			<section id="idB3EE85F85EFD4E3B9A0C7D08F3B67783"><enum>101.</enum><header>Tax credit for

			 older workers in flexible and phased work programs</header>

				<subsection id="id2B7342C64FD44CE5AA0B630492C09128"><enum>(a)</enum><text>Congress finds

			 that—</text>

					<paragraph id="id8CDDFAFBAFB7416ABE8F7063AEF9EBAF"><enum>(1)</enum><text>most older

			 workers expect to work past traditional retirement age;</text>

					</paragraph><paragraph id="idD58C918647B74ADFAF5B0E19466896AB"><enum>(2)</enum><text>most older

			 workers would prefer not to work a traditional full-time schedule;</text>

					</paragraph><paragraph id="id28D6FF89ED7B48B9AB0581A353CC4680"><enum>(3)</enum><text>older workers'

			 preference for flexible and phased work is not matched by opportunities

			 currently offered by employers;</text>

					</paragraph><paragraph id="id0ACEFB85D5E1497EA153C72FBC82D163"><enum>(4)</enum><text>many older

			 workers would choose to work longer if they were offered flexible and phased

			 work opportunities, which would also reduce employer costs by increasing

			 employee retention; and</text>

					</paragraph><paragraph id="id5AFBFAE37DF54181B3FC68E0EDE0F267"><enum>(5)</enum><text>many older

			 workers would like to gradually transition into retirement instead of taking

			 full retirement immediately.</text>

					</paragraph></subsection><subsection id="idB1E45140B25E48479E0C7E76B1D299B4"><enum>(b)</enum><header>Flexible and

			 phased work credit</header><text display-inline="yes-display-inline">Subpart D

			 of part IV of subchapter A of chapter 1 of the Internal Revenue Code of 1986

			 (relating to business related credits) is amended by adding at the end the

			 following new section:</text>

					<quoted-block display-inline="no-display-inline" id="idC528087E0690454E8CCE53086CACA31C" style="OLC">

						<section id="id451C77BA340349EEAB82874910C0D1AE"><enum>45N.</enum><header>Flexible and

				phased work credit</header>

							<subsection id="id0274520DC46843E5A615C3B5D028BBB6"><enum>(a)</enum><header>In

				general</header><text>For purposes of section 38, in the case of an eligible

				employer, the flexible and phased work credit determined under this section for

				the taxable year shall be equal to 40 percent of the qualified wages for such

				year.</text>

							</subsection><subsection id="id62303D1E16514441B76D8CDCCAF617AE"><enum>(b)</enum><header>Eligible

				employer</header><text>For purposes of this section, the term <term>eligible

				employer</term> means an employer which—</text>

								<paragraph id="idA11FCD6CFBD249B1A162C134B0E85942"><enum>(1)</enum><text>maintains a

				qualified trust (within the meaning of section 401(a)), and</text>

								</paragraph><paragraph id="id199B5E83AB284BFFB54583A71E2FBDCE"><enum>(2)</enum><text>provides health

				insurance coverage (as defined in section 9832(b)(1)(A)) to employees and pays

				no less than 60 percent of the cost of such health insurance coverage with

				respect to each full-time employee receiving such coverage.</text>

								</paragraph></subsection><subsection id="id405298EC35F74777B6199C8A83137C1C"><enum>(c)</enum><header>Qualified wages

				defined</header><text>For purposes of this section—</text>

								<paragraph id="id8BFF6419B2CF475A95206B71E0D693BE"><enum>(1)</enum><header>Qualified

				wages</header><text>The term <term>qualified wages</term> means the wages paid

				or incurred by an eligible employer during the taxable year to individuals whom

				at the time such wages are paid or incurred—</text>

									<subparagraph id="id38CE5813A8234A49B8FE84FA58744DFD"><enum>(A)</enum><text>have attained the

				age of 59½, and</text>

									</subparagraph><subparagraph id="idE97585B8855A49F3B9D4BBD8BF15D4CB"><enum>(B)</enum><text>are participating

				in a formal flexible work program or a formal phased work program.</text>

									</subparagraph></paragraph><paragraph id="id65230744F2434E5AAD1977CB3C998A4C"><enum>(2)</enum><header>Wages</header>

									<subparagraph id="idDF165C50A6694534BB64762B35C1F6F9"><enum>(A)</enum><header>In

				general</header><text>The term <term>wages</term> has the meaning given such

				term by subsection (b) of section 3306 (determined without regard to any dollar

				limitation contained in such section).</text>

									</subparagraph><subparagraph id="idC0EEACEE2EBD44EF94A181D3AF64C621"><enum>(B)</enum><header>Other

				rules</header><text>Rules similar to the rules of paragraph (2) and (3) of

				section 51(c) shall apply for purposes of this section.</text>

									</subparagraph><subparagraph id="id3BBC20C1883847178F00BEA521B248C6"><enum>(C)</enum><header>Termination</header><text>The

				term <term>wages</term> shall not include any amount paid or incurred to an

				individual after December 31, 2010.</text>

									</subparagraph></paragraph><paragraph id="id3AD921C11D144AE1978BA14DC0023877"><enum>(3)</enum><header>Only first

				$<enum-in-header>6,000</enum-in-header> of wages per year taken into

				account</header><text>The amount of the qualified wages which may be taken into

				account with respect to any individual shall not exceed $6,000 per year.</text>

								</paragraph></subsection><subsection id="idF9233C7D47A64A078A35D8D11C6F02F5"><enum>(d)</enum><header>Formal flexible

				work program</header><text>For purposes of this section—</text>

								<paragraph id="id85100E93699B45C7AF2FF195A9431324"><enum>(1)</enum><header>In

				general</header><text>The term <term>formal flexible work program</term> means

				a program of an eligible employer—</text>

									<subparagraph id="id8E8F86F9D8A64C19BA34A4AA3D54416A"><enum>(A)</enum><text>which consists of

				core time and flex time,</text>

									</subparagraph><subparagraph id="idB4B49564FE5D457DBA18462734E725F8"><enum>(B)</enum><text>under which core

				time does not exceed—</text>

										<clause id="id7881AFC4609E4487B0FA1FF39D2D6200"><enum>(i)</enum><text>20 hours per

				week,</text>

										</clause><clause id="id06F25326383D4E26B213B07DA0B3B60D"><enum>(ii)</enum><text>3 days per week,

				or</text>

										</clause><clause id="id76D010AA6A6C4135817CB2E277705CD1"><enum>(iii)</enum><text>1,000 hours per

				year, and</text>

										</clause></subparagraph><subparagraph id="id3CD4A8375CDD44BAB9536C0C8F2AA0EB"><enum>(C)</enum><text>which meets the

				requirements of subsection (f).</text>

									</subparagraph></paragraph><paragraph id="id0ADC910FC7DE4707B2D630F040DC1A86"><enum>(2)</enum><header>Core

				time</header><text>The term <term>core time</term> means the specific

				time—</text>

									<subparagraph id="idFEBEBAA7D08D4C44B0190833EC5914A5"><enum>(A)</enum><text>during which an

				employee is required to perform services related to employment, and</text>

									</subparagraph><subparagraph id="idAF9D9C9845F544B9A0EF056B9D65264D"><enum>(B)</enum><text>which is

				determined by the employer.</text>

									</subparagraph></paragraph><paragraph id="idCD453B5C22AA4A92B2194902368C9BB5"><enum>(3)</enum><header>Flex

				time</header><text>The term <term>flex time</term> means the time other than

				core time—</text>

									<subparagraph id="idE98A7C57B77C43868AEA3D4D6FC31544"><enum>(A)</enum><text>during which an

				employee is required to perform services related to employment, and</text>

									</subparagraph><subparagraph id="id03184DF3E42A47EEBFD9BC32D3B22885"><enum>(B)</enum><text>which is

				determined at the election of the employee.</text>

									</subparagraph></paragraph></subsection><subsection id="idC60011E7042C4962B3370B542DA71F17"><enum>(e)</enum><header>Formal phased

				work program</header><text>For purposes of this section, the term <term>formal

				phased work program</term> means—</text>

								<paragraph id="id3FA857BA173E4FB4992002B432EAA534"><enum>(1)</enum><text>a program of an

				eligible employer—</text>

									<subparagraph id="idC23D7B498AC74063B97E9125751B8A7F"><enum>(A)</enum><text>under which the

				employer and an employee enter into an agreement, in good faith, that the

				employee's work schedule will be no more than 80 percent of the work schedule

				of a similarly situated full-time employee, and</text>

									</subparagraph><subparagraph id="id332A92B55A744545A9C56C29E30BA74B"><enum>(B)</enum><text>which meets the

				requirements of subsection (f), or</text>

									</subparagraph></paragraph><paragraph id="idB8D46FFF7989415F8A8E1F982CAC66E6"><enum>(2)</enum><text>any phased

				retirement program of an eligible employer which—</text>

									<subparagraph id="id56D3466A42704181A5BEF425E88264F8"><enum>(A)</enum><text>is authorized by

				the Secretary, and</text>

									</subparagraph><subparagraph id="id6E771EAAEDCC4959A78FE06EF1482341"><enum>(B)</enum><text>meets the

				requirements of subsection (f).</text>

									</subparagraph></paragraph></subsection><subsection id="id5AAD18857B424660A6765F5EE6D1FFA4"><enum>(f)</enum><header>Requirements</header><text>A

				program shall not be considered a formal flexible work program or a formal

				phased work program under this section unless such program meets the following

				requirements:</text>

								<paragraph id="idF84B6175C15D42458103645F42311DDF"><enum>(1)</enum><header>Duration of

				program</header><text>The program shall allow for participation for a period of

				at least 1 year.</text>

								</paragraph><paragraph id="id746A3F7066544C6BA016688CFA195082"><enum>(2)</enum><header>No change in

				health benefits</header><text>With respect to a participant whose work schedule

				is no less than 20 percent of the work schedule of a similarly situated

				full-time employee—</text>

									<subparagraph id="id0475CDDC005B4C83BEEBD1369421B277"><enum>(A)</enum><text>such participant

				shall be entitled to the same health insurance coverage to which a similarly

				situated full-time employee would be entitled,</text>

									</subparagraph><subparagraph id="id1364D5C25C2D42B6AB90243CFE0BBAF2"><enum>(B)</enum><text>the employer

				shall contribute the same percentage of the cost of health insurance coverage

				for such participant as the employer would contribute for a similarly situated

				full-time employee, and</text>

									</subparagraph><subparagraph id="id3C3ACB94A94F4FDFBD5B631E4374DCE1"><enum>(C)</enum><text>such participant

				shall be entitled to participate in a retiree health benefits plan of the

				employer in the same manner as a similarly situated full-time employee, except

				that service credited under the plan for any plan year shall be equal to the

				ratio of the participant’s work schedule during such year to the work schedule

				of a similarly situated full-time employee during such year.</text>

									</subparagraph></paragraph><paragraph id="idC23652FC6A534C26B58EA04E31F55490"><enum>(3)</enum><header>No reduction in

				pension benefits</header>

									<subparagraph id="ID27e64fc1b1364acb8651d594c8df2592"><enum>(A)</enum><header>Defined benefit

				plans</header>

										<clause id="id9CF4E61EB86A466B8E5AA943FE5942C1"><enum>(i)</enum><text>A

				participant shall be entitled to participate in a defined benefit plan (within

				the meaning of section 414(j)) of the employer in the same manner as a

				similarly situated full-time employee.</text>

										</clause><clause id="id0F2960CFBA2A4F558E4AD713049601D8"><enum>(ii)</enum><text>Service credited

				to a participant under the plan for any plan year shall be equal to the ratio

				of the participant’s work schedule during such year to the work schedule of a

				similarly situated full-time employee during such year.</text>

										</clause><clause id="id933D0E9DEC734038A2F00780B35AD7D2"><enum>(iii)</enum><text>If the plan

				uses final average earnings to determine benefits, final average earnings of

				the participant shall be no less than such earnings were before the participant

				entered the program.</text>

										</clause></subparagraph><subparagraph commented="no" id="idB6D0F1EEA51B4A5CB8AC6B9887EEDB4F"><enum>(B)</enum><header>Defined

				contribution plans</header><text>A participant shall be entitled to participate

				in a defined contribution plan (within the meaning of section 414(i)) of the

				employer in the same manner as a similarly situated full-time employee, and the

				employer shall match the participant’s contributions at the same rate that the

				employer would match the contributions of a similarly situated full-time

				employee.</text>

									</subparagraph><subparagraph id="idA484B62B8F064F12A30B1E353D4B0A2F"><enum>(C)</enum><header>No forfeiture

				of pension benefits</header><text>The pension benefits of a participant shall

				not be forfeited under the rules of section 411(a)(3)(B) or section

				203(a)(3)(B) of the Employee Retirement Income Security Act of 1974 with

				respect to a participant who has attained normal retirement age as of the end

				of the plan year.</text>

									</subparagraph></paragraph><paragraph id="id9091C4396A3347F3BE4104ABE43BFCE3"><enum>(4)</enum><header>Nondiscrimination

				rule</header><text>Eligibility to participate in the program shall not

				discriminate in favor of highly compensated employees (within the meaning of

				section 414(q)).</text>

								</paragraph></subsection><subsection id="id485E0982052D4CD7B7691BBE0D030ACD"><enum>(g)</enum><header>Certain

				individuals ineligible</header><text>For purposes of this section, rules

				similar to the rules of paragraphs (1) and (2) of section 51(i) and section 52

				shall apply.</text>

							</subsection><subsection id="id2FD2C987AD734F83A6421AB4CF488451"><enum>(h)</enum><header>Regulations</header><text>The

				Secretary may prescribe such regulations as are necessary to carry out the

				purposes of this section, including simplified rules to satisfy the

				requirements of subsection (f)(3)(C) taking into account the requirements of

				section 411 and section 203 of the Employee Retirement Income Security Act of

				1974.</text>

							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="idC3FB0B4D55C54F33ACD42B0987EF28C7"><enum>(c)</enum><header>Credit made

			 part of general business credit</header><text>Subsection (b) of section 38 of

			 the Internal Revenue Code of 1986 is amended by striking <quote>and</quote> at

			 the end of paragraph (25), by striking the period at the end of paragraph (26)

			 and inserting <quote>, plus</quote>, and by adding at the end the following new

			 paragraph:</text>

						<paragraph id="id5FA757A3D8274A86A54013AA401D3470"><enum>(27)</enum><text>the flexible and

				phased work credit determined under section

				</subsection><subsection id="id8A6A993916704CE2804CEDEE96E6EE12"><enum>(d)</enum><header>No double

			 benefit</header><text>Subsection (a) of section 280C of the Internal Revenue

			 Code of 1986 is amended by inserting <quote>45N(a),</quote> after

			 <quote>45A(a),</quote>.</text>

				</subsection><subsection id="id6B3D9B1011484FAFBEF3727DD3991274"><enum>(e)</enum><header>Clerical

			 amendment</header><text>The table of sections for subpart D of part IV of

			 subchapter A of chapter 1 of the Internal Revenue Code of 1986 is amended by

			 adding at the end the following new item:</text>

						<toc-entry level="section"><quote>Sec. 45N. Flexible and phased work

				credit.</quote>.</toc-entry>

					</toc>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id6CC17B356FE34267928C26CFB87B79AB"><enum>(f)</enum><header>Effective

			 date</header><text>The amendments made by this section shall apply to wages

			 paid after December 31, 2005.</text>

				</subsection></section><section id="id4C7AB1DC1A57458E81564201D06E721F" section-type="subsequent-section"><enum>102.</enum><header>Expansion of

			 dependent care credit to eldercare expenses</header>

				<subsection id="idCADBAB2FD94947A29C41066817D286ED"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Paragraph (1) of

			 section 21(b) of the Internal Revenue Code of 1986 (relating to qualifying

			 individual) is amended by striking <quote>or</quote> at the end of subparagraph

			 (B), by striking the period at the end of subparagraph (C) and inserting

			 <quote>, or</quote>, and by adding at the end the following new

			 subparagraph:</text>

					<quoted-block display-inline="no-display-inline" id="id52474BFE688D429E8AF363E12D41EBEF" style="OLC">

						<subparagraph id="id11A1419369354710842E83502956ACA2"><enum>(D)</enum><text display-inline="yes-display-inline">an individual who—</text>

							<clause id="idDAD90D830A0E4217A0B43B773C36B44A"><enum>(i)</enum><text display-inline="yes-display-inline">has attained retirement age (as defined in

				section 216(l)(1) of the Social Security Act) before the end of the taxable

				year of the taxpayer,</text>

							</clause><clause id="id0E339C15793B436EB48DDFABE537E5B4"><enum>(ii)</enum><text display-inline="yes-display-inline">is the spouse of the taxpayer or has a

				relationship to the taxpayer described in subparagraph (B), (C), (D), (F), or

				(G) of section 152(d)(2), and</text>

							</clause><clause id="id8B3B48FFBFB643F8AA2C4314390B1334"><enum>(iii)</enum><text display-inline="yes-display-inline">is a chronically ill individual (within the

				meaning of section

				7702B(c)(2)).</text>

							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" id="id57BA03888C4B4E6EA8AFB5C64B0D5654"><enum>(b)</enum><header>Expenses for

			 care outside of household</header>

					<paragraph commented="no" id="idB53CA51AE3C44CF0B089AC3F2294F3C7"><enum>(1)</enum><header>In

			 general</header><text>Subparagraph (B) of section 21(b)(2) of the Internal

			 Revenue Code of 1986 is amended by striking <quote>or</quote> at the end of

			 clause (i), by redesignating clause (ii) as clause (iii), and by inserting

			 after clause (i) the following new clause:</text>

						<quoted-block display-inline="no-display-inline" id="id72149D1535B14DC2919452B5094C6D62" style="OLC">

							<clause commented="no" id="id65ADAB656B4342EC8738CDE781014789"><enum>(ii)</enum><text>a qualifying

				individual described in paragraph (1)(D),

			 paragraph (1), is amended by striking <quote>paragraph (1)(A)</quote> and

			 inserting <quote>subparagraph (A) or (D) of paragraph (1)</quote>.</text>

					</paragraph></subsection><subsection commented="no" id="idBBB4C287B21042C4B7680ED0F94DEB87"><enum>(c)</enum><header>Conforming

			 amendments</header>

					<paragraph commented="no" id="id14D5DC135AB642E383A35DE4E4835CA5"><enum>(1)</enum><text>The heading of

			 section 21 of the Internal Revenue Code of 1986 is amended by striking

			 <quote><header-in-text level="section" style="OLC">and dependent care

			 services</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">, dependent care, and eldercare

			 services</header-in-text></quote>.</text>

					</paragraph><paragraph commented="no" id="id2AAAFF591BB646B8B8A3B73FF2FFA212"><enum>(2)</enum><text>The item relating

			 to section 21 in the table of sections for subpart A of part IV of subchapter A

			 of chapter 1 of such Code is amended striking <quote>and dependent care

			 services</quote> and inserting <quote>, dependent care, and eldercare

			 services</quote>.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id22321FC4D119409F9F7E86E13C2CE5E3"><enum>(d)</enum><header>Effective

			 date</header><text>The amendments made by this section shall apply to taxable

			 years beginning after December 31, 2005.</text>

				<subsection id="ID35638C62ABCD45BBA17DEFDC4DDDD874"><enum>(a)</enum><header>Amendments to

			 the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of

			 1974</act-name></header><text>Section 602 of the

			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of

			 1974</act-name> (29 U.S.C. 1162) is amended—</text>

					<paragraph id="ID2254F72B19B04F48AB30EDF6D0084599"><enum>(1)</enum><text>in paragraph

			 (2)(A), by adding at the end the following:</text>

				coverage under this clause shall end on the date on which the employee becomes

				entitled to benefits under title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> based on age.</text>

			 training</header>

			<section id="ID68C3887487CD4FC993A255D19A689D0E"><enum>301.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 101 of the Workforce Investment Act

			 of 1998 (29 U.S.C. 2801) is amended—</text>

				<paragraph id="ID1381909C87944A33842A53B26B20C3A1"><enum>(1)</enum><text>by redesignating

			 paragraphs (17) through (53) as paragraphs (18) through (54), respectively;

			 and</text>

				</paragraph><paragraph id="ID4AFE394D35D54FB0851C6CB794BFE13B"><enum>(2)</enum><text>by inserting

			 after paragraph (16) the following:</text>

				populations</header><text>The term <term>hard-to-serve populations</term> means

				populations of individuals who are hard to serve, including displaced

				homemakers, low-income individuals, Native Americans, individuals with

				disabilities, older individuals, ex-offenders, homeless individuals,

				individuals with limited English proficiency, individuals who do not meet the

				definition of literacy in section 203, individuals facing substantial cultural

				barriers, migrant and seasonal farmworkers, individuals within 2 years of

				exhausting lifetime eligibility under part A of title IV of the

				<act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 601 et

				seq.), single parents (including single pregnant women), and such other groups

				as the Governor determines to be hard to

				serve.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section id="ID9C83F755C5C142E89AE07517F5F623D6"><enum>302.</enum><header>Statewide

			 employment and training activities</header><text display-inline="no-display-inline">Section 134(a)(3)(A) of such Act (29 U.S.C.

			 2864 (a)(3)(A)) is amended—</text>

				<paragraph id="IDA77AD752909F43E8A8F86FA97ED5D07B"><enum>(1)</enum><text>in clause (vi),

			 by striking <quote>and</quote> at the end;</text>

				</paragraph><paragraph id="ID1534F93D46E54CF7B637CCF5202E27A1"><enum>(2)</enum><text>by redesignating

			 clause (vii) as clause (viii); and</text>

			 employment and training activities</header>

				<subsection id="ID48B549EB6BEB4A6DB6C9AB300D4B3CD7"><enum>(a)</enum><header>Intensive

			 Services</header><text>Section 134(d)(3) of such Act (29 U.S.C. 2864(d)(3)) is

			 amended by striking subparagraph (A) and inserting the following:</text>

					<quoted-block id="ID21E689F72C1E44B4A9832D8BA76D5E24" style="OLC">

						<subparagraph id="IDA47B37400E874285B8246842899389FD"><enum>(A)</enum><header>In

				general</header>

							<clause id="ID3DECF880371245809EFBE55B428EECEB"><enum>(i)</enum><header>Eligibility</header><text>Except

				as provided in clause (iii), funds allocated to a local area for adults under

				paragraph (2)(A) or (3), as appropriate, of section 133(b), and funds allocated

				to the local area for dislocated workers under section 133(b)(2)(B), shall be

				used to provide intensive services to adults and dislocated workers,

				respectively—</text>

								<subclause id="IDD9B3E6C7C1AD4BF5BB4815998283BABA"><enum>(I)</enum><text>who are

				unemployed and who, after an interview, evaluation, or assessment, have been

				determined by a one-stop operator or one-stop partner to be—</text>

									<item id="IDDB682452295C4856A3E9DB435B1B14D1"><enum>(aa)</enum><text>unlikely or

				unable to obtain employment, that leads to self-sufficiency or wages comparable

				to or higher than previous employment, through core services described in

				paragraph (2); and</text>

									</item><item id="ID3568DE93E66243119E4A4483ACC72F64"><enum>(bb)</enum><text>in

				need of intensive services to obtain employment that leads to self-sufficiency

				or wages comparable to or higher than previous employment; or</text>

									</item></subclause><subclause id="ID5B9C2DC789B245CE9A111235C139CCEE"><enum>(II)</enum><text>who are

				employed, but who, after an interview, evaluation, or assessment, are

				determined by a one-stop operator or one-stop partner to be in need of

				intensive services to obtain or retain employment that leads to

				self-sufficiency.</text>

								</subclause></clause><clause id="IDEF0A840E22F0467A919984E3DC20AB03"><enum>(ii)</enum><header>Consideration</header><text>For

				purposes of determining whether an adult or dislocated worker meets the

				requirements of clause (i)(I)(aa), a one-stop operator or one-stop partner

				shall consider whether the adult or dislocated worker is a member of a

				hard-to-serve population.</text>

							</clause><clause id="ID4C89BD872E404ED397ECAF467259D6B8"><enum>(iii)</enum><header>Special

				rule</header><text>A new interview, evaluation, or assessment of a participant

				is not required under clause (i) if the one-stop operator or one-stop partner

				determines that it is appropriate to use a recent assessment of the participant

				conducted pursuant to another education or training

				program.</text>

							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="IDC7976F3E52B442D1944068ECF69D307F"><enum>(b)</enum><header>Training

			 Services</header><text>Section 134(d)(4) of such Act (29 U.S.C. 2864(d)(4)) is

			 amended by striking subparagraph (A) and inserting the following:</text>

					<quoted-block id="ID8E23BCD1563F4189B46AADD2EEEC6A71" style="OLC">

						<subparagraph id="ID2236DADFA2914BC1BD5AB24B5B9B7873"><enum>(A)</enum><header>In

				general</header>

							<clause id="ID45F985EFF8D9460BA4762091D9D416A0"><enum>(i)</enum><header>Eligibility</header><text>Except

				as provided in clause (iii), funds allocated to a local area for adults under

				paragraph (2)(A) or (3), as appropriate, of section 133(b), and funds allocated

				to the local area for dislocated workers under section 133(b)(2)(B), shall be

				used to provide training services to adults and dislocated workers,

				respectively—</text>

								<subclause id="ID8AD814A2369244F7A3FAE97F99D384A9"><enum>(I)</enum><text>who, after an

				interview, evaluation, or assessment, and case management, have been determined

				by a one-stop operator or one-stop partner, as appropriate, to—</text>

									<item id="ID39A11BE64638461883ED2583C4B06226"><enum>(aa)</enum><text>be

				unlikely or unable to obtain or retain employment, that leads to

				self-sufficiency or wages comparable to or higher than previous employment,

				through the intensive services described in paragraph (3);</text>

									</item><item id="ID930B795DFF0C42C39425A018642F080E"><enum>(bb)</enum><text>be

				in need of training services to obtain or retain employment that leads to

				self-sufficiency or wages comparable to or higher than previous employment;

				and</text>

									</item><item id="IDD82FC7FD0A9B4547BC3F6BFA1E018470"><enum>(cc)</enum><text>have the skills

				and qualifications to successfully participate in the selected program of

				training services;</text>

									</item></subclause><subclause id="ID5B3CB5CF9D924620B4477FBCDC5A62B7"><enum>(II)</enum><text>who select

				programs of training services that are directly linked to the employment

				opportunities in the local area or region involved or in another area to which

				the adults or dislocated workers are willing to commute or relocate;</text>

								</subclause><subclause id="ID755C1185131A413BAEBB02F623DF9B9F"><enum>(III)</enum><text>who meet the

				requirements of subparagraph (B); and</text>

								</subclause><subclause id="IDC2A7C050A98744958FC6FA10680E232D"><enum>(IV)</enum><text>who are

				determined to be eligible in accordance with the priority system in effect

				under subparagraph (E).</text>

								</subclause></clause><clause id="IDF832FB6D4EF84D8CBCA8A27C80316D1B"><enum>(ii)</enum><header>Consideration</header><text>For

				purposes of determining whether an adult or dislocated worker meets the

				requirements of clause (i)(I)(aa), a one-stop operator or one-stop partner

				shall consider whether the adult or dislocated worker is a member of a

				hard-to-serve population.</text>

							</clause><clause id="ID73FD183E1D7348A09FAE3DCA5714AECA"><enum>(iii)</enum><header>Special

				rule</header><text>A new interview, evaluation, or assessment of a participant

					</paragraph></subsection></section><section id="ID7218043BA02C485BBE5FA385A3D5FBE4"><enum>304.</enum><header>Performance

			 measures</header>

				<subsection id="ID9FB327BA8E1543E084A29ECBD3154C9E"><enum>(a)</enum><header>State

			 Performance Measures</header><text>Section 136(b)(3)(A)(iv)(II) of the

			 Workforce Investment Act of 1998 (29 U.S.C. 2871(b)(3)(A)(iv)(II)) is

			 amended—</text>

					<paragraph id="IDEF752543D9784B6A8BB0C8044BCFF4A0"><enum>(1)</enum><text>by striking

			 <quote>taking into account</quote> and inserting <quote>and shall ensure that

			 the levels involved are adjusted, using objective statistical methods, based

			 on</quote>;</text>

					</paragraph><paragraph id="ID396CE57EBCBD448EB4822E4FA7CD393B"><enum>(2)</enum><text>by inserting

			 <quote>(such as differences in unemployment rates and job losses or gains in

					</paragraph><paragraph id="ID7489DCDD156945F693755AA9C32C9DC3"><enum>(3)</enum><text>by inserting

			 <quote>(such as indicators of poor work history, lack of work experience, lack

			 disability status, older individual status, homelessness, ex-offender status,

			 and welfare dependency)</quote> after <quote>program</quote>.</text>

					</paragraph></subsection><subsection id="ID8186A5FA3A1D4E1FB5FC2AC17564B141"><enum>(b)</enum><header>Local

			 for Statewide Employment and Training Activities</header><text>Section

			 134(a)(2)(B) of the Workforce Investment Act of 1998 (29 U.S.C. 2864(a)(2)(B))

			 is amended—</text>

					<paragraph id="ID3585480630164EA8A93A86F7F15217D0"><enum>(1)</enum><text>in clause (v), by

			 striking <quote>and</quote> at the end;</text>

					</paragraph><paragraph id="IDF119F88E0831477688D64E151C0587A8"><enum>(2)</enum><text>in clause (vi),

			 by striking the period and inserting <quote>; and</quote>; and</text>

			 end the following:</text>

					</paragraph></subsection><subsection id="IDC8E7E524E0EF440482BF6452817847AD"><enum>(b)</enum><header>Incentive

			 Grants for Local Areas</header><text>Section 136 of such Act is amended by

			 adding at the end the following:</text>

					<quoted-block id="ID79CC509759BF412AA00410B450ADE954" style="OLC">

						<subsection id="ID7C95F43447924AEBB9C773AEB22A6DF8"><enum>(j)</enum><header>Incentive

				Grants for Local Areas</header>

							<paragraph id="ID8B8BF7851D1D48B5A16C62D431036CFB"><enum>(1)</enum><header>In

				general</header><text>From funds reserved under sections 128(a) and 133(a)(1),

				the Governor involved shall award incentive grants to local areas for

				performance described in paragraph (2) in carrying out programs under chapters

				4 and 5.</text>

							</paragraph><paragraph id="ID28D833E0C9634C23B595756FFFAED8CD"><enum>(2)</enum><header>Basis</header><text>The

				Governor shall award the grants on the basis that the local areas—</text>

								<subparagraph id="ID5E4B75C4615A439989B7050418E60CEB"><enum>(A)</enum><text>have exceeded the

				performance measures established under subsection (c)(2) relating to indicators

				described in subsection (b)(3)(A)(iii); or</text>

								</subparagraph><subparagraph id="ID066695A9BDD648A2B3240506283D4641"><enum>(B)</enum><text>have—</text>

									<clause id="ID681240193D534567A87E538125B51DB4"><enum>(i)</enum><text>met the

				performance measures established under subsection (c)(2) relating to indicators

				described in subsection (b)(3)(A)(iii); and</text>

									</clause><clause id="IDCCE31CF2496C4B0EB88A4E3593F5CE34"><enum>(ii)</enum><text>demonstrated

				exemplary performance in the State in serving hard-to-serve populations.</text>

									</clause></subparagraph></paragraph><paragraph id="ID15F04462BE28404BA45ADBD9C1B8D510"><enum>(3)</enum><header>Use of

				funds</header><text>The funds awarded to a local area under this subsection may

				be used to carry out activities authorized for local areas and such innovative

				projects or programs that increase coordination and enhance service to program

				participants, particularly hard-to-serve populations, as may be approved by the

				Governor.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="IDF899C89723974E0CBCCC1188655596AE"><enum>(c)</enum><header>Incentive

			 Grants for States</header><text>Section 503 of the Workforce Investment Act of

			 1998 (20 U.S.C. 9273) is amended—</text>

					<paragraph id="IDB25E2E923522477ABF988ADD1E70CBD3"><enum>(1)</enum><text>by striking

			 subsection (a) and inserting the following:</text>

							<subsection id="IDCE417E4C4B17462E87E074CCBBB794D6"><enum>(a)</enum><header>In

				General</header>

								<paragraph id="ID038347FEC0AB411CACE78C1BE30B62E7"><enum>(1)</enum><header>Timeline</header>

									<subparagraph id="ID204BEEA7381E4F4E886681B3969DC8B4"><enum>(A)</enum><header>Prior to july

				1, 2006</header><text>Prior to July 1, 2006, the Secretary shall award a grant

				to each State in accordance with the provisions of this section as this section

				was in effect on July 1, 2003.</text>

									</subparagraph><subparagraph id="ID051FD4DBF6A1412BBA4F3C8F90ABED5A"><enum>(B)</enum><header>Beginning july

				1, 2006</header><text>Beginning on July 1, 2006, the Secretary shall award

				incentive grants to States for performance described in paragraph (2) in

				carrying out innovative programs consistent with the programs under chapters 4

				and 5 of subtitle B of title I, to implement or enhance innovative and

				coordinated programs consistent with the statewide economic, workforce, and

				educational interests of the State.</text>

									</subparagraph></paragraph><paragraph id="ID650D73B7A8A34B62933AF4A467CEA856"><enum>(2)</enum><header>Basis</header><text>The

				Secretary shall award the grants on the basis that States—</text>

									<subparagraph id="ID6532B50EACEA435E98310645AB2C34EB"><enum>(A)</enum><text>have exceeded the

				State adjusted levels of performance for title I, the adjusted levels of

				performance for title II, and the levels of performance under the Carl D.

				Perkins Vocational and Technical Education Act of 1998 (20 U.S.C. 2301 et

				seq.); or</text>

									</subparagraph><subparagraph id="IDD621E0907115425683D92C270EC55763"><enum>(B)</enum><text>have—</text>

										<clause id="IDF2F6C62D44CF4254900E385FD933E8F9"><enum>(i)</enum><text>met the State

				adjusted levels of performance for title I, the adjusted levels of performance

				for title II, and the levels of performance under the Carl D. Perkins

				Vocational and Technical Education Act of 1998 (20 U.S.C. 2301 et seq.);

				and</text>

										</clause><clause id="IDCE120160EB09443A80A330EEE7EAED7A"><enum>(ii)</enum><text>demonstrated

				exemplary performance in serving hard-to-serve populations.</text>

										</clause></subparagraph></paragraph><paragraph id="ID02D2995B88514925B48480CD85FE5B80"><enum>(3)</enum><header>Use of

				funds</header><text>The funds awarded to a State under this section may be used

				to carry out activities authorized for States under chapters 4 and 5 of

				subtitle B of title I, title II, and the Carl D. Perkins Vocational and

				Technical Education Act of 1998 (20 U.S.C. 2301 et seq.), including

				demonstration projects, and for such innovative projects or programs that

				increase coordination and enhance service to program participants, particularly

				hard-to-serve populations.</text>

								</paragraph></subsection><after-quoted-block>;

				and</after-quoted-block></quoted-block>

					</paragraph><paragraph id="ID437A1FB9CE2B44F792E9E0E5DBE3D943"><enum>(2)</enum><text>in subsection

			 (b)(2), by striking subparagraph (C) and inserting the following:</text>

						<quoted-block display-inline="no-display-inline" id="ID34967BB85DB64195845E47FBA7565504" style="OLC">

							<subparagraph id="IDDEF6E88ECDCB49B1853A9DFD06DF99A8"><enum>(C)</enum><text>the State meets

				the requirements of subparagraph (A) or (B) of subsection

				(a)(2).</text>

							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection></section></title><title id="idCA256AF6451747B8B3369ACAF51AB9CC"><enum>IV</enum><header>Federal task

			 force on older workers</header>

			<section id="id65D4D5B5AD4F4C8E9787CD52284AF2B5"><enum>401.</enum><header>Federal task

			 force on older workers</header>

				<subsection id="id5BC6215DE0CE492CAC555013C9792F95"><enum>(a)</enum><header>Establishment</header><text>Not

			 later than 90 days after the date of enactment of this Act, the Secretary of

			 Labor shall establish a Federal Task Force on Older Workers (referred to in

			 this Act as the <quote>Task Force</quote>).</text>

				</subsection><subsection id="id41FB6768720D41B58425B3E4188108B4"><enum>(b)</enum><header>Membership</header><text>The

			 Task Force established pursuant to subsection (a) shall be composed of

			 representatives from all relevant Federal agencies that have regulatory

			 jurisdiction over, or a clear policy interest in, issues relating to older

			 workers, including the Internal Revenue Service, the Social Security

			 Administration, the Equal Employment Opportunity Commission, and the

			 Administration on Aging of the Department of Health and Human Services.</text>

				</subsection><subsection id="id23CEBD24F6704EB68D54111C879866B2"><enum>(c)</enum><header>Activities</header>

					<paragraph id="idCD552E9FA224483EA59EC7A96CFCDA0E"><enum>(1)</enum><header>After one

			 year</header><text>Not later than 1 year after the date of establishment of the

			 Task Force, the Task Force shall—</text>

						<subparagraph id="IDa7ebebd979e74090b8a3519c67925435"><enum>(A)</enum><text>identify

			 statutory and regulatory provisions in current law that tend to limit

			 opportunities for older workers, and develop legislative and regulatory

			 proposals to address such limitations;</text>

						</subparagraph><subparagraph id="id03B61F414C86436AA385F62D4A9B1047"><enum>(B)</enum><text>identify best

			 practices in the private sector for hiring and retaining older workers, and

			 serve as a clearinghouse of such information; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcc516ec630fe407d97b4e953514ed7ec"><enum>(C)</enum><text>assess the

			 effectiveness and cost of programs that Federal agencies have implemented to

			 hire and retain older workers (including the Senior Environmental Employment

			 (SEE) Program of the Environmental Protection Agency), and recommend

			 cost-effective programs for all Federal agencies to hire and retain older

			 workers.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id274B8AD943884F15B0F2075C24EEBC24"><enum>(2)</enum><header>After three

			 years</header><text>Not later than 3 years after the date of establishment of

			 the Task Force, the Task Force shall—</text>

						<subparagraph id="ID010d873ec837424d9aef8e5f210aebcc"><enum>(A)</enum><text>assess the

			 effectiveness of the provisions of this Act; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID741253a6c72542589ad8fbbc7ce3c3bb"><enum>(B)</enum><text>organize a

			 Conference on the Aging Workforce, which shall include the participation of

			 senior, business, labor, and other interested organizations.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC824379A520F4EA99B9A4B4591B8359E"><enum>(3)</enum><header>Report</header><text>The

			 Task Force shall submit a report to Congress on the activities of the Task

			 Force pursuant to paragraph (1). Such report shall be made available to the

			 public.</text>

					</paragraph></subsection><subsection id="idFA6B19FCCA2042CAA8C775A6F7CF9D20"><enum>(d)</enum><header>Consultation</header><text>In

			 carrying out activities pursuant to this section, the Task Force shall consult

			 with senior, business, labor, and other interested organizations.</text>

				</subsection><subsection id="idC9438EBFA7B84589B87A220BC2A6FEB6"><enum>(e)</enum><header>Applicability

			 of FACA; termination of task force</header>

					<paragraph id="idA900047D38F04830987061BFBAA6460F"><enum>(1)</enum><header>FACA</header><text>The

			 Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Task

			 Force established pursuant to this Act.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9D1028B4476F442E99EB8190704CBC24"><enum>(2)</enum><header>Termination</header><text>The

			 Task Force shall terminate 30 days after the date the Task Force completes all

			 of its duties under this Act.</text>
