		<official-title>To require the Administrator of the Environmental

		  Protection Agency to establish performance standards for fine particulates for

		  certain pulp and paper mills, and for other purposes.</official-title>

		<section id="idF3F5F0596ED1478F9534580EEBC02DB6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Tire-Derived Fuel Safety Act of

			 2005</short-title></quote>.</text>

		</section><section id="id882BC07094D04A40949F1A7C459B6A86" section-type="subsequent-section"><enum>2.</enum><header>Combustion of

			 tire-derived fuel</header>

			<subsection id="id07B0F4C89621495EA7D9F2B73B09AF8A"><enum>(a)</enum><header>Definitions</header><text>In

			 this section:</text>

				<paragraph id="idB64E315F3CA64CD68116E8C30EFAE380"><enum>(1)</enum><header>Administrator</header><text>The

			 term <term>Administrator</term> means the Administrator of the Environmental

			 Protection Agency.</text>

				</paragraph><paragraph id="idADC3BDD995B7447485E2A0953A9FC441"><enum>(2)</enum><header>Eligible

			 mill</header><text display-inline="yes-display-inline">The term <term>eligible

			 mill</term> means any pulp or paper mill (SIC code 2611 or 2621) that burns or

			 proposes to burn tire-derived fuel.</text>

				</paragraph><paragraph id="id4B791878D7FB41B191F77977B41C52AD"><enum>(3)</enum><header>Emission</header><text>The

			 term <term>emission</term> means an emission into the air of—</text>

					<subparagraph id="id1A1EF91692DA4F6EADEBA8FC08FA3D4F"><enum>(A)</enum><text>a criteria

			 pollutant, including a fine particulate; or</text>

					</subparagraph><subparagraph id="id0F3FEE7DAD5745E79D7A5A062A7DB102"><enum>(B)</enum><text>a hazardous air

			 pollutant.</text>

					</subparagraph></paragraph><paragraph id="idD1FA2E778AD84175B517B4412F7A5068"><enum>(4)</enum><header>Tire-derived

			 fuel</header><text>The term <term>tire-derived fuel</term> means fuel derived

			 from whole or shredded tires, including in combination with another

			 fuel.</text>

				</paragraph></subsection><subsection id="id2D15059883FA43D0A2C375359F80C97D"><enum>(b)</enum><header>Requirements

			 for approval</header>

				<paragraph id="id293633593E3E487FAE748DD3CFC9FF47"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 paragraph (2), notwithstanding any other provision of law, the Administrator

			 shall not issue a permit under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et

			 seq.), and shall object to the issuance of a permit under section 505(b) of

			 that Act (42 U.S.C. 7661d(b)), authorizing the burning of tire-derived fuel at

			 an eligible mill that is a major stationary source (as defined in section

			 111(a) of that Act (42 U.S.C. 7411(a))) unless—</text>

					<subparagraph id="ID404740D9C56F43349C8819C5A1F3AEB3"><enum>(A)</enum><text>the Administrator

			 has listed the source as part of a source category for which a performance

			 standard has been established under subsection (c); and</text>

					</subparagraph><subparagraph id="IDF26344121F3C48B0AC1D811E0D178497"><enum>(B)</enum><text>the source

			 demonstrates to the satisfaction of the Administrator that the source—</text>

						<clause id="idB218CAFF020C4A5F96503657180186B3"><enum>(i)</enum><text>will install any

			 control equipment required or make the necessary process changes before the

			 date on which the source begins operation; and</text>

						</clause><clause id="idFFED23E4BD8E4844B4FA1ACC628A6577"><enum>(ii)</enum><text>will operate at

			 or below the required emissions performance standards as demonstrated by data

			 from a continuous emissions monitoring device.</text>

						</clause></subparagraph></paragraph><paragraph id="id246B8071546F486A9B36BF226C721AD4"><enum>(2)</enum><header>Interim

			 permits</header><text>Notwithstanding paragraph (1), the Administrator may

			 approve an interim permit (including a trial permit) to burn tire-derived fuel

			 at a new eligible mill, or an eligible mill in existence on the date of

			 enactment of this Act, that is a major stationary source (as defined in section

			 111(a) of the Clean Air Act (42 U.S.C. 7411(a))) that demonstrates to the

			 satisfaction of the Administrator that the source—</text>

					<subparagraph id="id12DC6B7E8D3B411FB5D6533F20FF95C6"><enum>(A)</enum><text>will

			 install—</text>

						<clause id="idE4770EEBEC434138924FA5F9D0D1177F"><enum>(i)</enum><text>an

			 electrostatic precipitator;</text>

						</clause><clause id="id7C2017141AC14AEDA82C22C0135D3BDB"><enum>(ii)</enum><text>a

			 Kevlar baghouse; or</text>

						</clause><clause id="id9E80EA0002364F35A693FD9179D1CECE"><enum>(iii)</enum><text>any other

			 technology that achieves a reduction in emissions that is equivalent to the

			 reduction achieved using an electrostatic precipitator or a Kevlar baghouse;

			 and</text>

						</clause></subparagraph><subparagraph id="id4C7695A5D79C4EF78992D19A5F3E7EBF"><enum>(B)</enum><text>will operate at

			 or below the required emissions performance standards as demonstrated by data

			 from a continuous emissions monitoring device.</text>

					</subparagraph></paragraph></subsection><subsection id="id938F2B9234084C58A1C17E141000699F"><enum>(c)</enum><header>Standards for

			 certain pulp and paper mills</header>

				<paragraph id="id66F3B63131D14959AAAC090575E91A60"><enum>(1)</enum><header>Establishment</header>

					<subparagraph id="id86E88C54962A48D3BBE22A322108AA7C"><enum>(A)</enum><header>In

			 general</header><text>Not later than 18 months after the date of enactment of

			 this Act, the Administrator shall establish performance standards for fine

			 particulates for—</text>

						<clause id="id9903865E21904DE194C76B71AC96A3D3"><enum>(i)</enum><text>new

			 eligible mills; and</text>

						</clause><clause id="id273310D203FC4F06A18C65E95E30CF35"><enum>(ii)</enum><text>eligible mills

			 in existence on the date on which the standards are proposed.</text>

						</clause></subparagraph><subparagraph id="id9A1E78E186934CB6AEE0572535CDD147"><enum>(B)</enum><header>Requirements</header><text>In

			 establishing standards under subparagraph (A), the Administrator shall—</text>

						<clause id="id329DD507A39B4862A9D1AC5B491B3372"><enum>(i)</enum><text>ensure that the

			 standards would result in reductions in emission levels that are at least equal

			 to reductions achieved through the use of an electrostatic precipitator or

			 Kevlar baghouse; and</text>

						</clause><clause id="id49CB367DE7BB4382AE574718C7BC4E66"><enum>(ii)</enum><text>require pulp and

			 paper mills that are in operation as of the date on which the standards are

			 proposed, but that are not in compliance with those standards, to come into

			 compliance with the standards by not later than 18 months after the effective

			 date of the standards.</text>

						</clause></subparagraph></paragraph><paragraph id="id617C89096E564313903A93F1D8B35898"><enum>(2)</enum><header>Study and

			 report on general health effects</header><text>Not later than 1 year after the

			 date of enactment of this Act, the Administrator shall conduct a study, and

			 submit to Congress a report, on the impact on human health of increased

			 emissions, especially fine particulates, from the use of tire-derived

			 fuel.</text>

				</paragraph><paragraph id="idE3DFE5683DEE408385EA5D390FFCFFCD"><enum>(3)</enum><header>Report on

			 health effects on certain children</header><text>As soon as practicable after

			 the date of enactment of this Act, the Administrator, in coordination with the

			 Secretary of Health and Human Services, shall submit to Congress a report that

			 describes the rates of birth defects and childhood diseases (particularly

			 respiratory and immune system diseases) of children that live or attend school

			 within a 20-mile radius of any pulp and paper mill that burns tire-derived

			 fuel.</text>

				</paragraph></subsection></section></legis-body>
