		<official-title>To provide for the conveyance of certain public lands in

		  and around historic mining townsites in Nevada, and for other

		  purposes.</official-title>

		<section id="ID48F67683E7C642EA85BF1D5FF9E05C3A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Nevada

			 Mining Townsite Conveyance Act</quote>.</text>

		</section><section id="IDF4A3DA539BC94149BD080EADED893FEB"><enum>2.</enum><header>Disposal of

			 public lands in mining townsites, Esmeralda and Nye counties, Nevada</header>

			<subsection id="IDD9FCBB6AB45F40739674EEF6AFABC6D7"><enum>(a)</enum><header>Findings</header><text>Congress

			 finds the following:</text>

				<paragraph id="ID06C856684C6B4171A60D8F962F17D85D"><enum>(1)</enum><text>The Federal

			 Government owns real property in and around historic mining townsites in the

			 counties of Esmeralda and Nye in the State of Nevada.</text>

				</paragraph><paragraph id="ID9805170155334F528BF03BE26FBF83A5"><enum>(2)</enum><text>While the real

			 property is under the jurisdiction of the Secretary of the Interior, acting

			 through the Bureau of Land Management, some of the real property land has been

			 occupied for decades by persons who took possession by purchase or other

			 documented and putatively legal transactions, but whose continued occupation of

			 the real property constitutes a <quote>trespass</quote> upon the title held by

			 the Federal Government.</text>

				</paragraph><paragraph id="IDC5ED91377BA045188D7997175110414E"><enum>(3)</enum><text>As a result of

			 the confused and conflicting ownership claims, the real property is difficult

			 to manage under multiple use policies and creates a continuing source of

			 friction and unease between the Federal Government and local residents.</text>

				</paragraph><paragraph id="ID8E082AFF493042B1918F0D93566A0F14"><enum>(4)</enum><text>All of the real

			 property is appropriate for disposal for the purpose of promoting

			 administrative efficiency and effectiveness, and the Bureau of Land Management

			 has already identified certain parcels of the real property for

			 disposal.</text>

				</paragraph><paragraph id="ID40685E0A40D349939BFA02E9B4AA49E6"><enum>(5)</enum><text>Some of the real

			 property contains historic and cultural values that must be protected.</text>

				</paragraph><paragraph id="ID68585E8B8D4E4A2C85C5347AA07D6C0F"><enum>(6)</enum><text>To promote

			 responsible resource management of the real property, certain parcels should be

			 conveyed to the county in which the property is situated in accordance with

			 land use management plans of the Bureau of Land Management so that the county

			 can, among other things, dispose of the property to persons residing on or

			 otherwise occupying the property.</text>

				</paragraph></subsection><subsection id="ID0D571E8A4E984D1593020C3E24740A3A"><enum>(b)</enum><header>Mining Townsite

			 Defined</header><text>In this section, the term <term>mining townsite</term>

			 means real property in the counties of Esmeralda and Nye, Nevada, that is owned

			 by the Federal Government, but upon which improvements were constructed because

			 of a mining operation on or near the property and based upon the belief

			 that—</text>

				<paragraph id="IDBA7AA807EAC44D90BDA6B97E8DEB9FAB"><enum>(1)</enum><text>the property had

			 been or would be acquired from the Federal Government by the entity that

			 operated the mine; or</text>

				</paragraph><paragraph id="ID89378A6C5B124BCCAEF43BB7D0D117EC"><enum>(2)</enum><text>the person who

			 made the improvement had a valid claim for acquiring the property from the

			 Federal Government.</text>

				</paragraph></subsection><subsection id="IDFB1F41987D064100888A56856915E400"><enum>(c)</enum><header>Conveyance

			 Authority</header>

				<paragraph id="ID7EB901A176C04E1D9104A62088BC82CF"><enum>(1)</enum><header>In

			 general</header><text>Notwithstanding sections 202 and 203 of the

			 <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of

			 1976</act-name> (43 U.S.C. 1712, 1713), the Secretary of the Interior, acting

			 through the Bureau of Land Management, shall convey, without consideration, all

			 right, title, and interest of the United States in and to mining townsites

			 (including improvements thereon) identified for conveyance on the maps entitled

			 <quote>Original Mining Townsite, Ione, Nevada</quote> and <quote>Original

			 Mining Townsite, Gold Point, Nevada</quote> and dated October 17, 2005.</text>

				</paragraph><paragraph id="ID795476657FD947D0922A02B6AA897B26"><enum>(2)</enum><header>Availability of

			 maps</header><text>The maps referred to in paragraph (1) shall be on file and

			 available for public inspection in the appropriate offices of the Secretary of

			 the Interior, including the office of the Bureau of Land Management located in

			 the State of Nevada.</text>

				</paragraph></subsection><subsection id="ID11707B1552794E6BA4E97F63C6129DFA"><enum>(d)</enum><header>Recipients</header>

				<paragraph id="ID73816748CAC84317AC3EF26942D9522C"><enum>(1)</enum><header>Original

			 recipient</header><text>Subject to paragraph (2), the conveyance of a mining

			 townsite under subsection (c) shall be made to the county in which the mining

			 townsite is situated.</text>

				</paragraph><paragraph id="ID507A535F1E9145CCBDC037CE959F7CCB"><enum>(2)</enum><header>Reconveyance to

			 occupants</header><text>In the case of a mining townsite conveyed under

			 subsection (c) for which a valid interest is proven by one or more persons,

			 under the provisions of Nevada Revised Statutes Chapter 244, the county that

			 received the mining townsite under paragraph (1) shall reconvey the property to

			 that person or persons by appropriate deed or other legal conveyance as

			 provided in that State law. The county is not required to recognize a claim

			 under this paragraph submitted more than 10 years after the date of the

			 enactment of this Act.</text>

				</paragraph></subsection><subsection id="ID9FD226E8A37E490F8662E9B291E62571"><enum>(e)</enum><header>Protection of

			 Historic and Cultural Resources</header><text>As a condition on the conveyance

			 or reconveyance of a mining townsite under subsection (c), all historic and

			 cultural resources (including improvements) on the mining townsite shall be

			 preserved and protected in accordance with applicable Federal and State

			 law.</text>

			</subsection><subsection id="ID1BF5E36ADCC643F9A454277AA43CE25F"><enum>(f)</enum><header>Valid Existing

			 Rights</header><text>The conveyance of a mining townsite under this section

			 shall be subject to valid existing rights, including any easement or other

			 right-of-way or lease in existence as of the date of the conveyance. All valid

			 existing rights and interests of mining claimants shall be maintained, unless

			 those rights or interests are deemed abandoned and void or null and void

			 under—</text>

				<paragraph id="IDBB29033AAA4945AC93E09F6B95E8E158"><enum>(1)</enum><text>section 2320 of

			 the Revised Statutes (30 U.S.C. 21 et seq.);</text>

				</paragraph><paragraph id="ID84406BE38A064546BC59775EA2D1FFA7"><enum>(2)</enum><text>the

			 <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of

			 1976</act-name> (43 U.S.C. 1701 et seq.); or</text>

				</paragraph><paragraph id="ID965C17752BA3461EB278F5301E193FBF"><enum>(3)</enum><text>subtitle B of

			 title X of the <act-name parsable-cite="OBRA93">Omnibus Budget Reconciliation

			 Act of 1993</act-name> (30 U.S.C. 28(f)–(k)), including regulations promulgated

			 under section 3833.1 of title 43, Code of Federal Regulations or any successor

			 regulation.</text>

				</paragraph></subsection><subsection id="ID2DFB3834122D4178B2DECEAAC1F81254"><enum>(g)</enum><header>Survey</header><text>A

			 mining townsite to be conveyed by the United States under this section shall be

			 sufficiently surveyed to legally describe the land for patent

			 conveyance.</text>

			</subsection><subsection id="ID33E85F072B69425A962DB717484E0B77"><enum>(h)</enum><header>Release</header><text>On

			 completion of the conveyance of a mining townsite under subsection (c), the

			 United States shall be relieved from liability for, and shall be held harmless

			 from, any and all claims arising from the presence of improvements and

			 materials on the conveyed property.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID028C4C0D7A364C2DBCF3F1E67478762F"><enum>(i)</enum><header>Authorization

			 of Appropriations</header><text>There is authorized to be appropriated to the

			 Secretary of the Interior such amounts as may be necessary to carry out the

			 conveyances required by this section, including funds to cover the costs of

			 cadastral and mineral surveys, mineral potential reports, hazardous materials,

			 biological, cultural and archaeological clearances, validity examinations and

			 other expenses incidental to the conveyances.</text>

			</subsection></section></legis-body>
