		  requiring producers of sexually explicit material to keep and permit inspection

		  of records regarding the age of performers, and for other

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Protecting Children from Sexual

			 Exploitation Act of 2005</short-title></quote>.</text>

		</section><section id="idD849FDBECBF941A6B45A7DB5D7740045"><enum>2.</enum><header>Record keeping

			 of digital images</header><text display-inline="no-display-inline">Section 2257

			 of title 18, United States Code, is amended—</text>

			<paragraph id="IDc3cc80fb65874d6594c8e25ab7d20c5f"><enum>(1)</enum><text>in subsection

			 (a), by inserting after <quote>videotape,</quote> the following: <quote>digital

			 image, digitally- or computer-manipulated image of an actual human being,

			 picture,</quote>; and</text>

			</paragraph><paragraph id="IDb9a18b6defb64abbb356d8bb0b5eca54"><enum>(2)</enum><text>in subsection

			 (f)(4), by inserting after <quote>video</quote> the following: <quote>digital

			 image, digitally- or computer-manipulated image of an actual human being,

			 picture,</quote>.</text>

			</paragraph></section><section id="id9EFBD6EDAF5348438222AAC123AEFC5A"><enum>3.</enum><header>Other record

			 keeping requirements</header><text display-inline="no-display-inline">Section

			 2257 of title 18, United States Code, is amended—</text>

			<paragraph id="ID1569eb4d67e046059e649a4c17daa381"><enum>(1)</enum><text>in subsection

			 (f), by—</text>

				<subparagraph id="idD65B3B2CD7204154BC4EB982C239111D"><enum>(A)</enum><text>in paragraph (3),

			 by striking <quote>and</quote> after the semicolon;</text>

				</subparagraph><subparagraph id="idDE0744881CE946E8A58154DD384F22F7"><enum>(B)</enum><text>in paragraph (4),

			 by striking the period and inserting <quote>; and</quote>; and</text>

				</subparagraph><subparagraph id="id1ADA30FE4EFA4687BFBA9DE2698191B1"><enum>(C)</enum><text>by adding at the

			 end the following:</text>

					<quoted-block display-inline="no-display-inline" id="idADC16ACA2F534F08852ECA6401C2FF2D" style="OLC">

						<paragraph id="id37140CF3FF324491B4AF8281887431B9"><enum>(5)</enum><text>for any person to

				whom subsection (a) applies to refuse to permit the Attorney General or his or

				her designee to conduct an inspection under subsection

				(c).</text>

						</paragraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</subparagraph></paragraph><paragraph id="ID0d71e095e2454419859935fb31fbe0df"><enum>(2)</enum><text>by striking

			 subsection (h) and inserting the following:</text>

				<quoted-block display-inline="no-display-inline" id="id55C1C310CBB14A4B8D85AF41959A472B" style="OLC">

					<subsection id="id779B3B9A0FE94613B19A137D9B7D2EAF"><enum>(h)</enum><text>In this

				section—</text>

						<paragraph id="ID79f1527aeb4e4134adaaaef3a57c0321"><enum>(1)</enum><text>the term

				<term>actual sexually explicit conduct</term> means actual but not simulated

				conduct as defined in clauses (i) through (v) of section 2256(2)(A) of this

				title;</text>

						</paragraph><paragraph id="IDdc6f2fba872d45ecb46b3d6b93d83339"><enum>(2)</enum><text>the term

				<term>produces</term>—</text>

							<subparagraph id="IDc1f13f6ad42f4dc082cc2082b07a93f9"><enum>(A)</enum><text>means—</text>

								<clause id="id2077DD00A59B4FEDB1253AB5A9CBDFE7"><enum>(i)</enum><text>actually filming,

				videotaping, photographing, creating a picture, digital image, or digitally- or

				computer-manipulated image of an actual human being;</text>

								</clause><clause id="id41B0901AC083494E844FAFAC7BFB72B2"><enum>(ii)</enum><text>digitizing an

				image, of a visual depiction of sexually explicit conduct; or, assembling,

				manufacturing, publishing, duplicating, reproducing, or reissuing a book,

				magazine, periodical, film, videotape, digital image, or picture, or other

				matter intended for commercial distribution, that contains a visual depiction

				of sexually explicit conduct; or</text>

								</clause><clause id="id1251A4B1837A4E3C8D563D6DCB976B4B"><enum>(iii)</enum><text>inserting on a

				computer site or service a digital image of, or otherwise managing the sexually

				explicit content, of a computer site or service that contains a visual

				depiction of, sexually explicit conduct; and</text>

								</clause></subparagraph><subparagraph id="ID54fc90e727b34d0380855e0ba7fc2b60"><enum>(B)</enum><text>does not include

				activities that are limited to—</text>

								<clause id="ID243a9ccd8c2e4023a4050e675e880cc2"><enum>(i)</enum><text>photo or film

				processing, including digitization of previously existing visual depictions, as

				part of a commercial enterprise, with no other commercial interest in the

				sexually explicit material, printing, and video duplication;</text>

								</clause><clause id="ID924b4660654242408ef67a56eda32454"><enum>(ii)</enum><text>distribution;</text>

								</clause><clause id="IDb70921c03a6540579b752e454bfc17b3"><enum>(iii)</enum><text>any activity,

				other than those activities identified in subparagraph (A), that does not

				involve the hiring, contracting for, managing, or otherwise arranging for the

				participation of the depicted performers;</text>

								</clause><clause id="ID3ad2c655aa0640e2844cef6d18ac6ab4"><enum>(iv)</enum><text>the provision of

				web-hosting services when the provider does not, and reasonably cannot, manage

				the sexually explicit content of the computer site or service; or</text>

								</clause><clause id="IDab9f642c86bd43758b41ebf0878c254b"><enum>(v)</enum><text>the provision of

				an electronic communication service or remote computing service when the

				provider does not, and reasonably cannot, manage the sexually explicit content

				of the computer site or service; and</text>

								</clause></subparagraph></paragraph><paragraph id="ID829d2cd02faa46a8817c9ed4e51551b7"><enum>(3)</enum><text>the term

				<term>performer</term> includes any person portrayed in a visual depiction

				engaging in, or assisting another person to engage in, actual sexually explicit

				conduct.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="id92BA4CF5C863489394ABCE4AA702E6AB"><enum>4.</enum><header>Record keeping

			 requirements for simulated sexual conduct</header>

			<subsection id="IDa3826304f03443e9b807a814a3ffe0ea"><enum>(a)</enum><header>In

			 general</header><text>Chapter 110 of title 18, United States Code, is amended

			 by inserting after section 2257 the following:</text>

				<quoted-block display-inline="no-display-inline" id="id5CF0196F83624364982AB572177B5743" style="USC">

					<section id="idE2567C0734CA4CC7BC4649B6D1139B6A"><enum>2257A.</enum><header>Record

				keeping requirements for simulated sexual conduct</header>

						<subsection id="id3740A7FBDA534AE19E854817F70DB9B9"><enum>(a)</enum><text display-inline="yes-display-inline">Whoever produces any book, magazine,

				periodical, film, videotape, or other matter that—</text>

							<paragraph id="IDa34d7802403f4214a1ac2192a39455f4"><enum>(1)</enum><text>contains one or

				more visual depictions of simulated sexually explicit conduct; and</text>

							</paragraph><paragraph id="ID7e16aa38d5744981a030606937d18053"><enum>(2)</enum><text>is produced in

				whole or in part with materials which have been mailed or shipped in interstate

				or foreign commerce, or is shipped or transported or is intended for shipment

				or transportation in interstate or foreign commerce;</text>

							</paragraph><continuation-text continuation-text-level="subsection">shall

				create and maintain individually identifiable records pertaining to every

				performer portrayed in such a visual depiction.</continuation-text></subsection><subsection id="IDa070e1d5233741ca83cfb87c8f7cc9bb"><enum>(b)</enum><text>Any person to

				whom subsection (a) applies shall, with respect to every performer portrayed in

				a visual depiction of simulated sexually explicit conduct—</text>

							<paragraph id="IDe1cee3f567f5449d83eea706114c5895"><enum>(1)</enum><text>ascertain, by

				examination of an identification document containing such information, the

				performer's name and date of birth, and require the performer to provide such

				other indicia of his or her identity as may be prescribed by

				regulations;</text>

							</paragraph><paragraph id="IDc9894ff94c7842f2b9ba6fa2b022b39a"><enum>(2)</enum><text>ascertain any

				name, other than the performer's present and correct name, ever used by the

				performer including maiden name, alias, nickname, stage, or professional name;

				and</text>

							</paragraph><paragraph id="ID30412282fee9437a8ed7cd08a97b5cfe"><enum>(3)</enum><text>record in the

				records required by subsection (a) the information required by paragraphs (1)

				and (2) and such other identifying information as may be prescribed by

				regulation.</text>

							</paragraph></subsection><subsection id="IDe6311e86a1804e5d81fa2921c3e8bb9d"><enum>(c)</enum><text>Any person to

				whom subsection (a) applies shall maintain the records required by this section

				at their business premises, or at such other place as the Attorney General may

				by regulation prescribe and shall make such records available to the Attorney

				General for inspection at all reasonable times.</text>

						</subsection><subsection id="ID81547b18ee98459b81eae9347f9013c8"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id82EC78602373494BB9A9601038F6FB11"><enum>(1)</enum><text>No information or

				evidence obtained from records required to be created or maintained by this

				section shall, except as provided in this section, directly or indirectly, be

				used as evidence against any person with respect to any violation of

				law.</text>

							</paragraph><paragraph id="id133D0B5EF7164E09BE38B277039B1960" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not preclude the

				use of such information or evidence in a prosecution or other action for a

				violation of this chapter or chapter 71, or for a violation of any applicable

				provision of law with respect to the furnishing of false information.</text>

							</paragraph></subsection><subsection id="ID203b7a2041e945fbab8782459f5ce3af"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id17621E382D9A4E57A40D3422EF3F7551"><enum>(1)</enum><text display-inline="yes-display-inline">Any person to whom subsection (a) applies

				shall cause to be affixed to every copy of any matter described in subsection

				(a)(1) in such manner and in such form as the Attorney General shall by

				regulations prescribe, a statement describing where the records required by

				this section with respect to all performers depicted in that copy of the matter

				may be located.</text>

							</paragraph><paragraph id="id3B5858350C8248DF8E033B03849659AD" indent="up1"><enum>(2)</enum><text>If the person to whom subsection (a)

				applies is an organization the statement required by this subsection shall

				include the name, title, and business address of the individual employed by

				such organization responsible for maintaining the records required by this

				section.</text>

							</paragraph></subsection><subsection id="IDd426eebc330e49a1bfcff24e4bb3e4fc"><enum>(f)</enum><text>It shall be

				unlawful—</text>

							<paragraph id="IDb8d7eb91750a4aa293357c3e95bc4f55"><enum>(1)</enum><text>for any person to

				whom subsection (a) applies to fail to create or maintain the records as

				required by subsections (a) and (c) or by any regulation promulgated under this

				section;</text>

							</paragraph><paragraph id="IDe35308d2be9c4e78b65277210e74cc18"><enum>(2)</enum><text>for any person to

				whom subsection (a) applies knowingly to make any false entry in or knowingly

				to fail to make an appropriate entry in, any record required by subsection (b)

				or any regulation promulgated under this section;</text>

							</paragraph><paragraph id="ID4934adba8c5a40ada6b7174aee52e24a"><enum>(3)</enum><text>for any person to

				whom subsection (a) applies knowingly to fail to comply with the provisions of

				subsection (e) or any regulation promulgated pursuant to that subsection;

				or</text>

							</paragraph><paragraph id="ID093f2dd57e4b42f8b7702633f0b474a2"><enum>(4)</enum><text>for any person

				knowingly to sell or otherwise transfer, or offer for sale or transfer, any

				book, magazine, periodical, film, video, or other matter, produced in whole or

				in part with materials which have been mailed or shipped in interstate or

				foreign commerce or which is intended for shipment in interstate or foreign

				commerce, that—</text>

								<subparagraph id="ID50fbc667a4084535b4cc06dbdd116935"><enum>(A)</enum><text>contains one or

				more visual depictions made after the date of enactment of this subsection of

				simulated sexually explicit conduct; and</text>

								</subparagraph><subparagraph id="ID3f9ed0b272b84d54a07be845be881001"><enum>(B)</enum><text>is produced in

				whole or in part with materials which have been mailed or shipped in interstate

				or foreign commerce, or is shipped or transported or is intended for shipment

				or transportation in interstate or foreign commerce;</text>

								</subparagraph><continuation-text continuation-text-level="paragraph">which does

				not have affixed thereto, in a manner prescribed as set forth in subsection

				(e)(1), a statement describing where the records required by this section may

				be located, but such person shall have no duty to determine the accuracy of the

				contents of the statement or the records required to be kept; and</continuation-text></paragraph><paragraph id="IDca42d449aa2e416db5339c5f0535b272"><enum>(5)</enum><text>for any person to

				whom subsection (a) applies to refuse to permit the Attorney General or his or

				her designee to conduct an inspection under subsection (c).</text>

							</paragraph></subsection><subsection id="ID09504c829145469ab5ed46bd587b7c66"><enum>(g)</enum><text>As used in this

				section, the terms <quote>simulated sexually explicit conduct</quote>,

				<quote>produces</quote>, and <quote>performer</quote> have the same meaning as

				in section 2257(h) of this title.</text>

						</subsection><subsection id="id085B00696F7149919A0E4C62A17AE598"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id1C9EF048F81D4EEF9CAB7540C8426DE4"><enum>(1)</enum><text>Whoever violates this

				section shall be imprisoned for not more than 1 year, and fined in accordance

				with the provisions of this title, or both.</text>

							</paragraph><paragraph id="id603433A31B4B4634B0D937E093CF5F04" indent="up1"><enum>(2)</enum><text>Whoever violates this section in an

				effort to conceal a substantive offense involving the causing, transporting,

				permitting or offering or seeking by notice or advertisement, a minor to engage

				in sexually explicit conduct for the purpose of producing a visual depiction of

				such conduct in violation of this title, or to conceal a substantive offense

				that involved trafficking in material involving the sexual exploitation of a

				minor, including receiving, transporting, advertising, or possessing material

				involving the sexual exploitation of a minor with intent to traffic, in

				violation of this title, shall be imprisoned for not more than 5 years and

				fined in accordance with the provisions of this title, or both.</text>

							</paragraph><paragraph id="idE65BFC43DB9D4EF5B2A82B770E10DB02" indent="up1"><enum>(3)</enum><text>Whoever violates paragraph (2) after

				having been previously convicted of a violation punishable under that paragraph

				shall be imprisoned for any period of years not more than 10 years but not less

				than 2 years, and fined in accordance with the provisions of this title, or

				both.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="idDAD6AC1D0F094511B7606D3C12092DB5"><enum>(b)</enum><header>Chapter

			 analysis</header><text>The chapter analysis for chapter 110 of title 18, United

			 States Code, is amended by inserting after the item for section 2257 the

			 following:</text>
