		<official-title>To amend titles 10 and 38 of the United States Code, to

		  modify the circumstances under which a person who has committed a capital

		  offense is denied certain burial-related benefits and funeral

		  honors.</official-title>

		<section id="idB557690515734516B8B05829B39BAD85" section-type="section-one"><enum>1.</enum><header>Prohibition against interment

			 in national cemetery</header><text display-inline="no-display-inline">Section

			 2411 of title 38, United States Code, is amended—</text>

			<paragraph id="id7CF70365C24E4FDB98D8CB0710990B68"><enum>(1)</enum><text>in subsection

			 (b)—</text>

				<subparagraph id="id65F85CF6EF1040DBAA223D9CE25BB13C"><enum>(A)</enum><text>in paragraph (1),

			 by striking <quote> for which the person was sentenced to death or life

			 imprisonment</quote>; and</text>

				</subparagraph><subparagraph id="idC7B522DA064E4271B8E6B0FA3F500711"><enum>(B)</enum><text>in paragraph (2),

			 by striking <quote> for which the person was sentenced to death or life

			 imprisonment without parole</quote>; and</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB506DBBAC1DB49FBBAE42BC83301EF90"><enum>(2)</enum><text>in subsection

			 (d)—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="idB7F51738772546E6B7A54D09A75D0094"><enum>(A)</enum><text>in paragraph (1),

			 by striking <quote>the death penalty or life imprisonment</quote> and inserting

			 <quote>a life sentence or the death penalty</quote>; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBB183F04BC464AA0BF27E7B9C3BC9006"><enum>(B)</enum><text>in paragraph (2),

			 by striking <quote>the death penalty or life imprisonment without parole may be

			 imposed</quote> and inserting <quote>a life sentence or the death penalty may

			 be imposed</quote>.</text>

				</subparagraph></paragraph></section><section id="idE3A51449F51341A2A12A4C451E332ABF" section-type="subsequent-section"><enum>2.</enum><header>Denial of certain

			 burial-related benefits</header><text display-inline="no-display-inline">Section 985 of title 10, United States Code,

			 is amended—</text>

			<paragraph id="idDA449A5C2A054BA0A3BBD1823CAF3E6F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>who

			 has been convicted of a capital offense under Federal or State law for which

			 the person was sentenced to death or life imprisonment without parole.</quote>

			 and inserting <quote>described in section 2411(b) of title 38.</quote>;</text>

			</paragraph><paragraph id="id5356B906531D4D2BBFF19E54555C7B86"><enum>(2)</enum><text>in subsection

			 (b), by striking <quote>convicted of a capital offense under Federal

			 law</quote> and inserting <quote>described in section 2411(b) of title

			 38</quote>; and</text>

			</paragraph><paragraph id="id28C4FAD409384583BF7C5A1E1DC5EDA3"><enum>(3)</enum><text>by amending

			 subsection (c) to read as follows:</text>

				<quoted-block display-inline="no-display-inline" id="idA329FB484A6C40A2938CD7D4EB206F0E" style="OLC">

					<subsection id="id0E57D56D3349406A8083914785FCA9B6"><enum>(c)</enum><header>Definition</header><text>In

				this section, the term <term>burial</term> includes

				inurnment.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="id19972C39D1FD46B2BCA63F1E25ABFC9B"><enum>3.</enum><header>Denial of

			 funeral honors</header><text display-inline="no-display-inline">Section 1491(h)

			 of title 10, United States Code, is amended—</text>

			<paragraph id="idBA91B96901E74395B2D83C9CB5AFBBC1"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as

			 subparagraphs (A) and (B), respectively;</text>

			</paragraph><paragraph id="id39EA17FE7E9F403FA7C7EBC2595DC66E"><enum>(2)</enum><text>by striking

			 <quote> means a decedent who—</quote> and inserting the following: “—</text>

				<quoted-block display-inline="no-display-inline" id="id311DF4A74F184D57A07E7DA69FE255B2" style="OLC">

					<paragraph id="id0DFBD7DCE21C41BD8E3200525380FD84"><enum>(1)</enum><text>means a decedent

				who—</text>

					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

			</paragraph><paragraph id="idEDB3A09C0F4D4991ADD231DDB1E5B629"><enum>(3)</enum><text>in subparagraph

			 (B), as redesignated, by striking the period at the end and inserting <quote>;

			 and</quote>; and</text>

			</paragraph><paragraph id="id68D09D205C22405693BA18B8CEE71BC1"><enum>(4)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id2C107FF9B0754DF1BA549160D750EF6E" style="OLC">

					<paragraph id="id202A466D2CB1473B827C8640AD330CE3"><enum>(2)</enum><text>does not include

				any person described in section 2411(b) of title

				38.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="idE8906576468941C286633E5226AC0FA3"><enum>4.</enum><header>Rulemaking</header>

			<subsection id="idB0F1BF0FA2AC4ADAAD1F262130C1F319"><enum>(a)</enum><header>Department of

			 defense</header><text display-inline="yes-display-inline">The Secretary of

			 Defense shall prescribe regulations to ensure that a person is not interred in

			 any military cemetery under the authority of the Secretary or provided funeral

			 honors under section 1491 of title 10, United States Code, unless a good faith

			 effort has been made to determine whether such person is described in section

			 2411(b) of title 38, United States Code, or is otherwise ineligible for such

			 interment or honors under Federal law.</text>

			</subsection><subsection id="idAA79CDE410FC44CEB629686B235EC886"><enum>(b)</enum><header>Department of

			 veterans affairs</header><text display-inline="yes-display-inline">The

			 Secretary of Veterans Affairs shall prescribe regulations to ensure that a

			 person is not interred in any cemetery in the National Cemetery System unless a

			 good faith effort has been made to determine whether such person is described

			 in section 2411(b) of title 38, United States Code, or is otherwise ineligible

			 for such interment under Federal law.</text>
