<section id="id4AAD6223353B4D0EB92D97398FB75C2A"><enum>111.</enum><header>Definitions</header><text display-inline="no-display-inline">Unless otherwise specified in this subtitle, the terms used in this subtitle have the meanings given the terms in section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801).</text> </section><chapter id="idDC6F6B3F65A949D69B1FA5085E14F894"><enum>1</enum><header>MATH AND SCIENCE TEACHERS</header> <section id="id75AF29EB5987492A99FC92AF5E49F974"><enum>121.</enum><header>Baccalaureate degrees in mathematics and science with teacher certification</header> <subsection id="id3927AF853520434D843DA0D3A61C3513"><enum>(a)</enum><header>Grants authorized</header><text>From the amounts authorized under subsection (g), the Secretary shall award grants to eligible recipients to enable the eligible recipients to provide integrated courses of study in mathematics, science, or engineering and teacher education, that lead to a baccalaureate degree in mathematics, science, or engineering with concurrent teacher certification.</text> </subsection><subsection id="id4F136AB5F95D4E9CA65BA09B1CA42581"><enum>(b)</enum><header>Definition of eligible recipient</header><text>In this section, the term <term>eligible recipient</term> means any department of mathematics, science, or engineering of an institution of higher education.</text> </subsection><subsection id="id77A93FF9C87E4CC0AA0F8134DAF04F27"><enum>(c)</enum><header>Award and duration</header> <paragraph id="id6CBCFDCEEF814789A9966F4E4C5D9771"><enum>(1)</enum><header>Award</header><text>The Secretary shall award a grant under this section to each eligible recipient that collaborates with a teacher preparation program at an institution of higher education to develop undergraduate degrees in mathematics, science, or engineering with pedagogy education and teacher certification.</text> </paragraph><paragraph id="id57ABC654236C4FA394D191FC657F6687"><enum>(2)</enum><header>Duration</header><text>The Secretary shall award a grant under this section to each eligible recipient in an amount that is not more than $1,000,000 per year for a period of 5 years.</text> </paragraph></subsection><subsection id="id23DD86D172674CD788756226BA6E4359"><enum>(d)</enum><header>Matching requirement</header><text>Each eligible recipient receiving a grant under this section shall provide, from non-Federal sources (provided in cash or in kind), to carry out the activities supported by the grant, an amount that is not less than 25 percent of the amount of the grant for the first year of the grant, not less than 35 percent of the amount of the grant for the second year of the grant, and not less than 50 percent of the amount of the grant for each succeeding fiscal year of the grant.</text> </subsection><subsection id="id0EF0E61B2AC6467AAFDD9D87662F7FE0"><enum>(e)</enum><header>Application</header> <paragraph id="idD08418523ACD4C8FA8E384C8516CC122"><enum>(1)</enum><header>In general</header><text>Each eligible recipient desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and accompanied by such information as the Secretary may require.</text> </paragraph><paragraph id="idF28C255A25FE48B88BC3250D0D7FB1DB"><enum>(2)</enum><header>Contents</header><text>Each application submitted pursuant to paragraph (1) shall include—</text> <subparagraph id="id116912601733447CB00895A85A97506E"><enum>(A)</enum><text>a description of how the eligible recipient will use grant funds to develop and administer undergraduate degrees in mathematics, science, or engineering with pedagogy education and teacher certification, including a description of proposed high-quality research and laboratory experiences that will be available to students;</text> </subparagraph><subparagraph id="id3C9521C3C3F245DC8F6BBF94BC4D59C1"><enum>(B)</enum><text>a description of how the mathematics, science, or engineering departments will coordinate with a teacher preparation program to carry out the activities authorized under this section;</text> </subparagraph><subparagraph id="id3EF574F2DCEE47B18A219183A5A10E00"><enum>(C)</enum><text>a resource assessment that describes the resources available to the eligible recipient, the intended use of the grant funds, and the commitment of the resources of the eligible recipient to the activities assisted under this section, including financial support, faculty participation, time commitments, and continuation of the activities assisted under the grant when the grant period ends;</text> </subparagraph><subparagraph id="idA7837A34B65B43A7A0000D359067B92F"><enum>(D)</enum><text>an evaluation plan, including measurable objectives and benchmarks for—</text> <clause id="idDCB3ED7F5BA94D118A830BA116D831B6"><enum>(i)</enum><text>improving student retention;</text> </clause><clause id="idFEB9494492F8429DAA21E7B677C7A591"><enum>(ii)</enum><text>increasing the percentage of highly qualified mathematics and science teachers; and</text> </clause><clause id="id325DEAB2865941D8ACA6248D0E66E8F7"><enum>(iii)</enum><text>improving kindergarten through grade 12 student academic performance in mathematics and science;</text> </clause></subparagraph><subparagraph id="idD4BC0365210C4FFAB3C95A57DB662494"><enum>(E)</enum><text>a description of the activities the eligible recipient will conduct to ensure graduates of the program keep informed of the latest developments in the respective fields;</text> </subparagraph><subparagraph id="IDec20df711b694bcb967bcee54c8b6f2e"><enum>(F)</enum><text>a description of how the eligible recipient will work with local educational agencies in the area in which the eligible recipient is located and, to the extent practicable, with local educational agencies where graduates of the program authorized under this section are employed, to ensure that the activities required under subsection (f)(3) are carried out; and</text> </subparagraph><subparagraph id="IDb1e56b1710b04e2fbe0ae7dfba78cab0"><enum>(G)</enum><text>a description of efforts to encourage applications to the program from underrepresented groups, including women and minority groups.</text> </subparagraph></paragraph></subsection><subsection id="idB88562C5AFBD47D593190EEE0E5D593C"><enum>(f)</enum><header>Authorized activities</header><text>An eligible recipient shall use the funds received under this section—</text> <paragraph id="ID2683da6f04304b5291bb1ed35e694812"><enum>(1)</enum><text>to develop and administer teacher education and certification programs with in-depth content education and subject-specific education in pedagogy, leading to baccalaureate degrees in mathematics, science, or engineering with concurrent teacher certification;</text> </paragraph><paragraph id="ID4ddd999c789144a8b9057bc3e4a17e0f"><enum>(2)</enum><text>to offer high-quality research experiences and training in the use of educational technology; and</text> </paragraph><paragraph id="ID1a996009466d46d78eedf1e25989d5c4"><enum>(3)</enum><text>to work with local educational agencies in the area in which the eligible recipient is located and, to the extent practicable, with local educational agencies where graduates of the program authorized under this section are employed, to support the new teachers during the initial years of teaching, which may include—</text> <subparagraph id="IDbb860defe0f84167a1adc1744a5a4534"><enum>(A)</enum><text>promoting effective teaching skills;</text> </subparagraph><subparagraph id="ID700bc0fda43e414fbfa8e9d6a5d7c2fc"><enum>(B)</enum><text>development of skills in educational interventions based on scientifically-based research;</text> </subparagraph><subparagraph id="IDd0afc8518ba6464fa44f6a735e0e2104"><enum>(C)</enum><text>providing opportunities for high-quality teacher mentoring;</text> </subparagraph><subparagraph id="IDc3398edf86114cc89ad0adc271259c92"><enum>(D)</enum><text>providing opportunities for regular professional development;</text> </subparagraph><subparagraph id="ID7cd29fa54d1e4060a1261c7e90d6a094"><enum>(E)</enum><text>interdisciplinary collaboration among exemplary teachers, faculty, researchers, and other staff who prepare new teachers; and</text> </subparagraph><subparagraph id="IDeac5b4b27078413e9198cf90c421c181"><enum>(F)</enum><text>allowing time for joint lesson planning and other constructive collaborative activities.</text> </subparagraph></paragraph></subsection><subsection id="id1564CAE073F74D878272F0D9E379678E"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> <paragraph id="idB535D2BECF7B4B6D814B12BE2A02E437"><enum>(1)</enum><text>$30,000,000 for fiscal year 2007;</text> </paragraph><paragraph id="id36857061939145D18FC0C7E51CEBE488"><enum>(2)</enum><text>$90,000,000 for fiscal year 2008;</text> </paragraph><paragraph id="idE838FDAB543A42BBA9F1D280D24836B6"><enum>(3)</enum><text>$190,000,000 for fiscal year 2009;</text> </paragraph><paragraph id="id298531603C894A8B9573341ED79AC824"><enum>(4)</enum><text>$290,000,000 for fiscal year 2010;</text> </paragraph><paragraph id="id263A8C215C574E9E9588B7E00B70D157"><enum>(5)</enum><text>$390,000,000 for fiscal year 2011;</text> </paragraph><paragraph id="id769E52398676445DB01D6E5CE9A17E25"><enum>(6)</enum><text>$500,000,000 for fiscal year 2012; and</text> </paragraph><paragraph id="id0A53770293D649C59FD1944E57EAC159"><enum>(7)</enum><text>$500,000,000 for fiscal year 2013.</text> </paragraph></subsection></section><section id="idA503C477DCD144019FB5B2C88B45BC8B"><enum>122.</enum><header>Master's degrees in mathematics and science education for teachers</header> <subsection id="idD8C8EA5E937A4A3EA86C53F282930688"><enum>(a)</enum><header>Purposes</header><text>The purpose of this section is provide competitive institutional grants for eligible recipients to develop part-time, 3-year master’s degree programs in mathematics and science education for teachers in order to enhance the content knowledge and pedagogical skills of teachers.</text> </subsection><subsection id="idD74F59967AC74768978B66DB6AEE509E"><enum>(b)</enum><header>Definition of eligible recipient</header><text>In this section, the term <term>eligible recipient</term> means a mathematics, science, or engineering department of an institution of higher education.</text> </subsection><subsection id="id33F784894FF048F186BD51E35F2EAFC4"><enum>(c)</enum><header>Grants authorized</header> <paragraph id="id059B605953EB44E58DECD00467BE41F0"><enum>(1)</enum><header>Grants to eligible recipients</header><text>From the amounts authorized under subsection (i), the Secretary is authorized to award grants of not more than $1,000,000, on a competitive basis, to eligible recipients to enable the eligible recipients to carry out the authorized activities described in subsection (f).</text> </paragraph><paragraph id="idAE9B4BEB02B5464CAC2BAABF73BE36BE"><enum>(2)</enum><header>Qualification</header><text>In order to qualify for a grant under this section, an eligible recipient shall collaborate with a teacher preparation program of an institution of higher education.</text> </paragraph></subsection><subsection id="id19333B340BE141E09466CB60D61F0F9A"><enum>(d)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an eligible recipient shall submit an application to the Secretary that—</text> <paragraph id="id0DF22B577B984E009F45016B5618F5FD"><enum>(1)</enum><text>meets the requirements of this section;</text> </paragraph><paragraph id="id7732CCD8796548BF8AC1F39522D75C3D"><enum>(2)</enum><text>includes a description of how the eligible recipient intends to use the grant funds provided under this section;</text> </paragraph><paragraph id="idE39129BB6986420B904EE4AD689BBE59"><enum>(3)</enum><text>contains such information and assurances as the Secretary may require;</text> </paragraph><paragraph id="id15264E12C8D246FDAA3DBE55F7934872"><enum>(4)</enum><text>describes how the eligible recipient will prepare teachers to become more effective mathematics or science teachers;</text> </paragraph><paragraph id="id7FBF5E81E481455FA12C7B8B85468448"><enum>(5)</enum><text>describes how the eligible recipient will coordinate with a teacher preparation program, and how the activities of the eligible recipient will be consistent with State, local, and other education reform activities that promote student achievement;</text> </paragraph><paragraph id="id6857ECF7EB1547CA9EF03FE4B6BD2568"><enum>(6)</enum><text>describes the resources available to the eligible recipient, the intended use of the grant funds, and the commitment of resources of the eligible recipient to the activities assisted under this section, including financial support, faculty participation, time commitments, and continuation of the activities when the grant period ends;</text> </paragraph><paragraph id="id2ED79BF7569A470BB791F0F9F2258662"><enum>(7)</enum><text>provides an evaluation plan pursuant to subsection (g);</text> </paragraph><paragraph id="idA2FDADFC1C1A42DAB0743A9F9D11D437"><enum>(8)</enum><text>describes how the eligible recipient will align the proposed master’s degree program with challenging student academic achievement standards, and challenging academic content standards, established by the State in which the eligible recipient is located;</text> </paragraph><paragraph id="id8BF0236BB9E247F5B987D93AFCC145D4"><enum>(9)</enum><text>describes the activities the eligible recipient will undertake to ensure that local educational agencies in the geographic areas served by the eligible recipient are provided information about the activities carried out with grant funds under this section; and</text> </paragraph><paragraph id="id22AAF0E9F5C346C4925C61744B29B919"><enum>(10)</enum><text>describes how the eligible recipient will encourage applications to the program from underrepresented groups, including women and minority groups.</text> </paragraph></subsection><subsection id="idA526A4BC04544E5FA27782BF91D7A87A"><enum>(e)</enum><header>Priority</header><text>The Secretary may give priority consideration to applications that demonstrate that the eligible recipient shall—</text> <paragraph id="id22024B9854954749BAA54A96F00323E2"><enum>(1)</enum><text>consult with local educational agencies in developing and administering master’s degree programs;</text> </paragraph><paragraph id="id00683C0940CD4798A32B6CE03930FB60"><enum>(2)</enum><text>use online technology to allow for flexibility in the pace at which candidates complete the master's degree programs; and</text> </paragraph><paragraph id="id99CFAEF6F06D42A1BD2ECE733BC51AAB"><enum>(3)</enum><text>develop innovative efforts aimed at reducing the shortage of master’s degree level mathematics or science teachers in low-income urban or rural areas.</text> </paragraph></subsection><subsection id="id1AF9EFBAC99841579752F99E0C903E3B"><enum>(f)</enum><header>Authorized activities</header><text>An eligible recipient shall use the grant funds received under this section to develop part-time, 3-year master’s degree programs in mathematics and science education for teachers, conducted over 3 full-time summer sessions, and alternate weekends during the academic year, as appropriate, which shall include—</text> <paragraph id="id0FE5F4DF854C486E820F49AD0402CCA7"><enum>(1)</enum><text>developing courses that—</text> <subparagraph id="id573B75F4967F46D78E36F45B7AAA21A0"><enum>(A)</enum><text>are based on rigorous mathematics and science content and aligned with challenging State academic content standards;</text> </subparagraph><subparagraph id="idAF81EBD36AB04B5DB72BD0230EB54A3A"><enum>(B)</enum><text>promote effective teaching skills; and</text> </subparagraph><subparagraph id="id7CE5950ED15C4DD8B5378E9DB843BB4A"><enum>(C)</enum><text>promote understanding of effective instructional strategies for students with special needs, including students with disabilities, students who are limited English proficient, and students who are gifted and talented;</text> </subparagraph></paragraph><paragraph id="idFB260EC4F4BF4838AAB5C2D784E7812F"><enum>(2)</enum><text>hiring and training professional staff to administer the program;</text> </paragraph><paragraph id="id7D23944A95FC4B97980E832E12186F9C"><enum>(3)</enum><text>purchasing equipment for computer and teaching aids;</text> </paragraph><paragraph id="id2C89F2849DAF4B39B688061C69B1EC58"><enum>(4)</enum><text>providing educational instruction for not fewer than 20 teachers per year;</text> </paragraph><paragraph id="idD38B8329F851477E85B0C2B9C56A81D6"><enum>(5)</enum><text>providing stipends to help support the participants in the form of tuition reimbursement and travel expenses; and</text> </paragraph><paragraph id="id5435676F2CF94442B9E4E510EC32F5B6"><enum>(6)</enum><text>creating opportunities for clinical experience and training for teachers through participation with professionals in business, research, and work environments relating to mathematics, science, or engineering, including opportunities for using laboratory equipment.</text> </paragraph></subsection><subsection id="id0FF06A49FF0E4E7CB0ECFBF7E9255163"><enum>(g)</enum><header>Annual evaluation</header><text>Each eligible recipient shall establish and include in the application submitted pursuant to section (d) an evaluation plan that includes strong performance objectives. The plan shall include objectives and measures for increasing—</text> <paragraph id="id82016E21B7634C3CAA5D77CB33ADBAC6"><enum>(1)</enum><text>the percentage of master’s degree level mathematics or science teachers hired by the State in which the eligible recipient is located;</text> </paragraph><paragraph id="id4346A4A0D9F34BF3B4DA463A1EF93005"><enum>(2)</enum><text>teacher retention;</text> </paragraph><paragraph id="idB7E189FA60F2420E867AE9438CED18E3"><enum>(3)</enum><text>the percentage of master’s degree level mathematics or science teachers serving in high-need schools;</text> </paragraph><paragraph id="id54B2B9DEB5C64491B76B095607CC6535"><enum>(4)</enum><text>the percentage of master’s degree level mathematics or science teachers among underrepresented groups; and</text> </paragraph><paragraph id="id39E9D1DEB22547CB83E1E7A364F32310"><enum>(5)</enum><text>the competencies of program graduates in their respective fields of mathematics or science.</text> </paragraph></subsection><subsection id="idFF82E09DCCCD4288932C8F683B7DCF1E"><enum>(h)</enum><header>Graduate fellowships</header><text>An individual who has received a master’s degree in mathematics or science education under a program developed pursuant to this section and who meets the requirements of section 141(b)(2) shall be eligible for a fellowship authorized under such section 141(b)(2).</text> </subsection><subsection id="id95DB0B586F774718AF87717DC2CB8F89"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> <paragraph id="idBF8BEC251FE54E91911D4C8ECD6EE934"><enum>(1)</enum><text>$200,000,000 for fiscal year 2007;</text> </paragraph><paragraph id="idABE3DD8673E94A8FBE97B49DD91B8E3A"><enum>(2)</enum><text>$500,000,000 for fiscal year 2008;</text> </paragraph><paragraph id="id15EDC8FEA326444CA2E14D7EF0BCB457"><enum>(3)</enum><text>$500,000,000 for fiscal year 2009;</text> </paragraph><paragraph id="idF07EA46A58864463BFAD3CA3489A7E24"><enum>(4)</enum><text>$500,000,000 for fiscal year 2010;</text> </paragraph><paragraph id="id5B86F89803C848F5B3601892AD7005D4"><enum>(5)</enum><text>$500,000,000 for fiscal year 2011;</text> </paragraph><paragraph id="id60DB5FBC840C4877B7164076ECBBAA89"><enum>(6)</enum><text>$500,000,000 for fiscal year 2012; and</text> </paragraph><paragraph id="idEEAB3B3F91E944F0B37031E1323001B3"><enum>(7)</enum><text>$500,000,000 for fiscal year 2013.</text> </paragraph></subsection></section></chapter><chapter id="idB4B2C1A8784740C3A2BD29F4A36293C2"><enum>2</enum><header>NATIONAL SCIENCE FOUNDATION SCHOLARSHIPS AND FELLOWSHIPS </header> <subchapter id="idC3CE700D26EB4B9680501ACBA85FCDA4"><enum>A</enum><header>National science foundation scholarships for mathematics and science teachers</header> <section id="id5D34B6E4374E4FEA9AD55A10430113D5"><enum>131.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this subchapter is to annually recruit and train 10,000 new mathematics and science teachers by providing scholarships for undergraduate courses of study leading to baccalaureate degrees in mathematics, science, or engineering, with concurrent teacher certification.</text> </section><section id="id1B0FEA3A3B0547EBA4BADBACF19BCF84"><enum>132.</enum><header>Recruiting and training new mathematics and science teachers</header> <subsection id="ID68e8761c92374fb68adb96f508518923"><enum>(a)</enum><header>Grants authorized</header><text>From the amounts authorized under subsection (g), the Director of the National Science Foundation (referred to in this section as the <quote>Director</quote>) shall award merit-based undergraduate scholarships to eligible students to assist the eligible students in paying their college education expenses, which shall include tuition, fees, books, supplies, and equipment required for courses of instruction.</text> </subsection><subsection id="ID7d95775b6c7e4796828cc34104609eea"><enum>(b)</enum><header>Definition of eligible student</header><text>In this section, the term <term>eligible student</term> means a student who—</text> <paragraph id="id46207207FC1C42348FDCC89EAE556700"><enum>(1)</enum><text>attends an institution of higher education;</text> </paragraph><paragraph id="IDdf098cb9c92c4c70a96ae4ec5d5edac6"><enum>(2)</enum><text>is majoring in mathematics, science, or engineering;</text> </paragraph><paragraph id="IDd0fdd559787045f9bacf7b65d0b483cd"><enum>(3)</enum><text>is pursuing concurrent certification in teaching; and</text> </paragraph><paragraph id="id0AD7A76D890B446F9C453A4DC0B4D8FB"><enum>(4)</enum><text>demonstrates continued academic achievement and progress, as determined by the Director, toward completion of a baccalaureate degree in mathematics, science, or engineering with concurrent certification in teaching.</text> </paragraph></subsection><subsection id="ID67f3be0bb47640c1bd3e3e5796416933"><enum>(c)</enum><header>Awards</header><text>The Director shall award a scholarship under this section to an eligible student in an amount that is not greater than $20,000 per academic year for not more than 4 years of undergraduate study. The amount awarded for each academic year shall not exceed the student’s cost of attendance for the academic year.</text> </subsection><subsection id="IDf00e2a79c3e44bd6a493a646fa4cb159"><enum>(d)</enum><header>Service Requirements</header> <paragraph id="ID3cc854fb5f374859937041c1215b6249"><enum>(1)</enum><header>Service requirement</header><text>An individual who is awarded a scholarship under this section shall enter into an agreement with the Director under which the individual agrees to be employed for not less than 5 academic years as a full-time mathematics, science, or elementary school teacher in a public elementary school or secondary school, or 4 academic years as a full-time mathematics, science, or elementary school teacher in a public elementary school or secondary school—</text> <subparagraph id="IDa808bad4632c4cc59defcd822c873c8f"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id5123E673D42A4FE49EE9A4A77A9D984D"><enum>(i)</enum><text>in which not less than 40 percent of the children enrolled in the school are from low-income families; or</text> </clause><clause id="id3132027728494AB78C762CFAAB3E8737" indent="up1"><enum>(ii)</enum><text>designated with a school locale code of 7 or 8, or otherwise designated as a rural school, as determined by the Secretary; and</text> </clause></subparagraph><subparagraph id="id7243B8846BD945368BD15A3A831AE146"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id8846C22F49E84379B073ADEE6018AB79"><enum>(i)</enum><text>in which there is a higher percentage of teachers not teaching in the academic subject areas or grade levels in which the teachers were trained to teach; or</text> </clause><clause id="id4595C908A75F4036BCD9DB5420BE9A97" indent="up1"><enum>(ii)</enum><text>in which there is a high teacher turnover rate or a high percentage of teachers with emergency, provisional, or temporary certification or licenses.</text> </clause></subparagraph></paragraph><paragraph id="id7C7579ECC0794120839BDF6B88AF4A44"><enum>(2)</enum><header>Coordination with the secretary of education</header><text>The Director shall coordinate with the Secretary to determine whether an individual who receives a scholarship award under this section is employed as a full-time mathematics, science, or elementary school teacher in accordance with paragraphs (1), (3), and (4).</text> </paragraph><paragraph id="IDc70d36b034b8418ab4c42abdbd8ef2ae"><enum>(3)</enum><header>Failure to comply</header><text>If an individual who receives a scholarship award under this section fails to comply with the agreement entered into pursuant to paragraph (1), the Director shall take 1 or more of the following actions:</text> <subparagraph id="IDcdafafec2d284974966e964a69863521"><enum>(A)</enum><text>Require the individual to repay all or the applicable portion of the total scholarship amount awarded to the individual under this section.</text> </subparagraph><subparagraph id="IDe6c07a3566bf40f7ac023e6683547511"><enum>(B)</enum><text>Impose a fine or penalty in an amount to be determined by the Director.</text> </subparagraph></paragraph><paragraph id="ID0d8682df2a154464851d12c71e104834"><enum>(4)</enum><header>Regulations</header><text>The Director shall promulgate regulations setting forth the terms of repayment and the criteria to be considered in granting a waiver for the service requirements. Such criteria shall include whether compliance with the service requirements is inequitable and represents undue hardship.</text> </paragraph></subsection><subsection id="ID04c6ea0fe67847df8a02d93749ed938f"><enum>(e)</enum><header>Coordination with the secretary of defense</header><text>The Director shall coordinate with the Secretary of Defense to ensure members of the Armed Forces are aware of the educational opportunity under this section, particularly members of the Armed Forces who have training in engineering.</text> </subsection><subsection id="IDc0079c7b1b7144dfbf12d992fa2748ae"><enum>(f)</enum><header>Fellowships</header><text>An individual shall be eligible for a fellowship under section 141(b)(1) if the individual—</text> <paragraph id="ID74c7850f796a43d3a539b331856956a7"><enum>(1)</enum><text>has received a baccalaureate degree in mathematics, science, or engineering, and concurrent certification in teaching;</text> </paragraph><paragraph id="ID83e0364393f44abfa86ce332d6423d36"><enum>(2)</enum><text>has received a scholarship award under this section; and</text> </paragraph><paragraph id="IDabfee423d845416c84ea6edf0db964c0"><enum>(3)</enum><text>meets the requirements of section 141(b)(1).</text> </paragraph></subsection><subsection id="ID87056ed4434c485187ceea0ccdb93ecf"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> <paragraph id="ID3f011d45fd2a4cf48b3eb49562642154"><enum>(1)</enum><text>$50,000,000 for fiscal year 2007;</text> </paragraph><paragraph id="IDe0e360b6fecb4ba685038b312da79e36"><enum>(2)</enum><text>$100,000,000 for fiscal year 2008;</text> </paragraph><paragraph id="IDc9e26f47896a40c7baf3cf3a1b18da8b"><enum>(3)</enum><text>$150,000,000 for fiscal year 2009;</text> </paragraph><paragraph id="IDa653565431af424d80c5e3c9a284e805"><enum>(4)</enum><text>$170,000,000 for fiscal year 2010;</text> </paragraph><paragraph id="ID97e7d1c9e1b24ba1a94e38c485b258ea"><enum>(5)</enum><text>$170,000,000 for fiscal year 2011;</text> </paragraph><paragraph id="IDc9bcbdce924e453fb927f4a85a30f9de"><enum>(6)</enum><text>$170,000,000 for fiscal year 2012; and</text> </paragraph><paragraph id="ID914c97f4a4dd4872bdd09d27be16ba78"><enum>(7)</enum><text>$170,000,000 for fiscal year 2013.</text> </paragraph></subsection></section></subchapter><subchapter id="id902B7E350C3842A1964E81772C30FF78"><enum>B</enum><header>National science foundation fellowships for mathematics and science teachers</header> <section id="id690A0EE8E00C4B408554D3C8559A817E"><enum>141.</enum><header>National Science Foundation fellowships for mathematics and science teachers</header> <subsection id="IDf51551b9a93040a88d5206b7a394f163"><enum>(a)</enum><header>Fellowship authorized</header><text>The Director of the National Science Foundation (referred to in this section as the <quote>Director</quote>) is authorized to award fellowships to individuals, as described in subsection (b), a portion of which shall be used for continuing education and professional development activities.</text> </subsection><subsection id="ID571fbe2cf4274e0f868a52d0eeb9f820"><enum>(b)</enum><header>Fellowship awards</header><text>The Director shall award the following fellowships:</text> <paragraph id="IDddf3260a605747478e16eae04f3488be"><enum>(1)</enum><text>The Director shall award $10,000 annually for 4 academic years to an individual who meets the following criteria:</text> <subparagraph id="id4D321BDC51F440D48B802609AF8C19E2"><enum>(A)</enum><text>The individual has received a baccalaureate degree in mathematics, science, or engineering, and concurrent certification in teaching.</text> </subparagraph><subparagraph id="idA41C8674C14F4FBCA666578CBA25CE1C"><enum>(B)</enum><text>The individual received a scholarship award under section 132.</text> </subparagraph><subparagraph id="id4EAF8C66B2A845DC81D8B55E9AAAF1F3"><enum>(C)</enum><text>The individual is employed as a full-time mathematics, science, or elementary school teacher in a public elementary school or secondary school—</text> <clause id="ID34c57e10bb5645a989bd328d21f69b0b"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id0577DF9B26164A59B394F9DAC4E05698"><enum>(I)</enum><text>in which not less than 40 percent of the children enrolled in the school are from low-income families; or</text> </subclause><subclause id="id4763982B8D8946769D0A8806A3ECF7B1" indent="up1"><enum>(II)</enum><text>designated with a school locale code of 7 or 8, or otherwise designated as a rural school, as determined by the Secretary; and</text> </subclause></clause><clause id="IDcfd57ebd89b24faaaa510cd3b516f8f2"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id11F5FEA9C1034590A0DC15DD1CAE0C6D"><enum>(I)</enum><text>in which there is a high percentage of teachers not teaching in the academic subject areas or grade levels in which the teachers were trained to teach; or</text> </subclause><subclause id="id5EA01F78037B493CA810979FBA47187E" indent="up1"><enum>(II)</enum><text>in which there is a high teacher turnover rate or a high percentage of teachers with emergency, provisional, or temporary certification or licenses.</text> </subclause></clause></subparagraph></paragraph><paragraph id="ID1132848080f849af80525f56cd79924b"><enum>(2)</enum><text>The Director shall award $10,000 annually for 5 academic years to an individual who has received a master’s degree in mathematics or science education under a program developed pursuant to section 122 and who undertakes increased responsibilities, such as teacher mentoring and other leadership activities.</text> </paragraph></subsection><subsection id="IDb395c9570a6b440ea6937c397ac64d80"><enum>(c)</enum><header>Application</header><text>An individual desiring a fellowship under this section shall submit an application to the Director at such time, in such manner, and accompanied by such information as the Director may require. Each application shall include assurances that the individual meets the requirements of the fellowship for which the individual is applying.</text> </subsection><subsection id="ID60a302ee9c414e30ad87c586fbbf5cf2"><enum>(d)</enum><header>Coordination</header><text>The Director shall coordinate with the Secretary to determine whether an individual who receives a fellowship under this section meets the requirements of this section.</text> </subsection><subsection id="ID1b5d735922c7489cac75f5bb5da78734"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated—</text> <paragraph id="ID7661d80b4d164725a3264c21dc427644"><enum>(1)</enum><text>to carry out subsection (b)(1)—</text> <subparagraph id="ID3eb54b09565845a68cd1d962e0729e6f"><enum>(A)</enum><text>$5,000,000 for fiscal year 2008;</text> </subparagraph><subparagraph id="IDd7efceb57fed48fc90897fc8a176f20a"><enum>(B)</enum><text>$15,000,000 for fiscal year 2009;</text> </subparagraph><subparagraph id="ID75992e21d1fc42e3b251bacb72564eba"><enum>(C)</enum><text>$30,000,000 for fiscal year 2010;</text> </subparagraph><subparagraph id="IDc49afa25fc4e4b68abf6cd584469d1d6"><enum>(D)</enum><text>$45,000,000 for fiscal year 2011;</text> </subparagraph><subparagraph id="ID830964c3493f4483ba2efaa03d6653f0"><enum>(E)</enum><text>$45,000,000 for fiscal year 2012; and</text> </subparagraph><subparagraph id="ID245e225de5854e43aa4941fa6bdb29b3"><enum>(F)</enum><text>$45,000,000 for fiscal year 2013; and</text> </subparagraph></paragraph><paragraph id="ID17d49dbf2e444eb28dcbadf14f2ea039"><enum>(2)</enum><text>to carry out subsection (b)(2)—</text> <subparagraph id="ID439cf773506c478587195bff4396c405"><enum>(A)</enum><text>$100,000,000 for fiscal year 2010;</text> </subparagraph><subparagraph id="ID95d0524db4f04a99a7b6a8261776f4c7"><enum>(B)</enum><text>$200,000,000 for fiscal year 2011;</text> </subparagraph><subparagraph id="ID6a72e170b6de45da8e0b7c3ab969e285"><enum>(C)</enum><text>$300,000,000 for fiscal year 2012; and</text> </subparagraph><subparagraph id="ID810c81b4b6aa4e3cb8bc7ac27ea32bf5"><enum>(D)</enum><text>$400,000,000 for fiscal year 2013.</text> </subparagraph></paragraph></subsection></section></subchapter></chapter><chapter id="idB0B4A0E427354EBBBBE3ECEE2D664B1C"><enum>3</enum><header>ADVANCED PLACEMENT AND INTERNATIONAL BACCALAUREATE PROGRAMS</header> <section id="id3875A4D5D1714EC89CA911B526E3D8DD"><enum>151.</enum><header>Advanced Placement and International Baccalaureate Programs</header> <subsection id="ID928bf3079b9649a493a148b9e9750040"><enum>(a)</enum><header>Purpose</header><text>The purposes of this section are—</text> <paragraph id="IDed82279a909c410ebd1d6b38ce960f8d"><enum>(1)</enum><text>to educate an additional 70,000 Advanced Placement (AP) or International Baccalaureate (IB) and 80,000 pre-AP or pre-IB teachers of mathematics and science over the 5 year period beginning with 2007; and</text> </paragraph><paragraph id="ID0e7ede757c9b4781ac55d9a396436218"><enum>(2)</enum><text>to triple to 1,500,000 the number of students who take AP and IB mathematics and science examinations.</text> </paragraph></subsection><subsection id="ID33136653f21b4d7bb1b96cf3e9f94879"><enum>(b)</enum><header>Grants authorized</header> <paragraph id="id09365DDEA8274E2EA2DFC3FBDF7B59FE"><enum>(1)</enum><header>In general</header><text>From the amounts authorized under subsection (i), the Secretary shall award grants, on a competitive basis, to eligible recipients to enable the eligible recipients to carry out the activities authorized in subsection (f).</text> </paragraph><paragraph id="id6034E086BCAD4D75A1A2A1EBE4412054"><enum>(2)</enum><header>Limitation</header><text>An eligible recipient may not receive more than 1 grant at a time under this section to undertake authorized activities within the same State.</text> </paragraph></subsection><subsection id="ID2e689897bb64498e87ee52033e59a107"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="IDb3786a1044fe42f3aa0049d7ceb7a179"><enum>(1)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> means a nonprofit educational entity with expertise in Advanced Placement or International Baccalaureate services.</text> </paragraph><paragraph id="ID08932483172541e98cf8a3192f4e9852"><enum>(2)</enum><header>Master teacher</header><text>The term <term>master teacher</term> means a teacher—</text> <subparagraph id="id4B1D19D6AE3B4AF096650721B2840AFD"><enum>(A)</enum><text>with an advanced degree or an advanced certification;</text> </subparagraph><subparagraph id="idE2CBE9737EBE44929D3C36263358E492"><enum>(B)</enum><text>who uses the most effective teaching methods in the teacher’s disciplines; and</text> </subparagraph><subparagraph id="idB7E06EEC57CD4BDF989DC6C2E19E2F5E"><enum>(C)</enum><text>who has shown demonstrable results of higher student achievement in mathematics or science.</text> </subparagraph></paragraph></subsection><subsection id="IDb7e9eba3e77143188a73cdfa4080fd89"><enum>(d)</enum><header>Application</header> <paragraph id="ID423d5a00be3d41a39cc2d2f6ed278a88"><enum>(1)</enum><header>In general</header><text>Each eligible recipient desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and accompanied by such information as the Secretary may require.</text> </paragraph><paragraph id="ID557ada6ef3224f0fa31383c475f04023"><enum>(2)</enum><header>Contents</header><text>Each application submitted pursuant to paragraph (1) shall—</text> <subparagraph id="ID6a296e91d4f54a30a1d6834ff43ff5bf"><enum>(A)</enum><text>describe the need for increased access to Advanced Placement or International Baccalaureate programs in mathematics and science;</text> </subparagraph><subparagraph id="ID5f5e30f316f24915b36eb5b50cc76525"><enum>(B)</enum><text>provide for the involvement of business and community organizations in the activities to be assisted;</text> </subparagraph><subparagraph id="IDb97ebfe55efa4dd28782948c23527f91"><enum>(C)</enum><text>describe the availability of matching funds from non-Federal sources to assist in the activities authorized; and</text> </subparagraph><subparagraph id="ID4de9309d957749eab7c2c799a18b27ca"><enum>(D)</enum><text>demonstrate an intent to carry out activities that target local educational agencies—</text> <clause id="IDdebc9843114f43d4aa864a1e5658fbea"><enum>(i)</enum><text>that serve not fewer than 10,000 children from low-income families;</text> </clause><clause id="IDbb4b0913d9df4cba874fcf420d419fa7"><enum>(ii)</enum><text>for which not less than 20 percent of the children served by the local educational agency are children from low-income families; or</text> </clause><clause id="IDc3386f21f1dd415b8c96264fea7968f6"><enum>(iii)</enum><text>with a total of less than 600 students in average daily attendance at the schools that are served by the local educational agency and all of those schools are designated with a school locale code of 7 or 8, or otherwise designated as a rural school, as determined by the Secretary.</text> </clause></subparagraph></paragraph></subsection><subsection id="IDf0a4e5e10e5a48ca989647255e44e60d"><enum>(e)</enum><header>Priority consideration</header><text>The Secretary shall give priority to eligible recipients that submit an application under subsection (d) that demonstrates a pervasive need to expand or develop Advanced Placement or International Baccalaureate programs in mathematics and science.</text> </subsection><subsection id="IDe1fd3725413b4e989982cf134b758f6c"><enum>(f)</enum><header>Authorized activities</header><text>An eligible recipient shall use the grant funds provided under this section for the following activities:</text> <paragraph id="ID6d16d85cece2463594ccd40d2893a22e"><enum>(1)</enum><text>To identify and work with local educational agencies to expand or develop Advanced Placement or International Baccalaureate and pre-Advanced Placement or pre-International Baccalaureate programs in mathematics and science in schools served by the local educational agencies.</text> </paragraph><paragraph id="ID97d7d0b4351a4fcbae8459f24b85dcb1"><enum>(2)</enum><text>To work with the local educational agencies to establish Advanced Placement or International Baccalaureate coordinators in each secondary school served by the local educational agencies.</text> </paragraph><paragraph id="ID560af7616ec0417fbbe6e3d84843b7cb"><enum>(3)</enum><text>To ensure master teachers provide training to prepare teachers to teach Advanced Placement or International Baccalaureate courses in mathematics and science, which shall include at a minimum—</text> <subparagraph id="IDfbee1609a2cd48ef9bc3a66e440ccd69"><enum>(A)</enum><text>week-long summer institutes; and</text> </subparagraph><subparagraph id="ID6d1450fe71d14c49a576933db6de3edb"><enum>(B)</enum><text>2-day seminars in the teachers’ disciplines each year for 4 years.</text> </subparagraph></paragraph><paragraph id="ID0b172636ac3542e4b0ca1fe9c7b37c38"><enum>(4)</enum><text>To ensure master teachers provide training to prepare teachers to teach pre-Advanced Placement or pre-International Baccalaureate courses in mathematics and science, which shall include at a minimum—</text> <subparagraph id="ID972822d5f41c4e88bd1ab5406d0bb940"><enum>(A)</enum><text>a 4-day summer institute; and</text> </subparagraph><subparagraph id="IDc35f17e25a9b447f868a2c8e49a734cb"><enum>(B)</enum><text>4 days on campus each year for 4 years.</text> </subparagraph></paragraph><paragraph id="ID9afcafa70178429db01f3d8f1625f1d3"><enum>(5)</enum><text>To provide stipends to teachers who satisfactorily complete the Advanced Placement or International Baccalaureate or pre-Advanced Placement or pre-International Baccalaureate training.</text> </paragraph><paragraph id="ID9872f3fa865b4e5598a6001852ae38fc"><enum>(6)</enum><text>To provide a bonus to a teacher who has satisfactorily completed the Advanced Placement or International Baccalaureate or pre-Advanced Placement or pre-International Baccalaureate training for each student of the teacher who passes an Advanced Placement or International Baccalaureate examination in mathematics and science.</text> </paragraph><paragraph id="id537DCC6D31654ECBBDC23C7BEAC128CD"><enum>(7)</enum><text>To provide test preparation sessions for students taking Advanced Placement or International Baccalaureate examinations in mathematics and science.</text> </paragraph><paragraph id="IDf48894df4f7f472286e99020ed35194b"><enum>(8)</enum><text>To reimburse students half of the cost of the Advanced Placement or International Baccalaureate mathematics and science examination fees.</text> </paragraph><paragraph id="ID6af564dbceac47c4a229549291d250b3"><enum>(9)</enum><text>To provide scholarships to students who pass the Advanced Placement or International Baccalaureate mathematics and science examinations.</text> </paragraph></subsection><subsection id="ID2d7800336df34dffb5ea1e8d5c57b0d8"><enum>(g)</enum><header>Evaluation and accountability plan</header> <paragraph id="ID0d82d9ec242049d68c9c5d33b8a93977"><enum>(1)</enum><header>In general</header><text>Each eligible recipient receiving a grant under this section shall develop an evaluation and accountability plan for activities assisted under this section that includes rigorous objectives that measure the impact of activities assisted under this section.</text> </paragraph><paragraph id="IDb3cf5481fcc643d4954bba9aa17ddc60"><enum>(2)</enum><header>Contents</header><text>The plan developed pursuant to paragraph (1) shall include—</text> <subparagraph id="idB47C77E0C878445D9BCEBC55BB47765D"><enum>(A)</enum><text>the number of students served by the eligible recipient who are taking pre-Advanced Placement or pre-International Baccalaureate courses in mathematics and science;</text> </subparagraph><subparagraph id="IDf280da00bf6c45d2870e860ff30ef3fc"><enum>(B)</enum><text>the number of students served by the eligible recipient who are taking Advanced Placement or International Baccalaureate courses in mathematics and science;</text> </subparagraph><subparagraph id="IDb115b35a9e7e4677983725945f7eb2af"><enum>(C)</enum><text>the number of students served by the eligible recipient who take Advanced Placement or International Baccalaureate mathematics and science examinations;</text> </subparagraph><subparagraph id="ID3eb20788ea0a4b23b10b86c0c1cfa1f8"><enum>(D)</enum><text>the number of students served by the eligible recipients who pass Advanced Placement or International Baccalaureate mathematics and science examinations; and</text> </subparagraph><subparagraph id="IDb35b1b4f00d3426db7808128cf08191f"><enum>(E)</enum><text>the number of teachers trained in Advanced Placement or International Baccalaureate and pre-Advanced Placement or pre-International Baccalaureate mathematics and science programs.</text> </subparagraph></paragraph></subsection><subsection id="id1C8D4130216D478897B27BCF0A63CEDF"><enum>(h)</enum><header>Matching requirements for grants</header><text>Each eligible recipient receiving a grant under this section shall provide, from non-Federal sources (in cash or in kind), an amount equal to 100 percent of the amount of the grant for each year of the grant, of which not less than 25 percent shall come from State sources.</text> </subsection><subsection id="IDcbce644a094944329e17e378869888eb"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> <paragraph id="ID0a63de189fb54180968925da34d722ea"><enum>(1)</enum><text>$241,000,000 for fiscal year 2007;</text> </paragraph><paragraph id="ID774f56e3000b4443ad453713829654eb"><enum>(2)</enum><text>$341,000,000 for fiscal year 2008;</text> </paragraph><paragraph id="ID65730476b975428f958c1884667af62f"><enum>(3)</enum><text>$453,000,000 for fiscal year 2009;</text> </paragraph><paragraph id="ID239d37c621a64860a0fb269d2d00cadb"><enum>(4)</enum><text>$596,000,000 for fiscal year 2010; and</text> </paragraph><paragraph id="IDec44a61478fd43dcaf64f6907eb9f0d3"><enum>(5)</enum><text>$731,000,000 for fiscal year 2011.</text> </paragraph></subsection></section></chapter><chapter id="id8D55DD41E5DA41BC8CB8354D8384F2A7"><enum>4</enum><header>NATIONAL CLEARINGHOUSE ON MATHEMATICS AND SCIENCE TEACHING MATERIALS</header> <section id="id34E993A338F94609AF3F147C03E92065"><enum>161.</enum><header>National clearinghouse on mathematics and science teaching materials</header> <subsection id="ID6cc54963f60749098aa8314071ac7707"><enum>(a)</enum><header>Purpose</header><text>The purpose of the this section is to strengthen the skills of mathematics and science teachers by establishing a national clearinghouse of proven effective kindergarten through grade 12 mathematics and science teaching materials.</text> </subsection><subsection id="ID8bfe82d2729945d7aef6e70d5080472f"><enum>(b)</enum><header>Effective mathematics and science teaching materials</header><text>The Secretary is authorized to convene, not later than 1 year after the date of enactment of this Act, a national panel to collect proven effective kindergarten through grade 12 mathematics and science teaching materials, or to support the development of new materials where no effective models exist.</text> </subsection><subsection id="ID1a5748c750f24856b034a07eb9a43022"><enum>(c)</enum><header>Composition of national panel</header> <paragraph id="ID3b0a9a037a174e8384d0270792690b73"><enum>(1)</enum><header>Consultation</header><text>The Secretary shall appoint members to the panel after consultation with the National Academy of Sciences of the National Academies.</text> </paragraph><paragraph id="IDef6d9ec05dba41979c1937e81d7505bb"><enum>(2)</enum><header>Selection</header><text>The Secretary shall ensure that the panel broadly represents scientists, practitioners, educators, representatives from entities with expertise in education, mathematics, and science, and parents. The Secretary shall ensure that the panel includes the following:</text> <subparagraph id="ID20230e00834e466b9d1c0378709578df"><enum>(A)</enum><text>A majority representation of educators and parents directly involved in the kindergarten through grade 12 education process.</text> </subparagraph><subparagraph id="IDaf00d4c0b6224d6c89668a21e66851ea"><enum>(B)</enum><text>Proportionate representation of educators and parents from all demographic areas, including urban, suburban and rural schools.</text> </subparagraph><subparagraph id="id87D605DDD6B94E129DAF45281E6DAB93"><enum>(C)</enum><text>Proportionate representation of educators and parents from public and private schools.</text> </subparagraph></paragraph><paragraph id="ID76686aa913964bf7888e85c744cfc477"><enum>(3)</enum><header>Qualifications of members</header><text>The members of the panel shall be individuals who have substantial knowledge or experience relating to—</text> <subparagraph id="idC985487A6FC04FAE825FB52611CE8210"><enum>(A)</enum><text>education, mathematics, or science policy or programs; or</text> </subparagraph><subparagraph id="idCBCE58CFC33844B69BB381525761F8E6"><enum>(B)</enum><text>education, mathematics, or science curricula content development.</text> </subparagraph></paragraph></subsection><subsection id="IDad17dce8519445eda51c9cb25d9cdd2d"><enum>(d)</enum><header>Authorized activities of national panel</header><text>The panel shall—</text> <paragraph id="ID473f22ba75424b7186f5c9e1ac88f263"><enum>(1)</enum><text>identify proven effective kindergarten through grade 12 mathematics and science teaching materials;</text> </paragraph><paragraph id="IDa647d8a2401044079ffcc6d5fa0ef529"><enum>(2)</enum><text>identify the need for new mathematics and science teaching materials, and support the development of such new materials through contracts and cooperative agreements; and</text> </paragraph><paragraph id="ID1437376dbc6049ee89bcfa9ca251702f"><enum>(3)</enum><text>establish a national clearinghouse of information on effective kindergarten through grade 12 mathematics and science teaching materials.</text> </paragraph></subsection><subsection id="IDf5d9028f38224b8a8cc46aa3ca7aaf90"><enum>(e)</enum><header>Dissemination</header><text>The Secretary shall disseminate information related to the clearinghouse to State educational agencies, and otherwise make available and accessible to local educational agencies and schools the teaching materials collected by the panel in the form of a searchable online database or Internet web site.</text> </subsection><subsection id="ID0ea01f44afa54db8b38698ba990e1ebb"><enum>(f)</enum><header>Mathematics and science teaching materials</header> <paragraph id="ID59bdf05cfbbc45498638e756935d1efa"><enum>(1)</enum><header>Reliability and measurement</header><text>The kindergarten through grade 12 mathematics and science teaching materials collected under this section shall be—</text> <subparagraph id="ID69c13f312e094acdb4f9789840e5cd1d"><enum>(A)</enum><text>reliable, valid, and grounded in scientific theory and research in existence as of the date of the collection of materials;</text> </subparagraph><subparagraph id="ID7d2626d8dc7241aaa07994189e51a88d"><enum>(B)</enum><text>reviewed regularly to assess effectiveness; and</text> </subparagraph><subparagraph id="IDce59f591b61542e591cecc60302e21f6"><enum>(C)</enum><text>developed in careful consideration of State academic assessments and student academic achievement standards.</text> </subparagraph></paragraph><paragraph id="ID522fd8b413a84b779b01057e3e4229a3"><enum>(2)</enum><header>Students with diverse learning needs</header><text>The teaching materials shall include relevant materials for students with diverse learning needs, particularly for students with disabilities and students with limited English proficiency.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd20e92a1bc57481faf4e327ecb972663"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $20,000,000 for fiscal year 2007 and $20,000,000 for each of the fiscal years 2008 through 2011.</text> </subsection></section></chapter><chapter id="idE51EF4DAAD0C4DF484D8FBC24A3A1F13"><enum>5</enum><header>FUTURE AMERICAN-SCIENTIST SCHOLARSHIPS</header> <section commented="no" id="id038721D3000B42C08404BDF351A2F161"><enum>171.</enum><header>Future American-Scientist Scholarships</header> <subsection id="ID3b4e963b4908449e918b8f0d2a25733d"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to increase the number and percentage of citizens of the United States who earn baccalaureate degrees in mathematics or science (including engineering) by providing 25,000 new competitive merit-based undergraduate scholarships to students who are citizens of the United States, for the purpose of enabling each such student to obtain a baccalaureate degree in mathematics or science at a 4-year institution of higher education.</text> </subsection><subsection id="IDf7f75ff6f6db46c5a718869b94e0abee"><enum>(b)</enum><header>Scholarships</header> <paragraph id="idD7AD5BAB1E8F4E6FA241ADCC6678AB23"><enum>(1)</enum><header>In general</header><text>From the amounts authorized under subsection (e), the Secretary shall award the scholarships to eligible students that shall be used by the eligible students to pay for qualifying expenses at the 4-year institution of higher education of the eligible students' choosing.</text> </paragraph><paragraph id="ID3cd2e0bb0df547df9969e7c7d8e95e2b"><enum>(2)</enum><header>Future American-Scientist Scholarships</header><text>A scholarship awarded under this section shall be called a <quote>Future American-Scientist Scholarship</quote>.</text> </paragraph></subsection><subsection id="idDBCD07A1B6CC47E89598293898345792"><enum>(c)</enum><header>Amount; duration</header> <paragraph id="id347532D853D24189B6EAF522F8550807"><enum>(1)</enum><header>Amount</header><text>A scholarship award under this section shall be in an amount of not more than $20,000 per year.</text> </paragraph><paragraph id="idE94D1E11899449E590A4AA8882906FBA"><enum>(2)</enum><header>Duration of scholarship</header><text>A scholarship awarded to an eligible student under this section shall be for the number of years necessary for the eligible student to earn a baccalaureate degree in mathematics or science, except that no scholarship under this section shall be awarded for a period of more than 4 years.</text> </paragraph></subsection><subsection id="idF1A1429919A341459130999D20FD1208"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id4F5F25F8C0D2494DBD9A75BAC92EAB9B"><enum>(1)</enum><header>Eligible student</header><text>The term <term>eligible student</term> means a student who—</text> <subparagraph id="idDA4D6900CD93483FAF1D08D9162E2CDF"><enum>(A)</enum><text>is a citizen of the United States;</text> </subparagraph><subparagraph id="id3D2712EB5C9E4700867D72331F58CD80"><enum>(B)</enum><text>is attending a 4-year institution of higher education;</text> </subparagraph><subparagraph id="idF25DBA39F32F421194D033444DBB5CD6"><enum>(C)</enum><text>is enrolled, or will be enrolled at the start of the next academic year, in a course of study at an institution of higher education that leads to a baccalaureate degree in mathematics or science;</text> </subparagraph><subparagraph id="idC5CF74C66316415481362DF9AFC7C1D3"><enum>(D)</enum><text>demonstrates aptitude, as determined by the Secretary, in mathematics or science; or</text> </subparagraph><subparagraph id="id3D93713A120943769BDE835669610AE3"><enum>(E)</enum><text>for each year of a scholarship under this section, demonstrates continued academic achievement and progress, as determined by the Secretary, toward completion of a baccalaureate degree in mathematics or science.</text> </subparagraph></paragraph><paragraph commented="no" id="id246CC4A27993438C81C3A8A1386F2B3E"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a)).</text> </paragraph><paragraph id="id398DD4E0828C44FFA10BC75546B65657"><enum>(3)</enum><header>Qualified expenses</header><text>The term <term>qualified expenses</term> means the tuition, books, fees, supplies, and equipment required for a course of instruction leading to a baccalaureate degree in mathematics or science at a 4-year institution of higher education of the eligible student's choosing.</text> </paragraph><paragraph id="id84F6993A5718429F8B5C86B7618A6F29"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text> </paragraph></subsection><subsection id="IDfc09d3bdff1742a4b2a78a4879bd8cf1"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> <paragraph id="IDa913f6e75b4b45cea76a742f8a122d3c"><enum>(1)</enum><text>$375,000,000 for fiscal year 2007;</text> </paragraph><paragraph id="IDa9b295b622664629ae4979873f8afd1d"><enum>(2)</enum><text>$750,000,000 for fiscal year 2008;</text> </paragraph><paragraph id="ID719976f270db4c9cb09be9b6d7a58abe"><enum>(3)</enum><text>$1,125,000,000 for fiscal year 2009; and</text> </paragraph><paragraph id="IDcf9dacd8ba74449bbc74cdf4ebc33585"><enum>(4)</enum><text>$1,500,000,000 for each of the fiscal years 2010 through 2013.</text> </paragraph></subsection></section></chapter><chapter id="id9948B04284354383B3B74421AE907A0B"><enum>6</enum><header>GRADUATE RESEARCH FELLOWSHIPS</header> <section id="IDb231028ec7d441f78c7e1709578d830f"><enum>181.</enum><header>Graduate Research Fellowships in scientific areas of national need</header> <subsection id="IDdb4256ebc758431a9c958f59756fc9ff"><enum>(a)</enum><header>Fellowships authorized</header><text>From the amounts appropriated under subsection (e), the Secretary shall establish a fellowship program to provide tuition and financial support for eligible students pursuing master's and doctoral degrees in mathematics or science (including engineering) or other areas of national need.</text> </subsection><subsection id="IDf1608f4f5f674a70aeb45d397cddad0c"><enum>(b)</enum><header>Areas of national need</header><text>The Secretary may establish, on an annual basis, areas of national need important to the mission of the Department of Energy, and may use the areas of national need in determining the specific fields of study to be supported by fellowship awards under this section. In establishing the areas of national need, the Secretary shall consider the results of the survey conducted under section 1101 of the Energy Policy Act of 2005 (42 U.S.C. 16411).</text> </subsection><subsection id="IDcadb88f2697b4925ae5e985f05a2cd0c"><enum>(c)</enum><header>Use and amount of awards</header><text>A fellowship award under this section shall be—</text> <paragraph id="idCE4831695629484F872E1EC088C47813"><enum>(1)</enum><text>in an amount that is commensurate with the amount of similar graduate research fellowships awarded by the National Science Foundation; and</text> </paragraph><paragraph id="idC8472FAB0D8A474F9FC6709397FDD05D"><enum>(2)</enum><text>used by the eligible student to cover educational expenses and to provide additional financial support.</text> </paragraph></subsection><subsection id="id3E1C1B9201C24CABA76B01379FD03BFB"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id83995CF6F28B4AE19DCFCD0991DFF0F9"><enum>(1)</enum><header>Eligible student</header><text>The term <term>eligible student</term> means a student who is enrolled in a master's or doctoral degree program in mathematics or science (including engineering) or other areas of national need at an institution of higher education (as defined in section 171).</text> </paragraph><paragraph id="id5F7E8924C56843D1A589A590F632620B"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text> </paragraph></subsection><subsection id="ID91f57528127740cab2974447940c6306"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated under this section—</text> <paragraph id="ID370a8c88a50343a1b136f6231641f40d"><enum>(1)</enum><text>$225,000,000 for fiscal year 2007;</text> </paragraph><paragraph id="IDcb033217783d4b55a634a2e575eedde6"><enum>(2)</enum><text>$450,000,000 for fiscal year 2008; and</text> </paragraph><paragraph id="ID16fea787275148ec8255f17f69071d47"><enum>(3)</enum><text>$675,000,000 for each of the fiscal years 2009 through 2013.</text> </paragraph></subsection></section></chapter></subtitle><subtitle id="idF9B96342ACF44CD1B7726D095AC6AFF1"><enum>B</enum><header>National science foundation early-career research grants</header> <section id="id89D610A2B8B64DBB953ED87DEBEF0CEE"><enum>191.</enum><header>National Science Foundation early-career research grants</header> <subsection id="idA643AC8BFC614D3B9D15D5F98F4B1EDD"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section to authorize research grants in the National Science Foundation, for early-career scientists and engineers for purposes of pursuing independent research.</text> </subsection><subsection id="id50B7D72880474CF6A4FEC8DBAA52B951"><enum>(b)</enum><header>Definition of eligible early-career researcher</header><text>In this section, the term <term>eligible early-career researcher</term> means an individual who—</text> <paragraph id="id8406C64F745B4E1183F0F525638B09A3"><enum>(1)</enum><text>completed a doctorate or other terminal degree not more than 10 years before the date of enactment of this Act and has demonstrated promise in the field of science, technology, engineering, or mathematics; or</text> </paragraph><paragraph id="id96AB9A2E19AB4FB09852139C72EC6405"><enum>(2)</enum><text>has an equivalent professional qualification in the field of science, technology, engineering, or mathematics.</text> </paragraph></subsection><subsection id="id1BC7007E98144E1793EB56361FCE724A"><enum>(c)</enum><header>Grant program authorized</header> <paragraph id="id20FC94D5C5FA47D19F3F04041CD0B76B"><enum>(1)</enum><header>In general</header><text>The Director of the National Science Foundation shall award not less than 65 grants per year to outstanding eligible early-career researchers to support the work of such researchers in universities, private industry, or federally-funded research and development centers.</text> </paragraph><paragraph id="idFB508C9E660847CF8B882DC807576283"><enum>(2)</enum><header>Application</header><text>An eligible early-career researcher who desires to receive a grant under this section shall submit to the Director of the National Science Foundation an application at such time, in such manner, and accompanied by such information as the Director may require.</text> </paragraph><paragraph id="id18E3F7D5164144DC9C4FA8C73F42B794"><enum>(3)</enum><header>Special consideration</header><text>In awarding grants under this section, the Director of the National Science Foundation shall give special consideration to eligible early-career researchers who have followed alternative career paths such as working part-time or in non-academic settings, or who have taken a significant career break or other leave of absence.</text> </paragraph><paragraph id="id0D089A80EBD3432C80D418E2F8390C38"><enum>(4)</enum><header>Duration and amount</header><text>A grant under this section shall be 5 years in duration. An eligible early career-researcher who receives a grant under this section shall receive $100,000 for each year of the grant period.</text> </paragraph><paragraph id="idDCA08831A9184F8EAC6725DD14C33AA1"><enum>(5)</enum><header>Use of funds</header><text>An eligible early career-researcher who receives a grant under this section shall use the grant funds for basic research in natural sciences, engineering, mathematics, or computer sciences at a university, private industry, or federally-funded research and development center.</text> </paragraph><paragraph id="id9C60EA78D2B145BE98857D3544DB308F"><enum>(6)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> <subparagraph id="id98CB385423AD41DDAC842229F6686883"><enum>(A)</enum><text>$6,500,000 for fiscal year 2007;</text> </subparagraph><subparagraph id="id5060CD0F33F942B4B2FEC27941623A84"><enum>(B)</enum><text>$13,000,000 for fiscal year 2008;</text> </subparagraph><subparagraph id="idA327F2C0A865420EA894861C3B868F80"><enum>(C)</enum><text>$19,500,000 for fiscal year 2009;</text> </subparagraph><subparagraph seeds through science and engineering research</header> <subtitle id="idF554F86C5EAE42EC8E00085850FC9211"><enum>A</enum><header>Office of Science and Technology Policy Matters</header> <section commented="no" id="idA2B00F14BFF64A2AB6E9F2AD0D2E97E0"><enum>211.</enum><header>Coordination of science, mathematics, and engineering education programs</header> <subsection commented="no" id="idB2C0628BB0CD4C608EB00AD5EEC89782"><enum>(a)</enum><header>National goals</header> <paragraph commented="no" id="id46A3B17F4C0A4C4BBA18E39167F52655"><enum>(1)</enum><header>Body for establishment of goals</header><text>The Director of the Office of Science and Technology Policy shall establish within the President's Committee of Advisors on Science and Technology a standing subcommittee on education in mathematics, science, and engineering in the Federal Government.</text> </paragraph><paragraph commented="no" id="id4A125E4FB37C4CB7896EAAA8CD89C1F1"><enum>(2)</enum><header>Responsibility</header><text>The subcommittee established under this subsection shall—</text> <subparagraph commented="no" id="idE26791B7748E40F89430FDA8FEEF2870"><enum>(A)</enum><text>develop national goals for the support by the Federal Government of education in mathematics, science, and engineering; and</text> </subparagraph><subparagraph commented="no" id="id28D252149FE34243B0F4FE49F34D41EE"><enum>(B)</enum><text>periodically review and update any goals so developed.</text> </subparagraph></paragraph><paragraph commented="no" id="id329C231B2EB44DC09A812E3529D6336D"><enum>(3)</enum><header>Public comment</header><text>The Director shall enter into an agreement with the National Academy of Sciences or other appropriate scientific organization to seek public comment on the national goals developed under this subsection.</text> </paragraph></subsection><subsection commented="no" id="id18F1F2E0642C42F3BC7DEABCC3DF47A4"><enum>(b)</enum><header>Deputy Assistant Director for Science, Mathematics, and Engineering Education Programs</header> <paragraph commented="no" id="idDDF7A5BA91CD42EBBFAAF972AE011F86"><enum>(1)</enum><header>In general</header><text>There shall be in the Office of Science and Technology Policy a Deputy Assistant Director of the Office of Science and Technology Policy for Science, Mathematics, and Engineering Education Programs who shall be appointed by the Director of the Office of Science and Technology Policy, acting through the Associate Director for Science of the Office of Science and Technology Policy, from among individuals having the qualifications specified in paragraph (2).</text> </paragraph><paragraph commented="no" id="idBD6EEE153F7D41DEB726758418EF6FF6"><enum>(2)</enum><header>Qualifications for appointment</header><text>The qualifications of an individual for appointment as Deputy Assistant Director shall include such professional experience and expertise, and such other qualifications, as the Director of the Office of Science and Technology Policy considers appropriate to permit such individual to advise the Director on all matters relating to the education programs of the Executive Branch on mathematics, science, and technology.</text> </paragraph></subsection><subsection commented="no" id="id96C0995E201449DD9E5FE13B552B4E3D"><enum>(c)</enum><header>Responsibility</header><text>The Deputy Assistant Director of the Office of Science and Technology Policy for Science, Mathematics, and Engineering Educations Programs shall ensure effective coordination among the departments, agencies, and elements of the Federal Government in the discharge of the education programs of the Executive Branch on mathematics, science, and technology.</text> </subsection><subsection commented="no" id="id51EBF99FA7A74CB0B66C0288D362BEC8"><enum>(d)</enum><header>Plan for coordination of programs</header> <paragraph commented="no" id="id818F3674A7704BBE85C3524724DAB838"><enum>(1)</enum><header>In general</header><text>In carrying out the responsibility described in subsection (c), the Deputy Assistant Director of the Office of Science and Technology Policy for Science, Mathematics, and Engineering Educations Programs shall develop each year a plan for the coordination of the education programs of the Executive Branch on mathematics, science, and technology during the five fiscal years beginning in the year of such plan.</text> </paragraph><paragraph commented="no" id="id7BC749719A2E4C3AAED997F38123A716"><enum>(2)</enum><header>Elements</header><text>Each plan developed under this subsection shall include—</text> <subparagraph commented="no" id="idEDDCEEB3941F43679BF6305B488CBA8C"><enum>(A)</enum><text>mechanisms for the coordination of the education programs of the Executive Branch on mathematics, science, and technology during the five fiscal years beginning in the year of such plan; and</text> </subparagraph><subparagraph commented="no" id="id6599B73835284F9298D311CBE2E0EC51"><enum>(B)</enum><text>recommendations on funding, by agency, of such education programs during each such fiscal year.</text> </subparagraph></paragraph><paragraph commented="no" id="idDEBE7E8DA6654ED29A543D950AFC851D"><enum>(3)</enum><header>Consistency with national goals</header><text>Each plan developed under this subsection shall be consistent with the most current national goals for the support by the Federal Government of education in mathematics, science, and engineering developed under subsection (a).</text> </paragraph><paragraph commented="no" id="id29BE8B6D120F47A0BBC556B4BEF73E29"><enum>(4)</enum><header>Availability to public</header><text>The Director of the Office of Science and Technology Policy shall take appropriate actions to ensure that each plan developed under this subsection is available to the public.</text> </paragraph></subsection><subsection commented="no" id="id9FF7A89F208B4409B1E4E12EFFE42F45"><enum>(e)</enum><header>Staffing and other resources</header><text>The Director of the Office of Science and Technology Policy shall assign the Deputy Assistant Director of the Office of Science and Technology Policy for Science, Mathematics, and Engineering Educations Programs such personnel and other resources as the Director considers appropriate in order to permit the Deputy Assistant Director to carry out the duties of the Deputy Assistant Director under this section.</text> </subsection><subsection id="idB766FAE725D742F69E65353CD0A4947A"><enum>(f)</enum><header>Deadlines for certain actions</header> <paragraph id="idF475D65152394B4AA08603638B0C642B"><enum>(1)</enum><header>Establishment of subcommittee</header><text>The Director of the Office of Science and Technology Policy shall establish the subcommittee required by subsection (a)(1) not later than 30 days after the date of the enactment of this Act.</text> </paragraph><paragraph id="id397B442A20224FA79A2163905FF3F22B"><enum>(2)</enum><header>Appointment of deputy assistant director</header><text>The Director of the Office of Science and Technology Policy, acting through the Associate Director for Science of the Office of Science and Technology Policy, shall make the first appointment to the position of Deputy Assistant Director of the Office of Science and Technology Policy for Science, Mathematics, and Engineering Education Programs under subsection (b)(1) not later than 60 days after the date of the enactment of this Act.</text> </paragraph></subsection></section><section id="idBF7FB5B2DB0E45A58833EDC507BB0A44"><enum>212.</enum><header>National Coordination Office for Advanced Research Instrumentation and Facilities</header> <subsection id="id953429E82C91421C9BCC6B16FF9B563C"><enum>(a)</enum><header>Establishment</header> <paragraph id="idF087672CFE2F4F7AB58652244DAE0C56"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Science and Technology Policy shall establish within the Office of Science and Technology Policy an office to be known as the <quote>National Coordination Office for Advanced Research Instrumentation and Facilities</quote>.</text> </paragraph><paragraph id="id8C8360B1FB4E4F6AB7DF72D92C3B5F9D"><enum>(2)</enum><header>Head of office</header><text>The head of the National Coordination Office for Advanced Research Instrumentation and Facilities shall be the Director of the National Coordination Office for Advanced Research Instrumentation and Facilities, who shall be appointed by the Director of the Office of Science and Technology Policy.</text> </paragraph><paragraph id="id89B651DB56984EFC889C0E732F7AFCD0"><enum>(3)</enum><header>Staff and other resources</header><text>The Director of the Office of Science and Technology Policy shall assign to the National Coordination Office for Advanced Research Instrumentation and Facilities such personnel and other resources as the Director of the Office of Science and Technology Policy considers appropriate in order to permit the National Coordination Office for Advanced Research Instrumentation and Facilities to carry out its duties under this section.</text> </paragraph><paragraph id="id17144BE1607249018C4C4A47A8313189"><enum>(4)</enum><header>Deadline for establishment</header><text>The National Coordination Office for Advanced Research Instrumentation and Facilities shall be established not later than 30 days after the date of the enactment of this Act.</text> </paragraph></subsection><subsection id="id6AD99BD183A14C1D8F6A995C09CD2495"><enum>(b)</enum><header>Duties</header> <paragraph id="idD30B5812984146E793E98A910FC2F76F"><enum>(1)</enum><header>In general</header><text>The National Coordination Office for Advanced Research Instrumentation and Facilities shall coordinate the award by the departments, agencies, and other elements of the Federal Government of grants for advanced research instrumentation and facilities.</text> </paragraph><paragraph id="idD5C609C7C75F4E26A9C186F656A81C18"><enum>(2)</enum><header>Advanced research instrumentation and facilities</header> <subparagraph id="id962933A35998430F91F5B896ED503ABB"><enum>(A)</enum><header>In general</header><text>For purposes of this section, advanced research instrumentation and facilities are specially designed and developed instruments or tools (whether of a physical or nonphysical nature) that are available commercially but are overly expensive for design and development under a single research grant.</text> </subparagraph><subparagraph id="id22886EDCB5F341A49A24349C65272D80"><enum>(B)</enum><header>Examples</header><text>Examples of advanced research instrumentation and facilities for purposes of this section include the following:</text> <clause id="id17DC027586054B5EB2C30D6B0BFA715D"><enum>(i)</enum><text>Single, stand-alone instruments or instrument suites.</text> </clause><clause id="id44EA015EFB544ACFBB9C1DD7C5AFF4BF"><enum>(ii)</enum><text>Networks.</text> </clause><clause id="id9DC9F7607B6146E88D1115FA3E3B215B"><enum>(iii)</enum><text>Computational modeling applications.</text> </clause><clause id="id425FBDB8C25548E8AF4C658F193FA999"><enum>(iv)</enum><text>Computer databases.</text> </clause><clause id="idA3224FFCC3E343F48B5D5800E82F4786"><enum>(v)</enum><text>Sensor systems.</text> </clause><clause id="idAC7D05A440B8424BA993C844FF49AC55"><enum>(vi)</enum><text>Facilities that house ensembles of interrelated instruments.</text> </clause><clause id="idC1107AA4579947339F52C8772BD3986B"><enum>(vii)</enum><text>Instruments assembled from components.</text> </clause></subparagraph></paragraph><paragraph id="id76DF3814B261435D86B4947E96981752"><enum>(3)</enum><header>Discharge of duties</header><text>The Office shall coordinate the award of grants for advanced research instrumentation and facilities under this section in accordance with the strategic implementation plan developed under subsection (c).</text> </paragraph></subsection><subsection id="idF9D134BB35E44BE0AD65A6D89259CDDF"><enum>(c)</enum><header>Strategic implementation plan</header> <paragraph id="idC37779D7B7B144E999A71054B62111EF"><enum>(1)</enum><header>Plan required</header><text>Not later than one year after the date of the enactment of this Act, the Director of the Office of Science and Technology Policy shall, in consultation with the Director of the Office of Management and Budget, develop a plan for the award by the departments, agencies, and other elements of the Federal Government of grants for advanced research instrumentation and facilities during the five-year period beginning on the date of the issuance of the plan.</text> </paragraph><paragraph id="id67AE6CF083054738A00E3207A4B4B368"><enum>(2)</enum><header>Elements</header><text>The plan required by paragraph (1) shall include the following:</text> <subparagraph id="id4A7AA18BAD374FA0858A98286FD77556"><enum>(A)</enum><text>Criteria applicable to the award of grants for advanced research instrumentation and facilities, including criteria applicable to—</text> <clause id="id28F6DAECC41F472EBBEB1B54C2541C38"><enum>(i)</enum><text>scientific and technical merit;</text> </clause><clause id="id359A342D50E64AD2B25501E6A493A14D"><enum>(ii)</enum><text>the identification of the strategic requirements of the departments, agencies, and other elements of the Federal Government; and</text> </clause><clause id="id8E28902E50B248589361DEC39ED13916"><enum>(iii)</enum><text>national science and technology needs.</text> </clause></subparagraph><subparagraph id="id1E467BA36BCB4EAAB73CA856E37D7278"><enum>(B)</enum><text>An assessment of the current and anticipated needs of the departments, agencies, and other elements of the Federal Government for advanced research instrumentation and facilities.</text> </subparagraph><subparagraph id="id80D9198D0C0E4500A965F5DB2D38DD29"><enum>(C)</enum><text>A report to Congress on the proposed allocation of funds, including amounts authorized to be appropriated by subsection (f), by the departments, agencies, and other elements of the Federal Government for grants for advanced research instrumentation and facilities.</text> </subparagraph></paragraph><paragraph id="id08B5ADCA51334D9DBCB111CCF40CB970"><enum>(3)</enum><header>Public comment</header><text>In developing the plan required by paragraph (1), the Director of the Office of Science and Technology Policy shall enter into an agreement with the National Academy of Sciences, or other similar entity, to secure public comments on the plan.</text> </paragraph></subsection><subsection id="idAA38316AF930406F8B32AA81AA9021CB"><enum>(d)</enum><header>Recommendations on agency funding</header> <paragraph id="id625D495CA04F482BACEEFD11FC87F0C6"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Science and Technology Policy shall, in consultation with the Director of the National Coordination Office for Advanced Research Instrumentation and Facilities, make recommendations each year to the Director of the Office of Management and Budget on the amount of funds to be requested for the departments, agencies, and other elements of the Federal Government for the fiscal year beginning in such year for the award of grants for advanced research instrumentation and facilities.</text> </paragraph><paragraph id="id700D75915696425AA61B96B33CCA9829"><enum>(2)</enum><header>Purpose</header><text>The purpose of the recommendations under paragraph (1) shall be to advise the Director of the Office of Management and Budget on the amounts to be requested in the budget of the President (as submitted to Congress under section 1105 of title 31, United States Code) for each fiscal year for the award of grants for advanced research instrumentation and facilities.</text> </paragraph></subsection><subsection id="id19638D5463F843F1B771E679D6B0C333"><enum>(e)</enum><header>Use of grant amounts</header><text>Amounts under grants awarded by departments, agencies, and other elements of the Federal Government for advanced research instrumentation and facilities may be used for purposes as follows:</text> <paragraph id="id25F14638F3D944A3A1549EE561F92F57"><enum>(1)</enum><text>The purchase and installation of instruments.</text> </paragraph><paragraph id="id39F6E6E9F0694F838958235AD29FBB1D"><enum>(2)</enum><text>The commissioning of equipment.</text> </paragraph><paragraph id="idAC9B1386ECFF450E990301BF265FCDC7"><enum>(3)</enum><text>The calibration of instruments.</text> </paragraph><paragraph id="id71205B090BF542EE9BCBBED1A4FB2F9B"><enum>(4)</enum><text>The acquisition of parts and materials for construction of instruments.</text> </paragraph><paragraph id="id9B4944DC10A247D5809C9CC0F81D0184"><enum>(5)</enum><text>Personnel costs of personnel engaged in the development of instruments.</text> </paragraph><paragraph id="id1EFCBA1829F94AB780166C685D0E2407"><enum>(6)</enum><text>The operation and maintenance of instruments.</text> </paragraph><paragraph id="idCF0A225FDD0A4482B3A2584B0824EABC"><enum>(7)</enum><text>Such other purposes as the Director of the National Coordination Office for Advanced Research Instrumentation and Facilities considers appropriate.</text> </paragraph></subsection><subsection id="idAB6CD752114E44099F25137A877641A6"><enum>(f)</enum><header>Authorization of appropriations</header> <paragraph id="id39ED670D6B634218A081DC696C271288"><enum>(1)</enum><header>In general</header><text>In addition to amounts appropriated under Federal law other than this Act, there is authorized to be appropriated for each of fiscal years 2008 through 2012, to carry out this section (including the plan specified in subsection (c))—</text> <subparagraph id="id6036471F8E5149668F3EE9187F1583E1"><enum>(A)</enum><text>$1,000,000 to the Office of Science and Technology Policy;</text> </subparagraph><subparagraph id="id4F4C5BB863D8470EA41F62B647DC12E3"><enum>(B)</enum><text>$150,000,000 to the National Science Foundation;</text> </subparagraph><subparagraph id="id64BFFC0D701B48C4AFC8C86ADAEF124C"><enum>(C)</enum><text>$87,000,000 to the Department of Defense;</text> </subparagraph><subparagraph id="id3B10CB8BCADF40A78D6879318475EDDB"><enum>(D)</enum><text>$152,000,000 to the Office of Science of the Department of Energy; and</text> </subparagraph><subparagraph id="id5F944763F35C4D64A4BCC64497D15540"><enum>(E)</enum><text>$117,000,000 to the National Aeronautics and Space Administration.</text> </subparagraph></paragraph><paragraph id="id8BAB12B7EB0F43C3AF47D3FFC4172EEA"><enum>(2)</enum><header>Availability</header><text>The amount authorized to be appropriated by this subsection shall remain available until expended.</text> </paragraph></subsection></section><section id="id88D9894BF0864E0094E541868FD5F1CB"><enum>213.</enum><header>High-risk, high-payoff research</header> <subsection id="idCDB60626E29F4B398CEBAD710D7CCC26"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Science and Technology Policy shall, in consultation with the Director of the Office of Management and Budget, establish guidelines to ensure that each Federal research agency allocates not less than 8 percent of the funds available to such agency each fiscal year for basic research for high-risk, high-payoff research.</text> </subsection><subsection id="id7007F656F23D4589B216DFA586729166"><enum>(b)</enum><header>High-risk, high-payoff research</header><text display-inline="yes-display-inline">For purposes of this section, high-risk, high-payoff research is research that—</text> <paragraph id="id38F1745B8EB74B6F8059EBC5414DF8A7"><enum>(1)</enum><text display-inline="yes-display-inline">has the potential for yielding results with far-ranging or wide-ranging implications; but</text> </paragraph><paragraph id="idAE52C151CA8D4059851CE05172147892"><enum>(2)</enum><text display-inline="yes-display-inline">is too novel or spans too diverse a range of disciplines to fare well in the traditional peer review process.</text> </paragraph></subsection><subsection id="idE110AA8870454E75AA3FBBC405F5A9D9"><enum>(c)</enum><header>Guideline elements</header><text>The guidelines required by subsection (a) shall include provisions on the following:</text> <paragraph id="id099D70CDC2E44385BB7EE2015A814282"><enum>(1)</enum><text>Expedited procedures for the approval of the use of funds for high-risk, high-payoff research.</text> </paragraph><paragraph id="id379042B3F88C4238901A87492DDDD6D6"><enum>(2)</enum><text>Annual reports by Federal research agencies on activities relating to high-risk, high-payoff research.</text> </paragraph><paragraph id="id68A6CF4010454A0DBD38BD8CF332A7DD"><enum>(3)</enum><text>Criteria to establish the duration of funding for high-risk, high-payoff research projects.</text> </paragraph><paragraph id="id28C46E51626C48A0809F1F4FC5A03DCF"><enum>(4)</enum><text>Objectives for high-risk, high-payoff research projects.</text> </paragraph><paragraph id="id3708544DAB2A4585B32CAE89FADDF814"><enum>(5)</enum><text>Such other criteria, objectives, or other matters as the Director of the Office of Science and Technology Policy considers appropriate.</text> </paragraph></subsection><subsection id="idEFA7CFA5E82845268A60F80CAB5E4CC7"><enum>(d)</enum><header>Public comment</header><text>The Director of the Office of Science and Technology Policy shall enter into an agreement with the National Academy of Sciences, or similar entity, to solicit public comment, through a broad media solicitation, on the guidelines required by subsection (a) before the final issuance of such guidelines.</text> </subsection><subsection id="idB78FCB1DC3FB4B979513EBEABEC21B5B"><enum>(e)</enum><header>Review</header><text>The President's Committee of Advisors on Science and Technology shall, not less often than once every two years, conduct a review to determine whether or not Federal research agencies are allocating basic research funds in accordance with the guidelines required by subsection (a).</text> </subsection><subsection id="idCD8B1EE38680404988687ED3B7CC739C"><enum>(f)</enum><header>Annual reports to congress</header> <paragraph id="idFABC13B2C198458A89DD7E1130832F6A"><enum>(1)</enum><header>Reports required</header><text>The Director of the Office of Management and Budget shall, in consultation with the Director of the Office of Science and Technology Policy, submit to Congress each year a report on the use by Federal research agencies of basic research funds for high-risk, high-payoff research during the preceding fiscal year.</text> </paragraph><paragraph id="id72CDF9BC30C342F988828E98FF613B2B"><enum>(2)</enum><header>Time for submittal</header><text>The Director of the Office of Management and Budget shall submit the report required by paragraph (1) for a year together with the budget of the President for the fiscal year beginning in such year (as submitted to Congress under section 1105 of title 31, United States Code).</text> </paragraph></subsection><subsection id="id80687A950B9A4736890763F98F3DAA06"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idDEEB2B8253B64D48B06F5FE26FE53E94"><enum>(1)</enum><header>Federal research agency</header><text>The term <quote>Federal research agency</quote> means a major organizational component of a department or agency of the Federal Government, or other establishment of the Federal Government operating with appropriated funds, that has as its primary purpose the performance of scientific research.</text> </paragraph><paragraph id="id1B8E716F86794001AA6C4EB6CD94D38F"><enum>(2)</enum><header>Major organizational component</header><text>The term <quote>major organizational component</quote>, with respect to a department, agency, or other establishment of the Federal Government, means a component of the department, agency, or other establishment that is administered by an individual whose rate of basic pay is not less than the rate of basic pay payable under level V of the Executive Schedule under section 5316 of title 5, United States Code.</text> </paragraph></subsection></section><section id="id7F2572374C59474A8EEAAAC452485F28"><enum>214.</enum><header>President's Innovation Award</header> <subsection id="id0FA53F0B776A4C1991BEEC65C414E470"><enum>(a)</enum><header>Authority To Award</header> <paragraph id="idB369ADF233B34341A36115D6285F7CF3"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Science and Technology Policy shall, subject to the approval of the President, award each year to one or more individuals an award that recognizes recent innovations in science and engineering in the United States.</text> </paragraph><paragraph id="id79BCB7841EB74F51A1EF44B2B739AE31"><enum>(2)</enum><header>Designation</header><text>The award made under this section shall be known as the <quote>President's Innovation Award</quote>.</text> </paragraph><paragraph id="idF9D38D56F8694DC3A53204CC3F08CBDE"><enum>(3)</enum><header>Presentation</header><text>The presentation of awards made under this section shall be made by the President.</text> </paragraph></subsection><subsection id="id0DBC93C1D7D44BC9B9E53542EDDA2B8E"><enum>(b)</enum><header>Selection of recipients</header> <paragraph id="idC69E696C12D84BCB8A47B9A184D290FA"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Science and Technology Policy shall identify recipients of the award under this section from among individuals whose achievements are recognized in the most recent document entitled <quote>Interagency Research and Development Priorities</quote> published by the Director of the Office of Management and Budget and the Director of the Office of Science and Technology Policy.</text> </paragraph><paragraph id="id980340AB3C1445EB919EFEBFFE71B92C"><enum>(2)</enum><header>Solicitation of recommendations</header><text>In identifying potential recipients of the award under this section, the Director of the Office of Science and Technology Policy shall solicit recommendations from the heads of Federal agencies and the general public.</text> </paragraph></subsection><subsection id="id6D3E60925C7D43788C681717780D4B94"><enum>(c)</enum><header>Nature of award</header><text>The award made under this section shall consist of the following:</text> <paragraph id="idDC23A9B0EC9D480AA9377626DB010694"><enum>(1)</enum><text>A medal, of such design as the Director of the Office of Science and Technology Policy shall determine (subject to the approval of the President).</text> </paragraph><paragraph id="idD4DCCC01D013439D9386E69A059611BD"><enum>(2)</enum><text>A certificate of recognition.</text> </paragraph><paragraph id="id503C1DDDCA5F4EAB8A36EE94C2EC994B"><enum>(3)</enum><text>A cash prize, in such amount as the Director considers appropriate.</text> </paragraph></subsection><subsection id="id01FB84AEF06D48DDB3B1A4A9A946C1AD"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is hereby authorized to be appropriated to the Office of Science and Technology Policy each fiscal year $1,000,000 for the making of awards under this section.</text> </subsection></section></subtitle><subtitle id="id4EC3E504AC714C2CB560D8D799453B4C"><enum>B</enum><header>National Aeronautics and Space Administration Matters</header> <section id="idB8AD2DC9ABAA445F8F41139F8EE11D7E"><enum>221.</enum><header>National Aeronautics and Space Administration early-career research grants</header> <subsection id="idA2B38CAE92234F939CC5FA8C79F6CC94"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section to authorize research grants in the National Aeronautics and Space Administration for early-career scientists and engineers for purposes of pursuing independent research.</text> </subsection><subsection id="idE2A33AC059474F8FA37D46C6361A67DC"><enum>(b)</enum><header>Definition of eligible early-career researcher</header><text>In this section, the term <term>eligible early-career researcher</term> means an individual who—</text> <paragraph id="idFEAE1706296E4A53A4CEBE6FACD68714"><enum>(1)</enum><text>completed a doctorate or other terminal degree not more than 10 years before the date of enactment of this Act and has demonstrated promise in the field of science, technology, engineering, or mathematics; or</text> </paragraph><paragraph id="id679DA10F62BC4F988C782D0571046945"><enum>(2)</enum><text>has an equivalent professional qualification in the field of science, technology, engineering, or mathematics.</text> </paragraph></subsection><subsection id="id3F69E4F6CC834292852A14D020D73A55"><enum>(c)</enum><header>Grant program authorized</header> <paragraph id="idBE2B04E3709B4AFF8B2D6A0723FC31C1"><enum>(1)</enum><header>In general</header><text>The Administrator of the National Aeronautics and Space Administration shall award not less than 45 grants per year to outstanding eligible early-career researchers to support the work of such researchers in universities, private industry, or federally-funded research and development centers.</text> </paragraph><paragraph id="idE6565FDD03C943599FFF671898387865"><enum>(2)</enum><header>Application</header><text>An eligible early-career researcher who desires to receive a grant under this section shall submit to the Administrator of the National Aeronautics and Space Administration an application at such time, in such manner, and accompanied by such information as the Administrator may require.</text> </paragraph><paragraph id="id78E407F22C67446988322795DAA1D931"><enum>(3)</enum><header>Special consideration</header><text>In awarding grants under this section, the Administrator of the National Aeronautics and Space Administration shall give special consideration to eligible early-career researchers who have followed alternative career paths such as working part-time or in non-academic settings, or who have taken a significant career break or other leave of absence.</text> </paragraph><paragraph id="id2FEAFBA42D964062BF6597A09680D5FD"><enum>(4)</enum><header>Duration and amount</header><text>A grant under this section shall be 5 years in duration. An eligible early career-researcher who receives a grant under this section shall receive $100,000 for each year of the grant period.</text> </paragraph><paragraph id="id9B9924659DB9453AAB0731728C8FD75E"><enum>(5)</enum><header>Use of funds</header><text>An eligible early career-researcher who receives a grant under this section shall use the grant funds for basic research in natural sciences, engineering, mathematics, or computer sciences at a university, private industry, or federally-funded research and development center.</text> </paragraph><paragraph id="idAA7265FCC46F41548600277AD728CFE1"><enum>(6)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> <subparagraph id="idE9652AD1016144429DD45117B2444964"><enum>(A)</enum><text>$4,500,000 for fiscal year 2007;</text> </subparagraph><subparagraph id="id7327A04598534C798C329F508AA6339B"><enum>(B)</enum><text>$9,000,000 for fiscal year 2008;</text> </subparagraph><subparagraph id="idAB133F02C1C84BB78F91074FC9195268"><enum>(C)</enum><text>$13,500,000 for fiscal year 2009;</text> </subparagraph><subparagraph id="id61B8D316ECCA4BFC9C55256F0C40F230"><enum>(D)</enum><text>$18,000,000 for fiscal year 2010; and</text> </subparagraph><subparagraph id="id58BC147A9F484811A87FB30A50F83C97"><enum>(E)</enum><text>$22,500,000 for fiscal year 2011.</text> </subparagraph></paragraph></subsection></section><section id="id5ADF83ECD9F54DD889ECEAE503733550"><enum>222.</enum><header>Authorization of appropriations for the National Aeronautics and Space Administration for basic sciences</header> <subsection id="id1C386BDA71884CA58D972D45BC22CB4C"><enum>(a)</enum><header>In general</header><text>There is hereby authorized to be appropriated for the National Aeronautics and Space Administration for basic sciences for research specified in subsection (b), amounts as follows:</text> <paragraph id="id4A19A1DB23F24C52B8C92B813D3284A2"><enum>(1)</enum><text>$2,768,000,000 for fiscal year 2007.</text> criteria</header><text display-inline="yes-display-inline">The Secretary shall publish the criteria to be utilized in any competition under this paragraph for the selection of recipients of grants under this subsection. Such criteria shall include requirements relating to—</text> <clause commented="no" display-inline="no-display-inline" id="IDCD303BD8D4DA4D8D925808BB021F5656"><enum>(i)</enum><text display-inline="yes-display-inline">the number of jobs to be created at the science park each year for a period of 5 years;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDBA282793AF9C41B4B0BECA37916A20B1"><enum>(ii)</enum><text display-inline="yes-display-inline">the funding to be required to construct or expand the science park over the first 5 years;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID8DF46CAA9DD24A81AD8B878A65FA8BE3"><enum>(iii)</enum><text display-inline="yes-display-inline">the amount and type of cost matching by the applicant;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID92EE6AE1D4674660A4C9AD2A0DE80A21"><enum>(iv)</enum><text display-inline="yes-display-inline">the types of businesses and research entities expected in the science park and surrounding community;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID80E504792349453F8D108440EF395C7B"><enum>(v)</enum><text display-inline="yes-display-inline">letters of intent by businesses and research entities to locate in the science park;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID6E55274A5BE14FDE88487F42F3C7A355"><enum>(vi)</enum><text display-inline="yes-display-inline">the capacity of the science park for expansion over a period of 25 years;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID119C32EC316846D188735B98D227CBD0"><enum>(vii)</enum><text display-inline="yes-display-inline">the quality of life at the science park for employees at the science park;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDC58D79EE8BC54715A8FF4CB31F111F37"><enum>(viii)</enum><text display-inline="yes-display-inline">the capability to attract a well trained workforce to the science park;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID7E4B575FD5064D6DAEC2E60862D030EA"><enum>(ix)</enum><text display-inline="yes-display-inline">the management of the science park;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDE30861BF175849B6B343BC3AC20E1993"><enum>(x)</enum><text display-inline="yes-display-inline">expected risks in the construction and operation of the science park;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDB7D1ED7D51DA40CB878A1E142D9E1890"><enum>(xi)</enum><text display-inline="yes-display-inline">risk mitigation;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDD9927B0776F64B3A9297872CF694CAFA"><enum>(xii)</enum><text display-inline="yes-display-inline">transportation and logistics;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID493AE11700ED48FF9F73766843596D89"><enum>(xiii)</enum><text display-inline="yes-display-inline">physical infrastructure, including telecommunications; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id6FFC9D9782B54F38A482ECB4178F9F5D"><enum>(xiv)</enum><text display-inline="yes-display-inline">ability to collaborate with other science parks throughout the world.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID791CE9A25B424FDD8E36CA8D9A5F875F"><enum>(4)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for each of fiscal years 2007 through 2012, $7,500,000 to carry out this subsection.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID407C9677B74145ACAAA7967BF4E406FB"><enum>(b)</enum><header>Revolving loan Program for development of science park infrastructure</header> <paragraph commented="no" display-inline="no-display-inline" id="ID54D6F6669D204E54A2FB01C1638B731A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall make grants to six regional centers for the development of existing science park infrastructure through the operation of revolving loan funds by such centers.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5D949A390A9B412CB083FF6BBC98E33B"><enum>(2)</enum><header>Selection of centers</header> <subparagraph commented="no" display-inline="no-display-inline" id="IDA3700771305E466FA1AC7F2FCD424A36"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall select the regional centers to be awarded grants under this subsection utilizing such criteria as the Secretary shall prescribe.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC720DBDD3E354D88ABDA912FD65E88B7"><enum>(B)</enum><header>Criteria</header><text display-inline="yes-display-inline">The criteria prescribed by the Secretary under this paragraph shall include criteria relating to revolving loan funds and revolving loan fund operators under paragraph (4), including—</text> <clause commented="no" display-inline="no-display-inline" id="ID8A3D54813C434AD0B84619FB5BCA4E18"><enum>(i)</enum><text display-inline="yes-display-inline">the qualifications of principal officers;</text> </clause><clause commented="no" display-inline="no-display-inline" id="IDCD7F64E9309C42089A18D2735BBC5276"><enum>(ii)</enum><text display-inline="yes-display-inline">non-Federal cost matching requirements; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID0AE95C3AE6B545EE8F2A8B9A6BD94AF1"><enum>(iii)</enum><text display-inline="yes-display-inline">conditions for the termination of loan funds.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID13F1A96A86094E90B3F443E65628B898"><enum>(3)</enum><header>Limitation on loan amount</header><text display-inline="yes-display-inline">The amount of any loan for the development of existing science park infrastructure that is funded under this subsection may not exceed $3,000,000.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF2964F07BA6D4B37930F92B1C8CF391A"><enum>(4)</enum><header>Revolving loan funds</header> <subparagraph commented="no" display-inline="no-display-inline" id="ID97C4867064B44872A90C98E942C04DBD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A regional center receiving a grant under this subsection shall fund the development of existing science park infrastructure through the utilization of a revolving loan fund.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA899310E3D79455290B9E5A168AF3B42"><enum>(B)</enum><header>Operation and integrity</header><text display-inline="yes-display-inline">The Secretary shall prescribe regulations to maintain the proper operation and financial integrity of revolving loan funds under this paragraph.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE747AFA8033A4BF0B6C5EB4F7A3E5375"><enum>(C)</enum><header>Efficient Administration</header><text display-inline="yes-display-inline">The Secretary may—</text> <clause commented="no" display-inline="no-display-inline" id="ID923AF5381E8041EB8B834AD49AFB85B2"><enum>(i)</enum><text display-inline="yes-display-inline">at the request of a grantee, amend and consolidate grant agreements governing revolving loan funds to provide flexibility with respect to lending areas and borrower criteria;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID7EDDEED2801A4EEA9E63E468EC0BB635"><enum>(ii)</enum><text display-inline="yes-display-inline">assign or transfer assets of a revolving loan fund to a third party for the purpose of liquidation, and a third party may retain assets of the fund to defray costs related to liquidation; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID20168F92E12C4095B78ECDA9C534F6B3"><enum>(iii)</enum><text display-inline="yes-display-inline">take such actions as are appropriate to enable revolving loan fund operators to sell or securitize loans (except that the actions may not include issuance of a Federal guaranty by the Secretary).</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID62F0CB5B014E4E25970D40FBAB717AFE"><enum>(D)</enum><header>Treatment of actions</header><text display-inline="yes-display-inline">An action taken by the Secretary under this paragraph with respect to a revolving loan fund shall not constitute a new obligation if all grant funds associated with the original grant award have been disbursed to the recipient.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAFCEB3D2F0C84A50BFE858B77AF07959"><enum>(E)</enum><header>Preservation of securities laws</header> <clause commented="no" display-inline="no-display-inline" id="ID58B81CA09C264899AAD47A885358F887"><enum>(i)</enum><header>Not treated as exempted securities</header><text display-inline="yes-display-inline">No securities issued pursuant to subparagraph (C)(iii) shall be treated as exempted securities for purposes of the <act-name parsable-cite="SA33">Securities Act of 1933</act-name> or the <act-name parsable-cite="SEA34">Securities Exchange Act of 1934</act-name>, unless exempted by rule or regulation of the Securities and Exchange Commission.</text> </clause><clause commented="no" display-inline="no-display-inline" id="ID6E4CF73AFA4D499392DEB4F18A286F2C"><enum>(ii)</enum><header>Preservation</header><text display-inline="yes-display-inline">Except as provided in clause (i), no provision of this paragraph or any regulation issued by the Secretary under this paragraph shall supersede or otherwise affect the application of the securities laws (as such term is defined in section 2(a)(47) of the <act-name parsable-cite="SEA34">Securities Exchange Act of 1934</act-name>) or the rules, regulations, or orders of the Securities and Exchange Commission or a self-regulatory organization thereunder.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6A1A7B506BA243EBB5B440DC8D34D516"><enum>(5)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for each of fiscal years 2007 through 2012, $60,000,000 to carry out this subsection.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID92F113D3B3D4462E845C4632B46870CF"><enum>(c)</enum><header>Loan guarantees for science park infrastructure</header> <paragraph commented="no" display-inline="no-display-inline" id="ID38BA3C092E8A407EBE0898535C9D3D52"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall guarantee up to 80 percent of the loan amount for loans exceeding $10,000,000 for projects for the construction of science park infrastructure.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBA3110582E524D2EBDFD07180EF624D8"><enum>(2)</enum><header>Limitations on guarantee amounts</header><text display-inline="yes-display-inline">The maximum amount of loan principal guaranteed under this subsection may not exceed—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ID308698B1A4104A51A23C70D64E8350C8"><enum>(A)</enum><text display-inline="yes-display-inline">$50,000,000 with respect to any single project; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID96B3DB45BC6D4194ACC65CD19C3F3657"><enum>(B)</enum><text display-inline="yes-display-inline">$500,000,000 with respect to all projects.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID73E20B5793A2426ABB5BCFA16EAB7060"><enum>(3)</enum><header>Selection of guarantee recipients</header><text display-inline="yes-display-inline">The Secretary shall select recipients of loan guarantees under this subsection based upon the ability of the recipient to collateralize the loan amount through bonds, equity, property, and other such criteria as the Secretary shall prescribe.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID01890abdbf05438da01c1284a182f81a"><enum>(4)</enum><header>Terms and conditions for loan guarantees</header><text display-inline="yes-display-inline">For purposes of this section, the loans guaranteed shall be subject to such terms and conditions as the Secretary may prescribe, except that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDfee31dff6a544888bd6c77941fe8198b"><enum>(A)</enum><text display-inline="yes-display-inline">the final maturity of such loans made or guaranteed shall not exceed (as determined by the Secretary) the lesser of—</text> <clause commented="no" display-inline="no-display-inline" id="id5582A3A856CE41FBADE6E3E717BD7E95"><enum>(i)</enum><text display-inline="yes-display-inline">30 years and 32 days; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="idD9A1D41CAF184F1FA04C3E683FBA3292"><enum>(ii)</enum><text display-inline="yes-display-inline">90 percent of the useful life of any physical asset to be financed by such loan;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID324f6dadc4cc45f4868e2c3b173cb563"><enum>(B)</enum><text display-inline="yes-display-inline">no loan made or guaranteed may be subordinated to another debt contracted by the borrower or to any other claims against the borrowers in the case of default;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID42f0794decbf47b1a28280c81e0df20c"><enum>(C)</enum><text display-inline="yes-display-inline">no loan may be guaranteed unless the Secretary determines that the lender is responsible and that adequate provision is made for servicing the loan on reasonable terms and protecting the financial interest of the United States;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdfcc159235ad4291a50c26c79dda2815"><enum>(D)</enum><text display-inline="yes-display-inline">no loan may be guaranteed if the income from such loan is excluded from gross income for purposes of chapter 1 of the Internal Revenue Code of 1986, or if the guarantee provides significant collateral or security, as determined by the Secretary, for other obligations the income from which is so excluded;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc86745b4429347a39a043e73bb46abef"><enum>(E)</enum><text display-inline="yes-display-inline">any guarantee shall be conclusive evidence that said guarantee has been properly obtained, that the underlying loan qualified for such guarantee, and that, but for fraud or material misrepresentation by the holder, such guarantee shall be presumed to be valid, legal, and enforceable;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbcd7bd8e15d34ea09191789a3bc930f3"><enum>(F)</enum><text display-inline="yes-display-inline">the Secretary shall prescribe explicit standards for use in periodically assessing the credit risk of new and existing direct loans or guaranteed loans;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFC7206BB18DD4C67BC2FEC1B8C157B5D"><enum>(G)</enum><text display-inline="yes-display-inline">the Secretary must find that there is a reasonable assurance of repayment before extending credit assistance; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4800d0d2717b4cc0b5cb10fffb61bb0a"><enum>(H)</enum><text display-inline="yes-display-inline">new loan guarantees may not be committed except to the extent that appropriations of budget authority to cover their costs are made in advance, as required in section 504 of the Federal Credit Reform Act of 1990.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID45d71b864a94472da4d49d21c443f8d1"><enum>(5)</enum><header>Payment of losses</header><text display-inline="yes-display-inline">For purposes of this section—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDafae0da5472f44fb9fc42c56d57169bd"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If, as a result of a default by a borrower under a guaranteed loan, after the holder thereof has made such further collection efforts and instituted such enforcement proceedings as the Secretary may require, the Secretary determines that the holder has suffered a loss, the Secretary shall pay to such holder the percentage of such loss (not more than 80 percent) specified in the guarantee contract. Upon making any such payment, the Secretary shall be subrogated to all the rights of the recipient of the payment. The Secretary shall be entitled to recover from the borrower the amount of any payments made pursuant to any guarantee entered into under this section.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID02a198b13958458292843c2be3d2afb4"><enum>(B)</enum><header>Enforcement of rights</header><text display-inline="yes-display-inline">The Attorney General shall take such action as may be appropriate to enforce any right accruing to the United States as a result of the issuance of any guarantee under this section.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0df47d6cd9e244a8b7f45ac8f899f5e7"><enum>(C)</enum><header>Forbearance</header><text display-inline="yes-display-inline">Nothing in this section may be construed to preclude any forbearance for the benefit of the borrower which may be agreed upon by the parties to the guaranteed loan and approved by the Secretary, if budget authority for any resulting subsidy costs (as defined under the Federal Credit Reform Act of 1990) is available.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc1e18d0b418d4fc9835695064964ab24"><enum>(D)</enum><header>Management of property</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law relating to the acquisition, handling, or disposal of property by the United States, the Secretary shall have the right in the Secretary's discretion to complete, recondition, reconstruct, renovate, repair, maintain, operate, or sell any property acquired by the Secretary pursuant to the provisions of this section.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID954A2B5B6AAB4954A7E05FFB47EC51D6"><enum>(6)</enum><header>Review</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall, within 2 years of the date of enactment of this section, conduct a review of the subsidy estimates for the loan guarantees under this subsection, and shall submit to Congress a report on the review conducted under this paragraph.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID322B2A38930143EFA4F0E0AA13C35CC0"><enum>(7)</enum><header>Termination</header><text display-inline="yes-display-inline">No loan may be guaranteed under this subsection after September 30, 2012.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEF4970A2DD314BDBA9F094E8473FAF81"><enum>(8)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idADB09097B9FC42BFBD3355E2A6D2E6BD"><enum>(A)</enum><text display-inline="yes-display-inline">$35,000,000 for the cost, as defined in section 502(5) of the <act-name parsable-cite="FCRA90">Federal Credit Reform Act of 1990</act-name>, of guaranteeing $500,000,000 of loans under this subsection; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDA91DC8A49C043E9A23B840D8A84B18E"><enum>(B)</enum><text display-inline="yes-display-inline">$6,000,000 for administrative expenses for fiscal year 2007 and such sums as necessary thereafter for administrative expenses in subsequent years.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD9EE82C87F774429B95A5F53224BC757"><enum>(d)</enum><header>National Academy of Sciences evaluation</header> <paragraph commented="no" display-inline="no-display-inline" id="ID185639A69D5D48059BC76120BC1EAEE2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall enter into an agreement with the National Academy of Sciences under which the Academy shall evaluate, on a tri-annual basis, the activities under this section.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6B99D60E82CF4362903326B8D5950E33"><enum>(2)</enum><header>Tri-annual report</header><text display-inline="yes-display-inline">Under the agreement under paragraph (1), the Academy shall submit to the Secretary a report on its evaluation of science park development under that paragraph. Each report may include such recommendations as the Academy considers appropriate for additional activities to promote and facilitate the development of science parks in the United States.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2D711B98ADA347208B04166FA794DCE7"><enum>(e)</enum><header>Tri-Annual report</header><text display-inline="yes-display-inline">Not later than March 31 of every third year, the Secretary shall submit to Congress a report on the activities under this section during the preceding 3 years, including any recommendations made by the National Academy of Sciences under subsection (d)(2) during such period. Each report may include such recommendations for legislative or administrative action as the Secretary considers appropriate to further promote and facilitate the development of science parks in the United States.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="ID657BCC26318546B69CCEA89F8DF7C038"><enum>(f)</enum><header>Regulations</header> <paragraph commented="no" display-inline="no-display-inline" id="ID9F7F86903B1F453FB5FDBDA7E5D91B4E"><enum>(1)</enum><header>Regulations</header><text display-inline="yes-display-inline">Consistent with Office of Management and Budget Circular A–129, <quote>Policies for Federal Credit Programs and Non-Tax Receivables</quote>, the Secretary shall prescribe regulations to carry out this section.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8C55924105744DD8B4215FC459B96CED"><enum>(2)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Secretary shall prescribe such regulations not later than one year after the date of enactment of this section.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section></subtitle><subtitle </subsection></section></subtitle><enum>III</enum><header>Ensuring the best and brightest remain in the United States</header> <subtitle id="idA13158F4BF864287A3EDD0FC51291198"><enum>A</enum><header>Visas for doctorate students in mathematics, engineering, technology, or the physical sciences</header> <section id="id24460F0AB6764645B2D2B832D26B5EB0"><enum>311.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="idAADE42F8AB904554AAD4F3CE69232724"><enum>(1)</enum><text>The National Academies, in their congressionally requested report entitled <quote>Rising Above the Gathering Storm: Energizing and Employing America for a Brighter Economic Future</quote>, recommended that Congress—</text> <subparagraph id="idED4D9F7190E54404B189689714D6A23E"><enum>(A)</enum><text>continue to improve visa processing for international students and scholars by providing less complex procedures and continuing to make improvements on issues such as visa categories and duration, travel for scientific meetings, the technology-alert list, reciprocity agreements, and changes in status;</text> </subparagraph><subparagraph id="idDEE06A2BD7E0445F851120FD83A33940"><enum>(B)</enum><text>provide a 1-year automatic visa extension to international students who receive doctorates or the equivalent in science, technology, engineering, mathematics, or other fields of national need at qualified United States institutions to remain in the United States to seek employment;</text> </subparagraph><subparagraph id="id920AE380AC8A4BD6A2ABB93255FEB0F3"><enum>(C)</enum><text>provide such students with automatic work permits and expedited residence status if they are offered jobs by employers based in the United States and pass a security screening test;</text> </subparagraph><subparagraph id="id23C43F5C40E94DD1BCD7A33564B689B1"><enum>(D)</enum><text>institute a new skills-based, preferential immigration option that gives applicants with doctorate-level education and science and engineering skills priority in obtaining United States citizenship; and</text> </subparagraph><subparagraph id="id285109D146104512A02165C9D6D8E7D4"><enum>(E)</enum><text>increase the number of H–1B visas by 10,000, which should be allocated for applicants with doctorate degrees in science, or engineering from a United States university; and</text> </subparagraph></paragraph><paragraph id="idC0351F4E22CA41EE915C08DCD7521FA7"><enum>(2)</enum><text>Since the publication of the report by the National Academies, the Senate has passed the Deficit Reduction Act of 2005, which authorizes an additional 30,000 H–1B visas per year.</text> </paragraph></section><section id="idDC93FB80D39144D98F5B4D82F188A048"><enum>312.</enum><header>Sense of the Senate</header><text display-inline="no-display-inline">It is the sense of the Senate that—</text> <paragraph id="id5F5BD4A098654292B82FD074F4C71CA1"><enum>(1)</enum><text display-inline="yes-display-inline">the Department of State and the Department of Homeland Security have made significant improvements since 2002 in the efficiency with which visas are processed for—</text> <subparagraph id="id42A6B6343B59401A97BFAC823674F38D"><enum>(A)</enum><text display-inline="yes-display-inline">students at colleges and universities in the United States; and</text> </subparagraph><subparagraph id="id29288396B0394C079375F49071E3F975"><enum>(B)</enum><text>foreign researchers to engage in appropriate scientific research in the United States;</text> </subparagraph></paragraph><paragraph id="id9765572DA13948838671BEA90708751E"><enum>(2)</enum><text>particular improvements have been made to the MANTIS clearance process, which—</text> <subparagraph id="idB7892074566B49618336612D34A914E5"><enum>(A)</enum><text>reduce wait times from more than 70 days to less than 15 days; and</text> </subparagraph><subparagraph id="id9072513479244BDBA1B281DDF91E72BD"><enum>(B)</enum><text>extend the duration of the MANTIS clearance process up to 4 years, as appropriate, to cover the duration of study for foreign students in the United States;</text> </subparagraph></paragraph><paragraph id="id58378D31C69044A6AF6BDA6ACD08BB51"><enum>(3)</enum><text>both departments and related supporting agencies should further improve efficiency and convenience in the granting of visas to foreign students and researchers while protecting national security;</text> </paragraph><paragraph id="idD713560BCA78471AA27842FA73D0D6F8"><enum>(4)</enum><text>the departments should extend MANTIS clearance for foreign researchers for the duration of a specified scientific research program while balancing security concerns; and</text> </paragraph><paragraph id="idD7F9E1919FB84954A11CE965C22CA0A1"><enum>(5)</enum><text>other such improvements should include—</text> <subparagraph id="id9EF80471B7E74A9A8F82B4701813D5B3"><enum>(A)</enum><text>review of the technology-alert list; and</text> </subparagraph><subparagraph id="id960A9C8E629F455DBD3C95817A374CA5"><enum>(B)</enum><text>efforts to better facilitate travel for scientific conferences.</text> </subparagraph></paragraph></section><section id="idA55611AEC50246A4B85AF29D54A93A26"><enum>313.</enum><header>Visas for doctorate students in mathematics, engineering, technology, or the physical sciences</header> <subsection id="id721A669F3A7E481FB4D21D6620169D7A"><enum>(a)</enum><header>Creation of new visa category</header><text>Section 101(a)(15)(F) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(F)) is amended—</text> <paragraph id="id4A3DE37152F544238C83E282FC1885C1"><enum>(1)</enum><text>in clause (i)—</text> <subparagraph id="idCACD926A512C4FA5940FDB4BF760E2F0"><enum>(A)</enum><text>by inserting <quote>(except for a graduate program described in clause (iv))</quote> after <quote>full course of study</quote>;</text> </subparagraph><subparagraph id="idAF9D535252584E2E8803E6A90D7B7528"><enum>(B)</enum><text>by striking <quote>214(<italic>l</italic>)</quote> and inserting <quote>214(m)</quote>; and</text> </subparagraph><subparagraph id="idE9E72C0BC563462FB19F06E06B8D371F"><enum>(C)</enum><text>by striking the comma at the end and inserting a semicolon;</text> </subparagraph></paragraph><paragraph id="id544E309089414402A4FAA24CF3C73DE1"><enum>(2)</enum><text>in clause (ii)—</text> <subparagraph id="id26410118DF7F4F16BBC96B989414AC45"><enum>(A)</enum><text>by inserting <quote>or clause (iv)</quote> after <quote>clause (i)</quote>; and</text> </subparagraph><subparagraph id="id26D90699C9A546A894EF74C1AA7CF7B1"><enum>(B)</enum><text>by striking <quote>, and</quote> and inserting a semicolon;</text> </subparagraph></paragraph><paragraph id="id037FCCAD6BA843FB95FFB6685D169BA1"><enum>(3)</enum><text>in clause (iii), by inserting <quote>and</quote> at the end; and</text> </paragraph><paragraph id="id8228FE3BD784436A8AE24DEC3441D4FD"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id96327738B14B4264B12D78F2DF257735" style="OLC"> <clause id="id796B36C04ADC4AE0AB0B0C833169F6CB" indent="up1"><enum>(iv)</enum><text>an alien described in clause (i) who has been accepted and plans to attend an accredited graduate program in mathematics, engineering, technology, or the physical sciences in the United States for the purpose of obtaining a doctorate degree;</text> </clause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id2A7055E85EC749FBB38C3124A9702B05"><enum>(b)</enum><header>Requirements for obtaining an F–4 visa</header><text>Section 214(m) of the Immigration and Nationality Act (8 U.S.C. 1184(m)) is amended—</text> <paragraph id="id08355FFDF13F41F4ACC7C214FCEAAD49"><enum>(1)</enum><text>by striking the matter preceding paragraph (1) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idA229317B369D457E8F1461BEA0F9BACB" style="OLC"> <subsection id="id299A7062F6EF43D49CFE2CE566601887"><enum>(m)</enum><header>Nonimmigrant elementary, secondary, and post-secondary school students</header> </subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="idC9756A15D228456A8FE83AA1207CB2EB"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id86BBEB10EC4946BC94DE1139F514F7C8" style="OLC"> <paragraph id="id69CC10A5D48246AB87554E092A90EF91" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id254F8710AA0B4B11B52805BF7BE192DF"><enum>(A)</enum><text>An alien who obtains the status of a nonimmigrant under section 101(a)(15)(F)(iv) shall demonstrate an intent to—</text> <clause id="idD1C37879A28644FABEEC61F6E70D3D4C" indent="up1"><enum>(i)</enum><text>return to the country of residence of such alien immediately after the completion or termination of the graduate program qualifying such alien for such status; or</text> </clause><clause id="id045126D2D2D34C7B9D0A2CABEFE24D15" indent="up1"><enum>(ii)</enum><text>find employment in the United States related to the field of study of such alien and become a permanent resident of the United States upon the completion of the graduate program, which was the basis for such nonimmigrant status.</text> </clause></subparagraph><subparagraph id="id20AC430F6A044A83A2507D9D59CE9907" indent="up1"><enum>(B)</enum><text>A visa issued to an alien under section 101(a)(15)(F)(iv) shall be valid—</text> <clause id="idF7FD970F04D9445F82DCA16CAE3CD242"><enum>(i)</enum><text>during the intended period of study in a graduate program described in such section;</text> </clause><clause id="id9FE7C6C663FD4C73B5358EE1072D901D"><enum>(ii)</enum><text>for an additional period, not to exceed 1 year beyond the completion of the graduate program, if the alien is actively pursuing an offer of employment related to the knowledge and skills obtained through the graduate program; and</text> </clause><clause id="id72F03B108EBF4B29ABF8A8172D5E260E"><enum>(iii)</enum><text>for an additional period, not to exceed 6 months, while the alien’s application for adjustment of status under section 245(i)(4) is pending.</text> </clause></subparagraph><subparagraph id="idA903789CA6BE4F829F9BA1AAA8A4732D" indent="up1"><enum>(C)</enum><text>An alien shall qualify for adjustment of status to that of a person admitted for permanent residence if the alien—</text> <clause id="idEFED88D6398F4F75B458BA2E0B76F415"><enum>(i)</enum><text>has the status of a nonimmigrant under section 101(a)(15)(F)(iv);</text> </clause><clause id="idA1F575E6FE3941BFAEBBB049EB4B6342"><enum>(ii)</enum><text>has successfully earned a doctorate degree in mathematics, engineering, technology or the physical sciences at an accredited college or university in the United States; and</text> </clause><clause id="idAE3BA385B09F436DA048FEAFBE9303BF"><enum>(iii)</enum><text>is employed full-time in the United States in a position related to the knowledge and skills gained while pursuing such degree.</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id52C1685BAE7A4D2BAA857E7B1FE5D76D"><enum>(c)</enum><header>Adjustment of status</header><text>Section 245(i) of the Immigration and Nationality Act (8 U.S.C. 1255(i)) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id2A561C3A38D648ADBA2FF36A85E87232" style="OLC"> <paragraph id="id304B101A784F45EEB333E28C4B90115C" indent="up1"><enum>(4)</enum><text>The Secretary of Homeland Security may adjust the status of an alien who meets the requirements under section 214(m)(3) to that of an alien lawfully admitted for permanent residence if the alien—</text> <subparagraph id="id967EC82794EC4523B38FD9916E13ECD3"><enum>(A)</enum><text>makes an application for such adjustment;</text> </subparagraph><subparagraph id="id3318DBBE81C24CB39F2C4656B3D3F703"><enum>(B)</enum><text>is eligible to receive an immigrant visa;</text> </subparagraph><subparagraph id="idFBD3BD3F7EC34F99BC5ECB9203A5FFAB"><enum>(C)</enum><text>is admissible to the United States for permanent residence; and</text> </subparagraph><subparagraph id="idE26EE9B999E8415C80E27365D6D30875"><enum>(D)</enum><text>remits a fee of $1,000 to the Secretary.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="id97EAAB6D436746629722F69073365864"><enum>(d)</enum><header>Use of fees</header> <paragraph id="id91763C04D85A437E8356E1C7A698BF02"><enum>(1)</enum><header>Job training; scholarships</header><text>Section 286(s)(1) of the Immigration and Nationality Act (8 U.S.C. 1356(s)(1)) is amended by inserting <quote>and 80 percent of the fees collected under section 245(i)(4)</quote> before the period at the end.</text> </paragraph><paragraph id="idC0598FFA8B6545D8A2DF56A3656C79E0"><enum>(2)</enum><header>Fraud prevention and detection</header><text>Section 286(v)(1) of the Immigration and Nationality Act (8 U.S.C. 1356(v)(1)) is amended by inserting <quote>and 20 percent of the fees collected under section 245(i)(4)</quote> before the period at the end.</text> </paragraph></subsection></section><section id="id56BA06C4A7C9442E852D3BD5D994DAEB"><enum>314.</enum><header>Aliens not subject to numerical limitations on employment-based immigrants</header> <subsection id="id67477A9DD8494C8086487E8EC84730A4"><enum>(a)</enum><header>In general</header><text>Section 201(b)(1) of the Immigration and Nationality Act (8 U.S.C. 1151(b)(1)) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id7BB5DA7B2CB545ED800BCAFD3793E393" style="OLC"> <subparagraph id="idADEDB124FD4343FA9AD386D809522487"><enum>(F)</enum><text>Aliens who have earned an advanced degree in science, technology, engineering, or math and have been working in a related field in the United States under a nonimmigrant visa during the 3-year period preceding their application for an immigrant visa under section 203(b).</text> </subparagraph><subparagraph id="idAA5417BC33D4438F8347FC3E6BCA98A6"><enum>(G)</enum><text>Aliens described in subparagraph (A) or (B) of section 203(b)(1)(A) or who have received a national interest waiver under section 203(b)(2)(B).</text> </subparagraph><subparagraph id="id8C360D48783D456E86CADE959B698CDA"><enum>(H)</enum><text>The immediate relatives of an alien who is admitted as an employment-based immigrant under section 203(b).</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="idC33DB2D600E34DE2890F0D00263B4B0E"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply to any visa application pending on the date of enactment of this Act and any visa application filed on or after such date of enactment.</text> </subsection></section></subtitle><subtitle id="id2F289015D171404A9ABC4EBB7679BB59"><enum>B</enum><header>Patent Reform</header> <section id="id3DDB431756EE47919D902561F58B05AC"><enum>321.</enum><header>Patent reform</header><text display-inline="no-display-inline">It is the sense of the Senate that—</text> <paragraph id="ID8e187d4f34984c4f9cc123685e450111"><enum>(1)</enum><text>the United States Patent and Trademark Office should be provided with sufficient resources to make intellectual property protection more timely, predictable, and effective;</text> </paragraph><paragraph id="id0CAA91ECA816488FA77690DD18269C77"><enum>(2)</enum><text>the resources described under paragraph (1) should include a 20 percent increase in overall funding to hire and train additional examiners and implement more capable electronic processing; and</text> </paragraph><paragraph id="ID496506ecab854c56bc3c5f727cc9c011"><enum>(3)</enum><text>Congress should implement comprehensive patent reform that—</text> <subparagraph id="id4433F5D5A97648FE939930EC0D450511"><enum>(A)</enum><text>establishes a first-inventor-to-file system;</text> </subparagraph><subparagraph id="id09F0EFEB1F094F68BF8A6D20A542B0EF"><enum>(B)</enum><text>institutes an open review process following the grant of a patent;</text> </subparagraph><subparagraph id="id560DD8B434EA4E1F832B04981E70D783"><enum>(C)</enum><text>encourages research uses of patented inventions by shielding researchers from infringement liability; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD3393EA3655344C992AF660D5A687164"><enum>(D)</enum><text>reduces barriers to innovation in specific industries with specialized patent needs. <pagebreak></pagebreak></text> </subparagraph></paragraph></section></subtitle><enum>IV</enum><header>Reforming deemed exports</header> <section id="idFB4042A1A9A244F0896DF36BA2051146"><enum>401.</enum><header>Sense of Senate on exemption of certain uses of technology from treatment as exports</header> <subsection id="id52D6F408C4E349F8885179820BCE188C"><enum>(a)</enum><header>Sense of senate</header><text display-inline="yes-display-inline">It is the sense of the Senate that the use of technology by an institution of higher education in the United States should not be treated as an export of such technology for purposes of section 5 of the Export Administration Act of 1979 (50 U.S.C. App. 2404) and any regulations prescribed thereunder, as currently in effect pursuant to the provisions of the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), or any other provision of law, if such technology is so used by such institution for fundamental research.</text> </subsection><subsection id="idB738F23FBCF04ED8AE133C301B3DAA31"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id733ACB61139242DDB2AA9DD03533CC62"><enum>(1)</enum><header>Fundamental research</header><text>The term <quote>fundamental research</quote> has the meaning given that term in National Security Decision Directive 189, entitled <quote>National Policy on Transfer of Scientific, Technical, and Engineering Information</quote> and dated September 21, 1985.</text> </paragraph><paragraph id="idD1E6C5139EA443AF95DD28A2A80AB450"><enum>(2)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the meaning given that term in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a).</text> </paragraph></subsection></section><enum>V</enum><header>Strengthening basic research at the Department of Defense</header> <section id="id3950C9BCD7F44A6A9BA244278C33FD66"><enum>501.</enum><header>Department of Defense early-career research grants</header> <subsection id="id010577B57ECE4550B2D2CB14331FC807"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section to authorize research grants in the Department of Defense for early-career scientists and engineers for purposes of pursuing independent research.</text> </subsection><subsection id="id02F0A1821D9649A4A6DC68F4E28D4779"><enum>(b)</enum><header>Definition of eligible early-career researcher</header><text>In this section, the term <term>eligible early-career researcher</term> means an individual who—</text> <paragraph id="id2B7E697E7E5A45A7A78CE2AD88C9AAC4"><enum>(1)</enum><text>completed a doctorate or other terminal degree not more than 10 years before the date of enactment of this Act and has demonstrated promise in the field of science, technology, engineering, or mathematics; or</text> </paragraph><paragraph id="id5A4F6489928D4DBCB1DDF25FDF7A1291"><enum>(2)</enum><text>has an equivalent professional qualification in the field of science, technology, engineering, or mathematics.</text> </paragraph></subsection><subsection id="id78FA230055494810B5EF9CDB386E2EEA"><enum>(c)</enum><header>Grant program authorized</header> <paragraph id="idEB3110F1E10149B4AA98B4B18AF7608C"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense shall award not less than 25 grants per year to outstanding eligible early-career researchers to support the work of such researchers in universities, private industry, or federally-funded research and development centers.</text> </paragraph><paragraph id="idABF34080484B4108B5C3E8168941ECE8"><enum>(2)</enum><header>Application</header><text>An eligible early-career researcher who desires to receive a grant under this section shall submit to the Secretary of Defense an application at such time, in such manner, and accompanied by such information as the Secretary may require.</text> </paragraph><paragraph id="id450DE966DCE8428F9D48E3F55F0545E3"><enum>(3)</enum><header>Special consideration</header><text>In awarding grants under this section, the Secretary of Defense shall give special consideration to eligible early-career researchers who have followed alternative career paths such as working part-time or in non-academic settings, or who have taken a significant career break or other leave of absence.</text> </paragraph><paragraph id="id19DA7A2204AB4EA0A0DBECF0F8DD7304"><enum>(4)</enum><header>Duration and amount</header><text>A grant under this section shall be 5 years in duration. An eligible early career-researcher who receives a grant under this section shall receive $100,000 for each year of the grant period.</text> </paragraph><paragraph id="id42AC4A04AAB247CB8B659A57C9175E8C"><enum>(5)</enum><header>Use of funds</header><text>An eligible early career-researcher who receives a grant under this section shall use the grant funds for basic research in natural sciences, engineering, mathematics, or computer sciences at a university, private industry, or federally-funded research and development center.</text> </paragraph><paragraph id="idBEAEEA0B031042EB9E31F8C0F8CD8059"><enum>(6)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> <subparagraph id="id434055EBCB5A4FC99FB5876AFE74B33D"><enum>(A)</enum><text>$2,500,000 for fiscal year 2007;</text> </subparagraph><subparagraph id="id03B83D8BA13A4779A4F162830BDAF1E3"><enum>(B)</enum><text>$5,000,000 for fiscal year 2008;</text> </subparagraph><subparagraph id="id30B2F0D491B14B818F24E970E5DEF8C6"><enum>(C)</enum><text>$7,500,000 for fiscal year 2009;</text> </subparagraph><subparagraph id="id95AED07A711F45339291CF584878BB7A"><enum>(D)</enum><text>$10,000,000 for fiscal year 2010; and</text> </subparagraph><subparagraph id="idA63C9A20BAC041D3A8267B58E888D42C"><enum>(E)</enum><text>$12,500,000 for fiscal year 2011.</text> </subparagraph></paragraph></subsection></section><section id="idFE5E2AAF9BEB4CDFA1FE70D8DCA56EA3"><enum>502.</enum><header>Authorization of appropriations for the Department of Defense for basic research</header><text display-inline="no-display-inline">There is hereby authorized to be appropriated for the Department of Defense for basic (6.1) research, amounts for the research, development, test, and evaluation accounts of the Department, and for other accounts of the Department providing funding for such research, in the aggregate as follows:</text> <paragraph id="id62472A6FB3A14CF5978A401DAE1143F2"><enum>(1)</enum><text>$1,616,000,000 for fiscal year 2007.</text> </paragraph><paragraph id="idDA59CD2DAEA64FF2AC6529781D18F177"><enum>(2)</enum><text>$1,778,000,000 for fiscal year 2008.</text> </paragraph><paragraph id="idFD39667CF37A4C29AFD8B83DABE2E76D"><enum>(3)</enum><text>$1,995,000,000 for fiscal year 2009.</text> </paragraph><paragraph id="idEBEF0EAE3CDF475FBED704B72B816FFF"><enum>(4)</enum><text>$2,151,000,000 for fiscal year 2010.</text> </paragraph><paragraph id="idAB84837FD57F4D538EEFC10B81377752"><enum>(5)</enum><text>$2,364,000,000 for fiscal year 2011.</text> </paragraph><paragraph id="id404ADF82F6474AF4B01AACFF3D7B45B3"><enum>(6)</enum><text>$2,602,000,000 for fiscal year 2012.</text> </paragraph><paragraph id="id7BDD94BE48784EA4B15077BC7649699A"><enum>(7)</enum><text>$2,862,000,000 for fiscal year 2013.</text> </paragraph></section>
