		<official-title>To assist low-income families, displaced from their

		  residences in the States of Alabama, Louisiana, and Mississippi as a result of

		  Hurricane Katrina, by establishing within the Department of Housing and Urban

		  Development a homesteading initiative that offers displaced low-income families

		  the opportunity to purchase a home owned by the Federal Government, and for

		  other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Hurricane Katrina Recovery

			 Homesteading Act of 2005</short-title></quote>.</text>

		</section><section id="ID66412557eb5c4253a326af6cf88b40ec"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>

			<paragraph id="IDd700baf951ff439fb4a0556b09268362"><enum>(1)</enum><text>to allow

			 low-income families who were displaced from their residences in a designated

			 disaster area as a result of Hurricane Katrina to return to their States,

			 areas, or communities by providing homeownership opportunities;</text>

			</paragraph><paragraph id="IDba120c3559004e45b936d2f2673d6891"><enum>(2)</enum><text>to assist in the

			 rebuilding of neighborhoods in Alabama, Louisiana, and Mississippi that were

			 damaged by Hurricane Katrina, through strategies that promote homeownership

			 opportunities;</text>

			</paragraph><paragraph id="IDdf64bb64c79a4aeca2f9457a9d5383e1"><enum>(3)</enum><text>to maximize the

			 use of existing Federal resources to assist State and local governments in

			 providing homesteading and other homeownership opportunities in a designated

			 disaster area; and</text>

			</paragraph><paragraph id="ID98710a6594674ced8c35fe5ae53b63c4"><enum>(4)</enum><text>to promote the

			 cooperation at all levels of government and the private sector, including

			 nonprofit organizations, in providing homesteading opportunities and other

			 homeownership opportunities that will facilitate the rebuilding of

			 neighborhoods in a designated disaster area.</text>

			</paragraph></section><section id="ID9126965a44bf4f178498551dff3962d9"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act, the following

			 definitions shall apply:</text>

			<paragraph id="ID42a40b5a11c04908a262232dd68740cf"><enum>(1)</enum><header>Designated

			 disaster areas</header><text>The term <term>designated disaster area</term>

			 means any area in the States of Alabama, Louisiana, and Mississippi that is the

			 subject of a disaster declaration by the President under title IV of the Robert

			 T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et

			 seq.) in response to Hurricane Katrina.</text>

			</paragraph><paragraph id="ID859244bd5a1b4c6a93cc74441326d991"><enum>(2)</enum><header>Family</header><text>The

			 term <term>family</term> includes a family, as such term is defined in section

			 3 of the United States Housing Act of 1937 (42 U.S.C. 1437a), of 1 or more

			 persons.</text>

			</paragraph><paragraph id="IDab44e3f42a224aa89064b6abb45ae32e"><enum>(3)</enum><header>Low-income

			 family</header><text>The term <term>low-income family</term> means a family

			 whose income does not exceed 80 percent of the median income for the area, as

			 determined by the Secretary, with adjustments for family size, except that the

			 Secretary may establish an income ceiling higher or lower than 80 percent of

			 the median for the area if the Secretary finds that such a variation is

			 necessary because of prevailing levels of construction costs or unusually high

			 or low family incomes.</text>

			</paragraph><paragraph id="IDae0626e1297343b6bbb6f6f6ed54ff1b"><enum>(4)</enum><header>Participating

			 Federal agency</header><text>The term <term>participating Federal agency</term>

			 means a Federal agency the head of which is referenced by title in section

			 4(b), and any other Federal agency that transfers or conveys property for the

			 purposes of section 4.</text>

			</paragraph><paragraph id="IDb80ac6a64bac449b879d319302629b9f"><enum>(5)</enum><header>Responsible

			 administering entity</header><text>The term <term>responsible administering

			 entity</term> means a unit of general local government or a State in a

			 designated disaster area, or a public agency or other entity designated by a

			 unit of general local government or a State that is charged with administering

			 a homestead program approved under section 4(d).</text>

			</paragraph><paragraph id="IDb048a35ca45e4f47b3771185ab32ab33"><enum>(6)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of Housing and Urban

			 Development, except as otherwise specified.</text>

			</paragraph></section><section id="ID10e010ad7c8d4baf8fd49641f9bfca92"><enum>4.</enum><header>Homesteading</header>

			<subsection id="id7F88CABF5C9F462B8C4F048250838B81"><enum>(a)</enum><header>Eligible

			 property</header><text display-inline="yes-display-inline">The Secretary is

			 authorized to transfer, without payment, to a responsible administering entity,

			 any real property—</text>

				<paragraph id="ID29af8271d26c4ea697405ec552e0ae7b"><enum>(1)</enum><text>which is either

			 vacant or includes either a 1, 2, 3, or 4-family residence or multifamily

			 project;</text>

				</paragraph><paragraph id="ID67b7000fdd6143b2b5712f83e84436a3"><enum>(2)</enum><text>to which the

			 Secretary holds title, including property conveyed to the Secretary by any

			 other participating Federal agency;</text>

				</paragraph><paragraph id="ID701213aa2cd94a60bea079ca50c5bb7a"><enum>(3)</enum><text>which is not

			 occupied by a person legally entitled to reside there;</text>

				</paragraph><paragraph id="IDe3d49982d27a433b9b6fcab635e81d5e"><enum>(4)</enum><text>which is

			 requested by a responsible administering entity for use in a homestead

			 program;</text>

				</paragraph><paragraph id="IDbb55d8ba7cab4f9a81df31a88d05d94b"><enum>(5)</enum><text>which is

			 not—</text>

					<subparagraph id="idFA97CEB4C4404E4D8C1A0EB0F3ECFACD"><enum>(A)</enum><text>excess or surplus

			 Federal property subject to property disposition under title V of the

			 McKinney-Vento Homeless Assistance Act (42 U.S.C. 11411 et seq.); or</text>

					</subparagraph><subparagraph id="idCDABEEA45A35470E9E504BD40DFF984F"><enum>(B)</enum><text>Federal property

			 subject to disposition under a base closure law, as defined in section

			 101(a)(17) of title 10, United States Code; and</text>

					</subparagraph></paragraph><paragraph id="ID03cba05ab75c46d5b8052ffcd6c01b89"><enum>(6)</enum><text>which the

			 Secretary determines is suitable for use in a homestead program that is

			 approved under subsection (d).</text>

				</paragraph></subsection><subsection id="ID6cbe22ddd54341e18093d20b58c7b4d9"><enum>(b)</enum><header>Acquisitions

			 and reimbursements</header>

				<paragraph id="IDc4af9ec46303416b9f19acca8dd8082c"><enum>(1)</enum><header>In

			 general</header><text>Notwithstanding any other provision of law, the Secretary

			 of Agriculture, the Secretary of Health and Human Services, the Secretary of

			 Veterans Affairs, and the head of any other participating Federal agency are

			 authorized to transfer property to the Secretary, and the Secretary is

			 authorized to accept custody and accountability of such property, to carry out

			 this Act.</text>

				</paragraph><paragraph id="IDca39c2f76dc248edbf4ed9f1e3529ca8"><enum>(2)</enum><header>Reimbursement</header>

					<subparagraph id="id0C225E0C68B3495F9236B7CF685AF4C2"><enum>(A)</enum><header>In

			 general</header><text>The Secretary is authorized to reimburse the Federal

			 Housing Administration for property—</text>

						<clause id="idA6F709E27E14446F9520DCF194E0540B"><enum>(i)</enum><text>which the

			 Secretary has acquired under the National Housing Act (12 U.S.C. 1701 et seq.)

			 in the form of modification of subsidy costs, as authorized in the Federal

			 Credit Reform Act of 1990 (2 U.S.C. 661 et seq.); and</text>

						</clause><clause id="idDBA26B8BF2D44261B0A13C1740820F1C"><enum>(ii)</enum><text>which the

			 Secretary transfers for use in connection with a local homestead program

			 approved by the Secretary under this section.</text>

						</clause></subparagraph><subparagraph id="id2BA468ED4A7045A598A35528C757D0BD"><enum>(B)</enum><header>Homestead

			 program</header><text>The Secretary is authorized to reimburse a participating

			 Federal agency in an amount to be agreed upon by the Secretary and such

			 participating Federal agency for property that such participating Federal

			 agency transferred for use in connection with a homestead program approved by

			 the Secretary under this section.</text>

					</subparagraph><subparagraph id="id41291FA4569C4AA1984D6E084F2707E9"><enum>(C)</enum><header>Deposits</header><text>Amounts

			 to be reimbursed under this paragraph shall be—</text>

						<clause id="id5954440A8CAE4039BAECB7C9A563C978"><enum>(i)</enum><text>deposited

			 pursuant to the Federal Credit Reform Act of 1990 (2 U.S.C. 661 et seq.), as

			 applicable; or</text>

						</clause><clause id="id7B97A36F233847EE9CE5C652E8CE26AE"><enum>(ii)</enum><text>made available

			 to the agency to address real property capital asset needs.</text>

						</clause></subparagraph></paragraph><paragraph id="IDcbc9e935de6f4d16aa26786620e046ef"><enum>(3)</enum><header>Donated

			 property</header><text>The Secretary is authorized to accept, manage, and

			 convey residential property donated to the Secretary by a nongovernmental

			 entity for purposes of this Act.</text>

				</paragraph><paragraph id="ID188d1a2ff07541e9b0f0b527eb37add5"><enum>(4)</enum><header>Reversal of

			 transfer or conveyance</header>

					<subparagraph id="id4EC698E8D1064E189B12007826B26A03"><enum>(A)</enum><header>In

			 general</header><text>Notwithstanding any other provision of law, any real

			 property transferred to the Secretary by a participating Federal agency for

			 purposes of this Act shall be transferred back to that participating Federal

			 agency in the event that such property is not conveyed to a responsible

			 administering entity under subsection (a).</text>

					</subparagraph><subparagraph id="id8320E106FD93428CA6E1C4C53BFF4161"><enum>(B)</enum><header>Reversions</header><text>In

			 the event of a conveyance to a responsible administering entity for purposes of

			 this Act, if such responsible administering entity does not dispose of such

			 property within 18 months of the date of such conveyance, such property and its

			 proceeds shall revert—</text>

						<clause id="id55C67AC929C04564904234D79E85A9E0"><enum>(i)</enum><text>to

			 the Secretary; or</text>

						</clause><clause id="id17C0826691CB4D238C3259347114A277"><enum>(ii)</enum><text>in

			 the case of property transferred by a participating Federal agency under

			 paragraph (1), to such participating Federal agency.</text>

						</clause></subparagraph></paragraph></subsection><subsection id="ID891b55bb645a414a9f5d892c0da88a1d"><enum>(c)</enum><header>Suitable

			 property for homestead program</header><text>In determining the suitability of

			 a residential property for use in a homestead program, the Secretary shall

			 consider—</text>

				<paragraph id="ID0600ffc9e37944ac85c859d9268f2705"><enum>(1)</enum><text>the physical

			 condition of the residential property, including whether, upon rebuilding, or

			 if repairs or improvements are required, upon completion of such repairs or

			 improvements, the property—</text>

					<subparagraph id="IDa96de1cc81994795acb2d1b03453fcfd"><enum>(A)</enum><text>would meet local

			 or applicable standards or codes for habitation or occupancy;</text>

					</subparagraph><subparagraph id="ID5a41ed0b502a42be89a7fe90701a74b4"><enum>(B)</enum><text>is likely to meet

			 all Federal requirements for flood insurance; and</text>

					</subparagraph><subparagraph id="IDdc46287325244a9fbb87a109f80039df"><enum>(C)</enum><text>will otherwise

			 not endanger the health or safety of individuals residing within or nearby the

			 residential property;</text>

					</subparagraph></paragraph><paragraph id="ID6995a14295ad47fe87a6ca47718d90d2"><enum>(2)</enum><text>the estimated

			 time for rebuilding or repairing the property for residential use;</text>

				</paragraph><paragraph id="ID0d962064932d4b9397daf23a016cefec"><enum>(3)</enum><text>the environment

			 surrounding the property and the suitability of the surrounding structures and

			 the neighborhood to be rebuilt and sustained as a viable community;</text>

				</paragraph><paragraph id="ID828e69e679ef4001b99854f016f26e99"><enum>(4)</enum><text>the value of any

			 repairs and improvements required by the program;</text>

				</paragraph><paragraph id="ID509a91e956804042a22647b61368f61a"><enum>(5)</enum><text>the benefits to

			 the community and the reduced administrative costs to the Federal Government

			 which would accrue from the expedited occupancy of the unoccupied property;

			 and</text>

				</paragraph><paragraph id="ID0f67a67e849c4ef9b1503f6163933feb"><enum>(6)</enum><text>the possible

			 financial loss to the Federal Government which may result from the transfer of

			 the property without payment.</text>

				</paragraph></subsection><subsection id="IDf3bc74868e6e4f6b99ce31304997ac15"><enum>(d)</enum><header>Approval

			 criteria</header><text>The Secretary may approve a homestead program carried

			 out by a responsible administering entity, which provides for the

			 following:</text>

				<paragraph id="ID82c71f99825e4a82aa835029a0a18c10"><enum>(1)</enum><header>Equitable

			 selection of participating families</header><text>The homestead program shall

			 provide for an equitable procedure, as prescribed by the Secretary, for

			 selecting low-income families that have been displaced from residences in a

			 designated disaster area, which procedure shall—</text>

					<subparagraph id="ID183407fae71b413fa197560b53b92e24"><enum>(A)</enum><text>give priority to

			 low-income families who were displaced from their residences in a particular

			 designated disaster area or who were displaced as homeowners in a designated

			 disaster area, or other criteria as may be prescribed by the Secretary;</text>

					</subparagraph><subparagraph id="ID858188bf60b0430b9ca61a9b91c638c3"><enum>(B)</enum><text>take into account

			 for each family described under subparagraph (A), such family's—</text>

						<clause id="id100F9680FED947C295CF2B2BEF9838CD"><enum>(i)</enum><text>capacity to

			 obtain assistance for the rebuilding, repair, or maintenance of the housing

			 from private sources, community organizations, or other sources; or</text>

						</clause><clause id="idCE425F90574F483A9C9B67C5F70C4258"><enum>(ii)</enum><text>agreement to

			 rebuild or repair the housing by participating in a self-help sweat equity

			 housing program, or the family's contribution to the surrounding community;

			 and</text>

						</clause></subparagraph><subparagraph id="ID803d8feac3a347d4a631b08b39590040"><enum>(C)</enum><text>include such

			 other criteria as the Secretary determines appropriate.</text>

					</subparagraph></paragraph><paragraph id="IDc9e170910c6d47f48c5cd58636863ccb"><enum>(2)</enum><header>Initial

			 occupancy agreement</header><text>The homestead program shall provide for the

			 initial occupancy of unoccupied residential property pursuant to a written

			 agreement whereby the family to whom such property is conveyed agrees—</text>

					<subparagraph id="ID0d21a2ef231d46c0be0ed4dbe30c4b30"><enum>(A)</enum><text>to occupy such

			 property as a principal residence for a period of not less than 5 years, or

			 such other time period as the Secretary may prescribe;</text>

					</subparagraph><subparagraph id="ID3a5f2dfff0a3497dbee7b6e9c8449261"><enum>(B)</enum><text>to repair, or

			 cause to be repaired or improved, if housing is located on such property, all

			 defects in such housing that pose a substantial danger to health and safety

			 within 1 year of the date of such initial conveyance, or within such other time

			 period as may be prescribed by the Secretary;</text>

					</subparagraph><subparagraph id="ID8fe45089ef504dbcaf0987c01bb3c38d"><enum>(C)</enum><text>to make, or cause

			 to be made, such repairs and improvements, if housing is located on such

			 property, to such housing as may be necessary to meet applicable local

			 standards for decent, safe, and sanitary housing within 3 years after the date

			 of initial occupancy, or within such other time period as may be prescribed by

			 the Secretary;</text>

					</subparagraph><subparagraph id="ID71f3daace5ef4e80adac129b5f3adbff"><enum>(D)</enum><text>to build or cause

			 to be built, if housing is not located on the property, single family housing

			 that meets applicable local codes within 3 years after the date of initial

			 occupancy, or within such other time period as may be prescribed by the

			 Secretary;</text>

					</subparagraph><subparagraph id="IDa012a3a81dff48be8622f6b8a5613980"><enum>(E)</enum><text>to permit

			 reasonable periodic inspections at reasonable times, and with notice reasonable

			 in the circumstances, for the purpose of determining compliance with the

			 agreement;</text>

					</subparagraph><subparagraph id="ID3fc770af4eb84b17892c012eb3de2033"><enum>(F)</enum><text>to the revocation

			 of such agreement upon any material breach of the agreement, subject to

			 penalties under section 5; and</text>

					</subparagraph><subparagraph id="ID91aedee3f0b8419fb1c4ce7fbc41204d"><enum>(G)</enum><text>to accept the

			 conveyance from the responsible administering entity of fee simple title to

			 such property without consideration upon compliance with the agreement.</text>

					</subparagraph></paragraph><paragraph id="ID4e75306dcf664417bf19d81d34e5f5ed"><enum>(3)</enum><header>Other criteria

			 determined by the secretary</header><text>The homestead program shall meet such

			 other criteria determined by the Secretary to be appropriate for the program in

			 light of the location in which the program is to be administered, or following

			 consultation with State and local government officials.</text>

				</paragraph></subsection><subsection id="ID285a4968fa1b40d08788157d8f6ba95a"><enum>(e)</enum><header>Technical

			 support</header><text>The Secretary is authorized to provide technical

			 assistance and other resources directly or indirectly for the administration of

			 homestead programs that meet the requirements of subsection (d) and to families

			 who are participants in such programs.</text>

			</subsection></section><section id="ID8348478179e8409285568e796bafef6c"><enum>5.</enum><header>Compliance</header>

			<subsection id="id7B4711BC1A46433AA2655C9AE3943B01"><enum>(a)</enum><header>Compliance

			 monitoring</header><text display-inline="yes-display-inline">The Secretary

			 shall make such reviews and audits as may be necessary or appropriate to

			 determine whether activities authorized to be carried out under this Act are

			 carried out in accordance with the requirements of this Act and other

			 applicable law.</text>

			</subsection><subsection id="IDc3a09faf1c7e4ead84f27ea9587cb6e8"><enum>(b)</enum><header>Compliance

			 actions</header><text>In addition to any other actions authorized by applicable

			 law, if the Secretary determines that any property transferred for use under a

			 homestead program approved under section 4 has been conveyed or used under the

			 program in a manner contrary to the provisions of section 4, the Secretary may

			 take such actions as the Secretary considers appropriate, including—</text>

				<paragraph id="ID88784a5bccbd4e488800507d9005792a"><enum>(1)</enum><text>imposing a civil

			 money penalty on the responsible administering entity, or the transferee of

			 such entity, or both, as appropriate, in an amount equal to not less than any

			 profit realized with respect to the conveyance or use of such property contrary

			 to the provisions of this Act;</text>

				</paragraph><paragraph id="ID714de781ba5a4404954a7eb0572b3006"><enum>(2)</enum><text>enforcing,

			 revising, or releasing the restrictions contained in any instruments of

			 conveyance; or</text>

				</paragraph><paragraph id="ID850f6ca7ef594bf1bc9d8cddbb294388"><enum>(3)</enum><text>revoking the

			 conveyance of the property to the responsible administering entity or requiring

			 the responsible administering entity to revoke the conveyance of such property

			 to the family in accordance with procedures prescribed by the Secretary.</text>

				</paragraph></subsection><subsection id="IDc8150b6d5ed84b1b941e0fdd4976198d"><enum>(c)</enum><header>Judicial

			 enforcement</header><text>The Attorney General of the United States, at the

			 request of the Secretary, may bring civil actions in any district court of the

			 United States to enforce this Act, and such court shall have jurisdiction over

			 such actions.</text>

			</subsection></section><section id="ID90f9fe46fcb140a5a747bb54a8079672"><enum>6.</enum><header>Nondiscrimination</header><text display-inline="no-display-inline">No person in the United States shall, on the

			 grounds of race, color, national origin, religion, disability, or sex, be

			 excluded from participation in the homestead program established under this

			 Act.</text>

		</section><section id="ID365d8fbae4484c50ab81accdcb2b67ee"><enum>7.</enum><header>Environmental

			 review</header>

			<subsection id="idD6AC57FA882848A58122A24BADA0B86B"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 subsection (b), the National Environmental Policy Act (42 U.S.C. 4321 et seq.)

			 shall apply to all activities under this Act.</text>

			</subsection><subsection id="ID4b73fb45830748fca034d8f4409a7be2"><enum>(b)</enum><header>Exceptions</header><text>The

			 Secretary may, in consultation with Federal, Tribal, State, and local

			 governmental entities, as appropriate, waive the requirements of the National

			 Environmental Policy Act (42 U.S.C. 4321 et seq.), if the Secretary determines

			 that such a waiver—</text>

				<paragraph id="ID73f00237194b43f384078c005a9f1835"><enum>(1)</enum><text>will not

			 frustrate the goals of the National Environmental Policy Act or any other

			 provision of law that furthers the goals of that Act; and</text>

				</paragraph><paragraph id="IDaf12deba157c4262a2591f18a7e4734b"><enum>(2)</enum><text>does not threaten

			 the health or safety of the community involved by posing an immediate or

			 long-term hazard to residents of that community.</text>

				</paragraph></subsection></section><section id="ID80ba2d75fc94412b9784d94dcb522d5d"><enum>8.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There is

			 authorized to be appropriated to carry out this Act a total of $300,000,000 for

			 fiscal years 2006 through 2010.</text>

		</section><section id="ID6245eb9c5a764b0686873151617ec1f5"><enum>9.</enum><header>Implementation</header>

			<subsection id="idA59991262710408193BF5EBAEB7ACF82"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">To immediately

			 implement this Act, the Secretary shall, by notice, establish such requirements

			 as may be necessary to carry out this Act.</text>

			</subsection><subsection id="id30A13EB552444359BF6AEC4BA1B3D38B"><enum>(b)</enum><header>Procedure for

			 notice</header><text display-inline="yes-display-inline">The notice required

			 under subsection (a) shall—</text>

				<paragraph id="id1811D9351F7C4E47BDC0B8D459800CF5"><enum>(1)</enum><text display-inline="yes-display-inline">take effect upon issuance; and</text>

				</paragraph><paragraph id="id11DDC58443CC49459DE68FFA25478961"><enum>(2)</enum><text display-inline="yes-display-inline">provide the opportunity for public

			 comment.</text>

				</paragraph></subsection><subsection id="id269A77A599C548E8B2D20F1A36AE8868"><enum>(c)</enum><header>Final

			 regulations</header><text display-inline="yes-display-inline">The Secretary

			 shall issue final regulations based on the notice required under subsection

			 (a).</text>

			</subsection></section><section id="IDd8a3b1805d5441fba0a0c01a05c60899"><enum>10.</enum><header>Sunset</header><text display-inline="no-display-inline">The Secretary shall not accept, transfer, or

			 convey property under this Act after 5 years from the date of enactment of this
