		<official-title>To amend title XVIII of the Social Security Act to

		  provide residents of long-term care facilities with assistance with respect to

		  prescription drug coverage under part D of such title for the

		  resident.</official-title>

		<section id="idCF3621F34BC3401CA2759C796B2524A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Long-Term Care Resident Part D

			 Assistance Act of 2006</short-title></quote>.</text>

		</section><section id="ID44B9849B8F5741E082F74D111C1B136E"><enum>2.</enum><header>Part

			 <enum-in-header>D</enum-in-header> assistance for residents of Long-Term care

			 facilities</header>

			<subsection id="ID91D98A7F1A6B4376A891F7EF81A4CB00"><enum>(a)</enum><header>In

			 General</header><text>Section 1860D–42 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395w–152) is

			 amended by adding at the end the following new subsection:</text>

				<quoted-block act-name="Social Security Act" id="IDA3E892279F794ED89D11DDDB8898AEC5" style="OLC">

					<subsection id="ID4963CF1283D2441CA3D5FF3F8DC50DC1"><enum>(c)</enum><header>Assistance for

				Residents of Long-Term Care Facilities</header>

						<paragraph id="ID1C1FCA81C72946CEBE7FAF3D27ABB0B1"><enum>(1)</enum><header>Procedures and

				waiver of requirements</header>

							<subparagraph id="IDDF03C9DCAA2F4190B35BE33950F61FFA"><enum>(A)</enum><header>In

				general</header><text>The Secretary shall establish procedures and may waive

				requirements of this part as necessary to provide assistance to residents of

				long-term care facilities with respect to coverage under this part for the

				resident.</text>

							</subparagraph><subparagraph id="IDBACAB3EC8E8F40E69BF1FDB13BC4B89A"><enum>(B)</enum><header>Requirements</header><text>The

				procedures under subparagraph (A) shall include at least the following:</text>

								<clause id="ID8C4A004CD0E74B18B7F4BBE760ED4331"><enum>(i)</enum><header>Dedicated

				toll-free number</header><text>The establishment of a toll-free telephone

				number for staff members of long-term care facilities to request information

				regarding coverage under this part for the resident.</text>

								</clause><clause id="ID56F2BA29DB564376A58C374A256392D8"><enum>(ii)</enum><header>Assistance in

				selecting a plan rather than auto enrollment in a random

				plan</header><text>Notwithstanding section 1860D–1(b)(1)(C), in the case of a

				part D eligible individual who is a full-benefit dual eligible individual (as

				defined in section 1935(c)(6)), who is a resident of a long-term care facility,

				and who has failed to enroll in a prescription drug plan or an MA–PD plan,

				rather than randomly enrolling such an individual in a plan pursuant to such

				section, the Secretary shall coordinate with the resident and the long-term

				care facility to facilitate selection of and enrollment in the most appropriate

				plan under this part for the resident.</text>

								</clause><clause id="IDB53CF3C69652441CAE3DF5001E32CA95"><enum>(iii)</enum><header>Reimbursement

				of certain costs</header><text>The provision of reimbursement to long-term care

				facilities for the following costs:</text>

									<subclause id="id6693EA95197A4773A0FE4B7C009F5A50"><enum>(I)</enum><header>Costs

				associated with new requirements</header><text>Costs associated with the

				requirements under paragraph (2).</text>

									</subclause><subclause id="idE01E64D1237E44AA92C1D34686F333C7"><enum>(II)</enum><header>Prescription

				drug expenditures for covered part D drugs</header><text>The amount that the

				long-term care facility expends for payment for covered part D drugs for

				residents of the long-term care facility who are part D eligible individuals

				enrolled in a prescription drug plan under this part but were unable to access

				on a timely basis prescription drug benefits to which they were entitled under

				such plan.</text>

									</subclause><subclause id="id2939CF2E3B664BA3BA0D02DB1CAB12AE"><enum>(III)</enum><header>Providing

				part D assistance for residents of long-term care

				facilities</header><text>Costs associated with providing part D assistance for

				residents of long-term care facilities (including technical assistance in

				filling prescriptions, time spent waiting on the telephone or online to

				determine what plan a resident is enrolled in, and costs associated with

				advocating for residents by filing appeals or facilitating plan

				changes).</text>

									</subclause></clause></subparagraph></paragraph><paragraph id="ID8C394C90D2F94C82AC4A69B19370D5FC"><enum>(2)</enum><header>Requirements

				for long-term care facilities</header>

							<subparagraph id="ID9FBEA507F5E44F0295D8A539252F5B96"><enum>(A)</enum><header>In

				general</header><text>In the case of a long-term care facility receiving

				reimbursement under this title, the facility shall have in place procedures

				for—</text>

								<clause id="ID5CF4BAF75CFE49F68A3E0F4B46A8E994"><enum>(i)</enum><text>educating

				residents who are part D eligible individuals about the prescription drug

				coverage available through plans under this part; and</text>

								</clause><clause id="IDD944987F70DD422BBD2438EA1BDAA485"><enum>(ii)</enum><text>providing

				technical assistance, phone support, and counseling for such residents to

				facilitate selection of and enrollment in the most appropriate plan under this

				part for the resident.</text>

								</clause></subparagraph><subparagraph id="ID695E7781B1F94340893DDB77B7236A66"><enum>(B)</enum><header>Requirement</header><text>The

				procedures under subparagraph (A) shall include a requirement that the facility

				periodically ascertain (and inform the resident regarding) whether or not the

				plan in which the resident is enrolled in—</text>

								<clause id="ID84A59DEE46FC4A4DA341869B89DEEB9A"><enum>(i)</enum><text>provides coverage

				of the covered part D drugs that the resident requires; and</text>

								</clause><clause id="IDC93650DA1B2C4C64A95A3391FB5B2289"><enum>(ii)</enum><text>has a contract

				with a pharmacy that supports the

				facility.</text>

								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID1B0F69181E03405AB3BCEA03E298CE6F"><enum>(b)</enum><header>Effective

			 Date</header><text>The amendments made by this section shall take effect on the

			 date of enactment of this Act.</text>
