		<official-title display="yes">To amend the Immigration and Nationality

		  Act to resolve inequities in existing law by reducing the residency requirement

		  for the naturalization of aliens with extraordinary ability so that such aliens

		  may represent the United States at international events.</official-title>

		<section commented="no" display-inline="no-display-inline" id="id072E5685F1F74C4EA3DA8051C6C461A3" section-type="section-one"><enum>1.</enum><header>Naturalization of aliens with

			 extraordinary ability</header>

			<subsection commented="no" display-inline="no-display-inline" id="id1A9E795603D34AAEB139B7788FDC27C1"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 316 of the

			 Immigration and Nationality Act (8 U.S.C. 1427), is amended by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="idB64FBFB486304D7E97850F4BE8886A59" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="ID8b515c16581b4f9e97daa8fd5763acc2"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id284A052886E7417DA404B23D98CAB698"><enum>(1)</enum><text display-inline="yes-display-inline">The continuous residency requirement under

				subsection (a) may be reduced to 3 years for an applicant for naturalization

				if—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="id280CD429B96E4DE892E3528D78FA6231" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the applicant is the beneficiary of an

				approved petition for classification under section 204(a)(1)(E);</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3559F2E0DADA4D3597762E8B00E8B19D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the applicant has been approved for

				adjustment of status under section 245(a); and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7075B21CB9014E068E426C7ED8E36596" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">such reduction is necessary for the

				applicant to represent the United States at an international event.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id004C2C3A4E4C4371805AE0D819A76C92" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall

				adjudicate an application for naturalization under this section not later than

				30 days after the submission of such application if the applicant—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="id6B92069419C84287B05CE5F773409D0B"><enum>(A)</enum><text display-inline="yes-display-inline">requests such expedited adjudication in

				order to represent the United States at an international event; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2A18B6C849994F3498007CB91E4717C8"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrates that such expedited

				adjudication is related to such representation.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74EC0CC3564B4EF58FF67B1EC257A4FF" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">An applicant is ineligible for expedited

				adjudication under paragraph (2) if the Secretary of Homeland Security

				determines that such expedited adjudication poses a risk to national security.

				Such a determination by the Secretary shall not be subject to review.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2C68A2F47418469CB78BAFD9D74F2A09" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE9B2F9D9F0964D8F9711AB7B64925BA4"><enum>(A)</enum><text display-inline="yes-display-inline">In addition to any other fee authorized by

				law, the Secretary of Homeland Security shall charge and collect a $1,000

				premium processing fee from each applicant described in this subsection to

				offset the additional costs incurred to expedite the processing of applications

				under this subsection.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF8BA926C08A444899C103CEDA7479AFA" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The fee collected under subparagraph (A)

				shall be deposited as offsetting collections in the Immigration Examinations

				Fee

				Account.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idAB05266C0D5E4066B162FE28BBE54558"><enum>(b)</enum><header>Effective

			 date</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDd0538b46f9c245a186a0c6807a23724a"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The amendment made by

			 subsection (a)—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id75AB09FA779C489FAEF042C00C1FF902"><enum>(A)</enum><text display-inline="yes-display-inline">shall take effect on the date of enactment

			 of this Act; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8EE9E02EB94F46BEBDAF7293D1BA3DEA"><enum>(B)</enum><text display-inline="yes-display-inline">is repealed on January 14, 2006.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID00a1f35b79f447e8a94491c37924b112"><enum>(2)</enum><header>Implementation</header><text display-inline="yes-display-inline">Beginning on the date of enactment of this

			 Act, the Secretary of Homeland Security shall accept and process applications

			 for naturalization filed by aliens described in section 316(g)(1) of the

			 Immigration and Nationality Act (8 U.S.C. 1427(g)(1)) in accordance with the

			 amendment made by subsection (a).</text>
