		<official-title>To promote accountability and prevent fraud in Federal

		  contracting.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Reconstruction Accountability and

			 Fraud Prevention Act of 2005</short-title></quote>.</text>

		</section><section id="id5A0093D5C4DC42F3A1E0CCA41B530AD9"><enum>2.</enum><header>Accountability

			 in Federal contracting</header>

			<subsection id="idB558655A73A241619E8A11FB9FE423D9"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 subsection (b), none of the funds appropriated or otherwise made available by

			 the Emergency Supplemental Appropriations Act to Meet Immediate Needs Arising

			 From the Consequences of Hurricane Katrina, 2005 (Public Law 109–61), by the

			 Second Emergency Supplemental Appropriations Act to Meet Immediate Needs

			 Arising From the Consequences of Hurricane Katrina, 2005 (Public Law 109–62),

			 or through the Iraq Relief and Reconstruction Fund may be obligated or expended

			 in connection with a contract or covered task order entered into after the date

			 of the enactment of this Act with a contractor that, during the previous 5

			 years—</text>

				<paragraph id="id18D02813DE8E4852B724296EBD54E047"><enum>(1)</enum><text>has been found by

			 an executive agency or any Inspector General to have overcharged or improperly

			 billed the Federal Government by a total of at least $10,000,000 through one or

			 more overcharges;</text>

				</paragraph><paragraph id="id79E65D1376A3421BA55DC4F0710FD5DE"><enum>(2)</enum><text>has been found by

			 an executive agency or any Inspector General to have committed one or more

			 fraudulent acts resulting in total costs or losses to the Federal Government of

			 at least $10,000,000; or</text>

				</paragraph><paragraph id="id850273472ADE4348871C41DF034A91D2"><enum>(3)</enum><text>has been

			 suspended or debarred for a period of at least one year under the Federal

			 suspension and debarment regulations.</text>

				</paragraph></subsection><subsection id="id5464D90B87C849339BBACBB13341BB13"><enum>(b)</enum><header>National

			 security waiver</header><text>The President may waive the restrictions under

			 subsection (a) on a case-by-case basis if the President determines that such

			 waiver is in the national security interest of the United States and submits to

			 the appropriate congressional authorities a report describing the reasons for

			 such determination.</text>

			</subsection><subsection id="id7D0B3AF5E45A46DAA1AD214EF8FE5F96"><enum>(c)</enum><header>Definitions</header><text>In

			 this Act:</text>

				<paragraph id="id10EEA45E729B49C2A61C9D10F4E78277"><enum>(1)</enum><header>Appropriate

			 congressional authorities</header><text>The term <term>appropriate

			 congressional authorities</term> means—</text>

					<subparagraph id="id1919E31BCB204E33A90843AA119906C3"><enum>(A)</enum><text>the majority

			 leader and the minority leader of the Senate;</text>

					</subparagraph><subparagraph id="idDC6700853B0D48D3AEFCAE30E85219FE"><enum>(B)</enum><text>the Speaker of

			 the House of Representatives and the minority leader of the House of

			 Representatives; and</text>

					</subparagraph><subparagraph id="idAA196E1C6520467F92179AD5339DE256"><enum>(C)</enum><text>the Committees on

			 Appropriations of the Senate and the House of Representatives.</text>

					</subparagraph></paragraph><paragraph id="idFF656A39B5A24689987B5D7B5EA37CFF"><enum>(2)</enum><header>Covered task

			 order</header><text>The term <term>covered task order</term> means a task order

			 valued at more than $10,000,000 entered into pursuant to a contract entered

			 into before the date of the enactment of this Act.</text>

				</paragraph><paragraph id="id19B7C3B8A24E451A91797C65F02FA20B"><enum>(3)</enum><header>Executive

			 agency</header><text>The term <term>executive agency</term> has the meaning

			 given that term in section 4 of the Office of Federal Procurement Policy Act

			 (41 U.S.C. 403).</text>
