			<subsection id="idF81BD290993F4F1DB1CE217406877616"><enum>(a)</enum><header>Short

			 title</header><text>This Act may be cited as the <quote><short-title>Court Security Improvement Act of

			 2005</short-title></quote>.</text>

			</subsection></section><section id="ID763362e2e6ad4eab94d8212bfe0d7321"><enum>2.</enum><header>Judicial branch

			 security requirements</header>

			<subsection id="ID63635d5feaf14700aa86cb18f13048ed"><enum>(a)</enum><header>Ensuring

			 Consultation and Coordination With the Judiciary</header><text>Section 566 of

			 title 28, United States Code, is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="id0EFCB334229749B5A4BC8F70205ED748" style="OLC">

					<subsection id="ID1e4c8c7b1fcb4aae98415818769a7c70"><enum>(i)</enum><text>The Director of

				the United States Marshals Service shall consult and coordinate with the

				Judicial Conference of the United States on a continuing basis regarding the

				security requirements for the judicial branch of the United States

				Government.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID755a84c8727e4b00a2c02405f77a1b44"><enum>(b)</enum><header>Conforming

			 amendment</header><text display-inline="yes-display-inline">Section 331 of

			 title 28, United States Code, is amended by adding at the end the

			 following:</text>

				<quoted-block act-name="" display-inline="no-display-inline" id="id5CFC80C7D02A440FA78F4ADB1A42EA06" style="OLC">

					<subsection id="id09AE50140CDD4531B038AE3794A44684"><enum></enum><text>The Judicial

				Conference shall consult and coordinate with the Director of United States

				Marshals Service on a continuing basis regarding the security requirements for

				the judicial branch of the United States

			</subsection></section><section id="idA3D95145930A4D2DB2F97FEE4E423CBB"><enum>3.</enum><header>Protection of

			 family members</header><text display-inline="no-display-inline">Section

			 105(b)(3) of the Ethics in Government Act of 1978 (5 U.S.C. App.) is

			 amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id15EDB630368F4487BFAF811DAD4460DE"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>or

			 a family member of that individual</quote> after <quote>that

			 individual</quote>; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE86A814EA2D5429E9A32722E12259B18"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)(i), by inserting

			 <quote>or a family member of that individual</quote> after <quote>the

			 report</quote>.</text>

			</paragraph></section><section id="ID483ef05b3c424ccab2c1b3f781053c26"><enum>4.</enum><header>Extension of

			 sunset provision</header><text display-inline="no-display-inline">Section

			 105(b)(3) of the Ethics in Government Act of 1978 (5 U.S.C. App) is amended by

			 striking <quote>2005</quote> each place that term appears and inserting

			 <quote>2009</quote>.</text>

		</section><section id="IDbf5a894c3fd6482bb2296e5f8a8ae9b9"><enum>5.</enum><header>Protections

			 against malicious recording of fictitious liens against Federal judges and

			 Federal law enforcement officers</header>

			<subsection id="ID41565d9aaf984a27b543213bf14a5f77"><enum>(a)</enum><header>Offense</header><text>Chapter

			 73 of title 18, United States Code, is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="id35FB2A9898C44DF496AFF56C23D4AC3A" style="USC">

					<section id="IDc9197c7a1f1f41b18c83d9b5376b5760"><enum>1521.</enum><header>Retaliating

				against a Federal judge or Federal law enforcement officer by false claim or

				slander of title</header>

						<subsection id="ID05b7f7ce15424b41b39221613dd40bf3"><enum>(a)</enum><text>Whoever files or

				attempts to file, in any public record or in any private record which is

				generally available to the public, any false lien or encumbrance against the

				real or personal property of a Federal judge or a Federal law enforcement

				official, on account of the performance of official duties by that Federal

				judge or Federal law enforcement official, knowing or having reason to know

				that such lien or encumbrance is false or contains any materially false,

				fictitious, or fraudulent statement or representation, shall be fined under

				this title or imprisoned for not more than 10 years, or both.</text>

						</subsection><subsection id="ID86d8c48f1fb74a67866f565bcf63262c"><enum>(b)</enum><text>As used in this

				section—</text>

							<paragraph id="IDd49671aee3154e76ab44886e2dad8411"><enum>(1)</enum><text>the term

				<term>Federal judge</term> means a justice or judge of the United States as

				defined in section 451 of title 28, United States Code, a judge of the United

				States Court of Federal Claims, a United States bankruptcy judge, a United

				States magistrate judge, and a judge of the United States Court of Appeals for

				the Armed Forces, United States Court of Appeals for Veterans Claims, United

				States Tax Court, District Court of Guam, District Court of the Northern

				Mariana Islands, or District Court of the Virgin Islands; and</text>

							</paragraph><paragraph id="IDd44a0080c50b4b6699f2319fb84b6f0b"><enum>(2)</enum><text>the term

				<term>Federal law enforcement officer</term> has the meaning given that term in

				section 115 of this title and includes an attorney who is an officer or

				employee of the United States in the executive branch of the

				Government.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="IDd5cdb86385a246c7bc6d0f9520f48aac"><enum>(b)</enum><header>Clerical

			 amendment</header><text>The chapter analysis for chapter 73 of title 18, United

			 States Code, is amended by adding at the end the following new item:</text>

			 individuals performing certain official duties</header>

			<subsection id="IDde4bb2b12fd04689b7219754ec41b48f"><enum>(a)</enum><header>Offense</header><text>Chapter

			 7 of title 18, United States Code, is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="id101B963A8F7D4913882352720FB3D0E9" style="USC">

					<section id="ID7cb23603f7ed4064bd65d9536997dc16"><enum>117.</enum><header>Protection of

				individuals performing certain official duties</header>

						<subsection id="IDa879df7bbb804ea589b700ffa4aedf3f"><enum>(a)</enum><text>Whoever knowingly

				makes restricted personal information about a covered official, or a member of

				the immediate family of that covered official, publicly available, with the

				intent that such restricted personal information be used to kill, kidnap, or

				inflict bodily harm upon, or to threaten to kill, kidnap, or inflict bodily

				harm upon, that covered official, or a member of the immediate family of that

				covered official, shall be fined under this title and imprisoned not more than

				5 years, or both.</text>

						</subsection><subsection id="ID0779bc57a3b048f8a863a944d4bf89fa"><enum>(b)</enum><text>As used in this

				section—</text>

							<paragraph id="ID5f10fec2beba497bafe83b1adea3b2c3"><enum>(1)</enum><text>the term

				<quote>restricted personal information</quote> means, with respect to an

				individual, the Social Security number, the home address, home phone number,

				mobile phone number, personal email, or home fax number of, and identifiable

				to, that individual;</text>

							</paragraph><paragraph id="IDb1341378f4e645f3a43384f16ae65f98"><enum>(2)</enum><text>the term

				<term>covered official</term> means—</text>

								<subparagraph id="IDbd085862d54043e9805c51220815084b"><enum>(A)</enum><text>an individual

				designated in section 1114;</text>

								</subparagraph><subparagraph id="IDfb08ae23bcc64a1bb062e6c041f38630"><enum>(B)</enum><text>a Federal judge

				or Federal law enforcement officer as those terms are defined in section 1521;

				or</text>

								</subparagraph><subparagraph id="ID3744878d02a5444fbd01f71599254e1c"><enum>(C)</enum><text>a grand or petit

				juror, witness, or other officer in or of, any court of the United States, or

				an officer who may be serving at any examination or other proceeding before any

				United States magistrate judge or other committing magistrate; and</text>

								</subparagraph></paragraph><paragraph id="IDd2aa39770c5a4de59d0f6109de84882e"><enum>(3)</enum><text>the term

				<term>immediate family</term> has the same meaning given that term in section

				115(c)(2).</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID96736f3d86a94811bf6b190da6e9fe7f"><enum>(b)</enum><header>Clerical

			 amendment</header><text>The chapter analysis for chapter 7 of title 18, United

			 States Code, is amended by adding at the end the following new item:</text>

			</subsection></section><section id="ID1203ca58579e4a118f91ea736a2cf8cc"><enum>7.</enum><header>Prohibition of

			 possession of dangerous weapons in Federal court facilities</header><text display-inline="no-display-inline">Section 930(e)(1) of title 18, United States

			 Code, is amended by inserting <quote>or other dangerous weapon</quote> after

			 <quote>firearm</quote>.</text>

		</section><section id="ID3a669cd44ff14bd2828c05a069829daa"><enum>8.</enum><header>Clarification of

			 venue for retaliation against a witness</header><text display-inline="no-display-inline">Section 1513 of title 18, United States

			 Code, is amended by adding at the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="id93534A28D5424198964C729F87558EC1" style="OLC">

				<subsection id="IDf1385c603d3a499bac40a5276594102a"><enum>(g)</enum><text>A prosecution

				under this section may be brought in the district in which the official

				proceeding (whether or not pending, about to be instituted or completed) was

				intended to be affected, or in which the conduct constituting the alleged

				offense

				occurred.</text>

				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="ID362065bc017748988c816bf5e14f49bf"><enum>9.</enum><header>Witness

			 protection grant program</header><text display-inline="no-display-inline">Title

			 I of the Omnibus Crime Control and Safe Streets Act of 1968 is amended by

			 inserting after part BB (42 U.S.C. 3797j et seq.) the following new

			 part:</text>

			<quoted-block display-inline="no-display-inline" id="id26108A9B599049F9AD3FA32AF97AD9E1" style="OLC">

				<part id="id782343CC32794AACAF77CAA95EC55687"><enum>II</enum><header>Witness

				protection grants</header>

					<section id="IDc7a2366cce8a4c4cb5bbbec220f6396b"><enum>2995.</enum><header>Program

				authorized</header>

						<subsection id="ID2ef1e13ac18743bf920265ab14ae3404"><enum>(a)</enum><header>In

				general</header><text>From amounts made available to carry out this part, the

				Attorney General may make grants to States, units of local government, and

				Indian tribes to create and expand witness protection programs in order to

				prevent threats, intimidation, and retaliation against victims of, and

				witnesses to, crimes.</text>

						</subsection><subsection id="ID31b1bd0a5e904558810e4b01a3ce0df3"><enum>(b)</enum><header>Uses of

				funds</header><text>Grants awarded under this part shall be—</text>

							<paragraph id="IDd4b3ec70642a44148ae77849602c4b5c"><enum>(1)</enum><text>distributed

				directly to the State, unit of local government, or Indian tribe; and</text>

							</paragraph><paragraph id="ID9eb50807a9f64b2db7a09a22650d5a14"><enum>(2)</enum><text>used for the

				creation and expansion of witness protection programs in the jurisdiction of

				the grantee.</text>

							</paragraph></subsection><subsection id="IDed55c6fcfd614779beb73b9718b8d746"><enum>(c)</enum><header>Preferential

				consideration</header><text>In awarding grants under this part, the Attorney

				General may give preferential consideration, if feasible, to an application

				from a jurisdiction that—</text>

							<paragraph id="IDe5bbb84e611c4fc6963935a868acefba"><enum>(1)</enum><text>has the greatest

				need for witness and victim protection programs;</text>

							</paragraph><paragraph id="ID6d141a54cf314e04a9ca37ef185a0e4b"><enum>(2)</enum><text>has a serious

				violent crime problem in the jurisdiction; and</text>

							</paragraph><paragraph id="ID84cbd758e4a04d8b92adde2c09d1363b"><enum>(3)</enum><text>has had, or is

				likely to have, instances of threats, intimidation, and retaliation against

				victims of, and witnesses to, crimes.</text>

							</paragraph></subsection><subsection id="ID472344f0ec114b5ebcaea6c5fa1ae754"><enum>(d)</enum><header>Authorization

				of appropriations</header><text>There are authorized to be appropriated to

				carry out this section $20,000,000 for each of fiscal years 2006 through

				2010.</text>

						</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="ID9276beee9dca4463a5896b51063a12ba"><enum>10.</enum><header>Grants to

			 states to protect witnesses and victims of crimes</header>

			<subsection id="ID4e7ab643291e4c58b9bf69b97e3bdbb9"><enum>(a)</enum><header>In

			 general</header><text>Section 31702 of the Violent Crime Control and Law

			 Enforcement Act of 1994 (42 U.S.C. 13862) is amended—</text>

				<paragraph id="ID1a6750818bc24bb08fbc7c530679dd42"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking

			 <quote>and</quote> at the end;</text>

				</paragraph><paragraph id="IDd22971a454e74873832c98fb8cd58605"><enum>(2)</enum><text>in paragraph (4),

			 by striking the period and inserting <quote>; and</quote>; and</text>

				</paragraph><paragraph id="IDebf425f0660b4161835099e8094c4b3f"><enum>(3)</enum><text>by adding at the

			 end the following:</text>

					<quoted-block display-inline="no-display-inline" id="id6A387DA1D3E14A36B06E47C0012F0127" style="OLC">

				</paragraph></subsection><subsection id="ID20e921839f904f7a8851ebb9df31bd87"><enum>(b)</enum><header>Authorization

			 of appropriations</header><text>Section 31707 of the Violent Crime Control and

			 Law Enforcement Act of 1994 (42 U.S.C. 13867) is amended to read as

			 follows:</text>

			 state courts for certain Federal grants</header>

			<subsection id="ID35c092ecd60a4cc2bec2e0c16461a32f"><enum>(a)</enum><header>Purpose of

			 grants</header><text>Section 510(b) of the Omnibus Crime Control and Safe

			 Streets Act of 1968 (42 U.S.C. 3760) is amended by inserting <quote>State

			 courts,</quote> after <quote>institutions,</quote>.</text>

			</subsection><subsection id="ID1daf45a6a4e1424fbba025536cf7803c"><enum>(b)</enum><header>Correctional

			 options grants</header><text>Section 515 of the Omnibus Crime Control and Safe

			 Streets Act of 1968 (42 U.S.C. 3762a) is amended—</text>

				<paragraph id="IDae1ec224f8b845a6a3dab5774deae24c"><enum>(1)</enum><text>in subsection

			 (a)—</text>

					<subparagraph id="IDbfa02c2b27234978a049f7d01209186c"><enum>(A)</enum><text>in paragraph (2),

			 by striking <quote>and</quote> at the end;</text>

					</subparagraph><subparagraph id="ID54b63e18f6134ed288cc5112553942ed"><enum>(B)</enum><text>in paragraph (3),

			 by striking the period and inserting <quote>; and</quote>; and</text>

			 State court applicants under subsection (a)(4) that have the greatest

			 demonstrated need to provide security in order to administer

			 516(a) of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.

			 <quote>80</quote> and inserting <quote>70</quote>;</text>

				</paragraph><paragraph id="IDb948cdc34ddd4e16a274962585ccd202"><enum>(2)</enum><text>striking

			 <quote>and 10</quote> and inserting <quote>10</quote>; and</text>

				</paragraph><paragraph id="ID0d35acab23574a2f839bbba4c81568eb"><enum>(3)</enum><text>inserting before

			 the period the following: <quote>, and 10 percent for section

			 515(a)(4)</quote>.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID174d899906db421c9439c9fa135f03ec" section-type="subsequent-section"><enum>12.</enum><header>United States court

			 of appeals for veterans claims</header><text display-inline="no-display-inline">Section 7253(e) of title 38, United States

			 Code, is amended by striking <quote>district courts</quote> and inserting

			 <quote>Courts of Appeals</quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idA46C9634F7D645FFBD4F0B783D8C0E09" section-type="subsequent-section"><enum>13.</enum><header>Bankruptcy,

			 Magistrate, and territorial judges life insurance</header>

			<subsection commented="no" display-inline="no-display-inline" id="id05CE5BD66F5C49CEBE26705465DDA51A"><enum>(a)</enum><header>Bankruptcy

			 judges</header><text>Section 153 of title 28, United States Code, is amended by

			 adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id811E23DBA6B94A84984C4225A01BF9F1" style="OLC">

					<subsection id="ID3a353c780146473d82594f667bcce0a4"><enum>(e)</enum><text>For purposes of

				construing and applying chapter 87 of title 5, United States Code, including

				any adjustment of insurance rates by regulation or otherwise, a bankruptcy

				judge of the United States in regular active service or who is retired under

				section 377 of this title shall be deemed to be a judge of the United States

				described under section 8701(a)(5) of title

				5.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id6817AE7BC863427BBEA2B0567CF47CFE"><enum>(b)</enum><header>United States

			 Magistrate judges</header><text>Section 634(c) of title 28, United States Code,

			 is amended—</text>

				<paragraph id="ID10f098e88a1246b6aa8bcfe443134abd"><enum>(1)</enum><text>by inserting

			 <quote>(1)</quote> after <quote>(c)</quote>; and</text>

				</paragraph><paragraph id="ID8891f6dcc06746fb89298c078d42ea3c"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

			 judges</header>

			 24 of the Organic Act of Guam (48 U.S.C. 1424b) is amended by adding at the end

			 the following:</text>

						<subsection id="IDf108a1ef07ef43d99bb1bb9f8d011f14"><enum>(c)</enum><text>For purposes of

				any adjustment of insurance rates by regulation or otherwise, a judge appointed

				under this section who is in regular active service or who is retired under

				section 373 of title 28, United States Code, shall be deemed to be a judge of

				the United States described under section 8701(a)(5) of title

				5.</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph id="ID22f5aadab4bb465c9eb6a4ac53251316"><enum>(2)</enum><header>Commonwealth of

			 the Northern Mariana Islands</header><text>Section 1(b) of the Act of November

			 8, 1977 (48 U.S.C. 1821) is amended by adding at the end the following:</text>

				under this section who is in regular active service or who is retired under

				section 373 of title 28, United States Code, shall be deemed to be a judge of

				the United States described under section 8701(a)(5) of title

				</paragraph><paragraph id="IDbabb0ae019974190a4b8fa6f51442369"><enum>(3)</enum><header>Virgin

			 Islands</header><text>Section 24(a) of the Revised Organic Act of the Virgin

			 Islands (48 U.S.C. 1614(a)) is amended—</text>

					<subparagraph id="IDdd2c698d426241109909029bde8b2ead"><enum>(A)</enum><text>by inserting

			 <quote>(1)</quote> after <quote>(a)</quote>; and</text>

					</subparagraph><subparagraph id="ID7af5e3d070054f15960090f3803a7e6c"><enum>(B)</enum><text>by adding at the

			 end the following:</text>

			 insurance for surviving family and spouses of judges</header><text display-inline="no-display-inline">Section 8901(3) of title 5, United States

			 Code, is amended—</text>

			<paragraph id="ID5f9bef54a3d1475ebabd807246479d43"><enum>(1)</enum><text>in subparagraph

			 (C), by striking <quote>; and</quote> and inserting a semicolon;</text>

			</paragraph><paragraph id="ID067bc11ab1364eaeb4e46c6c7efca791"><enum>(2)</enum><text>in subparagraph

			 (D), by adding <quote>and</quote> after the semicolon; and</text>

			</paragraph><paragraph id="IDd3ef48cbaee648109ef0366834aa0695"><enum>(3)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id34C8FF82275943E7B5F73C89C573F456" style="OLC">

					<subparagraph id="ID34c4cf31999d4b65b8ec48e939302eb8"><enum>(E)</enum><text>a member of a

				family who is a survivor of—</text>

				Justice or judge of the United States, as defined under section 451 of title

				28, United States Code;</text>

						</clause><clause id="ID349b2951d1e440ad995f5b1f5f9d4924"><enum>(ii)</enum><text>a judge of the

				District Court of Guam, the District Court of the Northern Mariana Islands, or

				the District Court of the Virgin Islands;</text>

						</clause><clause id="IDc37e85d3cb98436793eaaa8acbe493c5"><enum>(iii)</enum><text>a judge of the

				United States Court of Federal Claims; or</text>

						</clause><clause id="ID1cbcd653148148868a220db797d46f03"><enum>(iv)</enum><text>a United States

				bankruptcy judge or a full-time United States magistrate

				judge.</text>
