			<enum>1.</enum>

			<header>Short title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Rail Crossing Safety

			 Act</short-title></quote>.</text>

		</section><section id="id59B43E1E00404CB9BF7EF0EF2AAB05D6"><enum>2.</enum><header>Report regarding

			 impact on public safety of train travel in communities without grade

			 separation</header>

			<subsection id="id3FB91D2E13FF49FB8834816ECDE51ADD"><enum>(a)</enum><header>Study</header><text>The

			 Secretary of Transporation shall, in consultation with State and local

			 government officials, conduct a study of the impact of blocked highway-railroad

			 grade crossings on the ability of emergency responders to perform public safety

			 and security duties.</text>

			</subsection><subsection id="idDAD1278CE1EC47F3B68B75F712AD06FD"><enum>(b)</enum><header>Report on the

			 impact of blocked highway-Railroad grade crossings on emergency

			 responders</header><text>Not later than 1 year after the date of enactment of

			 this Act, the Secretary shall submit the results of the study and

			 recommendations for reducing the impact of blocked crossings on emergency

			 response to the Senate Committee on Commerce, Science, and Transportation and

			 the House of Representatives Committee on Transportation and

			 Infrastructure.</text>

			</subsection></section><section id="id28EFB1B43058470D8BF8ECF7302D309E"><enum>3.</enum><header>Grade crossing

			 separation fund</header>

			<subsection id="idCC258FD9C5DA41038CC5F76E35B17B1B"><enum>(a)</enum><header>In

			 general</header><text>The Secretary of Transporation shall award grants to

			 States and units of local government to construct tunnels, bridges and other

			 means of separating rail tracks and roads.</text>

			</subsection><subsection id="id22C6475FEF3A42F080DE2357CB9A8620"><enum>(b)</enum><header>Priority</header>

				<paragraph id="id5277EE6405C24902B917C23283A7D3C4"><enum>(1)</enum><header>In

			 general</header><text>In awarding grants under this section, the Secretary

			 shall give priority to—</text>

					<subparagraph id="id7DE403BA42644A698E70C44FFF285E61"><enum>(A)</enum><text>grade separations

			 that would have the most impact on improving safety; and</text>

					</subparagraph><subparagraph id="idA25400CB07A44A8EA1636C61389703F4"><enum>(B)</enum><text>rail lines that

			 have a high volume of goods movement.</text>

					</subparagraph></paragraph><paragraph id="id8E8E3F6D5726453E8526C4A5C76831E3"><enum>(2)</enum><header>Priority

			 adjustment</header><text>After completion of the report required under section

			 2, the Secretary shall take the report's findings and recommendations into

			 account when determining priorities.</text>

				</paragraph></subsection><subsection id="idCA874E9074F042AFA3F1187A3F170EBC"><enum>(c)</enum><header>Regulations</header><text>In

			 order to carry out this section, the Secretary may establish any appropriate

			 policies, procedures, or requirements.</text>

			</subsection><subsection id="id2657603C97C646259714856448C3C11E"><enum>(d)</enum><header>Authorization

			 of appropriations</header><text>To carry out this section, there are authorized

			 to be appropriated such sums as may be necessary for each of fiscal years 2006

			 through 2010.</text>
