 To amend part E of title IV of the Social Security Act to provide for 
 the making of foster care maintenance payments to private for-profit 
                               agencies.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Fair Access Foster Care Act of 
2005''.

SEC. 2. FOSTER CARE MAINTENANCE PAYMENTS TO PRIVATE FOR-PROFIT 
              AGENCIES.

    Section 472(b) of the Social Security Act (42 U.S.C. 672(b)) is 
amended by striking ``nonprofit'' each place it appears.
