		  certain coastal States to share in qualified outer Continental Shelf

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Outer Continental Shelf Revenue

			 Sharing Act of 2005</short-title></quote>.</text>

		</section><section id="IDCC1170C35CCB4E70B1CC901F29739E6E"><enum>2.</enum><header>Outer

			 Continental Shelf revenue sharing</header>

			<subsection id="ID7C815ACC62EE45B8AA9255D9E48FB80C"><enum></enum><text>Section 31 of

			 the Outer Continental Shelf Lands Act (43 U.S.C. 1356a) is amended—</text>

				<paragraph id="id68053A3A0EEB4B18BEEAF6F563C84503"><enum>(1)</enum><text>in subsection

			 (a)—</text>

					<subparagraph id="id7FAA6CEC76534F96BBD19294061C432C"><enum>(A)</enum><text>by striking

			 paragraph (7);</text>

					</subparagraph><subparagraph id="idE85AF1BFBCE7472994AC647558C5D518"><enum>(B)</enum><text>by redesignating

			 paragraphs (8), (9), and (10) as paragraphs (7), (8), and (9),

			 respectively;</text>

					</subparagraph><subparagraph id="idC53E2A16870D4C1C9E68F8A282257CC8"><enum>(C)</enum><text>in paragraph (8)

			 (as redesignated by subparagraph (B)), by striking subparagraph (B) and

			 inserting the following:</text>

						<quoted-block display-inline="no-display-inline" id="idEDE1B1F41DE44C00A31F2F3DDE774AC8" style="OLC">

							<subparagraph id="id234324ABED584C42A1A069F474AAE507"><enum>(B)</enum><header>Inclusion</header><text>The

				term <term>producing State</term> includes any State that begins production on

				a leased tract on or after the date of enactment of the Outer Continental Shelf

				Revenue Sharing Act of 2005, regardless of whether the leased tract was on any

				date subject to a leasing moratorium.</text>

							</subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

					</subparagraph><subparagraph id="idC809E84FAB484028B30BA2083446D566"><enum>(D)</enum><text>in paragraph (9)

			 (as redesignated by subparagraph (B)), by striking subparagraph (C); and</text>

					</subparagraph></paragraph><paragraph id="idC8D3FF2DAEF54AF3B88BC6281F679979"><enum>(2)</enum><text>in subsection

			 (b)(4), by striking subparagraph (E).</text>

				</paragraph></subsection></section><section id="ID29388D3868854943B6D6C7F46210C875"><enum>3.</enum><header>Establishment of

			 Seaward Lateral Boundaries for Coastal States</header><text display-inline="no-display-inline">Section 4(a)(2)(A) of the Outer Continental

			 Shelf Lands Act (43 U.S.C. 1333(a)(2)(A)) is amended—</text>

			<paragraph id="IDCFC2A6D7382B409EB73E08D8AD7053D1"><enum>(1)</enum><text>by inserting

			 <quote>(i)</quote> after <quote>(A)</quote>;</text>

			</paragraph><paragraph id="IDAC61246A105A4F368180642DAFC83864"><enum>(2)</enum><text>in the first

			 sentence—</text>

				<subparagraph id="ID750B04DDBE5C4D1085122BC05DCCBCEB"><enum>(A)</enum><text>by striking

			 <quote>President shall</quote> and inserting <quote>Secretary shall by

			 regulation</quote>; and</text>

				</subparagraph><subparagraph id="ID4804E72BD87B4AD18AD7EFB916B40B73"><enum>(B)</enum><text>by inserting

			 before the period at the end the following: <quote>not later than 180 days

			 after the date of enactment of the Outer Continental Shelf Revenue Sharing Act

			 of 2005</quote>; and</text>

				</subparagraph></paragraph><paragraph id="ID028E88FEB5E14910923D51B09175CA08"><enum>(3)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block id="ID51E2257E8D184E0197F01C97E48CA13D" style="OLC">

					<clause id="ID676C526D4EDB44B48565E8CBF2103DD8" indent="up3"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="ID90693D1F45D644FB9DFDFFB585412A3A"><enum>(I)</enum><text>For purposes of this

				Act (including determining boundaries to authorize leasing and preleasing

				activities and any attributing revenues under this Act and calculating payments

				to producing States and coastal political subdivisions under section 31), the

				Secretary shall delineate the lateral boundaries between coastal States in

				areas of the Outer Continental shelf under exclusive Federal jurisdiction, to

				the extent of the exclusive economic zone of the United States, in accordance

				with article 15 of the United Nations Convention on the Law of the Sea of

				December 10, 1982.</text>

						</subclause><subclause id="id964F19397C0945D0AF983BC1542CE67F" indent="up1"><enum>(II)</enum><text>This clause shall not affect any

				right or title to Federal submerged land on the outer Continental

				Shelf.</text>

						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="IDD1CF04FCDDB240FDBD3B4D57980C5793"><enum>4.</enum><header>Option to

			 Petition for Leasing Within Certain Areas on the Outer Continental

			 Shelf</header><text display-inline="no-display-inline">Section 12 of the Outer

			 Continental Shelf Lands Act (43 U.S.C. 1341) is amended by adding at the end

			 the following:</text>

			<quoted-block id="ID10EA06FC150B482480FEE234AFFF1DC3" style="OLC">

				<subsection id="IDDEAE414518BE41C69BD697DCC7794946"><enum>(g)</enum><header>Leasing Within

				the Seaward Lateral Boundaries of Coastal States</header>

					<paragraph id="ID8CDE964F56BF48C49BD3EB671D9BB683"><enum>(1)</enum><header>Definition of

				affected area</header><text>In this subsection, the term <term>affected

				area</term> means any area located—</text>

						<subparagraph id="ID9067058F5B804DAAB6E6534AD34A8E82"><enum>(A)</enum><text>in the areas of

				northern, central, and southern California and the areas of Oregon and

				Washington;</text>

						</subparagraph><subparagraph id="ID6B6BFD956325407AB4B67462312A75B6"><enum>(B)</enum><text>in the north,

				middle, or south planning area of the Atlantic Ocean;</text>

						</subparagraph><subparagraph id="IDD1346B9F165D4CF2BC4954DB07716A71"><enum>(C)</enum><text>in the eastern

				Gulf of Mexico planning area and lying—</text>

							<clause id="IDE8342D0C35F341E183E34007B6E4ABBB"><enum>(i)</enum><text>south of 26

				degrees north latitude; and</text>

							</clause><clause id="ID409DF1A3E9024CF5AE4AD06EADDF7FE7"><enum>(ii)</enum><text>east of 86

				degrees west longitude; or</text>

							</clause></subparagraph><subparagraph id="ID145ED77A4CF947B3A7110F2407F7922D"><enum>(D)</enum><text>in the Straits of

				Florida.</text>

						</subparagraph></paragraph><paragraph id="ID4E80155CA9064EC18115C4041F046D92"><enum>(2)</enum><header>Restrictions on

				leasing</header><text>The Secretary shall not offer for offshore leasing,

				preleasing, or any related activity—</text>

						<subparagraph id="IDB67C47D68EC347BDA7144A9FAB81E27D"><enum>(A)</enum><text>any area located

				on the outer Continental Shelf that, as of the date of enactment of this

				subsection, is designated as a marine sanctuary under the Marine Protection,

				Research, and Sanctuaries Act of 1972 (33 U.S.C. 1401 et seq.); or</text>

						</subparagraph><subparagraph id="ID5341FADE3C8D4FFEB2862A3A4C5FB037"><enum>(B)</enum><text>except as

				provided in paragraphs (3) and (4), during the period beginning on the date of

				enactment of this subsection and ending on June 30, 2012, any affected

				area.</text>

						</subparagraph></paragraph><paragraph id="ID90EEB8072AAD4602B144695D43F0D7DF"><enum>(3)</enum><header>Resource

				assessments</header>

						<subparagraph id="IDD6A5AEFDC4B84BF8BCF1E613F64DE961"><enum>(A)</enum><header>In

				general</header><text>Beginning on the date on which the Secretary delineates

				seaward lateral boundaries under section 4(a)(2)(A)(ii), a Governor of a State

				in which an affected area is located, with the consent of the legislature of

				the State, may submit to the Secretary a petition requesting a resource

				assessment of any area within the seaward lateral boundary of the State.</text>

						</subparagraph><subparagraph id="ID6AA5EDDC7FB2418294F74CB73CEDBD02"><enum>(B)</enum><header>Eligible

				resources</header><text>A petition for a resource assessment under subparagraph

				(A) may be for—</text>

							<clause id="ID771EC25315AF4C5E9238311EC5C4054C"><enum>(i)</enum><text>oil and gas

				leasing;</text>

							</clause><clause id="IDBBA6E76E971B4959A967F78D8AC8BD5B"><enum>(ii)</enum><text>gas-only

				leasing; or</text>

							</clause><clause id="IDC368000E32B545A48A66203C73362A63"><enum>(iii)</enum><text>any other

				energy source leasing, including renewable energy leasing.</text>

							</clause></subparagraph><subparagraph id="IDF1820DEB6D774FBA8EDB09FAF52F77FF"><enum>(C)</enum><header>Action by

				secretary</header><text>Not later than 90 days after receipt of a petition

				under subparagraph (A), the Secretary shall approve the petition, unless the

				Secretary determines that a resource assessment of the area would create an

				unreasonable risk of harm to the marine, human, or coastal environment of the

				State.</text>

						</subparagraph><subparagraph id="IDAC45C5DFEA69489DAFD2D60D6A1B3292"><enum>(D)</enum><header>Failure to

				act</header><text>If the Secretary fails to approve or deny a petition in

				accordance with subparagraph (C)—</text>

							<clause id="ID882C0FAA4D684F969A84CB291A1C522D"><enum>(i)</enum><text>the petition

				shall be considered to be approved; and</text>

							</clause><clause id="ID9D02EC57040749DCA42F4C34EB1F01C7"><enum>(ii)</enum><text>a resource

				assessment of any appropriate area shall be carried out as soon as

				practicable.</text>

							</clause></subparagraph><subparagraph id="ID36D6DADBD4484068A0D61BD4ADABCAB0"><enum>(E)</enum><header>Submission to

				state</header><text>As soon as practicable after the date on which a petition

				is approved under subparagraph (C) or (D), the Secretary shall—</text>

							<clause id="IDBAE026D24B7643FF8A001F278091083B"><enum>(i)</enum><text>complete the

				resource assessment for the area; and</text>

							</clause><clause id="ID4A426FD3D4C74A129D26CEA827788A54"><enum>(ii)</enum><text>submit the

				completed resource assessment to the State.</text>

							</clause></subparagraph></paragraph><paragraph id="IDBE7E5B59BDFA45F58E1F0498408C598A"><enum>(4)</enum><header>Petition for

				leasing</header>

						<subparagraph id="IDD841ED39290843A0B92C4277D115F96B"><enum>(A)</enum><header>In

				general</header><text>On receipt of a resource assessment under paragraph

				(3)(E)(ii), the Governor of a State in which an affected area is located, with

				the consent of the legislature of the State, may submit to the Secretary a

				petition requesting that the Secretary make available any land that is within

				the seaward lateral boundaries of the State (as established under section

				4(a)(2)(A)(ii)) and that is greater than 20 miles from the coastline of the

				State for the conduct of offshore leasing, pre-leasing, or related activities

				with respect to—</text>

							<clause id="IDF4CCE46052604F078A401EDB78DDE468"><enum>(i)</enum><text>oil and gas

				leasing;</text>

							</clause><clause id="IDCDCB95C52B7F44EAAFDF6C48944C986E"><enum>(ii)</enum><text>gas-only

				leasing; or</text>

							</clause><clause id="ID9F8ED03B28A4464BBD125A6001029FB9"><enum>(iii)</enum><text>any other

				energy source leasing, including renewable energy leasing.</text>

							</clause></subparagraph><subparagraph id="ID6446A5ED66D34AF4B6BDFF625F99CAC2"><enum>(B)</enum><header>Action by

				secretary</header><text>Not later than 90 days after receipt of a petition

				under subparagraph (A), the Secretary shall approve the petition, unless the

				Secretary determines that leasing the area would create an unreasonable risk of

				harm to the marine, human, or coastal environment of the State.</text>

						</subparagraph><subparagraph id="IDE076DF361D5F4E8FA164DAA265F6975E"><enum>(C)</enum><header>Failure to

				act</header><text>If the Secretary fails to approve or deny a petition in

				accordance with subparagraph (B)—</text>

							<clause id="ID330EE43B5D5B4CE8B6AC0A061681ED77"><enum>(i)</enum><text>the petition

				shall be considered to be approved; and</text>

							</clause><clause id="ID815275E97C1E4B2087F9192256DB0320"><enum>(ii)</enum><text>any appropriate

				area shall be made available for oil and gas leasing, gas-only leasing, or any

				other energy source leasing, including renewable energy leasing.</text>

							</clause></subparagraph></paragraph><paragraph id="ID8F29E6A91D4D4432B0F652E0019A47BD"><enum>(5)</enum><header>Revenue

				sharing</header>

						<subparagraph id="ID434B870C5B184945ACF12FEDD2573398"><enum>(A)</enum><header>In

				general</header><text>Beginning on the date on which production begins in an

				area under this subsection, the State shall, without further appropriation,

				share in any qualified outer Continental Shelf revenues of the production under

				section 31.</text>

						</subparagraph><subparagraph id="ID526CD696A9524029AD5C33EC010FC499"><enum>(B)</enum><header>Applicable

				law</header>

							<clause id="ID5251D4DA347345D9B5A0ECA2E23EA805"><enum>(i)</enum><header>In

				general</header><text>Except as provided in clause (ii), a State shall not be

				required to comply with subsections (c) and (d) of section 31 to share in

				qualified outer Continental Shelf revenues under subparagraph (A).</text>

							</clause><clause id="ID52467E02D3784E46A4003B5C9011E798"><enum>(ii)</enum><header>Exception</header><text>Of

				any qualified outer Continental Shelf revenues received by a State (including a

				political subdivision of a State) under subparagraph (A), at least 25 percent

				shall be used for 1 or more of the purposes described in section

				31(d)(1).</text>

							</clause></subparagraph></paragraph><paragraph id="IDE8BD4EB824464C18A20E4B8E7BA43C39"><enum>(6)</enum><header>Effect</header><text>Nothing

				in this subsection affects any right relating to an area described in paragraph

				(1) or (2) under a lease that was in existence on the day before the date of

				enactment of this

				subsection.</text>

					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="id0CB4FAB44EEF470B8FD24787171A6E91"><enum>5.</enum><header>Regulations</header>

			<subsection id="ID2496BD5D73E04A61822477217E9BAF57"><enum>(a)</enum><header>In

			 general</header><text>The Secretary of the Interior shall issue such

			 regulations as are necessary to carry out this Act and the amendments made by

			 this Act, including regulations establishing procedures for entering into

			 gas-only leases.</text>

			</subsection><subsection id="ID82AE7581052C43FC89085471F548AF6A"><enum>(b)</enum><header>Gas-only

			 leases</header><text>In issuing regulations establishing procedures for

			 entering into gas-only leases, the Secretary shall—</text>

				<paragraph id="IDC9FF79979B0144F99A0EC4EF11F321C7"><enum>(1)</enum><text>ensure that

			 gas-only leases under the Outer Continental Shelf Lands Act (43 U.S.C. 1331 et

			 seq.) are not available in a State that (as of the day before the date of

			 enactment of this Act) did not contain an affected area (as defined in section

			 12(g)(1) of that Act (as added by section 4)); and</text>

				</paragraph><paragraph id="IDDD454814E4914448BEE3CB07BC5AD5B0"><enum>(2)</enum><text>define

			 <quote>natural gas</quote> as—</text>

					<subparagraph id="IDF5748872A34C4A5DA5FD5876062FD30A"><enum>(A)</enum><text>unmixed natural

			 gas; or</text>

					</subparagraph><subparagraph id="IDC1E1CA44ED32465F819781A83B59E171"><enum>(B)</enum><text>any mixture of

			 natural or artificial gas (including compressed or liquefied petroleum gas) and

			 condensate recovered from natural gas.</text>

					</subparagraph></paragraph></subsection></section></legis-body>
