		  process.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Transparency and Integrity in

			 Earmarks Act of 2006</short-title></quote>.</text>

		</section><section id="IDCB9A3CBFE236454EBE126701F9DA57B3"><enum>2.</enum><header>Earmarks</header><text display-inline="no-display-inline">Rule XVI of the Standing Rules of the Senate

			 is amended by adding at the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="ID3F3B03BA36434B3CBF5992C4BDADEBD0" style="OLC">

				<subsection id="ID29ECA5B82E19429B8AE6FD86DE0C4C42"><enum></enum><text>8.(a) In this

				paragraph, the term <term>earmark</term> means a provision that requires or

				permits the obligation or expenditure of any amount appropriated for the

				benefit of an identifiable person, program, project, entity, or jurisdiction by

				earmarking or other specification, whether by name or description, in a manner

				that—</text>

					<paragraph id="ID4F097236CEF345CBAC2661C0E85577D6"><enum>(1)</enum><text>discriminates

				against other persons, programs, projects, entities, or jurisdictions similarly

				situated that would be eligible, but for the requirement or permission, for the

				amount appropriated; or</text>

					</paragraph><paragraph id="IDC0D29884FF79414C95BFABDDC37E443F"><enum>(2)</enum><text>applies only to a

				single identifiable person, program, project, entity, or jurisdiction, unless

				the identifiable person, program, project, entity, or jurisdiction is described

				or otherwise clearly identified in a law or Treaty stipulation (or an Act or

				resolution previously passed by the Senate during the same session or in the

				estimate submitted in accordance with law).</text>

					</paragraph></subsection><subsection id="ID18D9402487E549E998C05A87E2990C02"><enum>(b)</enum><text>No appropriation

				bill shall be considered unless—</text>

					<paragraph id="id1E984BD9273F46359AFFC95115B4EC4D"><enum>(1)</enum><text>a list of all

				earmarks in such bill and the name of the requestor and a short justification

				for each earmark are available to all Members and made available to the general

				public by means of the Internet for at least 72 hours before its

				consideration;</text>

					</paragraph><paragraph id="id98FA3B26BB2648C38BB5DD143E6159CE"><enum>(2)</enum><text>all earmarks are

				contained in the text of the bill and not incorporated by reference or directed

				in the committee report; and</text>

					</paragraph><paragraph id="idCB06A5B04E934567AAA7194B0F654D15"><enum>(3)</enum><text>all earmarks are

				germane to the bill.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID441D1C60AC974B23A03FACE63FF2ECF5"><enum>(c)</enum><text>This paragraph

				may only be waived by <fraction>2/3</fraction> of Members, duly chosen and

				sworn.</text>

				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="id89B78F3F1D3D433D9EA15F824772E316"><enum>3.</enum><header>Prohibition on

			 Advocating for earmark in which there exists a financial interest</header><text display-inline="no-display-inline">Rule XXXVII of the Standing Rules of the

			 Senate is amended by adding at the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="id27FB62EC80B9448BB98E85E4CA8C5E0C" style="OLC">

				<subsection id="id97ACE4B075E2400DA9115EFB749ECAB6"><enum>12.</enum><text>No Member of the

				Senate may advocate to include an earmark in any bill or joint resolution (or

				an accompanying report) or in any conference report on a bill or joint

				resolution (including an accompanying joint statement of managers thereto) if

				the Member has a financial interest in such

				earmark.</text>

				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="idC2F3D6E133DC43DF84A20BFDF5155312"><enum>4.</enum><header>Prohibition on

			 buying votes</header><text display-inline="no-display-inline">Rule XXXVII of

			 the Standing Rules of the Senate is amended by adding at the end the

			 following:</text>

			<quoted-block display-inline="no-display-inline" id="idFA2DD03545204468A3FB89F0D093A8CE" style="OLC">

				<subsection id="idE6053D979AE44CC599EACFB702BC1AFF"><enum>13.</enum><text>No Member of the

				Senate shall condition the inclusion of language to provide funding for an

				earmark in any bill or joint resolution (or an accompanying report thereof) or

				in any conference report on a bill or joint resolution (including an

				accompanying joint statement of managers thereto) on any vote cast by the

				Member of the Senate in whose State the project will be carried

				out.</text>

				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="id49C3BBA8340D4665A2E3086B04D3FF75"><enum>5.</enum><header>Lobbying on

			 behalf of recipients of Federal funds</header><text display-inline="no-display-inline">The Lobbying Disclosure Act of 1995 is

			 amended by adding after section 5 the following:</text>

			<quoted-block display-inline="no-display-inline" id="id6453EEDD72C6494D8C5C864AC3CA9E29" style="OLC">

				<section id="id4BD1AC59F50144A1801EC8D85A758323"><enum>5A.</enum><header>Reports by

				recipients of Federal funds</header>

					<subsection id="id8940948F09F645138AFBD62EC119CC8F"><enum>(a)</enum><header>In

				general</header><text>A recipient of Federal funds shall file a report as

				required by section 5(a) containing—</text>

						<paragraph id="id13AFB7F96504496E932D7635D9601863"><enum>(1)</enum><text>the name of any

				lobbyist registered under this Act to whom the recipient paid money to lobby on

				behalf of the Federal funding received by the recipient; and</text>

						</paragraph><paragraph id="id9015733CCC864F35BE34F86E2E113F2B"><enum>(2)</enum><text>the amount of

				money paid as described in paragraph (1).</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4E58F5B5CC224647ACC801B58DB7B6D3"><enum>(b)</enum><header>Definition</header><text>In

				this section, the term <term>recipient of Federal funds</term> means the

				recipient of Federal funds constituting an award, grant, or

				loan.</text>
