		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Border Security and Modernization

			 Act of 2005</short-title></quote>.</text>

		</section><section id="idFF76A8C244E94BD18907093527012DDF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="id7AA6BED01B6944BDAA0D0018CD7DCA18"><enum>(1)</enum><header>Department</header><text>Except

			 as otherwise provided, the term <quote>Department</quote> means the Department

			 of Homeland Security.</text>

			</paragraph><paragraph id="idA3FC593CF0FF40969E2EF9B4875A523E"><enum>(2)</enum><header>Secretary</header><text>Except

			 as otherwise provided, the term <quote>Secretary</quote> means the Secretary of

			 Homeland Security.</text>

			</paragraph><paragraph id="idC1EBC0A17107469093934BC2CE3E7152"><enum>(3)</enum><header>State</header><text>Except

			 as otherwise provided, the term <term>State</term> has the meaning given that

			 term in section 101(a)(36) of the Immigration and Nationality Act (8 U.S.C.

			 1101 (a)(36)).</text>

			</paragraph></section><section id="ID2d4ea2835b9442c4ab6568a9d07e187e"><enum>3.</enum><header>Construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to

			 require law enforcement personnel of a State or political subdivision of a

			 State to—</text>

			<paragraph id="IDcc050119d17c4c979f4f95e42c77a5fa"><enum>(1)</enum><text>report the

			 identity of a victim of, or a witness to, a criminal offense to the Secretary

			 for immigration enforcement purposes;</text>

			</paragraph><paragraph id="IDae02378187294296a4ebc56c45dd8cd7"><enum>(2)</enum><text>arrest such

			 victim or witness for a violation of the immigration laws of the United States;

			 or</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2222089e06d64c7cb26a7df4dd76c4c1"><enum>(3)</enum><text>enforce the

			 immigration laws of the United States.</text>

			</paragraph></section><title id="idC0116FC814AA4515B2796B202275C2FC"><enum>I</enum><header>Border

			 protection</header>

			<subtitle id="id960856C51D93459EA31538CCEEC82371"><enum>A</enum><header>Personnel and

			 training</header>

				<section id="ID472b43cae310417fb646aaaad27c1832"><enum>101.</enum><header>Personnel of

			 the Department of Homeland Security</header>

					<subsection id="IDc3820594e8004eddb07ef1328c96ca86"><enum>(a)</enum><header>In

			 general</header>

						<paragraph id="ID0ded4900688c4ab6a134cbd32a47acdd"><enum>(1)</enum><header>Customs and

			 border protection officers</header><text>During each of the fiscal years 2007

			 through 2011, the Secretary shall, subject to the availability of

			 appropriations for such purpose, increase by not less than 1,000 the number of

			 positions for full-time active duty officers of the Bureau of Customs and

			 Border Protection of the Department for such fiscal year.</text>

						</paragraph><paragraph id="IDf78de4f7d5414ce99f0b405cd6190278"><enum>(2)</enum><header>Immigration and

			 customs enforcement inspectors</header><text>Section 5203 of the Intelligence

			 Reform and Terrorism Prevention Act of 2004 (Public Law 108–458; 118 Stat.

			 3734) is amended by striking <quote>800</quote> and inserting

			 <quote>1000</quote>.</text>

						</paragraph><paragraph id="IDf6a5a91a164d467cbd317a86202f54b5"><enum>(3)</enum><header>Investigative

			 personnel</header><text>In addition to the positions authorized under section

			 5203 of the Intelligence Reform and Terrorism Prevention Act of 2004, as

			 amended by paragraph (2), during each of the fiscal years 2007 through 2011,

			 the Secretary shall, subject to the availability of appropriations for such

			 purpose, increase by not less than 100 the number of positions for

			 investigative personnel within the Department to investigate alien smuggling

			 and immigration status violations for such fiscal year.</text>

						</paragraph><paragraph id="IDb3d5a6adb8d44de6941ca06148a622f8"><enum>(4)</enum><header>Legal

			 personnel</header><text>During each of the fiscal years 2007 through 2011, the

			 Secretary shall, subject to the availability of appropriations for such

			 purpose, increase by not less than 100 the number of positions for attorneys in

			 the Office of General Counsel of the Department who represent the Department in

			 immigration matters for such fiscal year.</text>

						</paragraph><paragraph id="ID2179b7c2f6634c0a8ca775f26de228d3"><enum>(5)</enum><header>Waiver of fte

			 limitation</header><text>The Secretary is authorized to waive any limitation on

			 the number of full-time equivalent personnel employed by the Department to

			 fulfill the requirements of paragraph (1) and the amendment made by paragraph

			 (2).</text>

						</paragraph></subsection><subsection id="ID3cee42740eed4ff481c73557c3062d7d"><enum>(b)</enum><header>Training</header><text>The

			 Secretary shall provide appropriate training for the agents, officers,

			 inspectors, and associated support staff of the Department on an ongoing basis

			 to utilize new technologies and techniques and to ensure that the proficiency

			 levels of such personnel are acceptable to protect the international borders of

			 the United States.</text>

					</subsection><subsection id="id22ADBA19FA294DC99FE0567841BDF542"><enum>(c)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated to the

			 Secretary for each of fiscal years 2007 through 2011, such sums as may be

			 necessary to carry out this section.</text>

					</subsection></section><section id="ID78e494b0de83409faa9a155007347839"><enum>102.</enum><header>Personnel of

			 the Department of Justice and other attorneys</header>

					<subsection id="IDff52e98321e243ada2c343fd284fc96e"><enum>(a)</enum><header>Litigation

			 attorneys</header><text>During each of the fiscal years 2007 through 2011, the

			 Attorney General shall, subject to the availability of appropriations for such

			 purpose, increase by not less than 50 the number of positions for attorneys in

			 the Office of Immigration Litigation of the Department of Justice for such

			 fiscal year.</text>

					</subsection><subsection id="ID950635906bde4438abc919cda3f302d2"><enum>(b)</enum><header>United States

			 attorneys</header><text>During each of the fiscal years 2007 through 2011, the

			 Attorney General shall, subject to the availability of appropriations for such

			 purpose, increase by not less than 50 the number of United States Attorneys to

			 litigate immigration cases in the Federal courts for such fiscal year.</text>

					</subsection><subsection id="id7A1D040752104C31AED767E1DDF7B81C"><enum>(c)</enum><header>United states

			 marshals</header><text>During each of the fiscal years 2007 through 2011, the

			 Attorney General shall, subject to the availability of appropriations for such

			 purpose, increase by not less than 50 the number of Deputy United States

			 Marshals to investigate criminal immigration matters.</text>

					</subsection><subsection id="IDa847c050d71d47c08ed4c83b567a43b0"><enum>(d)</enum><header>Immigration

			 judges</header><text>During each of fiscal years 2007 through 2011, the

			 Attorney General shall, subject to the availability of appropriations for such

			 purpose, increase by not less than 100 the number of immigration judges for

			 such fiscal year.</text>

					</subsection><subsection id="ID52d1e1812c844436afbadbcda1f147b1"><enum>(e)</enum><header>Defense

			 attorneys</header><text>During each of the fiscal years 2007 through 2011, the

			 Director of the Administrative Office of the United States Courts shall,

			 subject to the availability of appropriations for such purpose, increase by not

			 less than 100 the number of attorneys in the Federal Defenders Program for such

			 fiscal year.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID480b346e2e1e4543aba3e03fe95af07a"><enum>(f)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated to the

			 Attorney General for each of fiscal years 2007 through 2011 such sums as may be

			 necessary to carry out this section, including the hiring of necessary support

			 staff.</text>

					</subsection></section><section id="ID020faaeda326440daa43ed805e776804"><enum>103.</enum><header>Use of the

			 National Guard for border protection activities</header>

					<subsection id="idE346999E2938423DA0C54ED0C573E7E8"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 112 of title

			 32, United States Code, is amended—</text>

						<paragraph id="IDb6abae38fcb646bdbad24983546c1d12"><enum>(1)</enum><text>by striking

			 <quote>drug interdiction and counter-drug activities</quote> each place it

			 appears and inserting <quote>drug interdiction, counter drug, and border

			 activities</quote>; and</text>

						</paragraph><paragraph id="ID6c21e571aa8c476f85b789dc594b1390"><enum>(2)</enum><text>in subparagraphs

			 (A) and (B) of subsection (e)(1), by striking <quote>drug interdiction or

			 counter-drug activities</quote> each place it appears and inserting <quote>drug

			 interdiction, counter-drug, or border activities</quote>.</text>

						</paragraph></subsection><subsection id="id9BDD2F3104EE412E8F8905DBCF52A4ED"><enum>(b)</enum><header>Definition of

			 drug interdiction, counter-drug, and border activities</header><text>Subsection

			 (h)(1) of such section is amended to read as follows:</text>

						<quoted-block display-inline="no-display-inline" id="id68C44022377D4CC781EA9F0734CFC2EF" style="OLC">

							<paragraph id="id887F55FBF5AD4D1F8E3CB7550FCEBB5E"><enum>(1)</enum><text>The term

				<quote>drug interdiction, counter-drug, and border activities</quote>, with

				respect to the National Guard of a State, means the use of National Guard

				personnel in—</text>

								<subparagraph id="ID23d9be84000d4a43935b0a72c82e29e2"><enum>(A)</enum><text>drug interdiction

				and counter-drug law enforcement activities, including drug demand reduction

				activities authorized by the law of the State and requested by the Governor of

				the State; or</text>

								</subparagraph><subparagraph id="IDb73ee8806a624913bd362e37a4dc7978"><enum>(B)</enum><text>activities

				conducted in cooperation with personnel of the Department of Homeland Security

				to secure the international borders of the United States, including

				constructing roads, fencing, and vehicle barriers, assisting in search and

				rescue operations conducted by personnel of the Department of Homeland

				Security, and monitoring international borders, and excluding any law

				enforcement activities conducted by personnel of the Department of Homeland

				Security.</text>

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</subsection></section><section id="IDf91078dbafb44fb4a6534aecaa1e9ea7"><enum>104.</enum><header>Deputy Border

			 Patrol Agent Program</header>

					<subsection id="ID50656dc3baec4866b1bbf71f75b6c37c"><enum>(a)</enum><header>Authority to

			 establish</header><text>The Secretary may establish a Deputy Border Patrol

			 Agent Program (in this section referred to as the <quote>Program</quote>) in

			 the Office of Border Patrol.</text>

					</subsection><subsection id="id1B3C467E3A924E7EBF90432B8D4830F4"><enum>(b)</enum><header>Purpose</header><text>The

			 purpose of the Program shall be to establish a volunteer force of trained,

			 retired law enforcement officers to assist the Secretary in carrying out the

			 mission of the Department to achieve operational control of the borders of the

			 United States.</text>

					</subsection><subsection id="idE16DA47A2D71425FB96284FF172A8605"><enum>(c)</enum><header>Qualifications</header><text>An

			 individual may participate as a volunteer in the Program only if such

			 individual is a retired law enforcement officer, who is or was previously

			 licensed by a Federal or State authority to enforce Federal, State, or local

			 penal offenses.</text>

					</subsection><subsection id="IDecf70ca3e3e14baf87441e2e048fcf99"><enum>(d)</enum><header>Utilization of

			 volunteers</header><text>The Secretary may utilize an individual who

			 participates as a volunteer in the Program to provide such border security

			 functions that the Secretary determines are appropriate.</text>

					</subsection><subsection id="id8F4298F8F4FB41E590274263CEE07BA1"><enum>(e)</enum><header>Training and

			 other requirements</header><text>The Secretary may require an individual who

			 participates as a volunteer in the Program to participate in such training,

			 testing, and other requirements that the Secretary determines are

			 appropriate.</text>

					</subsection><subsection id="ID5438f6b580714ce2b76edbef937a8c84"><enum>(f)</enum><header>Swearing

			 In</header><text>Upon completion of any training, testing, or other procedures

			 required by the Secretary, an individual who participates in the Program shall

			 be sworn in and assigned to the Office of Border Patrol.</text>

					</subsection><subsection id="ID752e62fe5cda4292af10e45c87a15cfb"><enum>(g)</enum><header>Assignment of

			 volunteers</header><text>The Secretary may assign individuals participating in

			 the Program to provide patrol services at facilities and locations along the

			 international borders of the United States.</text>

					</subsection><subsection id="IDc418e3edc3ad4f3d88bd2502c7738f21"><enum>(h)</enum><header>Oversight of

			 agents</header><text>The Secretary, acting through the Commissioner of the

			 Bureau of Customs and Border Protection of the Department, shall have oversight

			 of all individuals participating in the Program. Such volunteers shall serve at

			 the pleasure of the Secretary, acting through the Commissioner of the Bureau of

			 Customs and Border Protection.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDb508457838cd4370802091bf50ac6ffe"><enum>(i)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated

			 $10,000,000 for each of the fiscal years 2007 through 2011 to carry out this

			 section.</text>

					</subsection></section><section id="ID494c7a4f50e4443ca053750fcefce513"><enum>105.</enum><header>Document fraud

			 detection</header>

					<subsection id="ID0fdf473b77f348739f69f74e7559c3af"><enum>(a)</enum><header>Training</header><text>The

			 Secretary shall provide appropriate officers of the Bureau of Customs and

			 Border Protection of the Department with training in identifying and detecting

			 fraudulent travel documents. Such training shall be developed in consultation

			 with the Forensic Document Laboratory of the Bureau of Immigration and Customs

			 Enforcement of such Department.</text>

					</subsection><subsection id="IDf9434d08a4f7489296c8dcd49778c3af"><enum>(b)</enum><header>Forensic

			 document laboratory</header><text>The Secretary shall provide all officers of

			 the Bureau of Customs and Border Protection with access to the Forensic

			 Document Laboratory.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID52ecd67a6cc5472dada0b06c80e10461"><enum>(c)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated

			 $10,000,000 for each of the fiscal years 2007 through 2011 to carry out this

			 section.</text>

					</subsection></section></subtitle><subtitle id="id6C78E9B0E58148F989503A6B46A85F52"><enum>B</enum><header>Infrastructure</header>

				<section id="ID37cbfb9ff10643aea30aabd4c9022f15"><enum>111.</enum><header>Modernization

			 of border infrastructure</header>

					<subsection id="IDa64cda83678940ce9f1ef8d984d2e748"><enum>(a)</enum><header>Definitions</header><text>In

			 this section:</text>

						<paragraph id="ID70ddb0a7952048a890de4c18a139edf7"><enum>(1)</enum><header>Commissioner</header><text>The

			 term <term>Commissioner</term> means the Commissioner of the Bureau of Customs

			 and Border Protection of the Department.</text>

						</paragraph><paragraph id="ID82a0d981844348898fc12446d581114c"><enum>(2)</enum><header>Maquiladora</header><text>The

			 term <term>maquiladora</term> means an entity located in Mexico that assembles

			 and produces goods from imported parts for export to the United States.</text>

						</paragraph><paragraph id="ID022df2356a46493fbb09478fe07f064f"><enum>(3)</enum><header>Northern

			 border</header><text>The term <term>northern border</term> means the

			 international border between the United States and Canada.</text>

						</paragraph><paragraph id="ID6664681a2718467097e96093d836388a"><enum>(4)</enum><header>Southern

			 border</header><text>The term <term>southern border</term> means the

			 international border between the United States and Mexico.</text>

						</paragraph></subsection><subsection id="ID98f83b96ff0b4f268d964aa187e9aa2d"><enum>(b)</enum><header>Border

			 technologies, assets, and construction</header>

						<paragraph id="IDa3a1a0126110438188a4122a6fe48a79"><enum>(1)</enum><header>Acquisition</header><text>The

			 Secretary shall procure technologies necessary to support the mission of the

			 Department to achieve operational control of the international borders of the

			 United States. In determining what technologies to procure, the Secretary shall

			 consult with the Secretary of Defense and the head of the National Laboratories

			 and Technology Centers of the Department of Energy.</text>

						</paragraph><paragraph id="ID680d05ff89bc463eb9b901a07882af50"><enum>(2)</enum><header>Construction of

			 border control facilities</header><text>The Secretary shall construct roads,

			 acquire vehicle barriers, and construct fencing necessary to support such

			 mission.</text>

						</paragraph><paragraph id="ID54f5854f13d1495ba618e97ba38dd10b"><enum>(3)</enum><header>Assets</header><text>The

			 Secretary shall acquire unmanned aerial vehicles, police-type vehicles,

			 helicopters, all terrain vehicles, interoperable communications equipment,

			 firearms, sensors, cameras, lighting and such other equipment and assets as may

			 be necessary to support such mission.</text>

						</paragraph><paragraph id="IDb13cb166eec84d2da97292d3a00e98fb"><enum>(4)</enum><header>Facilities</header><text>The

			 Secretary shall construct such facilities as may be necessary to support the

			 number of employees of the Department who are hired pursuant to any provision

			 of this Act or of subtitle B of title V of the Intelligence Reform and

			 Terrorism Prevention Act of 2004 (Public Law 108–458; 118 Stat. 3733).</text>

						</paragraph><paragraph id="ID2d89b77929d1483d876f9ec075ff7a78"><enum>(5)</enum><header>Checkpoints</header><text>The

			 Secretary may construct and maintain temporary or permanent checkpoints on

			 roadways located in close proximity to the northern border or the southern

			 border to support such mission.</text>

						</paragraph></subsection><subsection id="IDd238f1287aa744f5bf75fc78daa13cd3"><enum>(c)</enum><header>Port of entry

			 infrastructure assessment study</header>

						<paragraph id="IDd81b7df908a24d90ae83975bd57e1b1d"><enum>(1)</enum><header>Requirement to

			 update</header><text>In order to carry out the mission of the Department to

			 achieve operational control of the international borders of the United States,

			 not later than January 31 of each year, the Administrator of General Services

			 shall update the Port of Entry Infrastructure Assessment Study prepared by the

			 United States Customs Service, the Immigration and Naturalization Service, and

			 the General Services Administration in accordance with the matter relating to

			 the ports of entry infrastructure assessment that is set out in the joint

			 explanatory statement in the conference report accompanying H.R. 2490 of the

			 106th Congress, 1st session (House of Representatives Rep. No. 106–319, page

			 67) and submit such updated study to Congress.</text>

						</paragraph><paragraph id="IDb227766d09bb47c08e78ef37ec5e5a6f"><enum>(2)</enum><header>Consultation</header><text>In

			 preparing the updated studies required by paragraph (1), the Administrator of

			 General Services shall consult with the Director of the Office of Management

			 and Budget, the Secretary, and the Commissioner.</text>

						</paragraph><paragraph id="ID541bc3cddc5040279856841915f5ba91"><enum>(3)</enum><header>Content</header><text>Each

			 updated study required by paragraph (1) shall—</text>

							<subparagraph id="IDed251129276043a4887917e8c124ae4b"><enum>(A)</enum><text>identify port of

			 entry infrastructure and technology improvement projects that would enhance

			 border security and facilitate the flow of legitimate commerce if

			 implemented;</text>

							</subparagraph><subparagraph id="IDcea3aa17846146f8ac5b1285aec83573"><enum>(B)</enum><text>include the

			 projects identified in the National Land Border Security Plan required by

			 subsection (d); and</text>

							</subparagraph><subparagraph id="IDe90cff4c52a94a2581f4e021650982cd"><enum>(C)</enum><text>prioritize each

			 project described in subparagraph (A) or (B) based on the likelihood that the

			 project will—</text>

								<clause id="ID56911c1b861842c69402a6d8152dfb72"><enum>(i)</enum><text>fulfill immediate

			 security requirements; and</text>

								</clause><clause id="IDd916b3c86a7c45898b3967142ccab68c"><enum>(ii)</enum><text>facilitate trade

			 across the borders of the United States.</text>

								</clause></subparagraph></paragraph><paragraph id="ID0e31825a738e419ab27f90fb34ed5c57"><enum>(4)</enum><header>Project

			 implementation</header>

							<subparagraph id="id79497E4BD56B422F83774741B1F948A0"><enum>(A)</enum><header>In

			 general</header><text>The Commissioner shall implement the infrastructure and

			 technology improvement projects described in each updated study required by

			 paragraph (1) in the order of priority assigned to each project under paragraph

			 (3)(C).</text>

							</subparagraph><subparagraph id="ID019e1cd36e434e81b52badd613212585"><enum>(B)</enum><header>Exception</header><text>The

			 Commissioner may diverge from the priority order if the Commissioner determines

			 that significantly changed circumstances, such as immediate security needs or

			 changes in infrastructure in Mexico or Canada, compellingly alter the need for

			 a project in the United States.</text>

							</subparagraph></paragraph></subsection><subsection id="ID8602f2a1e37b487ea23f7c1271fb2882"><enum>(d)</enum><header>National land

			 border security plan</header>

						<paragraph id="ID2bead2b810ec477eb559c944b810e421"><enum>(1)</enum><header>Requirement for

			 plan</header><text>In order to carry out the mission of the Department to

			 achieve operational control of the international borders of the United States,

			 not later than January 31 of each year, the Secretary shall prepare a National

			 Land Border Security Plan and submit such plan to Congress.</text>

						</paragraph><paragraph id="IDa430752296ac4c369ac6b8c1c9f8ab81"><enum>(2)</enum><header>Consultation</header><text>In

			 preparing the plan required by paragraph (1), the Secretary shall consult with

			 the Under Secretary for Information Analysis and Infrastructure Protection and

			 the Federal, State, and local law enforcement agencies and private entities

			 that are involved in international trade across the northern border or the

			 southern border.</text>

						</paragraph><paragraph id="ID947302d1828e4eeb84d48f4b60e9197b"><enum>(3)</enum><header>Vulnerability

			 assessment</header>

							<subparagraph id="ID8d1a1d6422554463b8588de8becb2522"><enum>(A)</enum><header>In

			 general</header><text>The plan required by paragraph (1) shall include a

			 vulnerability assessment of each port of entry located on the northern border

			 or the southern border.</text>

							</subparagraph><subparagraph id="IDcc3d596a46c84f71a41134af19fbe27d"><enum>(B)</enum><header>Port security

			 coordinators</header><text>The Secretary may establish 1 or more port security

			 coordinators at each port of entry located on the northern border or the

			 southern border—</text>

								<clause id="ID565c61eedbb445288f5cdf55f46cbbd7"><enum>(i)</enum><text>to

			 assist in conducting a vulnerability assessment at such port; and</text>

								</clause><clause id="ID3665515134f843eea38539fb7e630e44"><enum>(ii)</enum><text>to

			 provide other assistance with the preparation of the plan required by paragraph

			 (1).</text>

								</clause></subparagraph></paragraph></subsection><subsection id="IDed8e57c0d1fb4eac9440188835ee4a4d"><enum>(e)</enum><header>Expansion of

			 Trade Security Programs</header>

						<paragraph id="ID01487630db2c4dd38cc431fa54f26e96"><enum>(1)</enum><header>Customs-trade

			 partnership against terrorism</header>

							<subparagraph id="ID7c4010f88bda45598621fef5d335f67a"><enum>(A)</enum><header>In

			 general</header><text>Not later than 180 days after the date of enactment of

			 this Act, the Commissioner, in consultation with the Secretary, shall develop a

			 plan to expand the size and scope (including personnel needs) of the

			 Customs-Trade Partnership Against Terrorism programs along the northern border

			 and southern border, including—</text>

								<clause id="IDc4710ec6df654f8fb83235cc3c966f0c"><enum>(i)</enum><text>the

			 Business Anti-Smuggling Coalition;</text>

								</clause><clause id="IDcbdb51c2dfc34dabbcd9dcb949d35767"><enum>(ii)</enum><text>the Carrier

			 Initiative Program;</text>

								</clause><clause id="ID3120bdd0496e47f38f2e9df96ad233d9"><enum>(iii)</enum><text>the Americas

			 Counter Smuggling Initiative;</text>

								</clause><clause id="IDf8eed6ef08634922b9bef5730fc26ea3"><enum>(iv)</enum><text>the Free and

			 Secure Trade Initiative; and</text>

								</clause><clause id="IDb4dc0497d2e441e49d0da9abcd1fa3ec"><enum>(v)</enum><text>other Industry

			 Partnership Programs administered by the Commissioner.</text>

								</clause></subparagraph></paragraph><paragraph id="IDad0472d4ad254324a9cfddeb1ae21ea8"><enum>(2)</enum><header>Maquiladora

			 demonstration program</header><text>Not later than 180 days after the date of

			 enactment of this Act, the Commissioner shall establish a demonstration program

			 to develop a cooperative trade security system with maquiladoras to improve

			 supply chain security.</text>

						</paragraph></subsection><subsection id="IDbbd75e6646324406b5bd8a07d0cec739"><enum>(f)</enum><header>Port of entry

			 technology demonstration program</header>

						<paragraph id="IDf4ec2a748dd14ccf91859c56a3f4c445"><enum>(1)</enum><header>Establishment</header><text>In

			 order to carry out the mission of the Department to achieve operational control

			 of the international borders of the United States, the Secretary shall carry

			 out a technology demonstration program to test and evaluate new port of entry

			 technologies, refine port of entry technologies and operational concepts, and

			 train personnel under realistic conditions. The Commissioner of the Bureau of

			 Customs and Border Protection shall oversee the program in consultation and

			 cooperation with other divisions of the Department.</text>

						</paragraph><paragraph id="ID732e804e71084570ab324bb65ea23874"><enum>(2)</enum><header>Technology and

			 facilities</header>

							<subparagraph id="ID592a8bbed0e04d05941119a22e85ee48"><enum>(A)</enum><header>Technology

			 tested</header><text>Under the demonstration program, the Secretary shall test

			 technologies that enhance port of entry operations, including those related to

			 inspections, communications, port tracking, identification of persons and

			 cargo, sensory devices, personal detection, decision support, and the detection

			 and identification of weapons of mass destruction.</text>

							</subparagraph><subparagraph id="ID4ada08c940ac4ce69d66833e60782c6c"><enum>(B)</enum><header>Facilities

			 developed</header><text>At a demonstration site selected pursuant to paragraph

			 (3)(B), the Secretary shall develop facilities to provide appropriate training

			 to law enforcement personnel who have responsibility for border security,

			 including cross-training among agencies, advanced law enforcement training, and

			 equipment orientation.</text>

							</subparagraph></paragraph><paragraph id="ID7d9ce1e653604ca6a7860fa65544e852"><enum>(3)</enum><header>Demonstration

			 sites</header>

							<subparagraph id="ID38c0230e40c243a388328de1683af4b4"><enum>(A)</enum><header>Number</header><text>The

			 Secretary shall carry out the demonstration program at not less than 3 sites

			 and not more than 5 sites.</text>

							</subparagraph><subparagraph id="IDd012fe45c98547899a45d26c32777297"><enum>(B)</enum><header>Selection

			 criteria</header><text>To ensure that at least 1 of the facilities selected as

			 a port of entry demonstration site for the demonstration program has the most

			 up-to-date design, contains sufficient space to conduct the demonstration

			 program, has a traffic volume low enough to easily incorporate new technologies

			 without interrupting normal processing activity, and can efficiently carry out

			 demonstration and port of entry operations, at least 1 port of entry selected

			 as a demonstration site shall—</text>

								<clause id="IDf08ec38e4f124ce8bc22ca1dbae16ffb"><enum>(i)</enum><text>have been

			 established not more than 15 years before the date of enactment of this

			 Act;</text>

								</clause><clause id="ID4125a73cb68949a68401295031c2c276"><enum>(ii)</enum><text>consist of not

			 less than 65 acres, with the possibility of expansion onto not less than 25

			 adjacent acres; and</text>

								</clause><clause id="IDdd2041bfa52848c393ce2886bf7d42f9"><enum>(iii)</enum><text>have serviced

			 an average of not more than 50,000 vehicles per month in the 12 full months

			 preceding the date of enactment of this Act.</text>

								</clause></subparagraph></paragraph><paragraph id="ID81ae99f95ce242f3bce4a59c189d0091"><enum>(4)</enum><header>Relationship

			 with other agencies</header><text>The Secretary shall permit personnel from an

			 appropriate Federal or State agency to utilize a demonstration site described

			 in paragraph (3) to test technologies that enhance port of entry operations,

			 including those related to inspections, communications, port tracking,

			 identification of persons and cargo, sensory devices, personal detection,

			 decision support, and the detection and identification of weapons of mass

			 destruction.</text>

						</paragraph><paragraph id="ID44100472499847808d5f729dc9480190"><enum>(5)</enum><header>Report</header>

							<subparagraph id="IDd633b4c46495413ba6963f42bcb9b037"><enum>(A)</enum><header>Requirement</header><text>Not

			 later than 1 year after the date of enactment of this Act, and annually

			 thereafter, the Secretary shall submit to Congress a report on the activities

			 carried out at each demonstration site under the technology demonstration

			 program established under this subsection.</text>

							</subparagraph><subparagraph id="IDb88c52256aeb4b3380485f2f34253580"><enum>(B)</enum><header>Content</header><text>Each

			 report submitted pursuant to subparagraph (A) shall include an assessment by

			 the Secretary of the feasibility of incorporating any demonstrated technology

			 for use throughout the Bureau of Customs and Border Protection.</text>

							</subparagraph></paragraph></subsection><subsection id="id198FE8057D1A4CE0B46A52AFC7BB0F2B"><enum>(g)</enum><header>Border Patrol

			 Technology Demonstration Program</header>

						<paragraph id="ID18c96e280f214f749188528b815625fa"><enum>(1)</enum><header>Establishment</header><text>In

			 order to carry out the mission of the Department to achieve operational control

			 of the international borders of the United States, the Secretary shall carry

			 out a technology demonstration program to test and evaluate new border security

			 technologies and train personnel under realistic conditions.</text>

						</paragraph><paragraph id="ID9d3f2fe563cf419ea6e8ce65b90fcfa4"><enum>(2)</enum><header>Technology and

			 facilities</header>

							<subparagraph id="IDfb7124c2a8c44b70899ca4f5c6ceee32"><enum>(A)</enum><header>Technology

			 tested</header><text>Under the demonstration program, the Secretary shall test

			 technologies that enhance border security, including those related to

			 communications, sensory devices, personal detection, and decision

			 support.</text>

							</subparagraph><subparagraph id="ID8637b1506ade4f4ab3df0bae2c373e9a"><enum>(B)</enum><header>Facilities

			 development</header><text>At a site where border patrol agents participate in

			 law enforcement training, the Secretary shall develop facilities to carry out

			 the demonstration program, including providing appropriate training to law

			 enforcement personnel who have responsibility for border security, including

			 cross-training among agencies, advanced law enforcement training, and equipment

			 orientation.</text>

							</subparagraph></paragraph><paragraph id="ID424b3cd3714847e9852b569f2d6a39f6"><enum>(3)</enum><header>Relationship

			 with other agencies</header><text>The Secretary shall permit personnel from an

			 appropriate Federal or State agency to utilize the demonstration site described

			 in this subsection to test technologies that enhance border security, including

			 those related to communications, sensory devices, personal detection, and

			 decision support.</text>

						</paragraph><paragraph id="IDc8adde33e9b64cd7a3c359e367cadddc"><enum>(4)</enum><header>Report</header>

							<subparagraph id="ID4d526e857b6e49b69c4c1a77110b59b1"><enum>(A)</enum><header>Requirement</header><text>Not

			 later than 1 year after the date of enactment of this Act, and annually

			 thereafter, the Secretary shall submit to Congress a report on the activities

			 carried out at the demonstration site under the technology demonstration

			 program established under this subsection.</text>

							</subparagraph><subparagraph id="IDbc8ad58b9d814b809ff3e8b08c538624"><enum>(B)</enum><header>Content</header><text>Each

			 report submitted pursuant to subparagraph (A) shall include an assessment by

			 the Secretary of the feasibility of incorporating any demonstrated technology

			 for use throughout the Department.</text>

							</subparagraph></paragraph></subsection><subsection id="idC99CBAA14EAB498B82C36BB03FC6D017"><enum>(h)</enum><header>International

			 agreements</header><text display-inline="yes-display-inline">Funds authorized

			 in this Act may be used for the implementation of projects described in the

			 Declaration on Embracing Technology and Cooperation to Promote the Secure and

			 Efficient Flow of People and Commerce across our Shared Border between the

			 United States and Mexico, agreed to March 22, 2002, Monterrey, Mexico (commonly

			 known as the Border Partnership Action Plan) or the Smart Border Declaration

			 between the United States and Canada, agreed to December 12, 2001, Ottawa,

			 Canada that are consistent with the provisions of this Act.</text>

					</subsection><subsection id="ID1b080b8ab78a4bfc9dd57e7cf1881da7"><enum>(i)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated the

			 following:</text>

						<paragraph id="ID404c50447ff24c6dac4fe9e9cba85b62"><enum>(1)</enum><text>For each of the

			 fiscal years 2007 through 2011, $1,000,000,000 to carry out subsection

			 (b).</text>

						</paragraph><paragraph id="ID235a38dfb02b4b19ad3c080b778da31a"><enum>(2)</enum><text>For each of the

			 fiscal years 2007 through 2011, such sums as may be necessary to carry out

			 paragraph (1) of subsection (c).</text>

						</paragraph><paragraph id="IDf69ed89720ee4f258a08ce1e53ae4045"><enum>(3)</enum><text>For each of the

			 fiscal years 2007 through 2011, $100,000,000 to carry out paragraph (4) of

			 subsection (c).</text>

						</paragraph><paragraph id="idD505654B1B4A413FAC3F3A7C3AC27ABD"><enum>(4)</enum><text>For each of the

			 fiscal years 2007 through 2011, such sums as may be necessary to carry out

			 subsection (d).</text>

						</paragraph><paragraph id="id468E6062B5914D31BCA63FD2116640E6"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id75F508147A274DD6A2BAF0182A2C53EC"><enum>(A)</enum><text>For fiscal year 2007,

			 $30,000,000 to carry out paragraph (1) of subsection (e); and</text>

							</subparagraph><subparagraph id="id6857C679BE0747258E18CD3C8A0612DC" indent="up1"><enum>(B)</enum><text>For each of the fiscal years 2008

			 through 2011, such sums as may be necessary to carry out such paragraph.</text>

							</subparagraph></paragraph><paragraph id="IDede3cd233cc94820a051d57a11945c17"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idAC37786322E54F5D9E1431F21D4BD7F5"><enum>(A)</enum><text>For fiscal year 2007,

			 $5,000,000 to carry out paragraph (2) of subsection (e); and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5C9E6FDE76D34636A487D749164F6152" indent="up1"><enum>(B)</enum><text>For each of the fiscal years 2008

			 through 2011, such sums as may be necessary to carry out such paragraph.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF84E41AB1DFE4B96AE52E803D4F7B420"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE16E4DB3F06A4F9BA2146619A0417C22"><enum>(A)</enum><text>For fiscal year 2007,

			 $50,000,000 to carry out subsection (f), and not more than $10,000,000 of such

			 amount may be expended for technology demonstration program activities at any 1

			 port of entry demonstration site during such fiscal year.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6197608F0B3B4285A2F4F06E5FC46AFB" indent="up1"><enum>(B)</enum><text>For each of the fiscal years 2008

			 through 2011, such sums as may be necessary to carry out subsection (f), and

			 not more than $10,000,000 may be expended for technology demonstration program

			 activities at any 1 port of entry demonstration site in any such fiscal

			 year.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8B5895B51ACB425A99605CB1069DF155"><enum>(8)</enum><text>For each of the

			 fiscal years 2007 through 2011, $10,000,000 to carry out subsection (g).</text>

						</paragraph></subsection></section><section id="IDf0e564a5bb3543e6ace61f6f42652639"><enum>112.</enum><header>Detention

			 space and removal capacity</header><text display-inline="no-display-inline">Section 5204(a) of the Intelligence Reform

			 and Terrorism Protection Act of 2004 (Public Law 108-458; 118 Stat. 3734) is

			 amended by striking <quote>8,000</quote> and inserting

			 <quote>15,000</quote>.</text>

				</section><section id="IDe5db68a223e64b73b909211a9d924164"><enum>113.</enum><header>Increase of

			 Federal detention space and the utilization of Federal facilities identified

			 for closure</header>

					<subsection id="IDd249dc237c4a4ba9abf7e1d504ef50c6"><enum>(a)</enum><header>Construction or

			 Acquisition of Detention Facilities</header>

						<paragraph id="ID9f29d59745bf48aa92638b6573e33586"><enum>(1)</enum><header>In

			 general</header><text>The Secretary shall construct or acquire additional

			 detention facilities in the United States.</text>

						</paragraph><paragraph id="ID2b8de2bb22014add98344fcf3765e968"><enum>(2)</enum><header>Determination

			 of location</header><text>The location of any detention facility built or

			 acquired in accordance with this subsection shall be determined by the Deputy

			 Assistant Director of the Office of Detention and Removal Operations within the

			 Bureau of Immigration and Customs Enforcement of the Department.</text>

						</paragraph><paragraph id="ID9a2d0544efd64a3788f7654d53151893"><enum>(3)</enum><header>Use of federal

			 facilities identified for closure</header><text>In acquiring detention

			 facilities under this subsection, the Secretary shall, to the maximum extent

			 practical, request the transfer of appropriate portions of military

			 installations approved for closure or realignment and any other Federal

			 facilities identified for closure.</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc26aad4bc95e4920a495f06fa36b485b"><enum>(b)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated such

			 sums as may be necessary to carry out this section.</text>

					</subsection></section><section id="IDb893ecc18b51467f8ef224bee4e67893"><enum>114.</enum><header>Alternatives

			 to detention</header><text display-inline="no-display-inline">The Secretary

			 shall implement demonstration programs in each State located along the

			 international border between the United States and Canada or along the

			 international border between the United States and Mexico to study the

			 effectiveness of alternatives to the detention of aliens, including electronic

			 monitoring devices and intensive supervision programs, that ensure that alien's

			 appearance at court and compliance with removal orders.</text>

				</section></subtitle><subtitle id="id2EAF8DEF464E40E381A91A05CBBAA3BD"><enum>C</enum><header>Grants for

			 States</header>

				<section id="ID55707ae045e0472a926ac5c58d483cb7"><enum>121.</enum><header>Border law

			 enforcement grants</header>

					<subsection id="IDbd88014c1879419d91b7259a05152fe0"><enum>(a)</enum><header>Law enforcement

			 agency defined</header><text>In this section, the term <term>law enforcement

			 agency</term> means a Tribal, State, or local law enforcement agency.</text>

					</subsection><subsection id="ID60b16b17102141dc933f735a78121041"><enum>(b)</enum><header>Authority to

			 award grants</header><text>The Secretary is authorized to award grants to an

			 eligible law enforcement agency to provide assistance with costs associated

			 with State border security efforts, including efforts to combat criminal

			 activity that occurs in the jurisdiction of such agency by virtue of such

			 agency’s proximity to an international border of the United States.</text>

					</subsection><subsection id="IDee1545fb92144019a41e7b8908223784"><enum>(c)</enum><header>Criteria</header><text>The

			 Secretary shall award grants under subsection (b) on a competitive basis,

			 considering criteria including—</text>

						<paragraph id="ID451d628feeff4a0a8c27e3c56ca35bfd"><enum>(1)</enum><text>the law

			 enforcement agency’s distance from the international border, with communities

			 closer to the border given priority because of their proximity;</text>

						</paragraph><paragraph id="IDf0554ad3e7b0426fbd8e5e0aba17580a"><enum>(2)</enum><text>population, with

			 smaller communities given priority;</text>

						</paragraph><paragraph id="IDcadfeeb379b140dfbd27e3677c8bbc44"><enum>(3)</enum><text>the criminal

			 caseload of the law enforcement agency, based upon the number of felony

			 criminal cases filed per judge in the United States district court located in

			 the district that the law enforcement agency has jurisdiction over, with

			 priority given to those with higher caseloads;</text>

						</paragraph><paragraph id="ID914b220f8ff74a51ab7c131d8f1762ab"><enum>(4)</enum><text>the percentage of

			 undocumented aliens residing in the law enforcement agency’s State compared to

			 the total number of such aliens residing in all States, based on the most

			 recent decennial census; and</text>

						</paragraph><paragraph id="ID4a43bf162b2b45d5aa8492b6fd9b4c2c"><enum>(5)</enum><text>the percentage of

			 undocumented alien apprehensions in the law enforcement agency’s State in that

			 fiscal year compared to the total of such apprehensions for all such States for

			 that fiscal year.</text>

						</paragraph></subsection><subsection id="ID6ee40c1565d047048b772db822d58b06"><enum>(d)</enum><header>Use of

			 funds</header><text>Grants awarded under subsection (b) shall be used to

			 provide additional resources for a law enforcement agency to address criminal

			 activity occurring near an international border of the United States,

			 including—</text>

						<paragraph id="ID0807e3450dd945f5aa0dccef1614cad7"><enum>(1)</enum><text>law enforcement

			 technologies;</text>

						</paragraph><paragraph id="ID5ce9884edd854030b19e727b6ff847b7"><enum>(2)</enum><text>equipment such as

			 police-type vehicles, all terrain vehicles, firearms, sensors, cameras, and

			 lighting; and</text>

						</paragraph><paragraph id="ID88810724a2674efa8be54cbd1490a2d1"><enum>(3)</enum><text>such other

			 resources as are available to assist the law enforcement agency.</text>

						</paragraph></subsection><subsection id="ID9353038313ec4138ac5b5909543d794f"><enum>(e)</enum><header>Application</header><text>The

			 head of a law enforcement agency seeking to apply for a grant under this

			 section shall submit an application to the Secretary at such time, in such

			 manner, and with such information as the Secretary may require.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID906bd8aecc184f25807b2f253748db87"><enum>(f)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated

			 $500,000,000 for each of the fiscal years 2007 through 2011 to carry out this

			 section.</text>

					</subsection></section></subtitle></title><title id="id909A5E35A10F4289995F8A2179892506"><enum>II</enum><header>Immigration

			 provisions </header>

			<section id="id40CE68935BD44461B773ABC193DF59BA"><enum>201.</enum><header>Expedited

			 removal between ports of entry</header>

				<subsection id="IDf66fa3d39aac40c280b26fd938d32f76"><enum>(a)</enum><header>In

			 general</header><text>Section 235 of the Immigration and Nationality Act (8

			 U.S.C. 1225) is amended—</text>

					<paragraph id="ID5992f882d004402b8c570c113556e16d"><enum>(1)</enum><text>in subsection

			 (b)(1)(A)(i), by striking <quote>the officer</quote> and inserting <quote>a

			 supervisory officer</quote>; and</text>

					</paragraph><paragraph id="IDb492bcd13c944f2a9b546a8b01778d25"><enum>(2)</enum><text>in subsection

			 (c), by adding at the end the following:</text>

						<quoted-block display-inline="no-display-inline" id="idB51E6B9CDEF44F11988666FD9CDD7716" style="OLC">

							<paragraph id="IDa8d25d7ecd644a64851d3d4a332f03eb"><enum>(4)</enum><header>Expansion</header><text>The

				Secretary of Homeland Security shall make the expedited removal procedures

				under this subsection available in all border patrol sectors on the southern

				border of the United States as soon as operationally possible.</text>

							</paragraph><paragraph id="IDc386c3baf65248cca9f8703c79a900a3"><enum>(5)</enum><header>Training</header><text>The

				Secretary of Homeland Security shall provide employees of the Department of

				Homeland Security with comprehensive training on the procedures authorized

				under this

				subsection.</text>

							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection id="ID08ba5402fe8a41aa913519781c46d956"><enum>(b)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated

			 $20,000,000 for each of fiscal years 2007 through 2011 to carry out the

			 amendments made by this section.</text>

				</subsection></section><section id="ID2ecaa53a09cc403fa63092d1ecb7a8c3"><enum>202.</enum><header>Cancellation

			 of visas</header><text display-inline="no-display-inline">Section 222(g) of the

			 Immigration and Nationality Act (8 U.S.C. 1202(g)) is amended—</text>

				<paragraph id="ID1a124b934a7d4690a1f77c11427fc456"><enum>(1)</enum><text>in paragraph (1),

			 by inserting <quote>and any other nonimmigrant visa issued by the United States

			 that is in the possession of the alien</quote> after <quote>such visa</quote>;

			 and</text>

				</paragraph><paragraph id="ID21749d91d5d843f5a2490aaf9fd0972d"><enum>(2)</enum><text>in paragraph

			 (2)(A), by striking <quote>(other than the visa described in paragraph (1))

			 issued in a consular office located in the country of the aliens

			 nationality</quote> and inserting <quote>(other than a visa described in

			 paragraph (1)) issued in a consular office located in the country of the aliens

			 nationality or foreign residence</quote>.</text>

				</paragraph></section><section id="IDfb15f110e3ce4dc3a4911e608127d5e1"><enum>203.</enum><header>Biometric

			 entry-exit system</header>

				<subsection id="IDdba0ac22df6c4afb99b6e924332d7c0b"><enum>(a)</enum><header>Grounds of

			 inadmissibility</header><text>Section 212 of the Immigration and Nationality

			 Act (8 U.S.C. 1182) is amended—</text>

					<paragraph id="IDb9e455c2a2a441f1a67a2f52950a30d9"><enum>(1)</enum><text>in subsection

			 (a)(7), by adding at the end the following:</text>

						<quoted-block display-inline="no-display-inline" id="id4EB43A86077B497B981382B2369B70E4" style="OLC">

							<paragraph id="IDec4da39003db4892bea87903a861762e"><enum>(C)</enum><header>Withholders of

				biometric data</header><text>Any alien who fails to comply with a lawful

				request for biometric data is

				inadmissible.</text>

							</paragraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

					</paragraph><paragraph id="ID587b9c93ddf149de88ad22558c32a177"><enum>(2)</enum><text>in subsection

			 (d), by inserting after paragraph (1) the following:</text>

						<quoted-block display-inline="no-display-inline" id="id0DF9C94D0F5444C68498C3A4300927B2" style="OLC">

			 subsection (c) as subsection (g); and</text>

			 applicants for admission</header><text>Section 235(d) of the Immigration and

			 Nationality Act (8 U.S.C. 1185(d)) is amended by adding at the end the

			 following:</text>

				admission or alien seeking to transit through the United States; or</text>

			 biometric data from alien crewman</header><text>Section 252 of the Immigration

			 and Nationality Act (8 U.S.C. 1282) is amended by inserting <quote>Immigration

			 officers are authorized to collect biometric data from any alien crewman

			 seeking permission to land temporarily in the United States.</quote> after

			 <quote>this title</quote>.</text>

				penalties for certain crimes committed by illegal aliens</header>

								<subsection id="IDbd4ca37a2c76462989dc3c82592241a5"><enum>(a)</enum><text>Any alien

				unlawfully present in the United States, who commits, or conspires or attempts

				to commit, a crime of violence or a drug trafficking offense (as defined in

				section 924), shall be fined under this title and sentenced to not less than 5

				years in prison.</text>

								</subsection><subsection id="ID0ef446b8f2d54e8a88214b0358fbbf52"><enum>(b)</enum><text>If an alien who

				violates subsection (a) was previously ordered removed under the Immigration

				and Nationality Act (8 U.S.C. 1101 et seq.) on the grounds of having committed

				a crime, the alien shall be sentenced to not less than 15 years in

				prison.</text>

								</subsection><subsection id="ID2c07f64c7b5f48f78a8ae1cb8f298dc4"><enum>(c)</enum><text>A sentence of

				imprisonment imposed under this section shall run consecutively to any other

				sentence of imprisonment imposed for any other

				crime.</text>

								</subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>

			 removable criminal aliens in Federal and State correctional facilities;</text>

						</subparagraph><subparagraph id="IDb012288077fb481a8dd2fc2e23fc6ebf"><enum>(B)</enum><text>ensure that such

			 aliens are not released into the community; and</text>

						</subparagraph><subparagraph id="ID9490ebb962854b188b4c2d1e1fb3f814"><enum>(C)</enum><text>remove such

			 aliens from the United States after the completion of their sentences.</text>

						</subparagraph></paragraph><paragraph id="ID620844ba85dc444db9659b5963e15b13"><enum>(2)</enum><header>Expansion</header><text>Not

			 later than 5 years after the date of the enactment of this Act, the Secretary

			 shall expand the Institutional Removal Program to every State.</text>

					</paragraph><paragraph id="id8396B58886DA4C39870B3AD0EFC87A1E"><enum>(3)</enum><header>State

			 participation</header><text>The appropriate officials of each State in which

			 the Secretary is operating the Institutional Removal Program should—</text>

						<subparagraph id="ID7d657a498d1844bb8503e09afe44985b"><enum>(A)</enum><text>cooperate with

			 Federal officials carrying out the Institutional Removal Program;</text>

						</subparagraph><subparagraph id="IDed8480194f8640949c9ccf206ffa1698"><enum>(B)</enum><text>expeditiously and

			 systematically identify criminal aliens in the prison and jail populations of

			 the State; and</text>

						</subparagraph><subparagraph id="ID7fc7c4d7164a452dbce4012be3306d4d"><enum>(C)</enum><text>promptly convey

			 the information described in subparagraph (B) to the appropriate officials

			 carrying out the Institutional Removal Program.</text>

						</subparagraph></paragraph></subsection><subsection id="IDfeea28ec85a747f98c2516d98d77f58d"><enum>(b)</enum><header>Report to

			 congress</header><text>Not later than 2 years after of the date of the

			 enactment of this Act, the Secretary shall submit a report to Congress on the

			 participation of the States in the Institutional Removal Program.</text>

				</subsection><subsection id="idB853DE6BB6D24BE08764A50A10492E76"><enum>(c)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated

			 $50,000,000 to carry out the expanded Institutional Removal Program authorized

			 under subsection (a).</text>

				</subsection></section><section id="ID5835546c3c0d47e3b979b96681bb4a91"><enum>402.</enum><header>Authorization

			 for detention after completion of state or local prison sentence</header>

				<subsection id="idE4475CFFA6CF4E74B1ABFC684C73DBFA"><enum>(a)</enum><header>In

			 general</header><text>Law enforcement officers of a State or political

			 subdivision of a State are authorized to—</text>

					<paragraph id="ID1ff3bd9da78e425dacaaa3f4a0818edc"><enum>(1)</enum><text>hold an illegal

			 alien for a period of up to 14 days after the alien has completed the alien's

			 State or local prison sentence in order to effectuate the transfer of the alien

			 to Federal custody when the alien is removable or not lawfully present in the

			 United States; or</text>

					</paragraph><paragraph id="IDba42fb1311514d91a5735d4e0e974f7d"><enum>(2)</enum><text>issue a detainer

			 that would allow aliens who have served a State or local prison sentence to be

			 detained by an appropriate prison until personnel from the Bureau of

			 Immigration and Customs Enforcement can take the alien into Federal

			 custody.</text>

					</paragraph></subsection><subsection id="id451CB20F8F5D4679AFF041C33597B7A3"><enum>(b)</enum><header>Reimbursement</header>

					<paragraph id="ID579e415898c14b58a7c47d423c5075b8"><enum>(1)</enum><header>In

			 general</header><text>The Secretary shall reimburse a State or a political

			 subdivision of a State for all reasonable expenses incurred by the State or the

			 political subdivision for the detention of an alien as described in subsection

			 (a).</text>

					</paragraph><paragraph id="id802618AED3C1480489A8DD57FDC1BF40"><enum>(2)</enum><header>Cost

			 computation</header><text>The amount of reimbursement provided for costs

			 incurred carrying out subsection (a) shall be determined pursuant to a formula

			 determined by the Secretary.</text>

					</paragraph></subsection><subsection id="idCB3E005E724A40C0835928624DDEB568"><enum>(c)</enum><header>Technology

			 usage</header><text>Technology such as videoconferencing shall be used to the

			 maximum extent possible in order to make the Institutional Removal Program

			 available in remote locations. Mobile access to Federal databases of aliens and

			 live scan technology shall be used to the maximum extent practicable in order

			 to make these resources available to State and local law enforcement agencies

			 in remote locations.</text>

				</subsection><subsection id="ID8547bca23f4142d7bd7bda34135a4e77"><enum>(d)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated such sums as may be necessary to reimburse a

			 State or political subdivision of a State for the detention of an illegal alien

			 pursuant to subsection (b).</text>

				</subsection></section><section id="IDb288734cf3584ccc948dcfbb87e8c6f3"><enum>403.</enum><header>Use of the

			 National Crime Information Center Database to track violations of immigration

			 law</header>

				<subsection id="id62DB149ABFBA4FDDACD6ED60E8FBDF79"><enum>(a)</enum><header>Provision of

			 Information to the National Crime Information Center</header>

					<paragraph id="IDdaafb5117df6488bb65b7bac04aa3204"><enum>(1)</enum><header>In

			 general</header><text>Not later than 1 year after the date of enactment of this

			 Act, the Secretary shall provide the National Crime Information Center of the

			 Department of Justice with such information as the Director may have related

			 to—</text>

						<subparagraph id="IDcdcc34b4cc174e5b88342d50aed56227"><enum>(A)</enum><text>any alien against

			 whom a final order of removal has been issued;</text>

						</subparagraph><subparagraph id="IDeb7dfb3749bc4093958fef22de5c5dcc"><enum>(B)</enum><text>any alien who is

			 subject to a voluntary departure agreement that has become invalid under

			 section 240B(a)(2) of the Immigration and Nationality Act (8 U.S.C. 1229c);

			 and</text>

						</subparagraph><subparagraph id="IDa75f295119304cc9b48e077aafe87140"><enum>(C)</enum><text>any alien whose

			 visa has been revoked.</text>

						</subparagraph></paragraph><paragraph id="ID737b1c0d0c634e69aec415a1f6db162e"><enum>(2)</enum><header>Requirement To

			 provide and use information</header><text>The information described in

			 paragraph (1) shall be provided to the National Crime Information Center, and

			 the Center shall enter the information into the Immigration Violators File of

			 the National Crime Information Center database if the name and date of birth

			 are available for the individual, regardless of whether the alien received

			 notice of a final order of removal or the alien has already been

			 removed.</text>

					</paragraph><paragraph id="IDba18fa69b9454333b6a1b82c56a13a1e"><enum>(3)</enum><header>Removal of

			 information</header><text>Should an individual be granted cancellation of

			 removal under section 240A of the Immigration and Nationality Act (8 U.S.C.

			 1229b), or granted permission to legally enter the United States pursuant to

			 the Immigration and Nationality Act after a voluntary departure under section

			 240B of the Immigration and Nationality Act (8 U.S.C. 1229c), information

			 entered into the National Crime Information Center in accordance with paragraph

			 (1) of this section shall be promptly removed.</text>

					</paragraph></subsection><subsection id="IDad8c7a6585eb46d385ba6677f1df10f5"><enum>(b)</enum><header>Inclusion of

			 information in the National Crime Information Center

			 Database</header><text>Section 534(a) of title 28, United States Code, is

			 amended—</text>

					<paragraph id="ID92e8233093a64138b9521c15006782b1"><enum>(1)</enum><text>in paragraph (3),

			 by striking <quote>and</quote> at the end;</text>

					</paragraph><paragraph id="IDa3a0694f2761483b9d57c12a4111bc96"><enum>(2)</enum><text>by redesignating

			 paragraph (4) as paragraph (5); and</text>

					</paragraph><paragraph id="ID5afc60b729b84484900bb2f1c0bddad4"><enum>(3)</enum><text>by inserting

			 after paragraph (3) the following new paragraph:</text>

						<quoted-block display-inline="no-display-inline" id="idA05EA1066B084968BCF2E2A5F71C86FB" style="OLC">

							<paragraph id="ID07ada486f6a545dca5bdb2fbcf22a91c"><enum>(4)</enum><text>acquire, collect,

				classify, and preserve records of violations of the immigration laws of the

				United States, regardless of whether the alien has received notice of the

				violation or the alien has already been removed;

				and</text>

							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
