		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cleanup of Inactive and Abandoned
			 Mines Act</short-title></quote>.</text>
		</section><section id="idA0B72D22009B43B684D8376E2C5235B3"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection id="idA19DA03FF4FB4248A3609B09CDB21D14"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="idB82B16E741EC42B99A18F8B1629CC8A1"><enum>(1)</enum><text>the Federal
			 Government and State governments encouraged hard rock mining in the United
			 States through a wide variety of laws, policies, and actions;</text>
				</paragraph><paragraph id="id0EF103FB86F6434EAA2EDF59DE5AC5D8"><enum>(2)</enum><text>the mining
			 activities that took place disturbed public and private land, and those
			 disturbances led to considerable environmental pollution;</text>
				</paragraph><paragraph id="IDaa74297a33bc42c3be03789cac4a8619"><enum>(3)</enum><text>many areas in
			 which hard rock mining took place in the United States are now inactive and
			 abandoned mine sites;</text>
				</paragraph><paragraph id="IDb70bead4955c4a06869e4484da48da73"><enum>(4)</enum><text>many inactive and
			 abandoned mine sites pollute the environment today and will continue to do so
			 indefinitely unless remediated;</text>
				</paragraph><paragraph id="id145D2A33506F4B44902EC2274CBFE566"><enum>(5)</enum><text>adits and other
			 tunnels will continue to drain pollutants to surface and ground water through
			 gravity flow;</text>
				</paragraph><paragraph id="id3809BF2E832F4A3FB95D3821004E3BD7"><enum>(6)</enum><text>surface runoff
			 will continue to pick up pollutants as the runoff moves over disturbed ground
			 and transports pollutants to surface waters;</text>
				</paragraph><paragraph id="id2A7F0D1D8ACB41CAA7DBF9ED7C36907B"><enum>(7)</enum><text>tailings and other
			 materials left exposed to the elements will continue to blow in the wind and
			 pollute the atmosphere and soils;</text>
				</paragraph><paragraph id="ID1399fb9ff71e43848462fb7e1ec57490"><enum>(8)</enum><text>many of the
			 individuals and corporate owners and operators of those mines, who caused this
			 pollution, are no longer alive or in existence;</text>
				</paragraph><paragraph id="idDDEF71545F1D4D2397A0D1C5DD889FB9"><enum>(9)</enum><text>some of the
			 remaining owners and operators who remain do not have resources that are
			 adequate to conduct remediation properly under applicable environmental laws,
			 for all practical purposes leaving no one responsible for the cleanup of
			 pollution from those sites;</text>
				</paragraph><paragraph id="ID9be694ee8e494154ac049e4d7370fbaf"><enum>(10)</enum><text>inactive and
			 abandoned mine sites are located in areas of known economic
			 mineralization;</text>
				</paragraph><paragraph id="id09DC95BB1713416D8CE116EFD5EE7E6D"><enum>(11)</enum><text>modern mining
			 activities often take place on or in the vicinity of the area in which historic
			 hard rock mining activities took place;</text>
				</paragraph><paragraph id="ID4a01f86b17b94b6e8c67556c3a9d53ea"><enum>(12)</enum><text>from time to
			 time, individuals and companies are willing to remediate historic mine sites
			 for the public good as Good Samaritans, despite the fact that these individuals
			 and companies are not legally required to remediate the mine sites;</text>
				</paragraph><paragraph id="idE14C86ADE9CD42E6989E224821B88D23"><enum>(13)</enum><text>Good Samaritan
			 remediation activities may—</text>
					<subparagraph id="id300C0BA0955140EE8136B88497A14483"><enum>(A)</enum><text>vary in size and
			 complexity;</text>
					</subparagraph><subparagraph id="idD0F181B3554047EA8670E4D0B5F971C6"><enum>(B)</enum><text>reflect the myriad
			 ways that mine residue may be cleaned up; and</text>
					</subparagraph><subparagraph id="idB247485F8FD848389929CA5DDD251192"><enum>(C)</enum><text>include, among
			 other activities—</text>
						<clause id="idABDBB63D3F394F39AF1B8FA2498906B9"><enum>(i)</enum><text>the relocation or
			 management of tailings or other waste piles;</text>
						</clause><clause id="idC10E1A43F45A4A7DA06C872D4E6BA3A6"><enum>(ii)</enum><text>passive or active
			 water treatment;</text>
						</clause><clause id="id01F9487DC25E46B6AF1BD3DE0C4B76D8"><enum>(iii)</enum><text>runoff or run-on
			 controls; and</text>
						</clause><clause id="id3E7586BC5B4E4FB2A13277615A39D0A0"><enum>(iv)</enum><text>the use or
			 reprocessing of, or removal of materials from, mine residue;</text>
						</clause></subparagraph></paragraph><paragraph id="id845B2BD1CA0A4039948EBEB27ABEBBF8"><enum>(14)</enum><text>the potential
			 environmental liabilities that may attach to those Good Samaritans as a result
			 of the remediation can dissuade those Good Samaritans from acting for the
			 public good;</text>
				</paragraph><paragraph id="IDb579dde1c4fb488abb8e93f99671d59a"><enum>(15)</enum><text>it is in the
			 interest of the United States, the States, and local communities to remediate
			 historic mine sites, in appropriate circumstances and to the maximum extent
			 practicable, so that the environmental impacts of the sites are lessened into
			 the future; and</text>
				</paragraph><paragraph id="ID557b9d461a254c0d88c4601101e2bd1c"><enum>(16)</enum><text>if appropriate
			 protections are provided for Good Samaritans, Good Samaritans will have a
			 greater incentive to remediate those sites for the public good.</text>
				</paragraph></subsection><subsection id="id67BBC1756C9D430192E63EADC71681F5"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="ID6f6eef8dea4b4c3a91d917d00f15a045"><enum>(1)</enum><text>to encourage
			 partial or complete remediation of inactive and abandoned mining sites for the
			 public good by persons who are not otherwise legally responsible for the
			 remediation;</text>
				</paragraph><paragraph id="ID43676484d5e343608256b3ad7d1916a1"><enum>(2)</enum><text>to provide
			 appropriate protections for Good Samaritans under applicable environmental
			 laws;</text>
				</paragraph><paragraph id="ID7ed11d360fa743a3af52428fc81ec348"><enum>(3)</enum><text>to ensure that
			 remediation performed by Good Samaritans creates actual and significant
			 environmental benefits;</text>
				</paragraph><paragraph id="IDfc8dcfd50ab84ddd8e0d6ef3b86a8eed"><enum>(4)</enum><text>to ensure that
			 remediation by Good Samaritans is carried out—</text>
					<subparagraph id="id2B46A29968B94757A720A8665343D6F2"><enum>(A)</enum><text>with the approval
			 and agreement, and in the discretion, of affected Federal, State, and local
			 authorities and with review by the public; and</text>
					</subparagraph><subparagraph id="id0703D465CAA34AA891C012C0DB437B05"><enum>(B)</enum><text>in a manner that
			 is beneficial to the environment and all affected communities;</text>
					</subparagraph></paragraph><paragraph id="IDe6aa60a85d64482785677c13bbb44646"><enum>(5)</enum><text>to create an
			 efficient permit process under which the cost and complexity of obtaining a
			 permit are commensurate with the scope of remediation work to be completed and
			 the environmental benefits from the work;</text>
				</paragraph><paragraph id="id7552D653FC1B4C5CBCFA1192CF81650B"><enum>(6)</enum><text>to avoid
			 permitting for ongoing, for-profit businesses that specialize in multiple Good
			 Samaritan projects that are designed to be permitted outside otherwise
			 applicable Federal, State, and local environmental laws; and</text>
				</paragraph><paragraph id="ID3c0467bc8612490aa8fb30244ab5d73f"><enum>(7)</enum><text>to ensure that the
			 protections for Good Samaritans provided in this Act are interpreted in
			 accordance with the purposes of this Act and to enhance the public good.</text>
				</paragraph></subsection></section><section id="idCCCE3F1AF32D40D89738E913CADAB16A"><enum>3.</enum><header>Remediation of
			 inactive or abandoned mines by Good Samaritans</header>
			<subsection id="ID0A02A1E1CD734ADC9400BB3DF4A32FD4"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="idD1CB031304F64C0881F5E35D4F524BE7"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
				</paragraph><paragraph id="idD14D1C77F875412BAA4A4D23F6351412"><enum>(2)</enum><header>Cooperating
			 agency</header><text>The term <term>cooperating agency</term> means any
			 Federal, State, or local agency or other person (other than the Administrator)
			 that—</text>
					<subparagraph id="id8ABA918327964A0687B8D18579BCCC28"><enum>(A)</enum><text>is authorized
			 under Federal or State law, or local ordinance, to participate in issuing a
			 permit under this section; and</text>
					</subparagraph><subparagraph id="id23A4677482DA484CBCF6E31C7C632F66"><enum>(B)</enum><text>elects to
			 participate in the process of issuing the permit.</text>
					</subparagraph></paragraph><paragraph id="idBCE1601CD94F4636871185A4A23B64F8"><enum>(3)</enum><header>Environmental
			 law</header><text>The term <term>environmental law</term> includes—</text>
					<subparagraph id="idF1D1FD8593A946F1ABE51B2985BB719F"><enum>(A)</enum><text>the
			 <act-name parsable-cite="TSCA">Toxic Substances Control Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C.
			 2601</external-xref> et seq.);</text>
					</subparagraph><subparagraph id="id0DF9B5FD84094739A95A6FBB57853C36"><enum>(B)</enum><text>the
			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C.
			 1251</external-xref> et seq.);</text>
					</subparagraph><subparagraph id="id6A83DAD3F25E416C88E3298340B02062"><enum>(C)</enum><text>the Safe Drinking
			 Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C.
			 300f</external-xref> et seq.);</text>
					</subparagraph><subparagraph id="idF0D355560E4149DB9483CE6C968771D7"><enum>(D)</enum><text>the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42
			 U.S.C. 4321</external-xref> et seq.);</text>
					</subparagraph><subparagraph id="id169F95715E774A36BB2E0BF1BC76C057"><enum>(E)</enum><text>the
			 <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C.
			 6901</external-xref> et seq.);</text>
					</subparagraph><subparagraph id="idEBCF6E6C5E55447E8DEE4DEBC3166A2D"><enum>(F)</enum><text>the
			 <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et
			 seq.);</text>
					</subparagraph><subparagraph id="idFF380F92182845FEB0B913462361BAFE"><enum>(G)</enum><text>the Uranium Mill
			 Tailings Radiation Control Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/42/7901">42 U.S.C. 7901</external-xref> et seq.);</text>
					</subparagraph><subparagraph id="id01F272D8D1B0445BB109E3934FBF155A"><enum>(H)</enum><text>the
			 <act-name parsable-cite="CERCL">Comprehensive Environmental Response,
			 Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref> et
			 seq.);</text>
					</subparagraph><subparagraph id="idFCDBF34CEC9B4040A8E10BBBCECCECF3"><enum>(I)</enum><text>applicable
			 environmental laws of a State; and</text>
					</subparagraph><subparagraph id="id41F6BA4514FE41858B2579A969604F69"><enum>(J)</enum><text>applicable
			 environmental ordinances of a political subdivision of a State.</text>
					</subparagraph></paragraph><paragraph id="idC6193368843A4F40B281D0E1A4453FFC"><enum>(4)</enum><header>Good
			 samaritan</header><text>The term <term>Good Samaritan</term> means a person
			 that—</text>
					<subparagraph id="id545DE03B0A86482CA3F646B2D5395A6D"><enum>(A)</enum><text>is unrelated, by
			 operation or ownership (except solely through succession to title), to the
			 historic mine residue to be remediated under this section;</text>
					</subparagraph><subparagraph id="id6AE872FB709E42FB89EE35DC43FBBE78"><enum>(B)</enum><text>had no role in the
			 creation of the historic mine residue;</text>
					</subparagraph><subparagraph id="id364F895E8EF7457D9C2A79E449248F24"><enum>(C)</enum><text>had no significant
			 role in the environmental pollution caused by the historic mine residue;
			 and</text>
					</subparagraph><subparagraph id="id0BA8C57A5C9843668222BE5FC0359812"><enum>(D)</enum><text>is not liable
			 under any Federal, State, or local law for the remediation of the historic mine
			 residue.</text>
					</subparagraph></paragraph><paragraph id="id642DE71ACCC7464DBB4F29BFC3186D33"><enum>(5)</enum><header>Historic mine
			 residue</header>
					<subparagraph id="id4EE01570E0B0476290D9CA4773CEFC0A"><enum>(A)</enum><header>In
			 general</header><text>The term <term>historic mine residue</term> means mine
			 residue or conditions at an inactive or abandoned mine site that pollute the
			 environment.</text>
					</subparagraph><subparagraph id="id10BFD188CA82418D942B8683BC47AB20"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>historic mine residue</term> may include, among other
			 materials—</text>
						<clause id="id7685F2EC28B14B31BA65D90892B10105"><enum>(i)</enum><text>ores;</text>
						</clause><clause id="id206317DE93404304B1DD40D41BA38444"><enum>(ii)</enum><text>minerals;</text>
						</clause><clause id="idBB8FBE0CD8F6499CB99F748E46BA0B31"><enum>(iii)</enum><text>equipment (or
			 materials in equipment);</text>
						</clause><clause id="id7496948BD983451882912A2D64A40049"><enum>(iv)</enum><text>wastes from
			 extractions, beneficiation, or other processing; and</text>
						</clause><clause id="id0C5C784F6A994281B316D2202DEA2204"><enum>(v)</enum><text>acidic or
			 otherwise polluted flows in surface or ground water.</text>
						</clause></subparagraph></paragraph><paragraph id="id04417BB553284E0BBE7B8407932B01B2"><enum>(6)</enum><header>Inactive or
			 abandoned mine site; mine site</header><text>The terms <term>inactive or
			 abandoned mine site</term> and <term>mine site</term> mean the site of a mine
			 and associated facilities that—</text>
					<subparagraph id="idCF366C7983394FEEAB4D6978578A7664"><enum>(A)</enum><text>were used for the
			 production of a mineral other than coal;</text>
					</subparagraph><subparagraph id="idF0947E06AB2F4A96A95685B6C903E398"><enum>(B)</enum><text>have historic mine
			 residue; and</text>
					</subparagraph><subparagraph id="id5EBECB44FD144D24BA82DB249D3D1365"><enum>(C)</enum><text>are abandoned or
			 inactive as of the date on which an application is submitted for a permit under
			 this section.</text>
					</subparagraph></paragraph><paragraph id="id08B842AAAF0C4DC6B35B9CFAAD407AD3"><enum>(7)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the Indian Self-Determination and Education Assistance
			 Act (25 U.S.C. 450b).</text>
				</paragraph><paragraph id="idC2F05E7B925C4400AAAA9AF699FDB3E0"><enum>(8)</enum><header>Person</header><text>The
			 term <term>person</term> includes—</text>
					<subparagraph id="idB4E3DF28B61F4765A591D502C0D28DE8"><enum>(A)</enum><text>an
			 individual;</text>
					</subparagraph><subparagraph id="id5138FC5D644C426BBA717AD17CC6F76C"><enum>(B)</enum><text>a firm;</text>
					</subparagraph><subparagraph id="id9C4F34479E504A7081B1B564EF56CCAA"><enum>(C)</enum><text>a
			 corporation;</text>
					</subparagraph><subparagraph id="idA6E061C101554EAF81CEF0B6ADBA6556"><enum>(D)</enum><text>an
			 association;</text>
					</subparagraph><subparagraph id="idF420A293DBE24E9CB855E721D28803E7"><enum>(E)</enum><text>a
			 partnership;</text>
					</subparagraph><subparagraph id="id84679B0AFF4B43768438D32778DC3A74"><enum>(F)</enum><text>a
			 consortium;</text>
					</subparagraph><subparagraph id="idC3744985FD704652BAD6D2E3E3940550"><enum>(G)</enum><text>a joint
			 venture;</text>
					</subparagraph><subparagraph id="idA4B3E6852AD44317AA1F007D3E9DA6FD"><enum>(H)</enum><text>a commercial
			 entity;</text>
					</subparagraph><subparagraph id="id72DED34D57504EACBC4D5B66F90EF6B1"><enum>(I)</enum><text>a nonprofit
			 organization;</text>
					</subparagraph><subparagraph id="idD0BB1C68BE184FB59C7974F380BEDB7F"><enum>(J)</enum><text>the Federal
			 Government;</text>
					</subparagraph><subparagraph id="id330B9F3E0BEF426FA330754A9FB78999"><enum>(K)</enum><text>a State;</text>
					</subparagraph><subparagraph id="id9A69ECE1F2DF4AF0B64A600302239FAE"><enum>(L)</enum><text>a political
			 subdivision of a State;</text>
					</subparagraph><subparagraph id="id3F18BA7DB6C74BFFA49D8C07454F389C"><enum>(M)</enum><text>an interstate
			 entity; and</text>
					</subparagraph><subparagraph id="id4EA07CC0B7314E399B5B0EF83357CFAA"><enum>(N)</enum><text>a
			 commission.</text>
					</subparagraph></paragraph><paragraph id="id13E5BB0AF3FA4FD1AE868FF20D18C982"><enum>(9)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
					<subparagraph id="ID01CAC88D89734E089AAF521EDEE96FD2"><enum>(A)</enum><text>a State;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF32869E9E0DC43D79A64807585A95FBF"><enum>(B)</enum><text>an Indian
			 tribe.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC440918B95C04EEA811C13EEA3BA8768"><enum>(b)</enum><header>Permits</header><text display-inline="yes-display-inline">The Administrator may issue a permit to a
			 Good Samaritan to carry out a project to remediate all or part of an inactive
			 or abandoned mine site in accordance with this section.</text>
			</subsection><subsection id="IDba95da1166b9414885756d9a42c285ed"><enum>(c)</enum><header>Eligibility for
			 permits</header>
				<paragraph id="id0E756816677541A1A98FC83577ED3402"><enum>(1)</enum><header>In
			 general</header><text>To be eligible for a permit to carry out a project to
			 remediate an inactive or abandoned mine site in a State under this
			 section—</text>
					<subparagraph id="idC7040ED3649A48588F19C05AC7862729"><enum>(A)</enum><text>the mine site
			 shall be located in the United States;</text>
					</subparagraph><subparagraph id="id0C47A49E91EA41E68FC01BDE7C7B8B65"><enum>(B)</enum><text>the principal
			 purpose of the project shall be the reduction of pollution caused by historic
			 mine residue;</text>
					</subparagraph><subparagraph id="idC7618586D1294F198664E4F2D2C59D6A"><enum>(C)</enum><text>the mine site may
			 not be a mine site included on the national priorities list under section
			 105(a)(8)(B) of the Comprehensive Environmental Response, Compensation, and
			 Liability Act of 1980 (42 U.S.C. 9605(a)(8)(B)) except in a case in which the
			 Administrator determines, on a case-by-case basis, that—</text>
						<clause id="id867DC6A1BB624567807038A69781ED08"><enum>(i)</enum><text>the remediation
			 project proposed to be carried out at the mine site is minor as compared to all
			 remediation activity needed at the listed mine site;</text>
						</clause><clause id="id1D0F1CDAA3534BBBB5F22E80BA99AAF7"><enum>(ii)</enum><text>the conduct of
			 the proposed remediation project at the listed mine site will not interfere
			 with any other remediation at the mine site that is reasonably likely to occur;
			 and</text>
						</clause><clause id="id6F6296CFC6B24F3AB9698E8131E210A2"><enum>(iii)</enum><text>except for the
			 remediation project proposed by the Good Samaritan at the mine site under this
			 Act, there is not likely to be remediation of the historic mine residue that is
			 the subject of the project at the listed mine site in the reasonably
			 foreseeable future;</text>
						</clause></subparagraph><subparagraph id="IDdf589cc2fee64055a4720c6d04533ec6"><enum>(D)</enum><text>the permit shall
			 authorize only those activities that are directly required for the remediation
			 of historic mine residue at the mine site;</text>
					</subparagraph><subparagraph id="idA547FBF4BCC1477CBA16997C270E1F96"><enum>(E)</enum><text>the person
			 obtaining the permit shall be a Good Samaritan; and</text>
					</subparagraph><subparagraph id="id26EA5CEEDCB247FCA7A77E2EA999ABE0"><enum>(F)</enum><text>a State
			 remediation program described in subsection (d) shall be in effect for
			 remediation of the mine site.</text>
					</subparagraph></paragraph><paragraph id="idFB3703AE1B6D4AE28D74BB09C1164C58"><enum>(2)</enum><header>Other
			 activities</header><text>Any activity other than the activities described in
			 paragraph (1)(D) conducted by the permittee or any other person at the mine
			 site (including, without limitation, any mining or processing in addition to
			 that required for the remediation of historic mine residue for the public
			 good)—</text>
					<subparagraph id="idD46681E4AB2E4407B3F940E8003EE803"><enum>(A)</enum><text>shall not be
			 authorized under a permit issued under this section; and</text>
					</subparagraph><subparagraph id="id4E11F67386884DE5B2E7DE1D68BEEE58"><enum>(B)</enum><text>may be authorized
			 under other applicable laws, including environmental laws.</text>
					</subparagraph></paragraph></subsection><subsection id="IDd65242b8e5ca4547ad7786b45ec05d56"><enum>(d)</enum><header>State
			 remediation program</header>
				<paragraph id="IDafea6b93d5064019bbdc07eafdcd29f9"><enum>(1)</enum><header>In
			 general</header><text>Before a permit may be issued to carry out a project in a
			 State under this section, the State shall have in effect a State remediation
			 program that meets the requirements of this subsection.</text>
				</paragraph><paragraph id="IDd2bb624441d648dd86a8b42d0ae5ea6c"><enum>(2)</enum><header>
			 Requirements</header><text>To meet the requirements of this subsection, under
			 the State remediation program, the State shall—</text>
					<subparagraph id="IDa73bb982d905442f9261493fbfc63312"><enum>(A)</enum><text>agree to
			 participate, as a signatory, in each project for a which a permit for
			 remediation in the State is issued under this section;</text>
					</subparagraph><subparagraph id="IDd6880ef96cf545a79123b90b842ff0eb"><enum>(B)</enum><text>agree that a
			 permittee shall comply with the terms and conditions of the permit in lieu of
			 compliance with applicable environmental laws specifically described in the
			 permit in accordance with subsection (h)(1)(B);</text>
					</subparagraph><subparagraph id="ID7bea9a2609e34811a171866805e27cc5"><enum>(C)</enum><text>authorize State
			 agencies and political subdivisions of the State to participate in the permit
			 process under this section, as appropriate, and assist in providing the
			 resources to enable that participation; and</text>
					</subparagraph><subparagraph id="ID343e0a7ae0414accb6221726dd64fa3b"><enum>(D)</enum><text>designate a lead
			 State agency that is responsible to carry out permitting responsibilities of
			 the State under this section.</text>
					</subparagraph></paragraph></subsection><subsection id="ID6545e8f477c2458391fd8eecc50dea75"><enum>(e)</enum><header>Application for
			 permits</header><text>To obtain a permit to carry out a project to remediate an
			 inactive or abandoned mine site under this section, an applicant shall submit
			 to the Administrator an application, signed by the applicant, that
			 provides—</text>
				<paragraph id="ID1ccbf751e79946a983efcae621d6fb2a"><enum>(1)</enum><text>a description of
			 the mine site (including the boundaries of the mine site);</text>
				</paragraph><paragraph id="ID2bb234290a5d435e8d8c231d7d4770c6"><enum>(2)</enum><text>an identification
			 of—</text>
					<subparagraph id="idB51202B544584FEEBABDA42F4052FC4A"><enum>(A)</enum><text>any current owner
			 or operator of the mine site; and</text>
					</subparagraph><subparagraph id="id630208F7F8464409A4A23CA04871DF8B"><enum>(B)</enum><text>any person with a
			 legal right to exclude other persons from the mine site or affect activities on
			 the mine site, with a description of those legal rights;</text>
					</subparagraph></paragraph><paragraph id="ID91d7e310536d43e2b159ee9b71dc14f9"><enum>(3)</enum><text>evidence
			 satisfactory to the Administrator that the applicant has or will acquire all
			 legal rights necessary to enter the mine site and to perform the remediation
			 described in the application;</text>
				</paragraph><paragraph id="IDcfdb023a7e9e4af28ec80509a6394544"><enum>(4)</enum><text>a description,
			 based on the conduct of an inquiry that is reasonable under the circumstances,
			 of—</text>
					<subparagraph id="id0B8CCB9481384B1DBAC94736C42DC505"><enum>(A)</enum><text>all persons that
			 may be legally responsible for the remediation of the mine site; and</text>
					</subparagraph><subparagraph id="idD9D0595EBBB74AF0BD279519586E30CC"><enum>(B)</enum><text>any relationship
			 between those persons and the applicant;</text>
					</subparagraph></paragraph><paragraph id="idD08AD441EBC74572BFD653DEB6B32248"><enum>(5)</enum><text>a certification
			 that the applicant knows of no other person that (as of the date of submission
			 of the application)—</text>
					<subparagraph id="id7BFBBE15F5F649B385FD2482D26E5F2F"><enum>(A)</enum><text>is potentially
			 legally responsible for the remediation of the mine site; and</text>
					</subparagraph><subparagraph id="id00036570CDAE45879A421DCFF338A68F"><enum>(B)</enum><text>has sufficient
			 resources to complete the remediation;</text>
					</subparagraph></paragraph><paragraph id="ID50102d876a60482fb08edac8d4a9799a"><enum>(6)</enum><text>a detailed
			 description of the historic mine residue to be remediated;</text>
				</paragraph><paragraph id="ID2e5ee808404b4c7fb64be482e5390d40"><enum>(7)</enum><text>a description of
			 the baseline conditions (as of the date of submission of the application) of
			 the environment affected by the historic mine residue to be remediated;</text>
				</paragraph><paragraph id="IDfe4682f227c245c789460bfd33efde27"><enum>(8)</enum><text>a description
			 of—</text>
					<subparagraph id="idE1CE2BCF1D8B43219E19CB37342635E5"><enum>(A)</enum><text>the nature and
			 scope of the proposed remediation; and</text>
					</subparagraph><subparagraph id="id535A5FC32E5240E8A78C867769073307"><enum>(B)</enum><text>detailed
			 engineering plans for the project;</text>
					</subparagraph></paragraph><paragraph id="id346A5E140E6C4EEB97AF70C6FF73564F"><enum>(9)</enum><text>a description of
			 the manner in which the remediation will assist the mine site in meeting, to
			 the maximum extent reasonable and practicable under the circumstances, water
			 quality standards;</text>
				</paragraph><paragraph id="IDfa7b3d163fd64595b2f9392947a8dccb"><enum>(10)</enum><text>a schedule for
			 the work to be carried out under the project;</text>
				</paragraph><paragraph id="IDe39bd6366c98409b9744c82895629d46"><enum>(11)</enum><text>a budget for the
			 work to be carried out under the project;</text>
				</paragraph><paragraph id="ID6c2440e7837b451a9650b8615db65150"><enum>(12)</enum><text>a description of
			 financial assurances, if any, to be provided by the permittee to ensure that
			 the permitted work, including any operation and maintenance, will be
			 completed;</text>
				</paragraph><paragraph id="ID66044867fb35438cbb9a68f6643c4363"><enum>(13)</enum><text>a description of
			 a monitoring program following remediation (if any) that will be implemented to
			 evaluate the effects of the remediation on the environment;</text>
				</paragraph><paragraph id="IDcf15b81855d24acf9f4092e4e2ad2e7d"><enum>(14)</enum><text>a detailed plan
			 for the required operation and maintenance of any remediation; and</text>
				</paragraph><paragraph id="ID504ffaab8f5143d7a195396705d18040"><enum>(15)</enum><text>a list of all
			 environmental laws for which the applicant seeks the protection described in
			 paragraphs (1) and (2) of subsection (g).</text>
				</paragraph></subsection><subsection id="id481FCF0698944C15972202377BA0FD06"><enum>(f)</enum><header>Permit
			 issuance</header>
				<paragraph id="IDa9944aec4a9042f688f0321d14ff2248"><enum>(1)</enum><header>In
			 general</header><text>The Administrator may issue a permit under this section
			 to carry out a project for the remediation of an inactive or abandoned mine
			 site in a State only if—</text>
					<subparagraph id="id086CEB5480A44FEBA2C9F48FBA2BCF76"><enum>(A)</enum><text>the Administrator
			 determines that—</text>
						<clause id="idAE24EEF306B9460DAD043918042A056A"><enum>(i)</enum><text>the project will
			 improve the environment on or in the area of the mine site to a significant
			 degree, as determined by the Administrator;</text>
						</clause><clause id="id2021500051114F649F080860CD13E51F"><enum>(ii)</enum><text>the project will
			 not degrade any aspect of the environment in any area to a significant
			 degree;</text>
						</clause><clause id="idA3BAFB6D82D346D38B655FD6EE16B260"><enum>(iii)</enum><text>the project will
			 meet applicable water quality standards, to the maximum extent reasonable and
			 practicable under the circumstances;</text>
						</clause><clause id="id056F073DEC1C47B197BDE5392DC08DEB"><enum>(iv)</enum><text>the permittee has
			 the financial and other resources to complete, and will complete, the permitted
			 work; and</text>
						</clause><clause id="id3D4B094D59C24878A8E298DDD4FC4119"><enum>(v)</enum><text>the project meets
			 the requirements of this section;</text>
						</clause></subparagraph><subparagraph id="id5C222E4131A74CE689242FDBA3929F59"><enum>(B)</enum><text>the State concurs
			 with the issuance of, and signs, the permit;</text>
					</subparagraph><subparagraph id="id6EFC54DA17D643F588E3E908D66043ED"><enum>(C)</enum><text>if the permit
			 provides protection for the permittee under an environmental law of a political
			 subdivision of a State in accordance with paragraphs (1) and (2) of subsection
			 (g), the political subdivision concurs with the issuance of, and signs, the
			 permit; and</text>
					</subparagraph><subparagraph id="idAF1B123988104D7BB19AC1480DD39D53"><enum>(D)</enum><text>if the proposed
			 project is to be carried out on Federal land, each State (or political
			 subdivision) within which the Federal land is located meets the requirements of
			 subparagraphs (B) and (C).</text>
					</subparagraph></paragraph><paragraph id="IDad64528f237b4eb98f03a84f7bafbd9c"><enum>(2)</enum><header>Discretionary
			 actions</header><text>The issuance of a permit by the Administrator, and the
			 concurrence of the affected State and political subdivisions of a State to
			 participate in the permit process, shall be discretionary actions and shall be
			 taken in the public interest.</text>
				</paragraph><paragraph id="id18A63A2F8AA04BB6800F01819B9BC91E"><enum>(3)</enum><header>Functional
			 equivalency</header><text>No action of the Administrator or any other person
			 pursuant to this section shall constitute a major Federal action significantly
			 affecting the quality of the human environment under the National Environmental
			 Policy Act (42 U.S.C. 4321 et seq.).</text>
				</paragraph><paragraph id="ID9110c6f056ae45e799ef9c740c059e00"><enum>(4)</enum><header>Deadline</header>
					<subparagraph id="idB69B49377C2C44F2AB109399FF8C0271"><enum>(A)</enum><header>In
			 general</header><text>The Administrator shall issue or deny a permit for the
			 remediation of a mine site not later than—</text>
						<clause id="idFED193D40C364827B117923F7FEACC22"><enum>(i)</enum><text>the date that is
			 180 days after the date of receipt by the Administrator of an application for
			 the permit that, as determined by the Administrator, is complete; or</text>
						</clause><clause id="id87922553B8B04440A2423DA4B4309091"><enum>(ii)</enum><text>such later date
			 as may be determined by the Administrator with the agreement of the
			 applicant.</text>
						</clause></subparagraph><subparagraph id="id8D0CCD98EC574D54BB4949EF896092F8"><enum>(B)</enum><header>Constructive
			 denial</header><text>If the Administrator fails to issue or deny the permit in
			 accordance with subparagraph (A), the application shall be considered to be
			 denied by the Administrator.</text>
					</subparagraph></paragraph><paragraph id="id99FEDB39B76E422EAF6289D21E7B372D"><enum>(5)</enum><header>Review for
			 certain projects</header><text>A project that, as determined by the
			 Administrator, would be less complex, or pose less risk, than other projects
			 under review by the Administrator for a permit under this section, may be
			 reviewed, at the discretion of the Administrator, under a more simple and rapid
			 review process under this subsection.</text>
				</paragraph></subsection><subsection id="id28AE4249781E434FBC4A76171359021B"><enum>(g)</enum><header>Effect of
			 permits</header>
				<paragraph id="ID529fe008f9ba4b3c8f20c67dcfe14cc2"><enum>(1)</enum><header>In
			 general</header><text>A permit issued under this section to carry out a project
			 for the remediation of an inactive or abandoned mine site—</text>
					<subparagraph id="idF28B27F0BDA84F36BE2085DD9F9B5286"><enum>(A)</enum><text>authorizes the
			 permittee to carry out the activities described in the permit;</text>
					</subparagraph><subparagraph id="id0DDEA7127F104EF3BF4F31DACE024682"><enum>(B)</enum><text>authorizes
			 enforcement under this section; and</text>
					</subparagraph><subparagraph id="idF101346EAC1943CAB7708D338C8BBAFC"><enum>(C)</enum><text>provides to the
			 permittee, in carrying out the activities authorized under the permit,
			 protection from actions taken, obligations, and liabilities arising under the
			 environmental laws specified in the permit.</text>
					</subparagraph></paragraph><paragraph id="IDbd46bd3284394388bf4c4770b6f6f038"><enum>(2)</enum><header>Cross-compliance</header><text>A
			 permittee shall comply with the terms and conditions of a permit issued under
			 this section in lieu of compliance with the environmental laws specified in the
			 permit with respect to the work authorized under the permit.</text>
				</paragraph></subsection><subsection id="ID715c43c68cc0465988d6dce5f3b161b4"><enum>(h)</enum><header>Content of
			 permits</header>
				<paragraph id="id1DF8A17C31CA499FA81C3FAAEAED05F8"><enum>(1)</enum><header>In
			 general</header><text>A permit issued under this section shall contain—</text>
					<subparagraph id="ID79d27079223c4db0b07d7619a631a74b"><enum>(A)</enum><text>a detailed
			 description of the engineering and other work that is authorized under the
			 permit;</text>
					</subparagraph><subparagraph id="IDc40d345b5d6e45838b86b57cebc00174"><enum>(B)</enum><text>a specific list of
			 environmental laws, or selected provisions of environmental laws, with respect
			 to which compliance with the permit will operate in lieu of compliance with the
			 laws;</text>
					</subparagraph><subparagraph id="IDde7ec33357bd429cb41db7cd3a125989"><enum>(C)</enum><text>a provision that
			 states that the permittee is responsible for securing, for all activities
			 authorized under the permit, all authorizations, licenses, and permits that are
			 required under applicable law, other than the environmental laws described in
			 subsection (g)(2); and</text>
					</subparagraph><subparagraph id="id3547C69D85A34803B27D6E59DCA736F0"><enum>(D)</enum><text>any other terms
			 and conditions that are determined to be appropriate by the
			 Administrator.</text>
					</subparagraph></paragraph><paragraph id="id87ED7CB1131740B79BE3A191E84B5BFB"><enum>(2)</enum><header>Investigative
			 sampling</header>
					<subparagraph id="id8114E97287D942F29E72664C418718C1"><enum>(A)</enum><header>In
			 general</header><text>A permit may identify an appropriate program of
			 investigative sampling to be completed prior to remediation, as determined by
			 the Administrator upon application.</text>
					</subparagraph><subparagraph id="idDC0F02A9D99341388D40073CC3CF483E"><enum>(B)</enum><header>Option to
			 decline remediation</header><text>In the event that investigative sampling is
			 authorized, the permit may allow the permittee to decline to undertake
			 remediation based upon sampling results.</text>
					</subparagraph><subparagraph id="idFD67C3CCCD654BD6B01C8B61C38A496A"><enum>(C)</enum><header>Permit
			 modification</header><text>Based upon sampling results, a permittee may apply
			 for a permit modification using the permit procedures in this Act.</text>
					</subparagraph></paragraph><paragraph id="ID8e838ab7d43e4b109b0e589abded7f97"><enum>(3)</enum><header>Timing</header><text>Work
			 authorized under a permit shall—</text>
					<subparagraph id="id1A7258773A1148B29B1C1CE175277E44"><enum>(A)</enum><text>commence not later
			 than the date that is 18 months after the date of issuance of the permit;
			 and</text>
					</subparagraph><subparagraph id="id6F56C87E4D4C4B2CB0FD3F9A602A274B"><enum>(B)</enum><text>continue until
			 completed, with temporary suspensions permitted during adverse weather or other
			 conditions specified in the permit.</text>
					</subparagraph></paragraph><paragraph id="ID059242788fc24ad189c6c50a523d215a"><enum>(4)</enum><header>Signature by
			 permittee</header><text>The signature of the permittee on the permit shall be
			 considered to be an acknowledgment by the permittee that the permittee accepts
			 the terms and conditions of the permit.</text>
				</paragraph><paragraph id="ID395b1886818e4351a9bb86e024345197"><enum>(5)</enum><header>Transfer of
			 permits</header><text>A permit may be transferred to another person only
			 if—</text>
					<subparagraph id="id93BD7413681B4731A1F5C89149B1BA95"><enum>(A)</enum><text>the Administrator
			 determines that the transferee will satisfy all of the requirements of the
			 permit;</text>
					</subparagraph><subparagraph id="id2BFD1827AB034D95A1D6FFDA7793D381"><enum>(B)</enum><text>the transferee
			 signs the permit; and</text>
					</subparagraph><subparagraph id="idCB250CBBC3414FEB9BB42D2DCB91759A"><enum>(C)</enum><text>the Administrator
			 includes in the transferred permit any additional conditions necessary to meet
			 the goals of this section.</text>
					</subparagraph></paragraph><paragraph id="idE337395F3ECA498EA8EDAEC88029D9EB"><enum>(6)</enum><header>Termination of
			 permit</header><text>The authority to carry out work under a permit issued
			 under this section shall terminate if the work does not commence by the date
			 that is 18 months after the date of issuance of the permit.</text>
				</paragraph></subsection><subsection id="id3C1693EE256546AC9917F5B30FE07A91"><enum>(i)</enum><header>Role of
			 Administrator</header><text>In carrying out this section, the Administrator
			 shall—</text>
				<paragraph id="IDe14707d5f7ec4093b1242ecd8db26611"><enum>(1)</enum><text>consult with
			 prospective applicants;</text>
				</paragraph><paragraph id="id6340EC8A685243338E332430B475940A"><enum>(2)</enum><text>accept permit
			 applications under this section;</text>
				</paragraph><paragraph id="ID66e840c17c344e0785f5a193d4bc6e04"><enum>(3)</enum><text>convene,
			 coordinate, and lead the application review process;</text>
				</paragraph><paragraph id="IDedd6149d1e424abaa73c76944ba760ba"><enum>(4)</enum><text>maintain all
			 records relating to the permit and the permit process;</text>
				</paragraph><paragraph id="ID214ce8f83eaf492f82d5c2c994401b86"><enum>(5)</enum><text>provide an
			 opportunity for cooperating agencies and the public to participate in the
			 permit process;</text>
				</paragraph><paragraph id="IDaee6160b62664f4892a3a03be8e56335"><enum>(6)</enum><text>issue the permit
			 under this section, if appropriate; and</text>
				</paragraph><paragraph id="ID419384e16d8149e6b20a616abfc9845e"><enum>(7)</enum><text>enforce and
			 otherwise carry out this section.</text>
				</paragraph></subsection><subsection id="id3291991C5F39480FB40B8B96654B324F"><enum>(j)</enum><header>Cooperating
			 agencies</header><text>If the Administrator learns that an application for the
			 remediation of a mine site under this section will be submitted to the
			 Administrator, the Administrator shall (as soon as practicable) provide a
			 notice of the application to—</text>
				<paragraph id="id58560F6CF6B942FC8AA243BF03FA6EC0"><enum>(1)</enum><text>the lead State
			 agency designated under subsection (d)(2)(D);</text>
				</paragraph><paragraph id="idCCCE8BE4E5C747EE8864423B77C5EB92"><enum>(2)</enum><text>each local
			 government located within a radius of 20 miles of the mine site; and</text>
				</paragraph><paragraph id="id3FC3BEDCCEF244A6B76AA19A615D2445"><enum>(3)</enum><text>each Federal and
			 State agency that may have an interest in the application.</text>
				</paragraph></subsection><subsection id="id901CD9A64B63472DA5854FBC7A3EA020"><enum>(k)</enum><header>Public
			 participation</header>
				<paragraph id="ID687d3193979d426e8d0bc650b3a98d82"><enum>(1)</enum><header>Potential
			 submission of applications</header><text>If the Administrator learns that an
			 application for the remediation of a mine site under this section will be
			 submitted to the Administrator, the Administrator shall (as soon as
			 practicable) provide to the public a notice that describes—</text>
					<subparagraph id="id098306A68DC54F81942C2FF7E9DB7592"><enum>(A)</enum><text>the location of
			 the mine site;</text>
					</subparagraph><subparagraph id="id10648D91F2D24A69BDF8F1BE94F27700"><enum>(B)</enum><text>the scope and
			 nature of the proposed remediation; and</text>
					</subparagraph><subparagraph id="idA12A4241D022474AACC65BEBF77458D4"><enum>(C)</enum><text>the name of the
			 Good Samaritan that will be carrying out the proposed remediation.</text>
					</subparagraph></paragraph><paragraph id="ID18bc66c8eddb4e7dbffcc034b0148192"><enum>(2)</enum><header>Receipt of
			 application</header><text>If the Administrator receives an application for the
			 remediation of a mine site under this section, the Administrator shall (as soon
			 as practicable) provide to the public a notice that provides the information
			 described in paragraph (1).</text>
				</paragraph><paragraph id="ID73ce87c20ced458194c8380779a362c1"><enum>(3)</enum><header>Hearing</header>
					<subparagraph id="id1494E82547B249D3B3E4297A12248AF6"><enum>(A)</enum><header>In
			 general</header><text>Not later than 45 days after the date of receipt of a
			 complete application for the remediation of a mine site under this section, the
			 Administrator shall hold a hearing in the vicinity of the mine site to be
			 remediated.</text>
					</subparagraph><subparagraph id="idF8173527F1A2406699D1AAE0D07E05B2"><enum>(B)</enum><header>Comments</header><text>At
			 the hearing, the Administrator shall provide the applicant, the public, and
			 cooperating agencies with the opportunity to comment on the application.</text>
					</subparagraph></paragraph><paragraph id="idF3945124C2E04585A9F2FDA0AD3DA3D2"><enum>(4)</enum><header>Notice of
			 pending issuance</header><text>Not less than 14 days before the date of
			 issuance of a permit for the remediation of a mine site under this section, the
			 Administrator shall provide to the public and each cooperating agency notice of
			 the pending issuance of the permit.</text>
				</paragraph><paragraph id="IDc742ed0fd8a14646b03c09cf85ae33fd"><enum>(5)</enum><header>Public
			 records</header><text>All records relating to the permit and the permit process
			 shall be considered to be public records, except to the extent the records are
			 subject to a legal privilege.</text>
				</paragraph></subsection><subsection id="IDefe19bdc5ebd4c718e3e76d325f9db15"><enum>(l)</enum><header>Monitoring</header>
				<paragraph id="IDdee27137c05b4a91a7afa2a47e0c6625"><enum>(1)</enum><header>In
			 general</header><text>The permittee shall take such actions as the
			 Administrator determines are necessary to ensure appropriate baseline and
			 post-remediation monitoring of the environment under paragraphs (7) and (13) of
			 subsection (e).</text>
				</paragraph><paragraph id="ID601c2fe0cbb74f7984fa54361b6e7c86"><enum>(2)</enum><header>Administration</header><text>When
			 selecting the type and frequency of the monitoring requirements to be included
			 in a permit, if any, the Administrator shall—</text>
					<subparagraph id="idEDDBD84E28774F48876967DD925A8327"><enum>(A)</enum><text>balance the need
			 for monitored information against the cost of the monitoring, based on the
			 circumstances relating to the remediation; and</text>
					</subparagraph><subparagraph id="id17C1929F8B2849E5935F0C3C715705B1"><enum>(B)</enum><text>take into account
			 the scope of the project.</text>
					</subparagraph></paragraph><paragraph id="id8B99615DA8494DF69215E4B1C9B88B1E"><enum>(3)</enum><header>Multiparty
			 monitoring</header><text>The Administrator may approve in a permit the conduct
			 of monitoring by multiple parties if, as determined by the Administrator, the
			 multiparty monitoring will effectively accomplish the goals of this
			 section.</text>
				</paragraph></subsection><subsection id="id1BD0E12A49D94ED481F6E1B534E29697"><enum>(m)</enum><header>Enforcement</header>
				<paragraph id="id95BBCCE2554140DFBE990CD980CA02BB"><enum>(1)</enum><header>Civil
			 penalty</header><text>Any person who violates a permit issued under this
			 section shall be subject to a civil penalty of up to $10,000 for each day of
			 the violation.</text>
				</paragraph><paragraph id="id101FC7F41CEF4855959BA610C8CFB4BA"><enum>(2)</enum><header>Injunctions</header>
					<subparagraph id="id962EC4D2BA86489D82DCF9464F93701C"><enum>(A)</enum><header>In
			 general</header><text>A court may issue an injunction—</text>
						<clause id="id58355E91B068451494DA966B131987DB"><enum>(i)</enum><text>mandating that a
			 person comply with a permit or take action to abate a permit violation;
			 or</text>
						</clause><clause id="id5DD44DECA68F45BAB05231BF4B538419"><enum>(ii)</enum><text>prohibiting a
			 person from violating a permit.</text>
						</clause></subparagraph><subparagraph id="id16BBC3C336764B3CA015F8981EAC3A2C"><enum>(B)</enum><header>Minimum
			 requirement</header><text>In the event of a permit violation, and absent
			 extraordinary circumstances, the court shall, at a minimum, require—</text>
						<clause id="id6988694B40B644BAACD3E8AF1C3EA0D2"><enum>(i)</enum><text>the permittee to
			 repair the damage to any part of the environment that is caused by an action of
			 the permittee in violation of the permit; and</text>
						</clause><clause id="id71DFD8E75A0E4DF28B2CBC898FA7CA77"><enum>(ii)</enum><text>the environment
			 to be restored to the condition of the environment prior to the action of the
			 permittee in violation of the permit.</text>
						</clause></subparagraph></paragraph><paragraph id="idC0D2040BD314432CB96A8BD2C7F0A19C"><enum>(3)</enum><header>Agencies</header><text>Any
			 government agency that signs a permit issued under this section may enforce the
			 permit through appropriate administrative or judicial proceedings.</text>
				</paragraph></subsection><subsection id="idC547F5C347C34476BB126D367B542311"><enum>(n)</enum><header>Judicial
			 review</header><text>A court may set aside or modify an action of the
			 Administrator in issuing a permit under this section, or an action of a State
			 or political subdivision of a State in signing a permit, only on clear and
			 convincing evidence of an abuse of discretion.</text>
			</subsection><subsection id="ID8490682bb28b4a1ab8bdd5860cd5d2f7"><enum>(o)</enum><header>Savings
			 provisions</header>
				<paragraph id="IDd78a57ffa04949109462bb4dfc6af256"><enum>(1)</enum><header>Emergency
			 authority</header><text>Nothing in this section affects the authority of a
			 Federal, State, or local agency to carry out any emergency authority, including
			 an emergency authority provided under any environmental law listed in a
			 permit.</text>
				</paragraph><paragraph id="IDe1eb297028dc4d20b8bfe44284f6dd5d"><enum>(2)</enum><header>Liability</header><text>Except
			 to the extent that a permit provides protection under an environmental law
			 specified in a permit in accordance with subsection (g)(1)(C), nothing in this
			 section or a permit issued under this section limits the liability of any
			 person (including a permittee) under any other provision of law.</text>
				</paragraph></subsection><subsection id="ID91d10a40373848b4a58a5c4bef5b17a8"><enum>(p)</enum><header>Regulations</header>
				<paragraph id="ID2a2b7bb68da045f28961314f49e8ec29"><enum>(1)</enum><header>In
			 general</header><text>The Administrator may promulgate such regulations as are
			 necessary to carry out this section.</text>
				</paragraph><paragraph id="ID9474489c40cf421793f51aac1f03da61"><enum>(2)</enum><header>Effectiveness</header><text>This
			 section shall be effective regardless of whether regulations are promulgated by
			 the Administrator under paragraph (1).</text>
				</paragraph></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause" changed="added" reported-display-style="italic" committee-id="SSEV00">
		<section id="id6a6b4bde-66ca-464f-8d2c-abc39d4a0cc7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cleanup of Inactive and Abandoned
			 Mines Act</short-title></quote>.</text>
		</section><section id="id0B73D5D194FB4C608C98247860F66605"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection id="ID075782f587fb4e9693747bd14b3b92c7"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="ID6f2ad4f48e884896825abe5b6ddf38a6"><enum>(1)</enum><text>the Federal Government
			 and State governments encouraged hard rock mining in the United States through
			 a wide variety of laws, policies, and actions;</text>
				</paragraph><paragraph id="ID0c9120233b114a17b246c9fd8999b5f2"><enum>(2)</enum><text>mining operations produce
			 metals and minerals with important social benefits and values;</text>
				</paragraph><paragraph id="ID7de61ef855854b1e9433f32301b74652"><enum>(3)</enum><text>many areas in which
			 historic mining took place in the United States are now inactive and abandoned
			 mine sites;</text>
				</paragraph><paragraph id="IDf611580cd7b34670966aa836b6fd8dbc"><enum>(4)</enum><text>the mining activities
			 that took place prior to the enactment of modern environmental laws often
			 disturbed public and private land, and those disturbances lead to environmental
			 pollution, including the discharge of pollutants to surface water and
			 groundwater;</text>
				</paragraph><paragraph id="IDea83c00356734a7886e198b9ab353b50"><enum>(5)</enum><text>many of the individuals
			 and corporate owners and operators of those mines, the actions of which caused
			 that pollution, are no longer alive or in existence;</text>
				</paragraph><paragraph id="ID0f5fbc6a8b9d4d5491325aa2268bb5c6"><enum>(6)</enum><text>many of those mine sites
			 have polluted the environment for more than a century and will continue to do
			 so indefinitely unless remediated;</text>
				</paragraph><paragraph id="ID4d2153a0f72b47359414c58f912223ac"><enum>(7)</enum><text>unabated discharges from
			 inactive and abandoned mines will continue to pollute surface water,
			 groundwater, and soils;</text>
				</paragraph><paragraph id="ID08c21bd03be549e9ab9c749650f489e0"><enum>(8)</enum><text>many of the streams and
			 waterbodies impacted by acid mine drainage are important resources for fish and
			 wildlife, recreation, drinking water, agriculture, and other public
			 purposes;</text>
				</paragraph><paragraph id="ID590f6c7fb94f47809adc2155c645e9ef"><enum>(9)</enum><text>because some of the
			 remaining owners and operators of mine sites do not have resources that are
			 adequate to conduct remediation properly under applicable environmental laws,
			 for all practical purposes, no person is responsible for the cleanup of
			 pollution from those sites;</text>
				</paragraph><paragraph id="IDcf2b1f0713074992b1959afcd84748d9"><enum>(10)</enum><text>from time to time,
			 individuals and companies are willing to remediate historic mine sites for the
			 public good as Good Samaritans, despite the fact that those individuals and
			 companies are not legally required to remediate the mine sites;</text>
				</paragraph><paragraph id="ID9aae52d827da4771a68929099bcc649c"><enum>(11)</enum><text>Good Samaritan
			 remediation activities may—</text>
					<subparagraph id="IDe8d9b69ca0b842cd891231d66ac90f30"><enum>(A)</enum><text>vary in size and
			 complexity;</text>
					</subparagraph><subparagraph id="ID8b141bff79914759ad7267b0a52f574f"><enum>(B)</enum><text>reflect the myriad
			 methods in which mine residue may be cleaned up; and</text>
					</subparagraph><subparagraph id="ID9fb18e8c0c234ea9ab347a3d68031465"><enum>(C)</enum><text>include, among other
			 activities—</text>
						<clause id="IDcef048ab99084d83951a5bf751d75f01"><enum>(i)</enum><text>the relocation or
			 management of tailings or other waste piles;</text>
						</clause><clause id="ID6f536fa9dc5a46c7ae1328f6cc9e19b4"><enum>(ii)</enum><text>passive or active water
			 treatment;</text>
						</clause><clause id="ID32cf1c5b5e6943978dabc5b56605e87f"><enum>(iii)</enum><text>runoff or run-on
			 controls; and</text>
						</clause><clause id="ID08be41e452cb4e90be7d6374511a82ef"><enum>(iv)</enum><text>the use or reprocessing
			 of, or removal of materials from, mine residue;</text>
						</clause></subparagraph></paragraph><paragraph id="IDa24eef8ad42b445fabb495464a081fdd"><enum>(12)</enum><text>the potential
			 environmental liabilities that may attach to Good Samaritans as a result of the
			 remediation can dissuade potential Good Samaritans from acting for the public
			 good;</text>
				</paragraph><paragraph id="ID950dc103604d4bf0bc253f4991f6e5ab"><enum>(13)</enum><text>it is in the interest of
			 the United States, the States, and local communities to remediate historic mine
			 sites, in appropriate circumstances and to the maximum extent practicable, so
			 that detrimental environmental impacts of the sites are lessened in the future;
			 and</text>
				</paragraph><paragraph id="IDce2586db685545189149a9eca1809c91"><enum>(14)</enum><text>if appropriate
			 protections are provided for Good Samaritans, Good Samaritans will have a
			 greater incentive to remediate those sites for the public good.</text>
				</paragraph></subsection><subsection id="ID0aeef1efe3154f0292734f679b2dcc2e"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="IDc99636f864254f8683f15b7be5dfd458"><enum>(1)</enum><text>to encourage partial or
			 complete remediation of inactive and abandoned mine sites for the public good
			 by persons that are not otherwise legally responsible for the
			 remediation;</text>
				</paragraph><paragraph id="IDb4f426b3b79549a2af9256151fa7f666"><enum>(2)</enum><text>to provide appropriate
			 protections for Good Samaritans under applicable environmental laws;</text>
				</paragraph><paragraph id="IDd6a9f9d1c3d043e48b070ed502dfeb83"><enum>(3)</enum><text>to ensure that
			 remediation performed by Good Samaritans creates actual and significant
			 environmental benefits;</text>
				</paragraph><paragraph id="IDc6e213d8dc774541af1dff9a5b3318e5"><enum>(4)</enum><text>to ensure that
			 remediation by Good Samaritans is carried out—</text>
					<subparagraph id="ID68945350756d47caa8b59a062f489ffb"><enum>(A)</enum><text>with the approval and
			 agreement, and in the discretion, of affected Federal, State, and local
			 authorities and with review by the public; and</text>
					</subparagraph><subparagraph id="ID1de1b754c6464a3a95b361871f280ba1"><enum>(B)</enum><text>in a manner that is
			 beneficial to the environment and all affected communities;</text>
					</subparagraph></paragraph><paragraph id="ID2de18a3be3e04e30b5341cfcae2338d2"><enum>(5)</enum><text>to create an efficient
			 permit process under which the cost and complexity of obtaining a permit are
			 commensurate with the scope of remediation work to be completed and the
			 environmental benefits from the work;</text>
				</paragraph><paragraph id="ID52fe77e274964ab28fe2defdf4012b95"><enum>(6)</enum><text>to avoid permitting for
			 ongoing, for-profit businesses that specialize in multiple Good Samaritan
			 projects that are designed to be permitted outside otherwise applicable
			 Federal, State, and local environmental laws;</text>
				</paragraph><paragraph id="IDab926fdf90654410849243ebb33f0eef"><enum>(7)</enum><text>to ensure that the
			 protections for Good Samaritans provided in this Act are interpreted in
			 accordance with the purposes of this Act and to enhance the public good;
			 and</text>
				</paragraph><paragraph id="ID79813d36cb47446b96f611c34b3af11e"><enum>(8)</enum><text>to further innovation and
			 cooperation among the Federal Government, State governments, private
			 individuals, and corporations to accelerate conservation and environmental
			 restoration.</text>
				</paragraph></subsection></section><section id="id548259a9-50ce-4d99-b374-c1578c03a908"><enum>3.</enum><header>Remediation of inactive
			 or abandoned mines by Good Samaritans</header>
			<subsection id="idd6c1966c-c7ca-4e2a-a782-5ea60908a0de"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="idbce80aca-5999-4174-84de-b31c60d3b31a"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
				</paragraph><paragraph id="id3591446d-5ccc-4af9-b19a-b600cef8fda1"><enum>(2)</enum><header>Cooperating
			 agency</header><text>The term <term>cooperating agency</term> means any
			 Federal, State, tribal, or local agency or other person (other than the
			 Administrator) that—</text>
					<subparagraph id="idc70ec189-5e68-4617-b7d0-2eac0e5395d9"><enum>(A)</enum><text>is authorized under
			 Federal or State law, tribal, or local ordinance, to participate in issuing a
			 permit under this section; and</text>
					</subparagraph><subparagraph id="id1cb97b5e-0591-4193-96d0-a56169eedb68"><enum>(B)</enum><text>elects to participate in
			 the process of issuing the permit.</text>
					</subparagraph></paragraph><paragraph id="id151c8fc8-0824-4114-8e77-e52b4bcf95fb"><enum>(3)</enum><header>Environmental
			 law</header><text>The term <term>environmental law</term> includes—</text>
					<subparagraph id="id065b99a5-f1d5-40cb-afa3-c38cc511492c"><enum>(A)</enum><text>the
			 <act-name parsable-cite="TSCA">Toxic Substances Control Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C.
			 2601</external-xref> et seq.);</text>
					</subparagraph><subparagraph id="idb277752b-e991-47c4-9785-6f0eef65d70c"><enum>(B)</enum><text>the
			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C.
			 1251</external-xref> et seq.);</text>
					</subparagraph><subparagraph id="idb8a85cd2-079f-4ac9-b1d6-5efc8559276f"><enum>(C)</enum><text>the
			 <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C.
			 6901</external-xref> et seq.);</text>
					</subparagraph><subparagraph id="id8509651f-2b72-4f85-bf5f-b0a536d084a9"><enum>(D)</enum><text>the
			 <act-name parsable-cite="CERCL">Comprehensive Environmental Response,
			 Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref> et
			 seq.);</text>
					</subparagraph><subparagraph id="id759d4785-dbc1-458a-a0d9-1bd3a90a264d"><enum>(E)</enum><text>applicable environmental
			 laws of a State or Indian tribe; and</text>
					</subparagraph><subparagraph id="id4b169133-acff-4d96-8705-518c4e333237"><enum>(F)</enum><text>applicable environmental
			 ordinances of a political subdivision of a State or Indian tribe.</text>
					</subparagraph></paragraph><paragraph id="id0f030a97-ccf2-4a6d-bf54-671a145ad0db"><enum>(4)</enum><header>Good
			 Samaritan</header><text>The term <term>Good Samaritan</term> means a person
			 that, with respect to historic mine residue—</text>
					<subparagraph id="id6CDBE6B1A4554503A42CB33AE6020C35"><enum>(A)</enum><text>had no role in the
			 creation of the historic mine residue;</text>
					</subparagraph><subparagraph id="IDe8874b25ab4e40158049886183f915fb"><enum>(B)</enum><text>had no role in creating
			 the environmental pollution caused by the historic mine residue; and</text>
					</subparagraph><subparagraph id="ida5f00940-16c2-48d5-89e2-313ee4bd297c"><enum>(C)</enum><text>is not liable under any
			 Federal, State, tribal, or local law for the remediation of the historic mine
			 residue.</text>
					</subparagraph></paragraph><paragraph id="id0941cc09-9d1f-441b-a2e5-1dd73e09ce59"><enum>(5)</enum><header>Historic mine
			 residue</header>
					<subparagraph id="id5f963196-b9f6-4294-9adc-44fdb7a6a90b"><enum>(A)</enum><header>In
			 general</header><text>The term <term>historic mine residue</term> means mine
			 residue or conditions at an inactive or abandoned mine site that pollute the
			 environment.</text>
					</subparagraph><subparagraph id="idc9a27abb-9a49-4f06-bc0c-79d54e291c90"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>historic mine residue</term> includes, among other materials—</text>
						<clause id="ID41a10b3bdd8140168b2a6c1769bd03cb"><enum>(i)</enum><text>previously mined ores and
			 minerals that directly contribute to acid mine drainage or other
			 pollution;</text>
						</clause><clause id="IDe2764f70effb4fcc8cc689a769ba03c0"><enum>(ii)</enum><text>equipment (or materials
			 in equipment);</text>
						</clause><clause id="ID849d229f9f6043439f15f243bdd6e170"><enum>(iii)</enum><text>wastes or materials
			 from extractions, beneficiation, or other processing; and</text>
						</clause><clause id="IDec3fdb69c2ea4ec5b9a28a6ad96a714d"><enum>(iv)</enum><text>acidic or otherwise
			 polluted flows in surface water or groundwater.</text>
						</clause></subparagraph></paragraph><paragraph id="id50be9248-ade4-419f-8b45-998f54f6a957"><enum>(6)</enum><header>Inactive or abandoned
			 mine site; mine site</header><text>The terms <term>inactive or abandoned mine
			 site</term> and <term>mine site</term> mean the site of a mine and associated
			 facilities that—</text>
					<subparagraph id="id8748b473-ee7d-4cea-843c-a651833c0344"><enum>(A)</enum><text>were used for the
			 production of a mineral other than coal;</text>
					</subparagraph><subparagraph id="id42fe317a-0f4b-4e8f-ac08-58b19512ddab"><enum>(B)</enum><text>have historic mine
			 residue; and</text>
					</subparagraph><subparagraph id="id31b47f29-7c6e-4db9-b8ec-5d20c799286d"><enum>(C)</enum><text>are abandoned or inactive
			 as of the date on which an application is submitted for a permit under this
			 section.</text>
					</subparagraph></paragraph><paragraph id="id51692a26-2ca6-4cf1-bf9d-873ab439fc21"><enum>(7)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the Indian Self-Determination and Education Assistance
			 Act (25 U.S.C. 450b).</text>
				</paragraph><paragraph id="idD17FF671F4DE494FBFD18A82CF5FF28F"><enum>(8)</enum><header>Permitting
			 authority</header><text>The term <term>permitting authority</term>
			 means—</text>
					<subparagraph id="id0BB47D93FA6542DCBAD153D181B26175"><enum>(A)</enum><text>the Administrator;
			 or</text>
					</subparagraph><subparagraph id="id72B913AACEC148B7A5DCD552B6C81A47"><enum>(B)</enum><text>a State or Indian tribe
			 with a Good Samaritan program approved under subsection (d).</text>
					</subparagraph></paragraph><paragraph id="id6b3dc2ca-546d-464d-8073-b1cb15bc3d74"><enum>(9)</enum><header>Person</header><text>The
			 term <term>person</term> includes—</text>
					<subparagraph id="id19f7d27f-23db-4b7a-b938-01edb9854146"><enum>(A)</enum><text>an individual;</text>
					</subparagraph><subparagraph id="id32f2d888-ca3d-45b6-bbe1-47f8ff00296a"><enum>(B)</enum><text>a firm;</text>
					</subparagraph><subparagraph id="id2e3e90fd-ce3b-4aed-9fc7-c11ee4cd3297"><enum>(C)</enum><text>a corporation;</text>
					</subparagraph><subparagraph id="idf197c9c0-5eb1-4f37-8000-b5a0c4b52773"><enum>(D)</enum><text>an association;</text>
					</subparagraph><subparagraph id="id2431e6d3-1ca8-477e-bbcf-ebd42401962e"><enum>(E)</enum><text>a partnership;</text>
					</subparagraph><subparagraph id="id6ce0bfc9-1db5-435d-8de8-72da687dd14b"><enum>(F)</enum><text>a consortium;</text>
					</subparagraph><subparagraph id="id5703c618-742a-49ca-b8b6-e7075f13a111"><enum>(G)</enum><text>a joint venture;</text>
					</subparagraph><subparagraph id="id1909564f-8274-48c4-88f8-1d74ca1a6585"><enum>(H)</enum><text>a commercial
			 entity;</text>
					</subparagraph><subparagraph id="id3340e63e-9e64-434f-9b8f-c29b17c7e589"><enum>(I)</enum><text>a nonprofit
			 organization;</text>
					</subparagraph><subparagraph id="idb9f9946c-52ba-4665-bdc7-7917583527ae"><enum>(J)</enum><text>the Federal
			 Government;</text>
					</subparagraph><subparagraph id="id14f6f839-eeb7-4c4a-8513-7a0ab834c678"><enum>(K)</enum><text>a State;</text>
					</subparagraph><subparagraph id="id5ca919f6-81d2-4c12-b363-744ac6251c02"><enum>(L)</enum><text>a political subdivision
			 of a State;</text>
					</subparagraph><subparagraph id="ideb42b212-eb00-4ea6-a07b-804b6eb9cdca"><enum>(M)</enum><text>an interstate
			 entity;</text>
					</subparagraph><subparagraph id="id26a41c72-8d22-4770-bd13-3c08b8d69ba1"><enum>(N)</enum><text>a commission; and</text>
					</subparagraph><subparagraph id="idFEB0F0B506D042F3BEC0CFB0B7C02F8C"><enum>(O)</enum><text>an Indian tribe.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida6e1df87-d9ca-4ca1-96b3-85cb0f1967e5"><enum>(b)</enum><header>Permits</header><text display-inline="yes-display-inline">The permitting authority may issue a permit
			 to a Good Samaritan to carry out a project to remediate all or part of an
			 inactive or abandoned mine site in accordance with this section.</text>
			</subsection><subsection id="idf5b531db-83f7-4e43-8e33-49c457c03752"><enum>(c)</enum><header>Eligibility for
			 permits</header>
				<paragraph id="id777bd362-bf1b-4cc0-92e8-e8d8f699385a"><enum>(1)</enum><header>In
			 general</header><text>To be eligible for a permit to carry out a project to
			 remediate an inactive or abandoned mine site under this section—</text>
					<subparagraph id="id3431659a-9016-4235-a411-b214872b75f0"><enum>(A)</enum><text>the mine site shall be
			 located in the United States;</text>
					</subparagraph><subparagraph id="idbe4fd7b9-2b0d-4b69-8ee8-a03022984117"><enum>(B)</enum><text>the principal purpose of
			 the project shall be the reduction of pollution caused by historic mine
			 residue;</text>
					</subparagraph><subparagraph id="id4c138c04-7b00-46a3-b823-388fe124cab9"><enum>(C)</enum><text>the mine site may not be
			 a mine site included on the national priorities list under section 105(a)(8)(B)
			 of the Comprehensive Environmental Response, Compensation, and Liability Act of
			 1980 (42 U.S.C. 9605(a)(8)(B));</text>
					</subparagraph><subparagraph id="idd613a6dc-3f06-4232-a66c-936aa7a5f58c"><enum>(D)</enum><text>the permit shall
			 authorize only those activities that are directly required for the remediation
			 of historic mine residue at the mine site;</text>
					</subparagraph><subparagraph id="id23c8dbc8-6d7f-44ff-884b-760f8114913a"><enum>(E)</enum><text>the person obtaining the
			 permit shall be a Good Samaritan; and</text>
					</subparagraph><subparagraph id="ide871cd2f-0f32-47f9-aa14-9ff2190e8cc9"><enum>(F)</enum><text>a State or tribal program
			 described in paragraph (1) or (3) of subsection (d) shall be in effect for
			 remediation of the mine site.</text>
					</subparagraph></paragraph><paragraph id="id56cbd9a1-7e2f-4dba-8499-3ae002ecba30"><enum>(2)</enum><header>Other
			 activities</header><text>Any activity other than the activities described in
			 paragraph (1)(D) conducted by the permittee or any other person at the mine
			 site (including, without limitation, any mining or processing in addition to
			 that required for the remediation of historic mine residue for the public
			 good)—</text>
					<subparagraph id="id47534130-65cf-49fd-a663-b54f883cdd2c"><enum>(A)</enum><text>shall not be authorized
			 under a permit issued under this section; and</text>
					</subparagraph><subparagraph id="id1e3d6729-3112-4ccc-a7da-e4dea94842ac"><enum>(B)</enum><text>may be authorized under
			 other applicable laws, including environmental laws.</text>
					</subparagraph></paragraph></subsection><subsection id="IDa4f752417b324e038c9bb6590206edae"><enum>(d)</enum><header>State or tribal
			 program</header>
				<paragraph id="IDa8ae44dcf65c415d9bb998163758378d"><enum>(1)</enum><header>Program</header>
					<subparagraph id="idEF2D17D55ACD4DF1852E52952128E21A"><enum>(A)</enum><header>In
			 general</header><text>Before a permit may be issued by a State or Indian tribe
			 to carry out a project under this Act, the State or Indian tribe shall have in
			 effect a voluntary Good Samaritan program approved by the Administrator.</text>
					</subparagraph><subparagraph id="idA9DDAD97B4AF4BA9B30F91264D62EBC0"><enum>(B)</enum><header>Application</header>
						<clause id="id57BF73FCF60240EA803A7C4609E19168"><enum>(i)</enum><header>In
			 general</header><text>The Governor of any State, or the head of the governing
			 body of an Indian tribe, may submit to the Administrator, at any time, an
			 application to administer a Good Samaritan program for activities under the
			 jurisdiction of the State or Indian tribe.</text>
						</clause><clause id="id2275D3D5267B40198D8EDA96D9B2954E"><enum>(ii)</enum><header>Requirements</header><text>An
			 application submitted under clause (i) shall include—</text>
							<subclause id="idEFDCFCA83BA54B108239522F209CEA93"><enum>(I)</enum><text>a complete and detailed
			 description of the permit program proposed to be administered under State or
			 tribal law; and</text>
							</subclause><subclause id="idB4701732045B4461BA5A63A12434D204"><enum>(II)</enum><text>a statement from the
			 State attorney general or an equivalent tribal official that the laws of the
			 State or Indian tribe provide adequate authority to carry out the proposed
			 program.</text>
							</subclause></clause><clause id="id99D02142EBAF422CB78F15F051B10669"><enum>(iii)</enum><header>Approval or
			 disapproval</header><text>The Administrator shall approve an application
			 received under clause (i) not later than 120 days after the date of receipt of
			 the application unless the Administrator determines that the applicable State
			 or Indian tribe does not meet the requirements described in paragraph
			 (2).</text>
						</clause></subparagraph></paragraph><paragraph id="IDf109a9b080ae4a4398d287af4c7c73f9"><enum>(2)</enum><header>
			 Requirements</header><text>A State or Indian tribe that seeks to administer a
			 Good Samaritan program shall—</text>
					<subparagraph id="IDfeafbbf5fae84914b0ded87b807b9314"><enum>(A)</enum><text>agree to participate as a
			 permit signatory in the issuance of permits for each project for which a State
			 or tribal permit for remediation in the State or relevant area under the
			 jurisdiction of the Indian tribe is issued under this section;</text>
					</subparagraph><subparagraph id="IDb0dd8e2d66484fb685c7833d2356f9a2"><enum>(B)</enum><text>designate a lead State or
			 tribal agency that is responsible for carrying out permitting responsibilities
			 of the State or Indian tribe under this section;</text>
					</subparagraph><subparagraph id="idA4AD7F8F20C54568BFCF2DC3065BB837"><enum>(C)</enum><text>provide an opportunity
			 for judicial review in State court, or by the tribal body that exercises
			 judicial functions of an Indian tribe, of the final decision by the State or
			 Indian tribe which approves or denies a permit application under this Act in
			 accordance with the standard described in subsection (p);</text>
					</subparagraph><subparagraph id="ID17fc5e48ec68408d95038a1dc471390d"><enum>(D)</enum><text>possess legal authority
			 to implement a Good Samaritan program with program elements consistent with
			 those described in this Act, including State or tribal enforcement
			 authorities;</text>
					</subparagraph><subparagraph id="idCEEE669F16B147F6943FAE13F7D772B8"><enum>(E)</enum><text>agree to carry out the
			 program in accordance with this Act (except that a State or Indian tribe shall
			 not be precluded from omitting or modifying any program element for the purpose
			 of imposing requirements that are more protective of the environment);
			 and</text>
					</subparagraph><subparagraph id="id35259577B9E74EAD97A6577E65459461"><enum>(F)</enum><text>provide for and encourage
			 public participation in the permitting process.</text>
					</subparagraph></paragraph><paragraph id="IDffe32f972c6f445c9bcc41ffb6797599"><enum>(3)</enum><header>States and Indian
			 tribes without Good Samaritan programs</header><text>In the case of a State or
			 Indian tribe without a Good Samaritan program approved under subsection (d),
			 the Administrator shall issue permits for Good Samaritan projects if the State
			 or Indian tribe—</text>
					<subparagraph id="IDfb25f0e9a4a741b9ab4a47f115b515b0"><enum>(A)</enum><text>agrees to participate as
			 a permit signatory in the issuance of permits for each project for which a
			 permit for remediation in the State or on that tribal land is issued under this
			 section;</text>
					</subparagraph><subparagraph id="ID7a049f726bbe4c9e9231af78ce6936e1"><enum>(B)</enum><text>agrees that a permittee
			 shall comply with the terms and conditions of the permit in lieu of compliance
			 with applicable environmental laws specifically described in the permit in
			 accordance with subsection (h)(1)(B);</text>
					</subparagraph><subparagraph id="ID0b379ca6f38c498eb30828aaaf52fe27"><enum>(C)</enum><text>authorizes State or
			 tribal agencies and political subdivisions of the State or Indian tribe to
			 participate in the permit process under this section, as appropriate, and
			 assist in providing the resources to enable that participation; and</text>
					</subparagraph><subparagraph id="ID1a69070a327d43b68945ea6641d6f5c1"><enum>(D)</enum><text>designates a lead State
			 or tribal agency that is responsible to carry out permitting responsibilities
			 of the State or Indian tribe under this section.</text>
					</subparagraph></paragraph></subsection><subsection id="idf3c3e38b-ac3d-4001-8fc1-8e19d2c69797"><enum>(e)</enum><header>Application for
			 permits</header><text>To obtain a permit to carry out a project to remediate an
			 inactive or abandoned mine site under this section, an applicant shall submit
			 to the permitting authority an application, signed by the applicant, that
			 provides—</text>
				<paragraph id="id47fe8131-a023-45eb-b7f2-d7fcd7ca6fbc"><enum>(1)</enum><text>a description of the mine
			 site (including the boundaries of the mine site);</text>
				</paragraph><paragraph id="id129dddab-d27c-4eaf-a77a-09476b9ddefa"><enum>(2)</enum><text>an identification
			 of—</text>
					<subparagraph id="id6296318e-bfa0-4fd4-ab8b-39d091b2b8c4"><enum>(A)</enum><text>any current owner or
			 operator of the mine site; and</text>
					</subparagraph><subparagraph id="idc3eec7b6-bc4d-4de0-b0c6-8a51b16275fb"><enum>(B)</enum><text>any person with a legal
			 right to exclude other persons from the mine site or affect activities on the
			 mine site, with a description of those legal rights;</text>
					</subparagraph></paragraph><paragraph id="id75bfb7fc-6c86-42f0-8821-a9c7b974d22b"><enum>(3)</enum><text>evidence satisfactory to
			 the permitting authority that the applicant has or will acquire all legal
			 rights necessary to enter the mine site and to perform the remediation
			 described in the application;</text>
				</paragraph><paragraph id="id0c41efe9-ac00-432f-8d0b-3da217d28bfc"><enum>(4)</enum><text>a description, based on
			 the conduct of an inquiry that is reasonable under the circumstances,
			 of—</text>
					<subparagraph commented="no" id="IDb3a14827a3ac468f9b6d6ac59c76bd32"><enum>(A)</enum><text>prior owners and
			 operators of the site (including the current location or business operations of
			 those owners and operators);</text>
					</subparagraph><subparagraph commented="no" id="id87F57130824A44AC80250A22B0D31304"><enum>(B)</enum><text>the mining activities
			 that occurred at the site; and</text>
					</subparagraph><subparagraph id="ideb8839e7-4c36-4c85-84e1-57b11bc26c28"><enum>(C)</enum><text>any relationship between
			 those persons and the applicant;</text>
					</subparagraph></paragraph><paragraph id="id28718d6f-20fd-492c-88e5-88dba109124a"><enum>(5)</enum><text>a certification that the
			 applicant knows of no other person that (as of the date of submission of the
			 application)—</text>
					<subparagraph id="idd26b12b7-0dcd-4dc3-86f0-713b0e819b64"><enum>(A)</enum><text>is responsible for the
			 remediation of the mine site; and</text>
					</subparagraph><subparagraph id="id94bd379b-c783-433e-9ff7-3736329d1c65"><enum>(B)</enum><text>has sufficient resources
			 to complete the remediation;</text>
					</subparagraph></paragraph><paragraph id="iddd122f34-a6e1-47dc-bd68-79646e5e994a"><enum>(6)</enum><text>a detailed description of
			 the historic mine residue to be remediated;</text>
				</paragraph><paragraph id="idc7f6f8e8-414a-4978-b483-25500ae72167"><enum>(7)</enum><text>a description of the
			 baseline conditions (as of the date of submission of the application) of the
			 environment affected by the historic mine residue to be remediated;</text>
				</paragraph><paragraph id="id2995b380-8d3a-4620-aba6-ba9814d56524"><enum>(8)</enum><text>a description of—</text>
					<subparagraph id="id145c66cd-81de-4c98-adde-eca81a7dc983"><enum>(A)</enum><text>the nature and scope of
			 the proposed remediation; and</text>
					</subparagraph><subparagraph id="id6f2eede5-bc6a-40d4-b698-5cbc295d2a10"><enum>(B)</enum><text>detailed engineering
			 plans for the project;</text>
					</subparagraph></paragraph><paragraph id="id4c0211d6-797a-4f07-a393-becc2f0b5cf5"><enum>(9)</enum><text>a description of the
			 manner in which the remediation will assist the mine site in meeting, to the
			 maximum extent reasonable and practicable under the circumstances, water
			 quality standards;</text>
				</paragraph><paragraph id="idB98751B223ED4A06851B0163B30F4501"><enum>(10)</enum><text>an identification, based
			 on an inquiry that is reasonable under the circumstances, of any significant
			 adverse effects on the environment that could reasonably be likely to occur if
			 the permittee fails to properly implement the proposed remediation in
			 accordance with the engineering plans;</text>
				</paragraph><paragraph id="id9ff7f962-e0ea-4359-9474-60cc786edc21"><enum><added-phrase committee-id="SSEV00" reported-display-style="italic">(11)</added-phrase></enum><text>a schedule for
			 the work to be carried out under the project;</text>
				</paragraph><paragraph id="id3a9f39d5-a61f-4479-a7a3-794deadc4357"><enum><added-phrase committee-id="SSEV00" reported-display-style="italic">(12)</added-phrase></enum><text>a budget for
			 the work to be carried out under the project;</text>
				</paragraph><paragraph id="id1856e511-32ac-419f-9dbe-c921a7f9f4c4"><enum><added-phrase committee-id="SSEV00" reported-display-style="italic">(13)</added-phrase></enum><text>a description
			 of financial assurances, if any, to be provided by the permittee to ensure that
			 the permitted work, including any operation and maintenance, will be
			 completed;</text>
				</paragraph><paragraph id="id3b182ca2-3c66-49a2-be6f-6c099ece8a2d"><enum><added-phrase committee-id="SSEV00" reported-display-style="italic">(14)</added-phrase></enum><text>a description
			 of a monitoring program following remediation (if any) that will be implemented
			 to evaluate the effects of the remediation on the environment;</text>
				</paragraph><paragraph id="id9e0016b6-c087-43d2-a9c9-ca110464d46e"><enum><added-phrase committee-id="SSEV00" reported-display-style="italic">(15)</added-phrase></enum><text>a detailed plan
			 for the required operation and maintenance of any remediation; and</text>
				</paragraph><paragraph id="id10e66dfc-3b33-453a-94c2-aedff600a68a"><enum><added-phrase committee-id="SSEV00" reported-display-style="italic">(16)</added-phrase></enum><text>a list of all
			 environmental laws for which the applicant seeks the protection described in
			 paragraphs (1) and (2) of subsection (g).</text>
				</paragraph></subsection><subsection id="id5ebb1611-30d2-4b92-b83e-71d1a134e2a2"><enum>(f)</enum><header>Permit
			 issuance</header>
				<paragraph id="idbc18957d-6b00-4d11-9e5f-37faf3c3ee46"><enum>(1)</enum><header>In
			 general</header><text>The permitting authority may issue a permit under this
			 section to carry out a project for the remediation of an inactive or abandoned
			 mine site only if—</text>
					<subparagraph id="id34350a44-3c08-437f-b4c8-a7cb18c9b85e"><enum>(A)</enum><text>the permitting authority
			 determines that—</text>
						<clause id="id39fd4f00-e253-4efd-9cd7-525ac9d9e260"><enum>(i)</enum><text>the project will improve
			 the environment on or in the area of the mine site to a significant degree, as
			 determined by the permitting authority;</text>
						</clause><clause id="idd7057616-c493-4cfc-b541-12bcdd092e4a"><enum>(ii)</enum><text>the project will meet
			 applicable water quality standards, to the maximum extent reasonable and
			 practicable under the circumstances;</text>
						</clause><clause id="id5a3b8054-b2bb-481d-a54e-dcec8f228e4f"><enum>(iii)</enum><text>the permittee has the
			 financial and other resources to complete, and will complete, the permitted
			 work;</text>
						</clause><clause id="idF8522779CA404AC48B6032F2D2ACF61B"><enum>(iv)</enum><text>the permittee has the
			 financial and other resources to address any contingencies identified in the
			 permit application pursuant to subsection (e)(10) (except that the permitting
			 authority may waive the requirements of this clause with respect to a project
			 that has a budget of less than $300,000);</text>
						</clause><clause id="idC97BDDA397174761A31DA9C1D7EC1F31"><enum>(v)</enum><text>the project meets the
			 requirements of this section;</text>
						</clause></subparagraph><subparagraph id="id5e8ea33a-f17a-43ac-a8c7-86abacdda2c9"><enum>(B)</enum><text>with respect to a State
			 or Indian tribe without a Good Samaritan program approved under subsection (d),
			 the State or Indian tribe concurs with the issuance of, and signs, the
			 permit;</text>
					</subparagraph><subparagraph id="idd5b6df7c-8072-4ab7-98b5-d6555feb8984"><enum>(C)</enum><text>if the permit provides
			 protection for the permittee under an environmental law of a political
			 subdivision of a State or Indian tribe in accordance with paragraphs (1) and
			 (2) of subsection (g), the political subdivision concurs with the issuance of,
			 and signs, the permit; and</text>
					</subparagraph><subparagraph id="id5ddc6783-3b74-4e89-a8ba-373e72d28689"><enum>(D)</enum><text>if the proposed project
			 is to be carried out on Federal land, each State or Indian tribe (or political
			 subdivision of the State or Indian tribe) within which the Federal land is
			 located meets the requirements of subparagraphs (B) and (C).</text>
					</subparagraph></paragraph><paragraph id="id2b540557-2df5-401f-98e0-2869f2f5c2f2"><enum>(2)</enum><header>Discretionary
			 actions</header><text>The issuance of a permit by the permitting authority, and
			 the concurrence of the affected State or Indian tribe (and political
			 subdivisions of the State or Indian tribe) to participate in the permit
			 process, shall be discretionary actions and shall be taken in the public
			 interest.</text>
				</paragraph><paragraph id="id9cbb792a-662b-4863-a0d2-6019f0bd4393"><enum>(3)</enum><header>Compliance with
			 NEPA</header><text>No action of a permitting authority or any other person
			 under this section shall be required to comply with section 102 of the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4332).</text>
				</paragraph><paragraph id="idaf879cb1-b126-45f0-9230-bdc900b69b1b"><enum>(4)</enum><header>Deadline</header>
					<subparagraph id="id9dad789d-7694-46f2-b3e3-55532230c5a9"><enum>(A)</enum><header>In
			 general</header><text>The permitting authority shall issue or deny a permit for
			 the remediation of a mine site not later than—</text>
						<clause id="ida13243ee-22cf-42d2-9871-e1ce8c59f1ce"><enum>(i)</enum><text>the date that is 180 days
			 after the date of receipt by the permitting authority of an application for the
			 permit that, as determined by the permitting authority, is complete; or</text>
						</clause><clause id="idea3da5d2-5726-4699-8f5f-a559cbc52e02"><enum>(ii)</enum><text>such later date as may
			 be determined by the permitting authority with the agreement of the
			 applicant.</text>
						</clause></subparagraph><subparagraph id="id3c2f6e58-7b7d-40f1-9946-e9add575ee63"><enum>(B)</enum><header>Constructive
			 denial</header><text>If the permitting authority fails to issue or deny the
			 permit in accordance with subparagraph (A), the application shall be considered
			 to be denied by the permitting authority.</text>
					</subparagraph></paragraph><paragraph id="idde36ed42-2c7a-4c22-969f-2dff1425e4fb"><enum>(5)</enum><header>Review for certain
			 projects</header><text>A project that, as determined by the permitting
			 authority, would be less complex, or pose less risk, than other projects under
			 review by the permitting authority for a permit under this section, may be
			 reviewed, at the discretion of the permitting authority, under a more simple
			 and rapid review process (including the conduct of a public hearing upon
			 request by an interested person) under this subsection.</text>
				</paragraph></subsection><subsection id="id896c40ca-8de4-4c96-b2ba-7b9287ab1279"><enum>(g)</enum><header>Effect of
			 permits</header>
				<paragraph id="id03bb43d0-b16f-4e86-9c67-e1b66d055788"><enum>(1)</enum><header>In
			 general</header><text>A permit issued under this section to carry out a project
			 for the remediation of an inactive or abandoned mine site—</text>
					<subparagraph id="id88190fa3-1615-44a2-919d-b808f78b8d80"><enum>(A)</enum><text>authorizes the permittee
			 to carry out the activities described in the permit;</text>
					</subparagraph><subparagraph id="id74b379a6-8468-4a8b-a11d-f606907f4a8d"><enum>(B)</enum><text>authorizes enforcement
			 under this section; and</text>
					</subparagraph><subparagraph id="idd02c3bab-a348-4946-b4c4-4dd8ebcaeff0"><enum>(C)</enum><text>provides to the
			 permittee, in carrying out the activities authorized under the permit,
			 protection from actions taken, obligations, and liabilities arising under the
			 environmental laws specified in the permit.</text>
					</subparagraph></paragraph><paragraph id="ide7dd220a-4df2-4aee-91b1-b69e7284736d"><enum>(2)</enum><header>Cross-compliance</header><text>A
			 permittee shall comply with the terms and conditions of a permit issued under
			 this section in lieu of compliance with the environmental laws specified in the
			 permit with respect to the work authorized under the permit.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6CE15E5E8476476D8BFF996E94EBCFF0"><enum>(3)</enum><header>Off-site
			 disposal</header><text>A permit issued pursuant to this Act shall not relieve
			 the permittee of the obligation to comply with any applicable provision of the
			 <act-name parsable-cite="TSCA">Toxic Substances Control Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C.
			 2601</external-xref> et seq.) or the <act-name parsable-cite="SWDA">Solid Waste
			 Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901</external-xref> et seq.) relating to
			 the off-site disposal of any waste or material removed from the applicable
			 inactive or abandoned mine site.</text>
				</paragraph></subsection><subsection id="id75254e00-022b-4d32-992e-fcef3120c0bf"><enum>(h)</enum><header>Content of
			 permits</header>
				<paragraph id="idb44808e7-f31a-416d-be76-d7ba7d0657ff"><enum>(1)</enum><header>In
			 general</header><text>A permit issued under this section shall contain—</text>
					<subparagraph id="idabc4938d-0bac-4bbf-b0ec-bea59fdc735f"><enum>(A)</enum><text>a detailed description of
			 the engineering and other work that is authorized under the permit;</text>
					</subparagraph><subparagraph id="id6033723c-5857-4889-a23a-b0c31b54952c"><enum>(B)</enum><text>a specific list of
			 environmental laws, or selected provisions of environmental laws, with respect
			 to which compliance with the permit will operate in lieu of compliance with the
			 laws;</text>
					</subparagraph><subparagraph id="id9168b715-4be5-4004-9d78-f30da4af2c50"><enum>(C)</enum><text>a provision that states
			 that the permittee is responsible for securing, for all activities authorized
			 under the permit, all authorizations, licenses, and permits that are required
			 under applicable law, other than the environmental laws described in subsection
			 (g)(2); and</text>
					</subparagraph><subparagraph id="id91fa359f-a73f-4fb8-a194-3f26936f2774"><enum>(D)</enum><text>any other terms and
			 conditions that are determined to be appropriate by the permitting
			 authority.</text>
					</subparagraph></paragraph><paragraph id="id9043FA54AA4143228AD5A480C1B353E4"><enum>(2)</enum><header>Force
			 majeure</header><text>A permit issued under this section may include, at the
			 request of the Good Samaritan, a force majeure provision.</text>
				</paragraph><paragraph id="id7ce14d24-50a4-40fa-9963-36993c2e7cde"><enum>(3)</enum><header>Investigative
			 sampling</header>
					<subparagraph id="idbbd6a14c-abe1-4529-8766-4c8e9ea6bee0"><enum>(A)</enum><header>In
			 general</header><text>A permit may identify an appropriate program of
			 investigative sampling to be completed prior to remediation, as determined by
			 the permitting authority upon application.</text>
					</subparagraph><subparagraph id="idc4b39957-f145-47a1-aa39-aecc7f148666"><enum>(B)</enum><header>Option to decline
			 remediation</header><text>In the event that investigative sampling is
			 authorized, the permit may allow the permittee to decline to undertake
			 remediation based upon sampling results.</text>
					</subparagraph><subparagraph id="id8ddd84ff-e115-4239-b340-0b97731e0f67"><enum>(C)</enum><header>Permit
			 modification</header><text>Based upon sampling results, a permittee may apply
			 for a permit modification using the permit procedures in this Act.</text>
					</subparagraph></paragraph><paragraph id="idbdc5d90b-7c0e-4c07-8319-8a5e54eed30e"><enum>(4)</enum><header>Timing</header><text>Work
			 authorized under a permit—</text>
					<subparagraph id="idcd570053-c07e-4584-91d8-4ccfd3905254"><enum>(A)</enum><text>shall commence not later
			 than the date that is 18 months after the date of issuance of the permit;
			 and</text>
					</subparagraph><subparagraph id="id1df41a83-6533-4b17-be02-d0f58e6d5989"><enum>(B)</enum><text>shall continue until
			 completed, with temporary suspensions permitted during adverse weather or other
			 conditions specified in the permit.</text>
					</subparagraph></paragraph><paragraph id="ida62bd32d-fb9a-4d14-bd31-06564a200087"><enum>(5)</enum><header>Signature by
			 permittee</header><text>The signature of the permittee on the permit shall be
			 considered to be an acknowledgment by the permittee that the permittee accepts
			 the terms and conditions of the permit.</text>
				</paragraph><paragraph id="idfd1e9124-6812-48d2-97f8-3ecf6c86fbc2"><enum>(6)</enum><header>Transfer of
			 permits</header><text>A permit may be transferred to another person only
			 if—</text>
					<subparagraph id="id36502ff4-ee10-41bc-abf2-52190c0d10d7"><enum>(A)</enum><text>the permitting authority
			 determines that the transferee qualifies as a Good Samaritan;</text>
					</subparagraph><subparagraph id="id8eef0d09-066c-4031-901e-7e0c07fc44fe"><enum>(B)</enum><text>the transferee signs, and
			 agrees to be bound by the terms of, the permit; and</text>
					</subparagraph><subparagraph id="id6e84b832-88c6-4ace-85bc-df3a9c70b669"><enum>(C)</enum><text>the permitting authority
			 includes in the transferred permit any additional conditions necessary to meet
			 the goals of this section.</text>
					</subparagraph></paragraph><paragraph id="id943a1b42-5810-49e7-89c4-291e13962be2"><enum>(7)</enum><header>Termination of
			 permit</header><text>The authority to carry out work under a permit issued
			 under this section shall terminate if the work does not commence by the date
			 that is 18 months after the date of issuance of the permit.</text>
				</paragraph></subsection><subsection id="id88fa6376-b202-4d68-a85f-11ffd16bc198"><enum>(i)</enum><header>Role of permitting
			 authority</header><text>In carrying out this section, the permitting authority
			 shall—</text>
				<paragraph id="id881f6cd0-83b5-48de-af0c-0093f2a79d64"><enum>(1)</enum><text>consult with prospective
			 applicants;</text>
				</paragraph><paragraph id="id4e0ab97d-d864-45d5-9bb9-ee4c58839b77"><enum>(2)</enum><text>accept permit
			 applications under this section;</text>
				</paragraph><paragraph id="id4fb3bd34-7bd1-4462-accd-e9affb1ea849"><enum>(3)</enum><text>convene, coordinate, and
			 lead the application review process;</text>
				</paragraph><paragraph id="id136168f4-05c8-4fcd-aef0-df1a56668a17"><enum>(4)</enum><text>maintain all records
			 relating to the permit and the permit process;</text>
				</paragraph><paragraph id="id5709d342-3e2d-43e1-b51b-254c42cc43ee"><enum>(5)</enum><text>provide an opportunity
			 for cooperating agencies and the public to participate in the permit
			 process;</text>
				</paragraph><paragraph id="iddd500d3c-fd80-42c1-9abe-965e50dd1923"><enum>(6)</enum><text>issue the permit under
			 this section, if appropriate; and</text>
				</paragraph><paragraph id="id9e98500e-dfc4-4e65-bf69-de01aec8cc53"><enum>(7)</enum><text>enforce and otherwise
			 carry out this section.</text>
				</paragraph></subsection><subsection id="id2abf237e-fe66-4a23-b357-3179212fc3b8"><enum>(j)</enum><header>Cooperating
			 agencies</header><text>If the permitting authority learns that an application
			 for the remediation of a mine site under this section will be submitted to the
			 permitting authority, the permitting authority shall (as soon as practicable)
			 provide a notice of the application to—</text>
				<paragraph id="id25dcd38d-01f2-4542-b70f-28991a2942c7"><enum>(1)</enum><text>the lead State or tribal
			 agency designated under subsection (d)(2)(B);</text>
				</paragraph><paragraph id="id32fe2a94-1db4-4aaa-a799-57009c87362a"><enum>(2)</enum><text>each local government
			 located within a radius of 75 miles of the mine site; and</text>
				</paragraph><paragraph id="idd2228b22-39cf-46bf-8572-899c34b9f5ea"><enum>(3)</enum><text>each Federal, State, and
			 tribal agency that may have an interest in the application.</text>
				</paragraph></subsection><subsection id="ID647d470f005b4558b926918714fc28c9"><enum>(k)</enum><header>State, local and tribal
			 communities</header>
				<paragraph id="idD89240E697B54DE3A88B3A8ABF3C04F2"><enum>(1)</enum><header>In
			 general</header><text>If the permitting authority receives an application for
			 the remediation of a mine site under this section, the permitting authority
			 shall, as soon as practicable, provide notice of the application to—</text>
					<subparagraph id="IDdfdb22dece5346fc8ed520b4c39bec17"><enum>(A)</enum><text>any lead State or tribal
			 agency designated under subsection (d)(2)(B), if the Administrator is the
			 permitting authority;</text>
					</subparagraph><subparagraph id="IDa6f6a1f74a8d4d978ce1021c69052c3e"><enum>(B)</enum><text>each local government
			 located within a radius of 75 miles of the project site; and</text>
					</subparagraph><subparagraph id="ID2f35bd6bfa64496488999dc22b16d354"><enum>(C)</enum><text>each Federal, State, and
			 tribal agency that the permitting authority determines may have an interest in
			 the application.</text>
					</subparagraph></paragraph><paragraph id="id5ED5B23CA9F84DA185E87D4AC57C32D7"><enum>(2)</enum><header>Copy of
			 application</header><text>The notice shall include a copy of the
			 application.</text>
				</paragraph></subsection><subsection id="IDe52f6ba6a11a46caa22ccf1503b03834"><enum>(l)</enum><header>Public notice of
			 receipt of applications</header>
				<paragraph id="IDdc9f195757ae4cbc9562b1103bcc9627"><enum>(1)</enum><header>In
			 general</header><text>On receipt of a complete application for the remediation
			 of an inactive or abandoned mine site under this Act, the permitting authority
			 shall, not later than 30 days after receipt of the application, provide to the
			 public a notice that—</text>
					<subparagraph id="idFD90F6B682E14270959E8DE74C5D7BB2"><enum>(A)</enum><text>describes—</text>
						<clause id="ID1acdb21b86264e92af3742a1634346d9"><enum>(i)</enum><text>the location of the mine
			 site;</text>
						</clause><clause id="ID8207605f3c7e445e98270a4143995bfd"><enum>(ii)</enum><text>the scope and nature of
			 the proposed remediation; and</text>
						</clause><clause id="IDaf7f9a5ec7004bceb67d56d835b3e8c7"><enum>(iii)</enum><text>the name of the Good
			 Samaritan applying for a permit to carry out the proposed remediation;
			 and</text>
						</clause></subparagraph><subparagraph id="id78308215EDF7424E8C9E8FB132785CD7"><enum>(B)</enum><text>provides to the public a
			 means of viewing or obtaining the application.</text>
					</subparagraph></paragraph><paragraph id="ID2ab7d60527a84b239eae7bb2ce115c06"><enum>(2)</enum><header>Hearing</header>
					<subparagraph id="ID1a6c4d68e22b459b9544d7600152f6c6"><enum>(A)</enum><header>In
			 general</header><text>Before the date of permit issuance, the permitting
			 authority shall hold a public hearing in the vicinity of the mine site to be
			 remediated.</text>
					</subparagraph><subparagraph id="id5FD9B590116442E0A6455C071D8FD259"><enum>(B)</enum><header>Notice</header><text>Not
			 later than 30 days before the date of the hearing, the permitting authority
			 shall provide the public with notice of the hearing and a draft permit.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd93bf4e57d67430e80eacb0e45ab1584"><enum>(C)</enum><header>Comments</header><text>The
			 permitting authority shall provide the applicant and the public with the
			 opportunity—</text>
						<clause commented="no" display-inline="no-display-inline" id="id177C466563E343019D98276ABD4E4C47"><enum>(i)</enum><text>to comment on the draft
			 permit at the public hearing; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idC9A25090A68B4DFA9A38A70CEC85BA95"><enum>(ii)</enum><text>to submit written
			 comments to the permitting authority during the 30–day period following the
			 date of the hearing.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idf89d1b67-911f-4a65-ba55-0761586a82a5"><enum>(m)</enum><header>Monitoring</header>
				<paragraph id="id2fd4d5cd-a33e-4c71-8a23-2a07e43fd79f"><enum>(1)</enum><header>In
			 general</header><text>The permittee shall take such actions as the permitting
			 authority determines are necessary to ensure appropriate baseline monitoring,
			 monitoring during the remediation project, and post-remediation monitoring of
			 the environment under paragraphs (7) and (13) of subsection (e).</text>
				</paragraph><paragraph id="idaae5a7cc-a5a8-4859-b009-264a2e2ab456"><enum>(2)</enum><header>Administration</header><text>When
			 selecting the type and frequency of the monitoring requirements to be included
			 in a permit, if any, the permitting authority shall—</text>
					<subparagraph id="id85a8ed4f-5084-4b98-b914-8790acdf1ae8"><enum>(A)</enum><text>balance the need for
			 monitored information against the cost of the monitoring, based on the
			 circumstances relating to the remediation; and</text>
					</subparagraph><subparagraph id="idb07a96f4-306f-4891-8891-d38322b0cd64"><enum>(B)</enum><text>take into account the
			 scope of the project.</text>
					</subparagraph></paragraph><paragraph id="id83b876b3-7995-4233-8bec-7e35953f816a"><enum>(3)</enum><header>Multiparty
			 monitoring</header><text>The permitting authority may approve in a permit the
			 conduct of monitoring by multiple parties if, as determined by the permitting
			 authority, the multiparty monitoring will effectively accomplish the goals of
			 this section.</text>
				</paragraph></subsection><subsection id="idf204706e-606f-44eb-a00e-96fa281f60e6"><enum>(n)</enum><header>Enforcement</header>
				<paragraph id="idc3237c5e-7af0-44a7-a7a5-6da62695be8c"><enum>(1)</enum><header>Civil
			 penalty</header><text>Any person who violates a permit issued under this
			 section shall be subject to a civil penalty of up to $10,000 for each day of
			 the violation.</text>
				</paragraph><paragraph id="id8e72240b-705d-48db-9f79-d89841928afc"><enum>(2)</enum><header>Injunctions</header>
					<subparagraph id="id44c28348-0e79-40f3-afda-43c62a9aab31"><enum>(A)</enum><header>In
			 general</header><text>A court may issue an injunction—</text>
						<clause id="idf1bc3301-2122-498f-91c1-3bfa18e8c2c5"><enum>(i)</enum><text>mandating that a person
			 comply with a permit or take action to abate a permit violation;</text>
						</clause><clause id="ida102b605-5788-444c-b47c-f4523a321b05"><enum>(ii)</enum><text>prohibiting a person
			 from violating a permit; or</text>
						</clause><clause id="IDecd69a81703047e1adc7d332dee78dea"><enum>(iii)</enum><text>prohibiting additional
			 activities under a permit (except activities carried out pursuant to
			 subparagraph (B)).</text>
						</clause></subparagraph><subparagraph id="id55b552c9-5cec-486d-bb56-e4c3ea4eb4b0"><enum>(B)</enum><header>Minimum
			 requirement</header><text>In the event of a permit violation, and absent
			 extraordinary circumstances, the court shall, at a minimum, require—</text>
						<clause id="ida8c230ca-7d1e-4615-a271-c68bb8ad9815"><enum>(i)</enum><text>the permittee to repair
			 the damage to any part of the environment that is caused by an action of the
			 permittee in violation of the permit; and</text>
						</clause><clause id="idfe624b79-91f6-4e6f-bf1b-fcd62aea10f5"><enum>(ii)</enum><text>the environment to be
			 restored to the condition of the environment prior to the action of the
			 permittee in violation of the permit.</text>
						</clause></subparagraph></paragraph><paragraph id="ideefb796a-c636-442d-903f-4ae382f04b27"><enum>(3)</enum><header>Agencies</header><text>Any
			 permitting authority that signs a permit issued under this section may enforce
			 the permit through appropriate administrative or judicial proceedings.</text>
				</paragraph></subsection><subsection commented="no" id="ID01e5f1c7ef4f4ab7825df156fabd31ee"><enum>(o)</enum><header>Grant
			 eligibility</header><text>A remediation project conducted pursuant to this
			 section shall be eligible for funding pursuant to section 319 of the Federal
			 Water Pollution Control Act (33 U.S.C. 1329).</text>
			</subsection><subsection id="id0fed9c6f-c07a-4d31-a96a-86ac9fdba3bb"><enum>(p)</enum><header>Judicial
			 review</header><text>A court may set aside or modify an action of the
			 Administrator in issuing a permit under this section, or an action of a State
			 or political subdivision in signing a permit, only on clear and convincing
			 evidence of an abuse of discretion.</text>
			</subsection><subsection commented="no" id="ID12139a287a3c4aa6a158ff62e6e7bfe2"><enum>(q)</enum><header>Transfer of permitting
			 authority</header>
				<paragraph commented="no" id="idCF8A51D003774B83AAA98116B8CA459F"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), not later than 120 days after
			 the date on which a State or Indian tribe has submitted an application to
			 administer a Good Samaritan program, the Administrator shall suspend the
			 issuance of permits under this Act for remediation activities in that State or
			 relevant area under the jurisdiction of an Indian tribe unless the
			 Administrator determines that the Good Samaritan program of the State or Indian
			 tribe does not satisfy the requirements of this Act.</text>
				</paragraph><paragraph commented="no" id="id02FF6ADDE8C24FA4A1FFBD0855B477C1"><enum>(2)</enum><header>Extension</header><text>The
			 period before which the Administrator will suspend permitting activity under
			 this subsection may be extended by mutual agreement of the Administrator and
			 the applicable State or Indian tribe.</text>
				</paragraph></subsection><subsection commented="no" id="ID59396395a3c74bcd86a4c73dd92fc944"><enum>(r)</enum><header>Notification of
			 administrator</header>
				<paragraph commented="no" id="ID12cfa21399484a33b1bc9b494e086ca8"><enum>(1)</enum><header>In
			 general</header><text>Each State or Indian tribe authorized to administer a
			 Good Samaritan program shall—</text>
					<subparagraph commented="no" id="id82EE53F734F44DC1A936F90B4C04299A"><enum>(A)</enum><text>submit to the
			 Administrator a copy of each permit application received by the State or Indian
			 tribe; and</text>
					</subparagraph><subparagraph commented="no" id="id78CBD2992E374E3184BBDAF66228B6A7"><enum>(B)</enum><text>provide notice to the
			 Administrator of each permit proposed to be issued by the State or Indian tribe
			 (including any proposed permit modifications, transfers, or
			 terminations).</text>
					</subparagraph></paragraph><paragraph commented="no" id="ID0d90e5e17c104d19bbc02e88e58a3b35"><enum>(2)</enum><header>Objection to
			 issuance</header>
					<subparagraph commented="no" id="id39BE724FAC6A416695F1335A68408E2B"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (C), no permit shall
			 be issued by a State or Indian tribe referred to in paragraph (1) if the
			 Administrator, by not later than the date that is 90 days after the date of
			 submission of the proposed permit notification, objects in writing to the
			 issuance of the permit on the basis that the permit would not be in accordance
			 with this Act.</text>
					</subparagraph><subparagraph commented="no" id="id1BF74C64D77F4E18A655CEA8FCE35D3F"><enum>(B)</enum><header>Statement of reasons
			 for objection</header><text>An objection by the Administrator described in
			 subparagraph (A) shall include a statement of the reasons for the
			 objection.</text>
					</subparagraph><subparagraph commented="no" id="ID97c2153bd01c4d07af6371d64e24a7d9"><enum>(C)</enum><header>Waiver</header><text>The
			 Administrator may, with respect to any permit application, waive the
			 applicability of subparagraph (A).</text>
					</subparagraph></paragraph><paragraph commented="no" id="ID5164412902eb4b4cbc3f89d45c605642"><enum>(3)</enum><header>Issuance or denial of
			 permits</header>
					<subparagraph commented="no" id="id150FAFD2489C4C92B006FFC2B2600CD3"><enum>(A)</enum><header>In
			 general</header><text>In any case in which the Administrator objects to the
			 issuance of a permit under paragraph (2), the Administrator, on the request of
			 the applicable State or Indian tribe, shall hold a public hearing on the
			 objection.</text>
					</subparagraph><subparagraph commented="no" id="id7B9986A912CC46BB93AF61162AD8BB08"><enum>(B)</enum><header>Failure to request
			 hearing or resubmit application</header><text>If a State or Indian tribe does
			 not resubmit a permit revised to meet the objections of the Administrator by
			 the date that is 30 days after the date of completion of a public hearing under
			 subparagraph (A) or, if such a public hearing is not requested before the date
			 that is 90 days after the date of issuance of an objection of the Administrator
			 to issuance of the permit, the Administrator may issue or deny the permit in
			 accordance with this Act.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="ID690fade9457c45709d97b5876d7a106e"><enum>(s)</enum><header>Withdrawal of approval
			 of State or tribal program and return of State or tribal program to
			 administrator</header>
				<paragraph commented="no" id="IDf9c587bbc2244109ab6c9e2a98f5b947"><enum>(1)</enum><header>In
			 general</header><text>Each State or tribal Good Samaritan program approved
			 under this Act shall be administered in accordance with this Act.</text>
				</paragraph><paragraph commented="no" id="ID04fc871df6854179be30cbbad2f56984"><enum>(2)</enum><header>Notification and
			 withdrawal</header>
					<subparagraph commented="no" id="id72BC6E327E4F480F9FC5EEFF28D31549"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), if the Administrator
			 determines, after a public hearing, that a State or Indian tribe is not
			 administering a program approved under this Act in accordance with this Act,
			 the Administrator shall—</text>
						<clause commented="no" id="id2559E7A323694F79A4498F3BAFA4CDEA"><enum>(i)</enum><text>notify the State or
			 Indian tribe of the determination; and</text>
						</clause><clause commented="no" id="id9DB97E1D0CC3422B89B61B8D55FBD2D7"><enum>(ii)</enum><text>if appropriate
			 corrective action is not taken within a reasonable time, not to exceed 90 after
			 the date of notification under clause (i), withdraw approval of the
			 program.</text>
						</clause></subparagraph><subparagraph commented="no" id="id67F627C18BE74C68B0848724DECEC600"><enum>(B)</enum><header>Notification of reasons
			 for withdrawal</header><text>The Administrator shall not withdraw approval of a
			 program under subparagraph (A) until the Administrator notifies the State or
			 Indian tribe, and makes available to the public, in writing, the reasons for
			 the withdrawal.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="IDe787fb35c6ef43b3a47cf5c245ebf05e"><enum>(t)</enum><header>Federal land management
			 agencies</header><text>A Federal land management agency that provides
			 authorization for, or participates in, a project authorized pursuant to this
			 Act shall not be liable under environmental laws for the conduct or actions of
			 a Good Samaritan (or any cooperating person).</text>
			</subsection><subsection id="id7e7a0bf2-3a5a-4327-aa58-0b758f575b16"><enum>(u)</enum><header>Emergency authority and
			 liability</header>
				<paragraph id="id7ee445fc-da1f-4e34-8cd3-9b70a7f4625d"><enum>(1)</enum><header>Emergency
			 authority</header><text>Nothing in this section affects the authority of a
			 Federal, State, tribal, or local agency to carry out any emergency authority,
			 including an emergency authority provided under any environmental law listed in
			 a permit.</text>
				</paragraph><paragraph id="id71b68ef4-05dc-4b22-bef0-1948b2293c62"><enum>(2)</enum><header>Liability</header><text>Except
			 to the extent that a permit provides protection under an environmental law
			 specified in a permit in accordance with subsection (g)(1)(C), nothing in this
			 section or a permit issued under this section limits the liability of any
			 person (including a permittee) under any other provision of law.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id25D90F92C9C04C71B7A67F9954303A08"><enum>(v)</enum><header>State and tribal
			 reclamation programs</header><text>No State, Indian tribe, or other Good
			 Samaritan shall be required to obtain a permit pursuant to this Act to
			 remediate an abandoned or inactive mine site for the conduct of reclamation
			 work under a State or tribal abandoned mine reclamation plan approved under
			 title IV of the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C.
			 1231 et seq.).</text>
			</subsection><subsection id="ID61815e2b2f8f46f5ad74f1d377c35fc9"><enum>(w)</enum><header>Termination of
			 authority</header>
				<paragraph id="IDc3b33a97f4d74767be0c5a8f5f66a150"><enum>(1)</enum><header>Termination</header>
					<subparagraph id="id609DBEDE7535476FA0D02D6F2E11FE10"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), the authority to
			 issue permits pursuant to this Act shall terminate on September 30,
			 2016.</text>
					</subparagraph><subparagraph id="IDb3031ab310d2432fa3bc623ec699ffd9"><enum>(B)</enum><header>Exception</header><text>Notwithstanding
			 subparagraph (A), a permitting authority may issue a permit pursuant to this
			 Act after September 30, 2016, if the application for the permit—</text>
						<clause id="id1CC60D96AE6343DC88B8A23BF77851B0"><enum>(i)</enum><text>was submitted not later
			 than 180 days before that date; and</text>
						</clause><clause id="id6E10E6D826FC46DD88D8C71DB0F13194"><enum>(ii)</enum><text>was completed in
			 accordance with subsection (e) by not later than September 30, 2016.</text>
						</clause></subparagraph></paragraph><paragraph id="IDe0125f15fb6b4295869988c35fd5cf16"><enum>(2)</enum><header>Effect on certain
			 permits</header><text>Any permit issued pursuant to this Act before September
			 30, 2016, that is in effect on that date (including any permit issued pursuant
			 to paragraph (1)(B)) shall remain in effect after that date in accordance
			 with—</text>
					<subparagraph id="id9668C19520654D58A6266940CCC091EA"><enum>(A)</enum><text>the terms and conditions
			 of the permit; and</text>
					</subparagraph><subparagraph id="id8C53F041CCCF4899807AC084F79DD9D5"><enum>(B)</enum><text>this Act.</text>
					</subparagraph></paragraph><paragraph id="IDeaa1e9b965ee4d53a40bdf1276b541cc"><enum>(3)</enum><header>Completion of
			 projects</header><text>Each project authorized under a permit issued pursuant
			 to this Act shall be completed by the later of—</text>
					<subparagraph id="id38A2DF4238684C7C8732C4522387D22F"><enum>(A)</enum><text>the date that is 10 years
			 after the date of enactment of this Act; and</text>
					</subparagraph><subparagraph id="id555C79CD71D74D5FB87EF467234A9457"><enum>(B)</enum><text>the date that is 4 years
			 after the date of issuance of the applicable permit.</text>
					</subparagraph></paragraph></subsection><subsection id="ID2c6b393039ef48dbaf93cb1d96216479"><enum>(x)</enum><header>Report to
			 Congress</header>
				<paragraph id="ID630e9d3c1f5444c4abdc5783270b6ca4"><enum>(1)</enum><header>Preparation and
			 submission</header><text>Not later than January 1, 2016, the Administrator
			 shall submit to the Chairpersons and Ranking Members of the Committee on
			 Environment and Public Works of the Senate and the Committees on Transportation
			 and Infrastructure, Energy and Commerce, and Resources of the House of
			 Representatives a report evaluating the permit program under this Act.</text>
				</paragraph><paragraph id="IDf133b156cc324a52b9019e72047267d4"><enum>(2)</enum><header>Inclusions</header><text>The
			 report under paragraph (1) shall include—</text>
					<subparagraph id="ID61bac4b9ecd748b6917f1ab37f28a6ae"><enum>(A)</enum><text>a description of—</text>
						<clause id="idDFF20E7E1CC548CA9FD462584CAC333F"><enum>(i)</enum><text>the number, types, and
			 objectives of permits issued pursuant to this Act; and</text>
						</clause><clause id="id3CC9FBD0BA4A4F8D9E05AA2AA8E95022"><enum>(ii)</enum><text>each site remediation
			 project authorized by those permits;</text>
						</clause></subparagraph><subparagraph id="IDea24561fe65f46e4812f97bcf1e1de57"><enum>(B)</enum><text>qualitative and
			 quantitative data on the results achieved under the permits before the date of
			 issuance of the report;</text>
					</subparagraph><subparagraph id="IDda9b8bef27034314b980d2ab027a038d"><enum>(C)</enum><text>a description of—</text>
						<clause id="id212A178162094D52BFF12B68DB5C6D87"><enum>(i)</enum><text>any problems encountered
			 in administering this Act; and</text>
						</clause><clause id="idDA136B2FB8E54678ADC6EF165FF0B01A"><enum>(ii)</enum><text>whether the problems
			 have been or can be remedied by administrative action (including amendments to
			 existing law);</text>
						</clause></subparagraph><subparagraph id="ID4cae5247753a44cc85bcd2115dda2ad7"><enum>(D)</enum><text>a description of progress
			 made in achieving the purposes of this Act; and</text>
					</subparagraph><subparagraph id="IDbea019520606416da6523eb0d70e8c42"><enum>(E)</enum><text>recommendations on
			 whether the permit program under this Act should be continued after September
			 30, 2016, including a description of any modifications (including amendments to
			 existing law) required to continue administering this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="id605BF842F708483BB520E5EC23EC69E7"><enum>(y)</enum><header>Regulations</header>
				<paragraph id="ID71609a2de7264525bb3949e729b3b622"><enum>(1)</enum><header>In
			 general</header><text>The Administrator shall promulgate such regulations as
			 the Administrator determines to be necessary to carry out this section.</text>
				</paragraph><paragraph id="ID75c2fa46ffb04ca98b9d2fb3fa688bd5"><enum>(2)</enum><header>Effectiveness</header><text>This
			 section shall be effective regardless of whether regulations are promulgated by
