		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>BSE and Other Prion Disease

			 Prevention and Public Health Protection Act</short-title></quote>.</text>

		</section><section id="IDc100243dff6141868767f0eecb2b3fa8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="IDc54df3c0bc944a89a1b79e6d49c989f9"><enum>(1)</enum><header>BSE</header><text>The

			 term <term>BSE</term> means bovine spongiform encephalopathy.</text>

			</paragraph><paragraph id="ID6178564413a24b76b76a89d815a8a120"><enum>(2)</enum><header>Covered

			 article</header>

				<subparagraph id="IDbb273179dd784aad93d39917b778b61e"><enum>(A)</enum><header>In

			 general</header><text>The term <term>covered article</term> means—</text>

					<clause id="ID22e39b3658d3441c8c711b07e71dc451"><enum>(i)</enum><text>food or feed for

			 a human or animal;</text>

					</clause><clause id="IDac6d199b0c8f41ccacd5fc32eb69207e"><enum>(ii)</enum><text>a

			 food or nutritional supplement;</text>

					</clause><clause id="ID786e05bc30cb43fe8bba201b759536cb"><enum>(iii)</enum><text>a

			 medicine;</text>

					</clause><clause id="IDff2531defed343acbffcde525a9ae3cb"><enum>(iv)</enum><text>a

			 pituitary-derived hormone;</text>

					</clause><clause id="IDa76363b419fa49259bd4d7ac9e043aaf"><enum>(v)</enum><text>transplant

			 material;</text>

					</clause><clause id="IDd9732be69d894a6bb099921a30b6a530"><enum>(vi)</enum><text>a

			 fertilizer derived from animals;</text>

					</clause><clause id="ID50b5169e56b94616a0dbb786cfb36ab2"><enum>(vii)</enum><text>a

			 cosmetic; and</text>

					</clause><clause id="IDdde236c109f347cd95a23aa023875d43"><enum>(viii)</enum><text>any other

			 article of a kind that is ordinarily ingested, implanted, or otherwise taken

			 into a human or animal.</text>

					</clause></subparagraph><subparagraph id="ID4095aa465ce0457fbe064985d57f32c8"><enum>(B)</enum><header>Exclusions</header><text>The

			 term <term>covered article</term> does not include—</text>

					<clause id="ID2042e1edaddb4f38979c6cda6a1bb290"><enum>(i)</enum><text>an

			 unprocessed agricultural commodity that is readily identifiable as nonanimal in

			 origin, such as a vegetable, grain, or nut;</text>

					</clause><clause id="ID6d06e49be0b14add95cea1c64b499ed6"><enum>(ii)</enum><text>an

			 article described in subparagraph (A) that, based on compelling scientific

			 evidence, the Secretary determines does not pose a risk of transmitting prion

			 disease; or</text>

					</clause><clause id="ID0e861643cf6b4fef974b533c1c3a2f47"><enum>(iii)</enum><text>an article

			 regulated by the Secretary that, as determined by the Secretary—</text>

						<subclause id="ID8bc1ba812cb2470e96d0b84b0c68bcdd"><enum>(I)</enum><text>poses a minimal

			 risk of carrying prion disease; and</text>

						</subclause><subclause id="IDe82158425e124f42bd666ef6b5e39055"><enum>(II)</enum><text>is necessary to

			 protect animal health or public health.</text>

						</subclause></clause></subparagraph></paragraph><paragraph id="IDab0b6efae19240cd86e2db4c40740665"><enum>(3)</enum><header>CWD</header><text>The

			 term <term>CWD</term> means chronic wasting disease.</text>

			</paragraph><paragraph id="IDead5450e096b441c8ca99dda3ab8ff62"><enum>(4)</enum><header>Prion

			 disease</header><text>The term <term>prion disease</term> means—</text>

				<subparagraph id="ID04d9a66a440c49a395012493620cc05a"><enum>(A)</enum><text>a transmissible

			 spongiform encephalopathy (including prion diseases that affect humans, cattle,

			 bison, sheep, goats, deer, elk, and mink); and</text>

				</subparagraph><subparagraph id="IDccbfba59df8048119bc0c54a99931560"><enum>(B)</enum><text>any related

			 disease, as determined by the Secretary in consultation with the Secretary of

			 Agriculture.</text>

				</subparagraph></paragraph><paragraph id="IDe653d974df194afbb0f06cc170107143"><enum>(5)</enum><header>Specified risk

			 material</header>

				<subparagraph id="IDd5d585771bf647c1af4bec107c0aebe6"><enum>(A)</enum><header>In

			 general</header><text>The term <term>specified risk material</term>

			 means—</text>

					<clause id="ID6feed8fcc5874c4b8fef0afda2bb4844"><enum>(i)</enum><text>the

			 skull, brain, trigeminal ganglia, eyes, tonsils, spinal cord, vertebral column,

			 or dorsal root ganglia of—</text>

						<subclause id="IDb09982dc4b604940a16349d7c687f932"><enum>(I)</enum><text>cattle and bison

			 30 months of age and older; or</text>

						</subclause><subclause id="ID1efeee688e1f4577bd0b7b50cee5658d"><enum>(II)</enum><text>sheep, goats,

			 deer, and elk 12 months of age and older;</text>

						</subclause></clause><clause id="ID4706d2f6cba74f2cbcfe41a95f5ff3b8"><enum>(ii)</enum><text>the intestinal

			 tract of a ruminant of any age; or</text>

					</clause><clause id="ID3d3cf5a90d5146dd9f70cff0e77fa8b3"><enum>(iii)</enum><text>any other

			 material of a ruminant that may carry a prion disease, as determined by the

			 Secretary in consultation with the Secretary of Agriculture, based on

			 scientifically credible research.</text>

					</clause></subparagraph><subparagraph id="IDd49c814033ce43d8a80bf0888afdf530"><enum>(B)</enum><header>Modification</header><text>The

			 Secretary, in consultation with the Secretary of Agriculture, may modify the

			 definition of specified risk material based on scientifically credible

			 research.</text>

				</subparagraph></paragraph><paragraph id="IDf0692d30aa3c43f4b9c754a9cfdb076c"><enum>(6)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of Health and Human

			 Services.</text>

			</paragraph></section><section id="ID36af590800234fe7b95fa1b7f2d4577a"><enum>3.</enum><header>Protection of

			 borders</header>

			<subsection id="IDd5dfb6a803ba4ba6aa7988337c97602b"><enum>(a)</enum><header>Prohibitions</header>

				<paragraph id="ID5802d91b21dc44459d16e546e3fae6cc"><enum>(1)</enum><header>Disclosure

			 requirement</header><text>It shall be unlawful for any person to import a

			 covered article—</text>

					<subparagraph id="IDea289ca46f664403a13736be09579f4d"><enum>(A)</enum><text>in the case of a

			 covered article that contains animal-derived material, if the covered article

			 does not exhibit or contain, or is not otherwise accompanied by, a statement in

			 English that—</text>

						<clause id="IDa6839c9ae32d41769fc423a53d7f0757"><enum>(i)</enum><text>states that the

			 covered article contains animal-derived material;</text>

						</clause><clause id="IDab5eb360f984442f8525cd1893857c01"><enum>(ii)</enum><text>states the

			 common English name of the animal from which the material in the article is

			 derived; and</text>

						</clause><clause id="IDc5f3bb68883342f48e6697f41091f3cb"><enum>(iii)</enum><text>if the animal

			 from which the material in the covered article is derived is a ruminant—</text>

							<subclause id="ID6669f20eed1747b89af189f8c9af2230"><enum>(I)</enum><text>identifies the

			 country of origin of the ruminant; and</text>

							</subclause><subclause id="IDa7b8d0a7fbcb43978dcd2182de52779e"><enum>(II)</enum><text>states whether

			 specified risk material from the ruminant is or may be part of the covered

			 article; or</text>

							</subclause></clause></subparagraph><subparagraph id="IDe50535c741094902aacec1ec873cc85c"><enum>(B)</enum><text>in the case of a

			 covered article that does not contain animal-derived material, if the covered

			 article does not exhibit or contain, or is not otherwise accompanied by, a

			 statement in English that states that the covered article does not contain

			 animal-derived material.</text>

					</subparagraph></paragraph><paragraph id="ID1891ab2e818d4c2590397395dacfda40"><enum>(2)</enum><header>Prohibition of

			 importation</header><text>It shall be unlawful for any person to import a

			 covered article described in section 2(2)(A) if, as determined by the Secretary

			 of Agriculture—</text>

					<subparagraph id="idAFFAFED31C4E4D6DAC9E35D62167D2C4"><enum>(A)</enum><text>the article

			 contains animal-derived material from a ruminant that was in any country at a

			 time at which there was a risk of transmission of BSE in the country;

			 and</text>

					</subparagraph><subparagraph id="idB76F1AA918604E77BF185AEABC0A7B3F"><enum>(B)</enum><text>the country did

			 not meet the guidelines on BSE established in the World Organization for Animal

			 Health’s (OIE) Terrestrial Animal Health Code.</text>

					</subparagraph></paragraph></subsection><subsection id="IDb07f15d5734a452ba70c01d39035ba55"><enum>(b)</enum><header>Regulations</header><text>Not

			 later than 1 year after the date of enactment of this Act, the Secretary, in

			 consultation with the Secretary of Agriculture, shall promulgate regulations

			 that establish standards for compliance with this section, including—</text>

				<paragraph id="ID5d1289fec22a418998e9e09cc3bd5b03"><enum>(1)</enum><text>the manner of

			 disclosure that shall be considered to be in compliance with this

			 subsection;</text>

				</paragraph><paragraph id="IDe73356ab1bc74784abdafaec7709c44b"><enum>(2)</enum><text>any manner of

			 disclosure that shall be considered not to be in compliance with this

			 subsection; and</text>

				</paragraph><paragraph id="ID52a7e01e55884e2895c470686f5d3023"><enum>(3)</enum><text>definitions of

			 the terms <term>animal-derived material</term>, <term>country of origin</term>,

			 and other terms used but not defined in this section.</text>

				</paragraph></subsection><subsection id="ID2d8933b88e054c78a8c1a23ac118cb29"><enum>(c)</enum><header>Interim

			 guidance</header><text>Until the date on which final regulations promulgated

			 under subsection (b) become effective, the Secretary shall provide guidance and

			 advice on general applicability of, and compliance with, this section.</text>

			</subsection><subsection id="ID83662eb67e5a425bae07b5e475894b21"><enum>(d)</enum><header>Enforcement</header><text>For

			 the purposes of administering the customs laws of the United States, the

			 requirement to comply with subsection (a)(1) shall be treated as a requirement

			 to mark an article under section 304 of the Tariff Act of 1930 (19 U.S.C.

			 1304).</text>

			</subsection></section><section id="ID2e62103196a34f33a4e61f3bc43a9ff6"><enum>4.</enum><header>Protection of

			 food and animal feed supplies and public health</header>

			<subsection id="IDd184177bab0c4e6f86696e083dfb0de5"><enum>(a)</enum><header>Covered

			 articles</header>

				<paragraph id="IDcb1865265403436c8ecd3e68ee68e33d"><enum>(1)</enum><header>Prohibition</header><text>It

			 shall be unlawful for any person to introduce into interstate or foreign

			 commerce a covered article if the covered article contains—</text>

					<subparagraph id="ID1b49cf5e6d0246f8acac12a12d1e1d09"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idDAEF765494F74198B1F7C814EAF07638"><enum>(i)</enum><text>specified risk material

			 from a ruminant; or</text>

						</clause><clause id="id23528A3E942C41BF81B7E645892B05A0" indent="up1"><enum>(ii)</enum><text>any material from a ruminant that

			 was in any foreign country at a time at which there was a risk of transmission

			 of BSE in the country and the country did not meet the guidelines on BSE

			 established in the World Organization for Animal Health’s (OIE) Terrestrial

			 Animal Health Code, as determined by the Secretary of Agriculture; or</text>

						</clause></subparagraph><subparagraph id="IDfeace594fc504582b43f4656dbf7a84d"><enum>(B)</enum><text>any material from

			 a ruminant exhibiting signs of a neurological disease.</text>

					</subparagraph></paragraph><paragraph id="IDede6323f465749c0b1484ab8b3054afe"><enum>(2)</enum><header>Reporting</header><text>The

			 Secretary of Agriculture will make publicly available quarterly reports

			 containing the number of noncompliance reports relating to regulations on

			 specified risk materials and the reasons for noncompliance.</text>

				</paragraph><paragraph id="IDb2f28e1c7e1b43b8bff24a3c567a2fc2"><enum>(3)</enum><header>Punitive or

			 retaliatory action</header><text>It shall be unlawful to take punitive or

			 retaliatory action against inspectors and other employees who report cases of

			 noncompliance.</text>

				</paragraph><paragraph id="ID3107b2e0dee9453a8fb3d62fd1c975b2"><enum>(4)</enum><header>Regulations</header>

					<subparagraph id="ID3797b840efe4446083e991603b9489e0"><enum>(A)</enum><header>Secretary of

			 agriculture</header><text>Not later than 1 year after the date of enactment of

			 this Act, the Secretary of Agriculture, in consultation with the Secretary,

			 shall promulgate regulations that establish standards for compliance with this

			 subsection, including—</text>

						<clause id="ID911f5c693021470788f1257f35f258d2"><enum>(i)</enum><text>requirements for

			 the disposal of dead and nonambulatory ruminants on a farm or ranch so that the

			 prion disease, if present in the animals, will not be recycled or expose other

			 animals;</text>

						</clause><clause id="ID26d0e4c499494f32a5b9ea593c50368b"><enum>(ii)</enum><text>requirements for

			 the registration with the Food and Drug Administration of all renderers and all

			 persons that engage in the business of buying, selling, or transporting—</text>

							<subclause id="IDf5b08410134c4f879515c91f1d4ed3b5"><enum>(I)</enum><text>dead, dying,

			 disabled, or diseased livestock; or</text>

							</subclause><subclause id="ID5bcf72582d134fd281a712afad966144"><enum>(II)</enum><text>parts of the

			 carcasses of livestock that die other than by slaughter;</text>

							</subclause></clause><clause id="ID3f2463e9665b4e35b9c31bd236000122"><enum>(iii)</enum><text>requirements

			 for the handling, transportation, and disposal of dead, dying, disabled, and

			 diseased livestock that are condemned on ante-mortem or post-mortem inspection

			 in accordance with any policy that is developed for the disposal of dead or

			 nonambulatory ruminants on the farm; and</text>

						</clause><clause id="ID98a046bc708443748077f181bd098414"><enum>(iv)</enum><text>a

			 requirement that slaughterhouses institute best practices to prevent

			 contamination of material intended for human consumption with specified risk

			 material.</text>

						</clause></subparagraph><subparagraph id="ID9e30fba6c3a049c4ace62ca8c1b2cf53"><enum>(B)</enum><header>Secretary</header><text>Not

			 later than 1 year after the date of enactment of this Act, the Secretary, in

			 consultation with the Secretary of Agriculture, shall promulgate regulations

			 that establish standards for compliance with this subsection, including a

			 prohibition on the use of salvaged pet food, plate waste, poultry litter, and

			 blood and blood products in animal feed intended for food producing ruminants,

			 with an exemption for the use of blood and blood products in bovine

			 biologics.</text>

					</subparagraph></paragraph></subsection><subsection id="ID522692fa550e48818171af6e1abf8234"><enum>(b)</enum><header>Animal

			 feed</header>

				<paragraph id="ID46e9f315c2fc44d1938e0b07435fe50f"><enum>(1)</enum><header>Monitoring and

			 evaluation</header><text>The Secretary shall annually conduct a formal

			 evaluation of the implementation of section 589.2000 of title 21, Code of

			 Federal Regulations (or a successor regulation), including an assessment of

			 coordination between the Food and Drug Administration, the Department of

			 Agriculture, and State agencies.</text>

				</paragraph><paragraph id="ID1c71f34c5594431695a34fab8fd0b7fa"><enum>(2)</enum><header>Registration of

			 businesses</header><text>Not later than 1 year after the date of enactment of

			 this Act, the Secretary shall promulgate regulations for the registration with

			 the Food and Drug Administration of all animal feed manufacturers,

			 transporters, on-farm mixers, and other animal feed industry businesses that

			 are subject to section 589.2000 of title 21, Code of Federal Regulations (or a

			 successor regulation).</text>

				</paragraph><paragraph id="ID1ee74790cffc47608e13af0941c2f536"><enum>(3)</enum><header>Prevention of

			 admixing</header><text>Not later than 1 year after the date of enactment of

			 this Act, the Secretary, in consultation with the Secretary of Agriculture,

			 shall promulgate regulations and an inspection plan to prevent admixing of

			 ruminant and nonruminant feed by animal feed manufacturers, animal feed

			 transporters, and producers that feed both ruminants and nonruminants on the

			 same farm.</text>

				</paragraph><paragraph id="ID39dfa90e738f42a3b4ebf7df8b311144"><enum>(4)</enum><header>Enforcement

			 plan</header>

					<subparagraph id="ID3edca652ed61451291597ccf0fc70437"><enum>(A)</enum><header>In

			 general</header><text>The Secretary shall develop and implement a plan for

			 enforcing section 589.2000 of title 21, Code of Federal Regulations (or a

			 successor regulation).</text>

					</subparagraph><subparagraph id="ID3a9e9c5026cc46ed9b3b472ba640faa8"><enum>(B)</enum><header>Contents</header><text>The

			 plan shall include—</text>

						<clause id="IDa4734cd735dc4f9884d6915bfc2ae566"><enum>(i)</enum><text>a

			 computer database that would allow for effective management of inspection

			 data;</text>

						</clause><clause id="IDe244a11d53594aeba52aca6f4885d8f7"><enum>(ii)</enum><text>a

			 hierarchy of enforcement actions to be taken;</text>

						</clause><clause id="ID48c596bb5f5f413a86cdc05e094cd64a"><enum>(iii)</enum><text>timeframes for

			 persons that are subject to that section to correct violations; and</text>

						</clause><clause id="ID9a85b185c21144ce86be9bf314a9c725"><enum>(iv)</enum><text>timeframes for

			 followup inspections to confirm that violations are corrected.</text>

						</clause></subparagraph></paragraph><paragraph id="IDf4113467aa6c4dfe9b1a9cfe2d4ffe47"><enum>(5)</enum><header>Review of

			 exclusion of certain portions of animals from definition of protein derived

			 from mammalian tissues</header><text>On the motion of the Secretary or on the

			 petition of any person that, citing scientifically credible evidence,

			 demonstrates that there is reason to believe that any of the portions of

			 mammalian animals excluded from the definition of protein derived from

			 mammalian tissues in section 589.2000(a) of title 21, Code of Federal

			 Regulations (or a successor regulation), may carry prion disease, the Secretary

			 shall commence a proceeding to determine whether the exclusion should be

			 modified or stricken.</text>

				</paragraph><paragraph id="ID08583dd877e14fb2915046c00789f585"><enum>(6)</enum><header>Labeling

			 requirements for animal feed</header><text>Animal feed intended for export

			 shall be subject to the labeling requirements for animal feed described in

			 section 589.2000 of title 21, Code of Federal Regulations (or a successor

			 regulation).</text>

				</paragraph></subsection></section><section id="ID69fd273aa89f491a822ae76afac05982"><enum>5.</enum><header>Surveillance of

			 BSE and prion diseases in humans and animals</header>

			<subsection id="ID9de8b73f54064df88f115c8da5eea9c7"><enum>(a)</enum><header>Ruminant

			 identification program</header><text>Title I of the Federal Meat Inspection Act

			 (21 U.S.C. 601 et seq.) is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id4D89D05B162849D99132EB7264DD4A1A" style="OLC">

					<section id="IDbb5732f57c6d4dcb985be3a1649ba222"><enum>25.</enum><header>Ruminant

				identification program</header>

						<subsection id="ID1cca245e0045416996d0cd87cf3734c5"><enum>(a)</enum><header>In

				general</header><text>The Secretary shall accelerate the establishment of a

				ruminant identification program, so that, not later than 1 year after the date

				of enactment of this section, the program will be capable of tracing, within 48

				hours after an animal is diagnosed with any reportable animal disease or any

				condition that can cause disease in humans, the movements of all exposed

				animals from birth to slaughter.</text>

						</subsection><subsection id="ID0284ca21343343fbb6e1f8356b5f4798"><enum>(b)</enum><header>Requirements</header>

							<paragraph id="IDef8a73a69a4841bf9ba116c16ee3bade"><enum>(1)</enum><header>In

				general</header><text>Under the ruminant identification program, the Secretary

				shall identify cattle, sheep, goats, bison, deer, and elk and any other

				ruminant species intended for human consumption through a nationally

				recognizable uniform numbering system under which an identification number is

				assigned to—</text>

								<subparagraph id="ID6695b00f541b45588c92ba8de71ca7c6"><enum>(A)</enum><text>each premises of

				a producer; and</text>

								</subparagraph><subparagraph id="IDbef71c6162084d5a9a4516725ec6bbd1"><enum>(B)</enum><text>each individual

				animal or group or lot of animals, as determined by the Secretary.</text>

								</subparagraph></paragraph><paragraph id="ID22a57a1044ce478ba6ea5bed725d3d82"><enum>(2)</enum><header>Continuation of

				existing programs</header><text>The program shall augment, and not supplant,

				nationally recognized systems in existence on the date of enactment of this

				section, such as the program for scrapie traceback and eradication in sheep and

				goats.</text>

							</paragraph></subsection><subsection id="ID375c64200f6c41f2902e35bf9242dfa7"><enum>(c)</enum><header>Prohibition or

				restriction on entry</header><text>The Secretary may prohibit or restrict entry

				into any slaughtering establishment inspected under this Act of any cattle,

				sheep, goats, bison, deer, elk, or other ruminant intended for human

				consumption that is not identified under the program.</text>

						</subsection><subsection id="ID66ea7331be634ed18b98d45d67765d95"><enum>(d)</enum><header>Records</header>

							<paragraph id="ID07d76be9c25c472395804f87c001ab93"><enum>(1)</enum><header>In

				general</header><text>The Secretary may require that a producer required to

				identify livestock under the program maintain records, as prescribed by the

				Secretary, regarding the purchase, sale, and identification of livestock for

				such period of time as the Secretary prescribes.</text>

							</paragraph><paragraph id="ID97eca691e6ea429bbbc814759c8c612e"><enum>(2)</enum><header>Access</header><text>A

				producer shall, at all reasonable times, on notice by an authorized

				representative of the Secretary, allow the representative access to examine and

				copy the records described in paragraph (1).</text>

							</paragraph></subsection><subsection id="ID3335038709de48a29eaccd5854696de8"><enum>(e)</enum><header>Prohibitions</header><text>It

				shall be unlawful for a producer to—</text>

							<paragraph id="ID474e69079fbc4fd7ade8ff2c2d9a4682"><enum>(1)</enum><text>falsify or

				misrepresent to any other person or to the Secretary any information relating

				to any premises at which any cattle, sheep, swine, goats, bison, deer, elk, or

				other ruminant intended for human consumption, or carcasses thereof, are held;

				or</text>

							</paragraph><paragraph id="IDbe75191f1a23476cb45b6b60e5bf578e"><enum>(2)</enum><text>alter, detach, or

				destroy any records or means of identification prescribed by the Secretary for

				use in determining the premises at which any cattle, sheep, swine, goats,

				bison, deer, elk, or other ruminant intended for human consumption, or

				carcasses thereof, are

				held.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID4a30c3982f3b44cda32a8adfdef154d6"><enum>(b)</enum><header>Programs</header>

				<paragraph id="id8DD4FC4E549F4364B3D68219B27F83E2"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 1 year

			 after the date of enactment of this Act—</text>

					<subparagraph id="ID15b92770e58544a2a8639221e783caea"><enum>(A)</enum><text>the Secretary of

			 Agriculture shall develop programs to—</text>

						<clause id="ID75a590bc26d54922863407b6e2bf82f2"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id40976A4C4DBD463E99DE83A053BAD9CF"><enum>(I)</enum><text>waive diagnostic

			 laboratory charges for the diagnosis of neurological disease in ruminants and

			 mink;</text>

							</subclause><subclause id="id784048A03F86410F84E7C8DAEE400898" indent="up1"><enum>(II)</enum><text>provide compensation for each submission

			 payable to the attending veterinarian to pay the costs of obtaining and

			 processing neurological samples; and</text>

							</subclause><subclause id="id7E0954DFE7084DEF84CC670373249E9C" indent="up1"><enum>(III)</enum><text>develop a program to pay a fee to

			 renderers or producers for each cattle head not already tested that is

			 submitted to a certified lab for BSE testing;</text>

							</subclause></clause><clause id="IDe57ecff3d43f4e41af5bce965e9100b8"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id365390021656426586857353012E9BE0"><enum>(I)</enum><text>fund the development of

			 the national animal health laboratory network;</text>

							</subclause><subclause id="id7C3A586BF39E4A73BD5DDC98614BA8A1" indent="up1"><enum>(II)</enum><text>expand the network to include all

			 certified Federal, State, and university veterinary diagnostic laboratories;

			 and</text>

							</subclause><subclause id="id179A23A589064F9491FCCA29D84C6E5E" indent="up1"><enum>(III)</enum><text>facilitate the timely processing of

			 samples from surveillance and epidemiological investigation;</text>

							</subclause></clause><clause id="ID76312042b3ec4622b56b142170c6182b"><enum>(iii)</enum><text>require rapid

			 prion disease screening tests on—</text>

							<subclause id="ID66563502579d411ba3a0e9720b61c20b"><enum>(I)</enum><text>all cattle and

			 bison 30 months of age and older and all sheep, goats, deer, and elk 12 months

			 of age and older presented for slaughter and intended for human consumption;

			 and</text>

							</subclause><subclause id="IDf8ad8c806f3c47678c823eed4af143ef"><enum>(II)</enum><text>all such

			 livestock of a younger age than either of the ages specified in subclause (I)

			 if the Secretary determines, based on scientifically credible research, that

			 screening of livestock of a younger age should be conducted;</text>

							</subclause></clause><clause id="ID509fdb4eadc84867b3cfe839999d4bfb"><enum>(iv)</enum><text>require rapid

			 prion disease screening tests on all nonambulatory ruminants, including all

			 ruminants exhibiting neurological signs, when presented at a slaughterhouse or

			 for disposal;</text>

						</clause><clause id="IDcaef59cf5fea436381a33a3ff68c1cde"><enum>(v)</enum><text>ensure

			 that—</text>

							<subclause id="id909FDB4A671E4BAAA620C49DE6D9AC89"><enum>(I)</enum><text>any ruminant

			 tested for BSE is excluded from use in any animal feed until the test is

			 confirmed negative in writing that clearly identifies the carcass with the

			 negative test result; and</text>

							</subclause><subclause id="id4E0064AA4FDE42FF9A3DCA1148C6DCB6"><enum>(II)</enum><text>all ruminants

			 exhibiting neurological signs are excluded from the human food supply

			 regardless of the results of the BSE test;</text>

							</subclause></clause><clause id="IDf2836495591c4267a68cbe92028f73cf"><enum>(vi)</enum><text>expand, in

			 conjunction with the Secretary of the Interior, the collection of animal tissue

			 by Federal, State, tribal, and local agencies for testing for chronic wasting

			 disease;</text>

						</clause><clause id="ID60234868b2a44223ae2f2b556fdb20e2"><enum>(vii)</enum><text>develop

			 programs to require CWD herd certification and interstate movement restrictions

			 for farm raised deer and elk;</text>

						</clause><clause id="ID8b6bbf895db74541afc9cc385deef069"><enum>(viii)</enum><text>develop a

			 coordinated strategy to identify resources needed to increase inspections of

			 imported goods; and</text>

						</clause><clause id="ID110cd740df04494390e6b8ca3476133b"><enum>(ix)</enum><text>allow qualified

			 entities to conduct additional voluntary rapid prion disease screening tests;

			 and</text>

						</clause></subparagraph><subparagraph id="IDde719c1a46e643ddad9fadcaeb2adf01"><enum>(B)</enum><text>the Secretary

			 shall develop programs to—</text>

						<clause id="IDdba9086d78cb49d4848b9a3412eb904f"><enum>(i)</enum><text>expand survey

			 efforts for prion diseases in humans, in conjunction with the National Prion

			 Disease Pathology Research Center at Case Western Reserve University;</text>

						</clause><clause id="ID59b032e7ee4844b3b0032f206654ae77"><enum>(ii)</enum><text>evaluate the

			 effectiveness of practices in effect as of the date of enactment of this Act

			 to—</text>

							<subclause id="id0A454B8537D24B568F5B517FFC6DB71D"><enum>(I)</enum><text>protect the human

			 blood supply from contamination from blood infected with prion disease;

			 and</text>

							</subclause><subclause id="id5DD14F1348834EE6BEFB72DA23FA7B84"><enum>(II)</enum><text>prevent

			 transmission of BSE through contaminated medical equipment; and</text>

							</subclause></clause><clause id="ID79ec6b802ad744cebec0bfbc58116e9f"><enum>(iii)</enum><text>develop a

			 coordinated strategy to identify resources needed to increase inspections of

			 imported goods.</text>

						</clause></subparagraph></paragraph><paragraph id="id15086E5791554F50B5CD84EBFF5FA9FB"><enum>(2)</enum><header>Definition of

			 qualified entity</header><text>For purposes of paragraph (1)(A)(ix), the term

			 <term>qualified entity</term> means a person or a State that—</text>

					<subparagraph id="idE46E6C5FF4B04E92BFE88AB2080E20C0"><enum>(A)</enum><text>uses rapid test

			 technology approved by the Secretary of Agriculture for the detection of BSE in

			 cattle; and</text>

					</subparagraph><subparagraph id="id47D324149D394900A861417833CB600D"><enum>(B)</enum><text>meets or exceeds

			 standards established by the Secretary for—</text>

						<clause commented="no" id="ID6d75540aa2fe49cabe9ced6d2f05e477"><enum>(i)</enum><text>laboratory sample

			 collection and chain of custody;</text>

						</clause><clause commented="no" id="ID7d5d1b87b7b849578a049961d33b2384"><enum>(ii)</enum><text>sample and

			 laboratory methods quality control; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID52ea136d71bd4265bb7734335ad8c469"><enum>(iii)</enum><text>laboratory

			 safety and quality.</text>

						</clause></subparagraph></paragraph></subsection><subsection id="ID4f9a1b79fcd8467c852e65ec61581190"><enum>(c)</enum><header>Liaison</header><text>Each

			 of the Secretary and the Secretary of Agriculture shall establish liaison

			 positions at each appropriate Undersecretary level to ensure adequate

			 coordination and communication between the Department of Health and Human

			 Services and the Department of Agriculture regarding prion diseases.</text>

			</subsection><subsection id="IDdc5367fa5b9148d3aa9fd7d42683fa1d"><enum>(d)</enum><header>Task

			 force</header>

				<paragraph id="IDfaffd2d577be44e187649efcf9a59442"><enum>(1)</enum><header>In

			 general</header><text>As soon as practicable after the date of enactment of

			 this Act, the Secretary and the Secretary of Agriculture shall jointly

			 establish a task force on prion diseases to provide recommendations to Congress

			 on the status of all surveillance and research programs.</text>

				</paragraph><paragraph id="ID9ee087d49756491d9c0300ae65a4b767"><enum>(2)</enum><header>Membership</header><text>The

			 Task Force shall include representatives of—</text>

					<subparagraph id="ID66e908b491db43ddb3271f79a1712b1e"><enum>(A)</enum><text>the Food Safety

			 and Inspection Service;</text>

					</subparagraph><subparagraph id="ID373518224da548c1b79dc41c8f3339b1"><enum>(B)</enum><text>the Animal and

			 Plant Health Inspection Service;</text>

					</subparagraph><subparagraph id="ID14db54564f804d60b5b00f1590aadb2b"><enum>(C)</enum><text>the Agricultural

			 Research Service;</text>

					</subparagraph><subparagraph id="ID9c5187ba257645408d2445483f9f06d4"><enum>(D)</enum><text>the Food and Drug

			 Administration;</text>

					</subparagraph><subparagraph id="ID0304e4fd5fa04cba898ca371f114d09b"><enum>(E)</enum><text>the Centers for

			 Disease Control and Prevention;</text>

					</subparagraph><subparagraph id="ID4cad1e52afd744f08c15d031105fd60e"><enum>(F)</enum><text>the National

			 Institutes of Health;</text>

					</subparagraph><subparagraph id="IDfc43fdf86def4b2fbe9a80490779c390"><enum>(G)</enum><text>the Customs

			 Service;</text>

					</subparagraph><subparagraph id="ID525440b8310b4d0aa022c9e5b220030c"><enum>(H)</enum><text>the National

			 Prion Research Program;</text>

					</subparagraph><subparagraph id="IDd40647ca116f43c08586afb37ad77e3a"><enum>(I)</enum><text>the Public Health

			 Service; and</text>

					</subparagraph><subparagraph id="IDd00d782bcbaa4991838d5e5b0746a922"><enum>(J)</enum><text>any other Federal

			 Agency the assistance of which the President determines is required to carry

			 out this subsection.</text>

					</subparagraph></paragraph><paragraph id="IDbbe6e5c4dbe9433abe0bec3187696905"><enum>(3)</enum><header>Existing task

			 force</header><text>The Secretary may expand or amend an existing task force to

			 perform the duties of the task force under this section.</text>

				</paragraph><paragraph id="ID947aa76b9a6643c1881dc0b9c5a4fc02"><enum>(4)</enum><header>Duties</header><text>The

			 task force shall—</text>

					<subparagraph id="ID138b6f113e3545fb82d9ab69b4d72367"><enum>(A)</enum><text>evaluate, with

			 respect to prion diseases, the need for structural changes in and among Federal

			 agencies that exercise jurisdiction over food safety and other aspects of

			 public health protection;</text>

					</subparagraph><subparagraph id="ID6a8de17183044574b3747c6f67e7e21b"><enum>(B)</enum><text>prioritize prion

			 disease resource and prion disease research needs at all Federal agencies that

			 exercise jurisdiction over matters relating to prion diseases,

			 including—</text>

						<clause id="IDd4472a30c12c49958262c05547bd5f38"><enum>(i)</enum><text>genetic markers

			 for all species affected by prion disease;</text>

						</clause><clause id="IDe489c8feb18242d180332720b503e997"><enum>(ii)</enum><text>in

			 vivo diagnostic tests;</text>

						</clause><clause id="ID24fe0cb55fff4038821ccab20267bcd6"><enum>(iii)</enum><text>human blood

			 supply diagnostic tests;</text>

						</clause><clause id="ID916e124613a9439297668edbb022793c"><enum>(iv)</enum><text>therapies for

			 humans and animals;</text>

						</clause><clause id="IDb73c33a6761f48e98343dfcb8c992efa"><enum>(v)</enum><text>processing

			 techniques that denature the prion protein in carcasses and other materials;

			 and</text>

						</clause><clause id="ID145a006c7f93451a8ae08879777b81fa"><enum>(vi)</enum><text>development of

			 stunning devices that are humane, protect worker safety, and do not allow

			 contamination of meat products; and</text>

						</clause></subparagraph><subparagraph id="ID8f51458ba3e846158ac5cb122d1e724c"><enum>(C)</enum><text>perform such

			 other duties pertaining to surveillance and research of prion disease as the

			 Secretary may specify.</text>

					</subparagraph></paragraph><paragraph id="IDb41c7a1fc99c4efeb70fb69f63bd3f9f"><enum>(5)</enum><header>Preliminary

			 recommendations</header><text>Not later than 180 days after the date of

			 enactment of this Act, the task force shall submit to Congress any preliminary

			 recommendations of the task force.</text>

				</paragraph><paragraph id="IDd0686dc1062e46999a83a8ba5e1eae31"><enum>(6)</enum><header>Final

			 recommendations</header><text>Not later than 1 year after the date of enactment

			 of this Act, the task force shall submit to Congress the final recommendations

			 of the task force.</text>

				</paragraph></subsection></section><section id="ID1f3a90f1aae1466fbab894c23a3337bd"><enum>6.</enum><header>Enforcement</header>

			<subsection id="ID52bbdf51d35441578b22c7dfc54d1f54"><enum>(a)</enum><header>Cooperation</header><text>The

			 Secretary and the heads of other Federal agencies, as appropriate, shall

			 cooperate with the Attorney General in enforcing this Act.</text>

			</subsection><subsection id="ID67a5767da62c4a8fb4a6c762089d7f27"><enum>(b)</enum><header>Due

			 process</header><text>Any person subject to enforcement action under this

			 section shall have the opportunity for an informal hearing on the enforcement

			 action as soon as practicable after, but not later than 10 days after, the

			 enforcement action is taken.</text>

			</subsection><subsection id="IDefb2d05da4d542baa477b2fbefc6f041"><enum>(c)</enum><header>Remedies</header><text>In

			 addition to any remedies available under other provisions of law, the head of a

			 Federal agency may enforce this Act by—</text>

				<paragraph id="ID703684ea7ce04a75ab9275b0acbf16c3"><enum>(1)</enum><text>seizing and

			 destroying an article that is introduced into interstate or foreign commerce in

			 violation of this Act; or</text>

				</paragraph><paragraph id="IDca80aa5d2601438288c4b3a31ca48e94"><enum>(2)</enum><text>issuing an order

			 requiring any person that introduces an article into interstate or foreign

			 commerce in violation of this Act—</text>

					<subparagraph id="IDa2a247db58784698ae48bde324b88d97"><enum>(A)</enum><text>to cease the

			 violation;</text>

					</subparagraph><subparagraph id="ID6d91fd2e7f0e47d9878f9b45b5b225b1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id889F626D6DD14B79A095B3C14734C5FD"><enum>(i)</enum><text>to recall any article

			 that is sold; and</text>

						</clause><clause id="id37AB3ED4206F4198886B7DC28A2E60BB" indent="up1"><enum>(ii)</enum><text>to refund the purchase price to

			 the purchaser;</text>

						</clause></subparagraph><subparagraph id="ID62ac43befc9b4b3bb9e32c69ec5945dc"><enum>(C)</enum><text>to destroy the

			 article or forfeit the article to the United States for destruction; or</text>

					</subparagraph><subparagraph id="ID782ee3510c26403cbc8af1f399581d69"><enum>(D)</enum><text>to cease

			 operations at the facility at which the article is produced until the head of

			 the appropriate Federal agency determines that the operations are no longer in

			 violation of this Act.</text>

					</subparagraph></paragraph></subsection></section><section id="ID1acdebeddf464ca49fb5b6c09f0cd77d"><enum>7.</enum><header>Authorization of

			 appropriations</header>

			<subsection id="ID9e5e0e15744e4557ad6395f83a3d519c"><enum>(a)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated to

			 carry out this Act—</text>

				<paragraph id="ID36cb7574481247e09c2edb179b74e7c3"><enum>(1)</enum><text>$100,000,000 for

			 each of fiscal years 2007 and 2008; and</text>

				</paragraph><paragraph id="ID542dcb17eb7c459089101a3b73ed2289"><enum>(2)</enum><text>such sums as are

			 necessary for each subsequent fiscal year.</text>

				</paragraph></subsection><subsection id="ID7b65f66b4d584570815ff05a7f917db7"><enum>(b)</enum><header>Allocation of

			 funds</header>

				<paragraph id="IDe0e7e31eb1554addaa1fd6089d8611bb"><enum>(1)</enum><header>In

			 general</header><text>Of the funds made available for each fiscal year under

			 subsection (a)—</text>

					<subparagraph id="ID60ab5c549b8c4332bf1653714de70718"><enum>(A)</enum><text>30 percent shall

			 be available to the Secretary; and</text>

					</subparagraph><subparagraph id="ID73ff669fb1f34915932e58fdb21eeda4"><enum>(B)</enum><text>70 percent shall

			 be available to the Secretary of Agriculture.</text>

					</subparagraph></paragraph><paragraph id="ID3bd3f81cf7624b32865608e805e73595"><enum>(2)</enum><header>Modification of

			 allocations</header><text>The President may alter the allocation of funding

			 under paragraph (1) as needed to better protect the public against prion

			 disease.</text>
