			<paragraph commented="no" display-inline="no-display-inline" id="id11AE27042C224DF8BAD2EDD3045F8193"><enum>(1)</enum><text>the terms

			 <term>Administration</term> and <term>Administrator</term> mean the Small

			 Business Administration and the Administrator thereof, respectively;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEF68BEAE9E754C1696E7719DBC299B62"><enum>(2)</enum><text>the term

			 <term>Disaster Area</term> means an area which the President has designated as

			 a disaster area as a result of Hurricane Katrina of August 2005 or Hurricane

			 Rita of September 2005; and</text>

			</paragraph><paragraph id="id7E1597EFF09E4FB5947C2F480D4CF608"><enum>(3)</enum><text>the term

			 <term>small business concern</term> has the same meaning as in section 3 of the

			 Small Business Act.</text>

			</paragraph></section><section id="idF19CD0A023CB4AFAA58CD2AAACCAB717"><enum>3.</enum><header>Disaster loans

			 after Hurricane Katrina and Hurricane Rita</header>

			<subsection id="idEC701BBC0F9644929C41D60CFB4E1F78"><enum>(a)</enum><header>In a disaster

			 area</header><text>Section 7(b) of the <act-name parsable-cite="SBA">Small

			 Business Act</act-name> (15 U.S.C. 636(b)) is amended by inserting immediately

			 after paragraph (3) the following:</text>

				<quoted-block act-name="Small Business Act" id="ID8B9076822C2A4B698E6C436BC3D0ABBF">

					<paragraph id="IDA278B8FC7A124A96A74C9218F1223E77"><enum>(4)</enum><header>Disaster loans

				after hurricane katrina and hurricane rita in a disaster area</header>

						<subparagraph id="idCEB211AA33DA44589361E2EB2097141D"><enum>(A)</enum><header>Definition</header><text>In

				this paragraph, the term <term>Disaster Area</term> means an area which the

				President has designated as a disaster area as a result of Hurricane Katrina of

				August 2005 or Hurricane Rita of September 2005.</text>

						</subparagraph><subparagraph id="idA8EFBF9684BB4B36856F4075A0ACA7F4"><enum>(B)</enum><header>Loans to

				nonprofits</header><text>In addition to any other loan authorized by this

				subsection, the Administrator may make such loans under this subsection (either

				directly or in cooperation with banks or other lending institutions through

				agreements to participate on an immediate or deferred basis) as the

				Administrator determines appropriate to a nonprofit organization located or

				operating in a Disaster Area or providing services to persons who have

				evacuated from a Disaster Area.</text>

						</subparagraph><subparagraph id="idD0C758E7597F4FE69DBBEDE3174AB7A2"><enum>(C)</enum><header>Increased loan

				caps</header>

							<clause id="idB6CECC08DCD5492F8425A6DFFEF2094B"><enum>(i)</enum><header>Aggregate loan

				amounts</header><text>Except as provided in clause (ii), the aggregate loan

				amount outstanding and committed to a borrower under this subsection, except

				for loans under paragraph (5) or (6), made as a result of Hurricane Katrina or

				Hurricane Rita, may not exceed $10,000,000.</text>

							</clause><clause id="idC6A71643D21443F4873388E1068F65DD"><enum>(ii)</enum><header>Waiver

				authority</header><text>The Administrator may, at the discretion of the

				Administrator, waive the aggregate loan amount established under clause

				(i).</text>

							</clause></subparagraph><subparagraph id="ID2AF2C8B8721542FEB1A1C3123DE99DAF"><enum>(D)</enum><header>Deferment of

				disaster loan payments</header>

							<clause id="ID3E5ACED7C7954E57B337D9A607D0F6FB"><enum>(i)</enum><header>In

				general</header><text>Notwithstanding any other provision of law, payments of

				principal and interest on a loan to a borrower located in a Disaster Area made

				before August 24, 2007, shall be deferred, and no interest shall accrue with

				respect to such loan, during the time period described in clause (ii).</text>

							</clause><clause id="id234F4C262F484BFD8F40C0163056CA3A"><enum>(ii)</enum><header>Time

				period</header><text>The time period for purposes of clause (i) shall be 1 year

				from the later of the date of enactment of this paragraph or the date of

				issuance of a loan described in clause (i), but may be extended to 2 years from

				such date, at the discretion of the Administrator.</text>

							</clause><clause id="ID6CC0F814417C4167BF0F14B5408E2D4B"><enum>(iii)</enum><header>Resumption of

				payments</header><text>At the end of the time period described in clause (ii),

				the payment of periodic installments of principal and interest shall be

				required with respect to such loan, in the same manner and subject to the same

				terms and conditions as would otherwise be applicable to any other loan made

				under this subsection.</text>

							</clause></subparagraph><subparagraph id="ID2113C6C6206946DE9B049629626295F4"><enum>(E)</enum><header>Refinancing

				disaster loans after Hurricane Katrina and Hurricane Rita</header>

							<clause id="ID6FBAE88D67184039A2DE2232EE6048E7"><enum>(i)</enum><header>In

				general</header><text>Any loan made under this subsection that was outstanding

				as to principal or interest on August 24, 2005, may be refinanced by a small

				business concern that is located in a Disaster Area, and the refinanced amount

				shall be considered to be part of the new loan for purposes of this

				subparagraph.</text>

							</clause><clause id="ID11700B74BFD8420BBF4FA1500C19AD52"><enum>(ii)</enum><header>No effect on

				eligibility</header><text>A refinancing under clause (i) by a small business

				concern shall be in addition to any other loan eligibility for that small

				business concern under this Act.</text>

							</clause></subparagraph><subparagraph id="ID8A9D7BD8C4E14CC886827FF84244448F"><enum>(F)</enum><header>Refinancing

				business debt</header>

							<clause id="ID277B6FEA40EA4515ACDE7FD4A71EBB8F"><enum>(i)</enum><header>In

				general</header><text>Any business debt of a small business concern that was

				outstanding as to principal or interest on August 24, 2005, may be refinanced

				by the small business concern if it is, or was on that date, located in a

				Disaster Area. With respect to a refinancing under this clause, payments of

				principal shall be deferred, and interest may accrue, during the 1-year period

				following the date of refinancing, and the refinanced amount shall be

				considered to be part of a new loan for purposes of this subparagraph.</text>

							</clause><clause id="ID508E43B3CD8A44B1BCB1B4063BED9A9D"><enum>(ii)</enum><header>Resumption of

				payments</header><text>At the end of the 1-year period described in clause (i),

				the payment of periodic installments of principal and interest shall be

				required with respect to such loan, in the same manner and subject to the same

				terms and conditions as would otherwise be applicable to any other loan made

				under this subsection.</text>

							</clause></subparagraph><subparagraph id="IDCCF390A96D8F4DC7892E68C3868C8510"><enum>(G)</enum><header>Terms</header><text>A

				loan under subparagraph (E) or (F) shall be made at the same interest rate as

				economic injury loans under paragraph (2).</text>

						</subparagraph><subparagraph id="ID0F3AD5EA72114E10856D204652DD1FD6"><enum>(H)</enum><header>Extended

				application period</header><text>Notwithstanding any other provision of law,

				the Administrator shall accept applications for assistance under this

				subsection as a result of Hurricane Katrina or Rita until 1 year after the date

				on which the President designated the area as a disaster area as a result of

				Hurricane Katrina or Hurricane Rita, as the case may be.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC51F3B3CED654BF28F8299A81DAB59DD"><enum>(I)</enum><header>No

				sale</header><text>No loan under this subsection made as a result of Hurricane

				Katrina or Hurricane Rita may be

				sold.</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="id37676DC3B52349F0933ABACBCDB1794A"><enum>(b)</enum><header>Nationwide

			 disaster loans</header><text display-inline="yes-display-inline">Section 7(b)

			 of the <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C.

			 636(b)), as amended by this Act, is amended by inserting immediately after

			 paragraph (4) the following:</text>

				<quoted-block display-inline="no-display-inline" id="idD3D99FBAA92642F9BA345C57A80A0D9D" style="OLC">

					<paragraph id="idB7ED1114D8224CE48651BE5E7277B3BC"><enum>(5)</enum><header>Nationwide

				loans after Hurricane Katrina and Hurricane Rita</header><text display-inline="yes-display-inline">In addition to any other loan authorized by

				this subsection, the Administrator may make such loans under this subsection

				(either directly or in cooperation with banks or other lending institutions

				through agreements to participate on an immediate or deferred basis) as the

				Administrator determines appropriate to a small business concern, small

				agricultural cooperative, small nursery, or small producer cooperative located

				anywhere in the United States that demonstrates a direct adverse economic

				impact caused by Hurricane Katrina or Hurricane Rita, based on such criteria as

				the Administrator may set by rule, regulation, or

				order.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="id8573E61AB4864CCD83FB0D12CF096B29"><enum>(c)</enum><header>Disaster

			 mitigation</header>

				<paragraph id="id11363B1C67884570A96766FC0C4DB7CA"><enum>(1)</enum><header>In

			 general</header><text>Section 7(b)(1)(A) of the Small Business Act (15 U.S.C.

			 636(b)(1)(A)) is amended by inserting <quote>of the aggregate costs of such

			 damage or destruction (whether or not compensated for by insurance or

			 otherwise)</quote> after <quote>20 per centum</quote>.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H59C787AD633F40BE8058A209DD53FDF6"><enum>(2)</enum><header>Effective

			 date</header><text>The amendment made by paragraph (1) shall apply with respect

			 to a loan or guarantee made after the date of enactment of this Act.</text>

				</paragraph></subsection><subsection id="H6A7E53BF8A32481E844036EDDC654857"><enum>(d)</enum><header>Technical

			 amendments</header><text>Section 7(b) of the Small Business Act (15 U.S.C.

			 636(b)) is amended—</text>

				<paragraph id="HD1D1198ADAED49BDB46B74F3C55EF0D3"><enum>(1)</enum><text>in the matter

			 preceding paragraph (1), by striking <quote>the, Administration</quote> and

			 inserting <quote>the Administration</quote>;</text>

				</paragraph><paragraph id="H6A65EA8A60824B68B18658BEE8C8AA26"><enum>(2)</enum><text>in paragraph

			 (2)(A), by striking <quote>Disaster Relief and Emergency Assistance Act</quote>

			 and inserting <quote>Robert T. Stafford Disaster Relief and Emergency

			 Assistance Act (42 U.S.C. 5121 et seq.)</quote>; and</text>

				</paragraph><paragraph id="ID50A58EAF5E794CF88C363DE72F45A06C"><enum>(3)</enum><text>in the

			 undesignated matter at the end—</text>

					<subparagraph id="IDBAE0B761FB7B4544A020D4FB5A57FEA1"><enum>(A)</enum><text>by striking

			 <quote>, (2), and (4)</quote> and inserting <quote>and (2)</quote>; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE8A2E2BF95A64CF8831929315D731D7A"><enum>(B)</enum><text>by striking

			 <quote>, (2), or (4)</quote> and inserting <quote>(2)</quote>.</text>

					</subparagraph></paragraph></subsection><subsection id="idFB222264E3904F4CB847B571CC11371B"><enum>(e)</enum><header>Disaster loan

			 additional amounts</header><text>In addition to any other amounts otherwise

			 appropriated for such purpose, there is authorized to be appropriated to the

			 Administration $86,000,000, to make loans under section 7(b) of the Small

			 Business Act.</text>

			</subsection></section><section id="idF8468EE6391A4E9DBDC21ABAC98082DA"><enum>4.</enum><header>Energy emergency

			 relief</header>

			<subsection id="ID635C88AAE094443F93EB665DE04D6B8B"><enum>(a)</enum><header>Small business

			 and farm energy emergency disaster loan program</header>

				<paragraph id="ID7BC7202F932242D99F5891FE12928538"><enum>(1)</enum><header>Small business

			 disaster loan authority</header><text>Section 7(b) of the

			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C. 636(b))

			 is amended by inserting immediately after paragraph (5), as added by this Act,

			 the following:</text>

					<quoted-block act-name="Small Business Act" id="ID77B318DDC4F54C0B8EF894988E8A262B">

						<paragraph id="ID100EE5BB259343D6B42DF74A98F5831B"><enum>(6)</enum><header>Energy

				emergency relief</header>

							<subparagraph id="id7F08EAB841EA423D8B43A049802AF19D"><enum>(A)</enum><header>Definitions</header><text>For

				purposes of this paragraph—</text>

								<clause id="IDAA477015498045659E18803B8A2685E7"><enum>(i)</enum><text>the term

				<term>base price index</term> means the moving average of the closing unit

				price on the New York Mercantile Exchange for heating oil, natural gas,

				gasoline, or propane for the 10 days, in each of the most recent 2 preceding

				years, which correspond to the trading days described in clause (ii);</text>

								</clause><clause id="IDF24F998DBEC24F1BBB231753A11BDA8D"><enum>(ii)</enum><text>the term

				<term>current price index</term> means the moving average of the closing unit

				price on the New York Mercantile Exchange, for the 10 most recent trading days,

				for contracts to purchase heating oil, natural gas, gasoline, or propane during

				the subsequent calendar month, commonly known as the <quote>front

				month</quote>;</text>

								</clause><clause id="IDA9A166433D0D42268F00C5488DBB2B44"><enum>(iii)</enum><text>the term

				<term>significant increase</term> means—</text>

									<subclause id="ID837805F44427440C91DE08A928018DD5"><enum>(I)</enum><text>with respect to

				the price of heating oil, natural gas, gasoline, or propane, any time the

				current price index exceeds the base price index by not less than 40 percent;

				and</text>

									</subclause><subclause id="IDB497804BB0C941088C61FF8BB622247B"><enum>(II)</enum><text>with respect to

				the price of kerosene, any increase which the Administrator, in consultation

				with the Secretary of Energy, determines to be significant; and</text>

									</subclause></clause><clause id="id6699F994F3F1410596E6592DDB421136"><enum>(iv)</enum><text>a small business

				concern engaged in the heating oil business is eligible for a loan, if the

				small business concern sells not more than 10,000,000 gallons of heating oil

				per year.</text>

								</clause></subparagraph><subparagraph id="ID378D1835686F4C35AF091555C24244F0"><enum>(B)</enum><header>Loan

				authority</header><text>The Administration may make such loans, either directly

				or in cooperation with banks or other lending institutions through agreements

				to participate on an immediate or deferred basis, to assist a small business

				concern that has suffered or that is likely to suffer substantial economic

				injury on or after August 24, 2005, as the result of a significant increase in

				the price of heating oil, natural gas, gasoline, propane, or kerosene occurring

				on or after August 24, 2005.</text>

							</subparagraph><subparagraph id="ID932873A471874EC5A7693797C868CB10"><enum>(C)</enum><header>Applicable

				interest rate</header><text>Any loan or guarantee extended pursuant to this

				paragraph shall be made at the same interest rate as economic injury loans

				under paragraph (2).</text>

							</subparagraph><subparagraph id="IDEA1EE9C862C64F3BBAEED0817B9F9CF5"><enum>(D)</enum><header>Loan

				limitation</header><text>No loan may be made under this paragraph, either

				directly or in cooperation with banks or other lending institutions through

				agreements to participate on an immediate or deferred basis, if the total

				amount outstanding and committed to the borrower under this subsection would

				exceed $1,500,000, unless such borrower constitutes a major source of

				employment in its surrounding area, as determined by the Administrator, in

				which case the Administrator, in its discretion, may waive the $1,500,000

				limitation.</text>

							</subparagraph><subparagraph id="ID2B91743A98024B82B99769E6BABD7AFE"><enum>(E)</enum><header>Loan

				criteria</header><text>For purposes of assistance under this paragraph—</text>

								<clause id="ID6FD229270F624FEAA499A535E9A84773"><enum>(i)</enum><text>a

				declaration of a disaster area based on conditions specified in this paragraph

				shall be required, and shall be made by the President or the Administrator;

				or</text>

								</clause><clause id="ID1E9A4B9D3AB8467BB10E64E1CD52DD4A"><enum>(ii)</enum><text>if no

				declaration has been made pursuant to clause (i), the Governor of a State in

				which a significant increase in the price of heating oil, natural gas,

				gasoline, propane, or kerosene has occurred may certify to the Administration

				that small business concerns have suffered economic injury as a result of such

				increase and are in need of financial assistance which is not otherwise

				available on reasonable terms in that State, and upon receipt of such

				certification, the Administration may make such loans as would have been

				available under this paragraph if a disaster declaration had been

				issued.</text>

								</clause></subparagraph><subparagraph id="ID39D61D89E0434DACBCC6E24D4EA5E756"><enum>(F)</enum><header>Permissible

				uses</header><text>Notwithstanding any other provision of law, loans made under

				this paragraph may be used by a small business concern described in

				subparagraph (B) to convert from the use of heating oil, natural gas, gasoline,

				propane, or kerosene to a renewable or alternative energy source, including

				agriculture and urban waste, geothermal energy, cogeneration, solar energy,

				wind energy, or fuel

				cells.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph id="ID3C2FB7B5460449AF91FCC5BCE18F0DBE"><enum>(2)</enum><header>Conforming

			 amendments</header><text>Section 3(k) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C. 632(k)) is

			 amended—</text>

					<subparagraph id="ID7B9DCE9916D847DB812639D3063D9562"><enum>(A)</enum><text>by inserting

			 <quote>, significant increase in the price of heating oil, natural gas,

			 gasoline, propane, or kerosene</quote> after <quote>civil disorders</quote>;

			 and</text>

					</subparagraph><subparagraph id="ID4C3456BEBBCE4526B51278BC8723DE8D"><enum>(B)</enum><text>by inserting

			 <quote>other</quote> before <quote>economic</quote>.</text>

					</subparagraph></paragraph><paragraph id="ID2E2ECB74636943BB90CD1A5FA63BCE9A"><enum>(3)</enum><header>Report</header><text>Not

			 later than 12 months after the date on which the Administrator issues

			 guidelines under subsection (c)(1), and annually thereafter, until the date

			 that is 12 months after the end of the effective period of section 7(b)(6) of

			 the Small Business Act, as added by this subsection, the Administrator shall

			 submit to the Committee on Small Business and Entrepreneurship of the Senate

			 and the Committee on Small Business of the House of Representatives, a report

			 on the effectiveness of the assistance made available under section 7(b)(6) of

			 the <act-name parsable-cite="SBA">Small Business Act</act-name>, as added by

			 this subsection, including—</text>

					<subparagraph id="ID23A0082E29EB4673B4CDF9D3874698B2"><enum>(A)</enum><text>the number of

			 small business concerns that applied for a loan under that section 7(b)(6) and

			 the number of those that received such loans;</text>

					</subparagraph><subparagraph id="ID48A254DC5559491497302634C1A6F2C3"><enum>(B)</enum><text>the dollar value

			 of those loans;</text>

					</subparagraph><subparagraph id="ID3704278484F64866863F302E7DC0B91D"><enum>(C)</enum><text>the States in

			 which the small business concerns that received such loans are located;</text>

					</subparagraph><subparagraph id="IDE3FAB17986FA4816A79CB21A29C3AD65"><enum>(D)</enum><text>the type of

			 energy that caused the significant increase in the cost for the participating

			 small business concerns; and</text>

					</subparagraph><subparagraph id="IDABE85899B0244A8CB8388FE193B797CC"><enum>(E)</enum><text>recommendations

			 for ways to improve the assistance provided under that section 7(b)(6), if

			 any.</text>

					</subparagraph></paragraph><paragraph id="ID2209B7AF2525468BA206C88860C92E67"><enum>(4)</enum><header>Effective

			 date</header><text>The amendments made by this subsection shall apply during

			 the 4-year period beginning on the earlier of the date on which guidelines are

			 published by the Administrator under subsection (c)(1), or 30 days after the

			 date of enactment of this Act, with respect to assistance under section 7(b)(6)

			 of the <act-name parsable-cite="SBA">Small Business Act</act-name>, as added by

			 this subsection.</text>

				</paragraph></subsection><subsection id="ID95497B9781F3433CA861B706650115B7"><enum>(b)</enum><header>Farm energy

			 emergency relief</header>

				<paragraph id="ID28D727ED9A8C436BB729BBA9A04AC136"><enum>(1)</enum><header>In

			 general</header><text>Section 321(a) of the <act-name parsable-cite="CFRDA">Consolidated Farm and Rural Development Act</act-name> (7

			 U.S.C. 1961(a)) is amended—</text>

					<subparagraph id="ID6DE28418321444F399C39CDC04FB6325"><enum>(A)</enum><text>in the first

			 sentence—</text>

						<clause id="IDD66B7CB0F42B452BB7FC6547019F4895"><enum>(i)</enum><text>by

			 striking <quote>operations have</quote> and inserting <quote>operations (i)

			 have</quote>; and</text>

						</clause><clause id="IDC4D3328C0F4745BEA8F4B637A3C08F0E"><enum>(ii)</enum><text>by

			 inserting before <quote>: <added-phrase>Provided,</added-phrase></quote> the

			 following: <quote>, or (ii)(I) are owned or operated by such an applicant that

			 is also a small business concern (as defined in section 3 of the

			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C. 632)),

			 and (II) have suffered or are likely to suffer substantial economic injury on

			 or after August 24, 2005, as the result of a significant increase in energy

			 costs or input costs from energy sources occurring on or after August 24, 2005,

			 in connection with an energy emergency declared by the President or the

			 Secretary</quote>;</text>

						</clause></subparagraph><subparagraph id="IDA137E7ACE04A42D0AD1E2EF9C172B9FC"><enum>(B)</enum><text>in the third

			 sentence, by inserting before the period at the end the following: <quote>or by

			 an energy emergency declared by the President or the Secretary</quote>;

			 and</text>

					</subparagraph><subparagraph id="ID12A99CA9BD934D00A3156DDE6F5846DC"><enum>(C)</enum><text>in the fourth

			 sentence—</text>

						<clause id="ID8B4CBEEA147F4C7F8B92D7F3439DBAE9"><enum>(i)</enum><text>by

			 inserting <quote>or energy emergency</quote> after <quote>natural

			 disaster</quote> each place that term appears; and</text>

						</clause><clause id="ID76A7BE6919AF41D398B9DDE1A6D630B9"><enum>(ii)</enum><text>by

			 inserting <quote>or declaration</quote> after <quote>emergency

			 designation</quote>.</text>

						</clause></subparagraph></paragraph><paragraph id="idC9EF204B3D65443997872BCC4A71044A"><enum>(2)</enum><header>Funding</header><text>Funds

			 available on the date of enactment of this Act for emergency loans under

			 subtitle C of the <act-name parsable-cite="CFRDA">Consolidated Farm and Rural

			 Development Act</act-name> (7 U.S.C. 1961 et seq.) shall be available to carry

			 out the amendments made by paragraph (1) to meet the needs resulting from

			 natural disasters.</text>

				</paragraph><paragraph id="IDC33011523AAA41EF9E8598D62D890D5E"><enum>(3)</enum><header>Report</header><text>Not

			 later than 12 months after the date on which the Secretary of Agriculture

			 issues guidelines under subsection (c)(1), and annually thereafter, the

			 Secretary shall submit to the Committee on Small Business and Entrepreneurship

			 and the Committee on Agriculture, Nutrition, and Forestry of the Senate and to

			 the Committee on Small Business and the Committee on Agriculture of the House

			 of Representatives, a report that—</text>

					<subparagraph id="ID326B9735CE604B7EA1615040C5A80A0F"><enum>(A)</enum><text>describes the

			 effectiveness of the assistance made available under section 321(a) of the

			 <act-name parsable-cite="CFRDA">Consolidated Farm and Rural Development

			 Act</act-name> (7 U.S.C. 1961(a)), as amended by this section; and</text>

					</subparagraph><subparagraph id="ID2D416DAFE78142569A9CE0161D56CB23"><enum>(B)</enum><text>contains

			 recommendations for ways to improve the assistance provided under such section

			 321(a).</text>

					</subparagraph></paragraph><paragraph id="IDA1573267F310401E91565556AA445D22"><enum>(4)</enum><header>Effective

			 date</header><text>The amendments made by this subsection shall apply during

			 the 4-year period beginning on the earlier of the date on which guidelines are

			 published by the Secretary of Agriculture under subsection (c)(1), or 30 days

			 after the date of enactment of this Act, with respect to assistance under

			 section 321(a) of the <act-name parsable-cite="CFRDA">Consolidated Farm and

			 Rural Development Act</act-name> (7 U.S.C. 1961(a)), as amended by this

			 subsection.</text>

				</paragraph></subsection><subsection id="IDBA04E3BFC62A4945BDE40DB70C499CE9"><enum>(c)</enum><header>Guidelines and

			 rulemaking</header>

				<paragraph id="ID4723AD33BE604A9EA7644CCD77C86837"><enum>(1)</enum><header>Guidelines</header><text>Not

			 later than 30 days after the date of enactment of this Act, the Administrator

			 and the Secretary of Agriculture shall each issue guidelines to carry out

			 subsections (a) and (b), respectively, and the amendments made thereby, which

			 guidelines shall become effective on the date of their issuance.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0A104CF451324F47B5070A3E015372BA"><enum>(2)</enum><header>Rulemaking</header><text>Not

			 later than 30 days after the date of enactment of this Act, the Administrator,

			 after consultation with the Secretary of Energy, shall promulgate regulations

			 specifying the method for determining a significant increase in the price of

			 kerosene under section 7(b)(6)(A)(iii)(II) of the <act-name parsable-cite="SBA">Small Business Act</act-name>, as added by this Act.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF21B21F8D9324115AEF3360C3E1EE071"><enum>5.</enum><header>Supplemental

			 emergency loans</header>

			<subsection commented="no" display-inline="no-display-inline" id="id6018988EBE214930A9A0DAC71DF0299C"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 7(a) of the

			 Small Business Act (15 U.S.C. 636(a)) is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="idADAF47AABF0E48CE91FA4DDB3AC1DDB0" style="OLC">

					<paragraph id="idEC99E3BCE7C84265BCC3D343312F86C8"><enum>(32)</enum><header>Supplemental

				emergency loans after hurricane katrina and hurricane rita</header>

						<subparagraph id="id108DF5CF6CB04292B2AC20ACB7A84CBB"><enum>(A)</enum><header>Loan

				authority</header><text>In addition to any other loan authorized by this

				subsection, the Administrator shall make such loans under this subsection

				(either directly or in cooperation with banks or other lending institutions

				through agreements to participate on an immediate or deferred basis) as the

				Administrator determines appropriate to a small business concern, located

				anywhere in the United States, that is directly adversely affected by Hurricane

				Katrina or Hurricane Rita, based on such criteria as the Administrator may set

				by rule, regulation, or order, subject to subparagraph (B).</text>

						</subparagraph><subparagraph id="id0E8C453938024CD2A113659AB1D75C4A"><enum>(B)</enum><header>Oversight

				protections</header><text>In making any loan under subparagraph (A)—</text>

							<clause id="id951FBE3E4AC74FA9B59C934A085CDACC"><enum>(i)</enum><text>the borrower

				shall be made aware that such loans are for those directly adversely affected

				by Hurricane Katrina or Hurricane Rita, as the case may be; and</text>

							</clause><clause id="id8B26D6E621214E02A1A07029301E69F3"><enum>(ii)</enum><text>if such loans

				are made in cooperation with a bank or other lending institution—</text>

								<subclause id="idE3FF107C31CD46149FBB7886D44F833D"><enum>(I)</enum><text>lenders shall

				document for the Administrator how the borrower was directly adversely affected

				by Hurricane Katrina or Hurricane Rita;</text>

								</subclause><subclause id="id2DD86BD269B64CF2B3A74C1367235752"><enum>(II)</enum><text>not later than 6

				months after the date of enactment of this paragraph, and every 6 months

				thereafter until the date that is 18 months after the date of enactment of this

				paragraph, the Inspector General of the Administration shall make a report

				regarding such loans to the Committee on Small Business and Entrepreneurship of

				the Senate and the Committee on Small Business of the House of Representatives,

				including verification that the program is being administered appropriately and

				that such loans are being used for purposes authorized by this paragraph;

				and</text>

								</subclause><subclause id="IDd426b1b0bbab4f039d4682fca12b35b7"><enum>(III)</enum><text>not later than

				12 months after the date on which the final report submitted by the Inspector

				General under subclause (II), the Comptroller General of the United States

				shall conduct a review of the administration of the supplemental emergency loan

				program authorized under this paragraph and submit a report to the Committee on

				Small Business and Entrepreneurship of the Senate and the Committee on Small

				Business of the House of Representatives containing the findings of the review

				and any recommendations.</text>

								</subclause></clause></subparagraph><subparagraph id="id1E8EBA2306234BB7868EF9E5EADC70F6"><enum>(C)</enum><header>Fees</header>

							<clause id="id8B496D7E94B245A0B16D8000649E54DA"><enum>(i)</enum><header>In

				general</header><text>Notwithstanding any other provision of law, the

				Administrator shall, in lieu of the fee established under paragraph (23)(A),

				collect an annual fee of 0.25 percent of the outstanding balance of deferred

				participation loans made under this subsection to a small business concern,

				located anywhere in the United States, directly adversely affected by Hurricane

				Katrina or Hurricane Rita for a period of 1 year after the date of enactment of

				this paragraph.</text>

							</clause><clause id="id037E395984A348D695CD7D41B3E4211B"><enum>(ii)</enum><header>Guarantee

				fees</header><text>Notwithstanding any other provision of law, the guarantee

				fee under paragraph (18)(A) for a period of 1 year after the date of enactment

				of this subparagraph shall be as follows:</text>

								<subclause id="ID68952fd0d0204775bb746a7dc5e0d998"><enum>(I)</enum><text>A guarantee fee

				equal to 1 percent of the deferred participation share of a total loan amount

				that is not more than $150,000.</text>

								</subclause><subclause id="ID14e52736b2a34d3d89871bd3c0eefa87"><enum>(II)</enum><text>A guarantee fee

				equal to 2.5 percent of the deferred participation share of a total loan amount

				that is more than $150,000, but not more than $700,000.</text>

								</subclause><subclause id="ID9aed8c6278464a5c8d71f1fa4e3ff53a"><enum>(III)</enum><text>A guarantee fee

				equal to 3.5 percent of the deferred participation share of a total loan amount

				that is more than

				$700,000.</text>

								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8E88E0697D354B0BB3324513E6E4ACEE"><enum>(b)</enum><header>Authorization

			 of appropriations</header><text>There is authorized to be appropriated

			 $75,000,000 to carry out section 7(a)(32) of the Small Business Act, as added

			 by this section.</text>

			</subsection></section><section id="id8B726CF61EA24EC39702875A495E7F86"><enum>6.</enum><header>Development

			 company debentures</header>

			<subsection id="id6491FF29DD534A708F13B515689F924E"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 503 of the Small Business

			 Investment Act of 1958 (15 U.S.C. 697) is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="id3D77E324E5B74973BD7C433799FEF72B" style="OLC">

					<subsection id="id352EB28015BA4BB7BF848FC4751DF306"><enum>(j)</enum><header>Debentures

				after hurricane katrina and hurricane rita</header>

						<paragraph id="idFF59441C598F4953BDD98412E2687149"><enum>(1)</enum><header>Authority</header>

							<subparagraph id="id23685862CC26405F8FDD4483295D4A20"><enum>(A)</enum><header>In

				general</header><text>In addition to any other guarantee authorized by this

				section, the Administrator may guarantee the timely payment of all principal

				and interest as scheduled on any debenture issued to a qualified

				borrower.</text>

							</subparagraph><subparagraph id="idE1EB735D595547EC86C09A17D5A4AABE"><enum>(B)</enum><header>Terms</header><text>The

				Administrator shall establish a fee for a guarantee issued under subparagraph

				(A) that is lower than that for other guarantees under this section.</text>

							</subparagraph></paragraph><paragraph id="id803F2B56D34F480887E28824BD88BDB1"><enum>(2)</enum><header>Existing

				guarantees</header>

							<subparagraph id="idA2D4AA34AA1A4EDCA6E0BE4EBDAB1191"><enum>(A)</enum><header>In

				general</header><text>Notwithstanding any other provision of law, the

				Administrator may temporarily defer payments of principal and interest on a

				guarantee made under this section before the date of enactment of this

				subsection to a qualified borrower located in a Disaster Area, in any case in

				which the payments are owed to the Administration.</text>

							</subparagraph><subparagraph id="idA0920C30BD2A47EEA210888709EE0237"><enum>(B)</enum><header>Payments to

				other parties</header><text>Notwithstanding any other provision of law, the

				Administrator may temporarily make payments of principal and interest on a loan

				made under this section before the date of enactment of this subsection to a

				qualified borrower located in a Disaster Area, in any case in which the

				payments are owed to a person other than the Administration.</text>

							</subparagraph><subparagraph id="id4564F970B8944DF2B5A7D5B3358C7E7D"><enum>(C)</enum><header>Termination of

				authority</header><text>The authority to defer, or make, payments under this

				paragraph shall terminate 1 year after the date of enactment of this

				subsection.</text>

							</subparagraph></paragraph><paragraph id="id86FE6ACE417C4184AB5E0B80F779FE31"><enum>(3)</enum><header>Definitions</header><text>In

				this subsection, the following definitions shall apply:</text>

							<subparagraph id="id385D58B2DD874BD2AF7E465C81A4258C"><enum>(A)</enum><header>Disaster

				Area</header><text>The term <term>Disaster Area</term> means an area which the

				President has designated as a disaster area as a result of Hurricane Katrina of

				August 2005 or Hurricane Rita of September 2005.</text>

							</subparagraph><subparagraph id="id122948B14D3C4AC9AC8444F2B3A81192"><enum>(B)</enum><header>Qualified

				Borrower</header><text>The term <term>qualified borrower</term> means a small

				business concern located anywhere in the United States that has been directly

				adversely affected by Hurricane Katrina or Hurricane Rita, based on such

				criteria as the Administrator may set by rule, regulation, or

				order.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="id35E5FFAE085943F9B294A1584818EBEB"><enum>(b)</enum><header>Authorization

			 of appropriations</header><text>There is authorized to be appropriated

			 $75,000,000 to carry out section 503(j) of the Small Business Investment Act of

			 1958, as added by this section.</text>

			</subsection></section><section id="idC08107F684AC4B52AD6CC5EA71553C15"><enum>7.</enum><header>Small business

			 emergency relief</header>

			<subsection id="idF23558F97B624DC5BCAFC6C8833DF352"><enum>(a)</enum><header>Business loan

			 programs</header><text>Section 20(e)(1)(B) of the Small Business Act (15 U.S.C.

			 631 note) is amended—</text>

				<paragraph id="id77F54B0ADA8842CA9B07B4645E5BFD25"><enum>(1)</enum><text>in the matter

			 preceding clause (i), by striking <quote>$25,050,000,000</quote> and inserting

			 <quote>$40,050,000,000</quote>;</text>

				</paragraph><paragraph id="id862FE2E4101840A889BF5D05B72CBEC5"><enum>(2)</enum><text>in clause (i), by

			 striking <quote>$17,000,000,000</quote> and inserting

			 <quote>$27,000,000,000</quote>; and</text>

				</paragraph><paragraph id="id7BB0F68363E14251A118953786117083"><enum>(3)</enum><text>in clause (ii),

			 by striking <quote>$7,500,000,000</quote> and inserting

			 <quote>$12,500,000,000</quote>.</text>

				</paragraph></subsection><subsection id="id99F2DD7E442F4F92A0C80D4503FC3B70"><enum>(b)</enum><header>Grants to

			 states damaged by hurricane katrina or hurricane rita</header>

				<paragraph id="id1704FA4B6EE74937A10B9FDC2E0E4E0D"><enum>(1)</enum><header>In

			 general</header><text>There is authorized to be appropriated to the Secretary

			 of Commerce $450,000,000 for the Economic Development Administration of the

			 Department of Commerce to make grants to the appropriate State government

			 agencies in Louisiana, Alabama, Mississippi, Texas, and Florida, to carry out

			 this subsection.</text>

				</paragraph><paragraph id="id9BE8BA15534940A0AC7EEDD17CEA2ECB"><enum>(2)</enum><header>Disbursement of

			 funds</header><text>The Department of Commerce shall disburse the funds

			 authorized under paragraph (1) in the most expeditious manner possible to the

			 designated States, based on—</text>

					<subparagraph id="IDae5d744979a84eac9f6505f76b551a33"><enum>(A)</enum><text>the number of

			 businesses directly damaged or disrupted by Hurricane Katrina or Hurricane Rita

			 in the State;</text>

					</subparagraph><subparagraph id="ID12be6023250d49d1a7d636b3624ac6b5"><enum>(B)</enum><text>the number of

			 residents displaced from the State by Hurricane Katrina or Hurricane

			 Rita;</text>

					</subparagraph><subparagraph id="ID1173ee4405f04279b9f1e98aca6c1e62"><enum>(C)</enum><text>the number of

			 jobs lost or disrupted by Hurricane Katrina or Hurricane Rita in the

			 State;</text>

					</subparagraph><subparagraph id="ID22987212c963466f871fa6d62e142bff"><enum>(D)</enum><text>the extent of

			 economic disruption by Hurricane Katrina or Hurricane Rita in the State;

			 and</text>

					</subparagraph><subparagraph id="idA807D5456FCE4059A0D5C8F93822570A"><enum>(E)</enum><text>the number of

			 evacuees from any other State due to Hurricane Katrina or Hurricane Rita to

			 whom the designated State is providing assistance.</text>

					</subparagraph></paragraph><paragraph id="idE7A75E9023A44EDC9A0E0D6AC91D5221"><enum>(3)</enum><header>Use of

			 funds</header>

					<subparagraph id="idF5BFC99E2227486CA11EBDF0226F0D8F"><enum>(A)</enum><header>In

			 general</header><text>Grants awarded to a State under paragraph (1) shall be

			 used by the State to provide bridge grants and loans, which may be made to any

			 person located in a Disaster Area who was directly adversely affected by

			 Hurricane Katrina or Hurricane Rita, to assist such person in covering costs

			 until the person is able to obtain loans through Administration assistance

			 programs or other sources.</text>

					</subparagraph><subparagraph id="id1E5DAC3571354633B0A25FB2D0C0EA36"><enum>(B)</enum><header>Reimbursement</header><text>A

			 State may use a grant awarded under paragraph (1) as reimbursement for any

			 State funds used to provide bridge grants or loans to any person located in a

			 Disaster Area who was directly adversely affected by Hurricane Katrina or

			 Hurricane Rita before the date on which the funds authorized under paragraph

			 (1) are disbursed.</text>

					</subparagraph><subparagraph id="idB740F06B7AE340C3B4421628F1225A08"><enum>(C)</enum><header>Criteria</header><text>Notwithstanding

			 any other provision of law, in making bridge grants and loans under

			 subparagraph (A), the State may use such criteria as the State determines

			 appropriate, and shall not be required to apply eligibility criteria for

			 programs administered by the Department of Commerce.</text>

					</subparagraph><subparagraph id="id7E60F2492AA146698987D0B0A6E9DEEF"><enum>(D)</enum><header>Terms</header><text>For

			 any loan made by a State under subparagraph (A)—</text>

						<clause id="id505842B664A943D29DCE84D953C47665"><enum>(i)</enum><text>such a loan may

			 initially be a noncollateralized, low-interest loan;</text>

						</clause><clause id="idD1C0ABE459F942578DEF6E9BE4C94101"><enum>(ii)</enum><text>payments and

			 interest on such a loan may be deferred for at least 1 year after the date on

			 which the loan is made;</text>

						</clause><clause id="id8833D328E47843FF9AFD71F06A668E6B"><enum>(iii)</enum><text>the balance

			 remaining on such a loan 5 years after the date on which the loan is made may

			 be forgiven entirely by the State, if the borrower has continued to operate

			 during that 5-year period in a Disaster Area; and</text>

						</clause><clause id="idD16C183A9B934D499491AE39AF4788BE"><enum>(iv)</enum><text>such a loan may

			 be forgiven by the State, under such terms as it may set, if the borrower

			 cannot repay such loan.</text>

						</clause></subparagraph><subparagraph id="id575DF8E0395A4922A4ACAA013BAACFA9"><enum>(E)</enum><header>Administrative

			 expenses</header><text>The Department of Commerce may use not more than

			 $1,000,000 of the funds authorized under paragraph (1) to administer the

			 provision of grants to the designated States under this subsection.</text>

					</subparagraph></paragraph></subsection></section><section id="idC78347B0B52E4768A2172CAA95305363"><enum>8.</enum><header>Business

			 counseling</header><text display-inline="no-display-inline">In addition to any

			 other amounts authorized for any fiscal year, there are authorized to be

			 appropriated to the Administration, to remain available until expended, for

			 fiscal year 2006—</text>

			<paragraph id="idE11D9C26DF5B486DB86F6A7212C6AE32"><enum>(1)</enum><text>$21,000,000, to

			 be used for activities of small business development centers pursuant to

			 section 21 of the Small Business Act, not less than $15,000,000 of which shall

			 be non-matching funds and used to aid and assist small business concerns

			 affected by Hurricane Katrina or Hurricane Rita;</text>

			</paragraph><paragraph id="IDf158c63df6b34c1c85dba81c4b913f8b"><enum>(2)</enum><text>$2,000,000, to be

			 used for the SCORE program authorized by section 8(b)(1) of the Small Business

			 Act, for the activities described in section 8(b)(1)(B)(ii) of that Act, not

			 less than $1,000,000 of which shall be used to aid and assist small business

			 concerns affected by Hurricane Katrina or Hurricane Rita;</text>

			</paragraph><paragraph id="ID26d83bba244f4430813e40acc5556d53"><enum>(3)</enum><text>$4,500,000, to be

			 used for activities of women's business centers authorized by section 29(b) of

			 the Small Business Act and for recipients of a grant under section 29(l) of

			 that Act, not less than $2,500,000 of which shall be non-matching funds used to

			 aid and assist small business concerns affected by Hurricane Katrina or

			 Hurricane Rita, which may also be made available to a women's business center

			 whose 5-year project ended in fiscal year 2004;</text>

			</paragraph><paragraph id="ID525cc71d59f44269b650319cbf996cad"><enum>(4)</enum><text>$1,250,000, to be

			 used for activities of the office of veteran's business development pursuant to

			 section 32 of the Small Business Act, not less than $750,000 of which shall be

			 used to aid and assist small business concerns affected by Hurricane Katrina or

			 Hurricane Rita; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBE5A2E7504FE46E185430491C582D1A4"><enum>(5)</enum><text>$5,000,000, to be

			 used for activities of the microloan program authorized by clauses (ii) and

			 (iii) of section 7(m)(1)(G) of the Small Business Act to aid and assist small

			 business concerns adversely affected by Hurricane Katrina or Hurricane

			 Rita.</text>

			</paragraph></section><section id="id278215DB2F5D49818D2345293876E834"><enum>9.</enum><header>Small business

			 development centers</header>

			<subsection id="idBA9A6DD9BA63483F96AEB92D3956A406"><enum>(a)</enum><header>Waiver of

			 maximum amount</header><text display-inline="yes-display-inline">Section

			 21(a)(4) of the Small Business Act (15 U.S.C. 648(a)(4)) is amended by adding

			 at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="idC0B4A41753914BB38044BBD3E57AED94" style="OLC">

					<subparagraph id="idDC1231BC27FD4757BFAC543E346ABA73" indent="up1"><enum>(D)</enum><header>Fiscal years 2005 and

				2006</header><text>For fiscal years 2005 and 2006, the Administrator has the

				authority to waive the maximum amount of $100,000 for grants under subparagraph

				(C)(viii), and such grants shall be made available for small business

				development centers assisting small business concerns adversely affected by

				Hurricane Katrina or Hurricane

				Rita.</text>

					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID0c77fafbf7c64ecd98bfe0577ed7537c"><enum>(b)</enum><header>Assistance

			 after hurricane katrina and hurricane rita</header><text>Section 21(b) of the

			 Small Business Act (15 U.S.C. 648(b)) is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="id0D59B39D5AE142DCAA516085D9A28E8C" style="OLC">

					<paragraph id="IDc10325bfd23043d89e142125750eb36d" indent="up1"><enum>(4)</enum><header>Assistance after hurricane katrina

				and hurricane rita</header>

						<subparagraph id="id9C4DCC1C7ECD4524A6C4303357551912"><enum>(A)</enum><header>In general</header><text>The

				Administration shall authorize any small business development center,

				regardless of location, to provide advice, information, and assistance, as

				described in subsection (c), to a small business concern located in an area

				which the President has designated as a disaster area as a result of Hurricane

				Katrina of August 2005 or Hurricane Rita of September 2005.</text>

						</subparagraph><subparagraph id="id3A32FC41AE7C422EA56AD6B13D627327"><enum>(B)</enum><header>Continuity of

				services</header><text>A small business development center that provides

				counselors to an area described in subparagraph (A) shall, to the maximum

				extent practicable, ensure continuity of services in the State it currently

				serves.</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section id="idFF0439BCC8284A7FBA2B48A336E78D56"><enum>10.</enum><header>HUBZones</header><text display-inline="no-display-inline">Section 3(p)(1) of the Small Business Act

			 (15 U.S.C. 632(p)(1)) is amended—</text>

			<paragraph id="id3CC436E862C64F34ADEAC7093CC2BACD"><enum>(1)</enum><text>in subparagraph

			 (D), by striking <quote>or</quote>;</text>

			</paragraph><paragraph id="id50DAA7E4F78D4D918CC1D822F7F65388"><enum>(2)</enum><text>in subparagraph

			 (E), by striking the period at the end and inserting <quote>; or</quote>;

			 and</text>

			</paragraph><paragraph id="idBE72914AB26D4D94B179BF5F0033D9FD"><enum>(3)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id6A4CC788B6304C9B839B68EF760D660F" style="OLC">

					<subparagraph id="id0C6126AD044B4373A17272A92D8B9961"><enum>(F)</enum><text>an area which the

				President has designated as a disaster area as a result of Hurricane Katrina of

				August 2005 or Hurricane Rita of September

					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="idFCB4072737F54A7C935BB85874929E13"><enum>11.</enum><header>Outreach

			 programs</header>

			<subsection id="idFA9CBD969A184BBFAA3E1D27657F9E8C"><enum>(a)</enum><header>In

			 general</header><text>Not later than 90 days after the date of enactment of

			 this Act, the Administrator shall establish a contracting outreach and

			 technical assistance program for small business concerns which have had a

			 primary place of business in, or other significant presence in a Disaster Area

			 at any time following the 60 days prior to the designation of such area by the

			 Administrator.</text>

			</subsection><subsection id="id11D0E91FE6794143A70D0F0BF7542BEB"><enum>(b)</enum><header>Administrator

			 action</header><text>The Administrator may fulfill the requirement of

			 subsection (a) by acting through—</text>

				<paragraph id="idFD092EEEF1484A49A345EEF6BB63AEA5"><enum>(1)</enum><text>the

			 Administration;</text>

				</paragraph><paragraph id="IDcd095a3bf178418f9cbb1ad97ce0013a"><enum>(2)</enum><text>the Federal

			 agency small business officials designated under section 15(k)(1) of the Small

			 Business Act (15 U.S.C. 644(k)(1)); or</text>

				</paragraph><paragraph id="ID6f5e2ac971d64d2895073dc48eb79649"><enum>(3)</enum><text>any Federal,

			 State, or local government entity, higher education institution, or private

			 nonprofit organization that the Administrator may deem appropriate, upon

			 conclusion of a memorandum of understanding or assistance agreement, as

			 appropriate, with the Administrator.</text>

				</paragraph></subsection></section><section id="idD35BB932EFD84E42A1212A3372DB744B"><enum>12.</enum><header>Small business

			 bonding threshold</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,

			 for all procurements related to Hurricane Katrina or Hurricane Rita, the

			 Administrator may, upon such terms and conditions as it may prescribe,

			 guarantee and enter into commitments to guarantee any surety against loss

			 resulting from a breach of the terms of a bid bond, payment bond, performance

			 bond, or bonds ancillary thereto, by a principal on any total work order or

			 contract amount at the time of bond execution that does not exceed $5,000,000,

			 except that the Administrator may increase such amount to $10,000,000, at the

			 discretion of the Administrator.</text>

		</section><section id="idFD712DAE96F14FC785795E2EB7132933"><enum>13.</enum><header>Small business

			 participation</header><text display-inline="no-display-inline">In order to

			 facilitate the maximum practicable participation of small business concerns in

			 activities related to relief and recovery from Hurricane Katrina and Hurricane

			 Rita, the Administrator and the head of any Federal agency making procurements

			 related to the aftermath of Hurricane Katrina or Hurricane Rita, shall set a

			 goal, to be met within a reasonable time, of awarding to small business

			 concerns not less than 30 percent of amounts expended for prime contracts and

			 not less than 40 percent of amounts expended for subcontracts on procurements

			 by such agency related to the aftermath of Hurricane Katrina or Hurricane Rita,

			 respectively.</text>

		</section><section id="ID616ffb5765fd4a3d9def5ab402ce62d4"><enum>14.</enum><header>Micropurchases</header>

			<subsection id="id42199F05E2D34783BB835D340CDC000A"><enum>(a)</enum><header>In

			 general</header><text>Section 101 of the Second Emergency Supplemental

			 Appropriations Act to Meet Immediate Needs Arising From the Consequences of

			 Hurricane Katrina, 2005 (Public Law 109–62; 119 Stat. 1990) is repealed.</text>

			</subsection><subsection id="ID63ed38719a8f40eaaa4cd4f43f09b6f0"><enum>(b)</enum><header>Authority</header><text>The

			 authority provided in subsection 32A of the Office of Federal Procurement

			 Policy Act (41 U.S.C. 428a) may be used with respect to any procurement for

			 property or services determined by the head of an Executive agency to be

			 necessary for support of Hurricane Katrina or Hurricane Rita rescue and relief

			 operations.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDf704325dba50464490a0d58c74c906b2"><enum>(c)</enum><header>Expiration</header><text>The

			 authority provided by subsection (b) shall expire on the date that is 180 days

			 after the date of enactment of this Act.</text>

			</subsection></section><section id="id6C46FE3FA95E466F96E31CF9EA02885A"><enum>15.</enum><header>Loan

			 defaults</header><text display-inline="no-display-inline">Notwithstanding any

			 other provision of law, no loan made before August 24, 2005, under subsection

			 (a) or (m) of section 7 of the Small Business Act or title III or section 503

			 of the Small Business Investment Act of 1958 for which the borrower goes into

			 default because of Hurricane Katrina or Hurricane Rita shall be considered a

			 cost, as that term is defined in section 502 of the Federal Credit Reform Act

			 of 1990, to the Administration for purposes of calculating the subsidy rate for

			 loans under subsection (a) or (m) of section 7 of the Small Business Act or

			 title III or section 503 of the Small Business Investment Act of 1958,

			 respectively.</text>

		</section><section id="idF6B9DE107B4049428BEF28F402215FDB"><enum>16.</enum><header>Budgetary

			 treatment of loans and financings</header>

			<subsection id="id375311269D5C4A63B078D15F0C40FE18"><enum>(a)</enum><header>In

			 general</header><text>Assistance made available under any loan made or approved

			 by the Administration under this Act, subsections (a) or (b) of section 7 of

			 the Small Business Act (15 U.S.C. 636(a)), as amended by this Act, or

			 financings made under title V of the Small Business Investment Act of 1958 (15

			 U.S.C. 695 et seq.), as amended by this Act, on and after the date of enactment

			 of this Act, shall be treated as separate programs of the Administration for

			 purposes of the Federal Credit Reform Act of 1990 only.</text>

			</subsection><subsection id="ID9c5f3a36c29b45018024ad98f0c7a9bc"><enum>(b)</enum><header>Use of

			 funds</header><text>Assistance under this Act and the amendments made by this

			 Act shall be available only to the extent that funds are made available under

			 appropriations Acts, which funds shall be utilized to offset the cost (as such

			 term is defined in section 502 of the Federal Credit Reform Act of 1990) of

			 such assistance.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="idD0BFC726E99B497C8FE719F4A5CE2526"><enum>17.</enum><header>Emergency

			 procurement authority</header>

			<subsection id="ID17604058EAAF4FCD9E34464DFAF8D013"><enum>(a)</enum><header>Small Business

			 Reservation Offset</header><text>Section 15(j) of the

			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C. 644(j))

			 is amended by adding at the end the following:</text>

				<quoted-block act-name="Small Business Act" id="ID4CDA843F7F1B4D01B636A96186566454" style="OLC">

					<paragraph id="ID0D31D1DF60984CAA821DA1F366AE129D" indent="up1"><enum>(4)</enum><text>For any contracts involving the use

				of the special emergency procurement authority under section 32A(c) of the

				Office of Federal Procurement Policy Act (41 U.S.C. 428a(c)), the dollar

				ceiling of the small business reservation established in paragraph (1) shall be

				adjusted to match the applicable amount of the simplified acquisition

				threshold.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID55A4FBBA47E94630BA87E2A0388A5825"><enum>(b)</enum><header>Retention of

			 Small Business Subcontracting</header><text>Section 8(d)(4)(D) of the

			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C.

			 637(d)(4)(D)) is amended—</text>

				<paragraph id="ID6985E7CD9A1A4714A938A949A64F6093"><enum>(1)</enum><text>by striking

			 <quote>(D) No contract</quote> and inserting the following:</text>

					<quoted-block id="ID48673DDEDC6F42BAB9B3002E453A6387" style="OLC">

				contract which otherwise meets the requirements of this subsection, and which

				involves the use of special emergency procurement authority under section

				32A(c) of the Office of Federal Procurement Policy Act (41 U.S.C. 428a(c)), the

				subcontracting plan required under this subsection shall be negotiated as soon

				as is practicable, but not later than 30 days after the date on which the

				contract is awarded.</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID12BE1AD590EE448786836BB78D4E07B6"><enum>(II)</enum><header>Payment</header><text>Not greater than

				50 percent of the amounts due under any contract described in subclause (I) may

				be paid, unless a subcontracting plan compliant with this subsection is

				negotiated by the

				contractor.</text>
