		<official-title>To ensure general aviation aircraft access to Federal

		  land and to the airspace over Federal land.</official-title>

	<legis-body>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Backcountry Landing Strip Access

			 Act</short-title></quote>.</text>

		</section><section id="ID457d3a6e3c504a2d97e208fa9a76d61e"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>

			<paragraph id="IDbf4f8ddabb9040c4889ab95cc1ff3a5f"><enum>(1)</enum><text>aircraft landing

			 strips—</text>

				<subparagraph id="id20DB6292660044B7929DDEFB191B7DE8"><enum>(A)</enum><text>serve an

			 essential safety role as emergency landing areas;</text>

				</subparagraph><subparagraph id="IDe18b47fac346413db14c3f7e06bba3d0"><enum>(B)</enum><text>provide access to

			 people who would otherwise be physically unable to enjoy national parks,

			 national forests, wilderness areas, and other Federal land;</text>

				</subparagraph><subparagraph id="IDfbba33e777dc4e13a2d6e25e4bd606d6"><enum>(C)</enum><text>support State

			 economies by providing efficient access for visitors seeking recreational

			 activities; and</text>

				</subparagraph><subparagraph id="ID7350808bf1a9445cbbe0da014b2cbb56"><enum>(D)</enum><text>serve an

			 essential role in search and rescue, forest and ecological management,

			 research, wildlife management, aerial mapping, firefighting, and disaster

			 relief; and</text>

				</subparagraph></paragraph><paragraph id="ID0393549d89ef4f4fb4b0adfdc5465393"><enum>(2)</enum><text>the Secretary of

			 the Interior and the Secretary of Agriculture should—</text>

				<subparagraph id="idE67BC9F6A18343AEAB7BEF5C7F8C19F7"><enum>(A)</enum><text>adopt a

			 nationwide policy for governing backcountry aviation issues relating to the

			 management of Federal land under the jurisdiction of the Secretaries;

			 and</text>

				</subparagraph><subparagraph id="idA16F1C44D4AB44AEBDA2AB29EFFC96ED"><enum>(B)</enum><text>require regional

			 managers to comply with the policy adopted under subparagraph (A).</text>

				</subparagraph></paragraph></section><section id="id4ADF148B9BA1475EAF52FA9DCD4E5D46"><enum>3.</enum><header>Definitions</header>

			<subsection id="idCB9E969C948144DB81DB6CDFA3000AEA"><enum></enum><text>In this

			 Act:</text>

				<paragraph id="idEC801D2AC46748B99966D33910DCD7F8"><enum>(1)</enum><header>Administrator</header><text>The

			 term <quote>Administrator</quote> means the Administrator of the Federal

			 Aviation Administration.</text>

				</paragraph><paragraph id="id8519797F4C704A4FA53AD009213D6473"><enum>(2)</enum><header>Aircraft

			 landing strip</header><text>The term <quote>aircraft landing strip</quote>

			 means an established aircraft landing strip located on Federal land under the

			 administrative jurisdiction of the Secretary that is commonly known, and has

			 been or is consistently used, for aircraft landing and departure

			 activities.</text>

				</paragraph><paragraph id="id947A089B3D6047D9B50D07C98D768558"><enum>(3)</enum><header>Permanently

			 close</header><text>The term <term>permanently close</term> means any closure,

			 the duration of which is more than 90 days in any calendar year.</text>

				</paragraph><paragraph id="idA59865B5FA46497F9E60230CF6E91685"><enum>(4)</enum><header>Secretary</header><text>The

			 term <quote>Secretary</quote> means—</text>

					<subparagraph id="id95AD5706841B4742880B0158B622BDA1"><enum>(A)</enum><text>with respect to

			 land under the jurisdiction of the Secretary of the Interior, the Secretary of

			 the Interior; and</text>

					</subparagraph><subparagraph id="id36E361593BDB4CC3A9A48E61C00D7ED6"><enum>(B)</enum><text>with respect to

			 land under the jurisdiction of the Secretary of Agriculture, the Secretary of

			 Agriculture.</text>

					</subparagraph></paragraph></subsection></section><section id="IDb724c5f583bf4aa8be9c8590ac6f4132"><enum>4.</enum><header>Procedure for

			 consideration of actions affecting certain aircraft landing strips</header>

			<subsection id="ID4c4aec81942140e3911d24c3304e097e"><enum>(a)</enum><header>In

			 general</header><text>The Secretary shall not take any action that would

			 permanently close, restrict, or render or declare as unserviceable any aircraft

			 landing strip unless—</text>

				<paragraph id="ID4e96fb3ea2b4472c94b6616c4ea5c810"><enum>(1)</enum><text>the head of the

			 aviation department of each State in which the aircraft landing strip is

			 located approves the action;</text>

				</paragraph><paragraph id="ID460c7565d64c43bfafa9cb75d12d55c4"><enum>(2)</enum><text>the Secretary

			 publishes in the Federal Register notice of the proposed action, including

			 notice that the action would permanently close, restrict, or render or declare

			 as unserviceable the aircraft landing strip;</text>

				</paragraph><paragraph id="ID1ea477b269ba4d35a9b7cfab2bbc0c78"><enum>(3)</enum><text>the Secretary

			 provides for a 90-day public comment period beginning on the date of

			 publication of the notice under paragraph (2); and</text>

				</paragraph><paragraph id="ID1087c070a22a4d04877d0a1c4b9e833c"><enum>(4)</enum><text>the Secretary and

			 the head of the aviation department of each State in which the affected

			 aircraft landing strip is located have taken into consideration any comments

			 received during the comment period under paragraph (3).</text>

				</paragraph></subsection><subsection id="IDc2fbefbd68de4d9384d218856ada3a03"><enum>(b)</enum><header>Policies</header>

				<paragraph id="id0E037B845B624A2AA2DACD4AD054D557"><enum>(1)</enum><header>Backcountry

			 aviation policies</header><text>Not later than 2 years after the date of

			 enactment of this Act, the Secretaries shall—</text>

					<subparagraph id="ID7ccf6e7709f34441944d0ec594e5a4a7"><enum>(A)</enum><text>adopt a

			 nationwide policy for governing backcountry aviation issues relating to the

			 management of Federal land under the jurisdiction of the Secretaries;

			 and</text>

					</subparagraph><subparagraph id="ID104e65c989344f5ea199ac395882b269"><enum>(B)</enum><text>require regional

			 managers to adhere to the policy adopted under subparagraph (A).</text>

					</subparagraph></paragraph><paragraph id="IDcd8f1a43eea74ac3a52c7feb5c595ccb"><enum>(2)</enum><header>Requirements</header><text>Any

			 policy affecting air access to an aircraft landing strip, including the policy

			 adopted under paragraph (1), shall not take effect unless the policy—</text>

					<subparagraph id="ID1dfa1ab047dd4f559d0617e20192b97c"><enum>(A)</enum><text>states that the

			 Administrator has the sole authority to control aviation and airspace over the

			 United States; and</text>

					</subparagraph><subparagraph id="ID70890058b54f467c8b6a0444abdcd7d1"><enum>(B)</enum><text>seeks and

			 considers comments from State governments and the public.</text>

					</subparagraph></paragraph></subsection><subsection id="ID810bad516771495f9b43903fb80c5522"><enum>(c)</enum><header>Maintenance of

			 airstrips</header>

				<paragraph id="ID231f1553c34246a599a92a72aaf4e2ce"><enum>(1)</enum><header>In

			 general</header><text>To ensure that aircraft landing strips are maintained in

			 a manner that is consistent with the resource values of any adjacent area, the

			 Secretary shall consult with—</text>

					<subparagraph id="ID6db80ee57c344f529defff44b2c38f09"><enum>(A)</enum><text>the head of the

			 aviation department of each State in which an aircraft landing strip is

			 located; and</text>

					</subparagraph><subparagraph id="ID95abc58519814626bb904a65821bb769"><enum>(B)</enum><text>any other

			 interested parties.</text>

					</subparagraph></paragraph><paragraph id="ID0b06686c8f2b4e2cb73331acb54cd7b8"><enum>(2)</enum><header>Cooperative

			 agreements</header><text>The Secretary may enter into cooperative agreements

			 with interested parties for the maintenance of aircraft landing strips.</text>

				</paragraph></subsection><subsection id="IDca6e028e747d49cfa39cade7f9324d6f"><enum>(d)</enum><header>Exchanges or

			 acquisitions</header><text>There shall not be as a condition of any Federal

			 acquisition of, or exchange involving, private property on which a landing

			 strip is located—</text>

				<paragraph id="id0CFBB111BC5F4437A4D5CE3849A35E0F"><enum>(1)</enum><text>the closure or

			 purposeful neglect of the landing strip; or</text>

				</paragraph><paragraph id="id9125EC4E7A124AFBBD124FC4AD446443"><enum>(2)</enum><text>any other action

			 that would restrict use or render any landing strip unserviceable.</text>

				</paragraph></subsection><subsection id="ID208237d0ef3c40d992bc10e8c7e04119"><enum>(e)</enum><header>Applicability</header><text>Subsections

			 (a), (b)(2), and (d) shall apply to any action, policy, exchange, or

			 acquisition, respectively, that is not final on the date of enactment of this

			 Act.</text>

			</subsection><subsection id="ID2a4ef7c6efe04d8e890dd015416076ad"><enum>(f)</enum><header>Effect on

			 federal aviation administration authority</header><text>Nothing in this Act

			 affects the authority of the Administrator over aviation or airspace.</text>

			</subsection></section></legis-body>
