		<official-title display="yes">To direct the Election Assistance

		  Commission to make grants to States to restore and replace election

		  administration supplies, materials, records, equipment, and technology which

		  were damaged, destroyed, or dislocated as a result of Hurricane Katrina or

		  Hurricane Rita.</official-title>

		<section id="id691F33178B1E4BD48E19B4059CD576A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Hurricane Election Relief Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="H71F4B6FAC1C5427184C9584B9192FFC3" section-type="subsequent-section"><enum>2.</enum><header>Grants to states for

			 restoring and replacing election administration supplies, materials, records,

			 equipment, and technology which were damaged, destroyed, or dislocated by

			 Hurricanes Katrina or Rita</header>

			<subsection commented="no" display-inline="no-display-inline" id="H7ABB39C5B6524C4E8382E5BCD52B6F6C"><enum>(a)</enum><header>Authority to

			 Make Grants</header><text display-inline="yes-display-inline">The Election

			 Assistance Commission shall make a grant to each eligible State, in such amount

			 as the Commission considers appropriate, for purposes of restoring and

			 replacing supplies, materials, records, equipment, and technology used in the

			 administration of Federal elections in the State which were damaged, destroyed,

			 or dislocated as a result of Hurricane Katrina or Hurricane Rita and ensuring

			 the full participation in such elections by individuals who were displaced as a

			 result of Hurricane Katrina or Hurricane Rita.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id16B73D4CC02B4105945265951C9DDA50"><enum>(b)</enum><header>Use of grant

			 funds</header><text>Funds received under a grant under subsection (a) shall be

			 used in a manner that is consistent with the requirements of title III of the

			 Help America Vote Act of 2002.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H7F9C5C8F953343F5BD5BF768A6F7A5DC"><enum>(c)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A State is eligible to receive a grant

			 under this section if it submits to the Commission (at such time and in such

			 form as the Commission may require) a certification that—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id0638EA37C6B94806BC35C646EABE1A53"><enum>(1)</enum><text display-inline="yes-display-inline">supplies, materials, records, equipment,

			 and technology used in the administration of Federal elections in the State

			 were damaged, destroyed, or dislocated as a result of Hurricane Katrina or

			 Hurricane Rita; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA48A473E519D4F45B0D9F15BCC0D6CDE"><enum>(2)</enum><text display-inline="yes-display-inline">the system of such State for conducting

			 Federal elections has been significantly impacted by the displacement of

			 individuals as a result of Hurricane Katrina or Hurricane Rita.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H3CDC15966187448E915C254BE22621B7" section-type="subsequent-section"><enum>3.</enum><header>Authorization of

			 Appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated for fiscal year 2006 for grants under this Act

			 $50,000,000, to remain available until expended.</text>
