		<official-title>To amend the Internal Revenue Code of 1986 to modify the

		  determination and deduction of interest on qualified education

		  loans.</official-title>

		<section id="HAAE0E5592CC64BEC00BCDE866E93270" section-type="section-one"><enum>1.</enum><header>Interest determinations on

			 student loans</header>

			<subsection display-inline="no-display-inline" id="H18825BEE21B24AFB00B89DB3E6AD1008"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 221 of the

			 Internal Revenue Code of 1986 (relating to interest on education loans) is

			 amended by redesignating subsection (f) as subsection (g) and by inserting

			 after subsection (e) the following new subsection:</text>

				<quoted-block display-inline="no-display-inline" id="HA39CEE47B2D244C1B200E7B9C6C81F3E" style="OLC">

					<subsection id="HA14DB4E1B90B47ECBD9DB0AAEBABD3A6"><enum>(f)</enum><header>Determination of

				interest paid</header><text display-inline="yes-display-inline">In the case of

				a qualified education loan made after December 31, 2004, for purposes of this

				section and notwithstanding any other provision of this title—</text>

						<paragraph id="H6B4505544FAE4E8BA761002CEA67A8D8"><enum>(1)</enum><header>In

				general</header>

							<subparagraph id="HCF4588D1B8BD4C328215A1ABB72B0082"><enum>(A)</enum><header>Treatment as

				interest</header><text>Any payment on such loan shall be treated as a payment

				of interest to the extent of the balance, immediately before such payment, in

				the accumulated interest account with respect to such loan.</text>

							</subparagraph><subparagraph id="H835424F6375F42E49566382E12E9B851"><enum>(B)</enum><header>Exception</header><text>Subparagraph

				(A) shall not apply to any payment of collection costs, late fees, and

				penalties.</text>

							</subparagraph></paragraph><paragraph id="H96A1DEDC7FC14352A8DD69119078A3B5"><enum>(2)</enum><header>Accumulated

				interest account</header>

							<subparagraph id="H0BD7CB12C9724FCE87C8B2C8ED3818B"><enum>(A)</enum><header>In

				general</header><text>The term <term>accumulated interest account</term> means

				an account which is adjusted in accordance with this paragraph.</text>

							</subparagraph><subparagraph id="H440A5B377C244A10A6E0240700088F45"><enum>(B)</enum><header>Increases</header><text>The

				balance in the accumulated interest account shall be increased for any period

				by the sum of—</text>

								<clause id="HD5C94B1B41E84C60BF086171ACFB6D4F"><enum>(i)</enum><text>the loan

				origination fees incurred by the borrower in such period,</text>

								</clause><clause id="H0433ED3D8822444C8DB01113FC9355A"><enum>(ii)</enum><text>the amount of

				stated interest on the loan for such period, and</text>

								</clause><clause id="idE32F056D5A2F4625AE955A78FD24C38B"><enum>(iii)</enum><text>the amount of

				any fee imposed under section 428(b)(1)(H) of the Higher Education Act of 1965

				(20 U.S.C. 1078(b)(1)(H)).</text>

								</clause></subparagraph><subparagraph id="HE73E5A13263943E7897502C1D63F5300"><enum>(C)</enum><header>Decreases</header><text>The

				balance in the accumulated interest account shall be decreased (but not below

				zero) by payments made on the loan to the extent treated as interest under this

				section.</text>

							</subparagraph></paragraph><paragraph id="H10AE2B2423A043289C5C60EDE2396DDC"><enum>(3)</enum><header>Loan origination

				fees</header>

							<subparagraph id="H01530031303441E792CA11008B192BA2"><enum>(A)</enum><header>Federal

				programs</header><text display-inline="yes-display-inline">The term <term>loan

				origination fee</term> includes any fee imposed under any of the following

				provisions of the Higher Education Act of 1965:</text>

								<clause id="H8C3FA5A1204440CDAA7FA2E02E2342CB"><enum>(i)</enum><text display-inline="yes-display-inline">Section 438(c) (20 U.S.C.

				1087–1(c)).</text>

								</clause><clause id="H4E3D81B8DBF04D658FA3CFF387ADBB7"><enum>(ii)</enum><text display-inline="yes-display-inline">Section 455(c) (20 U.S.C. 1087e(c)).</text>

								</clause></subparagraph><subparagraph id="H7FB4555160014DC800C196EDC7EA70AD"><enum>(B)</enum><header>Fees for

				services or property excluded</header><text display-inline="yes-display-inline">Except as provided under subparagraph (A),

				the term <quote>loan origination fee</quote> does not include any fee which is

				a fee for services or property.</text>

							</subparagraph></paragraph><paragraph id="id439D75E9E6AE4BE7B16BAFED4D844C7D"><enum>(4)</enum><header>Stated

				interest</header><text>The term <term>stated interest</term> means, with

				respect to any period, the amount of interest determined for the period based

				on the stated rate of interest applicable to the period (whether or not the

				interest is required to be paid in such period).</text>

						</paragraph><paragraph id="H6EF40DC0D6B24372B89B12ADA6D38EC5"><enum>(5)</enum><header>Anti-abuse

				rule</header><text>The Secretary may prescribe rules to prevent the

				acceleration or deceleration of additions to the accumulated interest account

				where the loan origination fees or stated interest do not properly reflect the

				substance of the

				loan.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="H093D18E0192E4A34BCF007339E53405B"><enum>(b)</enum><header>Information

			 returns</header>

				<paragraph id="H4F9E4FEC14FE43F78737503CA3AAD97C"><enum>(1)</enum><header>Interest and

			 loan origination fee defined</header><text>Subsection (e) of section 6050S of

			 such Code (relating to the general rule for form and manner of returns) is

			 amended by inserting before the period at the end the following: <quote>, and

			 the term <quote>interest</quote> has the same meaning as when used in section

			 221</quote>.</text>

				</paragraph><paragraph id="HE59235708FE44742A3D549E4367EACD7"><enum>(2)</enum><header>Pre-2005

			 loans</header><text display-inline="yes-display-inline">The regulations under

			 section 6050S of the Internal Revenue Code of 1986 which are applicable to

			 loans made before September 1, 2004, shall also apply to loans made on or after

			 such date which are made before January 1, 2005.</text>

				</paragraph></subsection><subsection id="H2213FD37C5A44522AD06E4D6398F4C90"><enum>(c)</enum><header>Effective

			 date</header><text>The amendments made by this section shall apply to taxable

			 years beginning after December 31, 2004.</text>
