikethrough"><enum>(A)</enum><header>In
				general</header><text>Each license issued for a utilization facility under this
				section or section 104 b. shall require as a condition of the license that in
				case of an unplanned release described in subparagraph (B), the licensee shall
				immediately notify the Commission, and the State and county in which the
				facility is located, of the release.</text>
								</subparagraph><subparagraph changed="deleted" id="id0F802084503D4A80AF6C86E6699BDE95" reported-display-style="strikethrough"><enum>(B)</enum><header>Unplanned
				releases</header><text>Subparagraph (A) applies to any unplanned release of
				quantities of fission products or other radioactive substances—</text>
									<clause id="id741C94699AA6474E865CA580F33BA6F3"><enum>(i)</enum><text>in excess of
				allowable limits for normal operation established by the Commission or other
				applicable Federal laws or standards; and</text>
									</clause><clause id="id1C0CA944E998418CA52ECC5F5E08914C"><enum>(ii)</enum><text>within allowable
				limits for normal operation established by the Commission or other applicable
				Federal laws or standards but that occurs more than twice within a 2-year
				period originating from the same source, process, or equipment at a
				facility.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph changed="deleted" id="idEACC72DD790844A2A30ED1A0876F5A9C" reported-display-style="strikethrough"><enum>(C)</enum><text>in paragraph (3)
			 (as so designated), by striking <quote>date of enactment of this
			 subsection</quote> and inserting <quote>date of enactment of the

			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Nuclear Release Notice Act of
			 2006</short-title></quote>.</text>
		</section><section changed="added" id="idD7DC48EBBF5D45F985BCBB51316E6405" reported-display-style="italic"><enum>2.</enum><header>Nuclear release notice
			 requirement</header><text display-inline="no-display-inline">Section 103 of the
			 Atomic Energy Act of 1954 (42 U.S.C. 2133) is amended by inserting after
			 subsection d. the following:</text>

				<subsection id="IDd7d30628add949c6aae2be7742d99497"><enum>e.</enum><header>Notice of unplanned
				release of radioactive substances</header>
					<paragraph changed="added" id="IDb93bedfb3f3844b09bdcf7c12e1e0b31" reported-display-style="italic"><enum>(1)</enum><header>Regulations</header>
						<subparagraph changed="added" id="ID75a95ec239734980a2d521203e5f7b94" reported-display-style="italic"><enum>(A)</enum><header>In
				general</header><text>Not later than 2 years after the date of enactment of the
				Nuclear Release Notice Act of 2006, the Commission shall promulgate regulations
				that require civilian nuclear power facilities licensed under this section or
				section 104(b) to provide notice of any release to the environment of
				quantities of fission products or other radioactive substances.</text>
						</subparagraph><subparagraph changed="added" id="idFB943B9F1D154C17B73A1BAE708501DF" reported-display-style="italic"><enum>(B)</enum><header>Considerations</header><text>In
				developing the regulations under subparagraph (A), the Commission shall
				consider requiring licensees of civilian nuclear power facilities to provide
				notice of the release—</text>
							<clause changed="added" id="IDea33fb16756246dbbd74f0440d5efb84" reported-display-style="italic"><enum>(i)</enum><text>not later than 24 hours
				after the release;</text>
							</clause><clause changed="added" id="IDca6ef9443bd846c6951f530a9856089c" reported-display-style="italic"><enum>(ii)</enum><text>to the Commission and
				the governments of the State and county in which the civilian nuclear power
				facility is located, if the unplanned release—</text>
								<subclause changed="added" id="ID3c6f23770afc46618bdd69e2bbd534f6" reported-display-style="italic"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id850BF68DD49D49FFB99A16E520437992"><enum>(aa)</enum><text>exceeds allowable
				limits for normal operation established by the Commission; and</text>
									</item><item changed="added" committee-id="SSEV00" id="idC5820D804F4D4046AC4D972CD07089DF" indent="up1" reported-display-style="italic"><enum>(bb)</enum><text>is not subject to more
				stringent reporting requirements established in existing regulations of the
				Commission; or</text>
									</item></subclause><subclause changed="added" id="ID2a437b283c2e4afa8a7a0c19761eec32" reported-display-style="italic"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idA6EF9EF0EC474BDBBAB8897559182E1F"><enum>(aa)</enum><text>enters into the
				environment; and</text>
									</item><item changed="added" committee-id="SSEV00" id="idAA099757DE2748E3BDB5C4C99AF8496F" indent="up1" reported-display-style="italic"><enum>(bb)</enum><text>may cause drinking water
				sources to exceed a maximum contaminant level established by the Environmental
				Protection Agency for fission products or other radioactive substances under
				the Safe Drinking Water Act (42 U.S.C. 300f et seq.); and</text>
									</item></subclause></clause><clause changed="added" id="IDcec2b002bdd34add9503f369a5b1e698" reported-display-style="italic"><enum>(iii)</enum><text>to the governments of
				the State and county in which the civilian nuclear power facility is located if
				the unplanned release reaches the environment by a path otherwise not allowed
				or recognized by the operating license of the civilian nuclear power facility
				and falls within the allowable limits specified in clause (ii),
				including—</text>
								<subclause id="ID1e4c94f287564ff18749ce9ff311ebb5"><enum>(I)</enum><text>considering any
				recommendations issued by the Liquid Radioactive Release Lessons-Learned Task
				Force;</text>
								</subclause><subclause id="ID5ea7dbec7ded473181a9f4bf0a5365b3"><enum>(II)</enum><text>the frequency and form
				of the notice; and</text>
								</subclause><subclause id="IDe11c1cbfb93e4b168f4b93472161910b"><enum>(III)</enum><text>the threshold, volume,
				and radiation content that trigger the notice.</text>
								</subclause></clause></subparagraph></paragraph><paragraph changed="added" id="ID18e8a0cc8e5b43dfa697b3442fa6f97b" reported-display-style="italic"><enum>(2)</enum><header>Effect</header><text>Nothing
				in this subsection provides to any State or county that receives a notice under
				this subsection regulatory jurisdiction over a licensee of a civilian nuclear
				power
				facility.</text>
