		<official-title>To amend title XVIII of the Social Security Act to

		  prohibit physicians and other health care practitioners from charging a

		  membership or other incidental fee (or requiring purchase of other items or

		  services) as a prerequisite for the provision of an item or service to a

		  medicare beneficiary.</official-title>

		<section id="ID92FA3FE0DDED430000DA2F00959919ED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Equal Access to Medicare Act of

			 2005</short-title></quote>.</text>

		</section><section id="IDFEF93121C43141B1817557CAECE972DD"><enum>2.</enum><header>Prohibition of

			 incidental fees and required purchase of noncovered items or services under

			 medicare</header>

			<subsection id="ID06813409CABE4FDB8D09F7214CA459F1"><enum>(a)</enum><header>In

			 general</header><text><external-xref legal-doc="act" parsable-cite="SSA/1842">Section 1842</external-xref> of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u</external-xref>)

			 is amended by adding at the end the following new subsection:</text>

					<subsection id="IDF87ABED18302494197F72407DB27E0BF"><enum>(u)</enum><header>Prohibition of

				incidental fees or requiring purchase of noncovered items or services</header>

						<paragraph id="ID6825381825E9451C9D02ED270051CBDA"><enum>(1)</enum><header>In

				general</header><text>A physician, practitioner (as described in subsection

				(b)(18)(C)), or other individual may not—</text>

							<subparagraph id="IDEA9FA666482B4491AD03FEF57C20CFF1"><enum>(A)</enum><text>charge a

				membership fee or any other incidental fee to a medicare beneficiary (as

				defined in section 1802(b)(5)(A)); or</text>

							</subparagraph><subparagraph id="IDFE6672D679B94BD5928EEE0700A49054"><enum>(B)</enum><text>require a

				medicare beneficiary (as so defined) to purchase a noncovered item or service

				as a prerequisite for the provision of a covered item or service to the

				beneficiary under this title.</text>

							</subparagraph></paragraph><paragraph id="ID811EB3C9A12D40E1B315B6418660B883"><enum>(2)</enum><header>Construction</header><text>Nothing

				in this subsection shall be construed to apply the prohibition under paragraph

				(1) to a physician, practitioner, or other individual described in such

				subsection who does not accept any funds under this

				title.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID6D8AA24D2B374202A866526B3397DE08"><enum>(b)</enum><header>Effective

			 date</header><text>The amendment made by subsection (a) shall apply to

			 membership fees and other charges made, or purchases of items and services

			 required, on or after the date of enactment of this Act.</text>
