		<official-title>To amend title X of the Public Health Service Act to

		  prohibit family planning grants from being awarded to any entity that performs

		  abortions.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Title X Family Planning

			 Act</short-title></quote>.</text>

		</section><section id="id1DFBF8A1DC864141AD57AC4F91CE6A6F"><enum>2.</enum><header>Amendment to the

			 Public Health Service Act</header><text display-inline="no-display-inline">Section 1008 of the Public Health Service

			 Act (42 U.S.C. 300a–6) is amended to read as follows:</text>

			<quoted-block display-inline="no-display-inline" id="idDD50C9FA335B43BDBE079A51F2E58A68" style="OLC">

				<section id="id08CA9B7B6B1645A38F2EA751962D1AC3"><enum>1008.</enum><header>Prohibition

				on abortion</header>

					<subsection id="id0EAA7B54C4CD4E5A9CAF50A81A84768F"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">None of the funds

				appropriated under this title shall be distributed to grantees who perform

				abortions or whose subgrantees perform abortions, except where a woman suffers

				from a physical disorder, physical injury, or physical illness, including a

				life-endangering physical condition caused by or arising from the pregnancy

				itself, that would, as certified by a physician, place the woman in danger of

				death unless an abortion is performed. The preceding sentence shall not apply

				to a grantee or subgrantee that is a hospital, so long as such hospital does

				not subgrant to a non-hospital entity that performs abortions.</text>

					</subsection><subsection id="id823FD535D32D4AC8B8B36E36402A530C"><enum>(b)</enum><header>List</header><text>Not

				later than 6 months after the date of enactment of the

				<short-title>Title X Family Planning Act</short-title>,

				and each fiscal year thereafter, the Secretary shall submit to Congress a list

				of grantees, to which subsection (a) applies, under this title for the fiscal

				year involved that perform abortions regardless of how such abortions are

				funded.</text>

					</subsection><subsection id="id5977E1C0578544238592D2401977ECDC"><enum>(c)</enum><header>Limitations on

				eligibility</header>

						<paragraph id="id6A516B9DE0804001A95F7F05DB107430"><enum>(1)</enum><header>Grantees on

				list</header><text>A grantee who appears on the list submitted under subsection

				(b) for a fiscal year shall not be eligible to receive assistance under this

				title for subsequent fiscal years unless the grantee submits to the Secretary a

				certification that such grantee, and the subgrantees of such grantee, no longer

				perform abortions.</text>

						</paragraph><paragraph id="id20D8224D529048C086A154BDA4DC3FBD"><enum>(2)</enum><header>Applications

				for assistance</header><text>To be eligible to receive assistance under this

				title, a grantee to which subsection (a) applies shall submit to the Secretary

				a certification that such grantee, and the subgrantees of such grantee, do not

				perform abortions other than those abortions explicitly permitted under

				subsection (a).</text>

						</paragraph></subsection><subsection id="id10D1DF69925A4CAE961317D48C973BE3"><enum>(d)</enum><header>Definitions</header><text>In

				this section:</text>

						<paragraph id="IDa5d3f43331224c12b3cde6881edaaab2"><enum>(1)</enum><header>Grantee</header><text>The

				term <term>grantee</term> means the organizational entity or individual to

				which a grant, under this title is awarded and which is responsible and

				accountable both for the use of the funds provided under the grant and for the

				performance of the grant-supported project or activities. A grantee is the

				entire legal entity even if only a particular component is designated in the

				award document.</text>

						</paragraph><paragraph changed="not-changed" commented="no" id="idC3D964AF1CD34EBDB84508C1F66DF716"><enum>(2)</enum><header>Hospital</header><text>The

				term <term>hospital</term> has the meaning given that term in section 1861(e)

				of the Social Security Act.</text>

						</paragraph><paragraph id="ID063953ce5eec4fad8ca00fcd64056d67"><enum>(3)</enum><header>Subgrantee</header><text>The

				term <term>subgrantee</term> means the government or other legal entity to

				which a subgrant is awarded under this title and which is accountable to the

				grantee for the use of the funds provided under the

				subgrant.</text>

						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
