				<paragraph id="IDA79708DDF2814C828DC0AC691AFF5AA1"><enum>(1)</enum><header>Study</header><text>The

			 Secretary of Homeland Security and the head of the United States Army Corps of

			 Engineers shall carry out a joint study on methods to prevent aliens from

			 illegally entering the United States through subterranean tunnels along the

			 international border between the United States and Mexico and the cost,

			 utility, and effectiveness of employing such methods for border

			 security.</text>

				</paragraph><paragraph id="IDC86409FE66324528A41D58B2060220B3"><enum>(2)</enum><header>Report</header><text>Not

			 later than 180 days after the date of enactment of this Act, the Secretary of

			 Homeland Security and the head of the United States Army Corps of Engineers

			 shall submit to Congress the results of the study required by paragraph

			 (1).</text>

				</paragraph></subsection><subsection id="IDB27F83925A6F4AF1986660AB575FAC2F"><enum>(b)</enum><header>Barriers for

			 land crossings</header>

				<paragraph id="IDB2CBA35731184FF9BD95AEBF70B0BD59"><enum>(1)</enum><header>Study</header><text>The

			 Secretary of Homeland Security shall carry out a study of the feasibility and

			 effectiveness of completing primary and secondary fences along the

			 international border between the United States and Mexico and the cost and

			 utility of employing such fences for border security.</text>

				</paragraph><paragraph id="ID88A485511678408DAB983960A37A4BEB"><enum>(2)</enum><header>Report</header><text>Not

			 later than 180 days after the date of enactment of this Act, the Secretary of

			 Homeland Security shall submit to Congress the results of the study required by

			 paragraph (1).</text>

				</paragraph></subsection></section><section id="ID83F160169A4249AAB4F43BE1D573B8E4"><enum>3.</enum><header>Necessary assets

			 for controlling United States borders</header>

			<subsection id="IDB67F25D1CC2E4422B911F9F40814E67A"><enum>(a)</enum><header>Personnel</header>

				<paragraph id="ID9DC34051557442A6AD99000C7D473544"><enum>(1)</enum><header>Customs and

			 Border Protection officers</header><text>In each of the fiscal years 2006

			 through 2010, the Secretary of Homeland Security shall increase by not less

			 than 250 the number of positions for full-time active duty Customs and Border

			 Protection officers.</text>

				</paragraph><paragraph id="ID141E3FE3A4134B4EAE785A2A69C5862A"><enum>(2)</enum><header>Authorization

			 of appropriations</header>

					<subparagraph id="ID79F61FA8A56741588F638036D231BD76"><enum>(A)</enum><header>Customs and

			 Border Protection officers</header><text>There are authorized to be

			 appropriated such sums as may be necessary for each of fiscal years 2006

			 through 2010 to carry out paragraph (1).</text>

					</subparagraph><subparagraph id="ID7ABC888B2170472D8535B700CA57321C"><enum>(B)</enum><header>Border Patrol

			 agents</header><text>There are authorized to be appropriated such sums as may

			 be necessary for each of fiscal years 2006 through 2010 to carry out section

			 5202 of the Intelligence Reform and Terrorism Prevention Act of 2004 (118 Stat.

			 3734).</text>

					</subparagraph><subparagraph id="ID298756A435F144BDAE836E65992C324F"><enum>(C)</enum><header>Transportation

			 of aliens</header><text>There are authorized to be appropriated such sums as

			 may be necessary for each of fiscal years 2006 through 2010 for the

			 transportation of aliens.</text>

					</subparagraph></paragraph></subsection><subsection id="IDD144A443C93B47FCBFF8BF39FEA98A7D"><enum>(b)</enum><header>Technological

			 assets</header>

				<paragraph id="ID83AC45111A4343D3ADDDF23004ADEFF0"><enum>(1)</enum><header>Acquisition</header><text>The

			 Secretary of Homeland Security shall procure unmanned aerial vehicles, cameras,

			 poles, sensors, and other technologies necessary to achieve operational control

			 of the borders of the United States.</text>

				</paragraph><paragraph id="ID7849073635C14FFDAA63CF3679D43591"><enum>(2)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated such

			 sums as may be necessary for each of fiscal years 2006 through 2010 to carry

			 out paragraph (1).</text>

				</paragraph></subsection><subsection id="IDDC4ECCF5139147C3A5F44F20010D49E0"><enum>(c)</enum><header>Infrastructure</header>

				<paragraph id="IDED646582998846BDB8034040F9E472FE"><enum>(1)</enum><header>Construction of

			 border control facilities</header><text>The Secretary of Homeland Security

			 shall construct all-weather roads and shall acquire vehicle barriers and

			 necessary facilities to support its mission of achieving operational control of

			 the borders of the United States.</text>

				</paragraph><paragraph id="IDEDFAA8F9341B465090753636AAA024BC"><enum>(2)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated such

			 sums as may be necessary for each of fiscal years 2006 through 2010 to carry

			 out paragraph (1).</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8B1767FADA5E42E088A84FF59618DB31"><enum>(d)</enum><header>Border Patrol

			 checkpoints</header><text>Temporary or permanent checkpoints may be maintained

			 on roadways in border patrol sectors within 100 miles of the border between the

			 United States and Mexico.</text>

			</subsection></section><section id="IDD3B82A555F544FC9912E4F9765B41F4B"><enum>4.</enum><header>Document fraud

			 detection</header>

			<subsection id="IDA4BAED7C7D3E4C3A9469C227EE5A4774"><enum>(a)</enum><header>Training</header><text>The

			 Secretary of Homeland Security shall provide all customs and border protection

			 officers with training in identifying and detecting fraudulent travel

			 documents. Such training shall be developed in consultation with the Forensic

			 Document Laboratory of Immigration and Customs Enforcement.</text>

			</subsection><subsection id="ID4A412D8930EE46AF8F4FA0CEF01B5C89"><enum>(b)</enum><header>Forensic

			 document laboratory</header><text>The Secretary of Homeland Security shall

			 provide all customs and border protection officers with access to the Forensic

			 Document Laboratory.</text>

			</subsection><subsection id="id2DB09EF8C0984342BD45BFFFC9ABC8C4"><enum>(c)</enum><header>Report and

			 assessment</header>

				<paragraph id="idDC0AD173D2204234A6C9CD7ABAA2C3F5"><enum>(1)</enum><header>Report</header><text>Not

			 later than 1 year after the effective date of this Act, and annually through

			 2010, the Secretary of Homeland Security shall submit a report to the Office of

			 the Inspector General regarding the accuracy and reliability of the Forensic

			 Document Laboratory in identifying and detecting fraudulent documents.</text>

				</paragraph><paragraph id="idEC3179DAA9E44ADB9C99C6FFFC3282CF"><enum>(2)</enum><header>Assessment</header><text>The

			 Office of Inspector General shall conduct an independent assessment of the

			 accuracy and reliability of the Forensic Document Library and submit a report

			 to Congress on the results of such assessment.</text>

				</paragraph></subsection><subsection id="id45EA26C05D684C3588081F95B7EC19DD"><enum>(d)</enum><header>Right to

			 appellate review</header>

				<paragraph id="id5AD3319C474B4168BF3A4CC6E32510F4"><enum>(1)</enum><header>Establishment

			 of appellate review board</header><text>There is established, within

			 Immigration and Customs Enforcement Identity and Benefits Fraud Branch of the

			 Department of Homeland Security, the Fraud Appellate Review Board, which shall

			 be authorized to review determinations by the Forensic Document Laboratory that

			 a certain document is fraudulent.</text>

				</paragraph><paragraph id="id9755D2A3D2E94472B3FA78E20CA6F50B"><enum>(2)</enum><header>Right to

			 appeal</header><text>Any alien against whom a negative determination is made by

			 the Forensic Document Laboratory regarding the authenticity of a document may

			 appeal such determination to the Fraud Appellate Review Board for an

			 independent determination of the findings of the Forensic Document

			 Laboratory.</text>

				</paragraph></subsection><subsection id="IDD569C9A9A46546BFB1B55CE12E994190"><enum>(e)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated such

			 sums as may be necessary for each of fiscal years 2006 through 2010 to carry

			 out this section.</text>

			</subsection></section><section id="ID4B6CBE5E2CCA4F84AA82DD03C0ABA81D"><enum>5.</enum><header>Report</header><text display-inline="no-display-inline">Not later than October 26, 2007, the

			 Secretary of Homeland Security shall submit a report to Congress that

			 describes—</text>

			<paragraph id="idE5200B3804A247E4B305060AE8FC286D"><enum>(1)</enum><text display-inline="yes-display-inline">the documents that need to be

			 machine-readable and tamper-resistant and incorporate biometric

			 identifiers;</text>

			</paragraph><paragraph id="id8F1D4A06CC14449099B13F0D2D782864"><enum>(2)</enum><text>how documents

			 described in paragraph (1) will meet those standards;</text>

			</paragraph><paragraph id="idE8175A8FBE3B483291CB4A388EE2379B"><enum>(3)</enum><text>the locations at

			 which the Department of Homeland Security will install document readers;</text>

			</paragraph><paragraph id="id4EF10B04E3614018B6BBA82975453BCF"><enum>(4)</enum><text>the estimated

			 costs for creating such documents and installing such readers; and</text>

			</paragraph><paragraph id="id46018ED738DF46809AD435FBC7905BAA"><enum>(5)</enum><text>realistic

			 deadlines for issuing machine-readable, tamper-resistant documents that

			 incorporate biometric documents and installing document readers.</text>

			</paragraph></section><section id="ID9490F96453AE4005ABDE51BA436A60A6"><enum>6.</enum><header>Biometric

			 entry-exit system</header>

			<subsection id="ID72370EBFC1394580A4539045F3BD8B78"><enum>(a)</enum><header>Grounds of

			 inadmissibility</header><text>Section 212 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8 U.S.C. 1182)

			 is amended—</text>

				<paragraph id="ID62C73F5E7C584D4992982DB094FD6A94"><enum>(1)</enum><text>in subsection

			 (a)(7), by adding at the end the following:</text>

					<quoted-block id="ID0B7FF15F87E645AB8298C88C702407CF">

						<subparagraph id="ID8ECC15A3EAB04C59A5AB30EC22512889"><enum>(C)</enum><header>Withholders of

				biometric data</header><text>Any alien who knowingly fails to comply with a

				lawful request for biometric data under section 215(c) or 235(d) is

				inadmissible.</text>

						</subparagraph><after-quoted-block>;

				</paragraph><paragraph id="ID38EB8F48DC8F480AA2C7186524E8BBB9"><enum>(2)</enum><text>in subsection

			 (d), by inserting after paragraph (1) the following:</text>

						<paragraph id="ID03EC9C8F2EA14BA8B0DE1153F964DE8E" indent="up1"><enum>(2)</enum><text>The Secretary of Homeland Security

				shall determine whether a ground for inadmissibility exists with respect to an

				alien described in subparagraph (C) subsection (a)(7) and may waive the

				application of such subparagraph, for an individual alien or a class of aliens,

				at the discretion of the

				Secretary.</text>

				</paragraph></subsection><subsection id="ID45497E465A984A6EB90CABA10A3D02EB"><enum>(b)</enum><header>Collection of

			 biometric data from aliens departing the United States</header><text>Section

			 215 of the <act-name parsable-cite="INA">Immigration and Nationality

			 Act</act-name> (8 U.S.C. 1185) is amended—</text>

				<paragraph id="ID0C5B02733F2047DBAEADC70CC2BF779D"><enum>(1)</enum><text>by redesignating

			 subsection (c) as subsection (g); and</text>

				</paragraph><paragraph id="ID20F4A1385D3E4C919CF798ED16FF5E43"><enum>(2)</enum><text>by inserting

			 after subsection (b) the following:</text>

				Homeland Security is authorized to require aliens departing the United States

				to provide biometric data and other information relating to their immigration

				status.</text>

				</paragraph></subsection><subsection id="ID9D41D65605604B0596CDE4712D662E0D"><enum>(c)</enum><header>Inspection of

			 applicants for admission</header><text>Section 235(d) of the

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8

			 U.S.C. 1185(d)) is amended by adding at the end the following:</text>

			 biometric data from alien crewman</header><text>Section 252 of the

			 U.S.C. 1282) is amended by inserting <quote>Immigration officers are authorized

			 to collect biometric data from any alien crewman seeking permission to land

			 temporarily in the United States.</quote> after <quote>this

				provide employees of the Department of Homeland Security with comprehensive

				training of the procedures authorized under this

				subsection.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7058A3ECDCDC402D8C5EE13C60E43038"><enum>(b)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated $10,000,000 for each of fiscal years 2006 through

			 2010 to carry out the amendments made by this section.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id5AC6B272BCD04A769B84814C7EAF5093" section-type="subsequent-section"><enum>8.</enum><header>Cancellation of

			 visas</header><text display-inline="no-display-inline">Section 222(g) of the

			 Immigration and Nationality Act (8 U.S.C. 1202(g)) is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id0AFEE55237E24AE8800CF56FB7A6247C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>and

			 any other nonimmigrant visa issued by the United States that is in the

			 possession of the alien except upon a showing of extraordinary circumstances or

			 in the case of technical violations</quote> after <quote>such visa</quote>;

			 and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD82EBF3F25914587BF292838C53ABF8E"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking

			 <quote>(other than the visa described in paragraph (1)) issued in a consular

			 office located in the country of the alien’s nationality</quote> and inserting

			 <quote>(other than a visa described in paragraph (1)) issued in a consular

			 office located in the country of the alien's nationality or foreign

			 residence</quote>.</text>

			</paragraph></section><section id="IDD8003414DEA34979A30D48E125D6D76A"><enum>9.</enum><header>Release of

			 aliens from noncontiguous countries</header>

			<subsection id="ID934FB080A2A74B1D9C57EA46C52A74E5"><enum>(a)</enum><header>Minimum

			 bond</header><text>Section 236(a)(2) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8 U.S.C.

			 1226(a)(2)) is amended—</text>

				prescribed by, the Secretary of Homeland Security or the Attorney General, and

				subject to review before the Executive Office of Immigration Review;

				or</text>

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection id="IDE834BAA99EB748C9902614A158043B25"><enum>(b)</enum><header>Report</header><text>Not

			 later than 2 years after the effective date of this Act, the Secretary of

			 Homeland Security shall submit a report to Congress on the number of aliens

			 from noncontiguous countries who are apprehended between land border ports of

			 entry.</text>

			</subsection></section><section id="IDD00D956C799748D3AF3534C171BB7A1D"><enum>10.</enum><header>Reducing

			 illegal immigration and alien smuggling on tribal lands</header>

			<subsection id="ID236FE1839947474B9AF3778F5409F808"><enum>(a)</enum><header>Grants

			 authorized</header><text>The Secretary of Homeland Security may award grants to

			 Indian tribes with lands adjacent to an international border of the United

			 States that have been adversely affected by illegal immigration.</text>

			</subsection><subsection id="ID9F466E97B2964E8990A46C45E24EEB2D"><enum>(b)</enum><header>Use of

			 funds</header><text>Grants awarded under subsection (a) may be used for—</text>

				<paragraph id="ID441F1760A20541558F2561412E1A1ECF"><enum>(1)</enum><text>law enforcement

			 activities;</text>

				</paragraph><paragraph id="IDD8441070824D4347A4CA3B911657C436"><enum>(2)</enum><text>health care

			 services;</text>

				</paragraph><paragraph id="ID5F724092B6B94E479E22A217911E2B62"><enum>(3)</enum><text>environmental

			 restoration; and</text>

				</paragraph><paragraph id="ID1066608BA9F7497BBBB54D859525E5D7"><enum>(4)</enum><text>the preservation

			 of cultural resources.</text>

				</paragraph></subsection><subsection id="ID9702A97B38164580881D69A154CF9CCD"><enum>(c)</enum><header>Report</header><text>Not

			 later than 180 days after the date of enactment of this Act, the Secretary of

			 Homeland Security shall submit a report to the Committee on the Judiciary of

			 the Senate and the Committee on the Judiciary of the House of Representatives

			 that—</text>

				<paragraph id="IDBBDBCAE5E5554F5AB953E9E3F0371B43"><enum>(1)</enum><text>describes the

			 level of access of Border Patrol agents on tribal lands;</text>

				</paragraph><paragraph id="ID9FD36DA5E04F40FFA7030671845B52DB"><enum>(2)</enum><text>describes the

			 extent to which enforcement of immigration laws may be improved by enhanced

			 access to tribal lands;</text>

				</paragraph><paragraph id="ID383AB36A1B484D86A62CEB113CB7C141"><enum>(3)</enum><text>contains a

			 strategy for improving such access through cooperation with tribal authorities;

			 and</text>

				</paragraph><paragraph id="ID9530ACFD7F8449C8AF511162D7864A43"><enum>(4)</enum><text>identifies grants

			 provided by the Department of Homeland Security for Indian tribes, either

			 directly or through State or local grants, relating to border security

			 expenses.</text>

				</paragraph></subsection><subsection id="ID68FDEA59EBE045E688B42161103C1E00"><enum>(d)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated

			 $10,000,000 for each of fiscal years 2006 through 2010 to carry out this

			 section.</text>

			</subsection></section><section id="ID6C026AB2B3784EAF8BD5CB03DB640783"><enum>11.</enum><header>Detention space

			 and removal capacity</header>

			<subsection id="id852CC66A5BD84C568D64E3DF3CFA14E7"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 5204 of the

			 Intelligence Reform and Terrorism Protection Act of 2004 (118 Stat. 3734) is

			 amended—</text>

			 (a), by striking <quote>8,000</quote> and inserting <quote>10,000</quote>;

			 representation</header><text>No person shall be detained by the Department of

			 Homeland Security in a location that limits the person's reasonable access to

			 legal counsel. Upon active or constructive notice that a person is represented

			 by an attorney, that person shall not be moved without providing the attorney

			 reasonable notice in advance of such move.</text>

			</subsection></section><section id="IDD21486FF5A2D4AABA5BF37F47868482F"><enum>12.</enum><header>Increased

			 criminal penalties for alien smuggling, document fraud, gang violence, and drug

			 trafficking</header>

			<subsection id="ID805B1436088F410EBD3E94FF22EDB24B"><enum>(a)</enum><header>Alien

			 smuggling</header><text>Section 274(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8 U.S.C.

			 1324(a)) is amended—</text>

								<subsection id="IDDE39A32BF7F34ECB9F68316901830BDB"><enum>(a)</enum><text>Any alien

				unlawfully present in the United States, who commits, or conspires or attempts

				to commit, a crime of violence or a drug trafficking offense (as defined in

				section 924), shall be fined under this title and sentenced to not less than 5

				years in prison.</text>

								</subsection><subsection id="ID98EBCF0B293747CEBD72214FFF36A90E"><enum>(b)</enum><text>If an alien who

				violates subsection (a) was previously ordered removed under the

				<act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8

				U.S.C. 1101 et seq.) on the grounds of having committed a crime, the alien

				shall be sentenced to not less than 15 years in prison.</text>

								</subsection><subsection id="ID68126C58B3B643B1BBC3A9455047E2F1"><enum>(c)</enum><text>A sentence of

				imprisonment imposed under this section shall run consecutively to any other

				sentence of imprisonment imposed for any other

				crime.</text>

								</subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph id="ID3FB9A1AC5B18471ABDEEA348F959A23B"><enum>(2)</enum><header>Deportability</header><text>Section

			 237(a)(2) of the <act-name parsable-cite="INA">Immigration and Nationality

			 Act</act-name> (8 U.S.C. 1227(a)(2)) is amended by adding at the end the

			 following:</text>

						<subparagraph id="ID695FFCA0CD33403EAF77DE3F80F915D1"><enum>(F)</enum><header>Aliens who are

				members of criminal street gangs</header>

							<clause id="idBE47B98988CA4BCEADDD0374D15A2C9C"><enum>(i)</enum><header>In

				general</header><text>Any alien who is found by a Federal district court to be

				a member of a criminal street gang (as defined in section 521(a) of title 18,

				United States Code) is deportable.</text>

							</clause><clause id="idF01A2F1EA464475C897B5A2B412A98B8"><enum>(ii)</enum><header>Exception</header><text>Clause

				(i) shall not apply to an alien who demonstrates that he or she is no longer a

				member of the criminal street

				gang.</text>

							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph id="ID1292658155364F11B7004B93AADE079A"><enum>(3)</enum><header>Temporary

			 protected status</header><text>Section 244(c)(2)(B) of the

			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8

			 U.S.C. 1254a(c)(2)(B)) is amended—</text>

					<subparagraph id="ID31594463559C40BC9D9C8EC82FD96092"><enum>(A)</enum><text>in clause (i), by

			 striking <quote>or</quote> at the end;</text>

					</subparagraph><subparagraph id="IDD5D05C5B97C34BEFA733A5A6F6500D3E"><enum>(B)</enum><text>in clause (ii),

			 by striking the period at the end and inserting <quote>; or</quote>; and</text>

					</subparagraph><subparagraph id="ID8BACE85AD844492CB74D4DEB1E0C53DC"><enum>(C)</enum><text>by adding at the

			 end the following:</text>

						<quoted-block id="IDF6B4A2ADFBAD445A9CAD2581E8B98393">

							<clause id="ID7310778470294CD491C77CABF5577069"><enum>(iii)</enum><text>the alien has

				been found by a Federal district court to be a member of a criminal street gang

				(as defined in section 521(a) of title 18, United States Code) and cannot

				demonstrate that he or she is no longer a member of the criminal street

				gang.</text>

							</clause><after-quoted-block>.</after-quoted-block></quoted-block>

					</subparagraph></paragraph></subsection></section><section id="ID92A083FA0EF74564985735F3614A04CD"><enum>13.</enum><header>Removal of

			 aliens</header>

			<subsection id="ID87B6BC832A0B4E4AA184BAE9BC22DFDC"><enum>(a)</enum><header>Continuation of

			 institutional removal program</header><text>The Secretary of Homeland Security

			 shall continue to operate the Institutional Removal Program or develop and

			 implement any other program to—</text>

				<paragraph id="ID7E53DB394A994FD4A4055B8056FC6A1F"><enum>(1)</enum><text>identify

			 removable criminal aliens in Federal and State correctional facilities;</text>

				</paragraph><paragraph id="ID032E8227196340FE8C13FFC6FFFFB040"><enum>(2)</enum><text>ensure that such

			 aliens are not released into the community; and</text>

				</paragraph><paragraph id="ID89FA55116D5D4A569CB625CA89A2D075"><enum>(3)</enum><text>remove such

			 aliens from the United States after the completion of their sentences.</text>

				</paragraph></subsection><subsection id="IDDF76C4D6CE92409086C0B0165D63A205"><enum>(b)</enum><header>Authorization

			 for detention after completion of State or local prison

			 sentence</header><text>Law enforcement officers of a State or political

			 subdivision of a State are authorized to—</text>

				<paragraph id="IDA697AA7ABCCB4567B62A6DFF38B1315B"><enum>(1)</enum><text>hold an illegal

			 alien for a period of up to 14 days after the alien has completed the alien’s

			 State prison sentence in order to effectuate the transfer of the alien to

			 Federal custody when the alien is removable or not lawfully present in the

			 United States; or</text>

				</paragraph><paragraph id="ID55982731B42F4983A96B1A5BC4541040"><enum>(2)</enum><text>issue a detainer

			 that would allow aliens who have served a State prison sentence to be detained

			 by the State prison until personnel from the Bureau of Immigration and Customs

			 Enforcement can take the alien into custody.</text>

				</paragraph></subsection><subsection id="ID480D6252E7A248F0A6FED9A64C178005"><enum>(c)</enum><header>Report to

			 Congress</header>

				<paragraph id="idA36357DD5B824C85B32C272BDFEB297B"><enum>(1)</enum><header>In

			 general</header><text>The Secretary of Homeland Security shall submit a report

			 to Congress on the participation of States in the Institutional Removal Program

			 and in any other program under subsection (a).</text>

				</paragraph><paragraph id="ID62DE0AD5F0D6498EBEFCF6579849F091"><enum>(2)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated such

			 sums as may be necessary to carry out paragraph (1).</text>

				</paragraph></subsection></section><section id="ID3C9F0A27A5004A96ADE9A2EF799FB50C"><enum>14.</enum><header>Additional

			 immigration personnel</header>

			<subsection id="IDFAB971D1982E479181A7377E2617B213"><enum>(a)</enum><header>Department of

			 Homeland Security</header>

				<paragraph id="IDE4AC7CBF263F4C0883B5180BE59D1299"><enum>(1)</enum><header>Investigative

			 personnel</header><text>In addition to the positions authorized under section

			 5203 of the Intelligence Reform and Terrorism Prevention Act of 2004, for each

			 of fiscal years 2006 through 2010, the Secretary of Homeland Security shall,

			 subject to the availability of appropriations for such purpose, increase by not

			 less than 200 the number of positions for investigative personnel within the

			 Department of Homeland Security investigating alien smuggling and immigration

			 status violations above the number of such positions for which funds were made

			 available during the preceding fiscal year.</text>

				</paragraph><paragraph id="IDFEEC374B3BAD49EE98AD5C99FC30E30E"><enum>(2)</enum><header>Trial

			 attorneys</header><text>In each of fiscal years 2006 through 2010, the

			 Secretary of Homeland Security shall, subject to the availability of

			 appropriations for such purpose, increase the number of positions for attorneys

			 in the Office of General Counsel of the Department of Homeland Security who

			 represent the Department in immigration matters by not less than 100 above the

			 number of such positions for which funds were made available during each

			 preceding fiscal year.</text>

				</paragraph><paragraph id="id46BD35796AEA400EB802E704EAA4B05C"><enum>(3)</enum><header>Defense

			 attorneys</header><text>In each of fiscal years 2006 through 2010, the Attorney

			 General shall, subject to the availability of appropriations for such purpose,

			 increase by not less than 100 the number of attorneys in the Federal Defenders

			 Program or any other federally funded program for each Federal judicial

			 district.</text>

				</paragraph><paragraph id="IDECC31E5C7715409FA0B76AA981986D6B"><enum>(4)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated to the

			 Department of Homeland Security for each of fiscal years 2006 through 2010 such

			 sums as may be necessary to carry out this subsection.</text>

				</paragraph></subsection><subsection id="IDAEA27129DD394FCAB6A9136762206B8C"><enum>(b)</enum><header>Department of

			 Justice</header>

				<paragraph id="ID5478C0358AF4440DA9C2C0ED38125BA9"><enum>(1)</enum><header>Assistant

			 Attorney General for Immigration Enforcement</header>

					<subparagraph id="ID9C2A2717F1C7458999191CD37212C080"><enum>(A)</enum><header>Establishment</header><text>There

			 is established within the Department of Justice the position of Assistant

			 Attorney General for Immigration Enforcement, which shall coordinate and

			 prioritize immigration litigation and enforcement in the Federal courts,

			 including—</text>

						<clause id="ID323091720B624DDDB4AAD71DB2B8768F"><enum>(i)</enum><text>removal and

			 deportation;</text>

						</clause><clause id="ID5EF2BB86F07A4D5880A83E8E760825D8"><enum>(ii)</enum><text>employer

			 sanctions; and</text>

						</clause><clause id="IDF8663593190648C19AF41443F0ACF6CD"><enum>(iii)</enum><text>alien smuggling

			 and human trafficking.</text>

						</clause></subparagraph><subparagraph id="IDC82FB45A1E394B219DDABB13BB202888"><enum>(B)</enum><header>Conforming

			 amendment</header><text>Section 506 of title 28, United States Code, is amended

			 by striking <quote>ten</quote> and inserting <quote>11</quote>.</text>

					</subparagraph></paragraph><paragraph id="IDFF44587D014940F09CB94E08A4AA4A94"><enum>(2)</enum><header>Litigation

			 attorneys</header><text>In each of fiscal years 2006 through 2010, the Attorney

			 General shall, subject to the availability of appropriations for such purpose,

			 increase by not less than 50 the number of positions for attorneys in the

			 Office of Immigration Litigation of the Department of Justice.</text>

				</paragraph><paragraph id="ID19A40229BA07466E82BADA6FF0A5DF27"><enum>(3)</enum><header>United States

			 attorneys</header><text>In each of fiscal years 2006 through 2010, the Attorney

			 General shall, subject to the availability of appropriations for such purpose,

			 increase by not less than 50 the number of attorneys in the United States

			 Attorneys’ office to litigate immigration cases in the Federal courts.</text>

				</paragraph><paragraph id="ID5757ABF8438E40F4A11E63E3F231F0B8"><enum>(4)</enum><header>Immigration

			 judges</header><text>In each of fiscal years 2006 through 2010, the Attorney

			 General shall, subject to the availability of appropriations for such purpose,

			 increase by not less than 50 the number of immigration judges.</text>

				</paragraph><paragraph id="ID399EB2A7762C49C793C363D9894269F8"><enum>(5)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated to the

			 Department of Justice for each of fiscal years 2006 through 2010 such sums as

			 may be necessary to carry out this subsection, including the hiring of

			 necessary support staff.</text>

				</paragraph></subsection></section><section id="IDE70A266D05DD478CA9D76979C6583D8A"><enum>15.</enum><header>Automated alien

			 records</header>

			<subsection id="IDC69DBCE933784D2383F80A1BA41C17AE"><enum>(a)</enum><header>In

			 general</header><text>Not later than 5 years after the date of enactment of

			 this Act, the Secretary of Homeland Security shall automate the storage of

			 alien records in an electronic format that is interoperable with the alien

			 record keeping systems of the Department of Justice and accessible by other

			 Federal agencies for the purposes of administering the immigration laws of the

			 United States.</text>

			</subsection><subsection id="ID7F9747DA7EDB4B33A89F24946049498E"><enum>(b)</enum><header>Existing

			 records</header><text>The Secretary of Homeland Security shall automate all

			 alien records that were created during the 5-year period ending on the date of

			 enactment of this Act.</text>

			</subsection><subsection id="IDBBBE0A5BD8DB4177BC85E16B9505502C"><enum>(c)</enum><header>Oversight</header><text>The

			 Chief Information Officer of the Department of Homeland Security shall be

			 responsible for oversight and management of automating the storage of alien

			 records in an electronic format.</text>

			</subsection><subsection id="ID96E05652DA1E4EEB96F0D52D6E4AAC8E"><enum>(d)</enum><header>Official

			 record</header><text>The automated alien record created under this section

			 shall constitute the official record for purposes of the National Archives and

			 Records Administration.</text>

			</subsection><subsection id="IDCB72D6393BD94FD1B70B776FBBF564E9"><enum>(e)</enum><header>Reports</header><text>The

			 Secretary of Homeland Security shall report to the appropriate committees in

			 Congress in 2008 and 2010 on the progress made in automating alien records

			 under this section.</text>

			</subsection><subsection id="ID41DFA9C2AF374A8C9ADB4425817E18E6"><enum>(f)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated such

			 sums as may be necessary for each of the fiscal years 2006 through 2010 to

			 carry out this section.</text>

			</subsection></section><section id="IDB665C49E67C74B20A15F7A9FBA3103F2"><enum>16.</enum><header>Increase of

			 Federal detention space</header>

			<subsection id="IDE57EAF323AC945D88A6CA40A36EDBA48"><enum>(a)</enum><header>Construction or

			 acquisition of detention facilities</header>

				<paragraph id="IDC58E900B49644935A09472040DA608EB"><enum>(1)</enum><header>In

			 general</header><text>The Secretary of Homeland Security shall construct or

			 acquire additional detention facilities in the United States.</text>

				</paragraph><paragraph id="ID1EC0896026C948D68E20BC288961961B"><enum>(2)</enum><header>Determination

			 of location</header><text>The location of any detention facility built or

			 acquired in accordance with this subsection shall be determined by the Deputy

			 Assistant Director of the Office of Detention and Removal Operations within the

			 Bureau of Immigration and Customs Enforcement.</text>

				</paragraph></subsection><subsection id="IDE5197A75E6FE4D6DB22ED458893469E3"><enum>(b)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated such

			 sums as necessary to carry out this section.</text>

			</subsection></section><section id="IDF6E81AAF0F80434F88723095D2FC51D8"><enum>17.</enum><header>State Criminal

			 Alien Assistance Program</header>

			<subsection id="ID9B3B94B31CB244E393149E756723F26F"><enum>(a)</enum><header>Transfer of

			 program</header>

				<paragraph id="ID00720D85C5D349AD8B4BA6C1EEE0F48B"><enum>(1)</enum><header>In

			 general</header><text>Section 501 of the Immigration Reform and Control Act of

			 1986 (8 U.S.C. 1365) is amended by striking <quote>Attorney General</quote>

			 each place it appears and inserting <quote>Secretary of Homeland

			 Security</quote>.</text>

				</paragraph><paragraph id="ID6E084DBBBA5D4044B5ECB8A8A0ECCAA3"><enum>(2)</enum><header>Contracts</header><text>Section

			 241(i) of the <act-name parsable-cite="INA">Immigration and Nationality

			 Act</act-name> (8 U.S.C. 1231(i)) is amended by striking <quote>Attorney

			 General</quote> each place it appears and inserting <quote>Secretary of

			 Homeland Security</quote>.</text>

				</paragraph></subsection><subsection id="ID99EF65855F9444BCAE9D4D4858B7CE4D"><enum>(b)</enum><header>Reimbursement

			 for costs associated with processing criminal illegal aliens</header><text>The

			 Secretary of Homeland Security shall reimburse States and units of local

			 government for costs associated with processing illegal aliens through the

			 criminal justice system, including—</text>

				<paragraph id="ID0901B9B37722409387BAB94992454C86"><enum>(1)</enum><text>indigent

			 defense;</text>

				</paragraph><paragraph id="ID5BEE65F3360442309C3C2F352DFEB7AC"><enum>(2)</enum><text>criminal

			 prosecution;</text>

				</paragraph><paragraph id="ID40D88FD4F1D44CE3A99798CBD18E8E4E"><enum>(3)</enum><text>autopsies;</text>

				</paragraph><paragraph id="ID4C837D837F7A432794AC98F15A1F74DA"><enum>(4)</enum><text>translators and

			 interpreters; and</text>

				</paragraph><paragraph id="IDC3618996396B465384EE30FEBA822E3B"><enum>(5)</enum><text>court

			 costs.</text>

				</paragraph></subsection><subsection id="ID20027D8157D24DC1937C2B01F6002EA8"><enum>(c)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">Section

			 241(i)(5) of the <act-name parsable-cite="INA">Immigration and Nationality

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1231(i)(5)">8 U.S.C. 1231(i)(5)</external-xref>) is

			 amended by striking <quote>appropriated</quote> and all that follows through

			 the period and inserting the

			 following:</text>

				2011.</text>

					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section id="IDCD160F9E09154929A80F1DAF339E4694"><enum>18.</enum><header>Construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to

			 require law enforcement personnel of a State or political subdivision of a

			 State to—</text>

			<paragraph id="ID9A088CC8D77743C4964D1A24F14276C2"><enum>(1)</enum><text>report the

			 identity of a victim of, or a witness to, a criminal offense to the Secretary

			 of Homeland Security for immigration enforcement purposes;</text>

			</paragraph><paragraph id="IDF09329B491BD48DB95D3A60F7B562468"><enum>(2)</enum><text>arrest such

			 victim or witness for a violation of the immigration laws of the United States;

			 or</text>

			</paragraph><paragraph id="IDE8CCE01BEFA9489AA9F535F31E952D08"><enum>(3)</enum><text>enforce the

			 immigration laws of the United States.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID7DB1C362777A4426803E6607D4A268B8" section-type="subsequent-section"><enum>19.</enum><header>State

			 defined</header><text display-inline="no-display-inline">In this Act, the term

			 <quote>State</quote> has the meaning given that term in section 101(a)(36) of

			 the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8

			 U.S.C. 1101 (a)(36)).</text>
