		<official-title>To strengthen the national flood insurance program,

		  encourage participation in the program, and provide owners of properties not

		  located in flood hazard zones a one-time opportunity to purchase flood

		  insurance coverage for a period covering such hurricane.</official-title>

		<section id="H8F00E7231A2B4BF58C6FBE5EAF649D00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Hurricanes Katrina and Rita Flood

			 Insurance Buy-In Act of 2005</short-title></quote>.</text>

		</section><section id="HA9667ACED7BE4DFD895CD1A9E7540055"><enum>2.</enum><header>Temporary flood

			 insurance buy-in program</header>

			<subsection id="H32E418BFA80849CCB80936B388E6673F"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Director of the

			 Federal Emergency Management Agency shall make available flood insurance

			 coverage under the national flood insurance program for eligible structures, in

			 accordance with this section.</text>

			</subsection><subsection id="H333EBE7F2216435A8C35E2A6F6C1634"><enum>(b)</enum><header>Scope of

			 coverage</header>

				<paragraph id="H2AB4E7C5621A4E99A58751627BF21628"><enum>(1)</enum><header>Eligible

			 losses</header><text>Coverage may be made available under this section only for

			 damage or loss to an eligible structure, but not including any contents

			 thereof, from flooding resulting from Hurricane Katrina or Hurricane Rita of

			 2005.</text>

				</paragraph><paragraph id="HB0CEEE97B5A1463BB22DA540FCD0C497"><enum>(2)</enum><header>Amount</header><text>The

			 amount of coverage made available under this section for an eligible structure

			 may not exceed the lesser of—</text>

					<subparagraph id="HDF80203FC0AF466180DEA54B5EFD2021"><enum>(A)</enum><text>the maximum amount

			 of coverage that may be made available for such structure under the national

			 flood insurance program; and</text>

					</subparagraph><subparagraph id="H7F262D3B9CA349F097EEF4821783922E"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of coverage provided for the

			 structure, as of August 29, 2005, under the policy for losses caused by wind or

			 windstorm (as referred to in subsection (c)(4)).</text>

					</subparagraph></paragraph></subsection><subsection id="H9B481EAFC01846AEA800FAAD18E4F923"><enum>(c)</enum><header>Eligible

			 structures</header><text>For purposes of this section, an eligible structure is

			 a structure that—</text>

				<paragraph id="HEB8F01571C8C49ECA8E172239B2651A9"><enum>(1)</enum><text>sustained damage

			 from flooding resulting from Hurricane Katrina or Hurricane Rita of

			 2005;</text>

				</paragraph><paragraph id="HCB0B7982EC28456DA1C9F63EC0693313"><enum>(2)</enum><text>is of a type

			 (including residential properties, business properties, and others) for which

			 coverage was generally made available under the national flood insurance

			 program as of August 29, 2005;</text>

				</paragraph><paragraph id="HD3025C82FACC4D16980063C140D40864"><enum>(3)</enum><text>is located in a

			 covered disaster area;</text>

				</paragraph><paragraph id="H16259C679E574357BB656D23345735BB"><enum>(4)</enum><text display-inline="yes-display-inline">was covered—</text>

					<subparagraph id="HDB6E5A609DCD4BFAAAE31448E391D500"><enum>(A)</enum><text>in the case of a

			 structure damaged by flooding resulting from Hurricane Katrina, as of August

			 29, 2005, by an insurance policy for losses caused by wind or windstorm;

			 and</text>

					</subparagraph><subparagraph id="H95EF0A129E7B431FB616EDB4A5F630C3"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a structure damaged by

			 flooding resulting from Hurricane Rita, as of September 23, 2005, by such a

			 policy;</text>

					</subparagraph></paragraph><paragraph id="H499E67285F304213B3C52397883391A7"><enum>(5)</enum><text>is not located in

			 an area that has been identified by the Director as an area having special

			 flood hazards (as such term is used for purposes of section 102 of the Flood

			 Disaster Protection Act of 1973 (42 U.S.C. 4012a)); and</text>

				</paragraph><paragraph id="HAE42F215269E4559A246C854844902BD"><enum>(6)</enum><text>was not covered by

			 flood insurance made available under the national flood insurance program at

			 the time of such damage.</text>

				</paragraph></subsection><subsection id="H3EC4FF7E939840C69900CB6549001D00"><enum>(d)</enum><header>Premiums</header>

				<paragraph id="HA147D58C0FEE4C6C90974F182D8363F0"><enum>(1)</enum><header>Amount</header><text>The

			 Director shall charge, for coverage made available under this section for an

			 eligible structure, premiums in the amount equal to 105 percent of the

			 aggregate amount of premiums that would have been charged, at the time, for

			 coverage for the structure under the national flood insurance program (for the

			 type and amount of coverage provided) for the 10-year period that ends upon the

			 date of purchase of such coverage.</text>

				</paragraph><paragraph id="H8B0D12974680417DA8EAFA5B34CEBAD"><enum>(2)</enum><header>Deduction from

			 claims</header><text>The Director shall provide that a purchaser of coverage

			 made available under this section may pay premiums charged for such coverage

			 under paragraph (1) by deducting such amounts from the amount of any claims

			 payable under such coverage.</text>

				</paragraph><paragraph id="HBAF9AE5B6671413C87CC7000529BE287"><enum>(3)</enum><header>Credits to

			 NFIF</header><text>There shall be credited to the National Flood Insurance Fund

			 established under section 1310 of the National Flood Insurance Act of 1968 (42

			 U.S.C. 4017) the following amounts:</text>

					<subparagraph id="H882BEF876C4249378DD79217107882DD"><enum>(A)</enum><text display-inline="yes-display-inline">Any premiums collected pursuant to this

			 section.</text>

					</subparagraph><subparagraph id="HE08D92325EAF476690682800DA113E8B"><enum>(B)</enum><text>From amounts

			 appropriated under subsection (i)(1), an amount equal to the amount of any

			 premiums charged for coverage made available under this subsection that are not

			 collected by the Director as a result of the operation of paragraph (2).</text>

					</subparagraph></paragraph></subsection><subsection id="HDE438E4B0B024BD7AFD07079C93B5D10"><enum>(e)</enum><header>Claims</header>

				<paragraph id="id90E98050F41E4133BF3FA7256963FC5B"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Claims for damage or

			 loss pursuant to coverage made available under this section may be paid only

			 from amounts made available in appropriation Acts under subsection (i).</text>

				</paragraph><paragraph id="id17A6CA6BA99A4295A09143B8E239506F"><enum>(2)</enum><header>Exclusion</header><text display-inline="yes-display-inline">Amounts in the National Flood Insurance

			 Fund established under section 1310 of the National Flood Insurance Act of 1968

			 (42 U.S.C. 4017), including any amount credited to such Fund under subsection

			 (d)(3), shall not be available for paying claims under coverage made available

			 under this section.</text>

				</paragraph></subsection><subsection id="HE2A726C70EAE4FB3A08E00B37D4C03FE"><enum>(f)</enum><header>Requirements to

			 obtain future coverage and take mitigation actions</header><text>The Director

			 may not make coverage available under this section for an eligible structure

			 unless the owner of the structure enters into a binding agreement, contained in

			 such deed restrictions as the Director considers appropriate, to ensure that

			 such owner, and any future owners, will—</text>

				<paragraph id="HDDA61D5E6DEB44239F2B002744EF5653"><enum>(1)</enum><text display-inline="yes-display-inline">at all times after purchasing coverage

			 under this section for the structure, in perpetuity, maintain coverage under

			 the national flood insurance program, for any structures located at any time on

			 the same property on which, at the time of purchase, such eligible structure is

			 located, in an amount at least equal to the lesser of—</text>

					<subparagraph id="H574FCE4DB2CC4EB9878446AD09E27CEF"><enum>(A)</enum><text>the value of the

			 structure, as determined by the Director; or</text>

					</subparagraph><subparagraph id="HD20D8419E60540F2ACBFFE1EB539AF14"><enum>(B)</enum><text>the maximum limit

			 of coverage made available with respect to the particular type of property

			 under the national flood insurance program; and</text>

					</subparagraph></paragraph><paragraph id="HB9EF8588F41A4A0B8EA21BF6F519F4C6"><enum>(2)</enum><text display-inline="yes-display-inline">accept any offer to take mitigation actions

			 or activities made, with respect to the structure, under a mitigation program

			 under section 1323, 1361A, or 1366 of the National Flood Insurance Act of 1968

			 (42 U.S.C. 4030, 4102a, 4104c).</text>

				</paragraph></subsection><subsection id="HF0184BE33EC74C2F007C829BDF41D5D9"><enum>(g)</enum><header>Premium rates

			 for future coverage</header><text display-inline="yes-display-inline">In

			 establishing rates for flood insurance coverage, other than coverage under this

			 section, made available under the national flood insurance program, the

			 Director shall not consider, in any manner—</text>

				<paragraph id="HF18718A5717540ED8D7DD3D519AE39FF"><enum>(1)</enum><text>any premiums

			 charged or collected under subsection (d);</text>

				</paragraph><paragraph id="H1940FD9FFAEE41C384F1D2622CBEE326"><enum>(2)</enum><text>any claims paid

			 pursuant to coverage made available under this section; or</text>

				</paragraph><paragraph id="HEEEB0390C2004E3E88F771BAC8A8E63"><enum>(3)</enum><text>any amounts

			 appropriated under subsection (i).</text>

				</paragraph></subsection><subsection id="H974A3563DA2645519FC7E85FB5F6D3"><enum>(h)</enum><header>Definitions</header><text>For

			 purposes of this section, the following definitions shall apply:</text>

				<paragraph id="HCBB489C187304DF4AE8D87C3E9933700"><enum>(1)</enum><header>Covered disaster

			 area</header><text>The term <quote>covered disaster area</quote> means an

			 area—</text>

					<subparagraph id="H3943617EF86A4D57AD41538B20513CC2"><enum>(A)</enum><text>for which a major

			 disaster was declared by the President pursuant to title IV of the Robert T.

			 Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.)

			 as a result of Hurricane Katrina or Hurricane Rita of 2005; and</text>

					</subparagraph><subparagraph id="H7F2AE679464E44F800083288FEA5EBB8"><enum>(B)</enum><text display-inline="yes-display-inline">in which the sale of flood insurance

			 coverage was available under the National Flood Insurance Act of 1968 (42

			 U.S.C. 4001 et seq.) as of August 25, 2005.</text>

					</subparagraph></paragraph><paragraph id="H0888BE12E38446DBB5A5CB264B5BADB8"><enum>(2)</enum><header>Director</header><text>The

			 term <quote>Director</quote> means the Director of the Federal Emergency

			 Management Agency.</text>

				</paragraph></subsection><subsection id="H8D9603F082164206BC4247BCADE5100"><enum>(i)</enum><header>Authorization of

			 appropriations</header>

				<paragraph id="H3F9B87D5091A49F2ACF7CC00D9B48000"><enum>(1)</enum><header>For claims

			 payments</header><text>There are authorized to be appropriated to the Director,

			 such sums as may be necessary to cover all costs of flood insurance coverage

			 made available under this section, including administrative expenses and claims

			 under such coverage.</text>

				</paragraph><paragraph id="HC97B45D0A06F4A88AB271F2FC975AE7"><enum>(2)</enum><header>For mitigation

			 assistance</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated such sums as may be necessary, for the National

			 Flood Insurance Fund established under section 1310 of the National Flood

			 Insurance Act of 1968 (42 U.S.C. 4017) and for the National Flood Mitigation

			 Fund established under section 1367 of such Act (42 U.S.C. 4104d), for use only

			 for mitigation activities under the programs under sections 1323, 1361A, and

			 1366 of the National Flood Insurance Act of 1968 (42 U.S.C. 4030, 4102a,

			 4104c), as appropriate, for eligible structures.</text>

				</paragraph></subsection><subsection id="id587FFF6463B04B2A97C18E88E662FA54"><enum>(j)</enum><header>Public

			 notice</header><text>Not later than 30 days after the date of enactment of this

			 Act, the Director shall issue and widely disseminate in the covered disaster

			 area public notice of the procedures to be followed for application for flood

			 insurance authorized by this Act.</text>

			</subsection><subsection id="HC18E12AEDC75494A947C8021AD00B911"><enum>(k)</enum><header>Termination</header><text>The

			 Director may not enter into any contract or policy for coverage under this

			 section except pursuant to an application for such coverage submitted to the

			 Director before the expiration of the 90-day period beginning on the date that

			 the public notice described in subsection (j) is issued.</text>

			</subsection></section></legis-body>
