		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Radio and Concert Disclosure and

			 Competition Act of 2005</short-title></quote>.</text>

		</section><section id="id4EC51F7D358C4797AA0B6874898108DE"><enum>2.</enum><header>Disclosure

			 regulations</header>

			<subsection id="id8053B3AFE07C4F5FB0418845585AA0C9"><enum>(a)</enum><header>Modification of

			 regulations</header>

				<paragraph id="idFF4390EE2198443DB13A99D9FF6F3A44"><enum>(1)</enum><header>In

			 general</header><text>Not later than 1 year after the date of the enactment of

			 this Act, the Federal Communications Commission shall modify its regulations

			 under sections 317 and 507 of the Communications Act of 1934 (47 U.S.C. 317 and

			 508), to prohibit the licensee or permittee of any radio station, including any

			 employee or affiliate of such licensee or permittee, from receiving money,

			 services, or other valuable consideration, whether directly or indirectly, from

			 a record company, recording artist, concert promoter, music promoter, or music

			 publisher, or an agent or representative thereof, unless the licensee or

			 permittee discloses at least monthly the receipt of such money, services, or

			 other consideration to the Federal Communications Commission (in this Act

			 referred to as the <quote>Commission</quote>) and the public in a manner that

			 the Commission shall specify.</text>

				</paragraph><paragraph id="idF09DBC34C8E24165830364BEA28BBA6A"><enum>(2)</enum><header>Exception</header><text>The

			 Commission in modifying its regulations as required under paragraph (1) may

			 create an exception to the prohibition described under paragraph (1)

			 for—</text>

					<subparagraph id="IDe3977715fa59490cae5b7ea453cc2de7"><enum>(A)</enum><text>transactions

			 provided at nominal cost; or</text>

					</subparagraph><subparagraph id="ID0893c58048f746ebb120559674d50ae1"><enum>(B)</enum><text>paid broadcasting

			 disclosed under section 317 of the Communications Act of 1934 (47 U.S.C. 317),

			 if the monthly disclosure described in paragraph (1) includes the proportion of

			 total airplay considered paid broadcasting.</text>

					</subparagraph></paragraph></subsection><subsection id="IDa54314d06e6d4b0f9fecd7bff942fcfd"><enum>(b)</enum><header>Playlist</header><text>The

			 monthly disclosure by a radio station licensee or permittee required under

			 subsection (a) shall include a list of songs and musical recordings aired

			 during the disclosure period, indicating the artist, record label, and number

			 of times the song was aired.</text>

			</subsection></section><section id="ID604a8d279a2c430ea7a6d781c1bbcf75"><enum>3.</enum><header>Arm's length

			 transactions</header>

			<subsection id="id05E7BC291BFD4420805268C66A921F22"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 1 year

			 after the date of the enactment of this Act, the Federal Communications

			 Commission shall modify its regulations under sections 317 and 507 of the

			 Communications Act of 1934 (47 U.S.C. 317 and 508), to require that all

			 transactions between a licensee or permittee of any radio station, including

			 any employee or affiliate of such licensee or permittee, and a record company,

			 recording artist, concert promoter, music promoter, or music publisher, or an

			 agent or representative thereof, shall be conducted at an arm’s length basis

			 with any such transaction reduced to writing and retained by the licensee or

			 permittee for the period of the license term or 5 years, whichever is

			 greater.</text>

			</subsection><subsection id="ID20a27f32f38d4724ab05738f8d7a6f46"><enum>(b)</enum><header>Records</header><text>A

			 record of each transaction described under subsection (a) shall be—</text>

				<paragraph id="idC45E38589D104D2C96659A9EAAEDF105"><enum>(1)</enum><text>made available

			 upon request to—</text>

					<subparagraph id="id480F85E6B14F4FE884F37979830B742E"><enum>(A)</enum><text>the Commission;

			 and</text>

					</subparagraph><subparagraph id="idD2310B844E4F4DD4B2511528233C245A"><enum>(B)</enum><text>any State

			 enforcement agency; and</text>

					</subparagraph></paragraph><paragraph id="id0DD87A9C957F417BAFD2D8E957DA5B72"><enum>(2)</enum><text>subject to a

			 random audit by the Commission to ensure compliance on a basis to be determined

			 by the Commission.</text>

				</paragraph></subsection><subsection id="IDd50ab384fc484082991c229151756607"><enum>(c)</enum><header>Exemption</header><text>The

			 Commission may create an exemption to the record keeping requirement described

			 in subsection (b)—</text>

				<paragraph id="id28C929459BAF4CFCA1A78CCD0C61B86E"><enum>(1)</enum><text>for a transaction

			 that is of a nominal value; and</text>

				</paragraph><paragraph id="idF6E4DD3EA7E742DD8AE47EC62C90E115"><enum>(2)</enum><text>for a radio

			 station that is a small business, as recognized by the Commission and

			 established by the Small Business Administration under section 121 of title 13,

			 Code of Federal Regulations, if the Commission determines that such record

			 keeping poses an undue burden to that small business.</text>

				</paragraph></subsection></section><section id="ID0b9bcf29aeb84c17a68bec314177c0a6"><enum>4.</enum><header>Competition

			 regulations</header><text display-inline="no-display-inline">Not later than 1

			 year after the date of the enactment of this Act, the Federal Communications

			 Commission shall modify its regulations under sections 317 and 507 of the

			 Communications Act of 1934 (47 U.S.C. 317 and 508), to accomplish the

			 following:</text>

			<paragraph id="ID2bac4dcc1ea8404f83e75816b211f369"><enum>(1)</enum><header>General

			 prohibition</header><text>To prohibit the licensee of any radio station,

			 including any parent, subsidiary, or affiliated entity of such licensee, from

			 using its control over any non-advertising matter broadcast by such licensee to

			 extract or receive money or any other form of consideration, whether directly

			 or indirectly, from a record company, artist, concert promoter, or any agent or

			 representative thereof.</text>

			</paragraph><paragraph id="ID4aef668be9604a839a1c584a7a94a062"><enum>(2)</enum><header>Radio station

			 concerts</header>

				<subparagraph id="id9804E7564E4C4F77B9CB5F9DF868051F"><enum>(A)</enum><header>In

			 general</header><text>To prohibit a licensee or permittee of a commercial radio

			 station, or affiliate thereof, from—</text>

					<clause id="idBFAB650D5889492C917AD9BBCE92F77E"><enum>(i)</enum><text>engaging,

			 receiving, making an offer for, or directly profiting from concert services of

			 any musician or recording artist unless the licensee or permittee does not

			 discriminate, in whole or in part, about the broadcast of non-advertising

			 matter, including any sound recording, by that particular artist upon whether

			 or not that artist performs at the radio station affiliated concert; and</text>

					</clause><clause id="IDf503cb416cbf4e48846973edb7f07214"><enum>(ii)</enum><text>engaging or

			 receiving concert services of any musician or recording artist unless the

			 licensee or permittee provides the musician or recording artist with

			 compensation for such services at the fair market value for the

			 performance.</text>

					</clause></subparagraph><subparagraph id="id6C1EBFDA1CB24969A22BAA7B917E7B0D"><enum>(B)</enum><header>Definition</header><text>For

			 purposes of subparagraph (A), the term <quote>fair market value</quote> shall

			 include such factors as—</text>

					<clause id="id79948C143DA1480C8C92BD5111C1B9AE"><enum>(i)</enum><text>the

			 rate typically charged by the musician or recording artist for a concert of the

			 size being put on for the station;</text>

					</clause><clause id="id77AB7F7DF6C94E678704135AC66875D4"><enum>(ii)</enum><text>the expenses of

			 the musician or recording artist to travel to, and perform at, the concert

			 location; and</text>

					</clause><clause id="id23936C0E7946433CBE696C92E54F6386"><enum>(iii)</enum><text>the length of

			 the performance in relation to the standard duration for a concert by the

			 musician or recording artist.</text>

					</clause></subparagraph><subparagraph id="id157B2DE63E2D4058812A3688210C6A4F"><enum>(C)</enum><header>Limitations and

			 exclusions</header><text>The provisions of this paragraph shall not—</text>

					<clause id="id5EE11DD13C324BEA98305E2934ED357F"><enum>(i)</enum><text>prohibit

			 consideration for the concert services being made in the form of promotional

			 value, cash, or a combination of both; or</text>

					</clause><clause id="id02700A52B8144B96BE36D9EA9ECA11FC"><enum>(ii)</enum><text>apply to—</text>

						<subclause id="IDd779644620d74a059d6650dcbe17a69a"><enum>(I)</enum><text>a radio station

			 that is a small business, as recognized by the Commission and established by

			 the Small Business Administration under section 121 of title 13, Code of

			 Federal Regulations;</text>

						</subclause><subclause id="ID0b298cf418f24e088b232334ca325f3b"><enum>(II)</enum><text>in-studio live

			 interviews and performances; or</text>

						</subclause><subclause id="ID8605d4dfe612497b98262cac4bf6bef0"><enum>(III)</enum><text>concerts whose

			 proceeds are intended and provided for charitable purposes.</text>

						</subclause></clause></subparagraph></paragraph><paragraph id="IDe4d9ffec2b70409fa533ad1de81dc043"><enum>(3)</enum><header>Radio and

			 concert cross-ownership</header>

				<subparagraph id="id6B0F01C2B1EC403A8B5CD36C1194E317"><enum>(A)</enum><header>In

			 general</header><text>To prohibit a licensee or permittee of a radio station,

			 or affiliate thereof, from owning or controlling a concert promoter or venue

			 primarily used for live concert performances.</text>

				</subparagraph><subparagraph id="id428E4B6A78D0430BA0638C27B4984170"><enum>(B)</enum><header>Waiver</header><text>The

			 Commission may waive the prohibition required under subparagraph (A) if—</text>

					<clause id="ID1cb4c4b9409c4fa18ac0f237c19c4ba2"><enum>(i)</enum><text>the

			 Commission determines that because of the nature of the cross-ownership and

			 market served—</text>

						<subclause id="ID660c1869c90e401fbb33063ba5ca56cb"><enum>(I)</enum><text>the affected

			 radio station, concert promoter, or venue would be subjected to undue economic

			 distress or would not be economically viable if such provisions were enforced;

			 and</text>

						</subclause><subclause id="ID21a69cc763454ce497ea1094a64e3c14"><enum>(II)</enum><text>the

			 anti-competitive effects of the proposed transaction are clearly outweighed in

			 the public interest by the probable effect of the transaction in meeting the

			 needs of the community to be served; and</text>

						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDabd6aa06b61547ef9f7c6dc6c151fdc8"><enum>(ii)</enum><text>the affected

			 radio station, concert promoter, or venue demonstrates to the Commission that

			 decisions regarding the broadcast of matter, including any sound recording,

			 will be made at arm’s length and not based, in whole or in part, upon whether

			 or not the creator, producer, or promoter of such matter engages the services

			 of the licensee or permittee, or an affiliate thereof.</text>

					</clause></subparagraph></paragraph></section><section id="ID4b013425e95b4294b2b620a7b483a002"><enum>5.</enum><header>Review of

			 transactions</header>

			<subsection id="id51BDF55C370E4B3886A07C82B3301115"><enum>(a)</enum><header>In

			 general</header><text>Upon petition by a musician, recording artist, or

			 interested party, the Commission shall review any transaction entered into

			 under section 3 or section 4.</text>

			</subsection><subsection id="id925D78A90D834CE4B9EB3E12ACA430F9"><enum>(b)</enum><header>Copy of

			 petition</header><text>A copy of any petition submitted to Commission under

			 subsection (a) shall be provided by the person filing such petition to the

			 licensee or permittee, or musician or recording artist, as applicable.</text>

			</subsection><subsection id="idA6797583D2474611AF1D9C00B999C66E"><enum>(c)</enum><header>Public

			 disclosure</header><text>If the Commission, after reviewing a petition

			 submitted under subsection (a) finds a transaction violated any provision of

			 this paragraph or section 3, the Commission shall publicly, after all parties

			 have had a reasonable opportunity to comment, disclose its finding and grant

			 appropriate relief.</text>

			</subsection></section><section id="ID24667a6d2c394bdc85805215112a8c72"><enum>6.</enum><header>Penalties</header><text display-inline="no-display-inline">The regulations promulgated under sections

			 2, 3 and 4 shall set forth appropriate penalties for violations including an

			 immediate hearing before the Commission upon the issuance of a notice of

			 apparent liability or violation, with possible penalties to include license

			 revocation.</text>

		</section><section id="ID6f7499c8bc0f41d78b5ce1f48dbebbdf"><enum>7.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 2 years after the date of

			 enactment of this Act, and every 2 years thereafter, the Commission shall issue

			 a report to Congress and the public that—</text>

			<paragraph id="IDe2133ca088df46f2b5a53a84e5ca8bcd"><enum>(1)</enum><text>summarizes the

			 disclosures made by licensees and permittees as required under section

			 2;</text>

			</paragraph><paragraph id="ID8901531895f147948ff9a9611e44cce3"><enum>(2)</enum><text>summarizes the

			 audits conducted by the Commission as required under section 3(b)(2);</text>

			</paragraph><paragraph id="ID4a1a4a718f794f56a31292697d965364"><enum>(3)</enum><text>summarizes the

			 cross-ownership waivers, if any, awarded by the Commission under section

			 4(3)(B);</text>

			</paragraph><paragraph id="IDf3128dfc9739426d9ad5b76ac5fc7a68"><enum>(4)</enum><text>evaluates

			 ownership concentration and market power in the radio industry in a manner

			 similar to the most recent in the discontinued series of FCC reports,

			 <quote>Radio Industry Review 2002: Trends in Ownership, Format, and

			 Finance</quote>; and</text>

			</paragraph><paragraph id="ID7fd2422e8633402ca56d2ec2d04fcb54"><enum>(5)</enum><text>describes any

			 violations of section 2, 3, or 4, and penalty proceedings under section 6, and

			 includes recommendations for any additional statutory authority the Commission

			 determines would improve compliance with regulations issued under this

			 Act.</text>

			</paragraph></section><section id="ID7db2f0438b37499b989f6eace7c61f9c"><enum>8.</enum><header>License

			 revocation</header><text display-inline="no-display-inline">Section 312(a) of

			 the Communications Act of 1934 (47 U.S.C. 312) is amended—</text>

			<paragraph id="ID80e9afbcd4854b75b08b2d68e87570cf"><enum>(1)</enum><text>in paragraph (6),

			 by striking <quote>; or</quote> and inserting a semicolon;</text>

			</paragraph><paragraph id="IDf9db1ca3e7f94602a23ca65a71a71176"><enum>(2)</enum><text>in paragraph (7),

			 by striking the period at the end and inserting <quote>; or</quote>; and</text>

			</paragraph><paragraph id="ID15e472777cd64cf494a4d5136b516931"><enum>(3)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="idD61D2A0DCEA54373A349608CF3DEE4C7" style="OLC">

					<paragraph id="IDf26be7ac13e643b18a1cd7cef1f5056f"><enum>(8)</enum><text>for violation of

				or failure to follow any regulation established in accordance with section 2,

				3, 4, or 6 of the Radio and Concert Disclosure and Competition Act of

				2005.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="ID1e1ba32ce2eb43d18239b78a8d74b606"><enum>9.</enum><header>Increased

			 maximum penalties</header>

			<subsection id="id5240CBC6A1774F38A23D2116D846F554"><enum>(a)</enum><header>Penalties for

			 disclosure of payments to individuals connected with broadcasts</header><text display-inline="yes-display-inline">Section 507(g)(1) of the Communications Act

			 of 1934 (47 U.S.C. 508(g)(1)) is amended by striking <quote>$10,000</quote> and

			 inserting <quote>$50,000</quote>.</text>

			</subsection><subsection id="id45225C12D1B2474EB12F4C0116DFC0C6"><enum>(b)</enum><header>Penalties for

			 prohibited practices in contests of knowledge, skill, or

			 chance</header><text>Section 508(c)(1) of the Communications Act of 1934 (47

			 U.S.C. 509(c)(1)) is amended—</text>

				<paragraph id="id3C341CB4987A4BE5A967022F3D617A57"><enum>(1)</enum><text>by striking

			 <quote>$10,000</quote> and inserting <quote>$50,000</quote>; and</text>

				</paragraph><paragraph id="ID68d1fbec441a46aa9df0d116d59ed2bd"><enum>(2)</enum><text>by inserting

			 <quote>, for each violation</quote> before the period.</text>

				</paragraph></subsection></section></legis-body>
