		<official-title>To prohibit predatory payday loans, and for other

		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Predatory Payday Loan Prohibition

			 Act of 2005</short-title></quote>.</text>

		</section><section id="IDee0c7f8e4a1549b1ab0ffb59ec7576a5"><enum>2.</enum><header>Prohibition on

			 creditors making payday loans</header><text display-inline="no-display-inline">The Truth in Lending Act (15 U.S.C. 1601 et

			 seq.) is amended by inserting after section 109 the following:</text>

			<quoted-block display-inline="no-display-inline" id="id5AA6414FCB4D473E89E41BC28CDB0804" style="OLC">

				<section id="IDe33ff750691a4b25ad4d487fba29d632"><enum>110.</enum><header>Prohibition on

				payday loans</header>

					<subsection id="ID756d98e8b4d346749b193dcd3b3722d6"><enum>(a)</enum><header>In

				general</header><text>A creditor may not make a payday loan to any person, if

				the creditor knows or has reasonable cause to believe that—</text>

						<paragraph id="ID7ba2e432f6fa4d3ebd2169bac449f01e"><enum>(1)</enum><text>the personal

				check or share draft that the creditor receives from the person in exchange for

				the loan is drawn on an insured depository institution or an insured credit

				union; or</text>

						</paragraph><paragraph id="ID18f59a9e7bd940f5bd2505d020b818c1"><enum>(2)</enum><text>the account that

				will be debited in exchange for the loan is a transaction account or share

				draft account at an insured depository institution or an insured credit

				union.</text>

						</paragraph></subsection><subsection id="IDdaeb085ff97345b19f9f378b27ad435f"><enum>(b)</enum><header>Definitions</header><text>In

				this section, the following definitions shall apply:</text>

						<paragraph id="IDc33c44fe094e447caf3f9b3a3193170a"><enum>(1)</enum><header>Insured

				institutions</header><text>The terms <term>insured depository

				institution</term> and <term>insured credit union</term> have the meanings

				given those terms in section 3 of the Federal Deposit Insurance Act and section

				101 of the Federal Credit Union Act, respectively.</text>

						</paragraph><paragraph id="IDdfe53437489342389ac05b1afd05b964"><enum>(2)</enum><header>Payday

				loan</header><text>The term <term>payday loan</term> means any transaction in

				which a short-term cash advance is made to a consumer in exchange for—</text>

							<subparagraph id="IDcdee53be72db4c0295dfb03b39762e35"><enum>(A)</enum><text>the personal

				check or share draft of the consumer, in the amount of the advance plus a fee,

				where presentment or negotiation of such check or share draft is deferred by

				agreement of the parties until a designated future date; or</text>

							</subparagraph><subparagraph id="idEA144A8C75404FFAACF3C0282E591B68"><enum>(B)</enum><text>the authorization

				of a consumer to debit the transaction account or share draft account of the

				consumer, in the amount of the advance plus a fee, where such account will be

				debited on or after a designated future

				date.</text>

							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="ID715c0c3680874215a752c9caf2a39aee"><enum>3.</enum><header>Prohibition on

			 insured depository institutions making payday loans</header><text display-inline="no-display-inline">Section 18 of the Federal Deposit Insurance

			 Act (12 U.S.C. 1828) is amended by adding at the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="id85EF3E7146114F9583405682A3E8CD73" style="OLC">

				<subsection id="id7D954BD5D9EE4B0B8610446C463FD550"><enum>(x)</enum><header>Prohibition on

				certain unsafe and unsound banking practices</header>

					<paragraph id="ID45c3d31d509d44169a8da841865ce7ae"><enum>(1)</enum><header>In

				general</header><text>An insured depository institution may not—</text>

						<subparagraph id="ID0b8c76db4f1e4f38bbb69e34032bfcde"><enum>(A)</enum><text>make any payday

				loan, either directly or indirectly; or</text>

						</subparagraph><subparagraph id="IDdf89f258e86d4bd8bddb5b87c7fd6df4"><enum>(B)</enum><text>make any loan to

				any other lender for purposes of financing a payday loan or refinancing or

				extending any payday loan.</text>

						</subparagraph></paragraph><paragraph id="ID09f200cb9e4647928754569719d1b1a7"><enum>(2)</enum><header>Payday loan

				defined</header><text>For purposes of this subsection, the term <term>payday

				loan</term> means any transaction in which a short-term cash advance is made to

				a consumer in exchange for—</text>

						<subparagraph id="ID0ecd21828a0e46b99e09c9cadbbcc39b"><enum>(A)</enum><text>the personal

				check or share draft of the consumer, in the amount of the advance plus a fee,

				where presentment or negotiation of such check or share draft is deferred by

				agreement of the parties until a designated future date; or</text>

						</subparagraph><subparagraph id="id0489C44C2CF440BF914B2D3571D273AC"><enum>(B)</enum><text>the authorization

				of the consumer to debit the transaction account or share draft account of the

				consumer, in the amount of the advance plus a fee, where such account will be

				debited on or after a designated future

				date.</text>

						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
