			 elect who is a registered lobbyist</quote>.</text>

			</section><section commented="no" display-inline="no-display-inline" id="H01B78C77644149F996AC9632ABEE0080" section-type="subsequent-section"><enum>103.</enum><header>Disclosure by

			 Members of Congress and senior congressional staff of employment

			 negotiations</header>

				<subsection commented="no" display-inline="no-display-inline" id="HA247488F298348A5AE7994B422F6EEE5"><enum>(a)</enum><header>Senate</header><text display-inline="yes-display-inline">Rule XXXVII of the Standing Rules of the

			 Senate is amended by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="id0B8F891457784A468A59A769F4AD7DBC" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="id0639F48BE7E94B519020582DDDFACCA8" indent="up1"><enum>13.

				(a)</enum><text display-inline="yes-display-inline">A Member of the Senate or

				an employee of the Senate earning in excess of 75 percent of the salary paid to

				a Senator shall notify the Committee on Ethics that he or she is negotiating or

				has any arrangement concerning prospective private employment if a conflict of

				interest or the appearance of a conflict of interest may exist.</text>

						</paragraph><subsection commented="no" display-inline="no-display-inline" id="idAAD80DFBB1894DD1B79EC4F7BB163322"><enum>(b)</enum><text display-inline="yes-display-inline">The disclosure and notification under

				subparagraph (a) shall be made within 3 business days after the commencement of

				such negotiation or arrangement.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="idC6B1EE636F0948CA8AE19293982CE6F6"><enum>(c)</enum><text display-inline="yes-display-inline">A Member or employee to whom this rule

				applies shall recuse himself or herself from any matter in which there is a

				conflict of interest for that Member or employee under this rule and notify the

				Select Committee on Ethics of such recusal.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="id4A8E4A8B635A4BD680F6D9E6854F6568"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idFE4B77F4BD2347079CA46121BFF029C9"><enum>(1)</enum><text display-inline="yes-display-inline">The Select Committee on Ethics shall

				develop guidelines concerning conduct which is covered by this

				paragraph.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id419B296E7ED6451D9A7259259AD43BC7" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Select Committee on Ethics shall

				maintain a current public record of all notifications received under

				subparagraph (a) and of all recusals under subparagraph

				(c).</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="H893239D8463F4769A3767D9F514B5FD1" section-type="subsequent-section"><enum>104.</enum><header>Ethics review of

			 employment negotiations by executive branch officials</header><text display-inline="no-display-inline">Section 208 of title 18, United States Code,

			 is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="HD97B4D9031CC4C81B6C5E392937DAB7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(1)—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="HAFB815B5134149818B3FDAD71865813C"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting after <quote>the Government

			 official responsible for appointment to his or her position</quote> the

			 following: <quote>and the Office of Government Ethics</quote>; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB98FAB14842B416CA4B511BDF4C5CFCB"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>a written determination

			 made by such official</quote> and inserting <quote>a written determination made

			 by the Office of Government Ethics, after consultation with such

			 official,</quote>; and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDF35CE6A507843FBA17772D2A45F73F8"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(3), by striking

			 <quote>the official responsible for the employee’s appointment, after review

			 of</quote> and inserting <quote>the Office of Government Ethics, after

			 consultation with the official responsible for the employee’s appointment and

			 after review of</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2A8232135AFE4CF4915419AD07A58202"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (d)(1)—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="H9A5307B22D2740E69ED3379E76D3314E"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Upon request</quote> and

			 all that follows through <quote>Ethics in Government Act of 1978.</quote> and

			 inserting <quote>In each case in which the Office of Government Ethics makes a

			 determination granting an exemption under subsection (b)(1) or (b)(3) to a

			 person, the Office shall, not later than 3 business days after making such

			 determination, make available to the public pursuant to the procedures set

			 forth in section 105 of the Ethics in Government Act of 1978, and publish in

			 the Federal Register, such determination and the materials submitted by such

			 person in requesting such exemption.</quote>; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB28823EB98724108A5F7A038FF0284B0"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the agency may

			 withhold</quote> and inserting <quote>the Office of Government Ethics may

			 withhold</quote>.</text>

					</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="HC0DA393D438248AF837DE412A2ED34AC" section-type="subsequent-section"><enum>105.</enum><header>Wrongfully

			 influencing a private entity’s employment decisions or practices</header>

				<subsection commented="no" display-inline="no-display-inline" id="idEBB423F1E345487CA5FBF5F259861C33"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Chapter 11 of title

			 18, United States Code, is amended by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="id027633EB48284913A0B6CBCB7E86E78D" style="USC">

						<section commented="no" display-inline="no-display-inline" id="id3BDA974BBAA64E92AA7519F29EBD94DE"><enum>226.</enum><header>Wrongfully

				influencing a private entity's employment decisions by a Member of

				Congress</header><text display-inline="no-display-inline">Whoever, being a

				Senator or Representative in, or a Delegate or Resident Commissioner to, the

				Congress or an employee of either House of Congress, with the intent to

				influence on the basis of partisan political affiliation an employment decision

				or employment practice of any private entity—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="H4DAE8EC85E744C9E89920090B949AD41"><enum>(1)</enum><text display-inline="yes-display-inline">takes or withholds, or offers or threatens

				to take or withhold, an official act; or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H06E6D96103AE4287909CBDE1D04500D"><enum>(2)</enum><text display-inline="yes-display-inline">influences, or offers or threatens to

				influence, the official act of another;</text>

							</paragraph><continuation-text commented="no" continuation-text-level="section">shall be fined under this title or

				imprisoned for not more than 15 years, or both, and may be disqualified from

				holding any office of honor, trust, or profit under the United

				States.</continuation-text></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="idAEFF3B043C444A969D39EEB9DA39F467"><enum>(b)</enum><header>No

			 inference</header><text>Nothing in section 226 of title 18, United States Code,

			 as added by this section, shall be construed to create any inference with

			 respect to whether the activity described in section 226 of title 18, United

			 States Code, was already a criminal or civil offense prior to the enactment of

			 this Act, including sections 201(b), 201(c), and 216 of title 18, United States

			 Code.</text>

				</subsection><subsection id="idD4F3B9D620914DD29C7C60C83206083F"><enum>(c)</enum><header>Chapter

			 analysis</header><text>The chapter analysis for chapter 11 of title 18, United

			 States Code, is amended by adding at the end the following:</text>

			 rules</header><text>Rule XLIII of the Standing Rules of the Senate is amended

			 by adding at the end the following:</text>

						<subsection id="idCBFA10CAED054621A17CA8F029F5553D"><enum>6.</enum><text>No Member shall,

				<subsection commented="no" display-inline="no-display-inline" id="HE4A3D8F3796F43B8AE61E319BD8141BB"><enum>(a)</enum><header>Quarterly filing

			 required</header><text display-inline="yes-display-inline">Section 5 of the

			 Lobbying Disclosure Act of 1995 (2 U.S.C. 1604) is amended—</text>

				to stimulate grassroots lobbying</header><text>The term <term>paid efforts to

				stimulate grassroots lobbying</term>—</text>

								<subparagraph commented="no" id="id951F3A49828F49CBBB449BF662B0FE0F"><enum>(A)</enum><text>means any paid

				attempt to influence the general public, or segments thereof, to engage in

				grassroots lobbying or lobbying contacts; and</text>

								</subparagraph><subparagraph commented="no" id="id8A4345E2555C43CEBA4FBEDCC046626E"><enum>(B)</enum><text>does not include

				any attempt described in subparagraph (A) by a person or entity directed to its

				members, employees, officers or shareholders, unless such attempt is financed

				with funds directly or indirectly received from or arranged by a lobbyist or

				other registrant under this Act retained by another person or entity.</text>

								</subparagraph></paragraph><paragraph commented="no" id="id4B87601A047149C68CCF07AB1DF1562F"><enum>(20)</enum><header>Grassroots

				lobbying firm</header><text>The term <term>grassroots lobbying firm</term>

				means a person or entity that—</text>

								<subparagraph commented="no" id="idBF8F1B9850274C799AC141F30D45D394"><enum>(A)</enum><text>is retained by 1

				or more clients to engage in paid efforts to stimulate grassroots lobbying on

				behalf of such clients; and</text>

								</subparagraph><subparagraph commented="no" id="id59D1BD160D1948C4B8D086F49813FE32"><enum>(B)</enum><text>receives income

				of, or spends or agrees to spend, an aggregate of $50,000 or more for such

				efforts in any quarterly

				period.</text>

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

								<subparagraph commented="no" display-inline="no-display-inline" id="idFB0F93E3CD1E40D389A51348E7F04C5A"><enum>(A)</enum><text>a report under

				this section not later than 20 days after receiving, spending, or agreeing to

				spend that amount; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA209154549C8403A80F0C2D5283044A2"><enum>(B)</enum><text>an additional

				report not later than 20 days after each time such registrant receives income

				of, or spends or agrees to spend, an aggregate amount of $250,000 or more on

				paid efforts to stimulate grassroots lobbying for a client, or for a group of

				clients for a joint

				effort.</text>

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection></section><section commented="no" id="id56A0CFDC08124CF8AF7E3D34D6EC20BF"><enum>205.</enum><header>Disclosure of

			 lobbying activities by certain coalitions and associations</header>

				<subsection commented="no" id="id3D5803AF9265468884D7BE9C6C310500"><enum>(a)</enum><header>In

			 general</header><text>Section 4(b)(3)(B) of the Lobbying Disclosure Act of 1995

			 (2 U.S.C. 1603(b)(3)(B)) is amended to read as follows:</text>

					<quoted-block display-inline="no-display-inline" id="idC6AB1856AC0F498BBB95BD27C5A1351D" style="OLC">

						<subparagraph commented="no" id="id9BAD809B31DD4B948E21CA242AF47534"><enum>(B)</enum><text>participates in

				the planning, supervision or control of such lobbying

				activities;</text>

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id6DD15337599545F1B0032D4EFF39BE3C"><enum>(b)</enum><header>No donor or

			 membership list disclosure</header><text>Section 4(b) of the Lobbying

			 Disclosure Act of 1995 (2 U.S.C. 1603(b)) is amended by adding at the end the

			 following:</text>

					<quoted-block display-inline="no-display-inline" id="idF99A6E0F3A91482CA23EDBC22EA56553" style="OLC">

						<quoted-block-continuation-text quoted-block-continuation-text-level="section">No

				disclosure is required under paragraph (3)(B) if it is publicly available

				knowledge that the organization that would be identified is affiliated with the

				client or has been publicly disclosed to have provided funding to the client,

				unless the organization in whole or in major part plans, supervises or controls

				such lobbying activities. Nothing in paragraph (3)(B) shall be construed to

				require the disclosure of any information about individuals who are members of,

				or donors to, an entity treated as a client by this Act or an organization

				identified under that

				paragraph.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="id8F4CF9A7BE1B44D9B279127B76CF54CF" section-type="subsequent-section"><enum>206.</enum><header>Disclosure by

			 registered lobbyists of past executive and congressional

			 employment</header><text display-inline="no-display-inline">Section 4(b)(6) of

			 the Lobbying Disclosure Act of 1995 (2 U.S.C. 1603(b)(6)) is amended by

			 striking <quote>or a covered legislative branch official</quote> and all that

			 follows through <quote>as a lobbyist on behalf of the client,</quote> and

			 inserting <quote>or a covered legislative branch official,</quote>.</text>

			</section><section commented="no" display-inline="no-display-inline" id="id272C618C6EAB4C93ABBB8EEB6205D06F" section-type="subsequent-section"><enum>207.</enum><header>Creation of a

			 comprehensive public database of lobbying disclosure information</header>

				<subsection commented="no" display-inline="no-display-inline" id="H8AF1883630E844F6A19029D0392D5315"><enum>(a)</enum><header>Database

			 required</header><text display-inline="yes-display-inline">Section 6 of the

			 Lobbying Disclosure Act of 1995 (2 U.S.C. 1605) is amended—</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0B7A96E4B8B6460690A93CB07C515B3E"><enum>(b)</enum><header>Availability of

			 reports</header><text display-inline="yes-display-inline">Section 6(4) of the

			 Lobbying Disclosure Act of 1995 is amended by inserting before the semicolon at

			 the end the following: <quote>and, in the case of a report filed in electronic

			 form pursuant to section 5(d), shall make such report available for public

			 inspection over the Internet not more than 48 hours after the report is so

			 filed</quote>.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="HD35E8F4B16024CF0ABA3F5A7333B70A4"><enum>(c)</enum><header>Authorization of

			 appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated such sums as may be necessary to carry out

			 section 6(9) of the Lobbying Disclosure Act of 1995, as added by subsection

			 (a).</text>

				</subsection></section><section id="idAD3B3CE2FECD4BF4B46F2B56D7F1721C"><enum>208.</enum><header>Conforming

			 amendment</header><text display-inline="no-display-inline">The requirements of

			 this Act shall not apply to the activities of any political committee described

			 in section 301(4) of the Federal Election Campaign Act of 1971.</text>

			</section></title><title id="id6E48CA1A01DF451EBF28C8B87C4301C0"><enum>III</enum><header>Restricting

			 congressional travel and gifts</header>

			<section id="id574848F37C5A403B99164A24302FCCD5"><enum>301.</enum><header>Ban on gifts

			 from lobbyists</header>

				<subsection id="id9B0FF5493103430485EA60317D1FA943"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Paragraph 1(a)(2) of

			 rule XXXV of the Standing Rules of the Senate is amended by adding at the end

			 the following: <quote>This clause shall not apply to a gift from a

			 lobbyist.</quote>.</text>

				</subsection><subsection id="idB3050D7D94AE447CB79C30A78990BEE9"><enum>(b)</enum><header>Rules Committee

			 review</header><text display-inline="yes-display-inline">The Committee on Rules

			 and Administration shall review the present exceptions to the Senate gift rule

			 and make recommendations to the Senate not later than 3 months after the date

			 of enactment of this Act on eliminating all but those which are absolutely

			 necessary to effectuate the purpose of the rule.</text>

				</subsection></section><section id="idE0B0CF80D9064F589A3DCF805F49EB5F"><enum>302.</enum><header>Prohibition on

			 privately funded travel</header><text display-inline="no-display-inline">Paragraph 2(a)(1) of rule XXXV of the

			 Standing Rules of the Senate is amended by striking <quote>an

			 individual</quote> and inserting <quote>an organization recognized under

			 section 501(c)(3) of the Internal Revenue Code of 1986 that is not affiliated

			 with any group that lobbies before Congress</quote>.</text>

			</section><section commented="no" display-inline="no-display-inline" id="H99993901691C4F68A3CCF1FC81BE645C" section-type="subsequent-section"><enum>303.</enum><header>Prohibiting lobbyist

			 organization and participation in congressional travel</header>

				<subsection commented="no" display-inline="no-display-inline" id="id10B64E97D64A41348BA686919BAF4964"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Paragraph 2 of rule

			 XXXV of the Standing Rules of the Senate is amended by adding at the end the

			 following:</text>

					<quoted-block display-inline="no-display-inline" id="idE39951742FC54EF7A11E2AFA37F8494F" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="idD6140351186D4607A434EE17B1F9D372"><enum>(g)</enum><text display-inline="yes-display-inline">A Member, officer, or employee may not

				accept transportation or lodging on any trip sponsored by an organization

				recognized under section 501(c)(3) of the Internal Revenue Code of 1986 covered

				by this paragraph that is planned, organized, requested, arranged, or financed

				in whole, or in part by a lobbyist or foreign agent, or in which a lobbyist

				participates.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="idC6BB1C3BD96D421984C7DB697DF17BBA"><enum>(h)</enum><text display-inline="yes-display-inline">Before a Member, officer, or employee may

				accept transportation or lodging otherwise permissible under this paragraph

				from any person, such Member, officer, or employee shall obtain a written

				certification from such person (and provide a copy of such certification to the

				Select Committee on Ethics) that—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="idDEC4C627D6F04CE49E36B51C0AFC4060"><enum>(1)</enum><text display-inline="yes-display-inline">the trip was not planned, organized,

				requested, arranged, or financed in whole, or in part by a registered lobbyist

				or foreign agent and was not organized at the request of a registered lobbyist

				or foreign agent;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAADDA36A58BF49989B41371B555E0FFF"><enum>(2)</enum><text display-inline="yes-display-inline">registered lobbyists will not participate

				in or attend the trip; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2DC43F352DBB448BBAA871B63C1DCCAB"><enum>(3)</enum><text display-inline="yes-display-inline">the person did not accept, from any source,

				funds specifically earmarked for the purpose of financing the travel

				expenses.</text>

							</paragraph><continuation-text commented="no" continuation-text-level="subsection">The Select Committee on Ethics shall

				make public information received under this subparagraph as soon as possible

				after it is

				received.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="id72FE35E3DBBA4C8086821EE4CDDD4EA6"><enum>(b)</enum><header>Conforming

			 amendments</header><text>Paragraph 2(c) of rule XXXV of the Standing Rules of

			 the Senate is amended—</text>

					<paragraph id="id56A45B6286C84966BB6B9A89699ED828"><enum>(1)</enum><text>by striking

			 <quote>of expenses reimbursed or to be reimbursed</quote>;</text>

					</paragraph><paragraph id="idD8B14E99A3724DA4BC84687798267897"><enum>(2)</enum><text>in clause (5), by

			 striking <quote>and</quote> after the semicolon;</text>

				information is deemed by the Member or supervisor under whose direct

				supervision the employee works to jeopardize the safety of an individual or

				otherwise interfere with the official duties of the Member, officer, or

				employee.</text>

							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection id="idC14D6D36FBFA407081DFD350D7B87EDD"><enum>(c)</enum><header>Public

			 availability</header><text>Paragraph 2(e) of rule XXXV is amended to read as

			 follows:</text>

					<quoted-block display-inline="no-display-inline" id="idBDEF9E72A1D444DEB5BF61B35254E49F" style="OLC">

						<subsection id="ID99b94dfe3fff495db7ffcf893ab5a71f"><enum>(e)</enum><text>The Secretary of

				the Senate shall make available to the public all advance authorizations,

				certifications, and disclosures filed pursuant to subparagraphs (a) and (h) as

				soon as possible after they are

				received.</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="HA991CB2C8E8E4D43AC853C2543524032"><enum>304.</enum><header>Disclosure of

			 noncommercial air travel</header><text display-inline="no-display-inline">A

			 Member, officer, or employee of the Senate shall—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id705FE1708D154F0B8A26698C6C6D3375"><enum>(1)</enum><text display-inline="yes-display-inline">disclose a flight on an aircraft that is

			 not licensed by the Federal Aviation Administration to operate for compensation

			 or hire, taken in connection with the duties of the Member, officer, or

			 employee as an officeholder or Senate officer or employee; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id070E54C23D11475CA1C158D08645EE24"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to the flight, file a report

			 with the Secretary of the Senate, including the date, destination, and owner or

			 lessee of the aircraft and the purpose of the trip.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idB25586F389274979A47E02A4189B202B"><enum>305.</enum><header>Per diem

			 expenses for congressional travel</header>

				<subsection commented="no" display-inline="no-display-inline" id="id020573EB0EC044FE965A0C60E0E65A12"><enum>(a)</enum><header>Senate</header><text display-inline="yes-display-inline">Rule XXXV of the Standing Rules of the

			 Senate is amended by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="idB382DCC1C8EB4AFB8AA9E6CE2F44DBF4" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="idC92ABA386BE34385A85BF52B87F04468"><enum>7.</enum><text display-inline="yes-display-inline">Not later than 90 days after the date of

				adoption of this paragraph and at annual intervals thereafter, the Committee on

				Rules and Administration shall develop and revise, as necessary, guidelines on

				what constitutes <quote>reasonable expenses</quote> or <quote>reasonable

				expenditures</quote> for purposes of this rule. In developing and revising the

				guidelines, the committee shall take into account the maximum per diem rates

				for official Government travel published annually by the General Services

				Administration, the Department of State, and the Department of

				Defense.</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection></section></title><title id="idAD53FEBCAE43481CB4C1E81F48CFD723"><enum>IV</enum><header>ENFORCEMENT OF

			 LOBBYING RESTRICTIONS</header>

			<section commented="no" display-inline="no-display-inline" id="idD77DEB9C855E4E788B8534C81FE3B10C"><enum>401.</enum><header>Senate Office

			 of Public Integrity</header>

				<subsection commented="no" display-inline="no-display-inline" id="id279C120D91004913B3416D2BFC17EFDA"><enum>(a)</enum><header>Establishment</header><text>There

			 is established in the Senate an office to be known as the <quote>Senate Office

			 of Public Integrity</quote> (referred to in this section as the

			 <quote>Office</quote>), which shall be headed by a Senate Director of Public

			 Integrity (hereinafter referred to as the <quote>Director</quote>).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id46EA75FC4EA04E67AF8B2518FC382A56"><enum>(b)</enum><header>Office</header><text>The

			 Office shall receive lobbyists' disclosures on behalf of the Senate under the

			 Lobbying Disclosure Act of 1995 and conduct such audits and investigations as

			 are necessary to ensure compliance with the Act.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idBE8C79A3D71D40179302B57501F3280D"><enum>(c)</enum><header>Referral

			 authority</header><text>The Office shall have authority to refer violations of

			 the Lobbying Disclosure Act of 1995 to the Select Committee on Ethics and the

			 Department of Justice for disciplinary action.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id778F388E476742B88ECB18B515D54D38"><enum>(d)</enum><header>Director</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id61FDA32528E84A7295A30F2CD5E7A74D"><enum>(1)</enum><header>In

			 general</header><text>The Director shall be appointed by the President pro

			 tempore of the Senate from among recommendations submitted by the majority and

			 minority leaders of the Senate. Any appointment made under this subsection

			 shall be made without regard to political affiliation and solely on the basis

			 of fitness to perform the duties of the position. Any person appointed as

			 Director shall be learned in the law, a member of the bar of a State or the

			 District of Columbia, and shall not engage in any other business, vocation, or

			 employment during the term of such appointment.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16BA97F755BB4757928EF438AE7809F6"><enum>(2)</enum><header>Oversight</header><text>The

			 Director shall report to a joint leadership group consisting of the President

			 pro tempore, the Majority Leader, and the Minority Leader.</text>

					</paragraph><paragraph id="ID9e53fd1ce12449c68828baa93abe6e62"><enum>(3)</enum><header>Terms of

			 service</header><text>Any appointment made under paragraph (1) shall become

			 effective upon approval by resolution of the Senate. The Director shall be

			 appointed for a term of service which shall expire at the end of the Congress

			 following the Congress during which the Director is appointed except that the

			 Senate may, by resolution, remove Director prior to the termination of any term

			 of service. The Director may be reappointed at the termination of any term of

			 service.</text>

					</paragraph><paragraph id="idB5B5BD456187460782CB85827D424A81"><enum>(4)</enum><header>Compensation</header><text>The

			 Director shall receive compensation at a rate equal to the annual rate of basic

			 pay for level III of the Executive Schedule under section 5314 of title 5,

			 United States Code .</text>

					</paragraph><paragraph id="id38F511570E604A6B9CD218BDC94745C8"><enum>(5)</enum><header>Staff</header><text>The

			 Director shall hire such additional staff as are required to carry out this

			 section, including investigators and accountants.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8F7525BAEC294831AD00CA9E3B91B911"><enum>(e)</enum><header>Audits and

			 investigations</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id4F39337835434E6E9560CA0F4421A471"><enum>(1)</enum><header>In

			 general</header><text>The Office shall audit lobbying registrations and reports

			 filed pursuant to the Lobbying Disclosure Act of 1995 to determine the extent

			 of compliance or non-compliance with the requirements of such Act by lobbyists

			 and their clients.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF1A5045B275F4EEBB1132586A9BE016E"><enum>(2)</enum><header>Evidence of

			 non-compliance</header><text>If in the course an audit conducted pursuant to

			 the requirements of paragraph (1), the Office obtains information indicating

			 that a person or entity may be in non-compliance with the requirements of the

			 Lobbying Disclosure Act of 1995, the Office shall refer the matter to the

			 Select Committee on Ethics or the United States Attorney for the District of

			 Columbia, as appropriate</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id62FFD23484894EF28E4CCD2EC446373A"><enum>(f)</enum><header>Transfer of

			 records</header><text>On the date that is 90 days after the date of enactment

			 of this Act, the Office of Public Records of the Senate shall transfer all

			 authority and records of that office to the Senate Office of Public

			 Integrity.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id9F4D96871A17426183013471BBC2FAB6"><enum>(g)</enum><header>Conforming

			 amendments</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id8DED6CDA8F0D422B9C11E8B8AA74E285"><enum>(1)</enum><header>New

			 office</header><text>Section 6 of the Lobbying Disclosure Act of 1995 (2 U.S.C.

			 1605) is amended by striking <quote>Secretary of the Senate</quote> and

			 inserting <quote>Senate Office of Public Integrity</quote>.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9DDBB676FC73432ABCEE93613150938B"><enum>(2)</enum><header>Audit

			 authority</header><text>Section 8 of the Lobbying Disclosure Act of 1995 (2

			 criminal penalties for failure to comply with lobbying disclosure

				knowingly, wilfully, and corruptly fails to comply with any provision of this

				section shall be imprisoned for not more than 10 years, or fined under title

				18, United States Code, or

				both.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section id="id77B9F90D6B8F4E1F8BD656D66F3A0E26"><enum>403.</enum><header>Penalty for

			 false certification in connection with congressional travel</header>

				<subsection commented="no" display-inline="no-display-inline" id="HAEA3EAB795DB49CD87C660A6C8D1BEA"><enum>(a)</enum><header>Civil

			 fine</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idE63B425CCEAC46EF8DC87339F0DCDA1C"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Whoever makes a false

			 certification in connection with the travel of a Member, officer, or employee

			 of either House of Congress (within the meaning given those terms in section

			 207 of title 18, United States Code), under paragraph 2(h) of rule XXXV of the

			 Standing Rules of the Senate, shall, upon proof of such offense by a

			 preponderance of the evidence, be subject to a civil fine depending on the

			 extent and gravity of the violation.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H298B9F2342414FBAB2C040683FB4C1E0"><enum>(2)</enum><header>Maximum

			 fine</header><text display-inline="yes-display-inline">The maximum fine per

			 offense under this section depends on the number of separate trips in

			 connection with which the person committed an offense under this subsection, as

			 follows:</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="H50931A91F0C84456A1C6C624F4243B83"><enum>(A)</enum><header>First

			 trip</header><text display-inline="yes-display-inline">For each offense

			 committed in connection with the first such trip, the amount of the fine shall

			 be not more than $100,000 per offense.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC4092769FAD1437E87029923CF09D8E"><enum>(B)</enum><header>Second

			 trip</header><text display-inline="yes-display-inline">For each offense

			 committed in connection with the second such trip, the amount of the fine shall

			 be not more than $300,000 per offense.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8D5293AB73E64D58B77664004EA291E4"><enum>(C)</enum><header>Any other

			 trips</header><text display-inline="yes-display-inline">For each offense

			 committed in connection with any such trip after the second, the amount of the

			 fine shall be not more than $500,000 per offense.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD7332671D4E34AC399419AB360EE4C05"><enum>(3)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The Attorney General may bring an action in

			 United States district court to enforce this subsection.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id27997AA42C3A47C186C0C5F28D685C6C"><enum>(b)</enum><header>Criminal

			 penalty</header>

					<paragraph id="IDd5381b5541dd43ca8d68769c0643fd1d"><enum>(1)</enum><header>In

			 general</header><text>Whoever knowingly and wilfully fails to comply with any

			 provision of this section shall be imprisoned for not more than 5 years, or

			 fined under title 18, United States Code, or both.</text>

					</paragraph><paragraph id="ID31db2d181586447bba0be3608194c27e"><enum>(2)</enum><header>Corruptly</header><text>Whoever

			 knowingly, wilfully, and corruptly fails to comply with any provision of this

			 section shall be imprisoned for not more than 10 years, or fined under title

			 18, United States Code, or both.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id1371E0D445DB4D5FAC0E356CC9445945"><enum>404.</enum><header>Mandatory

			 annual ethics training for congressional employees</header>

				<subsection commented="no" display-inline="no-display-inline" id="idBC6E685F74BA4982B15F9B57154A8124"><enum>(a)</enum><header>Ethics

			 training</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idBC881029D87E4204A8BFC0688FC1A9BC"><enum>(1)</enum><header>In

			 general</header><text>The Committee on Ethics shall provide annual ethics

			 training to each employee of the Senate which shall include knowledge of the

			 Official Code of Conduct and related Senate rules.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7771B3CEB8784D6CBB8E60D599BC4935"><enum>(2)</enum><header>Secretary of

			 the Senate</header><text>The Secretary of the Senate shall assist the Committee

			 on Ethics in providing training required by this subsection.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2908222D4A2E4FD1B9501EC8481F96A9"><enum>(3)</enum><header>New

			 employees</header><text>A new employee of the Senate shall receive training

			 under this section not later than 60 days after beginning service to the

			 Senate.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3696771E45FC4E5BB086278A73FC9C5B"><enum>(b)</enum><header>Certification</header><text>Not

			 later than January 31 of each year, each employee of the Senate shall file a

			 certification with the Committee on Ethics that the employee attended ethics

			 training in the last year as established by this section.</text>

				</subsection></section></title><title id="id35F927E2BF714496973DF05EE16F4AFE"><enum>V</enum><header>OPEN

			 GOVERNMENT</header>

			<section id="id36FA0C8E91E140D8BE597341EA6073CB"><enum>501.</enum><header>Sense of the

			 Senate on conference committee protocols</header><text display-inline="no-display-inline">It is the sense of Senate that—</text>

				<paragraph id="ID6c2eb4575be2468e92fe821a8ce74bc8"><enum>(1)</enum><text>conference

			 committees should hold regular, formal meetings of all conferees that are open

			 to the public;</text>

				</paragraph><paragraph id="ID15abed5fe8844475bf4d1dd700b7c8c2"><enum>(2)</enum><text>all conferees

			 should be given adequate notice of the time and place of all such

			 meetings;</text>

				</paragraph><paragraph id="IDe79bc0aca8604ec39780bdf0ee43e5d7"><enum>(3)</enum><text>all conferees

			 should be afforded an opportunity to participate in full and complete debates

			 of the matters that such conference committees may recommend to their

			 respective Houses;</text>

				</paragraph><paragraph id="id5D1628C948A847C6AB2A625C8B8BD88B"><enum>(4)</enum><text>all matters

			 before a conference committee should be resolved in conference by votes on the

			 public record; and</text>

				</paragraph><paragraph id="idFB68E2055FCF462B94479CF546FBF08C"><enum>(5)</enum><text>existing rules

			 should be enforced and new rules adopted in the Senate to shine the light on

			 special interest legislation that is enacted in the dead of night.</text>

				</paragraph></section><section id="id3FB15500273348939754D184BEBE7BDB"><enum>502.</enum><header>Actual voting

			 required in conference committee meetings</header><text display-inline="no-display-inline">Rule XXVIII of the Standing Rules of the

			 Senate is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id67889322A5174AB296D180ADDF3F878D" style="OLC">

					<subsection id="idD6CCACB8812D48179F9455E5301D2B58"><enum></enum><text>8. Each

				Senate member of a conference committee shall be afforded an opportunity at an

				open meeting of the conference to vote on the full text of the proposed report

				of the

				conference.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</section><section id="idBFEFCE7E87014B9D8F0C19A70A547A48"><enum>503.</enum><header>Availability

			 of conference reports on the internet</header><text display-inline="no-display-inline">Rule XXVIII of all the Standing Rules of the

			 Senate is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="idE4922D83D0DC428BB33D53795B4DDA44" style="OLC">

					<subsection id="id3788D6BBDC0F4419AD8495267652DA9C"><enum></enum><text>9. It shall

				not be in order in the Senate to consider a conference report unless such

				report is available to all Members and made available to the general public by

				means of the Internet for at least 24 hours before its

				consideration.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
