		<official-title>To authorize the Secretary of the Interior to lease oil

		  and gas resources underlying Fort Reno, Oklahoma, to establish the Fort Reno

		  Management Fund, and for other purposes. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Fort Reno Mineral Leasing

			 Act</short-title></quote>.</text>

		</section><section id="idF6EBF573E210470BB0B85353809D7C2B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="id6DBC1E3BD4E3476FAB750C065E35B1E5"><enum>(1)</enum><header>Board of

			 regents</header><text>The term <quote>Board of Regents</quote> means the Board

			 of Regents of the University of Oklahoma.</text>

			</paragraph><paragraph id="id7EC6887C6113453C8D647DFA8B76D7A7"><enum>(2)</enum><header>Fort reno

			 historic district</header><text>The term <quote>Fort Reno Historic

			 District</quote> means the former military installation at El Reno, Oklahoma,

			 as depicted on the map, that—</text>

				<subparagraph id="id1F8426C5769A46FD9142CFFAB0788542"><enum>(A)</enum><text>includes land and

			 facilities listed on the National Register of Historic Places in June 1970;

			 and</text>

				</subparagraph><subparagraph id="id288941ACCF4A403095346F9446FAAB86"><enum>(B)</enum><text>is administered

			 by the Secretary as part of the Fort Reno Management Area.</text>

				</subparagraph></paragraph><paragraph id="ID8cf4101ea46e4353a47f7bb1dca86fcb"><enum>(3)</enum><header>Fort Reno

			 Management area</header><text>The term <term>Fort Reno Management Area</term>

			 means the approximately 6,737 acres of Federal land, including Fort Reno and

			 the Park, as depicted on the map.</text>

			</paragraph><paragraph id="id53B4BC18A5F4433C9D7B4AE556AC36C0"><enum>(4)</enum><header>Fund</header><text>The

			 term <term>Fund</term> means the Fort Reno Management Fund established by

			 section 4(a).</text>

			</paragraph><paragraph id="idCD6B1706D23644728F10EC6CF0648FC1"><enum>(5)</enum><header>Map</header><text>The

			 term <quote>map</quote> means the map entitled <quote>Fort Reno Management

			 Area</quote> and dated September 2005.</text>

			</paragraph><paragraph id="id21C3E2FE271945B6AB4988B7DE1DD08D"><enum>(6)</enum><header>Park</header><text>The

			 term <quote>Park</quote> means the approximately 24.3 acres of land in the

			 State of Oklahoma known as the <quote>Fort Reno Science Park</quote>, as

			 generally depicted on the map.</text>

			</paragraph><paragraph id="id0D5731E2345A442E9FBEA194731E03DC"><enum>(7)</enum><header>Park

			 instrument</header>

				<subparagraph id="id60D43CDD498548E38FC2D9E37E775D7E"><enum>(A)</enum><header>In

			 general</header><text>The term <quote>Park instrument</quote> means an

			 instrument covering an agreement between the Department of Agriculture and the

			 Board of Regents relating to the use of the Park.</text>

				</subparagraph><subparagraph id="id060E356FCB544436B4993195DB56046A"><enum>(B)</enum><header>Inclusions</header><text>The

			 term <quote>Park instrument</quote> includes—</text>

					<clause id="id79EFBED7C05C46E68F435426BFBF767A"><enum>(i)</enum><text>the

			 master memorandum of understanding, dated August 19, 1998;</text>

					</clause><clause id="id5CB064227BB745F9842F91C4C5CC70E7"><enum>(ii)</enum><text>the supplements

			 numbered 1 and 2, dated January 19, 1999;</text>

					</clause><clause id="id70ADE9463D944E03981C4FCBDE5EBD16"><enum>(iii)</enum><text>the easement,

			 dated January 19, 1999;</text>

					</clause><clause id="id2F0D3CBC73624E718990B78FA718F735"><enum>(iv)</enum><text>the amended

			 easement deed, dated February 24, 2004;</text>

					</clause><clause id="idFEFF24579FB94FA4A2DA28A0695A5A77"><enum>(v)</enum><text>a

			 special warranty deed, dated May 29, 2001; and</text>

					</clause><clause id="id7A1B4045B31D40E9AD9888B8D844207F"><enum>(vi)</enum><text>a

			 memorandum of agreement, dated February 24, 2004.</text>

					</clause></subparagraph></paragraph><paragraph id="ID5f67842e5f214a28b3e24d0843abe1cf"><enum>(8)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of the Interior.</text>

			</paragraph></section><section id="ID5c5f36330da04934976192d45e4b6707"><enum>3.</enum><header>Fort Reno

			 management area</header>

			<subsection id="id23749E7996204E989B7883FE56FCC8A4"><enum>(a)</enum><header>Authorization

			 by Congress required for declaration as excess or surplus property or

			 conveyance</header><text>Notwithstanding any other provision of law, the Fort

			 Reno Management Area, without specific authorization by Congress, shall not, in

			 whole or part—</text>

				<paragraph id="ID6edffbcd2e7343aaa16de6e07490c28e"><enum>(1)</enum><text>be declared to be

			 excess or surplus Federal property under subtitle I of title 40, United States

			 Code;</text>

				</paragraph><paragraph id="ID9a9d8ca960644e63879a133f473adee8"><enum>(2)</enum><text>be conveyed;

			 or</text>

				</paragraph><paragraph id="id412DFC3D7C474096B2EFB68563C85DA1"><enum>(3)</enum><text>be transferred to

			 the administrative jurisdiction of any other Federal agency.</text>

				</paragraph></subsection><subsection id="ID56682cfd06c441a3a600c050b42ac26f"><enum>(b)</enum><header>Mineral

			 leasing</header>

				<paragraph id="IDb07b6d0024914273bfc3e44b06b36bc0"><enum>(1)</enum><header>In

			 general</header><text>Notwithstanding the provisions of the first section of

			 the Mineral Leasing Act of 1920 (30 U.S.C. 181) excluding Federal land in

			 incorporated cities from mineral leasing, the Secretary may provide for mineral

			 leasing at the Fort Reno Management Area in accordance with that Act, subject

			 to such terms and conditions as the Secretary of Agriculture determines to be

			 appropriate to preserve and protect historic properties and ongoing and

			 prospective research activities.</text>

				</paragraph><paragraph id="ID3ac43a4b0a80413f8ce181f673f3263b"><enum>(2)</enum><header>Environmental

			 analyses</header><text>After the date of enactment of this Act, no further

			 administrative or environmental analyses shall be required for the leasing and

			 development of minerals at the Fort Reno Management Area.</text>

				</paragraph></subsection><subsection id="id83DA7695F26B4A66A7AB17119CE8C76B"><enum>(c)</enum><header>Availability of

			 map</header><text>The map shall be on file and available for public inspection

			 in—</text>

				<paragraph id="id669F8507B0384F88B53AA1F9D82F7731"><enum>(1)</enum><text>the office of the

			 Administrator of the Agricultural Research Center; and</text>

				</paragraph><paragraph id="id644D70F82E8A45ED805285D46C7571AA"><enum>(2)</enum><text>the office of the

			 Director of the Grazinglands Research Laboratory in El Reno, Oklahoma.</text>

				</paragraph></subsection><subsection id="id53C2C649DED74A638BCC346CF782BC12"><enum>(d)</enum><header>Effect</header><text>Nothing

			 in this section precludes the Secretary of Agriculture from granting utilities

			 or access easements for, or issuing temporary permits for the use of, the Fort

			 Reno Management Area.</text>

			</subsection></section><section id="ID2a2af1e36eff4e02bed73bb9898d5d9e"><enum>4.</enum><header>Fort Reno

			 Management Fund</header>

			<subsection id="IDB87E6EB3E15A423C9459B522069F2D1F"><enum>(a)</enum><header>Establishment</header><text>There

			 is established in the Treasury of the United States a revolving fund, to be

			 known as the <quote>Fort Reno Management Fund</quote>, consisting of—</text>

				<paragraph id="IDD2EF1B70D5204F73B84970D1BF09ABCD"><enum>(1)</enum><text>such amounts as

			 are appropriated to the Fund under subsection (b);</text>

				</paragraph><paragraph id="id3006B3F8CB354EA5B80292648964AD9B"><enum>(2)</enum><text>such amounts as

			 are deposited under section 6(b)(1)(B); and</text>

				</paragraph><paragraph id="IDDEF1CB6C8E834F71B796E6B85E12D28F"><enum>(3)</enum><text>any interest

			 earned on investment of amounts in the Fund under subsection (d).</text>

				</paragraph></subsection><subsection id="ID75847D4BD6B24B8E83CBB81F88EF90BB"><enum>(b)</enum><header>Transfers to

			 Fund</header><text>Notwithstanding section 35 of the Mineral Leasing Act (30

			 U.S.C. 191), there are appropriated to the Fund amounts equivalent to amounts

			 received in the Treasury as proceeds from the leasing of mineral resources at

			 the Fort Reno Management Area under section 3(b).</text>

			</subsection><subsection id="ID72CBA45BD1F440E4B3F4FD55F33AAC30"><enum>(c)</enum><header>Expenditures

			 from Fund</header>

				<paragraph id="id9D935770D41D441E997AFE43C215AF99"><enum>(1)</enum><header>In

			 general</header><text>On request by the Secretary of Agriculture, the Secretary

			 of the Treasury shall transfer from the Fund to the Administrator of the

			 Agricultural Research Service—</text>

					<subparagraph id="id1279FA332907458E9F84B04F7559B7E4"><enum>(A)</enum><text>such amounts as

			 the Administrator determines are necessary, but not more than a total of

			 $22,000,000, to provide, with respect to the Fort Reno Historic

			 District—</text>

						<clause id="ID44549db5c139420d98c65e1f43bb9858"><enum>(i)</enum><text>the

			 restoration, maintenance, and management of historic buildings and

			 facilities;</text>

						</clause><clause id="ID08364bbd2c7c4931953322ef0f71dd76"><enum>(ii)</enum><text>the

			 interpretation, education, and visitor services and related activities in

			 connection with historic buildings and facilities;</text>

						</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id481B661E50BE4E49BD811AD49C53792F"><enum>(iii)</enum><text>the provision

			 and maintenance of facilities for utilities, waste management, streets, visitor

			 parking, and other improvements necessary or desirable for providing public and

			 administrative services; and</text>

						</clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id9E63768ED9AF41C9B3D4AA872FB93F9E"><enum>(iv)</enum><text>to reimburse the

			 Secretary for the costs of administering a mineral leasing program for the Fort

			 Reno Management Area under section 3(b).</text>

						</clause></subparagraph><subparagraph id="id9A08F8FBCF30405088CCBAAFB121FC67"><enum>(B)</enum><text>not more than

			 $250,000 for each fiscal year, as adjusted under paragraph (4), to be deposited

			 in a repair and maintenance fund established by the Secretary of Agriculture

			 for the Fort Reno Historic District.</text>

					</subparagraph></paragraph><paragraph id="id6317698F1C36413D967B62AA2F1CAAD0"><enum>(2)</enum><header>Reduction of

			 national debt</header><text>Any amounts remaining in the Fund after the

			 transfers are made under subparagraphs (A) and (B) of paragraph (1) shall be

			 used to reduce the debt of the United States.</text>

				</paragraph><paragraph id="ID9724CABDFFA844AE9AEFD47A75CBECA6"><enum>(3)</enum><header>Consultation</header><text>In

			 making expenditures from the Fund under clauses (i), (ii), and (iii) of

			 paragraph (1)(A), the Administrator of the Agricultural Research Service shall

			 consult with—</text>

					<subparagraph id="idDA71A69083174018B35704591EA58C44"><enum>(A)</enum><text>Historic Fort

			 Reno, Inc., (or any successors or assigns); and</text>

					</subparagraph><subparagraph id="id939D65D1624D4AA3AB8F0F55B7153018"><enum>(B)</enum><text>the Oklahoma

			 State Historic Preservation Officer.</text>

					</subparagraph></paragraph><paragraph id="id7F13640867CA45D89B9B263713D5D148"><enum>(4)</enum><header>Inflation

			 adjustment</header><text>For each fiscal year, the amount specified in

			 paragraph (1)(B) shall be increased by 4 percent.</text>

				</paragraph></subsection><subsection id="ID5603607AF5D94AF4BC15A9D3321A0821"><enum>(d)</enum><header>Investment of

			 amounts</header>

				<paragraph id="IDB41A9725093D45BAABBED0F22225BDF4"><enum>(1)</enum><header>In

			 general</header><text>The Secretary of the Treasury shall invest such portion

			 of the Fund as is not, in the judgment of the Secretary of the Treasury,

			 required to meet current withdrawals.</text>

				</paragraph><paragraph id="id6511CF2C0E1C45378F26AC70920DBAAF"><enum>(2)</enum><header>Interest-bearing

			 obligations</header><text>Investments may be made only in interest-bearing

			 obligations of the United States.</text>

				</paragraph><paragraph id="ID64BE379517894186B89A1201FBFD944E"><enum>(3)</enum><header>Acquisition of

			 obligations</header><text>For the purpose of investments under paragraph (1),

			 obligations may be acquired—</text>

					<subparagraph id="ID2FBB30C1FE744A27BAD9FAB522B3731C"><enum>(A)</enum><text>on original issue

			 at the issue price; or</text>

					</subparagraph><subparagraph id="ID119C636409D948D786ECA703681825D8"><enum>(B)</enum><text>by purchase of

			 outstanding obligations at the market price.</text>

					</subparagraph></paragraph><paragraph id="ID41DB13A27611478D8A6149DA3B5D78BE"><enum>(4)</enum><header>Sale of

			 obligations</header><text>Any obligation acquired by the Fund may be sold by

			 the Secretary of the Treasury at the market price.</text>

				</paragraph><paragraph id="ID484E65079F0D4D97AAD686B9EEE029C8"><enum>(5)</enum><header>Credits to

			 Fund</header><text>The interest on, and the proceeds from the sale or

			 redemption of, any obligations held in the Fund shall be credited to and form a

			 part of the Fund.</text>

				</paragraph></subsection><subsection id="ID990781DF86FA4B5A8ADACB8C3C4C49B3"><enum>(e)</enum><header>Transfers of

			 amounts</header>

				<paragraph id="IDEA15210E59234B4AB0176880E4E2B3F6"><enum>(1)</enum><header>In

			 general</header><text>The amounts required to be transferred to the Fund under

			 this section shall be transferred at least monthly from the general fund of the

			 Treasury to the Fund on the basis of estimates made by the Secretary of the

			 Treasury.</text>

				</paragraph><paragraph changed="not-changed" commented="no" id="IDCF3824F211E742E7A61FAAF06623B01E"><enum>(2)</enum><header>Adjustments</header><text>Proper

			 adjustment shall be made in amounts subsequently transferred to the extent

			 prior estimates were in excess of or less than the amounts required to be

			 transferred.</text>

				</paragraph></subsection></section><section changed="not-changed" commented="no" id="idEE297388C1594BD2A1A12EFA0DFAA4A7"><enum>5.</enum><header>Ratification of

			 fort reno science park instrument</header>

			<subsection id="IDeb9ce01843d44d30ade58cc931107138"><enum>(a)</enum><header>In

			 general</header><text>The Park instrument is ratified.</text>

			</subsection><subsection id="ID5de950a974af48bea4af4bfa0ef17665"><enum>(b)</enum><header>Amendments</header><text>The

			 Park instrument may only be amended or revoked if the parties to the Park

			 instrument agree to the amendment or revocation.</text>

			</subsection></section><section id="id06ADCF7AA2BB46EB9EEF9B0E63F1E277"><enum>6.</enum><header>Leasing

			 authority</header>

			<subsection id="id0FA4E9100C9741C5B9B5D0C8247588C5"><enum>(a)</enum><header>In

			 general</header><text>The Secretary of Agriculture may—</text>

				<paragraph id="ID8676f6e813a042afbd4c3b8577794b26"><enum>(1)</enum><text>lease to any

			 person or entity any property at the Fort Reno Management Area, subject to any

			 terms and conditions that the Secretary of Agriculture determines to be in the

			 public interest;</text>

				</paragraph><paragraph id="ID27e01abcbae84a3ebd42ac36fca0f221"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC8C6A1ADD27347AA91E5E31866153B4F"><enum>(A)</enum><text>if the Board of Regents

			 agrees to the conversion, convert to a lease, for no additional consideration,

			 the easements to the Park referred to in section 2(5)(B); and</text>

					</subparagraph><subparagraph id="idDE432EFDE3624D0AA184807EF06EB55A" indent="up1"><enum>(B)</enum><text>extend the lease converted under

			 subparagraph (A), subject to any terms and conditions that the Secretary of

			 Agriculture and the Board of Regents agree to, including terms and conditions

			 that provide that—</text>

						<clause id="id9D08E011241849D7BCEF3509A80F48B9"><enum>(i)</enum><text>the initial term of the lease shall

			 expire on February 3, 2049; and</text>

						</clause><clause id="id684DE733801E4609ADC5325E061FF229"><enum>(ii)</enum><text>the lease may be renewable for

			 additional 20-year terms.</text>

						</clause></subparagraph></paragraph></subsection><subsection id="idFF979AD875324E8287C5E6CF52171024"><enum>(b)</enum><header>Special terms

			 and conditions</header>

				<paragraph id="ID105bc5092ed74962b935e935f0f3791d"><enum>(1)</enum><header>Consideration</header>

					<subparagraph id="id7663CD81243448D7AFD92246B8144A77"><enum>(A)</enum><header>In

			 general</header><text>Subject to any terms and conditions that the parties to

			 the lease agree to, consideration for a lease under subsection (a)(1) may be in

			 the form of—</text>

						<clause id="idCE69E904816046E88527DE3B49222D53"><enum>(i)</enum><text>conveyance to the

			 Secretary of Agriculture of title to any non-Federal structures of, or

			 improvements to, the Fort Reno Management Area;</text>

						</clause><clause id="idCB32316E6257425284339C3B53DA39FD"><enum>(ii)</enum><text>repairs or

			 renovations to structures of, or improvements to, the Fort Reno Management

			 Area, that are conducted before or after the lease is entered into;</text>

						</clause><clause id="id04510C7D8E6B4B81862C159CCA56FDA3"><enum>(iii)</enum><text>cash; or</text>

						</clause><clause id="idAE52D9CEB78945E880A5F3142BC34D7C"><enum>(iv)</enum><text>a

			 combination of any of the forms of consideration described in clauses (i)

			 through (iii).</text>

						</clause></subparagraph><subparagraph id="IDfb36abbeb835428bb0006f5d0f4d17db"><enum>(B)</enum><header>Disposition in

			 fund</header><text>Any amount received as consideration for a lease under

			 subparagraph (A) shall be deposited in the Fund.</text>

					</subparagraph></paragraph><paragraph id="ID4a90977a1a954594bad39ff93e8c4686"><enum>(2)</enum><header>Term</header>

					<subparagraph id="idA0ADEC7A4DEF4372974F17B62BB2782D"><enum>(A)</enum><header>In

			 general</header><text>Except as provided in subsection (a)(2)(B) and

			 subparagraph (B), the term of any lease shall be for not more than 20

			 years.</text>

					</subparagraph><subparagraph id="idDB0BF8CF97684485AF3EA986C7A55C84"><enum>(B)</enum><header>Renewal</header><text>Notwithstanding

			 subparagraph (A), a lease may be renewed at the option of the parties, subject

			 to any terms and conditions that—</text>

						<clause id="idCC09297A974541389B9CD19B08636468"><enum>(i)</enum><text>the

			 Secretary of Agriculture determines to be in the public interest; and</text>

						</clause><clause id="idA58E797A46F24648971977D1CC9557E1"><enum>(ii)</enum><text>are agreed to by

			 the parties to the lease.</text>

						</clause></subparagraph></paragraph></subsection></section><section id="ID4062059e80334cdd9933ac77a9b44390"><enum>7.</enum><header>Effect</header>

			<subsection id="id35AE6493580C4F1C87B61F2AFCB62E8D"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Nothing in this Act

			 limits or modifies the authority of the Secretary of Agriculture—</text>

				<paragraph id="id23253306AF5543FBB9DDC928648E2709"><enum>(1)</enum><text>to conduct

			 research activities at the Fort Reno Management Area; or</text>

				</paragraph><paragraph id="id6E2B27F0F4614233B411FE9090FF600C"><enum>(2)</enum><text>to manage the

			 Federal land under the jurisdiction of the Secretary of Agriculture for

			 research purposes.</text>

				</paragraph></subsection><subsection id="idA8AFD2400A1F4CE49D0A318382FF0566"><enum>(b)</enum><header>Grazinglands

			 research laboratory</header><text>Designation of the Federal land at El Reno,

			 Oklahoma, as the Fort Reno Management Area does not affect the name or

			 operations of the Grazinglands Research Laboratory.</text>
