		<official-title>To amend title XVIII of the Social Security Act to

		  deliver a meaningful benefit and lower prescription drug prices under the

		  Medicare program.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Medicare-Guaranteed Prescription

			 Drug Act of 2006</short-title></quote>.</text>

		</section><section id="ID860D23EC34F642D6ADCB769A68381F95"><enum>2.</enum><header>Establishment of

			 Medicare-Guaranteed Prescription Drug Plan option</header>

			<subsection id="ID30DBD6F03CE245ECBB498D1955EBB0DC"><enum>(a)</enum><header>In

			 general</header><text>Subpart 2 of part D of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395w–111 et

			 seq.) is amended by inserting after section 1860D–11 the following new

			 section:</text>

					<section id="ID6D18A5C6AD894B65B980F08F0D8A7190"><enum>1860D–11A.</enum><header>medicare-guaranteed prescription drug plan

		  option</header><subsection commented="no" display-inline="yes-display-inline" id="ID4A64CF6874F141A1B8E24234AFA48A20"><enum>(a)</enum><header>In

				general</header><text>Notwithstanding any other provision of this part, for

				each year (beginning with 2007), the Secretary shall—</text>

							<paragraph id="idBD7276866888481EB25CAB5FD74A7225"><enum>(1)</enum><text display-inline="yes-display-inline">in addition to any plans offered under

				section 1860D–11, offer a Medicare-Guaranteed Prescription Drug Plan (as

				defined in subsection (c)) with a service area that consists of the entire

				United States; and</text>

							</paragraph><paragraph id="idE1DB019A681A4B0C90FB08612B2AB755"><enum>(2)</enum><text display-inline="yes-display-inline">enter into negotiations with pharmaceutical

				manufacturers to reduce the purchase cost of covered part D drugs under such

				Plan for eligible part D individuals in accordance with subsection (b).</text>

							</paragraph></subsection><subsection id="ID70E1F21FB4B345DC878D980A266A0136"><enum>(b)</enum><header>Negotiations</header><text>Notwithstanding

				section 1860D–11(i), for purposes of offering the Medicare-Guaranteed

				Prescription Drug Plan under this section, the Secretary shall negotiate with

				pharmaceutical manufacturers with respect to the purchase price of covered part

				D drugs and shall encourage the use of more affordable therapeutic equivalents

				to the extent such practices do not override medical necessity as determined by

				the prescribing physician. To the extent practicable and consistent with the

				previous sentence, the Secretary shall implement strategies similar to those

				used by other Federal purchasers of prescription drugs, and other strategies,

				to reduce the purchase cost of covered part D drugs.</text>

						</subsection><subsection id="ID20D95076D27846B984DDCAC62B9ACDCC"><enum>(c)</enum><header>Medicare-Guaranteed

				Prescription Drug Plan defined</header><text>For purposes of this part, the

				term <term>Medicare-Guaranteed Prescription Drug Plan</term> means a

				prescription drug plan that offers standard prescription drug coverage and

				access to negotiated prices described in section 1860D–2(a)(1)(A).</text>

						</subsection><subsection id="ID71BBEB7D4D194671A096AD4B6FF49D05"><enum>(d)</enum><header>Monthly

				beneficiary premium</header><text>The monthly beneficiary premium to be charged

				under a Medicare-Guaranteed Prescription Drug Plan shall be uniform nationally

				and shall be equal to the base beneficiary premium (computed under section

				1860D–13(a)(2)) applicable for the

				year.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="idA64CC81A278B4A14B8E3E1BD6FB4F513"><enum>(b)</enum><header>Sunset of

			 unnecessary plan requirement and fallback plan provisions</header>

				<paragraph id="id6B8E3AEACE4E49E48E383FA960697EF4"><enum>(1)</enum><header>Plan

			 requirement</header><text><external-xref legal-doc="act" parsable-cite="SSA/1860D–3(a)">Section 1860D–3 </external-xref>of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-103(a)">42 U.S.C.

			 1395w–103)</external-xref> is amended by adding at the end the following new

			 subsection:</text>

				</paragraph><paragraph id="idCDE8E0F42E0446099EF81CC12AB6ECC4"><enum>(2)</enum><header>Fallback</header><text>Section

			 1860D–11(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-113(c)(3)">42 U.S.C. 1395w–111(g)</external-xref>)

			 is amended by adding at the end the following new paragraph:</text>

			 amendments</header>

				<paragraph id="id8673950B925C4611AE5794CC76C40B91"><enum>(1)</enum><header>Application of

			 limited risk plans</header><text>Section 1860D–11(f) of the Social Security Act

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-113(c)(3)">42

			 U.S.C. 1395w–111(f)</external-xref>) is amended by adding at the end the

			 following new paragraph:</text>

			 part D standard prescription drug coverage</header>

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
