the Emergency Preparedness and
Response for Individuals With Disabilities Act of
2005
.
<enum>I</enum><header>Emergency
planning and response for individuals with disabilities</header>
<section id="id8C3B825D4B2040FD9067FACF66A85110"><enum>101.</enum><header>Definition</header><text display-inline="no-display-inline">Section 506 of the Homeland Security Act of
2002 (6 U.S.C. 316) is amended—</text>
<paragraph id="id865C553E7A8145D5B3F0EA1136BA71F9"><enum>(1)</enum><text>by redesignating
paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and
realigning the margin as appropriate; and</text>
</paragraph><paragraph id="id94213D0981424A1FBF2435B3D8FAB9F8"><enum>(2)</enum><text>by striking
<quote>, the term</quote> and inserting the following: “—</text>
<quoted-block display-inline="no-display-inline" id="idC0FAE3829C0A460DA4E73365E3B16B33" style="OLC">
<paragraph id="id10AB5DBAF6DE4AE18E3B02FBCBE00A6E"><enum>(1)</enum><text>the term

section 3 of the Americans with Disabilities Act of 1990 (42 U.S.C. 12102);

</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section id="id104F0F3F443E4400A91E6DF2541DD453"><enum>102.</enum><header>Disability
coordinator</header>
<subsection id="id8D759C63827C4470B2FD1B816DDF5450"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Title V of the
Homeland Security Act of 2002 (6 U.S.C. 311 et seq.) is amended by adding at
the end the following:</text>
<quoted-block display-inline="no-display-inline" id="idD067BD11D1E74336B3A5BBB7DB587D5C" style="OLC">
<section id="idE178FE725419482A8CC2A0471B01A00A"><enum>512.</enum><header>Disability
coordinator</header>
<subsection id="id7A0399CB08444E47863384062FD1BDD4"><enum>(a)</enum><header>In
general</header><text>After consultation with organizations representing
individuals with disabilities and the Interagency Coordinating Council on
Emergency Preparedness and Individuals with Disabilities established under
Executive Order 13347 (6 U.S.C. 312 note), the Secretary shall appoint a
Disability Coordinator. The Disability Coordinator shall report directly to the
Secretary, in order to ensure that the needs of individuals with disabilities
are being properly addressed in emergency preparedness and disaster
relief.</text>
</subsection><subsection id="id45998A104C184143B686CB2D7ACD16EC"><enum>(b)</enum><header>Responsibilities</header><text>The
Disability Coordinator shall be responsible for—</text>
<paragraph id="id7FF5F9D6D28047AD9259617B8817AA15"><enum>(1)</enum><text>providing
guidance and coordination on matters related to individuals with disabilities
in emergency planning requirements and relief efforts in the event of a major
disaster;</text>
</paragraph><paragraph id="id1685FE91CE974BEB83A6E3D11F5F3D77"><enum>(2)</enum><text>interacting
directly with Department staff, the Interagency Coordinating Council on
Emergency Preparedness and Individuals with Disabilities established under
Executive Order No. 13347 (6 U.S.C. 312 note), other agencies of the Federal
Government, and State and local government authorities regarding the needs of
individuals with disabilities in emergency planning requirements and relief
efforts in the event of a major disaster;</text>
</paragraph><paragraph id="idF2D4C23DF8D14567A781BF4C2DD484D0"><enum>(3)</enum><text>consulting with
organizations that represent the interests and rights of individuals with
disabilities about the needs of individuals with disabilities in emergency
planning requirements and relief efforts in the event of a major
disaster;</text>
</paragraph><paragraph id="IDd7a5be27314b43c7a64fd76faa9da1fa"><enum>(4)</enum><text>coordinating and
disseminating best practices and model evacuation plans for individuals with
disabilities;</text>
</paragraph><paragraph id="IDdf02e429bc0c4832b190ed5fa9cf83a4"><enum>(5)</enum><text>developing a
curriculum for first responder training on the needs of individuals with
disabilities, including the needs of individuals with physical disabilities and
the needs of individuals with psychiatric disabilities;</text>
</paragraph><paragraph id="IDabdfad411c2e4bb990e38df240d17fbc"><enum>(6)</enum><text>developing
training materials for State and local governmental officials, first
responders, and others about the importance of allowing individuals with
disabilities to retain their durable medical equipment, wheelchairs, service
animals, and other assistive devices, to the maximum extent possible, in the
aftermath of a major disaster;</text>
</paragraph><paragraph id="ID7e66634e698e4ad88bbd80a5afd746a5"><enum>(7)</enum><text>working with the
Director of the Centers for Medicare and Medicaid Services, durable medical
equipment regional carriers, manufacturers and suppliers of durable medical
equipment, and medical professionals to draft an emergency response plan for
the temporary loan or replacement of durable medical equipment in the event of
a major disaster;</text>
</paragraph><paragraph id="ID815bf09a687c4528afbea8318d6972c9"><enum>(8)</enum><text>ensuring the
accessibility of telephone hotlines and websites regarding emergency
preparedness, evacuations, and disaster relief;</text>
</paragraph><paragraph id="ID2ff7ebe3c54d40d396b8bd6f33706091"><enum>(9)</enum><text>working with the
Chairman of the Federal Communications Commission to ensure that video
programming distributors, including broadcasters, cable operators, and
satellite television services, make emergency information accessible to
individuals with hearing and vision disabilities;</text>
</paragraph><paragraph id="ID545c64b69094425ba22d15e4c7edbbbe"><enum>(10)</enum><text>coordinating the
availability of accessible transportation options for individuals with
disabilities in the event of an evacuation;</text>
</paragraph><paragraph id="IDc215494e4fa941d3983aa37c07838dc5"><enum>(11)</enum><text>providing
guidance and implementing policies to ensure that the rights and wishes of
individuals with disabilities regarding post-evacuation residency and
relocation are respected;</text>
</paragraph><paragraph id="id2BCD7C764D374123BB2D2E6C0A185AF6"><enum>(12)</enum><text>ensuring that
meeting the needs of individuals with disabilities are included in any Federal
emergency response plans; and</text>
</paragraph><paragraph id="id820CFF0B363A479CACED29E440EBFACF"><enum>(13)</enum><text>any other duties
relevant to emergency preparedness an response for individuals with
disabilities.</text>
</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="idDFBEC0539EBE4799AE7A1585835601BF"><enum>(b)</enum><header>Technical and
conforming amendments</header><text>The Homeland Security Act of 2002 (6 U.S.C.
101 et seq.) is amended—</text>
<paragraph id="idC58AE175B8844F12B8ACFA9A277BA118"><enum>(1)</enum><text>by redesignating
the second section designated as section 510 as section 511; and</text>
</paragraph><paragraph id="id6A8379BA910848A091658C078E73D94F"><enum>(2)</enum><text>in the table of
contents, by inserting after the item relating to section 509 the
following:</text>

housing</header><text display-inline="no-display-inline">Section 408(c)(1)(B)
of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42
U.S.C. 5174(c)(1)(B)) is amended by—</text>
<paragraph id="idF4F9C587B8D94DEA8A7025F1513DB9AF"><enum>(1)</enum><text display-inline="yes-display-inline">redesignating clauses (ii) and (iii) as
clauses (iii) and (iv) respectively; and</text>
</paragraph><paragraph id="id8C2F71BC03CC4E39B2AFFEFF336C5AC6"><enum>(2)</enum><text>inserting after
clause (i) the following:</text>

<clause id="id4DC93B03BEE240989C7CE2DD78A53F7B"><enum>(ii)</enum><header>Accessible
temporary housing</header><text>In the event temporary housing units, including
trailers, are provided under clause (i), not less than 30 percent of such
temporary housing shall be physically accessible to and usable by individuals
with disabilities, and the accessible units shall be integrated with other
available housing
units.</text>
</clause><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section id="idBFA8DE5E702A468E93785BDF6533ECFD"><enum>104.</enum><header>Right of
individuals with disabilities to live independently</header><text display-inline="no-display-inline">Section 308 of the Robert T. Stafford
Disaster Relief and Emergency Assistance Act (42 U.S.C. 5151) is amended by
adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="id94A0A9293E714A33ADD6D4A1276D8763" style="OLC">
<subsection id="id87A14033F8FE4190AA07113D4656D18F"><enum>(c)</enum><header>Individuals
with disabilities</header><text>Personnel carrying out Federal assistance
functions under subsection (a) and governmental bodies and other organizations
providing assistance under subsection (b) shall exert maximum effort to ensure
that individuals with disabilities (as defined in section 3 of the Americans
with Disabilities Act of 1990 (42 U.S.C. 12102)) who were living independently
before evacuating their homes are offered housing alternatives with comparable
independence.</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="id60F7F7B1E49D4178BDDF7817E5E11A6F"><enum>105.</enum><header>GAO Study on
accessibility of emergency shelters</header>
<subsection id="id286D18EEE5BE4124B2000AF102FB152B"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Comptroller
General of the United States shall conduct a national study regarding whether,
and, if so, to what extent, emergency shelters for use in response to a major
disaster, as that term is defined in section 102(2) of the Robert T. Stafford
Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122(2)) are accessible
to, and usable by, individuals with disabilities.</text>
</subsection><subsection id="id14E2DCDC20DA4FBE9C5FA944A90A0E8F"><enum>(b)</enum><header>Report</header><text>Not
later than 12 months after the date of enactment of this Act, the Comptroller
General of the United States shall submit a report summarizing the results of
this study to the Committee on Homeland Security and Governmental Affairs and
the Committee on Health, Education, Labor, and Pensions of the Senate and the
Committee on Homeland Security and the Committee on Education and the Workforce
of the House of Representatives.</text>
</subsection></section><enum>II</enum><header>Increasing
Accessibility of Replacement Housing</header>
<section id="HE3D0FDDB0F8F4A3C9272FF0047FB814D"><enum>201.</enum><header>Amount of
assistance available</header>
<subsection id="idE0C21C05C10E4D18840D71959CD31AE7"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Section 408(c)(3) of
the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
5174(c)(3)) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="idCBE2672AAD784324825F273FF2FE0EBE" style="OLC">
<subparagraph id="id86BF097B4CA444209A91B409D8EE0A7D"><enum>(D)</enum><header>Additional
assistance for enhanced accessibility</header><text>The maximum amount of
assistance provided to a household under this paragraph may be increased by
$5,000 if the owner of the residence involved agrees to comply with the
increased accessibility standards described in paragraph
(5).</text>
</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="idC4A47C30E9F84D22BD4D66AF4AAC528C"><enum>(b)</enum><header>Maximum
amounts</header><text>Section 408(h)(1) of the Robert T. Stafford Disaster
Relief and Emergency Assistance Act (42 U.S.C. 5174(h)(1)) is amended by
striking <quote>$25,000</quote> and inserting <quote>$30,000</quote>.</text>
</subsection><subsection commented="no" id="idE5C25AAB94D349F4A7D74FB58B3E3659"><enum>(c)</enum><header>Small
businesses</header><text>Section 7(b) of the Small Business Act (15 U.S.C.
636(b)) is amended by inserting immediately after paragraph (3) the
following:</text>
<quoted-block display-inline="no-display-inline" id="id50E6A213D0B24262A7E660008341C8D6" style="OLC">
<paragraph commented="no" id="idB358FEB751AF41CD9FD5E2BA18435BF8"><enum>(4)</enum><header>Accessibility
of replacement housing</header><text>Notwithstanding any other provision of
law, the Administrator may increase the maximum amount of a loan under this
subsection by not more than 10 percent if—</text>
<subparagraph commented="no" id="idDEB78F484A574361995C37B89C81F5C0"><enum>(A)</enum><text>the loan is for
replacement of a private residence; and</text>
</subparagraph><subparagraph commented="no" id="id82AE899FD9184E0C8E6AE6E52DA580FC"><enum>(B)</enum><text>the owner agrees
to comply with the increased accessibility standards described in paragraph (5)
of section 408(c) of the Robert T. Stafford Disaster Relief and Emergency
Assistance Act (42 U.S.C.
5174(c)).</text>
</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="ID50A58EAF5E794CF88C363DE72F45A06C"><enum>(d)</enum><header>Clerical
amendments</header><text>Section 7(b) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C. 636(b)) is amended
in the undesignated matter at the end—</text>
<paragraph id="IDBAE0B761FB7B4544A020D4FB5A57FEA1"><enum>(1)</enum><text>in the sentence
beginning <quote>In the Administration of the disaster loan program</quote>, by
striking <quote>, (2), and (4)</quote> and inserting <quote>and (2)</quote>;
and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE8A2E2BF95A64CF8831929315D731D7A"><enum>(2)</enum><text>in the sentence
beginning <quote>A State grant made on or prior to July 1, 1979</quote>, by
striking <quote>, (2), or (4)</quote> and inserting <quote>or

</paragraph></subsection></section><section id="H6DCD2C43E72E49A49204184216C84644"><enum>202.</enum><header>Accessibility
standards</header><text display-inline="no-display-inline">Section 408(c) of
the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
5174(c)) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="id9FF8934AA1014165BC04A2CC1F97C054" style="OLC">
<paragraph id="id792CBD36CF85440491DFCA77A28D0D13"><enum>(5)</enum><header>Increased
accessibility standards for replacement housing</header>
<subparagraph id="id4F7C98218BD34B2C8F87668F496D1E40"><enum>(A)</enum><header>In
general</header><text>The increased accessibility standards described in this
paragraph include features that allow a residence to be accessible to, and
usable by, an individual with a disability (including a person who uses a
wheelchair).</text>
</subparagraph><subparagraph id="id15F3117C9C2849F98D60F3F8CD992AA1"><enum>(B)</enum><header>Minimum
requirements</header><text>The accessible features described in this paragraph
include, at a minimum—</text>
<clause id="idCFAC23A5117A4608A64C59895B375DDE"><enum>(i)</enum><text>an accessible
pathway from outside of the residence to an accessible entrance;</text>
</clause><clause id="id31C85FAECE44490EA078DF4AE4A68EB2"><enum>(ii)</enum><text>an accessible
entrance;</text>
</clause><clause id="id96AC496CB4574FC499622A25DFDF622C"><enum>(iii)</enum><text>an accessible
pathway that connects the accessible entrance to the accessible features within
the residence;</text>
</clause><clause id="idA026474BD4064016A3DCF41E26E4DD35"><enum>(iv)</enum><text>accessible
interior doors;</text>
</clause><clause id="id4BC538D4B4D8458E94C8D1A179B3D9AD"><enum>(v)</enum><text>accessible
environmental controls;</text>
</clause><clause id="id668E172D6EE3469DB4CC25040C179626"><enum>(vi)</enum><text>an accessible
sleeping area;</text>
</clause><clause id="id17ACC70966BE4CE694AFDEB35ED7AEE5"><enum>(vii)</enum><text>an accessible
bathing area;</text>
</clause><clause id="idC1EFB0B64D3B4C54A0B23CD6B4C5204D"><enum>(viii)</enum><text>an accessible
bathroom that includes an accessible toileting area;</text>
</clause><clause id="id7EE8CB6E5BE64F81AE023971FF4189B0"><enum>(ix)</enum><text>an accessible
kitchen; and</text>
</clause><clause id="idD658D92AAD9A4705ADB10126C5542EC8"><enum>(x)</enum><text>accessible living
space.</text>
</clause></subparagraph><subparagraph id="id26889831356A483EA0D8F9DA1B9EF8E8"><enum>(C)</enum><header>Location</header><text>The
interior accessible features described in subparagraph (B) shall either be
located on 1 level of the residence or connected to each other in a manner that
allows their independent use by an individual with a disability (including a
person who uses a wheelchair).</text>
</subparagraph><subparagraph id="idC60C2C20012C4581BE98511B3CF20F34"><enum>(D)</enum><header>Standards</header>
<clause id="idC4C1A08ACF9B46E78BE9B720CFA32AF6"><enum>(i)</enum><header>In
general</header><text>Not later than 12 months after the date of enactment of
this paragraph, the Architectural and Transportation Barriers Compliance Board
shall issue and publish standards setting forth the minimum technical criteria
necessary to implement the requirements set forth in this paragraph. The
Architectural and Transportation Barriers Compliance Board shall periodically
review and, as appropriate, amend the standards.</text>
</clause><clause id="id61AAFD217FA14FAC930B85097FE7B77B"><enum>(ii)</enum><header>Interim
standards</header><text>If a State or locality has an ordinance, statute, or
regulation that provides for increased housing accessibility standards
comparable to those in subparagraph (B), residents of that State or locality
who agree to meet the standards shall be eligible for the increased funds
available under paragraph (3)(D) of this subsection and paragraph (4) of
section 7(b) of the Small Business Act (15 U.S.C. 636(b)), until such time as
the Architectural and Transportation Barriers Compliance Board issues and
publishes its standards under clause (i).</text>
</clause></subparagraph></paragraph><paragraph id="id814CA51EAEF9421EA796F35875333913"><enum>(6)</enum><header>Enforcement of
accessibility standards</header>
<subparagraph id="idC1705811B2A647B69F63790CCF092A16"><enum>(A)</enum><header>Requirement for
additional assistance for enhanced accessibility</header><text>Each applicant
for additional assistance for enhanced accessibility under paragraph (3)(D) of
this subsection or section 7(b)(4) of the Small Business Act shall submit an
assurance to the Federal Emergency Management Agency that the residence
described in paragraph (3)(D) of this subsection or section 7(b)(4) of the
Small Business Act, as the case may be (referred to in this paragraph as
<quote>replacement housing</quote>), shall be constructed in compliance with
the increased accessibility standards described in paragraph (5).</text>
</subparagraph><subparagraph id="H43679B5C5FC14F89A8ADC301F53508C1"><enum>(B)</enum><header>Approval of
architectural and construction plans</header>
<clause id="H88EC9E5B264A4C3987D142E7E32D6531"><enum>(i)</enum><header>Submission</header><text>Each
applicant for additional assistance for enhanced accessibility under paragraph
(3)(D) of this subsection or section 7(b)(4) of the Small Business Act shall
submit architectural and construction plans for the proposed replacement
housing to the appropriate State or local agency.</text>
</clause><clause id="HA70F17FC9D3D4CD99097A901CE1222EB"><enum>(ii)</enum><header>Federal housing
assistance</header><text>The Secretary of Homeland Security and the Director of
the Federal Emergency Management Agency shall not provide any financial
assistance under this Act to a State or unit of general local government (or
any agency thereof) unless the appropriate State or local agency is, in the
determination of such Secretary or Director, taking the enforcement actions
described in clause (iii).</text>
</clause><clause id="H821EBEDBA7424603908BF2008B1DD6C4"><enum>(iii)</enum><header>Enforcement
actions</header><text>The enforcement actions described in this clause
are—</text>
<subclause id="H358D8B285BF347568DE061ABCE948D1D"><enum>(I)</enum><text>reviewing any
plans for proposed replacement housing submitted under clause (i) and approving
or disapproving such plans based upon compliance of the replacement housing
with the requirements of paragraph (5); and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="H7992CE52E7DD438BAC866DB73C593424"><enum>(II)</enum><text>consistent with
applicable State or local laws and procedures, withholding final approval for
construction or occupancy of the replacement housing unless and until such
compliance is achieved.</text>
</subclause></clause><clause id="H7423EBA5968F4470A9756D24E46F8734"><enum>(iv)</enum><header>Enforcement by
Attorney General</header><text>Whenever the Attorney General has reasonable
cause to believe that any person or group of persons has violated this
paragraph or paragraph (5), the Attorney General may commence a civil action in
any appropriate United States district court.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H7E053C9C86E34447B6BF55CBED85477C"><enum>(v)</enum><header>Relief</header><text>In
any civil action brought under clause (iv), if the court finds that a violation
of this paragraph or paragraph (5) has occurred or is about to occur, the court
may grant any equitable relief that the court considers to be appropriate,
including temporary, preliminary, or permanent relief.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB6625014461A44E896AC339FD8350149"><enum>(7)</enum><header>Definitions</header><text>In
this subsection:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id0923B76D62814599BECAC611EDBC345C"><enum>(A)</enum><header>Appropriate
state or local agency</header><text>The term <term>appropriate State or local
agency</term> means the State or local department or agency that is
responsible, under applicable State or local law, for the review and approval
of construction plans for compliance with generally applicable building codes
or requirements.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9B83DBC3690C4B43AAA136D3223B3C81"><enum>(B)</enum><header>Individual with
a disability</header><text>The term <term>individual with a disability</term>
has the meaning given the term in section 3 of the Americans with Disabilities
Act of 1990 (42 U.S.C.
12102).</text>
</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
