			 Teacher Housing Act of 2005</quote>.</text>

		</section><section changed="not-changed" id="ID98C16BDAB89C4523B45369709254CFA2" reported-display-style="italic"><enum>2.</enum><header>Findings and

			 purpose</header>

			<subsection changed="not-changed" id="IDB2B20161FBC74196ABBAECC8290C638C" reported-display-style="italic"><enum>(a)</enum><header>Findings</header><text>Congress

			 finds that—</text>

				<paragraph changed="not-changed" id="IDE7AEA22551194BC3892FF86FE91B031B" reported-display-style="italic"><enum>(1)</enum><text>housing for teachers,

			 administrators, other school staff, and the households of such staff in remote

			 and rural areas of the State of Alaska is often substandard, if available at

			 all;</text>

				</paragraph><paragraph changed="not-changed" id="IDB9903765BFD247BF9042711C03508C07" reported-display-style="italic"><enum>(2)</enum><text>teachers, administrators,

			 other school staff, and the households of such staff are often forced to find

			 alternate shelter, sometimes even in school buildings; and</text>

				</paragraph><paragraph changed="not-changed" id="ID6B4B87A9A5CB4414BCDA6C22C054A02A" reported-display-style="italic"><enum>(3)</enum><text>rural school districts in

			 the State of Alaska face increased challenges, including meeting the

			 requirements of the Elementary and Secondary Education Act of 1965 (20 U.S.C.

			 6301 et seq.), in recruiting employees due to the lack of affordable, quality

			 housing.</text>

				</paragraph></subsection><subsection changed="not-changed" id="IDA80D3C948146413EAAB1680A8709264E" reported-display-style="italic"><enum>(b)</enum><header>Purpose</header><text>The

			 purpose of this Act is to provide habitable living quarters for teachers,

			 administrators, other school staff, and the households of such staff in rural

			 areas of the State of Alaska located in or near Alaska Native villages.</text>

			</subsection></section><section changed="not-changed" id="IDD99A1BD568D142C998B5062FEE25763E" reported-display-style="italic"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph changed="not-changed" id="IDE29CCB2734904130801089E780EDB751" reported-display-style="italic"><enum>(1)</enum><header>Alaska housing finance

			 corporation</header><text>The term <term>Alaska Housing Finance

			 Corporation</term> means the State housing authority for the State of Alaska

			 created under the laws of the State of Alaska (or a successor

			 authority).</text>

			</paragraph><paragraph changed="not-changed" id="IDC6439EBA08EA433887A9865AD5CD474C" reported-display-style="italic"><enum>(2)</enum><header>Elementary

			 school</header><text>The term <term>elementary school</term> has the meaning

			 given the term in section 9101 of the <act-name parsable-cite="ESEA">Elementary

			 and Secondary Education Act of 1965</act-name> (20 U.S.C. 7801).</text>

			</paragraph><paragraph changed="not-changed" id="ID373EC6C812C84CE4AE6A335C6CDD517E" reported-display-style="italic"><enum>(3)</enum><header>Eligible school

			 district</header><text>The term <term>eligible school district</term> means a

			 public school district (as defined under the laws of the State of Alaska)

			 located in the State of Alaska that operates 1 or more schools in a qualified

			 community.</text>

			</paragraph><paragraph changed="not-changed" id="ID5C4756F95BC949E28FCAE8958722AAAB" reported-display-style="italic"><enum>(4)</enum><header>Native village</header>

				<subparagraph changed="not-changed" id="id9C20EDA57B914423BDAB2099CF936F72" reported-display-style="italic"><enum>(A)</enum><header>In

			 general</header><text>The term <term>Native village</term> has the meaning

			 given the term in section 3 of the Alaska Native Claims Settlement Act (43

			 U.S.C. 1602).</text>

				</subparagraph><subparagraph changed="not-changed" id="ID93DFB952786046358CA8627846903834" reported-display-style="italic"><enum>(B)</enum><header>Inclusion</header><text>The

			 term <term>Native village</term> includes the Metlakatla Indian Community of

			 the Annette Islands Reserve.</text>

				</subparagraph></paragraph><paragraph changed="not-changed" id="ID189200CE46CF4599993716BBAA31CC55" reported-display-style="italic"><enum>(5)</enum><header>Other school

			 staff</header><text>The term <term>other school staff</term> means—</text>

				<subparagraph changed="not-changed" id="idC7DB8B55E60D4C21B38DA21C48E81217" reported-display-style="italic"><enum>(A)</enum><text>pupil services

			 personnel;</text>

				</subparagraph><subparagraph changed="not-changed" id="idCBD5E84639434B53B7740D1EB88B6DD0" reported-display-style="italic"><enum>(B)</enum><text>librarians;</text>

				</subparagraph><subparagraph changed="not-changed" id="id2FA3BE54C5644A7EA665406D855AF3FD" reported-display-style="italic"><enum>(C)</enum><text>career guidance and

			 counseling personnel;</text>

				</subparagraph><subparagraph changed="not-changed" id="id7F70D976AF2241B7A76FAA81D85888A9" reported-display-style="italic"><enum>(D)</enum><text>education aides;

			 and</text>

				</subparagraph><subparagraph changed="not-changed" id="id44F25B77E3144A2DAC632FE46BBD4FA7" reported-display-style="italic"><enum>(E)</enum><text>other instructional and

			 administrative school personnel.</text>

				</subparagraph></paragraph><paragraph changed="not-changed" id="IDA7A7ED8023CD4C3EBDCAC4D5FF928E6D" reported-display-style="italic"><enum>(6)</enum><header>Qualified

			 community</header><text>The term <term>qualified community</term> means a home

			 rule city or a general law city incorporated under the laws of the State of

			 Alaska, or an unincorporated community (as defined under the laws of the State

			 of Alaska) in the State of Alaska located outside the boundaries of such a

			 city, that, as determined by the Alaska Housing Finance Corporation—</text>

				<subparagraph changed="not-changed" id="ID7B071A0D99A649E3938742CEF73E0EAE" reported-display-style="italic"><enum>(A)</enum><text>has a population of not

			 greater than 6,500 individuals;</text>

				</subparagraph><subparagraph changed="not-changed" id="ID2ACA7A7C2CB64A8BB926AB142D0B7B9F" reported-display-style="italic"><enum>(B)</enum><text>is located in or near a

			 Native village; and</text>

				</subparagraph><subparagraph changed="not-changed" id="IDC9D5582B35594F7CA04F500786CB951D" reported-display-style="italic"><enum>(C)</enum><text>is not connected by road

			 or railroad to the municipality of Anchorage, Alaska, excluding any

			 connection—</text>

					<clause changed="not-changed" id="idECFAD0331761437C80201B8B0D5D6789" reported-display-style="italic"><enum>(i)</enum><text>by the Alaska Marine

			 Highway System created under the laws of the State of Alaska; or</text>

					</clause><clause changed="not-changed" id="id3BC63EA5281E4F87A06AAD171C868635" reported-display-style="italic"><enum>(ii)</enum><text>that requires travel by

			 road through Canada.</text>

					</clause></subparagraph></paragraph><paragraph changed="not-changed" id="ID941C12D8062B43FB9F994265A7130D2B" reported-display-style="italic"><enum>(7)</enum><header>Secondary

			 school</header><text>The term <term>secondary school</term> has the meaning

			 given the term in section 9101 of the <act-name parsable-cite="ESEA">Elementary

			 and Secondary Education Act of 1965</act-name> (20 U.S.C. 7801).</text>

			</paragraph><paragraph changed="not-changed" id="IDA5F97E23A3EE46DCBB16F69680928FBE" reported-display-style="italic"><enum>(8)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of Housing and Urban

			 Development.</text>

			</paragraph><paragraph changed="not-changed" id="ID33E88C084AB548C7B9323B0CDE1F759C" reported-display-style="italic"><enum>(9)</enum><header>Teacher</header><text>The

			 term <term>teacher</term> means an individual who—</text>

				<subparagraph changed="not-changed" id="id3FD24730433C42EC94DC32AA6A2E7EA9" reported-display-style="italic"><enum>(A)</enum><text>is employed as a teacher

			 in a public elementary school or secondary school; and</text>

				</subparagraph><subparagraph changed="not-changed" id="id35F4345A75964584ABB437FF5519524F" reported-display-style="italic"><enum>(B)</enum><text>meets the teaching

			 certification or licensure requirements of the State of Alaska.</text>

				</subparagraph></paragraph><paragraph changed="not-changed" id="ID17142E0D38AF41138A5E9CF647468318" reported-display-style="italic"><enum>(10)</enum><header>Tribally designated

			 housing entity</header><text>The term <term>tribally designated housing

			 entity</term> has the meaning given the term in section 4 of the Native

			 American Housing Assistance and Self-Determination Act of 1996 (25 U.S.C.

			 4103).</text>

			</paragraph><paragraph changed="not-changed" id="ID68BB5DE2B2BF4E2BAAFDE27233E33661" reported-display-style="italic"><enum>(11)</enum><header>Village

			 corporation</header>

				<subparagraph changed="not-changed" id="id38522781C7F64957A5092A09A854C00D" reported-display-style="italic"><enum>(A)</enum><header>In

			 general</header><text>The term <term>Village Corporation</term> has the meaning

			 given the term in section 3 of the Alaska Native Claims Settlement Act (43

			 U.S.C. 1602).</text>

				</subparagraph><subparagraph changed="not-changed" id="idCFEA2404468F499F888C41081D2E52B1" reported-display-style="italic"><enum>(B)</enum><header>Inclusions</header><text>The

			 term <term>Village Corporation</term> includes, as defined in section 3 of that

			 Act (43 U.S.C. 1602)—</text>

					<clause changed="not-changed" id="idBC7762D2CA174BA5A0B1DCA335E0071A" reported-display-style="italic"><enum>(i)</enum><text>Urban Corporations;

			 and</text>

					</clause><clause changed="not-changed" id="id0D4552F4A14248CBAF7DF94F318FECC7" reported-display-style="italic"><enum>(ii)</enum><text>Group

			 Corporations.</text>

					</clause></subparagraph></paragraph></section><section changed="not-changed" id="ID6929889267344EACB3790A6831CE08FB" reported-display-style="italic"><enum>4.</enum><header>Rural teacher housing

			 program</header>

			<subsection changed="not-changed" id="IDC3779E66311E4F1D9937873F3A7C2E33" reported-display-style="italic"><enum>(a)</enum><header>In

			 general</header><text>The Secretary shall provide funds to the Alaska Housing

			 Finance Corporation in accordance with regulations promulgated under section 5

			 for use in accordance with subsection (b).</text>

			</subsection><subsection changed="not-changed" id="IDD6C2A6AF64C1437F9A1FE31E541D3DA9" reported-display-style="italic"><enum>(b)</enum><header>Use of Funds</header>

				<paragraph changed="not-changed" id="IDB49D2BB90AA4416F9B902BD9026EC96A" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>The Alaska Housing Finance Corporation shall use funds

			 provided under subsection (a) to provide grants and loans to eligible school

			 districts for use in accordance with paragraph (2).</text>

				</paragraph><paragraph changed="not-changed" id="ID1A6BDB41A6074F96977D4273F4BEF5BD" reported-display-style="italic"><enum>(2)</enum><header>Use of funds by

			 eligible school districts</header><text>An eligible school district shall use a

			 grant or loan under paragraph (1) for—</text>

					<subparagraph changed="not-changed" id="ID59DBF7075AEF4500BD1BE78A03F22050" reported-display-style="italic"><enum>(A)</enum><text>the construction of new

			 housing units in a qualified community;</text>

					</subparagraph><subparagraph changed="not-changed" id="ID69AC5B583C664369854FE60178F87D3C" reported-display-style="italic"><enum>(B)</enum><text>the purchase and

			 rehabilitation of existing structures to be used as housing units in a

			 qualified community;</text>

					</subparagraph><subparagraph changed="not-changed" id="IDF9DB2A4D448943B191BF8AAE7B2891E8" reported-display-style="italic"><enum>(C)</enum><text>the rehabilitation of

			 housing units in a qualified community;</text>

					</subparagraph><subparagraph changed="not-changed" id="IDE02E1B614FEE47FC8A49068004BF2F07" reported-display-style="italic"><enum>(D)</enum><text>the leasing of housing

			 units in a qualified community;</text>

					</subparagraph><subparagraph changed="not-changed" id="ID1700C24C83564FC0AFE0FBD4B9D5E4E5" reported-display-style="italic"><enum>(E)</enum><text>purchasing or leasing

			 real property on which housing units will be constructed, purchased, or

			 rehabilitated in a qualified community;</text>

					</subparagraph><subparagraph changed="not-changed" id="ID63B1C70D5233400EAACC2DEE5D2D60B7" reported-display-style="italic"><enum>(F)</enum><text>the repayment of a loan

			 to—</text>

						<clause changed="not-changed" id="idF141E32077264935B84015D0E559E18E" reported-display-style="italic"><enum>(i)</enum><text>construct, purchase, or

			 rehabilitate housing units;</text>

						</clause><clause changed="not-changed" id="id84D84D5A32A4426F9B8875AA6E5864DE" reported-display-style="italic"><enum>(ii)</enum><text>purchase real property

			 on which housing units will be constructed, purchased, or rehabilitated in a

			 qualified community; or</text>

						</clause><clause changed="not-changed" id="id66C68A5B8C904FA4A93000298AEFB6F8" reported-display-style="italic"><enum>(iii)</enum><text>carry out an activity

			 described in subparagraph (G); and</text>

						</clause></subparagraph><subparagraph changed="not-changed" id="IDC2C08432C19643BD82693B6370477FA6" reported-display-style="italic"><enum>(G)</enum><text>any other activity

			 normally associated with the construction, purchase, or rehabilitation of

			 housing units, or the purchase or lease of real property on which housing units

			 will be constructed, purchased, or rehabilitated, in a qualified community,

			 including—</text>

						<clause changed="not-changed" id="IDD72DA1A5D305441197E997AE09016EAC" reported-display-style="italic"><enum>(i)</enum><text>connecting housing units

			 to a utility;</text>

						</clause><clause changed="not-changed" id="ID8ADADE1B61DE4FCAA4C999A89F4BE1ED" reported-display-style="italic"><enum>(ii)</enum><text>preparing construction

			 sites;</text>

						</clause><clause changed="not-changed" id="ID1C2EE3631515406C92E7181E28036464" reported-display-style="italic"><enum>(iii)</enum><text>transporting any

			 equipment or material necessary for the construction or rehabilitation of

			 housing units to and from the site on which the housing units are or will be

			 constructed; and</text>

						</clause><clause changed="not-changed" id="IDFDEABC61FA124D93BA6D6F8F295CDAD4" reported-display-style="italic"><enum>(iv)</enum><text>carrying out an

			 environmental assessment and remediation of a construction site or a site on

			 which housing units are located.</text>

						</clause></subparagraph></paragraph></subsection><subsection changed="not-changed" id="IDD19FB1ADEC9C41BB8E7914C6412A1764" reported-display-style="italic"><enum>(c)</enum><header>Ownership of Housing

			 and Land</header>

				<paragraph changed="not-changed" id="IDC1EA5CF1688F4797959743089B8ADEF5" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>Any housing unit constructed, purchased, or

			 rehabilitated, and any real property purchased, using a grant or loan provided

			 under this section shall be considered to be owned, as the Secretary determines

			 to be appropriate, by—</text>

					<subparagraph changed="not-changed" id="idDABF01C9602E403CBBED6EFE6C4F0B6B" reported-display-style="italic"><enum>(A)</enum><text>the affected eligible

			 school district;</text>

					</subparagraph><subparagraph changed="not-changed" id="idAD75402096D64BD2A241A566EAE0CB03" reported-display-style="italic"><enum>(B)</enum><text>the affected

			 municipality, as defined under the laws of the State of Alaska;</text>

					</subparagraph><subparagraph changed="not-changed" id="idCE131B6B728B4F2D907EE1680BCBD51B" reported-display-style="italic"><enum>(C)</enum><text>the affected Village

			 Corporation;</text>

					</subparagraph><subparagraph changed="not-changed" id="idC18AA4A6644843258D7C9B769D19B842" reported-display-style="italic"><enum>(D)</enum><text>the Metlakatla Indian

			 Community of the Annette Islands Reserve; or</text>

					</subparagraph><subparagraph changed="not-changed" id="id03560E843CFC47C4BC3A0E521B64EDE6" reported-display-style="italic"><enum>(E)</enum><text>a tribally designated

			 housing entity.</text>

					</subparagraph></paragraph><paragraph changed="not-changed" id="id140CABD0F4B74C86A2F0F134D3DA2668" reported-display-style="italic"><enum>(2)</enum><header>Transfer of

			 ownership</header><text>Ownership of a housing unit or real property under

			 paragraph (1) may be transferred between the entities described in that

			 paragraph.</text>

				</paragraph></subsection><subsection changed="not-changed" id="ID54E038D674CE4ADFBF75F89B52439BB9" reported-display-style="italic"><enum>(d)</enum><header>Occupancy of Housing

			 Units</header>

				<paragraph changed="not-changed" id="ID5AC554B6AED540D5A08C44A773CDCB31" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>Except as provided in paragraphs (2) and (3), each

			 housing unit constructed, purchased, rehabilitated, or leased using a grant or

			 loan under this section shall be occupied by—</text>

					<subparagraph changed="not-changed" id="id527C49AFAF4D4B0E823867F4161B3BB0" reported-display-style="italic"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id23E2CB0F35004B899A234F4C938B9A9E"><enum>(i)</enum><text>a teacher;</text>

						</clause><clause changed="not-changed" id="id8A8EA2FC68FD4013AC38B134F9A38AB9" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>an

			 administrator; or</text>

						</clause><clause changed="not-changed" id="id4591AEC070C74FF4B7DEA02B4AECE365" indent="up1" reported-display-style="italic"><enum>(iii)</enum><text>other school staff;

			 and</text>

						</clause></subparagraph><subparagraph changed="not-changed" id="id6C6D3424E68D492EB78317918F673C3C" reported-display-style="italic"><enum>(B)</enum><text>the household of an

			 individual described in subparagraph (A), if any.</text>

					</subparagraph></paragraph><paragraph changed="not-changed" id="IDB3C544BDB1D044ED96826CDE77C2BCA5" reported-display-style="italic"><enum>(2)</enum><header>Nonsession

			 months</header><text>A housing unit constructed, purchased, rehabilitated, or

			 leased using a grant or loan under this section may be occupied by an

			 individual other an individual described in paragraph (1) only during a period

			 in which school is not in session.</text>

				</paragraph><paragraph changed="not-changed" id="ID8434DE540C034775B7D2C3AA37A09B98" reported-display-style="italic"><enum>(3)</enum><header>Temporary

			 occupants</header><text>A vacant housing unit constructed, purchased,

			 rehabilitated, or leased using a grant or loan under this section may be

			 occupied by a contractor or guest of an eligible school district for a period

			 to be determined by the Alaska Housing Finance Corporation, by

			 regulation.</text>

				</paragraph></subsection><subsection changed="not-changed" id="ID848174C25B87441FABDD104C35B8C6F8" reported-display-style="italic"><enum>(e)</enum><header>Compliance With

			 Law</header><text>An eligible school district that receives a grant or loan

			 under this section shall ensure that each housing unit constructed, purchased,

			 rehabilitated, or leased using the grant or loan complies with applicable laws

			 (including regulations and ordinances).</text>

			</subsection><subsection changed="not-changed" id="ID4D91C2AD81444997AC06D001441B4B86" reported-display-style="italic"><enum>(f)</enum><header>Program

			 Policies</header>

				<paragraph changed="not-changed" id="ID6566241F078446D5B83D23ADDE4191B2" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>The Alaska Housing Finance Corporation, in consultation

			 with any appropriate eligible school district, shall establish policies

			 governing the administration of grants and loans under this section, including

			 a method of ensuring that funds are made available on an equitable basis to

			 eligible school districts.</text>

				</paragraph><paragraph changed="not-changed" id="ID23F58FE35761474492B927C2C4B606C1" reported-display-style="italic"><enum>(2)</enum><header>Revisions</header><text>Not

			 less frequently than once every 3 years, the Alaska Housing Finance

			 Corporation, in consultation with any appropriate eligible school district,

			 shall take into consideration revisions to the policies established under

			 paragraph (1).</text>

				</paragraph></subsection></section><section changed="not-changed" id="ID86E1920C500B463AAF9C9F194CB533EC" reported-display-style="italic"><enum>5.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 1 year after the date of

			 enactment of this Act, the Secretary shall promulgate such regulations as are

			 necessary to carry out this Act.</text>

		</section><section changed="not-changed" id="IDF453040CC6434A228A8D18D88C8DEC45" reported-display-style="italic"><enum>6.</enum><header>Authorization of

			 appropriations</header>

			<subsection changed="not-changed" id="IDD15779DD9D314569827309A0DC13D8C3" reported-display-style="italic"><enum>(a)</enum><header>In

			 General</header><text>There are authorized to be appropriated to the Secretary

			 such sums as are necessary to carry out this Act for each of fiscal years 2007

			 through 2016.</text>

			</subsection><subsection changed="not-changed" id="ID0DACACC8F425442A9763BBAD7EA89FB8" reported-display-style="italic"><enum>(b)</enum><header>Administrative

			 expenses</header><text>Each of the Secretary and the Alaska Housing Finance

			 Corporation shall use not more than 5 percent of funds appropriated during a

			 fiscal year to pay administrative expenses incurred in carrying out this

			 Act.</text>
