			 with the States</header><text display-inline="no-display-inline">Section 6 of

			 the Endangered Species Act (16 U.S.C. 1535) is amended—</text>

				<paragraph id="id0FE84564550B49DBBA0A1A7A9099B601"><enum>(1)</enum><text>in subsection

			 (c), by adding at the end the following:</text>

				agreements</header>

							<subparagraph id="idAC9ABFB85A1A4A668BD6CC07EF1AC8E9"><enum>(A)</enum><header>Agreements</header>

								<clause id="idFBB2592B5E33409D897B26B612B1C07D"><enum>(i)</enum><header>In

				general</header><text>A cooperative agreement entered into by the Secretary

				under this subsection may provide for development of a program for the

				conservation of—</text>

									<subclause id="id6CB2513611404952B108A56B0354A583"><enum>(I)</enum><text>a species

				determined to be a candidate species under section 4(b)(3)(B)(iii); or</text>

									</subclause><subclause id="id967F7EBA3AE34F87873B366C2FB26D90"><enum>(II)</enum><text>any other

				species that the State and the Secretary agree is likely to be determined to be

				an endangered species or threatened species under section 4(a)(1).</text>

									</subclause></clause><clause id="idAC83A98382804072B41584053FFF1226"><enum>(ii)</enum><header>Application of

				take statement</header><text>After consultation on the cooperative agreement in

				accordance with subsection (e)(2), any incidental take statement issued on the

				cooperative agreement shall apply to any species described in clause (i) and to

				the State and any landowners enrolled in any program under the cooperative

				agreement, without further consultation (except any additional consultation

				required under subsection (e)(2)), if—</text>

									<subclause id="id8B6361B29A1545989C203AF3463D302E"><enum>(I)</enum><text>the species is

				subsequently determined to be an endangered species or a threatened species;

				and</text>

									</subclause><subclause id="idE8998CF98B994975978883D113C3AC28"><enum>(II)</enum><text>the cooperative

				agreement remains an adequate and active program for the conservation of

				endangered species and threatened species.</text>

									</subclause></clause></subparagraph><subparagraph id="idF711BE62AB1F4AC7B5BF31D9E6E8C3A8"><enum>(B)</enum><header>Monitoring</header><text>A

				cooperative agreement entered into by the Secretary under this subsection may

				provide for monitoring, or assistance in monitoring, the status of—</text>

								<clause id="idA907B6DF3915434D88FFA5FE46D6B93E"><enum>(i)</enum><text>a

				candidate species in accordance with section 4(b)(3)(C)(iii); or</text>

								</clause><clause id="idCA61B1D7D0BC47A8B5529967C5F721B6"><enum>(ii)</enum><text>a species that

				is determined to be recovered, and that is delisted, in accordance with section

				4.</text>

								</clause></subparagraph></paragraph><paragraph id="idF3C17E1E14F84DC4BF9E32E18926D5A4"><enum>(4)</enum><header>Enrollment of

				land or water rights</header><text>A cooperative agreement entered into by the

				Secretary under this subsection that provides for the enrollment of private

				land or water rights in any program established by the cooperative agreement

				shall ensure that the decision to enroll is voluntary for each owner of the

				land or water

				rights.</text>

						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

				</paragraph><paragraph id="id8600A43787C24A3FB31717076EA5086C"><enum>(2)</enum><text>in subsection

			 (d)(1)—</text>

					<subparagraph id="id9762E3C8EE9247A7B33D337D1CF4C727"><enum>(A)</enum><text>in the first

			 sentence—</text>

						<clause id="id1094A84C7DA64DD8907718B4FBE9FE2A"><enum>(i)</enum><text>by

			 striking <quote>pursuant to subsection (c) of this section</quote>; and</text>

						</clause><clause id="id9FCC324F08A34ABA93CE93941F2159BB"><enum>(ii)</enum><text>by

			 striking <quote>or to assist</quote> and all that follows through

			 <quote>section 4(g)</quote> and inserting <quote>under paragraphs (1) or (2) of

			 subsection (c) or section 4(b)(5)(C), or to address candidate species or other

			 species at risk and recovered species under subsection (c)(3)</quote>;

			 and</text>

						</clause></subparagraph><subparagraph id="id063D2BAAE0A2468484570AEE9FA946E6"><enum>(B)</enum><text>in subparagraph

			 (F), by striking <quote>monitoring the status of candidate species</quote> and

			 inserting <quote>developing a conservation program for, or monitoring the

			 status of, candidate species or other species determined to be at risk under

			 subsection (c)(3)</quote>; and</text>

					</subparagraph></paragraph><paragraph id="idC8DF79574B6D489A800383147ECA8F95"><enum>(3)</enum><text>by striking

			 subsection (e) and inserting the following:</text>

					<quoted-block display-inline="no-display-inline" id="id8E687F6276E942C7A481B4FC34488111" style="OLC">

						<subsection id="idD469D856C47A4EA18BD3ECAE60A894C7"><enum>(e)</enum><header>Review of State

				programs</header>

							<paragraph id="id6E04252E45D44BB8811F74CD89C47F48"><enum>(1)</enum><header>In

				general</header><text>Any action taken by the Secretary under this section

				shall be subject to periodic review by the Secretary at least every 3

				years.</text>

							</paragraph><paragraph id="id0456010A2BCB4222A2045CDFAA107E7D"><enum>(2)</enum><header>Applicable

				authority</header><text>A cooperative agreement entered into by the Secretary

				under subsection (c) shall be subject to subsections (a)(2) through (d) of

				section 7 (including implementing regulations) only before the date on

				which—</text>

								<subparagraph id="id185649D8AD444ADE8AE038BF0FAA6432"><enum>(A)</enum><text>the Secretary

				enters into the cooperative agreement; or</text>

								</subparagraph><subparagraph id="id2CB672800368445D8302482E2D4497DF"><enum>(B)</enum><text>the Secretary

				approves any renewal of, or amendment to, the cooperative agreement

				that—</text>

									<clause id="IDf386b03c219d425a8fb7723a9650dc9f"><enum>(i)</enum><text>addresses species

				that—</text>

										<subclause id="id809331570F79433B9D750630DE8E4917"><enum>(I)</enum><text>are determined to

				be endangered species or threatened species;</text>

										</subclause><subclause id="idD9142F48FD8C4D33888636EC0EDD0772"><enum>(II)</enum><text>are not

				addressed in the cooperative agreement; and</text>

										</subclause><subclause id="id47D87190B5EF40CA80845AF52A189BFA"><enum>(III)</enum><text>may be affected

				by the cooperative agreement; or</text>

										</subclause></clause><clause id="IDf68805e35ef84ffa9729d63521bdfdae"><enum>(ii)</enum><text>contains new

				information about any species addressed in the cooperative agreement that the

				Secretary determines—</text>

										<subclause id="IDde855b69527c46c2870a74c885fbd384"><enum>(I)</enum><text>constitutes the

				best scientific and commercial data available; and</text>

										</subclause><subclause id="ID61c4cf16321e40129bbaf332044ddd5a"><enum>(II)</enum><text>indicates that

				the cooperative agreement may have adverse effects on the species that had not

				been considered previously when the cooperative agreement was entered into or

				during any revision of or amendment to the cooperative agreement.</text>

										</subclause></clause></subparagraph></paragraph><paragraph id="ID0bb9987267564320a58cd2829ad208d1"><enum>(3)</enum><header>Suspension of

				cooperative agreement</header><text>The Secretary may suspend a cooperative

				agreement entered into by the Secretary under subsection (c), after

				consultation with the Governor of the affected State, if Secretary finds during

				the periodic review required by paragraph (1) that the cooperative agreement no

				longer constitutes an adequate and active program for the conservation of

				endangered species and threatened species.</text>

							</paragraph><paragraph id="ID8c1425d8ede84192acb07c8cf36fdef2"><enum>(4)</enum><header>Termination of

				cooperative agreement</header><text>The Secretary may terminate a cooperative

				agreement entered into by the Secretary under subsection (c), after

				consultation with the Governor of the affected State, if—</text>

								<subparagraph id="ID03922aba205a4952a96c733371b48728"><enum>(A)</enum><text>as result of

				subsections (a)(2) through (d) of section 7 (including implementing

				regulations), the Secretary determines that—</text>

									<clause id="id3300FDBB8A27482481C68CB87E8C5552"><enum>(i)</enum><text>continued

				implementation of the cooperative agreement is likely—</text>

										<subclause id="idD0EDBEB61E234005ABF245D99E641A80"><enum>(I)</enum><text>to jeopardize the

				continued existence of endangered species or threatened species; or</text>

										</subclause><subclause id="id64124A8928BF4C69A8E701868B37CAE8"><enum>(II)</enum><text>to result in the

				destruction or adverse modification of critical habitat; and</text>

										</subclause></clause><clause id="id2F76696CAA2E4E27922754CC231256C7"><enum>(ii)</enum><text>the cooperative

				agreement is not amended or revised to incorporate a reasonable and prudent

				alternative offered by the Secretary under section 7(b)(3); or</text>

									</clause></subparagraph><subparagraph id="ID9ae51078492b4733a7dc022fd94d91e8"><enum>(B)</enum><text>the cooperative

				agreement—</text>

									<clause id="id4B4CE2BE5438469D9C2169855735B9CE"><enum>(i)</enum><text>has been

				suspended under paragraph (3); and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="id10D842C5D1E9460082C8FA59B94619E9"><enum>(ii)</enum><text>as of the date

				that is 180 days after the date of the suspension, has not been amended or

				revised and found by the Secretary to constitute an adequate and active program

				for the conservation of endangered species and threatened

				species.</text>

			 Listing and Recovery</header>

			 and recovery of endangered species and threatened species</header>

				<subsection id="id90986ED204E4491DBE6D713074272BBA"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 4 of the

			 Endangered Species Act of 1973 (16 U.S.C. 1533) is amended—</text>

					<paragraph id="idE12E831CD07B4147B9FF38642673EDEB"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the section heading and all

			 that follows through <quote>(a) <header-in-text level="subsection" style="OLC">General</header-in-text>.—(1) The Secretary</quote> and inserting

				provisional recovery goals for a species at the time of the listing of the

				for delisting; and</text>

				general</header><text>Not later than 270 days after the date of enactment of

				the <short-title>Priority for Listing and Recovery

				Act</short-title>, the Secretary of the Interior and the Secretary of Commerce,

				after providing notice and an opportunity for public comment, each shall

				establish a priority system for making all decisions under this subsection,

				subsection (a), and subsection (f) regarding various species in the most

				efficient and effective manner practicable.</text>

									</subparagraph><subparagraph id="IDc6fb03c6577c4efda2c2c9df9a644eb8"><enum>(B)</enum><header>Criteria for

				priorities</header><text>The priority system shall assign priorities to species

				based on—</text>

										<clause id="ID86d253481b2d4164af8561fdbbacefbe"><enum>(i)</enum><text>the magnitude and

				immediacy of risk of extinction (high, moderate, or low), considering—</text>

											<subclause id="IDb7b01fe868e54a89a04693c7c2f02539"><enum>(I)</enum><text>the level of risk

				to the species based on the factors described in subsection (a)(1);</text>

											</subclause><subclause id="ID4e26db611e214c438106f6956dd18c11"><enum>(II)</enum><text>the geographic

				distribution of the species (wide or narrow),</text>

											</subclause><subclause id="IDab8bb23d5e9944d2b167b5ea8e5cb2b2"><enum>(III)</enum><text>the habitat

				specificity of the species (broad or restricted); and</text>

											</subclause><subclause id="IDbe7b4851a9b342ecaddaaaee4c758a40"><enum>(IV)</enum><text>the taxonomic

				distinctiveness of the species (monotypic genus, species, subspecies, or

				distinct population segment);</text>

											</subclause></clause><clause id="ID092576a970964d64ac751e2eed8f9aca"><enum>(ii)</enum><text>the likelihood

				of achieving recovery of the species;</text>

										</clause><clause id="IDc2c35dff502643219262748b631b49ea"><enum>(iii)</enum><text>the quality and

				quantity of available information, with the species priority increasing

				progressively as current professional documentation is obtained for each of the

				following in order of increasing importance:</text>

											<subclause id="IDb50bd8379aec4e7faedee13cfe8d1ec7"><enum>(I)</enum><text>Distribution of

				the species based on data describing presence and absence.</text>

											</subclause><subclause id="ID8a99cc467d454700b4e453a30f47a9f4"><enum>(II)</enum><text>Habitat types

				that correlate with population density (defined as various concentrations of

				individuals of the species occupying an area).</text>

											</subclause><subclause id="IDbfa1a6a5c31b47bf9baa5def9eb83d62"><enum>(III)</enum><text>Rates of

				reproduction, survival, or population growth.</text>

											</subclause><subclause id="ID610775da2fc84758bc7ea7274b97520d"><enum>(IV)</enum><text>Habitat types

				that correlate with rates of reproduction, survival, or population

				growth;</text>

											</subclause></clause><clause id="ID77431f0853c84756b5f95011d6ee3922"><enum>(iv)</enum><text>the degree to

				which recovering the species helps recover other species; and</text>

										</clause><clause id="ID5b7faf57a50c4766b10aa4a3d66625cb"><enum>(v)</enum><text>the degree to

				which recovery efforts would minimize conflicts with—</text>

											<subclause id="ID2580e983f8cd4744ab9a2fb82006769c"><enum>(I)</enum><text>construction,

				development projects, jobs, private property, or other economic

				activities;</text>

											</subclause><subclause id="IDf767680b6abb4e99946ed0f7c426f3d8"><enum>(II)</enum><text>military

				training and operations; or</text>

											</subclause><subclause id="ID388a2d3a3b5c459ca6519071be919563"><enum>(III)</enum><text>other human

				activities.</text>

											</subclause></clause></subparagraph><subparagraph id="ID1e562dde61a645eb94dc04ea63d45df0"><enum>(C)</enum><header>Incentive for

				collaborative conservation</header>

										<clause id="id3CA9427465E746629DEF632BBA316894"><enum>(i)</enum><header>In

				general</header><text>The Secretary shall assign highest priority to a decision

				pending for any species if petitioned to do so by a collaborative group that,

				in the judgment of the Secretary, meets the description of an executive

				committee under subsection (f)(3)(B).</text>

										</clause><clause id="id1F963FAFFED94497849B97AB9006C774"><enum>(ii)</enum><header>Facilitation</header><text>If

				a collaborative group described in clause (i) uses non-Federal funds to carry

				out actions that support the completion of the pending action for a species,

				the Secretary shall facilitate the pending action to a commensurate

				extent.</text>

										</clause></subparagraph></paragraph><paragraph id="IDc13c3257857d46c98733515ece94dd1d"><enum>(4)</enum><header>Schedule</header>

									<subparagraph id="ID09c69ea4f80a4d00ac271b3c231c6b1b"><enum>(A)</enum><header>In

				general</header><text>The Secretary shall establish a schedule of all decisions

				under this subsection, subsection (a), and subsection (f) based on the priority

				ranking system described in paragraph (3).</text>

									</subparagraph><subparagraph id="id969291F6471C40418C540CD1567B164F"><enum>(B)</enum><header>Estimates</header><text>Not

				later than February 1 of each year following the date of enactment of this

				subparagraph, the Secretary shall submit to the Committee on Appropriations of

				the Senate and the Committee on Appropriations of the House of Representatives

				an estimate with respect to the following year, based on the priority ranking

				system described in paragraph (3), of—</text>

										<clause id="id258BC531F194447BAF4DF84A6DE198B1"><enum>(i)</enum><text>the quantity

				of—</text>

											<subclause id="id46E083CE3F654EA9A6CA6D6C739BBEB4"><enum>(I)</enum><text>petitions to be

				reviewed under this section;</text>

											</subclause><subclause id="id34B5B07682AF45D6AFC25C1C51B2F880"><enum>(II)</enum><text>status reviews

				to be completed under this section; and</text>

											</subclause><subclause id="id893DD1852BA2428785C62B13686CF8C7"><enum>(III)</enum><text>rules that will

				be promulgated with respect to status and critical habitat; and</text>

											</subclause></clause><clause commented="no" id="id1A768E9D2C5E4D1A87617EE2F5F3D576"><enum>(ii)</enum><text>the amount of

				funds required for each recovery plan to be funded under this section.</text>

										</clause></subparagraph><subparagraph id="ID9d489370eb4f4a98bba6514c151360c1"><enum>(C)</enum><header>Pending

				actions</header><text>The schedule established under subparagraph (A) shall

				include all decisions pending under this subsection, subsection (a), and

				subsection (f), including—</text>

										<clause id="IDe72ef71db5154b0190adbfbe64a9302b"><enum>(i)</enum><text>findings and

				decisions based on status reviews, proposed determinations, or final

				determinations for which a court has issued an order prior to the date of

				enactment of the <short-title>Collaboration for the

				Recovery of Endangered Species Act</short-title> remanding to the Secretary a

				decision, or setting a schedule for the Secretary to act, or requiring any

				other action regarding such findings and decisions; and</text>

										</clause><clause id="ID2269dfc4502140d9b99e3fc20832eb38"><enum>(ii)</enum><text>designations of

				critical habitat for which a court has issued an order prior to the date of

				enactment of the <short-title>Collaboration for the

				Recovery of Endangered Species Act</short-title> remanding to the Secretary a

				decision, or ordering the Secretary to act by a specified date, or requiring

				any other action regarding the designation of critical habitat.</text>

										</clause></subparagraph><subparagraph id="ID08c0f887e8464fd39e1472205826e50a"><enum>(D)</enum><header>Remanded

				actions</header><text>No court shall have the power to require the Secretary to

				complete an action inconsistent with the schedule established under

				subparagraph (A).</text>

									</subparagraph><subparagraph id="id4ACCDF300C7B4314B3005E05783E5CAB"><enum>(E)</enum><header>Revisions to

				schedule</header><text>The Secretary may revise the schedule established under

				subparagraph (A) during a fiscal year by—</text>

										<clause id="idAF669716FF5A4947BC42060FE75342B0"><enum>(i)</enum><text>reviewing a

				petition received during the fiscal year that the Secretary determines to be

				filed in a timely manner; or</text>

										</clause><clause id="id61698975D42A4190A5D3D2E4DF6F7526"><enum>(ii)</enum><text>elevating the

				priority of a recovery plan that receives financial or other commitments from a

				non-Federal

				sponsor.</text>

										</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

						</subparagraph></paragraph><paragraph id="id21013D7577804AB5AB454BB01186368C"><enum>(4)</enum><text>by striking

			 subsection (f) and inserting the following:</text>

						<quoted-block display-inline="no-display-inline" id="id16BD2547EEBC42D99A71585B93513D49" style="OLC">

							<subsection id="id3B76E6034100416B8585B3AE1C3FDEC4"><enum>(f)</enum><header>Recovery

				programs</header>

								<paragraph id="ID16312a9a6a72428e8aecd94a0382d2c6"><enum>(1)</enum><header>In

				general</header><text>When a species is scheduled for recovery under subsection

				(b)(4), or upon the petition of a collaborative group that qualifies as an

				executive committee under paragraph (3), the Secretary—</text>

									<subparagraph id="idA4498DE8764D4C0083EB5058091A1F77"><enum>(A)</enum><text>shall establish a

				recovery program for that species, and other threatened or endangered species

				if practicable, by assigning a recovery coordinator; and</text>

									</subparagraph><subparagraph id="idE69724A7979C468FB0BC5B40D486282D"><enum>(B)</enum><text>may, based on the

				nature and extent of actions required for recovery, also form a recovery team,

				an executive committee, or both.</text>

									</subparagraph></paragraph><paragraph id="IDc264d3306e5b4485a9c0af9d446fe324"><enum>(2)</enum><header>Recovery

				team</header>

									<subparagraph id="id161275A16488455988032537CC5B6E21"><enum>(A)</enum><header>Establishment</header>

										<clause id="idBBFC0C17D3524F69AFFCC186D8DAFF6F"><enum>(i)</enum><header>In

				general</header><text>If the Secretary establishes a recovery team, the team

				shall consist of members of appropriate public and private agencies and

				institutions reflecting individual perspectives and objectiveness resulting

				from professional expertise, and technical and academic experience, relating to

				the species or ecosystem that is the subject of the recovery program.</text>

										</clause><clause id="id67FEA4BE5F834218BF694EEC9D81F46A"><enum>(ii)</enum><header>Lack of

				bias</header><text>In carrying out the duties described in subparagraph (B),

				members described in clause (i) shall provide their expertise in good faith and

				not express the views or representations of any organization.</text>

										</clause></subparagraph><subparagraph id="ID8fb055ad874b4736a69b827a8471767e"><enum>(B)</enum><header>Duties</header><text>After

				considering the provisional recovery goals set by the Secretary under

				subsection (b)(8)(D) and identifying all relevant conservation programs of

				State, local, tribal, and private entities and foreign governments, a recovery

				team shall propose a recovery plan to the executive committee.</text>

									</subparagraph><subparagraph id="ID7b89e44632394a658e3cc5cd78ebacaa"><enum>(C)</enum><header>FACA</header><text>A

				recovery team established under this subsection shall not be subject to the

				Federal Advisory Committee Act (5 U.S.C. App.).</text>

									</subparagraph></paragraph><paragraph id="ID49cc62db1e4d4beebf1caed2eb59ac27"><enum>(3)</enum><header>Executive

				committee</header>

									<subparagraph id="id0BA7CDD70C404F26993CD1264582476D"><enum>(A)</enum><header>In

				general</header><text>For each recovery program, the Secretary shall establish

				an executive committee to propose collaborative efforts to achieve the goals of

				the recovery plan.</text>

									</subparagraph><subparagraph id="IDd931fbfd73a34a749821f2bd634718f1"><enum>(B)</enum><header>Membership</header><text>The

				membership of an executive committee shall—</text>

										<clause id="id30A4B99ACA5B450B98752EC7152B16EC"><enum>(i)</enum><text>reflect a

				cross-section of interests from appropriate public and private persons,

				agencies, or institutions reflecting a balance of viewpoints;</text>

										</clause><clause id="idE1AD617DA7B74ED7B4685682440B5133"><enum>(ii)</enum><text>to be selected

				for diversity of knowledge and experience in natural resource issues and for

				commitment to collaborative decisionmaking;</text>

										</clause><clause id="idBE2332139B054A0AA92C7A8085B9DAE5"><enum>(iii)</enum><text>to the maximum

				extent practicable, be from communities within and adjacent to the recovery

				plans geographic area; and</text>

										</clause><clause id="idE85BA9F86EA1481ABC527FCB5D3BE39D"><enum>(iv)</enum><text>have an

				economic, social, or professional interest in the recovery of the

				species.</text>

										</clause></subparagraph><subparagraph id="ID15503ec37beb40368f153a7826482631"><enum>(C)</enum><header>Duties</header><text>An

				executive committee shall—</text>

										<clause id="ID9cf63093a7324fc49a4c6bb583a02487"><enum>(i)</enum><text>review the

				proposed recovery plan and make recommendations on collaborative efforts that

				may be undertaken to implement and achieve the goals of the recovery

				plan;</text>

										</clause><clause id="id01E6423A32C94B409284007F6928F19F"><enum>(ii)</enum><text>consult with the

				applicable recovery team, as necessary;</text>

										</clause><clause id="ID169c13f36e0943b69b14f1a726470939"><enum>(iii)</enum><text>consult with

				State, local, and tribal governments and landowners on opportunities for

				implementation of the recovery plan; and</text>

										</clause><clause id="IDe2841828c85344af85cc91e503104373"><enum>(iv)</enum><text>after approval

				by the Secretary of the applicable recovery plan, publish a work plan

				describing the collaborative and voluntary efforts that the executive committee

				recommends to contribute to the recovery of the applicable species.</text>

										</clause></subparagraph><subparagraph id="idCBB9A73FFC794166AC043DD56415F2F8"><enum>(D)</enum><header>FACA</header><text>An

				executive committee established under this subsection shall not be subject to

				the Federal Advisory Committee Act (5 U.S.C. App.).</text>

									</subparagraph></paragraph><paragraph id="ID85f9aacb151d4b569f42aa709dffd00d"><enum>(4)</enum><header>Recovery

				coordinator</header><text>The Secretary shall assign for each recovery program,

				by direct employment or cooperative arrangement with an appropriate Federal

				department or agency, a full-time recovery coordinator—</text>

									<subparagraph id="id2DDD3CB343434A79B47FFFD7F404F7BB"><enum>(A)</enum><text>to serve as the

				primary staff to implement the recovery plan and manage program operations for

				the executive committee, if applicable; and</text>

									</subparagraph><subparagraph id="id65EEF91CCEA64DDBA1C6469E3F390C24"><enum>(B)</enum><text>to the maximum

				extent practicable, to ensure that relevant Federal and State programs are

				coordinated to support programs toward the recovery goals of the recovery

				plan.</text>

									</subparagraph></paragraph><paragraph id="ID381a80f3ea3d4413a88805e75ce2b76e"><enum>(5)</enum><header>Recovery

				plan</header>

									<subparagraph id="ID1439d09036ab4b7ba3c16f58338b38da"><enum>(A)</enum><header>In

				general</header><text>A recovery plan shall—</text>

										<clause id="idB7813B7A805C4AAE9B336DC07E122550"><enum>(i)</enum><text>be proposed by a

				recovery team and an executive committee, in a case in which a recovery team

				and executive committee are involved in the recovery program;</text>

										</clause><clause id="idBF5989A068C245679D868BE20F679BF0"><enum>(ii)</enum><text>be approved by

				the Secretary; and</text>

										</clause><clause id="idB36C7D222A7A4BAEB908ABD8A83D1D0D"><enum>(iii)</enum><text>include—</text>

											<subclause id="ID42950341d34c4c4c993fb65f79c3640f"><enum>(I)</enum><text>a description of

				site-specific recovery actions that may be necessary to achieve the goal of the

				plan for the conservation of the species, including appropriate financial

				assistance and incentive programs for landowners;</text>

											</subclause><subclause id="ID4dc304c922b94900a5a14b3582d0b8d5"><enum>(II)</enum><text>guidance on how

				the geographic distribution of site-specific recovery actions can enhance the

				effectiveness of the actions in promoting recovery; and</text>

											</subclause><subclause id="IDdb63de39ac1b456289dab80036332498"><enum>(III)</enum><text>objective,

				measurable criteria (including population size and geographic range) that, when

				met, would result in a determination, in accordance with this section, that the

				status of the species should be changed from an endangered species or a

				threatened species, or that the species should be removed from the list.</text>

											</subclause></clause></subparagraph><subparagraph id="ID4bc44c48e0764b25b9536786dfd6463b"><enum>(B)</enum><header>Effect of

				plan</header><text>A recovery plan approved by the Secretary—</text>

										<clause id="id5968E736129343928C5EC68B95062A49"><enum>(i)</enum><text>shall be

				non-binding and advisory; and</text>

										</clause><clause id="idE8CBA1DF90C844A5840D03B11DBFC698"><enum>(ii)</enum><text>may be amended

				by the Secretary or by recommendation of the executive committee and approval

				by the Secretary.</text>

										</clause></subparagraph><subparagraph id="ID152cf291813e426daf521cfb84dc9c6a"><enum>(C)</enum><header>Relationship to

				conservation programs</header><text>The Secretary shall—</text>

										<clause id="idE611D147E2AF45E4BD78C8491618C9DB"><enum>(i)</enum><text>acknowledge

				appropriate existing conservation programs; and</text>

										</clause><clause id="id52ED823FDFAD4585BB71797CCC88FA92"><enum>(ii)</enum><text>coordinate with

				all governmental agencies to incorporate those programs in a recovery

				plan.</text>

										</clause></subparagraph></paragraph><paragraph id="ID44c0cd9864954e7387b943be202dcd46"><enum>(6)</enum><header>Periodic

				review</header>

									<subparagraph id="id87AFF13BC3504AEA852EC0B7FA8BA68D"><enum>(A)</enum><header>In

				general</header><text>The Secretary shall periodically review the progress of

				all recovery programs.</text>

									</subparagraph><subparagraph id="idCB30D32B89B341F9913514576003CB44"><enum>(B)</enum><header>Inquiry</header><text>If

				the Secretary finds that a recovery program is not making progress towards

				recovery of the species or is not acting within the guidance of the recovery

				plan, the Secretary shall submit to the relevant executive committee a written

				inquiry for an explanation that requests specific remedial actions.</text>

									</subparagraph><subparagraph id="id99EAD46401234B40B98FAD54810A9BCD"><enum>(C)</enum><header>Response</header><text>The

				executive committee shall have 180 days from the date of receipt of the inquiry

				to fulfill the request.</text>

									</subparagraph><subparagraph id="id78C901275EFC445DAF38502C19D64DD4"><enum>(D)</enum><header>Dispute

				resolution</header><text>If the executive committee disputes the findings of

				the Secretary—</text>

										<clause id="id9FDC27FCBB524DFD9480FCF1F8D9B840"><enum>(i)</enum><text>the Secretary

				shall, in consultation with an appropriate professional society, appoint a

				technical reviewer;</text>

										</clause><clause id="idA982784530514F1F813ACFA2C2448A7B"><enum>(ii)</enum><text>the executive

				committee shall, in consultation with an appropriate professional society,

				appoint a technical reviewer;</text>

										</clause><clause id="id1CB9FEBAA58643A69E695BE0E7BEC5B8"><enum>(iii)</enum><text>the 2 technical

				reviewers shall appoint a third technical reviewer;</text>

										</clause><clause id="id57B841A533394E5A8A2ED0062263706B"><enum>(iv)</enum><text>the technical

				reviewers, based on majority opinion, shall make a recommendation to the

				Secretary as to whether the program is achieving progress toward recovery and

				whether remedial actions are necessary; and</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="id1B228DBB1867415F8582B28507C16947"><enum>(v)</enum><text>having considered

				the recommendation of the technical reviewers, the Secretary may—</text>

											<subclause commented="no" display-inline="no-display-inline" id="idC3BD413D702643EC843C395705989D80"><enum>(I)</enum><text>require remedial

				actions of the executive committee;</text>

											</subclause><subclause commented="no" display-inline="no-display-inline" id="id8D972415A3E64112B21B6802EA6408FB"><enum>(II)</enum><text>decommission the

				recovery program; or</text>

											</subclause><subclause commented="no" display-inline="no-display-inline" id="idEFC9C996A811446B8EC979FE003C2224"><enum>(III)</enum><text>take other

				appropriate

				actions.</text>

											</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC05E76F1804749EFB6241B6CC74A7374"><enum>(5)</enum><text>in subsection

			 general</header><text>The Endangered Species Act of 1973 (16 U.S.C. 1531 et

			 seq.) is amended by inserting after section 4 the following:</text>

				purposes of this section are—</text>

								<paragraph id="idCC83EB0F9ADB4C7B82D4BAD9045F80C3"><enum>(1)</enum><text>to conserve,

				restore, and enhance habitat for the conservation and recovery of—</text>

									<subparagraph id="idB1947F9494C54CC69C86813B1BDF33FD"><enum>(A)</enum><text>candidate

				species;</text>

									</subparagraph><subparagraph id="idA8A422154CB440BB8CC82BA6C109667E"><enum>(B)</enum><text>threatened

				species;</text>

									</subparagraph><subparagraph id="id9D7389186F074006A8035D8F1D843E5A"><enum>(C)</enum><text>endangered

				species; and</text>

									</subparagraph><subparagraph id="id0EE9AA6073E54D1AA88F704C41A450BD"><enum>(D)</enum><text>species of

				this section:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id6D278E8671F94584B085735DBF1E6FB2"><enum>(1)</enum><header>Conservation

				bank</header><text>The term <term>conservation bank</term> means an area of

				land, water, or other habitat (not necessarily contiguous) that is

				managed—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="id27BAF1864010466BAFC9F664D3570CB4"><enum>(A)</enum><text>in perpetuity, or

				for another appropriate period, under an enforceable legal instrument;

				and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7579344ACC8C48C4855DAADE936DECFB"><enum>(B)</enum><text>for purposes of

				conservation and recovery of—</text>

										<clause commented="no" display-inline="no-display-inline" id="id3EBFE06CE9B544FB90993C9993D97F53"><enum>(i)</enum><text>a habitat;</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="id11ABC08B22774D089A975C5156C4EB17"><enum>(ii)</enum><text>a candidate

				species, threatened species, or endangered species; or</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="idD6F045780776467EB9A76EFE0CD6FC32"><enum>(iii)</enum><text>a species of

				special concern.</text>

										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBAE9399A491D4AF6A624544FE811316B"><enum>(2)</enum><header>Credit</header>

									<subparagraph commented="no" display-inline="no-display-inline" id="id2B6EE1B056DC4307BC7C7348AFC5F5EF"><enum>(A)</enum><header>In

				general</header><text>The term <term>credit</term> means the unit of currency

				of a conservation bank, generated by preserving or restoring habitat in a

				conservation bank agreement, as established through a quantification of the

				conservation values of a species or habitat.</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDBBFB4F2156245B5B3A872FDBC8AE36E"><enum>(B)</enum><header>Conservation

				values</header><text>Conservation values described in subparagraph (A)

				shall—</text>

										<clause id="idA1CABBD3BC07449A95F194627A9C74A0"><enum>(i)</enum><text>be determined by

				the Secretary for each conservation bank; and</text>

										</clause><clause id="id6BDBB0A343DF468B9C6A2A7DAD89B23F"><enum>(ii)</enum><text>be converted

				into a fixed number of credits that may be bought, sold, or traded to offset

				the impact of Federal, State, tribal, local, or private activities.</text>

										</clause></subparagraph></paragraph><paragraph id="id3C96E3C645524F7C96AAD8A5C6991FA1"><enum>(3)</enum><header>Service

				area</header>

									<subparagraph id="id19012BC9ABFE4C6593002C9374A7EC43"><enum>(A)</enum><header>In

				general</header><text>The term <term>service area</term> means an area

				identified in a conservation bank agreement.</text>

									</subparagraph><subparagraph id="id30C39462F849496DA404C8DB19430FA5"><enum>(B)</enum><header>Inclusions</header><text>The

				term <term>service area</term> includes a soil type, watershed, habitat type,

				political boundary, an area described in a federally-recognized conservation

				plan, and an area designated for conservation purposes in which a credit may be

				used to offset an effect of a project.</text>

									</subparagraph></paragraph></subsection><subsection id="idBA40CF7A2DF24FF99F9FDB70861B5CA3"><enum>(c)</enum><header>Establishment

				and management of conservation banks</header>

								<paragraph id="idCC59CADA0ECE434A80CEFFBD893B4BF9"><enum>(1)</enum><header>Establishment</header><text>A

				conservation bank under this section may be established by any private

				landowner that—</text>

									<subparagraph id="id05ABC77A85DA4A9AA9083200D51D1C7C"><enum>(A)</enum><text>submits to the

				Secretary an application, in accordance with any regulations promulgated by the

				Secretary;</text>

									</subparagraph><subparagraph id="idB2F1BFB030354D89AAA0024F65A3E0A5"><enum>(B)</enum><text>demonstrates that

				the affected area of land, water, or other habitat is managed under an

				enforceable legal instrument; and</text>

									</subparagraph><subparagraph id="id0893BED43A65421D9A642DA1A5C5A9F1"><enum>(C)</enum><text>contributes to

				the conservation of the candidate species, threatened species, endangered

				species, or species of special concern that is the subject of the conservation

				bank.</text>

									</subparagraph></paragraph><paragraph id="id995D5225BF2748999C1C11C2C4435B4E"><enum>(2)</enum><header>Certain

				property owners</header><text>A property owner that uses Federal or State

				funding (including funding for technical assistance), such as funding under the

				Farm Security and Rural Investment Act of 2002 (Public Law 107–171; 116 Stat.

				134) or an amendment made by that Act, may submit an application to the

				Secretary under paragraph (1)(B)(i).</text>

								</paragraph><paragraph id="idE100407DF59F4C8CA5BD506FE14AF921"><enum>(3)</enum><header>Determinations

				regarding applications</header><text>The Secretary shall approve or disapprove

				a proposed conservation bank under paragraph (1)(B) not later than 180 days

				after the date on which the application relating to the conservation bank is

				submitted to the Secretary under paragraph (1)(B)(i).</text>

								</paragraph><paragraph id="idDDFB5F3C5FC7483D9F3E16A157C465CF"><enum>(4)</enum><header>Management</header>

									<subparagraph id="id86ACFDECA6A54AF1BE23FC4AB6D8546B"><enum>(A)</enum><header>In

				general</header><text>A conservation bank established under paragraph (1) may

				be managed, in accordance with a conservation bank agreement under subparagraph

				(B), by—</text>

										<clause id="idBD4AE99664CE4B0E8B155C5DC60C9993"><enum>(i)</enum><text>a

				State, in accordance with a process of the State that has been approved by the

				Secretary;</text>

										</clause><clause id="id2F0BC25EFD9B49EBAB0329D8A23CCF17"><enum>(ii)</enum><text>the holder of

				the conservation bank;</text>

										</clause><clause id="id359F1D6AF5834F8FB5FFD29370D0C385"><enum>(iii)</enum><text>a party other

				than the holder of the conservation bank, as specified in the conservation bank

				agreement; or</text>

										</clause><clause id="id0F56385D497D45C7969B511D7FAAF78D"><enum>(iv)</enum><text>a party that

				acquires property rights relating to the conservation bank.</text>

										</clause></subparagraph><subparagraph id="id6784FCCD87B347E99F0BDCF0B76BF5BE"><enum>(B)</enum><header>Conservation

				bank agreements</header>

										<clause id="idF6EE326C439142CA9CEB4239D7AAA322"><enum>(i)</enum><header>In

				general</header><text>The holder of a conservation bank under this section

				shall—</text>

											<subclause id="idE9EB6A7A21A74A14A02E227693780E40"><enum>(I)</enum><text>establish an

				agreement that describes the proposed management of the conservation bank;

				and</text>

											</subclause><subclause id="id9A388E2EAE334981B1576D49CE3EA8C8"><enum>(II)</enum><text>submit the

				agreement to the Secretary for approval.</text>

											</subclause></clause><clause id="id42286C23A1AC49C59D0CFC666953FFFB"><enum>(ii)</enum><header>Approval by

				Secretary</header><text>As soon as practicable after the date on which the

				Secretary receives an agreement under clause (i)(II), the Secretary shall

				approve or disapprove the agreement.</text>

										</clause><clause id="id168D6F10F4EE47E3A00435CB0FE3778C"><enum>(iii)</enum><header>Amendments</header><text>An

				agreement approved under clause (ii) may be amended on the approval of—</text>

											<subclause id="id3D0D4E32C16648B89917DCC4EBF4F450"><enum>(I)</enum><text>each party to the

				agreement; and</text>

											</subclause><subclause id="id5D0A3AFD047C408EA9013966E7543756"><enum>(II)</enum><text>the

				Secretary.</text>

											</subclause></clause><clause id="id9436098EF61C4631AF32FD750C203FB7"><enum>(iv)</enum><header>Nullification

				of agreement</header><text>The Secretary shall nullify an agreement approved

				under clause (ii) on a determination by the Secretary that—</text>

											<subclause id="id8DDA076897BE442ABF5A28335B65CCAD"><enum>(I)</enum><text>the holder of the

				conservation bank has been convicted of—</text>

												<item id="id23F131803A32403BAAFD062DCE2AF892"><enum>(aa)</enum><text>making a

				materially false statement on a bank application or a report to the Secretary;

				or</text>

												</item><item id="id6FB33234118D4B33BDA5CAEDF3283B73"><enum>(bb)</enum><text>any other

				offense that demonstrates that the holder is unfit to manage the conservation

				bank; or</text>

												</item></subclause><subclause id="idF2447C83C41F4858A803500F75607E58"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id4E8D66A888714D0D8EED9DCF5508FE06"><enum>(aa)</enum><text>the holder of the

				conservation bank has irremediably failed to carry out the duties of the

				holder; and</text>

												</item><item id="idF1985AFD20154F86BE5CFAD578F002B2" indent="up1"><enum>(bb)</enum><text>the failure was not the result of a

				drought, hurricane, tornado, or other event outside the reasonable control of

				the holder.</text>

												</item></subclause></clause></subparagraph></paragraph></subsection><subsection id="id0E64797DBE82496CB618E3B7FD71F540"><enum>(d)</enum><header>Recovery plans

				and incentive programs</header><text>In developing and implementing recovery

				plans and incentive programs, the Secretary shall—</text>

								<paragraph id="idCA4EA3A61B1F4F94947EB005D1E51E99"><enum>(1)</enum><text>take into

				consideration the practicability of establishing conservation banks; and</text>

								</paragraph><paragraph id="id1294D32311D344599486788D9A86DE64"><enum>(2)</enum><text>not later than

				180 days after the date of enactment of this section, promulgate regulations to

				manage conservation banks in a manner that balances—</text>

									<subparagraph id="id9C0C0709F8E94C3F8FB004F667C0CDAA"><enum>(A)</enum><text>the biological

				conditions of candidate species, threatened species, and endangered species,

				species of special concern, and habitat; with</text>

									</subparagraph><subparagraph id="id6513823CDA6B4522BF8866320BCC7CC5"><enum>(B)</enum><text>economic free

				market principles to ensure value to landowners through a tradable credit

				program.</text>

									</subparagraph></paragraph></subsection><subsection id="id102ADFF3919A4201ACA50874A504E4C6"><enum>(e)</enum><header>Regulations</header><text>Regulations

				promulgated under subsection (d)(2) shall include provisions relating

				to—</text>

								<paragraph id="id45B0F885FE85473CBE15203BC745C5F8"><enum>(1)</enum><text>conservation and

				recovery goals;</text>

								</paragraph><paragraph id="id478263E0C5FD473782E37630174C9B8A"><enum>(2)</enum><text>activities that

				may be carried out in a conservation bank;</text>

								</paragraph><paragraph id="id5EAB2E13AFAC4EE3AF938E072AD976FA"><enum>(3)</enum><text>design,

				operation, and management to ensure the viability of conservation banks;</text>

								</paragraph><paragraph id="idCB25379D1D664715B0E50F252C8C8907"><enum>(4)</enum><text>the demonstration

				of adequate legal control of property proposed to be included in the

				conservation bank, such as a title, license, easement, or option relating to

				the property;</text>

								</paragraph><paragraph id="id878702F59BC140A6822F0161F1BD2022"><enum>(5)</enum><text>criteria for

				determining—</text>

									<subparagraph id="id89044E86925646AFB5771BDD187A0E49"><enum>(A)</enum><text>the number of

				credits allocated to a conservation bank under subsection (f)(1);</text>

									</subparagraph><subparagraph id="id73CD6B080316491EB8F566D1BE6483D7"><enum>(B)</enum><text>methods for

				accounting for, and recording, the creation and use of credits; and</text>

									</subparagraph><subparagraph id="id1F1F50EB3C304B49B17DAC32F9271733"><enum>(C)</enum><text>a timeline with

				respect to the transfer and accounting of credits;</text>

									</subparagraph></paragraph><paragraph id="id046C7E54AF2D4322A280F53499EA40AD"><enum>(6)</enum><text>the determination

				of the boundaries of service areas;</text>

								</paragraph><paragraph id="id110C040A5AF74F9DA79FEDA42FE0C369"><enum>(7)</enum><text>the applicability

				of, and compliance with, sections 7 and 10;</text>

								</paragraph><paragraph id="id9C63E80CA807476F8A4C2146AA308807"><enum>(8)</enum><text>the monitoring

				of, and reporting requirements for, conservation banks;</text>

								</paragraph><paragraph id="id7E4259F965984AFEAB80F34FF8A8D21D"><enum>(9)</enum><text>financial

				requirements to ensure the viability of conservation banks;</text>

								</paragraph><paragraph id="idED10A2712E774B5DA40E5AFC8A45BBD5"><enum>(10)</enum><text>procedures for

				resolving disputes relating to conservation bank management, including

				procedures for providing notices; and</text>

								</paragraph><paragraph id="id9AEFF98EBE01408A81527D5D0102E03E"><enum>(11)</enum><text>remedies for

				disputes that are not resolved under a procedure described in paragraph

				(10).</text>

								</paragraph></subsection><subsection id="idE71C40917E114DC3B655CBE390AE97AB"><enum>(f)</enum><header>Transfer of

				credits by conservation banks</header>

								<paragraph id="id985F4872D8784D7DA07C60F06381336E"><enum>(1)</enum><header>Allocation</header><text>The

				number of credits allocated for transfer by a conservation bank shall be

				determined by biological data that reflects—</text>

									<subparagraph id="idCE9108F157CC4978820BC0EB7B9CCE20"><enum>(A)</enum><text>the quality of

				habitat preserved or restored in the conservation bank;</text>

									</subparagraph><subparagraph id="idC36BE38CEE08475792ACB37E93B481B1"><enum>(B)</enum><text>the necessary

				amount of habitat needed to be preserved or restored within the entire service

				area of the conservation bank; and</text>

									</subparagraph><subparagraph id="idE5922D13363048CB937D028A437ED108"><enum>(C)</enum><text>the population of

				candidate species, threatened species, and endangered species, and species of

				special concern, that the conservation bank supports or could support.</text>

									</subparagraph></paragraph><paragraph id="id6B1F8E03551C40288CA615F096208673"><enum>(2)</enum><header>Credit transfer

				approval process</header>

									<subparagraph id="id068377D55115463EB0F1852E01016648"><enum>(A)</enum><header>In

				general</header><text>As soon as practicable after the date of enactment of

				this section, the Secretary shall establish a standard credit transfer approval

				process for each service area to facilitate efficient and prompt transactions

				relating to credits.</text>

									</subparagraph><subparagraph id="id58895C7877B6489A870B522F357FF9D3"><enum>(B)</enum><header>Requirements</header><text>The

				process established under subparagraph (A) shall provide for credit transfers

				for purposes of—</text>

										<clause id="idB38DEB9CED7B44B8A221690C80EBA5F1"><enum>(i)</enum><text>compliance with

				an injunctive order of a court;</text>

										</clause><clause id="id7CB6B7B65AE5428E8088B3215B3A6C61"><enum>(ii)</enum><text>meeting a

				requirement under subsection (a) or (b) of section 7, or section 10(a)(1);

				and</text>

										</clause><clause id="idEAE5AA27C3E642B997D0FD30A0EF2AA4"><enum>(iii)</enum><text>out-of-kind

				mitigation under subparagraph (C).</text>

										</clause></subparagraph><subparagraph id="id816D5887FCA94025A7A6F5344D00C772"><enum>(C)</enum><header>Out-of-kind

				mitigation</header>

										<clause id="id5FFBB520F1E440A8A696A675DF8A9CF7"><enum>(i)</enum><header>Definition of

				out-of-kind</header><text>In this subparagraph, the term

				<term>out-of-kind</term>, with respect to mitigation, means mitigation

				involving the same species or habitats, but in a different service area.</text>

										</clause><clause id="id9AEE2641F64343E1BC488F3BCFE61BE5"><enum>(ii)</enum><header>Determination

				by Secretary</header><text>The Secretary may allow out-of-kind mitigation

				through the use of credits if the Secretary determines that out-of-kind

				mitigation—</text>

											<subclause id="idD88378092F9247FEA57D734126417C1E"><enum>(I)</enum><text>is a desirable

				ecological alternative to in-kind mitigation; and</text>

											</subclause><subclause id="idDD25E2E5F6C94F94BB3CC50F06B8F96E"><enum>(II)</enum><text>is practicable

				for an expanded market of potential buyers of credits.</text>

											</subclause></clause><clause id="id95EF54FCD1EA49078A86529B3B6879BE"><enum>(iii)</enum><header>Preference</header><text>Notwithstanding

				any other provision of this subparagraph, the Secretary shall give preference

				to in-kind mitigation to the maximum extent practicable.</text>

										</clause><clause id="idC6A85C296A0D4F13B0F0EA1F9CD8272C"><enum>(iv)</enum><header>Effect of

				subparagraph</header><text>Nothing in this subparagraph affects any requirement

				relating to in-kind mitigation.</text>

										</clause></subparagraph><subparagraph id="id916BE48EB4694508A237C364933A4651"><enum>(D)</enum><header>Limitation</header><text>In

				establishing a process under this subsection, the Secretary shall not—</text>

										<clause id="id78DF814E6519447F973B6B6D26854D20"><enum>(i)</enum><text>regulate the

				price of any credit transfer; or</text>

										</clause><clause id="id92D465E8CA8E43E3BFB4475E757157F1"><enum>(ii)</enum><text>limit

				participation in the credit transfer process by any party.</text>

										</clause></subparagraph></paragraph><paragraph id="idDF199FA4926D4762B4EF4757E393B909"><enum>(3)</enum><header>Credit

				transfers</header><text>A conservation bank may transfer credits of the

				conservation bank—</text>

									<subparagraph id="idD77AFA1EA44145C8BEE1309EDC0C96A2"><enum>(A)</enum><text>on the date on

				which the Secretary approves the conservation bank under subsection (c)(3);

				or</text>

									</subparagraph><subparagraph id="id38B9EB410A334483BC42BD3A1E7ED6EE"><enum>(B)</enum><text>before the date

				described in subparagraph (A), if the holder of the conservation bank

				demonstrates to the satisfaction of the Secretary that—</text>

										<clause id="id70164197121B4393953CBF7C43D6E2E2"><enum>(i)</enum><text>the conservation

				bank agreement adequately provides for each activity proposed to be carried out

				relating to the conservation bank; and</text>

										</clause><clause id="idAF2F38BCFAC148629342B226584C68CF"><enum>(ii)</enum><text>a timetable

				relating to the activities described in clause (i) has been approved by the

				Secretary.</text>

										</clause></subparagraph></paragraph><paragraph id="id5BA298BFC64F4BF0A0CDFB2314692034"><enum>(4)</enum><header>Use of profits

				by certain holders</header><text>A holder of a conservation bank described in

				subsection (c)(2) may retain any profits from the transfer of a credit under

				this subsection.</text>

								</paragraph></subsection><subsection id="id019D722D846641E69FD58C45E44BC6A3"><enum>(g)</enum><header>Integration

				with other conservation plans</header>

								<paragraph id="id8CD48CCF12EA4F95B0FCF960C45C9E78"><enum>(1)</enum><header>In

				general</header><text>Except as provided in paragraph (2), to the maximum

				extent practicable, the creation of a conservation bank shall be integrated

				with conservation plans developed or being developed under section 10 if the

				conservation bank—</text>

									<subparagraph id="id3E540C11BD9748A690A27DED2CD04127"><enum>(A)</enum><text>meets the

				ecological criteria of the habitat conservation plan; and</text>

									</subparagraph><subparagraph id="idB25D795F52194B3F81DC6A1F9036D434"><enum>(B)</enum><text>provides greater

				economic benefits compared with other forms of mitigation of habitat

				destruction.</text>

									</subparagraph></paragraph><paragraph id="id38B180B94F264033B7D8B9FB1A856C08"><enum>(2)</enum><header>Effect of

				subsection</header><text>Notwithstanding paragraph (1), nothing in this

				subsection requires any person operating a conservation bank in existence on

				the date of enactment of this section to submit an application for the

				conservation bank under this section.</text>

								</paragraph></subsection><subsection id="id765D87678D7A404E855596B61D664EF2"><enum>(h)</enum><header>Judicial

				review</header>

								<paragraph id="idCB0A8233289F4D21A293FD1008B25733"><enum>(1)</enum><header>In

				general</header><text>Any party to an agreement entered into with respect to a

				conservation bank may bring a civil action in a United States district court

				for a breach of the agreement.</text>

								</paragraph><paragraph id="idFEF87BC34EE742178BFD2B1AD2514263"><enum>(2)</enum><header>Actions by

				court</header><text>A United States district court described in paragraph (1)

				may—</text>

									<subparagraph id="id3D672810D4DA4D55899022875C251001"><enum>(A)</enum><text>issue such awards

				and judgments, including equitable relief, as the court determines to be

				appropriate; and</text>

									</subparagraph><subparagraph id="id1E1EC851CAD848CBA599522E177DC5DC"><enum>(B)</enum><text>award costs of

				litigation to the prevailing party.</text>

									</subparagraph></paragraph><paragraph id="id4D7A00FE67DF405889C758CA75BC863A"><enum>(3)</enum><header>Certain

				defendants</header>

									<subparagraph id="id52C9DEEE49D44E579A597E124E920E86"><enum>(A)</enum><header>In

				general</header><text>Notwithstanding any other provision of law, the United

				States, a State, an Indian tribe, or a unit of local government may 0be named

				as a defendant in a civil action under this subsection.</text>

									</subparagraph><subparagraph id="id31A9A214BD604111B19AB0517FDAB0BF"><enum>(B)</enum><header>Sovereign

				immunity</header><text>An entity described in subparagraph (A) that is named as

				a defendant in a civil action under this subsection shall be considered to have

				waived sovereign

				immunity.</text>

				to monitor impacts of the plan on covered species and the effectiveness of the

				necessary to respond to all reasonably foreseeable changes in circumstances

				that could appreciably reduce the likelihood of the survival and recovery of

				any species covered by the

				plan.</text>

								</subclause><after-quoted-block>;</after-quoted-block></quoted-block>

						</clause></subparagraph><subparagraph id="id41CC98FE395B4BE190BED313C65B4E97"><enum>(B)</enum><text>in subparagraph

			 (B)—</text>

						<clause id="id09947678DBA948F1A25F2D8C50E62825"><enum>(i)</enum><text>in

			 the matter preceding clause (i), by striking <quote>If</quote> and inserting

			 <quote>The Secretary shall issue a permit for an application and the related

				general</header><text>If a proposed conservation plan implements a

				site-specific recovery action from a relevant approved recovery plan, the

				Secretary shall include such terms and conditions as the Secretary considers

				necessary to reduce or offset the impacts of incidental taking or otherwise

				comply with the requirements of paragraph (2)(B), such that—</text>

									<subclause id="id293411CDCC3D49B0B0218F67797821FC"><enum>(I)</enum><text>the effect of the

				terms and conditions are approximately proportional in extent to the effect of

				the incidental take specified in the conservation plan under subparagraph

				(A)(i); and</text>

									</subclause><subclause id="idCECE2ECF091D4DBF8AF9564F8BEC7AE8"><enum>(II)</enum><text>the terms and

				conditions are feasible and consistent with the goals of the plan to the

				maximum extent practicable.</text>

									</subclause></clause><clause id="id6651461AF3B44BC79CD01956F6B12B2B"><enum>(ii)</enum><header>Additional

				finding</header><text>If, in addition to a finding described in subparagraph

				(B), the Secretary finds that the proposed conservation plan will implement 1

				or more site-specific recovery actions from a relevant approved recovery plan,

				so long as the contribution to recovery is at least proportional to the

				potential for and degree of incidental take that may reasonably be expected to

				occur under the plan, the application relating to, and issuance of a permit

				for, the plan shall be considered to be exempt from—</text>

									<subclause id="id9D881FAA2B4047528A23AAAFC05011AB"><enum>(I)</enum><text>section 7;

				and</text>

									</subclause><subclause id="idEC79971363C44DD487C98F5EA022B823"><enum>(II)</enum><text>the National

				Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text>

									</subclause></clause><clause id="id5852038278414E48B7AAC4E6EEFE5E77"><enum>(iii)</enum><header>Effect of

				paragraph</header><text>This paragraph does not limit the authority of the

				Secretary to require greater than acre-for-acre mitigation when necessary to

				address the extent of the impacts.</text>

								</clause></subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph id="id472CE85F0D88422FAE274709C948F8E7"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

					<quoted-block display-inline="no-display-inline" id="id65CB1BA08A46462380554AD508980C50" style="traditional">

						<paragraph id="ID47db0120b151497082b8acb2635fb32c"><enum>(3)</enum><header>Qualification

				for provisional permit</header>

							<subparagraph id="idEB2E3BD4F8F445C7889AF80718AC28DD"><enum>(A)</enum><header>In

				general</header><text>An applicant shall qualify for a provisional permit with

				respect to an application and the related conservation plan if, as of the date

				on which the applicant submits the application and the related conservation

				plan to the Secretary under this subsection—</text>

								<clause id="idB049B6E072864B02B600981FDC94F3A3"><enum>(i)</enum><text>the applicant

				voluntarily implements the terms of the proposed application under paragraph

				(2) during the pendency of review; and</text>

								</clause><clause id="idA0B0C11B3B36447CB18EACFEC6A2AB54"><enum>(ii)</enum><text>the applicant

				has completed a field survey to determine the area occupied by the

				species.</text>

								</clause></subparagraph><subparagraph id="idB90D9A60721C409D9C6D72FC73AE1869"><enum>(B)</enum><header>Effect of

				permit</header><text>A provisional permit under subparagraph (A) shall—</text>

								<clause id="idAC5C185D13F4484ABA647B8E95A70D6F"><enum>(i)</enum><text>authorize

				existing activities (except an activity that requires ground clearing) relating

				to the relevant land; and</text>

								</clause><clause id="id889A4CD76DB24E7FB9202CA9B164E89F"><enum>(ii)</enum><text>remain in effect

				until the date on which a permit is issued under this subsection.</text>

								</clause></subparagraph><subparagraph id="idA587114580564DB884802DACD631E22F"><enum>(C)</enum><header>Admissibility

				of information</header><text>Information submitted by an applicant in an

				application under this paragraph shall not be admissible in any action relating

				to a prohibited act under section 9.</text>

							</subparagraph></paragraph><paragraph id="ID6b8b531fad55484589275e2ea292818e"><enum>(4)</enum><header>Agricultural

				agreements</header><text>If a landowner enters into an agreement under title

				XII of the Food and Security Act of 1985 (16 U.S.C. 3831 et. seq.) and the

				conservation activities of the landowner include 1 or more site-specific

				recovery actions from an approved recovery plan resulting in a net conservation

				benefit for a listed species, the Secretary shall permit the incidental take of

				that species—</text>

							<subparagraph id="ID4783483e18084b048de204ea5841fb8f"><enum>(A)</enum><text>for the duration

				of the agreement; and</text>

							</subparagraph><subparagraph id="id5BBB93D5497C4695B3C4DF1768F7E9CC"><enum>(B)</enum><text>within the area

				in which the net conservation benefits will accrue, so long as the contribution

				to recovery is at least proportional to the potential for and degree of

				incidental taking that may reasonably be expected to occur in the

				agreement.</text>

							</subparagraph></paragraph><paragraph id="idF7D59A2AA8FF40EE978842921D0D01B9"><enum>(5)</enum><header>Liability while

				performing recovery actions</header><text>The Secretary shall permit the

				incidental take of a species that—</text>

							<subparagraph id="id7AD0BEB4F29B4B329C2E13CDF174ED33"><enum>(A)</enum><text>occurs or may

				occur as a result of the landowner implementing a site-specific recovery action

				of an approved recovery plan in a manner that contributes to the conservation

				of the species; and</text>

							</subparagraph><subparagraph id="id9FF14A05B8AB47848AD36D3E456F2ADE"><enum>(B)</enum><text>occurs or may

				occur within the area in which the net conservation benefits will accrue, so

				long as the contribution to recovery is at least proportional to the potential

				for and degree of incidental taking that may reasonably be expected to

				occur.</text>

							</subparagraph></paragraph><paragraph id="ID6a6974783d6349c79a454b26c015ce01"><enum>(6)</enum><header>Requirements

				applicable upon compliance with permit</header>

							<subparagraph id="idF9754A1EC0AD4BE1B637DAB1E43B5A3D"><enum>(A)</enum><header>In

				general</header><text>Except as otherwise provided in this paragraph, if the

				holder of a permit under this subsection for any purpose other than a

				scientific purpose is in compliance with the terms and conditions of the permit

				(including any conservation plan or agreement incorporated by reference in the

				permit), as determined by the Secretary, the Secretary shall not require the

				holder to adopt any minimization, mitigation, or other measure with respect to

				any species that the Secretary determines to be adequately covered by the

				permit during the term of the permit without the consent of the holder.</text>

							</subparagraph><subparagraph id="id77BF9C2870694722A4B835D55B0ABD1B"><enum>(B)</enum><header>Identified

				change of circumstance</header><text>If a change of circumstance that is

				identified in the permit occurs, as determined by the Secretary, the Secretary

				may require the holder to carry out only such additional minimization,

				mitigation, or other measures as are provided under the permit with respect to

				the circumstance.</text>

							</subparagraph><subparagraph id="id07B56665758C4E729157FDAD19E67B43"><enum>(C)</enum><header>Unidentified

				change of circumstance</header><text>If a change of circumstance that is not

				identified in the permit occurs, the Secretary may require the holder to carry

				out only additional minimization, mitigation, and other measures that do not

				involve—</text>

								<clause id="id1CAC5754B4654172BCEBF972D975ED55"><enum>(i)</enum><text>the commitment of

				any additional uncommitted land, water, or financial compensation; or</text>

								</clause><clause id="idB69598972F1F4B8F82B003272DC191AA"><enum>(ii)</enum><text>the imposition

				of additional restrictions on the use of any land, water, or other natural

				resource that is otherwise available for development or use under the original

				terms and conditions of the permit.</text>

								</clause></subparagraph><subparagraph id="id294DCB0263374BE18BE5730CE030DCF6"><enum>(D)</enum><header>Burden of

				proof</header><text>The Secretary shall have the burden of proof in

				demonstrating and documenting, using the best scientific and commercial data

				available, the occurrence of any changed circumstances for the purpose of this

				paragraph.</text>

							</subparagraph><subparagraph id="id95CD65F7B6C34C88A3F1478869907D8D"><enum>(E)</enum><header>Assurances</header>

								<clause id="id714A2067652645479CD265B03130AD6A"><enum>(i)</enum><header>Recent

				permits</header><text>All permits issued under this subsection on or after the

				date of enactment of this paragraph, other than permits issued for scientific

				purposes, shall contain assurances regarding requirements specified in

				subparagraphs (B) through (D) of this paragraph and subparagraphs (A) and (B)

				of paragraph (5).</text>

								</clause><clause id="id09DA68174D73414EA933CE1815B6C225"><enum>(ii)</enum><header>Older

				permits</header><text>All permits issued under this subsection on or after

				March 25, 1998, and before the date of enactment of this paragraph, other than

				permits issued for scientific purposes, shall be governed by the applicable

				portions of subsections (b) through (d) of section 17.22, and subsections (b)

				through (d) of section 17.32, of title 50, Code of Federal Regulations (as in

				effect as of the date of enactment of this paragraph).</text>

								</clause></subparagraph></paragraph><paragraph id="IDae467489d17a456bbfb515de44c6a603"><enum>(7)</enum><header>Revocation of

				permit</header>

							<subparagraph id="idAB72ECCD6E6540CF846D0D92DE758BAA"><enum>(A)</enum><header>In

				general</header><text>The Secretary shall revoke a permit issued under this

				subsection if the Secretary determines that the holder of the permit is not in

				compliance with the terms and conditions of the permit.</text>

							</subparagraph><subparagraph id="id509527B5F40942A4AF9BDD63DF1C6A97"><enum>(B)</enum><header>Revocation of

				permit that includes conservation plan</header><text>The Secretary may revoke a

				permit that includes a conservation plan described in this subsection due to a

				change in circumstances only if the Secretary—</text>

								<clause id="IDfc4b90e73b084f3f83ac0eabfb9d324e"><enum>(i)</enum><text>determines that

				continuing the activities under the permit would be inconsistent with paragraph

				(2);</text>

								</clause><clause id="IDb141262ca65244adaa67483442b08369"><enum>(ii)</enum><text>not later than

				60 days before the date on which the Secretary revokes the permit, provides a

				notice of revocation to the holder of the permit; and</text>

								</clause><clause id="ID5831e5105cea470195ce424a6181d1bb"><enum>(iii)</enum><text>is unable to

				otherwise remedy the inconsistency.</text>

								</clause></subparagraph></paragraph><paragraph id="IDe532374d2e494837a8986114bf405b04"><enum>(8)</enum><header>Statements and

				assessments</header>

							<subparagraph id="id8C3F7DE5FB2045E0890C47DAC0C06F9F"><enum>(A)</enum><header>In

				general</header><text>In preparing any environmental impact statement or

				environmental assessment under section 102 of the National Environmental Policy

				Act of 1969 (42 U.S.C. 4332) with respect to the application for, or issuance

				of, a permit under this subsection, the Secretary shall not identify or analyze

				the impacts and potential minimization and mitigation measures relating to any

				alternative other than—</text>

								<clause id="id70028E44420645F99AED70A093AA15BD"><enum>(i)</enum><text>the alternative

				presented by the permit applicant under the conservation plan or another

				document; and</text>

								</clause><clause id="idDEC5959FD4F6477ABBE0807DA4411214"><enum>(ii)</enum><text>an alternative

				requiring no action by the Secretary.</text>

								</clause></subparagraph><subparagraph id="idB13CD4799C2F454FB808E8B56448C467"><enum>(B)</enum><header>Regulations</header><text>The

				Secretary shall promulgate regulations under which the Secretary, subject to

				the availability of appropriations, shall reimburse a permit applicant under

				this subsection for reasonable amounts paid by the person for preparation by a

				contractor, or another person selected by the Secretary, of an environmental

				impact statement, environmental assessment, or related documentation or study

				required under section 102 of the National Environmental Policy Act of 1969 (42

				U.S.C. 4332) with respect to the application for, or issuance of, the

				permit.</text>

							</subparagraph></paragraph><paragraph commented="no" id="IDb6032c64f8bf43e2adf1b2a88d928d95"><enum>(9)</enum><header>Publication of

				notice of decision</header><text>Not later than 15 days before the proposed

				effective date of a permit, the Secretary shall publish in the Federal Register

				a notice of any decision of the Secretary to approve or disapprove an

				application for, or amendment to, a permit under this

				section.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section id="idC45C4F67CDC44FB092B2D62B92F29AF7"><enum>304.</enum><header>Technical

			 corrections</header><text display-inline="no-display-inline">Section 4(f)(1) of

			 the Endangered Species Act of 1978 (16 U.S.C. 1533(f)(1)) is amended—</text>

				<paragraph id="idB172A9968A0749878CC6AD8A5D3069D3"><enum>(1)</enum><text>in the matter

			 preceding subparagraph (A), by striking <quote>in development</quote> and

			 inserting <quote>in developing</quote>; and</text>

				</paragraph><paragraph id="id6C8183E18D21448A89D4BEEF224BB679"><enum>(2)</enum><text>in subparagraph

			 (A), by striking <quote>activity;</quote> and inserting <quote>activity;

			 and</quote>.</text>

				</paragraph></section><section id="id2810D157D6EC4CC2BDE1A16E2DE46400"><enum>305.</enum><header>Tax

			 incentives</header>

				<subsection id="id4B335F32095E4373899EF686EA8DAF04"><enum>(a)</enum><header>Deduction for

			 cost of conservation and recovery bank credit</header>

					<paragraph id="id23047885049D4724BEB96F0B784C6302"><enum>(1)</enum><header>In

			 general</header><text>Part VI of subchapter B of chapter 1 of the Internal

			 Revenue Code of 1986 (relating to itemized deductions for individuals and

			 corporations) is amended by adding at the end the following new section:</text>

						<quoted-block display-inline="no-display-inline" id="id84DF2687A9B24DF7A176A54EB3AD0962" style="OLC">

							<section id="id9875ABD79CD343E09E8BA12C4EE9D8CB"><enum>200.</enum><header>Conservation

				bank credits</header><text display-inline="no-display-inline">There shall be

				allowed as a deduction an amount equal to the cost of any credit purchased from

				a conservation bank approved under section 4A of the Endangered Species Act of

				1973 in the taxable year in which such credit is

				purchased.</text>

							</section><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph><paragraph id="idD3C74FB8A9AB4B8787009B94E1EF5D3E"><enum>(2)</enum><header>Clerical

			 amendment</header><text>The table of sections for such part VI is amended by

			 adding at the end the following new item:</text>

			 costs incurred for conversation activities related to endangered, threatened,

			 and candidate species</header>

					<paragraph id="HDAEB1E5B0D474C88974E00AB005CAAAE"><enum>(1)</enum><header>In

			 general</header><text>Subpart B of part IV of subchapter A of chapter 1 of the

			 Internal Revenue Code of 1986 (relating to other credits) is amended by adding

			 at the end the following new section:</text>

				costs incurred for conversation and recovery activities related to endangered,

				threatened, and candidate species</header>

								<subsection id="H79D8093502DE43338405AF236BCEDEFC"><enum>(a)</enum><header>Allowance of

				credit</header><text>There shall be allowed as a credit against the tax imposed

				by this chapter for the taxable year an amount equal to the qualified

				conservation and recovery costs of an eligible taxpayer for the taxable

				year.</text>

								</subsection><subsection id="HDE97EB237D6644A6A8D54B3792866F4D"><enum>(b)</enum><header>Limitation based

				on amount of tax</header><text display-inline="yes-display-inline">The credit

				allowed under subsection (a) for the taxable year shall not exceed the excess

				of—</text>

									<paragraph id="HF379549A80964AE5AB24EBE84057B348"><enum>(1)</enum><text>the sum of the

				regular tax liability (as defined in section 26(b)) plus the tax imposed by

				section 55, over</text>

									</paragraph><paragraph id="HFA85456A43D14AF59B06D52DB2983819"><enum>(2)</enum><text>the sum of the

				credits allowable under subpart A and sections 27, 30A, 30B, and 30C for the

				taxable year.</text>

									</paragraph></subsection><subsection id="HAFDA39AE10BC402D9C1CFA2827B8CE00"><enum>(c)</enum><header>Qualified

				conservation and recovery costs</header><text display-inline="yes-display-inline">For purposes of this section, the term

				<term>qualified conservation and recovery costs</term> means costs paid or

				incurred by the eligible taxpayer in carrying out approved site-specific

				recovery actions under section 4(f) of the Endangered Species Act (16 U.S.C.

				1533(f)), or any other Federal- or State-approved conservation and recovery

				agreements involving an endangered, threatened, or candidate species under the

				Endangered Species Act (16 U.S.C. 1531 et seq.) in an amount equal to—</text>

									<paragraph id="ID5909539cbfa847c09b29b36a961c11a2"><enum>(1)</enum><text>under a binding

				agreement for not less than 99 years, the sum of—</text>

										<subparagraph id="id846047E545904C8DB47523C1A3647FB9"><enum>(A)</enum><text>the amount by

				which the fair market value of the land is reduced by such site-specific

				recovery actions or agreements, and</text>

										</subparagraph><subparagraph id="idA3E8FD78D40D45E8A7313FCB51935F48"><enum>(B)</enum><text>the actual costs

				to the property owner of such approved site-specific recovery actions or

				agreements,</text>

										</subparagraph></paragraph><paragraph id="ID73d4d1a060cb40acb144b3db4e9a0c12"><enum>(2)</enum><text>under a binding

				agreement for not less than 30 years but less than 99 years, the sum of—</text>

										<subparagraph id="idDE4AF580FCE04E749A8D23593F299F6A"><enum>(A)</enum><text>75 percent of the

				amount described in paragraph (1)(A), and</text>

										</subparagraph><subparagraph id="idEAB9F0E2B79C4E8191E09EA125F26800"><enum>(B)</enum><text>75 percent of the

				actual costs of such approved site-specific recovery actions or agreements,

				and</text>

										</subparagraph></paragraph><paragraph id="ID01c9acf1df924c07ba46a258cf426437"><enum>(3)</enum><text>under a binding

				agreement for not less than 10 years but less than 30 years, 75 percent of the

				actual costs of such approved site-specific recovery actions or

				agreements.</text>

									</paragraph></subsection><subsection id="ID43173609cf134c1e9109e5555f0e9239"><enum>(d)</enum><header>Eligible

				taxpayer</header><text>For purposes of this section—</text>

									<paragraph id="idC1623A7E15004143BA036DED88CA5A8C"><enum>(1)</enum><header>In

				general</header><text>The term <term>eligible taxpayer</term> means any person

				who submits to the Secretary, together with the return of the taxpayer for the

				taxable year—</text>

										<subparagraph id="id7CB2DBA43A0A4F3FAFAAAD5CAF4F34B2"><enum>(A)</enum><text>evidence of the

				binding agreement described in subsection (c), and</text>

										</subparagraph><subparagraph id="idF2872D11F2134AA496876D83845A1BEB"><enum>(B)</enum><text>a written

				verification from a biologist not directly employed by the taxpayer that any

				conservation and recovery practice for which the taxpayer seeks a credit under

				this section—</text>

											<clause id="idD12D697590A943A1BCA8365A99BEE690"><enum>(i)</enum><text>is described in a

				Federal- or State-approved agreement in subsection (c), and</text>

											</clause><clause id="id2B1D15D12D7D452388A70A8776010B73"><enum>(ii)</enum><text>was carried

				out—</text>

												<subclause id="id66ACEBB322094E49BD6F36FFAB75B875"><enum>(I)</enum><text>during the

				taxable year, and</text>

												</subclause><subclause id="idACF8F730F723451E81E0A3AE1912A43D"><enum>(II)</enum><text>in accordance

				with the schedule of the Federal- or State-approved agreement in subsection

				(c).</text>

												</subclause></clause></subparagraph></paragraph><paragraph id="ID71c09fd8ac504f3fa3860fedc3235f4c"><enum>(2)</enum><header>Effect of

				governmental assistance on eligibility</header><text>Such term shall not

				include any taxpayer who receives any cost share assistance from the Federal

				Government or a State government under any approved site-specific recovery

				action or agreement described in subsection (c) for the taxable year, unless

				the adjusted gross income of the taxpayer for such taxable year does not exceed

				the amount of the adjusted gross income limitation which would apply to such

				taxpayer for such taxable year for purposes of the credit allowed under section

				32.</text>

									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA282BD3F744648549616D8E7778E6EA8"><enum>(e)</enum><header>Carryback and

				carryforward allowed</header>

									<paragraph commented="no" display-inline="no-display-inline" id="IDA50BD5978D29447D9BBDD8524F316521"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">If the credit

				allowable under subsection (a) for a taxable year exceeds the amount of the

				limitation under subsection (b) for such taxable year (in this paragraph

				referred to as the <quote>unused credit year</quote>), such excess shall be a

				credit carryback to each of the 1 taxable years preceding the unused credit

				year and a credit carryforward to each of the 20 taxable years following the

				unused credit year.</text>

									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3CFCDC6C2AFF454BB3D1B3148D2B1C0D"><enum>(2)</enum><header>Rules</header><text display-inline="yes-display-inline">Rules similar to the rules of section 39

				shall apply with respect to the credit carryback and credit carryforward under

				subparagraph (A).</text>

									</paragraph></subsection><subsection id="ID836EB6D8F17A456C92B954F13C60B159"><enum>(f)</enum><header>Credits may be

				transferred</header><text>Nothing in any law or rule of law shall be construed

				to limit the transferability of any credit allowed by this section through sale

				and repurchase agreements.</text>

								</subsection><subsection id="H73FE29E11B8440A093EC7800FB525B81"><enum>(g)</enum><header>Special

				rules</header>

									<paragraph display-inline="no-display-inline" id="H7DE2D2C0515B49F09CAE003C645B8CD4"><enum>(1)</enum><header>Basis

				reduction</header><text display-inline="yes-display-inline">The basis of any

				property for which a credit is allowable under subsection (a) shall be reduced

				by the amount of such credit (determined without regard to subsection

				(b)).</text>

									</paragraph><paragraph id="H6AF63212E0AC445EBD1E1B9B75C17E24"><enum>(2)</enum><header>No double

				benefit</header><text display-inline="yes-display-inline">The amount of any

				deduction or credit allowable under this chapter (other than the credit

				allowable under subsection (a)), shall be reduced by the amount of credit

				allowed under subsection (a) (determined without regard to subsection (b)(2))

				for the taxable year.</text>

									</paragraph><paragraph id="H677491D9EFB74D990027366F00ECD615"><enum>(3)</enum><header>Reduction for

				assistance</header><text display-inline="yes-display-inline">The amount taken

				into account under subsection (a) with respect to any project shall be reduced

				by the amount of any Federal, State, or local grant or other assistance

				received by the taxpayer during such taxable year or any prior taxable year

				which was used for qualified conservation and recovery costs and which was not

				included in the gross income of such taxpayer.</text>

									</paragraph></subsection><subsection id="idECACDB229A2449528A238F8B8D292BCE"><enum>(h)</enum><header>Recapture</header><text display-inline="yes-display-inline">The Secretary shall, by regulations,

				provide for the recapture of any credit allowable under subsection (a) if the

				taxpayer breaches or terminates the agreement described in subsection

				(c).</text>

								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph><paragraph id="H321D8CECAB224225B219227C528DCB30"><enum>(2)</enum><header>Basis

			 adjustment</header><text>Section 1016(a) of such Code is amended by striking

			 <quote>and</quote> at the end of paragraph (36), by striking the period at the

			 end of paragraph (37) and inserting <quote>, and</quote>, and by adding at the

			 end the following new paragraph:</text>

			 Measures in Forests</header>

			<section id="idE5B5AB6F232E4C59A90C3E5F7F35468E"><enum>401.</enum><header>Protections

			 and measures</header><text display-inline="no-display-inline">Section 506(a) of

			 the Healthy Forests Restoration Act of 2003 (16 U.S.C. 6576(a)) is

			 amended—</text>

				<paragraph id="id051BAF48A7D24F69A28E0D2399F6A0F2"><enum>(1)</enum><text>by striking

			 <quote>and protection under—</quote> and inserting <quote>and protection as

			 follows:</quote>; and</text>

				</paragraph><paragraph id="idEBC48C0464AE46F690AF15C336F8FDAE"><enum>(2)</enum><text>by striking

			 paragraphs (1) and (2) and inserting the following:</text>

					<quoted-block display-inline="no-display-inline" id="id2064E0EDCC0947C395A715109A84D8FB" style="OLC">

						<paragraph id="ID0e4db699c2fd4c65ba9ca2cebf469982"><enum>(1)</enum><header>Conservation

				activities that include a site-specific recovery action</header><text>In the

				case of a landowner that enrolls in the program and the restoration plan of

				which includes 1 or more site-specific recovery actions from a recovery plan

				approved under section 4(f) of the Endangered Species Act of 1973 (16 U.S.C.

				1533(f)), the landowner shall not be liable under section 9 of that Act (16

				U.S.C. 1538) for the incidental take of species covered by the restoration

				plan—</text>

							<subparagraph id="id78EEC481945742AD822CEEFE314CF059"><enum>(A)</enum><text>for the duration

				of the agreement; and</text>

							</subparagraph><subparagraph id="idEC848756176A42F8AAD53AB023328D9D"><enum>(B)</enum><text>within the area

				in which the net conservation benefits will accrue, so long as the contribution

				to recovery is at least proportional to the potential for and degree of

				incidental taking that may reasonably be expected to occur in the restoration

				plan.</text>

							</subparagraph></paragraph><paragraph id="ID63052daed0124643afb6568f29aeca16"><enum>(2)</enum><header>Conservation

				activities that do not include a site-specific recovery action</header><text>In

				the case of a landowner the conservation activities of which do not include a

				site-specific recovery action from a recovery plan approved under section 4(f)

				of the Endangered Species Act of 1973 (16 U.S.C. 1533(f)), the Secretary of

				Agriculture shall make available to the landowner safe harbor or similar

				assurances and protections under—</text>

							<subparagraph id="idB3A79F8358FA47AD93D11180C7C3FFF3"><enum>(A)</enum><text>section 7(b)(4)

				of the Endangered Species Act of 1973 (16 U.S.C. 1536(b)(4)); or</text>

							</subparagraph><subparagraph id="id8187A869D168457A8F02272D1836D05E"><enum>(B)</enum><text>section 10 (a)(1)

				of that Act (16 U.S.C.

				1539(a)(1)).</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
