		  establish in the State of Louisiana a memorial to honor the Buffalo

		<section id="id30214DA951FE483AB6CCF227FDF4399E" section-type="section-one"><enum>1.</enum><header>Short title</header>

			<subsection id="id6BCBC4C88A344510A7148C70187A794F"><enum></enum><text>This Act may be

			 cited as the <quote>Buffalo Soldiers

			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">commemoration</deleted-phrase>

						<added-phrase committee-id="SSEG00" reported-display-style="italic">Commemoration</added-phrase> Act of

			 2005</quote>.</text>

			</subsection></section><section id="idD91E6D17DF2D41E28168D290C7A8B271"><enum>2.</enum><header>Establishment of

			 Buffalo Soldiers memorial</header>

			<subsection id="ID725D9CE1711B462EA9FE654E0AAEACD6"><enum>(a)</enum><header>Authorization</header><text>The

			 American Battle Monuments Commission is authorized to establish a memorial to

			 honor the Buffalo Soldiers in or around the City of New Orleans on land donated

			 for such purpose or on Federal land with the consent of the appropriate land

			 manager.</text>

			</subsection><subsection id="IDA8B0D68A9C4F492DBA76FD26AB7F52CE"><enum>(b)</enum><header>Contributions</header><text>The

			 Commission shall solicit and accept contributions for the construction and

			 maintenance of the memorial.</text>

			</subsection><subsection id="IDAB23A4C5D43D4D62A538C9FE66EAB95E"><enum>(c)</enum><header>Cooperative

			 agreements</header><text>The Commission may enter into a cooperative agreement

			 with a private or public entity for the purpose of fundraising for the

			 construction and maintenance of the memorial.</text>

			</subsection><subsection id="ID6117A0096D474B2496AAA632B0E7FF4F"><enum>(d)</enum><header>Maintenance

			 agreement</header><text>Prior to beginning construction of the memorial, the

			 Commission shall enter into an agreement with an appropriate public or private

			 entity to provide for the permanent maintenance of the memorial and shall have

			 sufficient funds, or assurance that it will receive sufficient funds, to

			 complete the memorial.</text>

			</subsection></section><section id="ID41C051220D774CA998AB51C096FF2C82"><enum>3.</enum><header>Buffalo Soldiers

			 memorial account</header>

			<subsection id="IDCA55BC80C22F4B8EACF5E3EA9505B791"><enum>(a)</enum><header>Establishment</header><text>The

			 Commission shall maintain an escrow account (<quote>account</quote>) to pay

			 expenses incurred in constructing the memorial.</text>

			</subsection><subsection id="ID374EECFB71A94CF0857DE1EEF96C545E"><enum>(b)</enum><header>Deposits into

			 the account</header><text>The Commission shall deposit into the account any

			 principal and interest by the United States that the Chairman determines has a

			 suitable maturity.</text>

			</subsection><subsection id="ID5AB2DAEBD30D4FEFBA8820022D3ABA25"><enum>(c)</enum><header>Use of

			 account</header><text>Amounts in the account, including proceeds of any

			 investments, may be used to pay expenses incurred in establishing the memorial.

			 After construction of the memorial amounts in the account shall be transferred

			 by the Commission to the entity providing for permanent maintenance of the

			 memorial under such terms and conditions as the Commission determines will

			 ensure the proper use and accounting of the amounts.</text>

			</subsection></section><section id="IDE8C288B3BC5C4F0D98A535B14D1A7C6E"><enum>4.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated such sums as may be necessary to carry out this

			 Act.</text>
