		<section id="id07757DAF68D5430F9197476AA7C820F3" section-type="section-one"><enum>1.</enum><header>Strategic refinery

			 reserve</header>

			<subsection id="id3BAF3B0E7CFD43C082D8955CB2508C22"><enum>(a)</enum><header>Establishment</header>

				<paragraph id="IDca2e36794e6044538c9ab8bdc4fe965c"><enum>(1)</enum><header>In

			 general</header><text>The Secretary of Energy shall establish and operate a

			 Strategic Refinery Reserve (referred to in this section as the

			 <quote>Reserve</quote>) in the United States.</text>

				</paragraph><paragraph id="id3BF5AD14EC1F4CC89E27FF904B4C6EEE"><enum>(2)</enum><header>Authorities</header><text>To

			 carry out this subsection, the Secretary of Energy may contract for—</text>

					<subparagraph id="id8368C7E1944A4A179F3CE15D1C6860CA"><enum>(A)</enum><text>the construction

			 or operation of new refineries; or</text>

					</subparagraph><subparagraph id="idBD03816F4E864D51BA07454AF3842951"><enum>(B)</enum><text>the acquisition

			 or reopening of closed refineries.</text>

					</subparagraph></paragraph></subsection><subsection id="ID71b25ae99da845d9a35fd28a8b9d9b20"><enum>(b)</enum><header>Operation</header><text display-inline="yes-display-inline">The Secretary of Energy shall operate the

			 Reserve—</text>

				<paragraph id="ID8a117864a78a4f739ecc8a38e2e8e83f"><enum>(1)</enum><text>to provide

			 petroleum products to—</text>

					<subparagraph id="idF046F36448CA499BBC3AA4781289F9AB"><enum>(A)</enum><text>the Federal

			 Government (including the Department of Defense); and</text>

					</subparagraph><subparagraph id="idF335DDCF62A04538AE006A2535DC9E8E"><enum>(B)</enum><text>any State

			 governments and political subdivisions of States that opt to purchase refined

			 petroleum products from the Reserve; and</text>

					</subparagraph></paragraph><paragraph id="ID6efe14e0327a49239eae94ddd060a13d"><enum>(2)</enum><text>to provide

			 petroleum products to the general public during any period described in

			 subsection (c).</text>

				</paragraph></subsection><subsection id="ID477880e8e40a42a280dfdc6882ddb005"><enum>(c)</enum><header>Emergency

			 periods</header><text>The Secretary of Energy shall make petroleum products

			 from the Reserve available under subsection (b)(2) only if the President

			 determines that—</text>

				<paragraph id="IDbf9153d06833486abcaaab3319c96d50"><enum>(1)</enum><text>there is a severe

			 energy supply interruption within the meaning of the term under section 3 of

			 the <act-name parsable-cite="EPCA">Energy Policy and Conservation

			 Act</act-name> (42 U.S.C. 6202); or</text>

				</paragraph><paragraph id="ID2b223094f21b4a86a0fc5c7b5293e261"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id7FA7BB56F036494F9D92B9AC99278B75"><enum>(A)</enum><text>there is a regional

			 petroleum product supply shortage of significant scope and duration; and</text>

					</subparagraph><subparagraph id="idE8AF0E56C8A44E08B1BC022C5B5E14CB" indent="up1"><enum>(B)</enum><text>action taken under subsection (b)(2)

			 would directly and significantly assist in reducing the adverse impact of the

			 shortage.</text>

					</subparagraph></paragraph></subsection><subsection id="IDfa04e0b42924494d86a7bd604bfc11f2"><enum>(d)</enum><header>Locations</header><text>In

			 determining the location of a refinery for inclusion in the Reserve, the

			 Secretary of Energy shall take into account—</text>

				<paragraph id="IDac6c9f89de084669a87e26596b9f33de"><enum>(1)</enum><text>the impact of the

			 refinery on the local community, as determined after requesting and reviewing

			 any comments from State and local governments and the public;</text>

				</paragraph><paragraph id="ID638fd858a45649a4b3769d06719ab733"><enum>(2)</enum><text>regional

			 vulnerability to—</text>

					<subparagraph id="id33E5AE48E8C8435495576916A779D19A"><enum>(A)</enum><text>natural

			 disasters; and</text>

					</subparagraph><subparagraph id="IDafd7e2a543044ea1b0ac2c2f01b1dda6"><enum>(B)</enum><text>terrorist

			 attacks;</text>

					</subparagraph></paragraph><paragraph id="IDaf5e4d253abd46e4bd2cc7189d1aa9ee"><enum>(3)</enum><text>the proximity of

			 the refinery to the Strategic Petroleum Reserve;</text>

				</paragraph><paragraph id="ID9c9f12d9e414474298342c7463a732e0"><enum>(4)</enum><text>the accessibility

			 of the refinery to energy infrastructure and Federal facilities (including

			 facilities under the jurisdiction of the Department of Defense);</text>

				</paragraph><paragraph id="IDb8fab97164644c85a74c1cadbead57a8"><enum>(5)</enum><text>the need to

			 minimize adverse public health and environmental impacts; and</text>

				</paragraph><paragraph id="ID87a2b65694ad4b7186c955d1f660c4f8"><enum>(6)</enum><text>the energy needs

			 of the Federal Government (including the Department of Defense).</text>

				</paragraph></subsection><subsection id="ID58048c59fbbb4f21bfc4e5c386019467"><enum>(e)</enum><header>Increased

			 capacity</header><text>The Secretary of Energy shall ensure that refineries in

			 the Reserve are designed to provide a rapid increase in production capacity

			 during periods described in subsection (c).</text>

			</subsection><subsection id="ID6410b4a6098845fbb03af7491c1e6574"><enum>(f)</enum><header>Implementation

			 plan</header>

				<paragraph id="id186E8FAB41644E829BB3043EF5245A54"><enum>(1)</enum><header>In

			 general</header><text>Not later than 180 days after the date of the enactment

			 of this Act, the Secretary of Energy shall submit to Congress a plan for the

			 establishment and operation of the Reserve under this section.</text>

				</paragraph><paragraph id="id8579936854C342B089914BB7D87DFE6F"><enum>(2)</enum><header>Requirements</header><text>The

			 plan required under paragraph (1) shall—</text>

					<subparagraph id="id842C18D4278C475AB6FDAE75DC0993EF"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id5CC14F67626E4AB3AA9B7F6653BEC60E"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idD072C033FB1F420384539786D0DBBEC0"><enum>(I)</enum><text>provide for, within 2

			 years after the date of enactment of this Act, a capacity within the Reserve

			 equal to 5 percent of the total United States daily demand for gasoline,

			 diesel, and aviation fuel; and</text>

							</subclause><subclause id="id548BD7650B7D44F29A78DCEE670D0FD3" indent="up2"><enum>(II)</enum><text>provide for a capacity within the

			 Reserve such that not less than 75 percent of the gasoline and diesel fuel

			 produced by the Reserve contain an average of 10 percent renewable fuel (as

			 that term is defined in 211(o)(1)(C) of the Clean Air Act (42 U.S.C.

			 7545(o)(1)(C)); or</text>

							</subclause></clause><clause id="idD25F82F2C8784EE6AA19B442C1A47C75" indent="up1"><enum>(ii)</enum><text>if the Secretary of Energy finds

			 that achieving the capacity described in either subclause (I) or (II) of clause

			 (i) is not feasible within 2 years, include—</text>

							<subclause id="idFC1C1B66EAD34526A4302BFCA30FD427"><enum>(I)</enum><text>an explanation from the Secretary of

			 Energy of the reasons why achieving the capacity within the timeframe is not

			 feasible; and</text>

							</subclause><subclause id="id45850538DA60477B8F6AF125EBE92B76"><enum>(II)</enum><text>provisions for achieving the required

			 capacity as soon as practicable; and</text>

							</subclause></clause></subparagraph><subparagraph id="id5F7CB5867FB741DCB091A1309D8FCEF3"><enum>(B)</enum><text>provide for

			 adequate delivery systems capable of providing Reserve product to the entities

			 described in subsection (b)(1).</text>

					</subparagraph></paragraph></subsection><subsection id="idD88D5E59906C4DDEB12FC4714F943C38"><enum>(g)</enum><header>Coordination</header><text>The

			 Secretary of Energy shall carry out this section in coordination with the

			 Secretary of Defense.</text>

			</subsection><subsection id="ID6f96f265ca0d4d2ca47b04527084a058"><enum>(h)</enum><header>Compliance with

			 federal environmental requirements</header><text>Nothing in this section

			 affects any requirement to comply with Federal or State environmental or other

			 laws.</text>

			</subsection></section><section id="idD00EB477FFD64F4F8192028392A9E826"><enum>2.</enum><header>Reports on

			 refinery closures</header>

			<subsection id="ID36f091d40cbb4590a8385120c52c4327"><enum>(a)</enum><header>Reports to

			 secretary of energy</header>

				<paragraph id="idEA5F9CB4C9724BAEA5B0A605FEF9A9D7"><enum>(1)</enum><header>In

			 general</header><text>Not later than 180 days before permanently closing a

			 refinery in the United States, the owner or operator of the refinery shall

			 provide to the Secretary of Energy notice of the closing.</text>

				</paragraph><paragraph id="id471FAEABF25D42C78B4FBA0E4A0A34CB"><enum>(2)</enum><header>Requirements</header><text>The

			 notice required under paragraph (1) with respect to a refinery to be closed

			 shall include an explanation of the reasons for the closing of the

			 refinery.</text>

				</paragraph></subsection><subsection id="IDf6e3c7ffe60f48c3ae3f497edbae3cb9"><enum>(b)</enum><header>Reports to

			 congress</header><text>The Secretary of Energy shall, in consultation with the

			 Secretary of Defense, the Administrator of the Environmental Protection Agency,

			 and the Federal Trade Commission and as soon as practicable after receipt of a

			 report under subsection (a), submit to Congress—</text>

				<paragraph id="idC0A16DD3D7CA45F38340BFE1DA8381F0"><enum>(1)</enum><text>the report;

			 and</text>

				</paragraph><paragraph id="idF34D855FECF04BAE8C45340824D84D95"><enum>(2)</enum><text>an analysis of

			 the effects of the proposed closing covered by the report on—</text>

					<subparagraph id="idA2C7BEE22E0D4474AEE6124745A3608B"><enum>(A)</enum><text>in accordance

			 with the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et

			 seq.), supplies of clean fuel;</text>

					</subparagraph><subparagraph id="id1E13AB0DD9D8474A8B33060AA7D3EF8A"><enum>(B)</enum><text>petroleum product

			 prices;</text>

					</subparagraph><subparagraph id="id2615E6BCD031491A9D24E8E20DEC5FFD"><enum>(C)</enum><text>competition in

			 the refining industry;</text>

					</subparagraph><subparagraph id="idC175C693D4A24E81BFC27F648E8A9C38"><enum>(D)</enum><text>the national

			 economy;</text>

					</subparagraph><subparagraph id="id528AA7D99C04428582F691689441FEB4"><enum>(E)</enum><text>regional

			 economies;</text>

					</subparagraph><subparagraph id="id9F37AA611DAB48DA846AEA58CAF7F0F5"><enum>(F)</enum><text>regional supplies

			 of refined petroleum products;</text>

					</subparagraph><subparagraph id="idE04E7D0AE32241D590BC01FBA79E1A74"><enum>(G)</enum><text>the supply of

			 fuel to the Department of Defense; and</text>

					</subparagraph><subparagraph id="id064B532102F74FBDA7459F578B88CA93"><enum>(H)</enum><text>energy

			 security.</text>

					</subparagraph></paragraph></subsection></section></legis-body>
