			 separation tolled during litigation</header><text display-inline="no-display-inline">Section 233 of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2293) is

			 amended by adding at the end the following:</text>

					<subsection id="IDE76681C59F7D46AF8FC4FF565A87066B"><enum>(h)</enum><header>Special rule

				for calculating separation</header><text>Notwithstanding any other provision of

				this chapter, any period during which a judicial or administrative appeal is

				pending with respect to the denial by the Secretary of a petition under section

				223 shall not be counted for purposes of calculating the period of separation

				under subsection (a)(2) and an adversely affected worker that would otherwise

				be entitled to a trade readjustment allowance shall not be denied such

				allowance because of such

				appeal.</text>

			 of Trade Adjustment Assistance Advisor</header>

				<subsection id="IDF07658A9D6BB4C2FB5D9CF1A98DC5A57"><enum>(a)</enum><header>In

			 general</header><text>Subchapter A of chapter 2 of title II of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> is amended by

			 inserting after section 221, the following new section:</text>

						<section id="ID61D452C11A6247A4AA9E4359E4BB941B"><enum>221A.</enum><header>Establishment

				of Trade Adjustment Assistance Advisor</header>

							<subsection id="ID0A7689A728F5453CA6FE7AA38851266D"><enum>(a)</enum><header>In

				general</header><text>There is established in the Department of Labor an office

				to be known as the <quote>Office of the Trade Adjustment Assistance

				Advisor</quote>. The Office shall be headed by a Director, who shall be

				responsible for providing assistance and advice to any person or entity

				described in section 221(a)(1) desiring to file a petition for certification of

				eligibility under section 221.</text>

							</subsection><subsection id="ID19B575346EDD46A28719A9CDE5E34BFE"><enum>(b)</enum><header>Technical

				assistance</header><text>The Director shall coordinate with each agency

				responsible for providing adjustment assistance under this chapter or chapter 6

				and shall provide technical and legal assistance and advice to enable persons

				or entities described in section 221(a)(1) to prepare and file petitions for

				certification under section

				221.</text>

							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="ID3AF08AFCB71B4F8CA98AF36F6B3266AB"><enum>(b)</enum><header>Technical

			 amendment</header><text>The table of contents for title II of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> is amended by

			 inserting after the item relating to section 221, the following:</text>

				evidence or information from an employer in order to make a determination under

				this section, the accuracy and completeness of any evidence or information

				submitted by the employer shall be certified by the employer’s legal counsel or

				by an officer of the

				employer.</text>

			</section><section id="ID3B59689C38BC4F6E8B59D2F072B733CB"><enum>104.</enum><header>Revision of

			 eligibility criteria</header>

				<subsection id="IDFA716C80F1EC48C0B70033E1CB7FD890"><enum>(a)</enum><header>Shifts in

			 production</header><text>Section 222(a)(2)(B) of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 (U.S.C.

			 2272(a)(2)(B)) is amended to read as follows:</text>

					<quoted-block act-name="Trade Act of 1974" id="IDBBF270F284EB4372A1F5F2712507864F">

						<subparagraph id="ID2E63799EAC314B10A4F1B50392CA4608" indent="up1"><enum>(B)</enum><text>there has been a shift in production

				by such workers’ firm or subdivision to a foreign country of articles like or

				directly competitive with articles which are produced by such firm or

				subdivision.</text>

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="IDC87AF0902460499AA17F9C4B4956AF12"><enum>(b)</enum><header>Wage

			 insurance</header>

					<paragraph id="ID1142F38C33424E54AE388503681072A8"><enum>(1)</enum><header>In

			 general</header><text>Section 246(a)(3) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2318(a)(3)) is

			 amended to read as follows:</text>

						<quoted-block act-name="Trade Act of 1974" id="ID0377D4011EE44A9DB862AA1B8915B9C9">

							<paragraph id="ID3BD25C1B6B4B4B76A29E6C395CDDEDB1"><enum>(3)</enum><header>Eligibility</header><text>A

				worker in a group that the Secretary has certified as eligible to apply for

				adjustment assistance under section 223 may elect to receive benefits under the

				alternative trade adjustment assistance program if the worker—</text>

								<subparagraph id="ID0CBFD58035554F9CBC238156BBC0443E"><enum>(A)</enum><text>obtains

				reemployment not more than 26 weeks after the date of separation from the

				adversely affected employment;</text>

								</subparagraph><subparagraph id="ID0842B27E70BE4A3097494D50458B3DA2"><enum>(B)</enum><text>is at least 40

				years of age;</text>

								</subparagraph><subparagraph id="ID01821BAA566E4662B10C384D88A18CD8"><enum>(C)</enum><text>earns not more

				than $50,000 a year in wages from reemployment;</text>

								</subparagraph><subparagraph id="ID56142EA1CA7D4898BF12AF1E98CDE493"><enum>(D)</enum><text>is employed on a

				full-time basis as defined by State law in the State in which the worker is

				employed; and</text>

								</subparagraph><subparagraph id="IDADBE6450356B4E46AB2F4A9C72C74F87"><enum>(E)</enum><text>does not return

				to the employment from which the worker was

				separated.</text>

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph><paragraph id="IDE48ECAA96AF84C95A262A6507F257713"><enum>(2)</enum><header>Conforming

			 amendments</header>

						<subparagraph id="ID00E02399541F46069D1CB8D074AF8B08"><enum>(A)</enum><text>Subparagraphs (A)

			 and (B) of section 246(a)(2) of the <act-name parsable-cite="TA74">Trade Act of

			 1974</act-name> (19 U.S.C. 2318(a)(2)) are amended by striking <quote>paragraph

			 (3)(B)</quote> and inserting <quote>paragraph (3)</quote> each place it

			 appears.</text>

						</subparagraph><subparagraph id="ID3C14B4DC380C431799432983F6EC80EB"><enum>(B)</enum><text>Section 246(b)(2)

			 of such Act is amended by striking <quote>subsection (a)(3)(B)</quote> and

			 inserting <quote>subsection (a)(3)</quote>.</text>

						</subparagraph></paragraph></subsection><subsection id="IDCAA034E69112402CA36D3566A2A28353"><enum>(c)</enum><header>Downstream

			 workers</header><text>Section 222(c)(3) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 (U.S.C. 2272(c)(3)) is

			 amended by striking <quote>, if the certification of eligibility</quote> and

			 all that follows to the end period.</text>

				</subsection></section><section id="ID1C63468A9F564F0F86C59B4675E7F4E7"><enum>105.</enum><header>Training</header>

				<subsection id="IDB1F7486315B74EC8B17154166B53DDF0"><enum>(a)</enum><header>Modification of

			 enrollment deadlines</header><text>Section 231(a)(5)(A)(ii) of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C.

			 2291(a)(5)(A)(ii)) is amended—</text>

					<paragraph id="ID40C48063D7854995AE7D6975E9E20CC1"><enum>(1)</enum><text>in subclause (I),

			 by striking <quote>16th week</quote> and inserting <quote>26th week</quote>;

			 and</text>

					</paragraph><paragraph id="ID32FAE095FAE4407EA5E06C5C883A4730"><enum>(2)</enum><text>in subclause

			 (II), by striking <quote>8th week</quote> and inserting <quote>20th

			 week</quote>.</text>

					</paragraph></subsection><subsection id="IDC010C7BE3F8F4EE89BF252DC6D4F8AED"><enum>(b)</enum><header>Extension of

			 allowance to accommodate training</header><text>Section 233 of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2293) is

			 amended by adding at the end the following:</text>

					<quoted-block act-name="Trade Act of 1974" id="IDA474C37D8CD54294844FA0FD572679AC">

						<subsection id="ID0BEAC44D1F394CA7820E4C68086791C6"><enum>(h)</enum><header>Extension of

				allowance</header><text>Notwithstanding any other provision of this section, a

				trade readjustment allowance may be paid to a worker for a number of additional

				weeks equal to the number of weeks the worker’s enrollment in training was

				delayed beyond the deadline applicable under section 231(a)(5)(A)(ii) pursuant

				to a waiver granted under section

				231(c)(1)(E).</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="idC8C1B0963A9646138F76061EA387DA40"><enum>(c)</enum><header>Funding for

			 training</header><text>Section 236(a) of the Trade Act of 1974 (19 U.S.C.

			 2296(a)) is amended—</text>

					<paragraph id="id2AD6EF059236469784252484D2C9CD1E"><enum>(1)</enum><text>in paragraph (1)

			 by striking <quote>Upon such approval</quote> and all that follows to the end;

			 and</text>

					</paragraph><paragraph id="id3878148007024D70BD5316E507028887"><enum>(2)</enum><text>by amending

			 paragraph (2) to read as follows:</text>

						<quoted-block display-inline="no-display-inline" id="idF52DEDED737A4AF9AAE45F0DA7A32B9F" style="OLC">

							<paragraph id="idA6C9932B0CFB40BC91D08AAC4297C1ED"><enum>(2)(A)</enum><text>Upon approval

				of a training program under paragraph (l), and subject to the limitations

				imposed by this section, an adversely affected worker covered by a

				certification issued under section 223 shall be eligible to have payment of the

				costs of that training, including any costs of an approved training program

				incurred by a worker before a certification was issued under section 223, made

				on behalf of the worker by the Secretary directly or through a voucher

				system.</text>

								<subparagraph id="IDa15621f66dc943bb8c72c3b5a426eaf5" indent="up1"><enum>(B)</enum><text>Not later than 6 months after the date

				of enactment of the Trade Adjustment Assistance Improvement Act of 2005, the

				Secretary shall develop and submit to Congress for approval a formula that

				provides workers with an individual entitlement for training costs to be

				administered pursuant to sections 239 and 240. The formula shall take into

				account—</text>

									<clause id="IDbaecb1ccfb9146cf98c329c6e36bffa6"><enum>(i)</enum><text>the number of workers enrolled in

				trade adjustment assistance;</text>

									</clause><clause id="IDae8a17518c9a488fb438bb7a9487aa20"><enum>(ii)</enum><text>the duration of the

				assistance;</text>

									</clause><clause id="ID9b3841f784ba476a83b93ef7cbb05e32"><enum>(iii)</enum><text>the anticipated training costs

				for workers; and</text>

									</clause><clause id="ID03a3135f8d4840ad9b5ddac4a9695da1"><enum>(iv)</enum><text>any other factors the Secretary

				deems appropriate.</text>

									</clause></subparagraph><subparagraph id="ID09fc84010a9c4cd4acf9d67f9868a7d7" indent="up1"><enum>(C)</enum><text>Until such time as Congress approves

				the formula, the total amount of payments that may be made under subparagraph

				(A) for any fiscal year shall not exceed fifty percent of the amount of trade

				readjustment allowances paid to workers during that fiscal

				year.</text>

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection id="id38B7E85CDFDA4DCC913DABF2210A88FF"><enum>(d)</enum><header>Approved

			 training programs</header>

					<paragraph id="id5EFD0FE5C9C1432FA1C15AE0442D76EE"><enum>(1)</enum><header>In

			 general</header><text>Section 236(a)(5) of the Trade Act of 1974 (19 U.S.C.

			 2296(a)(5)) is amended—</text>

						<subparagraph id="idC073CB78F45A4445BFE85D20444D44C9"><enum>(A)</enum><text>by striking

			 <quote>and</quote> at the end of subparagraph (E);</text>

						</subparagraph><subparagraph id="id121E0235E9344E7590610E515CAC1C24"><enum>(B)</enum><text>by redesignating

			 subparagraph (F) as subparagraph (H); and</text>

						</subparagraph><subparagraph id="idF2079FBECA4344B094E759E4523BD67C"><enum>(C)</enum><text>by inserting

			 after subparagraph (E) the following:</text>

			 247 of the Trade Act of 1974 (19 U.S.C. 2319) is amended by adding at the end

			 the following:</text>

							<paragraph id="idD4A97F32A1994C95AA3B423D3CF7384C"><enum>(18)</enum><text>The term

				<term>integrated workforce training</term> means training that integrates

				occupational skills training with English language

				acquisition.</text>

			 administrative costs</header><text display-inline="no-display-inline">Section

			 241 of the Trade Act of 1974 (19 U.S.C. 2313) is amended by adding at the end

			 the following:</text>

				<quoted-block display-inline="no-display-inline" id="id2350EC69E718490391412192BC9566DC" style="OLC">

					<subsection id="id896699B490604EFF9910F7360CAD898D"><enum>(d)</enum><text>Funds provided by

				the Secretary to a State to cover administrative costs associated with the

				performance of a State's responsibilities under section 239 shall be sufficient

				to cover all costs of the State associated with operating the trade adjustment

				assistance program, including case worker

				costs.</text>

			 of appropriations</header>

				<subsection id="id315F1E2D890E415BAA394387978BD15E"><enum>(a)</enum><header>In

			 general</header><text>Section 245(a) of the Trade Act of 1974 (19 U.S.C.

			 2317(a)) is amended by striking <quote>2007</quote> and inserting

			 <quote>2012</quote>.</text>

				evaluations</header><text>The Secretary shall establish an effective

				performance measuring system to evaluate the following:</text>

				performance</header><text>A comparison of the trade adjustment assistance

				program before and after the effective date of the Trade Adjustment Assistance

				Reform Act of 2002 with respect to—</text>

									<subparagraph id="ID64F9487C9015452294CFCBBB0B17AB52"><enum>(A)</enum><text>the number of

				workers certified and the number of workers actually participating in the trade

				adjustment assistance program;</text>

									</subparagraph><subparagraph id="IDE18D283DB97C415F9B660B4D929B1785"><enum>(B)</enum><text>the time for

				processing petitions;</text>

									</subparagraph><subparagraph id="ID1BEC04CA965C47649852AAE114CE2632"><enum>(C)</enum><text>the number of

				training waivers granted;</text>

									</subparagraph><subparagraph id="IDB5264295C89F4D1F829D9441408FF3DB"><enum>(D)</enum><text>the coordination

				of programs under this chapter with programs under the Workforce Investment Act

				of 1998 (29 U.S.C. 2801 et seq.);</text>

									</subparagraph><subparagraph id="IDFE481F778EDC46B7912ACC5DDF089ABF"><enum>(E)</enum><text>the effectiveness

				of individual training providers in providing appropriate information and

				training;</text>

									</subparagraph><subparagraph id="ID6FE98BA73A584A46BC660ADBE9B21C5B"><enum>(F)</enum><text>the extent to

				which States have designed and implemented health care coverage options under

				title II of the Trade Act of 2002, including any difficulties States have

				encountered in carrying out the provisions of title II;</text>

									</subparagraph><subparagraph id="ID7EBD7C5B9FA445459B67E6EE367AF6F4"><enum>(G)</enum><text>how Federal,

				State, and local officials are implementing the trade adjustment assistance

				program to ensure that all eligible individuals receive benefits, including

				providing outreach, rapid response, and other activities; and</text>

									</subparagraph><subparagraph id="ID6975F54FD4794F73B6814702B1BA4064"><enum>(H)</enum><text>any other data

				necessary to evaluate how individual States are implementing the requirements

				of this chapter.</text>

									</subparagraph></paragraph><paragraph id="ID1C0BEDDBEB7241DD88414F1ED06C3350"><enum>(2)</enum><header>Program

				participation</header><text>The effectiveness of the program relating

				to—</text>

									<subparagraph id="ID6BA616CBCA974CB38041036FA1F6DA5C"><enum>(A)</enum><text>the number of

				workers receiving benefits and the type of benefits being received both before

				and after the effective date of the Trade Adjustment Assistance Reform Act of

				2002;</text>

									</subparagraph><subparagraph id="ID1ACB5A1E44C24A42870453B743EF2F3F"><enum>(B)</enum><text>the number of

				workers enrolled in, and the duration of, training by major types of training

				both before and after the effective date of the Trade Adjustment Assistance

				Reform Act of 2002;</text>

									</subparagraph><subparagraph id="IDC86186532A044E7DAB485F3012E4264D"><enum>(C)</enum><text>earnings history

				of workers that reflects wages before separation and wages in any job obtained

				after receiving benefits under this Act;</text>

									</subparagraph><subparagraph id="ID5DC8BD9027A246E1ACB068F4922F853E"><enum>(D)</enum><text>reemployment

				rates and sectors in which dislocated workers have been employed;</text>

									</subparagraph><subparagraph id="IDCF11E5E1D1B44CA6997FD7C6448862E9"><enum>(E)</enum><text>the cause of

				dislocation identified in each petition that resulted in a certification under

				this chapter; and</text>

									</subparagraph><subparagraph id="IDE64FB94BC8DF4606BDBA09344D64FE8E"><enum>(F)</enum><text>the number of

				petitions filed and workers certified in each congressional district of the

				United States.</text>

									</subparagraph></paragraph></subsection><subsection id="IDC8D2C2A51C374CEEA2A3346B7EFEB51E"><enum>(c)</enum><header>State

				participation</header><text>The Secretary shall ensure, to the extent

				practicable, through oversight and effective internal control measures the

				following:</text>

								<paragraph id="ID98CB5C3494B74605963283450744284A"><enum>(1)</enum><header>State

				participation</header><text>Participation by each State in the performance

				measurement system established under subsection (b) and shall provide

				incentives for States to supplement employment and wage data obtained through

				the use of unemployment insurance wage records.</text>

								</paragraph><paragraph id="ID964A0B904BDD4EB8AE4530694480235E"><enum>(2)</enum><header>Monitoring</header><text>Monitoring

				by each State of internal control measures with respect to performance

				measurement data collected by each State.</text>

								</paragraph><paragraph id="ID440EBD605A294843BEE4C95D127318AA"><enum>(3)</enum><header>Response</header><text>The

				quality and speed of the rapid response provided by each State under section

				134(a)(2)(A) of the Workforce Investment Act of 1998 (29 U.S.C.

				2864(a)(2)(A)).</text>

								</paragraph></subsection><subsection id="ID84838591FFF64DA6BF4A0A49B0667850"><enum>(d)</enum><header>Reports</header>

								<paragraph id="IDE24AA3B8A59442CDA2EDF94C95A16715"><enum>(1)</enum><header>Reports by the

				Secretary</header>

									<subparagraph id="IDEFC7EE36B37A42D99663B3007DF72FE6"><enum>(A)</enum><header>Initial

				report</header><text>Not later than 6 months after the date of enactment of the

				Trade Adjustment Assistance Accountability Act, the Secretary shall submit to

				the Committee on Finance of the Senate and the Committee on Ways and Means of

				the House of Representatives a report that—</text>

										<clause id="IDC2539416538146458CE679CC19C1FA7C"><enum>(i)</enum><text>describes the

				performance measurement system established under subsection (b);</text>

										</clause><clause id="IDCDF30300A7E94E9D9F0F909E1098D125"><enum>(ii)</enum><text>includes

				analysis of data collected through the system established under subsection (b);

				and</text>

										</clause><clause id="IDB489E18CB95F43BEB2BB946C4AB363F0"><enum>(iii)</enum><text>provides

				recommendations for program improvements.</text>

										</clause></subparagraph><subparagraph id="IDF95EAE17602645A4BDF5143E5BC2FA4C"><enum>(B)</enum><header>Annual

				report</header><text>Not later than 1 year after the date the report is

				submitted under subparagraph (A), and annually thereafter, the Secretary shall

				submit to the Committee on Finance of the Senate and the Committee on Ways and

				Means of the House of Representatives and release to the public a report that

				includes the information collected under clause (ii) of subparagraph

				(A).</text>

									</subparagraph></paragraph><paragraph id="IDA73C97200CAA470A8D702CAD000E11C4"><enum>(2)</enum><header>State

				reports</header><text>Pursuant to regulations prescribed by the Secretary, each

				State shall submit to the Secretary a report that details its participation in

				the programs established under this chapter, and that contains the data

				necessary to allow the Secretary to submit the report required under paragraph

				(1).</text>

								</paragraph><paragraph id="IDDBDFB4C4C13F444C8B63AB1204B1F2F8"><enum>(3)</enum><header>Publication</header><text>The

				Secretary shall make available to each State, to Congress, and to the public,

				the data gathered and evaluated through the performance measurement system

				established under subsection

				(b).</text>

								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="IDD33E925851A64E9CB9E0BEFE794D0298"><enum>(b)</enum><header>Conforming

			 amendments</header>

					<paragraph id="ID38608BA6E8854A52ADA0AD18B0CD1EDF"><enum>(1)</enum><header>Coordination</header><text>Section

			 281 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19

			 U.S.C. 2392) is amended by striking <quote>Departments of Labor and

			 Commerce</quote> and inserting <quote>Departments of Labor, Commerce, and

			 Agriculture</quote>.</text>

					</paragraph><paragraph id="IDB82606605CC7486590070648C9927A91"><enum>(2)</enum><header>Trade

			 monitoring system</header><text>Section 282 of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2393) is

			 amended by striking <quote>The Secretary of Commerce and the Secretary of

			 Adjustment Assistance for farmers</header>

			<section id="ID33B2143C9C9845B1949A4CD11AD84591"><enum>301.</enum><header>Clarification

			 of marketing year and other provisions</header>

				<subsection id="ID404F35BC4E314578BDF25925188093B6"><enum>(a)</enum><header>In

			 general</header><text>Section 291(5) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2401(5)) is

			 amended by inserting before the end period the following: <quote>, or in the

			 case of an agricultural commodity that has no officially designated marketing

			 year, in a 12-month period for which the petitioner provides written

			 request</quote>.</text>

				</subsection><subsection id="ID74D3DB9A94144209B7861C11BB100D41"><enum>(b)</enum><header>Fishermen</header><text>Notwithstanding

			 any other provision of law, for purposes of chapter 2 of title II of the

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2271 et

			 seq.) fishermen who harvest wild stock shall be eligible for adjustment

			 assistance to the same extent and in the same manner as a group of workers

			 under such chapter 2.</text>

				</subsection></section><section id="ID0E13A54F8EB540A4A98E393BA2F4C4AE"><enum>302.</enum><header>Eligibility</header>

				<subsection id="ID6984522319E84AA9ACAF9809A5328C2F"><enum>(a)</enum><header>In

			 general</header><text>Section 292(c)(1) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2401a(c)(1)) is

			 amended by striking <quote>80 percent</quote> and inserting <quote>90

			 percent</quote>.</text>

				</subsection><subsection id="ID9F0CC3CF57B74954BF172C0380BCA75B"><enum>(b)</enum><header>Net farm

			 income</header><text>Section 296(a)(1)(C) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2401e(a)(1)(C)) is

			 amended by inserting before the end period the following: <quote>or the

			 producer had no positive net farm income for the 2 most recent consecutive

			 years in which no adjustment assistance was received by the producer under this

			 chapter</quote>.</text>
