			 requirements</header>

			<subsection id="id03DF0B73B33445AD8130EBC3340A70C8"><enum>(a)</enum><header>Requirement</header>

				<paragraph id="id2EC8ECAF5552454489DA96384520C38C"><enum>(1)</enum><header>In

			 general</header><text>Section 1860D–4(b) of the Social Security Act (42 U.S.C.

			 1395w–104(b)) is amended by adding at the end the following new

			 paragraph:</text>

					<quoted-block display-inline="no-display-inline" id="idD4987FBBB4414EA8AFBB325B47C84801" style="OLC">

						<paragraph id="idD8BEDD2DFFFA48A0B175303E16126DE1"><enum>(4)</enum><header>Formulary

				transition</header><text>The sponsor of a prescription drug plan is required to

				provide at least a 30-day supply of any drug that a new enrollee in the plan

				was taking prior to enrolling in such plan. For individuals residing in a

				long-term care setting, the sponsor of a prescription drug plan is required to

				provide at least a 90-day supply of any drug such individual was taking prior

				to enrolling in such plan. A formulary transition supply provided under this

				section shall be made by the sponsor of a prescription drug plan without

				imposing any prior authorization requirements or other access restrictions for

				individuals stabilized on a course of treatment and at the dosage previously

				prescribed by a physician or recommended by a physician going forward.</text>

						</paragraph><paragraph id="id8850F399624A482D963323D9732D722A"><enum>(5)</enum><header>Customer

				service</header><text>The sponsor of a prescription drug plan is required to

				provide—</text>

							<subparagraph id="idB27840736B8649F78C50A44685816B6A"><enum>(A)</enum><text>accessible and

				trained customer service representatives available for full business hours from

				coast to coast to provide knowledgeable assistance to individuals seeking help

				with Medicare Part D including, but not limited to, beneficiaries, caseworkers,

				SHIP counselors, pharmacists, doctors, and caregivers;</text>

							</subparagraph><subparagraph id="id8A73F025CB5542DBA6B22E7B22DC2DF4"><enum>(B)</enum><text>at least one

				dedicated phone line for pharmacists with sufficient staff to reduce wait times

				for pharmacists seeking Medicare Part D assistance to no more than 20 minutes;

				and</text>

							</subparagraph><subparagraph id="idDBF74E3A131844159D4387A0034EA8D3"><enum>(C)</enum><text>sufficient staff

				to reduce wait times for all Medicare Part D-related calls to plan phone lines

				to no more than 20

				minutes.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph id="idDFB0FF0A6F754EDBBBBD5BA4615E1C4F"><enum>(2)</enum><header>Application</header><text>The

			 requirements under paragraphs (4) and (5) of section 1860D–4(b) of the Social

			 Security Act (42 U.S.C. 1395w–104(b)), as added by subsection (a), shall apply

			 to the plan serving as the national point of sale contractor under part D of

			 title XVIII of such Act.</text>

				</paragraph></subsection><subsection id="idED387298A4AC4B9B953C82B0CCED89EF"><enum>(b)</enum><header>Effective Date

			 and Enforcement</header>

				<paragraph id="idC621D50BAC8E470B8D3A0EB8B178B286"><enum>(1)</enum><header>Effective

			 Date</header><text>The amendment made by subsection (a) shall take effect on

			 the date of enactment of this Act.</text>

				</paragraph><paragraph id="IDCA54AC32311D4A2BBB891318FA20FC81"><enum>(2)</enum><header>Enforcement</header><text>The

			 Secretary may impose a civil monetary penalty in an amount not to exceed

			 $15,000 for conduct that a sponsor of a prescription drug plan or an

			 organization offering an MA–PD plan knows or should know is a violation of the

			 provisions of paragraph (4) or (5) of section 1860D–4(b) of the Social Security

			 Act (42 U.S.C. 1395w–104(b)), as added by subsection (a). The provisions of

			 section 1128A of the Social Security Act (42 U.S.C. a–7a), other than

			 subsections (a) and (b) and the second sentence of subsection (f), shall apply

			 to a civil monetary penalty under the previous sentence in the same manner as

			 such provisions apply to a penalty or proceeding under subsection (a) of such

			 section 1128A(a).</text>

				</paragraph></subsection></section><section id="idD0A7845046594CC4A1158F1BE701BFEA"><enum>3.</enum><header>Federal fallback

			 for full-benefit dual eligible individuals for 2006</header>

			<subsection id="idEEAB849AE9314993BB72DAE70606DEA0"><enum>(a)</enum><header>In

			 general</header>

				<paragraph id="idE80BCE99582341E29A52F7034915DB01"><enum>(1)</enum><header>In

			 general</header><text>If a full-benefit dual eligible individual (as defined in

			 section 1935(c)(6) of the Social Security Act (42 U.S.C. 1396u–5(c)(6))), or an

			 individual who is presumed to be such an individual pursuant to subsection (b),

			 presents a prescription for a covered part D drug (as defined in section

			 1860D–2(e) of such Act (42 U.S.C. 1395w–102(e))) at a pharmacy in 2006 and the

			 pharmacy is unable to locate or verify the individual's enrollment through a

			 reasonable effort, including the use of the pharmacy billing system or by

			 calling an official Medicare hotline, or to bill for the prescription through

			 the plan serving as the national point of sale contractor, the pharmacy may

			 provide a 30-day supply of the drug to the individual.</text>

				</paragraph><paragraph id="id03C26A508B4D484C8163A388A381B5D9"><enum>(2)</enum><header>Refill</header><text>The

			 pharmacy may provide an additional 30-day supply of a drug if the pharmacy

			 continues to be unable to locate the individual's enrollment through such

			 reasonable efforts or to bill for the prescription through the plan serving as

			 the national point of sale contractor when a prescription is presented on or

			 after the date that a prescription refill is appropriate, but in no case after

			 December 31, 2006.</text>

				</paragraph><paragraph id="id9ED549735061431D92928D13E687B9EE"><enum>(3)</enum><header>Cost-sharing</header><text>The

			 cost-sharing for a prescription filled pursuant to this subsection shall be

			 cost-sharing provided for under section 1860D–14(a) of the Social Security Act

			 (42 U.S.C. 1395w–114(a)).</text>

				</paragraph></subsection><subsection id="id38CC418FFB244745B75414268E2366B3"><enum>(b)</enum><header>Presumptive

			 eligibility</header><text>An individual shall be presumed to be a full-benefit

			 dual eligible individual (as so defined) if the individual presents at the

			 pharmacy with—</text>

				<paragraph id="id53B79025D9EB4CCFAA710D9FCB595ABD"><enum>(1)</enum><text>a government

			 issued picture identification card;</text>

				</paragraph><paragraph id="idFC4798726F614098B4BCDA7CF09EDFD1"><enum>(2)</enum><text>reliable evidence

			 of Medicaid enrollment, such as a Medicaid card, recent history of Medicaid

			 billing in the pharmacy patient profile, or a copy of a current Medicaid award

			 letter; and</text>

				</paragraph><paragraph id="idDF9402E4FBB34E83AACF226BB46C9EBA"><enum>(3)</enum><text>reliable evidence

			 of Medicare enrollment, such as a Medicare identification card, a Medicare

			 enrollment approval letter, a Medicare Summary Notice, or confirmation from an

			 official Medicare hotline.</text>

				</paragraph></subsection><subsection id="idDEB37E49B6EF429C928D7444C0F25A6B"><enum>(c)</enum><header>Payments to

			 pharmacists</header>

				<paragraph id="id6A72A32654834F4FB161E57B342E9453"><enum>(1)</enum><header>In

			 general</header><text>The Secretary of Health and Human Services shall

			 reimburse pharmacists, to the extent that such pharmacists are not otherwise

			 reimbursed by States or plans, for the costs incurred in complying with the

			 requirements under subsection (a), including acquisition costs, dispensing

			 costs, and other overhead costs. Such payments shall be made in a timely manner

			 from the Medicare Prescription Drug Account under section 1860D–16 of the

			 Social Security Act (42 U.S.C. 1395w–116) and shall be deemed to be payments

			 from such Account under subsection (b) of such section.</text>

				</paragraph><paragraph id="id6E781FA3087A43B39908BADF831D9175"><enum>(2)</enum><header>Retroactive

			 application to beginning of 2006</header><text>The costs incurred by a pharmacy

			 which may be reimbursed under paragraph (1) shall include costs incurred during

			 the period beginning on January 1, 2006, and before the date of enactment of

			 this Act.</text>

				</paragraph></subsection><subsection id="id1A71DC1902604469A07CBED927841284"><enum>(d)</enum><header>Recovery of

			 costs from plans by Secretary not Pharmacies</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services

			 shall establish a process for recovering the costs described in subsection

			 (c)(1) from prescription drug plans (as defined in section 1860D–1(a)(3)(C) of

			 the Social Security Act (42 U.S.C. 1394w–101(a)(3)(C))) and MA–PD plans (as

			 defined in section 1860D–41(a)(14) of such Act (42 U.S.C. 1395w–151(a)(14))) if

			 the Secretary determines that such plans should have incurred such costs.

			 Amounts recovered pursuant to the preceding sentence shall be deposited in the

			 Medicare Prescription Drug Account described in subsection (c)(1).</text>

			</subsection></section><section id="id83CDCDC22F1A47B5A0F057A7126924CE"><enum>4.</enum><header>Identifying

			 full-benefit dual eligible individuals in data records</header>

			<subsection id="IDb75a2025651e4184a581be27a465c5fe"><enum>(a)</enum><header>In

			 general</header><text>The Secretary of Health and Human Services and a

			 prescription drug plan or an MA–PD plan shall clearly identify all full-benefit

			 dual eligible individuals (as defined in section 1935(c)(6) of the Social

			 Security Act (42 U.S.C. 1396u–5(c)(6))) and reflect the low-income subsidy

			 status of such individual for each calender year (beginning with 2006) in every

			 data record file used to enroll or adjudicate claims for such

			 individuals.</text>

			</subsection><subsection id="idE9DC5C30A3F84E2FA4CBCE7976AB9FA9"><enum>(b)</enum><header>Enrollment</header><text>For

			 each calendar year (beginning with 2006) and for each Medicaid beneficiary who

			 is a full-benefit dual eligible individual (as so defined), the Secretary of

			 Health and Human Services shall—</text>

				<paragraph id="id70D9C27587C94A0CB10FD40A69C7ACD3"><enum>(1)</enum><text>identify in the

			 Medicare enrollment database that such individual has dual eligible status that

			 has been verified with a State or the District of Columbia; and</text>

				</paragraph><paragraph id="idAB72611442C1470E884F74063F8A8F1D"><enum>(2)</enum><text>ensure that such

			 dual eligible status is reflected in each data file necessary to ensure that

			 such status is transmitted to a prescription drug plan or an MA–PD plan when

			 the Secretary certifies the enrollment of such an individual in a plan.</text>

				</paragraph></subsection><subsection id="idFE4E084B51B64B9EB8E51FC0F037E279"><enum>(c)</enum><header>Definition of

			 MA–PD plan and prescription drug plan</header><text>For purposes of this

			 section, the terms <quote>MA–PD plan</quote> and <quote>prescription drug

			 plan</quote> have the meaning given such terms in sections 1860D–1(a)(3)(C) and

			 1860D–41(a)(14) of the Social Security Act (42 U.S.C. 1395w–101(a)(3)(C);

			 1395w–151(a)(14)), respectively.</text>

			</subsection></section><section id="idD1A25A614C5D49DDB89F770A22A9D277"><enum>5.</enum><header>Prohibition on

			 conditioning Medicaid eligibility for individuals enrolled in certain

			 creditable prescription drug coverage on enrollment in the Medicare part D drug

			 program</header>

			<subsection id="id7A0164413BB847FDB53B19B4A74A2559"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 1935 of the

			 Social Security Act (42 U.S.C. 1396v) is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="id827A892BBC1445F5ACDA63F4665330F5" style="OLC">

					<subsection id="id4442DE9D68F146E0968B4E1550ADB7B0"><enum>(f)</enum><header>Prohibition on

				conditioning eligibility for medical assistance for individuals enrolled in

				certain creditable prescription drug coverage on enrollment in medicare

				prescription drug benefit</header>

						<paragraph id="idE921DBB829EB44B891E5E872754A4E1D"><enum>(1)</enum><header>In

				general</header><text>A State shall not condition eligibility for medical

				assistance under the State plan for a part D eligible individual (as defined in

				section 1860D–1(a)(3)(A)) who is enrolled in creditable prescription drug

				coverage described in any of subparagraphs (C) through (H) of section

				1860D–13(b)(4) on the individual's enrollment in a prescription drug plan under

				part D of title XVIII or an MA–PD plan under part C of such title.</text>

						</paragraph><paragraph id="id62E0F6741A6542F1BC5C40829DA1BD08"><enum>(2)</enum><header>Coordination of

				benefits with part D for other individuals</header><text>Nothing in this

				subsection shall be construed as prohibiting a State from coordinating medical

				assistance under the State plan with benefits under part D of title XVIII for

				individuals not described in paragraph

				(1).</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="idEC8B5DBB8F384FA183BE3D07C9D2C959"><enum>(b)</enum><header>Nullification

			 of state plan amendments, redetermination of eligibility</header><text>In the

			 case of a State that, as of the date of enactment of this Act, has an approved

			 amendment to its State plan under title XIX of the Social Security Act with a

			 provision that conflicts with section 1935(f) of such Act (as added by

			 subsection (a)), such provision is, as of such date of enactment, null and

			 void. The State shall redetermine any applications for medical assistance that

			 have been denied solely on the basis of the application of such a State plan

			 amendment not later than 90 days after the date of enactment of this

			 Act.</text>

			</subsection></section><section id="id5A3284A0E6D64E18A3ED03720C576AFD"><enum>6.</enum><header>Ensuring that

			 full-benefit dual eligible individuals are not overcharged</header>

			<subsection id="id275CB3DECD1343F8B7651EA094404EFD"><enum>(a)</enum><header>In

			 General</header><text>Section 1860D–14 of the Social Security Act (42 U.S.C.

			 1395w–114) is amended—</text>

				<paragraph id="id0EF90BF7B10C45CBA6861EAAD54CFCD6"><enum>(1)</enum><text>by redesignating

			 subsection (d) as subsection (e); and</text>

				</paragraph><paragraph id="idE93C7B4E56CD419DBE8C8DA99FBE75B3"><enum>(2)</enum><text>by inserting

			 after subsection (c) the following new subsection:</text>

					<quoted-block display-inline="no-display-inline" id="id34BF71AABA7D41BA8EDD62AAB54BB5EF" style="OLC">

						<subsection id="id517E0DE6A37C402CA0D78A610FDE59A2"><enum>(d)</enum><header>Ensuring

				full-benefit dual eligible individuals are not overcharged</header>

							<paragraph id="id7B6C2DB46CDF4AA6A2E61B87EFC996BF"><enum>(1)</enum><header>In

				general</header><text>The Secretary shall, as soon a possible after the date of

				enactment of this subsection, establish processes for the following:</text>

								<subparagraph id="id72BD8C2C69A64421A2A2B4945D92CB07"><enum>(A)</enum><header>Tracking

				inappropriate payments</header><text>The Secretary shall track full-benefit

				dual eligible individuals enrolled in a prescription drug plan or an MA–PD plan

				to determine whether such individuals were inappropriately subject under the

				plan to a deductible or cost-sharing that is greater than is required under

				section 1860D–14.</text>

								</subparagraph><subparagraph id="id194329977970402EB74749421C2C3214"><enum>(B)</enum><header>Reduction in

				payments to plans and refunds to individuals</header><text>If the Secretary

				determines under subparagraph (A) that an individual was overcharged, the

				Secretary shall—</text>

									<clause id="idB7DF48A305D14E41884054A4A833BEC9"><enum>(i)</enum><text>reduce payments

				to the sponsor of the prescription drug plan under section 1860D–15 or to the

				organization offering the MA–PD plan under section 1853 that inappropriately

				charged the individual by an amount equal to the inappropriate charges;

				and</text>

									</clause><clause id="idE12D9120B5BB4796A64239A5D1B5155D"><enum>(ii)</enum><text>refund such

				amount to the individual within 60 days of the determination that the

				individual was inappropriately charged.</text>

									</clause><continuation-text continuation-text-level="subparagraph">If the

				Secretary does not provide for the refund under clause (i) within the 60 days

				provided for under such clause, interest at the rate established under section

				6621(a)(1) of the Internal Revenue Code of 1986 shall be payable from the end

				of such 60-day period until the date of the refund.</continuation-text></subparagraph></paragraph><paragraph id="id8C35C751D944443E921F76ABB980D7CC"><enum>(2)</enum><header>Requirement</header><text>The

				processes established under paragraph (1) shall provide for the ability of an

				individual to notify the Secretary if the individual believes that they were

				inappropriately subject under the plan to a deductible or cost-sharing that is

				greater than is required under section

				1860D–14.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection id="id18603C6D26DD48649A958106A5FDCBD0"><enum>(b)</enum><header>Report to

			 Congress</header><text>Not later than January 1, 2007, the Secretary of Health

			 and Human Services shall submit a report to Congress on the implementation of

			 the processes established under subsection (d) of section 1860D–14 of the

			 Social Security Act (42 U.S.C. 1395w–114), as added by subsection (a).</text>

			</subsection></section><section id="idA652981CDF934137BDD6B26F51B86DF1"><enum>7.</enum><header>Reimbursement of

			 States for 2006 transition costs</header>

			<subsection id="idC51F8213F9BA4808B670C93E0BC173A5"><enum>(a)</enum><header>Reimbursement</header>

				<paragraph id="id8A2C70E437DC4ECBAD751D4D757C29DF"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Notwithstanding

			 section 1935(d) of the Social Security Act (42 U.S.C. 1396u–5(d) or any other

			 provision of law, the Secretary of Health and Human Services shall reimburse

			 States for 100 percent of the costs incurred by the State during 2006 for

			 covered part D drugs (as defined in section 1860D–2(e) of such Act (42 U.S.C.

			 1395w–102(e))) for part D eligible individuals (as defined in section

			 1860D–1(a)(3)(A) of the Social Security Act (42 U.S.C. 1394w–101(a)(3)(A)))

			 which the State reasonably expected would have been covered under such part but

			 were not because the individual was unable to access on a timely basis

			 prescription drug benefits to which they were entitled under such part. Such

			 payments shall be made from the Medicare Prescription Drug Account under

			 section 1860D–16 of the Social Security Act (42 U.S.C. 1395w–116) and shall be

			 deemed to be payments from such Account under subsection (b) of such

			 section.</text>

				</paragraph><paragraph id="id630179B0B801443D91D35C0F89BEAF7E"><enum>(2)</enum><header>Retroactive

			 application to beginning of 2006</header><text>The costs incurred by a State

			 which may be reimbursed under paragraph (1) shall include costs incurred during

			 the period beginning on January 1, 2006, and before the date of enactment of

			 this Act.</text>

				</paragraph></subsection><subsection id="idE52C4255A76945329612C050F9DDDDA5"><enum>(b)</enum><header>Recovery of

			 costs from plans by Secretary not States</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services

			 shall establish a process for recovering the costs described in subsection

			 (a)(1) from prescription drug plans (as defined in section 1860D–1(a)(3)(C) of

			 the Social Security Act (42 U.S.C. 1394w–101(a)(3)(C))) and MA–PD plans (as

			 defined in section 1860D–41(a)(14) of such Act (42 U.S.C. 1395w–151(a)(14))) if

			 the Secretary determines that such plans should have incurred such costs.

			 Amounts recovered pursuant to the preceding sentence shall be deposited in the

			 Medicare Prescription Drug Account described in subsection (a)(1).</text>

			</subsection><subsection id="idFAEC40B62990496D822310256AE6FC49"><enum>(c)</enum><header>State</header><text>For

			 purposes of this section, the term <quote>State</quote> includes the District

			 of Columbia.</text>

			</subsection></section><section id="ID760941E4A71F463E89F9C3FCEFE0D576"><enum>8.</enum><header>Facilitation of

			 identification and enrollment through pharmacies of full-benefit dual eligible

			 individuals in the Medicare part <enum-in-header>D</enum-in-header> drug

			 program</header>

			<subsection id="ID74ECC4BECEF247C796EFEC7108054802"><enum>(a)</enum><header>In

			 General</header><text>The Secretary of Health and Human Services shall provide

			 for outreach and education to every pharmacy that has participated in the

			 Medicaid program under title XIV of the <act-name parsable-cite="SSA">Social

			 Security Act</act-name>, particularly independent pharmacies, on the

			 following:</text>

				<paragraph id="IDECA5615ECB204A1D82CE1ADC88F9EFD1"><enum>(1)</enum><text>The needs of

			 full-benefit dual eligible individuals and the challenges of meeting those

			 needs.</text>

				</paragraph><paragraph id="IDECFB3E84BA7540E4A455F4F39E61AAB3"><enum>(2)</enum><text>The processes for

			 the transition from Medicaid prescription drug coverage to coverage under such

			 part D for such individuals.</text>

				</paragraph><paragraph id="ID305D652441FD40E3A04771E01EEBEB32"><enum>(3)</enum><text>The processes

			 established by the Secretary to facilitate, at point of sale, identification of

			 drug plan assignment of such population or enrollment of previously

			 unidentified or new full-benefit dual eligible individuals into Medicare part D

			 prescription drug coverage, including how pharmacies can use such processes to

			 help ensure that such population makes a successful transition to Medicare part

			 D without a lapse in prescription drug coverage.</text>

				</paragraph></subsection><subsection id="ID0C66B99E88DC4E119B566D6663A11FCB"><enum>(b)</enum><header>Holding

			 Pharmacies Harmless for Certain Costs</header>

				<paragraph id="id3C4BF0C933D1488DB4CD7B051FD757B0"><enum>(1)</enum><header>In

			 general</header><text>The Secretary of Health and Human Services shall provide

			 for such payments to pharmacies as may be necessary to reimburse pharmacies

			 fully for—</text>

					<subparagraph id="ID7DAC90E2A4754B9B9C5ABD70ADFD236F"><enum>(A)</enum><text>transaction fees

			 associated with the point-of-sale facilitated identification and enrollment

			 processes referred to in subsection (a)(3); and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID24A445F347914B84BAB1D566C0C352BA"><enum>(B)</enum><text>costs associated

			 with technology or software upgrades necessary to make any identification and

			 enrollment inquiries as part of the processes under subsection (a)(3).</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4623633206564E57859150DD7B5171F2"><enum>(2)</enum><header>Time</header><text>Payments

			 under paragraph (1) shall be made with respect to fees and costs incurred

			 during the period beginning on December 1, 2005, and ending on June 1,

			 2006.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44B078C0C7454A75AB494467481D2CA8"><enum>(3)</enum><header>Payments from

			 account</header><text>Payments under paragraph (1) shall be made from the

			 Medicare Prescription Drug Account under section 1860D–16 of the Social

			 Security Act (42 U.S.C. 1395w–116) and shall be deemed to be payments from such

			 Account under subsection (b) of such section.</text>

				</paragraph></subsection></section><section id="IDAA73BDCD79BF48648DEC6A12B0AF3D34"><enum>9.</enum><header>State health

			 insurance program assistance regarding the new Medicare prescription drug

			 benefit</header><text display-inline="no-display-inline">During the period

			 beginning on the date that is 7 days after the date of enactment of this Act

			 and ending on May 15, 2006 (or a later date if determined appropriate by the

			 Secretary of Health and Human Services), the Secretary shall ensure that an

			 employee of the Centers for Medicare &amp; Medicaid Services is stationed at

			 each State health insurance counseling program (receiving funding under section

			 4360 of the Omnibus Budget Reconciliation Act of 1990) in order to—</text>

			<paragraph id="ID83B5E03D3E9E4F579FD27B80D299837D"><enum>(1)</enum><text>assist Medicare

			 beneficiaries and counselors under such program in better understanding the

			 Medicare prescription drug benefit under part D of title XVIII of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name>; and</text>

			</paragraph><paragraph id="ID6027E254DF1B42DDBA5679E871F6DFC0"><enum>(2)</enum><text>act as a liaison

			 to the Secretary and the Administrator of the Centers for Medicare &amp;

			 Medicaid Services regarding issues related to oversight and enforcement of

			 provisions under the Medicare prescription drug benefit.</text>

			</paragraph></section><section id="id31FF6D87D81647378A2F0ACBE6DD2009"><enum>10.</enum><header>Additional

			 Medicare part D informational resources</header>

			<subsection id="id8A013BDDF6F543A4BB6A0600AC9D251D"><enum>(a)</enum><header>1-800-MEDICARE</header><text>The

			 Secretary of Health and Human Services shall increase the number of trained

			 employees staffing the toll-free telephone number 1–800–MEDICARE in order to

			 ensure that the average wait time for a caller does not exceed 20

			 minutes.</text>

			</subsection><subsection id="id1A7AF2C6B53E406BAC20C64EA846181A"><enum>(b)</enum><header>Pharmacy

			 hotline</header><text>The Secretary of Health and Human Services shall—</text>

				<paragraph id="id2C11F6727CF34ED5A46893177D0E5A34"><enum>(1)</enum><text>establish a

			 toll-free telephone number that is dedicated to providing information regarding

			 the Medicare prescription drug benefit under title XVIII of the Social Security

			 Act to pharmacists; and</text>

				</paragraph><paragraph id="id8B8A0D99AC1846E696B35C7B5236414F"><enum>(2)</enum><text>staff such

			 telephone number in order to ensure that the average wait time for a caller

			 does not exceed 20 minutes.</text>

				</paragraph></subsection><subsection id="id814DD62F1332491385305A78B5D50924"><enum>(c)</enum><header>State health

			 insurance program hotline</header><text>The Secretary of Health and Human

			 Services shall—</text>

				<paragraph id="id2072E0FFB5C84363AC0D5552E8908DAF"><enum>(1)</enum><text>establish a

			 toll-free telephone number that is dedicated to providing information regarding

			 the Medicare prescription drug benefit under title XVIII of the Social Security

			 Act to counselors working in State health insurance counseling programs

			 (receiving funding under section 4360 of the Omnibus Budget Reconciliation Act

			 of 1990); and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0D0D8BE92D44DBC841F5B64FB6CACA1"><enum>(2)</enum><text>staff such

			 telephone number in order to ensure that the average wait time for a caller

			 does not exceed 20 minutes.</text>

				</paragraph></subsection></section><section id="id2FC857BF165542948B6DDA2FA1B70D7D"><enum>11.</enum><header>GAO study and

			 report on the imposition of co-payments under part D for full-benefit dual

			 eligible individuals residing in a long-term care facility</header>

			<subsection id="id0BD2E1CD22974B5BB8BA2AD5D71D977D"><enum>(a)</enum><header>Study</header><text>The

			 Comptroller General of the United States shall conduct a study on how mental

			 health patients who are full-benefit dual eligible individuals (as defined in

			 section 1935(c)(6) of the Social Security Act (42 U.S.C. 1396u–5(c)(6))) and

			 who reside in long-term care facilities, including licensed assisted living

			 facilities, will be affected by the imposition of co-payments for covered part

			 D drugs under part D of title XVIII of such Act. Such study shall include a

			 review of issues that relate to the potential harm of displacement due to an

			 inability to access needed medications because of such co-payments.</text>

			</subsection><subsection id="id6F977F1922A9477F9752882DDD207095"><enum>(b)</enum><header>Report</header><text>Not

			 later than 6 months after the date of enactment of this Act, the Comptroller

			 General of the United States shall submit a report to Congress on the study

			 conducted under subsection (a) together with recommendations for such

			 legislation as the Comptroller General determines is appropriate.</text>

			</subsection></section><section id="id3628C526A05145EC95BBD17B5F1BEF87"><enum>12.</enum><header>State coverage

			 of non-formulary prescription drugs for full-benefit dual eligible individuals

			 during 2006</header>

			<subsection commented="no" display-inline="no-display-inline" id="idB92121A2E50F49A895429A83C55228D1"><enum>(a)</enum><header>State coverage

			 of non-formulary prescription drugs for full-benefit dual eligible individuals

			 during 2006</header><text display-inline="yes-display-inline">For prescriptions

			 filled during 2006, notwithstanding section 1935(d) of the Social Security Act

			 (42 U.S.C. 1396v(d)), a State (as defined for purposes of title XIX of such

			 Act) may provide (and receive Federal financial participation for) medical

			 assistance under such title with respect to prescription drugs provided to a

			 full-benefit dual eligible individual (as defined in section 1935(c)(6) of such

			 Act (42 U.S.C. 1396v(c)(6)) that are not on the formulary of the prescription

			 drug plan under part D or the MA–PD plan under part C of title XVIII of such

			 Act in which such individual is enrolled.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idFC6EF1421D204B23A12F806D500B268C"><enum>(b)</enum><header>Application</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id0873AC4F62174328A7D4D08C240A6369"><enum>(1)</enum><header>Medicare as

			 primary payer</header><text display-inline="yes-display-inline">Nothing in

			 subsection (a) shall be construed as changing or affecting the primary payer

			 status of a prescription drug plan under part D or an MA–PD plan under part C

			 of title XVIII of the Social Security Act with respect to prescription drugs

			 furnished to any full-benefit dual eligible individual (as defined in

			 <external-xref legal-doc="act" parsable-cite="SSA/1935(c)(6)">section

			 1935(c)(6)</external-xref> of such <act-name parsable-cite="SSA">Act</act-name>

			 (42 U.S.C. 1396v(c)(6)) during 2006.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7BA27D3E236C4E899293C8377728C560"><enum>(2)</enum><header>Third Party

			 Liability</header><text display-inline="yes-display-inline">Nothing in

			 subsection (a) shall be construed as limiting the authority or responsibility

			 of a State under section 1902(a)(25) of the Social Security Act (42 U.S.C.

			 1396a(a)(25)) to seek reimbursement from a prescription drug plan, an MA–PD

			 plan, or any other third party, of the costs incurred by the State in providing

			 prescription drug coverage during 2006.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id816BF060017644DD9ED88B9E3CE1FDAB"><enum>13.</enum><header>Protection for

			 full-benefit dual eligible individuals from plan termination prior to receiving

			 functioning access in a new part D plan</header>

			<subsection commented="no" display-inline="no-display-inline" id="id7ECEE939A05F4DC0B47B940046C9A03E"><enum>(a)</enum><header>In

			 general</header><text>Notwithstanding any other provision of law, the Secretary

			 of Health and Human Services shall not terminate coverage of a full-benefit

			 dual eligible individual (as defined in section 1935(c)(6) of the Social

			 Security Act (42 U.S.C. 1396v(c)(6)) unless such individual has functioning

			 access to a prescription drug plan under part D or an MA–PD plan under part C

			 of title XVIII of such Act. Such access shall include entry of the individual

			 into the computer system of such plan and an acknowledgment by the plan that

			 the individual is eligible for a full premium subsidy under section 1860D–14 of

			 such Act (42 U.S.C. 1395w–114).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idE3A403910AF94BE18580CAA987F83007"><enum>(b)</enum><header>Effective

			 date</header><text>This section shall take effect on the date of enactment of

			 this Act.</text>
