		<official-title>To direct the Secretary of the Interior to convey certain

		  parcels of land acquired for the Blunt Reservoir and Pierre Canal features of

		  the initial stage of the Oahe Unit, James Division, South Dakota, to the

		  Commission of Schools and Public Lands and the Department of Game, Fish, and

		  Parks of the State of South Dakota for the purpose of mitigating lost wildlife

		  habitat, on the condition that the current preferential leaseholders shall have

		  an option to purchase the parcels from the Commission, and for other

		  purposes.</official-title>

		<section id="ID069965ED944140DD006E8FBE01100039" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Blunt Reservoir and Pierre Canal Land

			 Conveyance Act of 2006</short-title></quote>.</text>

		</section><section id="ID82CFE2C4A0454147AE1F476B41BDEF9C"><enum>2.</enum><header>Blunt Reservoir

			 and Pierre Canal</header>

			<subsection id="ID10C534CBD5794F56BC1730B438DB5F00"><enum>(a)</enum><header>Definitions</header><text>In

			 this section:</text>

				<paragraph id="ID431ED7C925034A3CA1BBD9E36D83D006"><enum>(1)</enum><header>Blunt Reservoir

			 feature</header><text>The term <term>Blunt Reservoir feature</term> means the

			 Blunt Reservoir feature of the Oahe Unit, James Division, authorized by the Act

			 of August 3, 1968 (<external-xref legal-doc="statute-at-large" parsable-cite="stat/82/624">82 Stat. 624</external-xref>), as part of the

			 Pick-Sloan Missouri River Basin program.</text>

				</paragraph><paragraph id="ID84902880B22D47F290AB0079BF9DEB53"><enum>(2)</enum><header>Commission</header><text>The

			 term <term>Commission</term> means the Commission of Schools and Public Lands

			 of the State.</text>

				</paragraph><paragraph id="ID5404A70133B34679B63D2B503B8E5B12"><enum>(3)</enum><header>Nonpreferential

			 lease parcel</header><text>The term <term>nonpreferential lease parcel</term>

			 means a parcel of land that—</text>

					<subparagraph id="IDE2239167AFF049228B42D04C7EB2FE39"><enum>(A)</enum><text>was purchased by

			 the Secretary for use in connection with the Blunt Reservoir feature or the

			 Pierre Canal feature; and</text>

					</subparagraph><subparagraph id="IDABED40C904E84DE4AEEA793446B3397B"><enum>(B)</enum><text>was considered to

			 be a nonpreferential lease parcel by the Secretary as of January 1, 2001, and

			 is reflected as such on the roster of leases of the Bureau of Reclamation for

			 2001.</text>

					</subparagraph></paragraph><paragraph id="IDF601ACB457874185A6A9840970839E87"><enum>(4)</enum><header>Pierre Canal

			 Feature</header><text>The term <term>Pierre Canal feature</term> means the

			 Pierre Canal feature of the Oahe Unit, James Division, authorized by the Act of

			 August 3, 1968 (<external-xref legal-doc="statute-at-large" parsable-cite="stat/82/624">82 Stat. 624</external-xref>), as part of the

			 Pick-Sloan Missouri River Basin program.</text>

				</paragraph><paragraph id="ID01F6D0A7716C4BC2AA57A8448E9DF3B5"><enum>(5)</enum><header>Preferential

			 leaseholder</header><text>The term <term>preferential leaseholder</term> means

			 a person or descendant of a person that held a lease on a preferential lease

			 parcel as of January 1, 2001, and is reflected as such on the roster of leases

			 of the Bureau of Reclamation for 2001.</text>

				</paragraph><paragraph id="IDCC8CF00BA1814343989B4CDB9559DD57"><enum>(6)</enum><header>Preferential

			 lease parcel</header><text>The term <term>preferential lease parcel</term>

			 means a parcel of land that—</text>

					<subparagraph id="IDBB9000038979416AA342CFDAD18F8F03"><enum>(A)</enum><text>was purchased by

			 the Secretary for use in connection with the Blunt Reservoir feature or the

			 Pierre Canal feature; and</text>

					</subparagraph><subparagraph id="ID0A0003EF03AA4D04B86C7C134286DC97"><enum>(B)</enum><text>was considered to

			 be a preferential lease parcel by the Secretary as of January 1, 2001, and is

			 reflected as such on the roster of leases of the Bureau of Reclamation for

			 2001.</text>

					</subparagraph></paragraph><paragraph id="ID522FF3822D01413B8DC600E5E7072447"><enum>(7)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of the Interior, acting through

			 the Commissioner of Reclamation.</text>

				</paragraph><paragraph id="IDD1EAFFF6B3F14E03BA3B0169A000B376"><enum>(8)</enum><header>State</header><text>The

			 term <term>State</term> means the State of South Dakota, including a successor

			 in interest of the State.</text>

				</paragraph><paragraph id="ID0851D8A6C6AB4E89943C2960893FAB68"><enum>(9)</enum><header>Unleased

			 parcel</header><text>The term <term>unleased parcel</term> means a parcel of

			 land that—</text>

					<subparagraph id="ID218DC8F08C24492283A0F742A076D4A5"><enum>(A)</enum><text>was purchased by

			 the Secretary for use in connection with the Blunt Reservoir feature or the

			 Pierre Canal feature; and</text>

					</subparagraph><subparagraph id="IDC281CBC9C4624D8998C0EBC3A134E57B"><enum>(B)</enum><text>is not under

			 lease as of the date of enactment of this Act.</text>

					</subparagraph></paragraph></subsection><subsection id="ID4A9A1DB7E4744F09A7215D96CA7EA361"><enum>(b)</enum><header>Deauthorization</header><text>The

			 Blunt Reservoir feature is deauthorized.</text>

			</subsection><subsection id="IDA9274CF4B37643508B2CB565C607DD37"><enum>(c)</enum><header>Acceptance of

			 land and obligations</header>

				<paragraph id="IDFBC520D60B324CDD99E8C1003C5CF205"><enum>(1)</enum><header>In

			 general</header><text>As a condition of each conveyance under subsections

			 (d)(5) and (e), respectively, the State shall agree to accept—</text>

					<subparagraph id="ID121103DF28A449B9A99FB5000812DB27"><enum>(A)</enum><text>in <quote>as

			 is</quote> condition, the portions of the Blunt Reservoir Feature and the

			 Pierre Canal Feature that pass into State ownership;</text>

					</subparagraph><subparagraph id="IDA144E4EE48DB4E71B77455D3C279CA43"><enum>(B)</enum><text>any liability

			 accruing after the date of conveyance as a result of the ownership, operation,

			 or maintenance of the features referred to in subparagraph (A), including

			 liability associated with certain outstanding obligations associated with

			 expired easements, or any other right granted in, on, over, or across either

			 feature; and</text>

					</subparagraph><subparagraph id="ID967D757A326649CAA8D5F49E6321CEC8"><enum>(C)</enum><text>the

			 responsibility that the Commission will act as the agent for the Secretary in

			 administering the purchase option extended to preferential leaseholders under

			 subsection (d).</text>

					</subparagraph></paragraph><paragraph id="ID7799E220F6FA4316A5946DEA70354F29"><enum>(2)</enum><header>Responsibilities

			 of the State</header><text>An outstanding obligation described in paragraph

			 (1)(B) shall inure to the benefit of, and be binding upon, the State.</text>

				</paragraph><paragraph id="ID60C6C7A574344E239420BF756B10F97F"><enum>(3)</enum><header>Oil, gas,

			 mineral and other outstanding rights</header><text>A conveyance to the State

			 under subsection (d)(5) or (e) or a sale to a preferential leaseholder under

			 subsection (d) shall be made subject to—</text>

					<subparagraph id="ID8BB7E789013F47D29D9D58641CC0E900"><enum>(A)</enum><text>oil, gas, and

			 other mineral rights reserved of record, as of the date of enactment of this

			 Act, by or in favor of a third party; and</text>

					</subparagraph><subparagraph id="ID6CCAF76EB7B048CF9C87F5FE151B9755"><enum>(B)</enum><text>any permit,

			 license, lease, right-of-use, or right-of-way of record in, on, over, or across

			 a feature referred to in paragraph (1)(A) that is outstanding as to a third

			 party as of the date of enactment of this Act.</text>

					</subparagraph></paragraph><paragraph id="ID1EC1F3F99F8C476EB22938725B548155"><enum>(4)</enum><header>Additional

			 conditions of conveyance to State</header><text>A conveyance to the State under

			 subsection (d)(5) or (e) shall be subject to the reservations by the United

			 States and the conditions specified in section 1 of the Act of May 19, 1948

			 (chapter 310;

			 <external-xref legal-doc="statute-at-large" parsable-cite="stat/62/240">62

			 Stat. 240</external-xref>), as amended (<external-xref legal-doc="usc" parsable-cite="usc/16/667b">16 U.S.C. 667b</external-xref>), for the transfer

			 of property to State agencies for wildlife conservation purposes.</text>

				</paragraph></subsection><subsection id="IDD5EA413EA9104632A51427DB7DCFB6E2"><enum>(d)</enum><header>Purchase

			 option</header>

				<paragraph id="ID26947F7ABEDC491AA5CB1B0213DF8429"><enum>(1)</enum><header>In

			 general</header><text>A preferential leaseholder shall have an option to

			 purchase from the Commission, acting as an agent for the Secretary, the

			 preferential lease parcel that is the subject of the lease.</text>

				</paragraph><paragraph id="ID82D49A0A4DC6430884890975B145C49D"><enum>(2)</enum><header>Terms</header>

					<subparagraph id="ID2902049702B542C9AFC89C40AD52A8C9"><enum>(A)</enum><header>In

			 general</header><text>Except as provided in subparagraph (B), a preferential

			 leaseholder may elect to purchase a parcel on one of the following

			 terms:</text>

						<clause id="ID9E099A4B08B1495A818DBE2B8054E6E8"><enum>(i)</enum><text>Cash purchase for

			 the amount that is equal to—</text>

							<subclause id="ID1523ADBAE52A43C0A13F7E881878F7C5"><enum>(I)</enum><text>the value of the

			 parcel determined under paragraph (4); minus</text>

							</subclause><subclause id="ID3D51336C62534DC0AF00F54DD6D0DFBD"><enum>(II)</enum><text>ten percent of

			 that value.</text>

							</subclause></clause><clause id="ID4A1D8A3E1C514E438D6BB29DFA21DED4"><enum>(ii)</enum><text>Installment

			 purchase, with 10 percent of the value of the parcel determined under paragraph

			 (4) to be paid on the date of purchase and the remainder to be paid over not

			 more than 30 years at 3 percent annual interest.</text>

						</clause></subparagraph><subparagraph id="IDF28B564527BF41F4A071A035E16F4B00"><enum>(B)</enum><header>Value under

			 $10,000</header><text>If the value of the parcel is under $10,000, the purchase

			 shall be made on a cash basis in accordance with subparagraph (A)(i).</text>

					</subparagraph></paragraph><paragraph id="IDF16EA7C8082149FCB99BBC00A8EAE9D1"><enum>(3)</enum><header>Option exercise

			 period</header>

					<subparagraph id="IDC86FDD5AEDA141179900A23E91B9FB42"><enum>(A)</enum><header>In

			 general</header><text>A preferential leaseholder shall have until the date that

			 is 5 years after enactment of this Act to exercise the option under paragraph

			 (1).</text>

					</subparagraph><subparagraph id="ID4897A7EE2D764AEEA327FAC53DBD452E"><enum>(B)</enum><header>Continuation of

			 leases</header><text>Until the date specified in subparagraph (A), a

			 preferential leaseholder shall be entitled to continue to lease from the

			 Secretary the parcel leased by the preferential leaseholder under the same

			 terms and conditions as under the lease, as in effect as of the date of

			 enactment of this Act.</text>

					</subparagraph></paragraph><paragraph id="ID646702FE36C54915A57C023C3E32A142"><enum>(4)</enum><header>Valuation</header>

					<subparagraph id="ID528924EF64224F32BBE02C559053C407"><enum>(A)</enum><header>In

			 general</header><text>The value of a preferential lease parcel shall be its

			 fair market value for agricultural purposes determined by an independent

			 appraisal, exclusive of the value of private improvements made by the

			 leaseholders while the land was federally owned before the date of the

			 enactment of this Act, in conformance with the Uniform Appraisal Standards for

			 Federal Land Acquisition.</text>

					</subparagraph><subparagraph id="ID870351DB94664EFD8767674BD200515B"><enum>(B)</enum><header>Fair market

			 value</header><text>Any dispute over the fair market value of a property under

			 subparagraph (A) shall be resolved in accordance with section 2201.4 of title

			 43, Code of Federal Regulations.</text>

					</subparagraph></paragraph><paragraph id="IDAD5D736FB41848E4BDA46700FFA80472"><enum>(5)</enum><header>Conveyance to

			 the State</header>

					<subparagraph id="ID422432046FDA467FB737009C2DB025EC"><enum>(A)</enum><header>In

			 general</header><text>If a preferential leaseholder fails to purchase a parcel

			 within the period specified in paragraph (3)(A), the Secretary shall convey the

			 parcel to the State of South Dakota Department of Game, Fish, and Parks.</text>

					</subparagraph><subparagraph id="IDF59C2DDE35A1491FB4D85320DA6EE256"><enum>(B)</enum><header>Wildlife

			 habitat mitigation</header><text>Land conveyed under subparagraph (A) shall be

			 used by the South Dakota Department of Game, Fish, and Parks for the purpose of

			 mitigating the wildlife habitat that was lost as a result of the development of

			 the Pick-Sloan project.</text>

					</subparagraph></paragraph><paragraph id="ID701AD23935CA4D0683E216C874BE64E3"><enum>(6)</enum><header>Use of

			 proceeds</header><text>Proceeds of sales of land under this Act shall be

			 deposited as miscellaneous funds in the Treasury and such funds shall be made

			 available, subject to appropriations, to the State for the establishment of a

			 trust fund to pay the county taxes on the lands received by the State

			 Department of Game, Fish, and Parks under the bill.</text>

				</paragraph></subsection><subsection id="IDD0A5D8979BB2480A9FA0E37C2B1FA100"><enum>(e)</enum><header>Conveyance of

			 nonpreferential lease parcels and unleased parcels</header>

				<paragraph id="ID30FCA1A029994E0AA745476F62B6CDF5"><enum>(1)</enum><header>Conveyance by

			 Secretary to State</header>

					<subparagraph id="ID3FD6EE41CC1A4FC5BB9792AD089358AD"><enum>(A)</enum><header>In

			 general</header><text>Not later than 1 year after the date of enactment of this

			 Act, the Secretary shall convey to the South Dakota Department of Game, Fish,

			 and Parks the nonpreferential lease parcels and unleased parcels of the Blunt

			 Reservoir and Pierre Canal.</text>

					</subparagraph><subparagraph id="IDEFBE7D21BFA943A893CCE40060A3C9A0"><enum>(B)</enum><header>Wildlife

			 habitat mitigation</header><text>Land conveyed under subparagraph (A) shall be

			 used by the South Dakota Department of Game, Fish, and Parks for the purpose of

			 mitigating the wildlife habitat that was lost as a result of the development of

			 the Pick-Sloan project.</text>

					</subparagraph></paragraph><paragraph id="ID68A9179C0D8740FFA89887BE21D183F2"><enum>(2)</enum><header>Land exchanges

			 for nonpreferential lease parcels and unleased parcels</header>

					<subparagraph id="IDCC16DDBDF9F145D0A7B9E8444398AD9D"><enum>(A)</enum><header>In

			 general</header><text>With the concurrence of the South Dakota Department of

			 Game, Fish, and Parks, the South Dakota Commission of Schools and Public Lands

			 may allow a person to exchange land that the person owns elsewhere in the State

			 for a nonpreferential lease parcel or unleased parcel at Blunt Reservoir or

			 Pierre Canal, as the case may be.</text>

					</subparagraph><subparagraph id="ID334971844B41480A89946E43387FA0D7"><enum>(B)</enum><header>Priority</header><text>The

			 right to exchange nonpreferential lease parcels or unleased parcels shall be

			 granted in the following order or priority:</text>

						<clause id="ID220D2356D78141E88207CD0044068900"><enum>(i)</enum><text>Exchanges with

			 current lessees for nonpreferential lease parcels.</text>

						</clause><clause id="ID202796936161464AB79B79F68B940412"><enum>(ii)</enum><text>Exchanges with

			 adjoining and adjacent landowners for unleased parcels and nonpreferential

			 lease parcels not exchanged by current lessees.</text>

						</clause></subparagraph><subparagraph id="IDD08FF7A771EE4F31B11E617FCC74AEF3"><enum>(C)</enum><header>Easement for

			 water conveyance structure</header><text>As a condition of the exchange of land

			 of the Pierre Canal Feature under this paragraph, the United States reserves a

			 perpetual easement to the land to allow for the right to design, construct,

			 operate, maintain, repair, and replace a pipeline or other water conveyance

			 structure over, under, across, or through the Pierre Canal feature.</text>

					</subparagraph></paragraph></subsection><subsection id="ID139EF5F72F074618A3C3F98531A01F17"><enum>(f)</enum><header>Release from

			 liability</header>

				<paragraph id="ID162D793A39F14C49A15F009653D02CCA"><enum>(1)</enum><header>In

			 general</header><text>Effective on the date of conveyance of any parcel under

			 this Act, the United States shall not be held liable by any court for damages

			 of any kind arising out of any act, omission, or occurrence relating to the

			 parcel, except for damages for acts of negligence committed by the United

			 States or by an employee, agent, or contractor of the United States, before the

			 date of conveyance.</text>

				</paragraph><paragraph id="ID0EAAAEEAB80D4D54901969F958D8F400"><enum>(2)</enum><header>No additional

			 liability</header><text>Nothing in this section adds to any liability that the

			 United States may have under chapter 171 of title 28, United States Code

			 (commonly known as the <quote>Federal Tort Claims Act</quote>).</text>

				</paragraph></subsection><subsection id="ID2F1588A212664639BE61A3B86D007146"><enum>(g)</enum><header>Requirements

			 concerning conveyance of lease parcels</header>

				<paragraph id="IDAFB4B1733EB840748576054C57621BBB"><enum>(1)</enum><header>Interim

			 requirements</header><text>During the period beginning on the date of enactment

			 of this Act and ending on the date of conveyance of the parcel, the Secretary

			 shall continue to lease each preferential lease parcel or nonpreferential lease

			 parcel to be conveyed under this section under the terms and conditions

			 applicable to the parcel on the date of enactment of this Act.</text>

				</paragraph><paragraph id="ID9FAE2F01EECC4F41A9A8C96FECB1D184"><enum>(2)</enum><header>Provision of

			 parcel descriptions</header><text>Not later than 180 days after the date of

			 enactment of this Act, the Secretary shall provide the State a full legal

			 description of all preferential lease parcels and nonpreferential lease parcels

			 that may be conveyed under this section.</text>

				</paragraph></subsection><subsection id="ID24532E4E109E47ACB2501E00E4773236"><enum>(h)</enum><header>Authorization

			 of appropriations</header><text>There is authorized to be appropriated to carry

			 out this Act $750,000 to reimburse the Secretary for expenses incurred in

			 implementing this Act, and such sums as are necessary to reimburse the

			 Commission for expenses incurred implementing this Act, not to exceed 10

			 percent of the cost of each transaction conducted under this Act.</text>
