			 <quote><short-title>Continuing Care for Recovering

			 Families Act</short-title></quote>.</text>

			<header>Extension of COBRA coverage period for certain

			 individuals</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID5D4C61C5A99944269F964347646CDFBF">

				<enum>(a)</enum>

				<header>ERISA amendment</header>

				<text display-inline="yes-display-inline">

					<external-xref legal-doc="act" parsable-cite="ERISA/605">Section

			 605</external-xref> of the <act-name parsable-cite="ERISA">Employee Retirement

			 Income Security Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/1165">29 U.S.C. 1165</external-xref>) is amended by

			 adding at the end the following:</text>

						<enum>(c)</enum>

						<header>Temporary extension of COBRA election and coverage period for

				victims of terrorist attacks</header>

						<paragraph commented="no" display-inline="no-display-inline" id="IDA71274EE9D474AB5B913C491C7C0232D">

							<enum>(1)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">In the case of an eligible

				individual and notwithstanding subsection (a), such individual may elect

				continuation coverage under this part during the 120-day period that begins on

				the later of—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID97926BA65CEC4A49BC7703057FCEB6AD">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">the date of enactment of

				the Continuing Care for Recovering Families Act; or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3CF726659672422E93C06688692F663A">

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">the date on which the

				individual experiences the terrorism-related loss of coverage.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA24E7263C32745FFA5F1A3B54A78D311">

							<enum>(2)</enum>

							<header>Commencement of coverage; no reach-back</header>

							<text display-inline="yes-display-inline">Any continuation coverage

				elected by an eligible individual under paragraph (1) shall commence at the

				beginning of the 120-day election period described in such paragraph and shall

				not include any period prior to such 120-day election period. In no event shall

				the maximum period required under section 602(2)(A) be less than the period

				during which the individual is an eligible individual.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD651894DED7343AB967E1B78E22EDF52">

							<enum>(3)</enum>

							<header>Preexisting conditions</header>

							<text display-inline="yes-display-inline">With respect to an

				individual who elects continuation coverage pursuant to paragraph (1), the

				period—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID020CF9467CE745BA80F2BEAB8E840170">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">beginning on the date of

				the terrorism-related loss of coverage, and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID22E51F3DA732470096309E41015472C1">

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">ending on the first day of

				the 120-day election period described in paragraph (1), shall be disregarded

				for purposes of determining the 63-day periods referred to in section

				701(c)(2), section 2701(c)(2) of the <act-name parsable-cite="PHSA">Public

				Health Service Act</act-name>, and section 9801(c)(2) of the Internal Revenue

				Code of 1986.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF16D0B472C8747EC90EFDDCFE090A160">

							<enum>(4)</enum>

							<header>Definitions</header>

							<text display-inline="yes-display-inline">For purposes of this

				subsection:</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDFC48663C34F0447FADAEB66C88E6AF6D">

								<enum>(A)</enum>

								<header>Eligible individual</header>

								<text display-inline="yes-display-inline">The term <term>eligible

				individual</term> means an individual who—</text>

								<clause commented="no" display-inline="no-display-inline" id="IDE95A280768AC40C5BD121C9A04EF0978">

									<enum>(i)</enum>

									<subclause commented="no" display-inline="yes-display-inline" id="ID409389ECBF4B477BB7B974C4D6E0FB83"><enum>(I)</enum>

										<text display-inline="yes-display-inline">is the child of an

				individual described in section 405(c)(2) of the September 11th Victim

				Compensation Fund of 2001; or</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID14CB2D74A47A4D57956A3F275142189E" indent="up1">

										<enum>(II)</enum>

										<text display-inline="yes-display-inline">was the spouse of an

				individual described in section 405(c)(2) of the September 11th Victim

				Compensation Fund of 2001, on September 11, 2001;</text>

									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID18665DA0D2E1456C95D0849901216B4E">

									<enum>(ii)</enum>

									<text display-inline="yes-display-inline">has experienced a

				terrorism-related loss of coverage; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID8A45FB366ECA42FDBBF0222FE3D272C0">

									<enum>(iii)</enum>

									<text display-inline="yes-display-inline">is not otherwise entitled

				to benefits, or enrolled, under part A of title XVIII of the

				<act-name parsable-cite="SSA">Social Security Act</act-name> or enrolled under

				part B of such title.</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF5EF0BDDA89844B7A7727A15113C4C78">

								<enum>(B)</enum>

								<header>Terrorism-related loss of coverage</header>

								<text display-inline="yes-display-inline">The term

				<term>terrorism-related loss of coverage</term> means, with respect to an

				eligible individual, the loss of health benefits coverage associated with the

				death, injury, or loss of employment of an individual described in section

				405(c)(2) of the September 11th Victim Compensation Fund of 2001.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2BAA7127CB3F482AB178E85AA6114716">

				<enum>(b)</enum>

				<header>PHSA amendment</header>

				<text display-inline="yes-display-inline">

					<external-xref legal-doc="act" parsable-cite="PHSA/2205">Section

			 2205</external-xref> of the <act-name parsable-cite="PHSA">Public Health

			 Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300bb-5">42 U.S.C. 300bb–5</external-xref>) is amended by

			 adding at the end the following:</text>

				individual and notwithstanding subsection (a), such individual may elect

				continuation coverage under this title during the 120-day period that begins on

				the later of—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID14B950E1ED61444BAB5C035447B8C962">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">the date of enactment of

				the Continuing Care for Recovering Families Act; or</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID62541B0420934927898AA772E7B2604C">

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">the date on which the

				individual experiences the terrorism-related loss of coverage.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID76D05EF8B487471ABF01BF52101D066A">

							<enum>(2)</enum>

							<header>Commencement of coverage; no reach-back</header>

							<text display-inline="yes-display-inline">Any continuation coverage

				elected by an eligible individual under paragraph (1) shall commence at the

				beginning of the 120-day election period described in such paragraph and shall

				not include any period prior to such 120-day election period. In no event shall

				the maximum period required under section 2202(2)(A) be less than the period

				during which the individual is an eligible individual.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID901124451B6F4C1FAFD1D790157C82AA">

							<enum>(3)</enum>

							<header>Preexisting conditions</header>

							<text display-inline="yes-display-inline">With respect to an

				individual who elects continuation coverage pursuant to paragraph (1), the

				period—</text>

								<text display-inline="yes-display-inline">beginning on the date of

				the terrorism-related loss of coverage, and</text>

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">ending on the first day of

				the 120-day election period described in paragraph (1), shall be disregarded

				for purposes of determining the 63-day periods referred to in section

				2701(c)(2), section 701(c)(2) of the <act-name parsable-cite="ERISA">Employee

				Retirement Income Security Act of 1974</act-name>, and section 9801(c)(2) of

				the Internal Revenue Code of 1986.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC1272BD1AE7C4D18B779369384C84ECD">

							<enum>(4)</enum>

							<header>Definitions</header>

							<text display-inline="yes-display-inline">For purposes of this

				subsection:</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="IDCC61CB20FC0D46359650389CE426B90D">

								<enum>(A)</enum>

								<header>Eligible individual</header>

								<text display-inline="yes-display-inline">The term <term>eligible

				individual</term> means an individual who—</text>

								<clause commented="no" display-inline="no-display-inline" id="ID9C694987ACAF4DE185F8BCC46A15C4C6">

									<enum>(i)</enum>

									<subclause commented="no" display-inline="yes-display-inline" id="ID9F5FE7209DEB4D9F83F8108109A89A2A"><enum>(I)</enum>

										<text display-inline="yes-display-inline">is the child of an

				individual described in section 405(c)(2) of the September 11th Victim

				Compensation Fund of 2001; or</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDDE74C5B2D1B4452CA48F1E769A94CFAB" indent="up1">

										<enum>(II)</enum>

										<text display-inline="yes-display-inline">was the spouse of an

				individual described in section 405(c)(2) of the September 11th Victim

				Compensation Fund of 2001, on September 11, 2001;</text>

									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDD8E91791C6EE42BDBAD972B05D6C911A">

									<enum>(ii)</enum>

									<text display-inline="yes-display-inline">has experienced a

				terrorism-related loss of coverage; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID2E8AEA328FF14A469AB0A2AE854E7CED">

									<enum>(iii)</enum>

									<text display-inline="yes-display-inline">is not otherwise entitled

				to benefits, or enrolled, under part A of title XVIII of the

				<act-name parsable-cite="SSA">Social Security Act</act-name> or enrolled under

				part B of such title.</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID651527E1CACE41FC895B7B0B59E640C1">

								<enum>(B)</enum>

								<header>Terrorism-related loss of coverage</header>

								<text display-inline="yes-display-inline">The term

				<term>terrorism-related loss of coverage</term> means, with respect to an

				eligible individual, the loss of health benefits coverage associated with the

				death, injury, or loss of employment of an individual described in section

				405(c)(2) of the September 11th Victim Compensation Fund of 2001.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				<enum>(c)</enum>

				<header>IRC amendments</header>

				<text display-inline="yes-display-inline">Paragraph (5) of section

			 4980B(f) of the Internal Revenue Code of 1986 (relating to election) is amended

			 by adding at the end the following:</text>

								<enum>(II)</enum>

								<text display-inline="yes-display-inline">the date on which the

				individual experiences the terrorism-related loss of coverage.</text>

							<enum>(ii)</enum>

							<header>Commencement of coverage; no reach-back</header>

							<text display-inline="yes-display-inline">Any continuation coverage

				elected by an eligible individual under clause (i) shall commence at the

				beginning of the 120-day election period described in such clause and shall not

				include any period prior to such 120-day election period. In no event shall the

				maximum period required under paragraph (2)(B)(i) be less than the period

				during which the individual is an eligible individual.</text>

							<enum>(iii)</enum>

				the 120-day election period described in clause (i), shall be disregarded for

				purposes of determining the 63-day periods referred to in section 9801(c)(2),

				section 701(c)(2) of the <act-name parsable-cite="ERISA">Employee Retirement

				Income Security Act of 1974</act-name>, and section 2701(c)(2) of the

				<act-name parsable-cite="PHSA">Public Health Service Act</act-name>.</text>

							<enum>(iv)</enum>

							<header>Definitions</header>

				individual described in section 405(c)(2) of the September 11th Victim

				Compensation Fund of 2001; or</text>

										<enum>(BB)</enum>

										<text display-inline="yes-display-inline">was the spouse of an

				individual described in section 405(c)(2) of the September 11th Victim

				Compensation Fund of 2001, on September 11, 2001;</text>

				to benefits, or enrolled, under part A of title XVIII of the

				part B of such title.</text>
