		<section id="ID6E7BC0F956AB4FF58E98B5FEC1B3F74F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Phone Records Protection Act of

			 2006</short-title></quote>.</text>

		</section><section id="IDB7C87DF2B0B64E3E002DF44D12F18C00"><enum>2.</enum><header>Prohibition on

			 sale or transfer of telephone records</header>

			<subsection id="IDBC15B295DEB24C0E9397FE00AAA275C5"><enum>(a)</enum><header>In

			 general</header><text>Title 18, United States Code, is amended by inserting

			 after chapter 123 the following new chapter:</text>

				records</header>

							<toc-entry level="section">2801. Prohibition on sale or transfer of

				  telephone records.</toc-entry>

						</toc>

						<section id="ID6D04BE09FC034EE49DCF96001F40C3C3"><enum>2801.</enum><header>Prohibition

				on sale or transfer of telephone records</header>

							<subsection id="id1BEEEF7F1D5840A89221C000CBAA79A7"><enum>(a)</enum><header>Criminal

				violation</header><text display-inline="yes-display-inline">Whoever knowingly

				and intentionally sells or fraudulently transfers or uses, or attempts to sell

				or fraudulently transfer or use, the records of a customer of a telephone

				service provider shall be fined in accordance with this title, imprisoned for

				not more than 10 years, or both.</text>

							</subsection><subsection id="id9F298A07C8E041F09478326D027BED4B"><enum>(b)</enum><header>Nonapplicability

				to law enforcement agencies</header><text>Subsection (a) shall not prevent any

				action by a law enforcement agency, or any officer, employee, or agent of such

				agency, to obtain the records of a customer of a telephone service provider in

				connection with the performance of the official duties of the agency.</text>

							</subsection><subsection id="id468C86D3272C47D4A9319A41C4CFF52C"><enum>(c)</enum><header>Exception for

				law enforcement requests</header><text>A telephone service provider, or any

				employee thereof, shall not be in violation of subsection (a) if such provider,

				upon request, transfers or otherwise provides to a law enforcement agency, or

				any officer, employee, or agent of such agency the records of a customer of

				such provider.</text>

							</subsection><subsection id="id3A2DA0AF44A74219BAC519961B553661"><enum>(d)</enum><header>Definitions</header><text>In

				this section:</text>

								<paragraph id="IDf8d60a017cc642dbb24e00b64ea4dc0c"><enum>(1)</enum><header>Records of a

				customer</header><text>The term <quote>records of a customer</quote> means any

				data or information associated with an individual contained in a database,

				networked or integrated databases, or other data system of a telephone service

				provider.</text>

								</paragraph><paragraph id="idC530D17E360A4D36BC5EFD460B3105ED"><enum>(2)</enum><header>Telephone

				service</header><text>The term <quote>telephone service</quote>—</text>

									<subparagraph id="idF5FAC11A71FF41C19CF410E7030CCE00"><enum>(A)</enum><text>has the same

				meaning given the term <quote>telecommunications service</quote> in section 3

				of the Communications Act of 1934 (47 U.S.C. 153); and</text>

									</subparagraph><subparagraph id="id0D09FE0174A64F9E88A3E1854D88E75B"><enum>(B)</enum><text>includes any form

				of wireless telephone service, including—</text>

										<clause id="idF946B9984EF345DD9D81BD6CD26F1ADB"><enum>(i)</enum><text>cellular

				telephone service;</text>

										</clause><clause id="id64283B3A9805451CAB61EA3807ACD53B"><enum>(ii)</enum><text>broadband

				Personal Communication Service (<quote>PCS</quote>) telephone service;</text>

										</clause><clause id="idE35BD8BFF72B4FAFA098F030340697CA"><enum>(iii)</enum><text>Covered

				Specialized Mobile Radio (<quote>SMR</quote>) service; and</text>

										</clause><clause id="id6AF9955CF9FD44228E6CA5FCD9BF511A"><enum>(iv)</enum><text>any successor

				service to such service (including so-called next generation or third

				generation service).</text>

										</clause></subparagraph></paragraph><paragraph id="IDf80a580dc9ff4056b3c95671e9b4c69c"><enum>(3)</enum><header>Telephone

				service provider</header><text>The term <quote>telephone service

				provider</quote> has the same meaning given the term <quote>telecommunications

				carrier</quote> in section 3 of the Communications Act of 1934 (47 U.S.C.

				153).</text>

								</paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="IDB1C1827B4505450F8EBC639700573FF6"><enum>(b)</enum><header>Amendment to

			 part analysis</header><text>The table of chapters at the beginning of part I of

			 title 18, United States Code, is amended by inserting after the item relating

			 to chapter 123 the following new item:</text>
