		<official-title>To amend title XIX of the Social Security Act to provide

		  for an offset from the Medicaid clawback for State prescription drug

		  expenditures for covered part D drugs for Medicare

		  beneficiaries.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Medicare State Reimbursement Act

			 of 2006</short-title></quote>.</text>

		</section><section id="id4943B83539F445BAB7CA1F04E05E09B7"><enum>2.</enum><header>Federal

			 responsibility for State prescription drug expenditures for covered part D

			 drugs for medicare beneficiaries</header><text display-inline="no-display-inline">Section 1935(c) of the Social Security Act

			 (42 U.S.C. 1396v(c)) is amended—</text>

			<paragraph id="id96DD4503FDB94389BB4F399CF5E9B289"><enum>(1)</enum><text>in paragraph

			 (1)(A), by striking <quote>Each of the 50 States</quote> and inserting

			 <quote>Subject to paragraph (7), each of the 50 States</quote>; and</text>

			</paragraph><paragraph id="id225F3903D49543E1B9E2935AA588E08E"><enum>(2)</enum><text>by adding at the

			 end the following new paragraph:</text>

				<quoted-block display-inline="no-display-inline" id="id8598E8105D8E44E6BAE89801C102B4A1" style="OLC">

					<paragraph id="id4B86A07F59544A86ACDADD66063EEB0E"><enum>(7)</enum><header>Offset for

				State prescription drug expenditures for covered part D drugs for medicare

				beneficiaries</header>

						<subparagraph id="id06598A60C6F84CF4B6394C2882DDD3B0"><enum>(A)</enum><header>In

				general</header><text>The amount of payment for a month (beginning with January

				2006) under paragraph (1) shall be reduced by an amount equal to the sum

				of—</text>

							<clause id="id331B2FD17BDC4AD3BAA03EAB821D5FBF"><enum>(i)</enum><text>the amount (as

				documented by the State) that the State expended during the month for payment

				for covered part D drugs for part D eligible individuals who are enrolled in a

				prescription drug plan under part D of title XVIII but were unable to access on

				a timely basis prescription drug benefits to which they were entitled under

				such plan; and</text>

							</clause><clause commented="no" id="id3BF3D8168F864C0E84B52A45D6383F00"><enum>(ii)</enum><text>interest on such

				amount (for the period beginning on the day after the date on which an

				expenditure described in subparagraph (A) is made and ending on the date on

				which payment is made under paragraph (1)) at a rate equal to the weighted

				average of interest on 3-month marketable Treasury securities determined for

				such period, increased by 0.1 percentage point.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id838FE196374F40AABBCCFFAAD22217CA"><enum>(B)</enum><header>Recovery of

				reduced payment from prescription drug plans</header><text display-inline="yes-display-inline">The Secretary shall provide for recovery of

				payment reductions made under subparagraph (A) from those prescription drug

				plans under part D of title XVIII or MA–PD plans under part C of such title

				that would otherwise be responsible for the expenditures described in

				subparagraph (A)(i). Any such amounts recovered shall be deposited into the

				Medicare Prescription Drug Account in the Federal Supplementary Medical

				Insurance Trust

				Fund.</text>
