			 <quote><short-title>Valles Caldera Preservation Act of

			 2005</short-title></quote>.</text>

			 the Valles Caldera Preservation Act</header>

			<subsection id="ID08DCD84A2E6F4CF9988BBD0B63418F65"><enum>(a)</enum><header>Acquisition of

			 outstanding mineral interests</header><text>Section 104(e) of the Valles

			 Caldera Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/698v-2(e)">16 U.S.C. 698v–2(e)</external-xref>) is

			 amended—</text>

				Secretary shall acquire the interests pursuant to section 3114 of title 40,

				funds</header><text>Any difference between the sum of money estimated to be

				just compensation by the Secretary and the amount awarded shall be paid from

			 expenditures</header><text>Section 106(e) of the Valles Caldera Preservation

			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/698v-4(e)">16 U.S.C.

			 698v–4(e)</external-xref>) is amended by adding at the end the

			 following:</text>

					<paragraph id="ID0717DBC3EC974985B4746CC014854EE3"><enum>(4)</enum><header>Obligations and

				expenditures</header><text>Subject to the laws applicable to Government

				corporations, the Trust shall determine—</text>

						<subparagraph id="ID2404B74380104365AB27DC88ABBDC09D"><enum>(A)</enum><text>the character of,

				and the necessity for, any obligations and expenditures of the Trust;

				and</text>

						</subparagraph><subparagraph id="IDDFBAF579032A4E15B96D6B8E96B621D3"><enum>(B)</enum><text>the manner in

				which obligations and expenditures shall be incurred, allowed, and paid.</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="IDE8F57AE567344C65B1EF7F795F86A0CA"><enum>(c)</enum><header>Solicitation of

			 donations</header><text>Section 106(g) of the Valles Caldera Preservation Act

			 (<external-xref legal-doc="usc" parsable-cite="usc/16/698v-4(g)">16 U.S.C.

			 698v–4(g)</external-xref>) is amended by striking <quote>The Trust may

			 solicit</quote> and inserting <quote>The members of the Board of Trustees, the

			 executive director, and 1 additional employee of the Trust in an executive

			 position designated by the Board of Trustees or the executive director may

			 solicit</quote>.</text>

			</subsection><subsection id="ID5CC0A4BE0E7B4525AD7923AB27D3ED16"><enum>(d)</enum><header>Use of

			 proceeds</header><text>Section 106(h)(1) of the Valles Caldera Preservation Act

			 (<external-xref legal-doc="usc" parsable-cite="usc/16/698v-4(h)(1)">16 U.S.C.

			 698v–4(h)(1)</external-xref>) is amended by striking <quote>subsection

			 (g)</quote> and inserting <quote>subsection (g), from claims, judgments, or

			 settlements arising from activities occurring on the Baca Ranch or the Preserve

			 after October 27, 1999,</quote>.</text>

			</subsection></section><section id="IDBE1B6ACFA7E74972A8B01955E6DCEB41"><enum>3.</enum><header>Board of

			 Trustees</header><text display-inline="no-display-inline">Section 107(e) of the

			 Valles Caldera Preservation Act (U.S.C. 698v–5(e)) is amended—</text>

			<paragraph id="IDA116BC0229154AA4B7BA285B950CE07F"><enum>(1)</enum><text>in paragraph (2),

			 by striking <quote>Trustees</quote> and inserting <quote>Except as provided in

			 paragraph (3), trustees</quote>; and</text>

			</paragraph><paragraph id="IDA80A264D39534990A6383D05332B512F"><enum>(2)</enum><text>in paragraph

			 (3)—</text>

				<subparagraph id="IDF803EC4DBC4F45B492CB553127E002A1"><enum>(A)</enum><text>by striking

				pay for level IV of the Executive Schedule under section 5315 of title 5,

				United States Code, for each day (including travel time) in which the chair is

				engaged in the performance of duties of the Board of Trustees.</text>

						</subparagraph><subparagraph id="ID91C6EA56787A4DCB94A81932C4ED64D4"><enum>(C)</enum><header>Maximum rate of

				pay</header><text>The total amount of compensation paid to the chair for a

				fiscal year under subparagraph (B) shall not exceed 25 percent of the annual

				rate of pay for level IV of the Executive Schedule under section 5315 of title

				5, United States Code.</text>

			 Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/698v-6(c)(3)">16 U.S.C. 698v–6(c)(3)</external-xref>) is

			 amended—</text>

				with management program</header><text>The plan shall be consistent with the

				management program developed pursuant to subsection (d).</text>

								</clause><clause id="ID88A8D919E9D24A6295A000381BF85896"><enum>(iii)</enum><header>Cooperative

				agreement</header><text>To the extent generally authorized at other units of

				the National Forest System, the Secretary shall provide the services to be

				carried out pursuant to the plan under a cooperative agreement entered into

				between the Secretary and the Trust.</text>

								</clause></subparagraph><subparagraph id="IDCADD83A00EC74E2CABC03C6649899262"><enum>(B)</enum><header>Reimbursable

				services</header><text>To the extent generally authorized at other units of the

				National Forest System, the Secretary may provide presuppression and

				nonemergency rehabilitation and restoration services for the Trust at any time

				on a reimbursable basis.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
