		<official-title>To provide for ethics reform of the Federal judiciary and

		  to instill greater public confidence in the Federal courts.</official-title>

		<section id="IDD60F896EBC3144BC87ECD35F00E6427D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Federal Judiciary Ethics Reform Act of

			 2006</short-title></quote>.</text>

		</section><section id="IDD246992F9F0F492384B0357B8B6957B1"><enum>2.</enum><header>Judicial

			 Education Fund</header>

			<subsection id="ID023D5EB5B863448FAAF0F3A25C7B3820"><enum>(a)</enum><header>Establishment</header><text>Chapter

			 42 of title 28, United States Code, is amended by adding at the end the

			 following:</text>

				<quoted-block id="ID7825CEE7C2C242B5B7C417450352F6C5" style="USC">

					<section id="ID8732C66AFF104DBD8B6860249529E7A3"><enum>630.</enum><header>Judicial

				Education Fund</header>

						<subsection id="IDE3B0CD7A1E914DAFACF976E3DA35F2A7"><enum>(a)</enum><text>In this section,

				the term—</text>

							<paragraph id="ID4BF1E09C2DE44BBDBCDCAC2F37EDE4C0"><enum>(1)</enum><text><quote>institution

				of higher education</quote> has the meaning given under section 101(a) of the

				<act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/20/1001(a)">20 U.S.C.

				1001(a)</external-xref>);</text>

							</paragraph><paragraph id="ID6556BD94AC174642874657C1EAEB7F50"><enum>(2)</enum><text><quote>private

				judicial seminar</quote>—</text>

								<subparagraph id="IDF9FFA87497F44EE9941567A63773C8AD"><enum>(A)</enum><text>means a seminar,

				symposia, panel discussion, course, or a similar event that provides continuing

				legal education to judges; and</text>

								</subparagraph><subparagraph id="ID4B224BF2DCB7417AB329F217912178FE"><enum>(B)</enum><text>does not

				include—</text>

									<clause id="IDC55F81AB6105444EB455DBEAB8C31E98"><enum>(i)</enum><text>seminars that

				last 1 day or less and are conducted by, and on the campus of, an institute of

				higher education;</text>

									</clause><clause id="IDE433CB489C704BB1BB9DA9518DCD21E4"><enum>(ii)</enum><text>seminars that

				last 1 day or less and are conducted by national bar associations or State or

				local bar associations for the benefit of the bar association membership;

				or</text>

									</clause><clause id="ID6D3FDE370C614138970055DB7E6F2446"><enum>(iii)</enum><text>seminars of any

				length conducted by, and on the campus of an institute of higher education or

				by national bar associations or State or local bar associations, where a judge

				is a presenter and at which judges constitute less than 25 percent of the

				participants;</text>

									</clause></subparagraph></paragraph><paragraph id="IDA21F204F3F3E495FB83EE0A1C42C3DB4"><enum>(3)</enum><text><quote>national

				bar association</quote> means a national organization that is open to general

				membership to all members of the bar; and</text>

							</paragraph><paragraph id="ID192E7041A18A45A4008EEA82CF1EFA35"><enum>(4)</enum><text><quote>State or

				local bar association</quote> means a State or local organization that is open

				to general membership to all members of the bar in the specified geographic

				region.</text>

							</paragraph></subsection><subsection id="IDFB8DC169EC6B4EEC9533A39BE2956995"><enum>(b)</enum><text>There is

				established within the United States Treasury a fund to be known as the

				<quote>Judicial Education Fund</quote> (in this section referred to as the

				<quote>Fund</quote>).</text>

						</subsection><subsection id="ID74C61E660B674D76BDBD98F16268F475"><enum>(c)</enum><text>Amounts in the

				Fund may be made available for the payment of necessary expenses, including

				reasonable expenditures for transportation, food, lodging, private judicial

				seminar fees and materials, incurred by a judge or justice in attending a

				private judicial seminar approved by the Board of the Federal Judicial Center.

				Necessary expenses shall not include expenditures for recreational activities

				or entertainment other than that provided to all attendees as an integral part

				of the private judicial seminar. Any payment from the Fund shall be approved by

				the Board.</text>

						</subsection><subsection id="IDC5A93910D8D94E8B891C3616FF401722"><enum>(d)</enum><text>The Board may

				approve a private judicial seminar after submission of information by the

				sponsor of that private judicial seminar that includes—</text>

							<paragraph id="ID75D6B3ABB558403BB0244E142579D674"><enum>(1)</enum><text>the content of

				the private judicial seminar (including a list of presenters, topics, and

				course materials); and</text>

							</paragraph><paragraph id="ID9470DCF65DC24CC4B35BCED4D3977E81"><enum>(2)</enum><text>the litigation

				activities of the sponsor and the presenters at the private judicial seminar

				(including the litigation activities of the employer of each presenter) on the

				topic related to those addressed at the private judicial seminar.</text>

							</paragraph></subsection><subsection id="ID3FD0ABDBCFFB4B68A326C5D169825CA4"><enum>(e)</enum><text>If the Board

				approves a private judicial seminar, the Board shall make the information

				submitted under subsection (d) relating to the private judicial seminar

				available to judges and the public by posting the information on the

				Internet.</text>

						</subsection><subsection id="IDAEBEFCADB49B4DD789BABD055C5470CE"><enum>(f)</enum><text>The Judicial

				Conference shall promulgate guidelines to ensure that the Board only approves

				private judicial seminars that are conducted in a manner so as to maintain the

				public’s confidence in an unbiased and fair-minded judiciary.</text>

						</subsection><subsection id="IDC3A3653D6298490281D72EF5A665A8E9"><enum>(g)</enum><text>There are

				authorized to be appropriated for deposit in the Fund $2,000,000 for each of

				fiscal years 2006, 2007, and 2008, to remain available until

				expended.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="IDD7AD43EE47FF46C79D6D8843CCE56098"><enum>(b)</enum><header>Technical and

			 conforming amendment</header><text>The table of sections for chapter 42 of

			 title 28, United States Code, is amended by adding at the end the

			 following:</text>

			</subsection></section><section id="IDAC56CAEC3B0A4412B0FCC458C4D31F9C"><enum>3.</enum><header>Private judicial

			 seminar gifts prohibited</header>

			<subsection id="ID59084B2E7B1F450AAD9BE25E41CC3F07"><enum>(a)</enum><header>Definitions</header><text>In

			 this section, the term—</text>

				<paragraph id="ID0C09E2AF38A04BDA88563191386DFBB7"><enum>(1)</enum><text><quote>institution

			 of higher education</quote> has the meaning given under

			 <external-xref legal-doc="act" parsable-cite="HEA65/101(a)">section

			 101(a)</external-xref> of the <act-name parsable-cite="HEA65">Higher Education

			 Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001(a)">20 U.S.C. 1001(a)</external-xref>);</text>

				</paragraph><paragraph id="ID8957E77C84BF4D608BFBA17E006B6423"><enum>(2)</enum><text><quote>private

			 judicial seminar</quote>—</text>

					<subparagraph id="ID22F6F40D15F54521B9A0002B8F205B7F"><enum>(A)</enum><text>means a seminar,

			 symposia, panel discussion, course, or a similar event that provides continuing

			 legal education to judges; and</text>

					</subparagraph><subparagraph id="IDACEFDB1C489345E8B7FEB97FD7ED7499"><enum>(B)</enum><text>does not

			 include—</text>

						<clause id="IDD7FA6CF70C27420E857F66045C577CDC"><enum>(i)</enum><text>seminars that

			 last 1 day or less and are conducted by, and on the campus of, an institute of

			 higher education;</text>

						</clause><clause id="ID8CAC3FC9C5974EF49DD1AFB69E171033"><enum>(ii)</enum><text>seminars that

			 last 1 day or less and are conducted by national bar associations or State or

			 local bar associations for the benefit of the bar association membership;

			 or</text>

						</clause><clause id="IDBEE8FA2EAF8F46B09050FFDDEDA62EC0"><enum>(iii)</enum><text>seminars of any

			 length conducted by, and on the campus of an institute of higher education or

			 by national bar associations or State or local bar associations, where a judge

			 is a presenter and at which judges constitute less than 25 percent of the

			 participants;</text>

						</clause></subparagraph></paragraph><paragraph id="ID81F9B336D7FD4E9DB7BC69F8EBCCF0E9"><enum>(3)</enum><text><quote>national

			 bar association</quote> means a national organization that is open to general

			 membership to all members of the bar; and</text>

				</paragraph><paragraph id="ID06CF29759A0F4FFBA7150052AD1281B6"><enum>(4)</enum><text><quote>State or

			 local bar association</quote> means a State or local organization that is open

			 to general membership to all members of the bar in the specified geographic

			 region.</text>

				</paragraph></subsection><subsection id="ID36EAADA2B0174317BE32E5BC8399002E"><enum>(b)</enum><header>In

			 general</header><text>Not later than 240 days after the date of enactment of

			 this Act, the Judicial Conference of the United States shall promulgate

			 regulations to apply section 7353(a) of title 5, United States Code, to

			 prohibit the solicitation or acceptance of anything of value in connection with

			 a private judicial seminar.</text>

			</subsection><subsection id="IDD1A1AB827455416390001938437240DE"><enum>(c)</enum><header>Exception</header><text>The

			 prohibition under the regulations promulgated under subsection (b) shall not

			 apply if—</text>

				<paragraph id="IDB73D9B506D674DB796EE11AA05CC4B3B"><enum>(1)</enum><text>the judge

			 participates in a private judicial seminar as a speaker, panel participant, or

			 otherwise presents information;</text>

				</paragraph><paragraph id="IDE10D4296CBDA4F00A8259747E4772181"><enum>(2)</enum><text>Federal judges

			 are not the primary audience at the private judicial seminar; and</text>

				</paragraph><paragraph id="ID7BB7E4E4A6C34AEEBB45EF691F8B048D"><enum>(3)</enum><text>the thing of

			 value accepted is—</text>

					<subparagraph id="IDEC300EA6F2514654AE2BED060544A24F"><enum>(A)</enum><text>reimbursement

			 from the private judicial seminar sponsor of reasonable transportation, food,

			 or lodging expenses on any day on which the judge speaks, participates, or

			 presents information, as applicable;</text>

					</subparagraph><subparagraph id="ID89464181A92A4A95A12FFA997E499E55"><enum>(B)</enum><text>attendance at the

			 private judicial seminar on any day on which the judge speaks, participates, or

			 presents information, as applicable; or</text>

					</subparagraph><subparagraph id="IDEE2ECE86E1264E2DBB225B5BE9755947"><enum>(C)</enum><text>anything excluded

			 from the definition of a gift under regulations of the Judicial Conference of

			 the United States under sections 7351 and 7353 of title 5, United States Code,

			 as in effect on the date of enactment of this Act.</text>

					</subparagraph></paragraph></subsection></section><section id="ID1AD8C44879484642B27CC6C381D1CA6E"><enum>4.</enum><header>Recusal

			 lists</header><text display-inline="no-display-inline">Section 455 of title 28,

			 United States Code, is amended by adding at the end the following:</text>

			<quoted-block id="ID2AE469636ED04B0CADD89B38BE9E437F">

				<subsection id="ID05996F2B31974FA890691729340769F0"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="IDE02FCB25C18745C8828C3726BDD6E67E"><enum>(1)</enum><text>Each justice, judge,

				and magistrate of the United States shall maintain a list of all financial

				interests that would require disqualification under subsection (b)(4).</text>

					</paragraph><paragraph id="IDABA3A183EB894CE5B4A56826004D9989" indent="up1"><enum>(2)</enum><text>Each list maintained under paragraph

				(1) shall be made available to the public at the office of the clerk for the

				court at which a justice, judge, or magistrate is

				assigned.</text>

					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
